Brian Doherty is best known as a drummer for groups like They Might Be Giants, RCA Recording artists, The Silos, XTC, Freedy Johnston, and Ben Folds In the early 90s, Brian was recruited by They Might Be Giants. For three years Brian and TMBG recorded albums, wrote songs, and relentlessly toured the world. In 2001, Brian went back to graduate school and became a New York City school teacher as part of the New York City Teaching Fellows program. As well as teaching, he remains professionally active as a drummer recording in the studio and performing on a variety of gigs that includes Broadway shows. On Broadway, Brian has performed in productions of RENT, Hairspray, The Times They Are A Changin', Waitress and Little Shop of Horrors. Bad Faith in Arkansas Requires Proof of Dishonest, Malicious, or Oppressive Conduct Including Hatred, Ill Will, a Spirit of Revenge Owners Insurance Company moved for summary judgment as to a claim of bad faith. Separately, Owners argued the Court should make a finding that there no evidence to support a punitive damages instruction. In RMS Warehouse 1315, LLC v. Owners Insurance Company, No. 5:22-CV-5114, United States District Court, W.D. Arkansas, Fayetteville Division (July 7, 2023) the USDC resolved the bad faith issue. BAD FAITH The tort of bad faith is established in Arkansas when an insurance company affirmatively engages in dishonest, malicious, or oppressive conduct in order to avoid a just obligation to its insured. The tort requires evidence of a state of mind characterized by hatred, ill will, or a spirit of revenge. Importantly, bad faith does not arise from a mere denial of a claim; there must be affirmative misconduct. Plaintiff RMS contends its two claims of loss should have been covered under the policy of insurance it had with Owners. The first loss occurred on May 4, 2020, following a hailstorm that caused damage to RMS's warehouse. The second loss was in February 2021, after a winter storm event. RMS narrows its bad-faith claim to Owners's treatment of the winter-storm claim and explicitly states that Owners did not act in bad faith with respect to the hailstorm claim. The only evidence RMS cited in support of its bad-faith claim is the denial letter sent by insurance adjuster Brian Doherty. RMS believes Mr. Doherty “misrepresented” in the letter what the insurance policy actually provided and omitted reference to crucial portions of the policy that provided coverage. The standard for establishing a claim for bad faith is, and always should be, rigorous and difficult to satisfy. RMS betrayed a fundamental misunderstanding about the tort when, at one point in its briefing, it characterizes Owners' actions as “[a]t best... a mistake,” Neither a mistake nor a “refusal to pay a disputed claim” is tortious behavior according to Arkansas law. Summary judgment on Count II, the tort of bad faith, was therefore granted. As a consequence, RMS is not entitled to a punitive damages instruction. The Motion was granted as to Count II, and the claim of bad faith was dismissed with prejudice; as a result, RMS will not be entitled to an instruction on punitive damages. ZALMA OPINION Acting as its own worst enemy the insured's brief admitted that the insurer erred. A mistake may be sufficient to establish a breach of contract but is insufficient to prove the tort of bad faith and the right to seek punitive damages. (c) 2023 Barry Zalma & ClaimSchool, Inc. The band was rounded out with David Henning and Forrest Williams. They disbanded in 2002 and Ian Thornley pursued a solo career with his own band Thornley. In 2010, Ian Thornley and Brian Doherty reunited for a cross-Canada tour, playing both Big Wreck and Thornley songs. In 2012, under the name Big Wreck, the band released their third studio album, Albatross. The band has since released the albums Ghosts in 2014, Grace Street in 2017, ...But For the Sun in 2019, and are currently releasing three EPs that will be put together to make their seventh full-length album Big Wreck 7. He has spent nearly twenty years in Nova Scotia, Canada plying his musical trade. In 1998 he accepted a personal invitation by then president, Bill Clinton, to perform his song 'Anthem for the Children' in the White House. His audiences range from four and five year-olds right up to the thousands who regularly attend his performances on the stages of the U.S. and Canada's premier Irish music festivals. Tom has an extensive back-catalogue of recorded music and continues to release albums for children and adults alike. On this week's episode of Versus Trump, Jason, Charlie, and Easha—in her last episode for several months—discuss the fast-moving lawsuit by states against the Trump Administration and Cody Wilson seeking to block distribution of plans for 3D-printed guns. Charlie starts the discussion by explaning the background of the dispute, which actually dates back several years to a lawsuit brought by Wilson, the would-be distributor of these plans, against the Obama Administration. The Obama Administration successfully blocked the plans' distribution, and the Trump Administration defended that position until a recent settlement that would have permitted the distribution as of August 1. Jason then turns to the current lawsuit brought by many blue states that seeks to stop the settlement from going into effect and has resulted in a temporary block on Wilson's website. The trio discuss the administrative and constitutional law aspects of the dispute. David centers this episode on analyzing three recent school safety mass media articles to reveal how sensationalized headings fail to match the content of the articles, thus creating a disservice to readers and further eroding public trust in the mainstream media's ability to accurately report safety news. Dr. Perrodin identifies the authors' biases and specifically exposes their attempts to deploy fear narratives to persuade the public toward accepting rhetoric that schools are in a default status of “unsafe” and the antidotes are in the forms of legislation, obscure software or genetically modifying humans to be stress-resistant flesh machines shielded from the horrors of trauma. HEADLINE #1: Representative Massive (R-Ky.) Wants to Repeal Gun-Free School Zones Act by Brian Doherty [reason.com/blog] (January 5, 2017). “Gun-Free School Zones” signs grow in the boulevards of every school in America. Invasive - and impervious to weed wackers! They've been stoutly rooted since 1990. The article states (per quote from Rep. Massie): “Gun-free school zones are ineffective.” Yeah, I agree. Everyone agrees. The bill doesn't deter school shooters, much like a non-smoking sign won't discourage an arsonist. The bill was a paper tiger and it's not like we don't have laws against committing homicide. So yes, by all means, trash the GFSZA! However, Rep. Massie goes on to make a statement that simply isn't true. “They [GFSZA] make people less safe by inviting criminals into target rich, no-risk environments and prevent law-abiding citizens from protecting themselves, and create vulnerable populations that are targeted by criminals.” Yikes. No, Rep. Massie. Repealing the bill won't be like Gotham welcoming back Batman. Nothing will change except it will be easier to mow the school boulevard. HEADLINE #2: D.C. online watchdog group spots Wisconsin school threat on Twitter by Savanna Tomei [WKOW 27] (January 14, 2017). This is a terrific example of an advertisement pretending to be an article. You'll be amazed at what I uncovered after exploring “The Tactical Institute” website – the self-funded “group” (schools must pay for its services) that, per its website “monitors the entire Web for threats to our clients", including something referred to as “The Dark Web” which apparently is so secretive that is undetectable by search engines. FYI - "Dark" is a persuasion word - it is intended to frighten you. Per its website, TI appears to have a knack for facilitating inter-agency networking – even though, as I clarify, such provisions are already provided to law enforcement agencies via the ‘The USA PATRIOT ACT' (which I talk about). HEADLINE #3: Preventing Mental Illness With a Stress Vaccine by Danielle Elliot [The Atlantic] (November 26, 2016). The headline's claim is absurd and a complete mismatch from the article which unfortunately bends immune system research being conducted, in part, by Dr. Rebecca Brachman. Dr. Brachman was a student at Columbine High School during the infamous 1999 shooting. She has devoted her life toward better understanding stress, the immune system and mental health. The deductions penned by the article's author are beyond sensationalism – they are hurtful to persons suffering from PTSD, such as rescue workers and soldiers, as it is implied that one day a simple vaccine will create an “ideal world” where people would be immune from debilitating trauma-induced mental health conditions. Did I mention that current clinical trials involve 12 mice? Brian Doherty is the founder and guitar player in the band "Big Wreck". Brian started his music journey learning the trumpet and soon moved over to guitar playing in local bands. After high school, Brian went to the prestigious Berklee college of music and soon formed "Big Wreck" with Ian Thornley. While most of the band is from America, "Big Wreck" charted high in the Canadian charts and had critical acclaim with their first release "In Loving Memory of..." and toured extensively in Canada and the USA. After a second album and some bad luck, the band broke up and all the members went on to other projects. Brian started teaching guitar in Sarnia, Ontario where he still lives today. After ten years, "Big Wreck" got back together and released a new album and started getting back into the swing of playing live and enjoying the accolades that might have been missed in their first run. Stephan Kinsella NYC LibertyFest, Brooklyn, NY October 11, 2014   Introduction Modern libertarianism is about 50 years old. Main figures: Rand and Rothbard. “three furies of libertarianism” (Doherty, Radicals for Capitalism): Rose Wilder Lane, Ayn Rand, and Isabel Patterson (1943) Mises, Hayek, Read, Friedman Rand Atlas, 1957; Rothbard, MES, 1962 From a Foreword I wrote for a forthcoming libertarian book: Modern libertarian theory is only about five decades old. The ideas that have influenced our greatest thinkers can be traced back centuries, of course,[1] to luminaries such as Hugo Grotius, John Locke, Thomas Paine, Herbert Spencer, David Hume, and John Stuart Mill, and to more recent and largely even more radical thinkers such as Gustave de Molinari, Benjamin Tucker, Lysander Spooner, Bertrand de Jouvenal, Franz Oppenheimer, and Albert Jay Nock.[2] The beginnings of the modern movement can be detected in the works of the “three furies of libertarianism,” as Brian Doherty calls them: Rose Wilder Lane, Ayn Rand, and Isabel Patterson, whose respective books The Discovery of Freedom, The Fountainhead, and The God of the Machine were all published, rather remarkably, in the same year: 1943.[3] But in its more modern form, libertarianism originated in the 1960s and 1970s from thinkers based primarily in the United States, notably Ayn Rand and Murray Rothbard. Other significant influences on the nascent libertarian movement include Ludwig von Mises, author of Liberalism (1927) and Human Action (1949, with a predecessor version published in German in 1940); Nobel laureate F.A. von Hayek, author of The Road to Serfdom (1944); Leonard Read, head of the Foundation for Economic Education (founded 1946); and Nobel laureate Milton Friedman, author of the influential Capitalism and Freedom (1962). The most prominent and influential of modern libertarian figures, however, were the aforementioned novelist-philosopher Ayn Rand, the founder of “Objectivism” and a “radical for capitalism,” and Murray Rothbard, the Mises-influenced libertarian anarcho-capitalist economist and political theorist. Rothbard's seminal role is widely recognized, even by non-Rothbardians. Objectivist John McCaskey, for example, has observed, that out of the debates in the mid-1900s about what rights citizens ought to have, "grew the main sort of libertarianism of the last fifty years. It was based on a principle articulated by Murray Rothbard in the 1970s this way: No one may initiate the use or threat of physical violence against the person or property of anyone else. The idea had roots in John Locke, America's founders, and more immediately Ayn Rand, but it was Rothbard's formulation that became standard. It became known as the non-aggression principle or—since Rothbard took it as the starting point of political theory and not the conclusion of philosophical justification—the non-aggression axiom.
