Speaker: Gregory Fox, Wayne State UniversityDate: Friday Lunchtime Lecture - Friday 24 January 2025Summary: Does international law place any constraints on a possible Ukraine-Russia peace agreement? While we can only speculate about its contents, two aspects appear certain: Ukraine will be asked to relinquish (at a minimum) territory now occupied by Russia, and it will only contemplate entering into an agreement because Russia invaded its territory. Professor Fox will examine the implications of these and other factors for the validity of an agreement.Gregory H. Fox is a Professor of Law at Wayne State University School of Law, where he is the Director of the Program for International Legal Studies. Professor Fox is an elected member of the American Law Institute. He has been a Visiting Professor at the University of Michigan Law School and the Universidad Iberoamericana in Mexico City, a Visiting Fellow at the Lauterpacht Research Centre for International Law at Cambridge University, a Fellow at the Max Planck Institute for Public International Law and Comparative Public Law in Heidelberg, Germany, and a Fellow at the Schell Center for Human Rights at Yale Law School, among other institutions. Professor Fox has written widely on a variety of international law topics, including civil war peace agreements, the powers of the UN Security Council, international occupation law, international control of territory, and international efforts to promote democratic governance. His most recent article, Of Looting, Land and Loss: The New International Law of Takings, was published in Volume 65 of the Harvard International Law Journal. Professor Fox was co-counsel to the State of Eritrea in the Zukar-Hanish arbitration with the Republic of Yemen concerning the status of a group of islands in the southern Red Sea. He has also served as counsel in several human rights cases in US courts. Black Hawk Down (2001) describes the plight of the U.S. crew of a Black Hawk helicopter that is shot down during the Battle of Mogadishu during the civil war in Somalia in October 1993. The battle resulted in the death of 18 American soldiers and hundreds of Somalis; it also prompted the U.S. withdrawal from Somalia after images of dead U.S. soldiers being dragged through the streets of Mogadishu by enraged Somalis were broadcast on American television. Directed by Ridley Scott from a book by Mark Bowden, Black Hawk Down is a gritty action movie that captures the brutal nature of urban warfare. It also provides a window into a host of complex international legal and political issues surrounding humanitarian intervention in the aftermath of the Cold War. Joining me is Greg Fox, Professor and Director of the Program for International Legal Studies at Wayne State University in Detroit. Professor Fox is a widely cited authority on international law and international organizations and a leader in a variety of academic and professional organizations.Timestamps:0:00 Introduction1:40 A primer on Somalia and its history6:40 The legal framework for the international humanitarian intervention9:50 The opportunities for intervention after the end of the Cold War15:33 Preparing to go into Somalia19:16 The pros and cons of intervention23:04 The U.S. shift on military intervention after the Vietnam War24:43 The challenges of intervening in civil wars33:47 International humanitarian law and urban warfare43:14 Legacies of the Battle of Mogadishu52:06 Internal debates within the UN over humanitarian intervention 54:55 What happened in Somalia after the Battle of MogadishuFurther reading:Bowden, Mark, Black Hawk Down: A Story of Modern War (1999)Carroll, Jonathan, “Courage Under Fire: Reevaluating Black Hawk Down and the Battle of Mogadishu,” 29 (3) War in History 704 (July 2022)Fox, Gregory H., Humanitarian Occupation (2008)Hakimi, Monica, “Toward a Legal Theory on the Responsibility to Protect,” 39(2) Yale J. Thulani Rudolf Maseko is my guest in this episode, and we discuss the intervention of the international community in Swaziland amidst the country's political unrest. He also gives a high-level constitutional opinion and on the democratization of the country. Thulani is an experienced human rights lawyer with a passion for the rule of law. He holds a Master's Degree in Human Rights and Democratization in Africa from the University of Pretoria, Centre for Human Rights. He holds a Hubert Humphrey Fellowship in Leadership from the American University Washington College of Law where he obtained a Master's Degree in International Legal Studies. He holds a Bachelor of Arts and a Bachelor of Laws from the University of Swaziland. Thulani is a founder member of Lawyers for Human Rights (Swaziland) and has worked for the International Commission of Jurists (ICJ) for several years as a consultant based in Swaziland. He has worked as an attorney in private practice for the last twenty-one years focusing mostly on human rights and constitutional litigation. In 2018, he was elected to be the Secretary of the Law Society of Swaziland for a period of two years. He has represented a number of the pro-democracy activists who constantly face prosecution and persecution by the State in the courts of Swaziland. He, himself, is a victim of abuse of power and authority, spent two years in prison before he was acquitted on appeal. On 18 March 2014, Thulani was jailed for contempt of court after criticizing Swaziland's judicial system. In August 2014, Maseko wrote to US President Barack Obama from prison, seeking his intervention ahead of the 2014 United States–Africa Leaders' Summit. Maseko was released from prison on 30 July 2015. He had been declared a prisoner of conscience by Amnesty International. Some highlights from our conversation: Whether trust should be placed on the international community to intervene and help Swaziland to democratize. Southern African Development Community's fact-finding mission in Swaziland. Swaziland political groups and civil society's submission to SADC Troika: The king and government must ensure that the process of dialogue includes all the players in Swaziland; a commitment to total unbanning of political parties; consideration for setting up an interim government; the process must give results to an adoption of a new democratic constitution; and the new constitution must ensure, going forward, the country is governed under a multiparty dispensation grounded on the rule of law. Historical background of the drafting process of the constitution and the intent of the drafters on the powers of the king. Everything that Swazi's do is informed by the wishes and whims of the monarch. The constitution was not intended to bind the king – a fundamental problem faced by all Swazis. For the people to merely elect their own prime minister without fundamentally changing the structure of the organs of the state would not give Swazi democracy. Human rights perspective on the king's speech, in particular: “Everything thing in Swaziland belongs to the king.” --- Support this podcast: https://anchor.fm/mpilo-nkambule/support

Lecture summary: Visual international law tells stories. Image and art supporting imperialism in the eighteenth and nineteenth centuries also projected the authority, legitimacy, and universality of international law. This lecture argues that depictions of treaty-making, international legal theorists, and conferences were about painting European international law as ‘successful’—telling stories of an authoritative, universal, and virtue-laden mode of international regulation. That same approach also stretched into the twentieth and twenty-first centuries, including through the physical construction of international law in the architecture of its statement buildings, such as the International Court of Justice. Dr Kate Miles is a Fellow, Lecturer and Director of Studies in Law at Gonville and Caius College, Cambridge. She is also a Fellow of the Lauterpacht Centre for International Law, University of Cambridge. She is the author of a monograph published by Cambridge University Press: The Origins of International Investment Law: Empire, Environment and the Safeguarding of Capital. She is also the author of a forthcoming monograph also with Cambridge University Press: Visual International Law: Image, Symbol, Art and Architecture. As an undergraduate in law and arts at the University of Auckland, she studied law, art history, philosophy and ancient history. She holds a B.A. in Art History, LL.B., and an LL.M. in Environmental Law (Hons I) from the University of Auckland, an LL.M. in International Legal Studies from NYU School of Law, and a Ph.D. from the University of Sydney. Since 2015, her research has drawn together those interdisciplinary threads and engaged with the visuality of international law. In particular, it has focused on the role of the visual in projecting the authority, legitimacy and universality of imperial international law.

This is part 2, of a two-part interview, with Brigadier General Mark Maldonado on "Career Path." If you didn't hear part 1, please do. Brigadier General Maldonado is the current Commander for the District of Columbia Air National Guard, who also holds the remarkable achievement of attaining 3 Air Force Specialty Codes (AFSCs) through his career as a pilot, personnelist, and a judge advocate – a true “triple threat” one could say! And he’s here today to talk about his career path – in that there is not necessarily a “normal” career path – from his humble beginnings in Puerto Rico and the Bronx, NY where he first learned to speak English, to his prominent role as a Commanding General. Brigadier General Maldonado pinned onto the rank of Brigadier General in June of 2019 and has had a truly remarkable – and unique – career. He graduated with a Bachelor of Science from the U.S. Air Force Academy in 1991 and commissioned as a Second Lieutenant pilot in May of that year. He attended undergraduate pilot training at Vance AFB, Oklahoma. From there, he transitioned into a personnelist, earning his second AFSC, where he acted as the Chief of Personnel Utilization and Training, at McGuire AFB, NJ. Brigadier General Maldonado then moved back into his pilot career path as a KC-135 aircraft commander at both Grand Forks AFB, ND, and then the New Jersey ANG from 1994-2006. During his transition to the New Jersey ANG he entered law school and graduated with a JD from Rutgers Law School in 2004. In 2006, he transitioned into his third AFSC as a Deputy Judge Advocate with the 113th Wing, District of Columbia Air National Guard. He subsequently became the State Staff Judge Advocate for Joint Force Headquarters, DC National Guard. In his civilian capacity, he worked as a federal prosecutor for the Department of Justice for more than a decade where he prosecuted large-scale international cases working in the Counterterrorism, Narcotic and Dangerous Drug Sections. Brigadier General Maldonado has numerous deployments under his belt including flying 48 combat sorties over Afghanistan in the aftermath of the terrorist attacks of 9/11. Other deployments include Saudi Arabia, Turkey, the United Kingdom, Germany, Japan, Spain, Oman and Portugal. He also represented the Department of Defense’s Institute for International Legal Studies as a Rule of Law, Counterterrorism, and Counter-narcotics expert instructor in Peru, El Salvador, and the Democratic Republic of Congo. Currently, Brigadier General Maldonado acts as the Commanding General, Air Component Command, District of Columbia National Guard. He is the principal advisor to the Commanding General of the DC National Guard and manages over 1,200 Airmen, civilians and contractors, while ensuring all his units maintain the required readiness for world-wide deployment.

Corruption has become a hot topic in Public International Law in recent years. In particular, its prevention has been the subject of numerous treaties and soft law instruments, and it has been wielded as a defence to both investment treaty claims and commercial contract claims (which in turn raises questions of private international law). Yet the source and theoretical underpinnings of a supposed international norm prohibiting corruption remains opaque. Tribunals and commentators make reference to “international public policy,” but the question remains whether the supposed prohibition of corruption is a rule of international law, and where it features in the hierarchy of norms. We propose to examine (i) the current “state of play” (i.e., the various ways in which international law addresses and reprimands corruption), (ii) whether Public International Law prohibits corruption and, if so, the source and status of that norm; and (iii) what the future of international anti-corruption efforts might look like.
