How are the federal courts faring during these tumultuous times? I thought it would be worthwhile to discuss this important subject with a former federal judge: someone who understands the judicial role well but could speak more freely than a sitting judge, liberated from the strictures of the bench.Meet Judge Nancy Gertner (Ret.), who served as a U.S. District Judge for the District of Massachusetts from 1994 until 2011. I knew that Judge Gertner would be a lively and insightful interviewee—based not only on her extensive commentary on recent events, reflected in media interviews and op-eds, but on my personal experience. I've known Judge Nancy Gertner for more than 25 years, dating back to when I took a full-year course on federal sentencing from her and the late Professor Dan Freed at Yale Law School. She was a great teacher, and although we didn't always agree—she was a professor who let students have their own opinions—I always admired her intellect and appreciated her insights.Judge Gertner is herself a graduate of Yale Law School—where she met, among other future luminaries, Bill and Hillary Clinton. After a fascinating career in private practice as a litigator and trial lawyer handling an incredibly diverse array of cases, Judge Gertner was appointed to serve as a U.S. District Judge for the District of Massachusetts in 1994, by President Clinton. She retired from the bench in 2011, but she is definitely not retired: she writes opinion pieces for outlets such as The New York Times and The Boston Globe, litigates and consults on cases, and trains judges and litigators. She's also working on a book called Incomplete Sentences, telling the stories of the people she sentenced over 17 years on the bench. Her autobiography, In Defense of Women: Memoirs of an Unrepentant Advocate, was published in 2011. Without further ado, here's my conversation with Judge Nancy Gertner.Judge, thank you so much for joining me.Nancy Gertner: Thank you for inviting me. This is wonderful.DL: So it's funny: I've been wanting to have you on this podcast in a sense before it existed, because you and I worked on a podcast pilot. It ended up not getting picked up, but perhaps they have some regrets over that, because legal issues have just blown up since then.NG: I remember that. I think it was just a question of scheduling, and it was before Trump, so we were talking about much more sophisticated, superficial things, as opposed to the rule of law and the demise of the Constitution.DL: And we will get to those topics. But to start off my podcast in the traditional way, let's go back to the beginning. I believe we are both native New Yorkers?NG: Yes, that's right. I was born on the Lower East Side of Manhattan, in an apartment that I think now is a tenement museum, and then we moved to Flushing, Queens, where I lived into my early 20s.DL: So it's interesting—I actually spent some time as a child in that area. What was your upbringing like? What did your parents do?NG: My father owned a linoleum store, or as we used to call it, “tile,” and my mother was a homemaker. My mother worked at home. We were lower class on the Lower East Side and maybe made it to lower-middle. My parents were very conservative, in the sense they didn't know exactly what to do with a girl who was a bit of a radical. Neither I nor my sister was precisely what they anticipated. So I got to Barnard for college only because my sister had a conniption fit when he wouldn't pay for college for her—she's my older sister—he was not about to pay for college. If we were boys, we would've had college paid for.In a sense, they skipped a generation. They were actually much more traditional than their peers were. My father was Orthodox when he grew up; my mother was somewhat Orthodox Jewish. My father couldn't speak English until the second grade. So they came from a very insular environment, and in one sense, he escaped that environment when he wanted to play ball on Saturdays. So that was actually the motivation for moving to Queens: to get away from the Lower East Side, where everyone would know that he wasn't in temple on Saturday. We used to have interesting discussions, where I'd say to him that my rebellion was a version of his: he didn't want to go to temple on Saturdays, and I was marching against the war. He didn't see the equivalence, but somehow I did.There's actually a funny story to tell about sort of exactly the distance between how I was raised and my life. After I graduated from Yale Law School, with all sorts of honors and stuff, and was on my way to clerk for a judge, my mother and I had this huge fight in the kitchen of our apartment. What was the fight about? Sadie wanted me to take the Triborough Bridge toll taker's test, “just in case.” “You never know,” she said. I couldn't persuade her that it really wasn't necessary. She passed away before I became a judge, and I told this story at my swearing-in, and I said that she just didn't understand. I said, “Now I have to talk to my mother for a minute; forgive me for a moment.” And I looked up at the rafters and I said, “Ma, at last: a government job!” So that is sort of the measure of where I started. My mother didn't finish high school, my father had maybe a semester of college—but that wasn't what girls did.DL: So were you then a first-generation professional or a first-generation college graduate?NG: Both—my sister and I were both, first-generation college graduates and first-generation professionals. When people talk about Jewish backgrounds, they're very different from one another, and since my grandparents came from Eastern European shtetls, it's not clear to me that they—except for one grandfather—were even literate. So it was a very different background.DL: You mentioned that you did go to Yale Law School, and of course we connected there years later, when I was your student. But what led you to go to law school in the first place? Clearly your parents were not encouraging your professional ambitions.NG: One is, I love to speak. My husband kids me now and says that I've never met a microphone I didn't like. I had thought for a moment of acting—musical comedy, in fact. But it was 1967, and the anti-war movement, a nascent women's movement, and the civil rights movement were all rising around me, and I wanted to be in the world. And the other thing was that I didn't want to do anything that women do. Actually, musical comedy was something that would've been okay and normal for women, but I didn't want to do anything that women typically do. So that was the choice of law. It was more like the choice of law professor than law, but that changed over time.DL: So did you go straight from Barnard to Yale Law School?NG: Well, I went from Barnard to Yale graduate school in political science because as I said, I've always had an academic and a practical side, and so I thought briefly that I wanted to get a Ph.D. I still do, actually—I'm going to work on that after these books are finished.DL: Did you then think that you wanted to be a law professor when you started at YLS? I guess by that point you already had a master's degree under your belt?NG: I thought I wanted to be a law professor, that's right. I did not think I wanted to practice law. Yale at that time, like most law schools, had no practical clinical courses. I don't think I ever set foot in a courtroom or a courthouse, except to demonstrate on the outside of it. And the only thing that started me in practice was that I thought I should do at least two or three years of practice before I went back into the academy, before I went back into the library. Twenty-four years later, I obviously made a different decision.DL: So you were at YLS during a very interesting time, and some of the law school's most famous alumni passed through its halls around that period. So tell us about some of the people you either met or overlapped with at YLS during your time there.NG: Hillary Clinton was one of my best friends. I knew Bill, but I didn't like him.DL: Hmmm….NG: She was one of my best friends. There were 20 women in my class, which was the class of ‘71. The year before, there had only been eight. I think we got up to 21—a rumor had it that it was up to 21 because men whose numbers were drafted couldn't go to school, and so suddenly they had to fill their class with this lesser entity known as women. It was still a very small number out of, I think, what was the size of the opening class… 165? Very small. So we knew each other very, very well. And Hillary and I were the only ones, I think, who had no boyfriends at the time, though that changed.DL: I think you may have either just missed or briefly overlapped with either Justice Thomas or Justice Alito?NG: They're younger than I am, so I think they came after.DL: And that would be also true of Justice Sotomayor then as well?NG: Absolutely. She became a friend because when I was on the bench, I actually sat with the Second Circuit, and we had great times together. But she was younger than I was, so I didn't know her in law school, and by the time she was in law school, there were more women. In the middle of, I guess, my first year at Yale Law School, was the first year that Yale College went coed. So it was, in my view, an enormously exciting time, because we felt like we were inventing law. We were inventing something entirely new. We had the first “women in the law” course, one of the first such courses in the country, and I think we were borderline obnoxious. It's a little bit like the debates today, which is that no one could speak right—you were correcting everyone with respect to the way they were describing women—but it was enormously creative and exciting.DL: So I'm gathering you enjoyed law school, then?NG: I loved law school. Still, when I was in law school, I still had my feet in graduate school, so I believe that I took law and sociology for three years, mostly. In other words, I was going through law school as if I were still in graduate school, and it was so bad that when I decided to go into practice—and this is an absolutely true story—I thought that dying intestate was a disease. We were taking the bar exam, and I did not know what they were talking about.DL: So tell us, then, what did lead you to shift gears? You mentioned you clerked, and you mentioned you wanted to practice for a few years—but you did practice for more than a few years.NG: Right. I talk to students about this all the time, about sort of the fortuities that you need to grab onto that you absolutely did not plan. So I wind up at a small civil-rights firm, Harvey Silverglate and Norman Zalkind's firm. I wind up in a small civil-rights firm because I couldn't get a job anywhere else in Boston. I was looking in Boston or San Francisco, and what other women my age were encountering, I encountered, which is literally people who told me that I would never succeed as a lawyer, certainly not as a litigator. So you have to understand, this is 1971. I should say, as a footnote, that I have a file of everyone who said that to me. People know that I have that file; it's called “Sexist Tidbits.” And so I used to decide whether I should recuse myself when someone in that file appeared before me, but I decided it was just too far.So it was a small civil-rights firm, and they were doing draft cases, they were doing civil-rights cases of all different kinds, and they were doing criminal cases. After a year, the partnership between Norman Zalkind and Harvey Silverglate broke up, and Harvey made me his partner, now an equal partner after a year of practice.Shortly after that, I got a case that changed my career in so many ways, which is I wound up representing Susan Saxe. Susan Saxe was one of five individuals who participated in robberies to get money for the anti-war movement. She was probably five years younger than I was. In the case of the robbery that she participated in, a police officer was killed. She was charged with felony murder. She went underground for five years; the other woman went underground for 20 years.Susan wanted me to represent her, not because she had any sense that I was any good—it's really quite wonderful—she wanted me to represent her because she figured her case was hopeless. And her case was hopeless because the three men involved in the robbery either fled or were immediately convicted, so her case seemed to be hopeless. And she was an extraordinarily principled woman: she said that in her last moment on the stage—she figured that she'd be convicted and get life—she wanted to be represented by a woman. And I was it. There was another woman in town who was a public defender, but I was literally the only private lawyer. I wrote about the case in my book, In Defense of Women, and to Harvey Silvergate's credit, even though the case was virtually no money, he said, “If you want to do it, do it.”Because I didn't know what I was doing—and I literally didn't know what I was doing—I researched every inch of everything in the case. So we had jury research and careful jury selection, hiring people to do jury selection. I challenged the felony-murder rule (this was now 1970). If there was any evidentiary issue, I would not only do the legal research, but talk to social psychologists about what made sense to do. To make a long story short, it took about two years to litigate the case, and it's all that I did.And the government's case was winding down, and it seemed to be not as strong as we thought it was—because, ironically, nobody noticed the woman in the bank. Nobody was noticing women in general; nobody was noticing women in the bank. So their case was much weaker than we thought, except there were two things, two letters that Susan had written: one to her father, and one to her rabbi. The one to her father said, “By the time you get this letter, you'll know what your little girl is doing.” The one to her rabbi said basically the same thing. In effect, these were confessions. Both had been turned over to the FBI.So the case is winding down, not very strong. These letters have not yet been introduced. Meanwhile, The Boston Globe is reporting that all these anti-war activists were coming into town, and Gertner, who no one ever heard of, was going to try the Vietnam War. The defense will be, “She robbed a bank to fight the Vietnam War.” She robbed a bank in order to get money to oppose the Vietnam War, and the Vietnam War was illegitimate, etc. We were going to try the Vietnam War.There was no way in hell I was going to do that. But nobody had ever heard of me, so they believed anything. The government decided to rest before the letters came in, anticipating that our defense would be a collection of individuals who were going to challenge the Vietnam War. The day that the government rested without putting in those two letters, I rested my case, and the case went immediately to the jury. I'm told that I was so nervous when I said “the defense rests” that I sounded like Minnie Mouse.The upshot of that, however, was that the jury was 9-3 for acquittal on the first day, 10-2 for acquittal on the second day, and then 11-1 for acquittal—and there it stopped. It was a hung jury. But it essentially made my career. I had first the experience of pouring my heart into a case and saving someone's life, which was like nothing I'd ever felt before, which was better than the library. It also put my name out there. I was no longer, “Who is she?” I suddenly could take any kind of case I wanted to take. And so I was addicted to trials from then until the time I became a judge.DL: Fill us in on what happened later to your client, just her ultimate arc.NG: She wound up getting eight years in prison instead of life. She had already gotten eight years because of a prior robbery in Philadelphia, so there was no way that we were going to affect that. She had pleaded guilty to that. She went on to live a very principled life. She's actually quite religious. She works in the very sort of left Jewish groups. We are in touch—I'm in touch with almost everyone that I've ever known—because it had been a life-changing experience for me. We were four years apart. Her background, though she was more middle-class, was very similar to my own. Her mother used to call me at night about what Susan should wear. So our lives were very much intertwined. And so she was out of jail after eight years, and she has a family and is doing fine.DL: That's really a remarkable result, because people have to understand what defense lawyers are up against. It's often very challenging, and a victory is often a situation where your client doesn't serve life, for example, or doesn't, God forbid, get the death penalty. So it's really interesting that the Saxe case—as you talk about in your wonderful memoir—really did launch your career to the next level. And you wound up handling a number of other cases that you could say were adjacent or thematically related to Saxe's case. Maybe you can talk a little bit about some of those.NG: The women's movement was roaring at this time, and so a woman lawyer who was active and spoke out and talked about women's issues invariably got women's cases. So on the criminal side, I did one of the first, I think it was the first, battered woman syndrome case, as a defense to murder. On the civil side, I had a very robust employment-discrimination practice, dealing with sexual harassment, dealing with racial discrimination. I essentially did whatever I wanted to do. That's what my students don't always understand: I don't remember ever looking for a lucrative case. I would take what was interesting and fun to me, and money followed. I can't describe it any other way.These cases—you wound up getting paid, but I did what I thought was meaningful. But it wasn't just women's rights issues, and it wasn't just criminal defense. We represented white-collar criminal defendants. We represented Boston Mayor Kevin White's second-in-command, Ted Anzalone, also successfully. I did stockholder derivative suits, because someone referred them to me. To some degree the Saxe case, and maybe it was also the time—I did not understand the law to require specialization in the way that it does now. So I could do a felony-murder case on Monday and sue Mayor Lynch on Friday and sue Gulf Oil on Monday, and it wouldn't even occur to me that there was an issue. It was not the same kind of specialization, and I certainly wasn't about to specialize.DL: You anticipated my next comment, which is that when someone reads your memoir, they read about a career that's very hard to replicate in this day and age. For whatever reason, today people specialize. They specialize at earlier points in their careers. Clients want somebody who holds himself out as a specialist in white-collar crime, or a specialist in dealing with defendants who invoke battered woman syndrome, or what have you. And so I think your career… you kind of had a luxury, in a way.NG: I also think that the costs of entry were lower. It was Harvey Silverglate and me, and maybe four or five other lawyers. I was single until I was 39, so I had no family pressures to speak of. And I think that, yes, the profession was different. Now employment discrimination cases involve prodigious amounts of e-discovery. So even a little case has e-discovery, and that's partly because there's a generation—you're a part of it—that lived online. And so suddenly, what otherwise would have been discussions over the back fence are now text messages.So I do think it's different—although maybe this is a comment that only someone who is as old as I am can make—I wish that people would forget the money for a while. When I was on the bench, you'd get a pro se case that was incredibly interesting, challenging prison conditions or challenging some employment issue that had never been challenged before. It was pro se, and I would get on the phone and try to find someone to represent this person. And I can't tell you how difficult it was. These were not necessarily big cases. The big firms might want to get some publicity from it. But there was not a sense of individuals who were going to do it just, “Boy, I've never done a case like this—let me try—and boy, this is important to do.” Now, that may be different today in the Trump administration, because there's a huge number of lawyers that are doing immigration cases. But the day-to-day discrimination cases, even abortion cases, it was not the same kind of support.DL: I feel in some ways you were ahead of your time, because your career as a litigator played out in boutiques, and I feel that today, many lawyers who handle high-profile cases like yours work at large firms. Why did you not go to a large firm, either from YLS or if there were issues, for example, of discrimination, you must have had opportunities to lateral into such a firm later, if you had wanted to?NG: Well, certainly at the beginning nobody wanted me. It didn't matter how well I had done. Me and Ruth Ginsburg were on the streets looking for jobs. So that was one thing. I wound up, for the last four years of my practice before I became a judge, working in a firm called Dwyer Collora & Gertner. It was more of a boutique, white-collar firm. But I wasn't interested in the big firms because I didn't want anyone to tell me what to do. I didn't want anyone to say, “Don't write this op-ed because you'll piss off my clients.” I faced the same kind of issue when I left the bench. I could have an office, and sort of float into client conferences from time to time, but I did not want to be in a setting in which anyone told me what to do. It was true then; it certainly is true now.DL: So you did end up in another setting where, for the most part, you weren't told what to do: namely, you became a federal judge. And I suppose the First Circuit could from time to time tell you what to do, but….NG: But they were always wrong.DL: Yes, I do remember that when you were my professor, you would offer your thoughts on appellate rulings. But how did you—given the kind of career you had, especially—become a federal judge? Because let me be honest, I think that somebody with your type of engagement in hot-button issues today would have a challenging time. Republican senators would grandstand about you coming up with excuses for women murderers, or what have you. Did you have a rough confirmation process?NG: I did. So I'm up for the bench in 1993. This is under Bill Clinton, and I'm told—I never confirmed this—that when Senator Kennedy…. When I met Senator Kennedy, I thought I didn't have a prayer of becoming a judge. I put my name in because I knew the Clintons, and everybody I knew was getting a job in the government. I had not thought about being a judge. I had not prepared. I had not structured my career to be a judge. But everyone I knew was going into the government, and I thought if there ever was a time, this would be it. So I apply. Someday, someone should emboss my application, because the application was quite hysterical. I put in every article that I had written calling for access to reproductive technologies to gay people. It was something to behold.Kennedy was at the tail end of his career, and he was determined to put someone like me on the bench. I'm not sure that anyone else would have done that. I'm told (and this isn't confirmed) that when he talked to Bill and Hillary about me, they of course knew me—Hillary and I had been close friends—but they knew me to be that radical friend of theirs from Yale Law School. There had been 24 years in between, but still. And I'm told that what was said was, “She's terrific. But if there's a problem, she's yours.” But Kennedy was really determined.The week before my hearing before the Senate, I had gotten letters from everyone who had ever opposed me. Every prosecutor. I can't remember anyone who had said no. Bill Weld wrote a letter. Bob Mueller, who had opposed me in cases, wrote a letter. But as I think oftentimes happens with women, there was an article in The Boston Herald the day before my hearing, in which the writer compared me to Lorena Bobbitt. Your listeners may not know this, but he said, “Gertner will do to justice, with her gavel, what Lorena did to her husband, with a kitchen knife.” Do we have to explain that any more?DL: They can Google it or ask ChatGPT. I'm old enough to know about Lorena Bobbitt.NG: Right. So it's just at the tail edge of the presentation, that was always what the caricature would be. But Kennedy was masterful. There were numbers of us who were all up at the same time. Everyone else got through except me. I'm told that that article really was the basis for Senator Jesse Helms's opposition to me. And then Senator Kennedy called us one day and said, “Tomorrow you're going to read something, but don't worry, I'll take care of it.” And the Boston Globe headline says, “Kennedy Votes For Helms's School-Prayer Amendment.” And he called us and said, “We'll take care of it in committee.” And then we get a call from him—my husband took the call—Kennedy, affecting Helms's accent, said, ‘Senator, you've got your judge.' We didn't even understand what the hell he said, between his Boston accent and imitating Helms; we had no idea what he said. The job did come with certain restrictions. Did you enjoy it, notwithstanding the restrictions?NG: I candidly was not sure that I would last beyond five years, for a couple of reasons. One was, I got on the bench in 1994, when the sentencing guidelines were mandatory, when what we taught you in my sentencing class was not happening, which is that judges would depart from the guidelines and the Sentencing Commission, when enough of us would depart, would begin to change the guidelines, and there'd be a feedback loop. There was no feedback loop. If you departed, you were reversed. And actually the genesis of the book I'm writing now came from this period. As far as I was concerned, I was being unfair. As I later said, my sentences were unfair, unjust, and disproportionate—and there was nothing I could do about it. So I was not sure that I was going to last beyond five years.In addition, there were some high-profile criminal trials going on with lawyers that I knew that I probably would've been a part of if I had been practicing. And I hungered to do that, to go back and be a litigator. The course at Yale Law School that you were a part of saved me. And it saved me because, certainly with respect to the sentencing, it turned what seemed like a formula into an intellectual discussion in which there was wiggle room and the ability to come up with other approaches. In other words, we were taught that this was a formula, and you don't depart from the formula, and that's it. The class came up with creative issues and creative understandings, which made an enormous difference to my judging.So I started to write; I started to write opinions. Even if the opinion says there's nothing I can do about it, I would write opinions in which I say, “I can't depart because of this woman's status as a single mother because the guidelines said only extraordinary family circumstances can justify a departure, and this wasn't extraordinary. That makes no sense.” And I began to write this in my opinions, I began to write this in scholarly writings, and that made all the difference in the world. And sometimes I was reversed, and sometimes I was not. But it enabled me to figure out how to push back against a system which I found to be palpably unfair. So I figured out how to be me in this job—and that was enormously helpful.DL: And I know how much and how deeply you cared about sentencing because of the class in which I actually wound up writing one of my two capstone papers at Yale.NG: To your listeners, I still have that paper.DL: You must be quite a pack rat!NG: I can change the grade at any time….DL: Well, I hope you've enjoyed your time today, Judge, and will keep the grade that way!But let me ask you: now that the guidelines are advisory, do you view that as a step forward from your time on the bench? Perhaps you would still be a judge if they were advisory? I don't know.NG: No, they became advisory in 2005, and I didn't leave until 2011. Yes, that was enormously helpful: you could choose what you thought was a fair sentence, so it's very advisory now. But I don't think I would've stayed longer, because of two reasons.By the time I hit 65, I wanted another act. I wanted another round. I thought I had done all that I could do as a judge, and I wanted to try something different. And Martha Minow of Harvard Law School made me an offer I couldn't refuse, which was to teach at Harvard. So that was one. It also, candidly, was that there was no longevity in my family, and so when I turned 65, I wasn't sure what was going to happen. So I did want to try something new. But I'm still here.DL: Yep—definitely, and very active. I always chuckle when I see “Ret.,” the abbreviation for “retired,” in your email signature, because you do not seem very retired to me. Tell us what you are up to today.NG: Well, first I have this book that I've been writing for several years, called Incomplete Sentences. And so what this book started to be about was the men and women that I sentenced, and how unfair it was, and what I thought we should have done. Then one day I got a message from a man by the name of Darryl Green, and it says, “Is this Nancy Gertner? If it is, I think about you all the time. I hope you're well. I'm well. I'm an iron worker. I have a family. I've written books. You probably don't remember me.” This was a Facebook message. I knew exactly who he was. He was a man who had faced the death penalty in my court, and I acquitted him. And he was then tried in state court, and acquitted again. So I knew exactly who he was, and I decided to write back.So I wrote back and said, “I know who you are. Do you want to meet?” That started a series of meetings that I've had with the men I've sentenced over the course of the 17-year career that I had as a judge. Why has it taken me this long to write? First, because these have been incredibly moving and difficult discussions. Second, because I wanted the book to be honest about what I knew about them and what a difference maybe this information would make. It is extremely difficult, David, to be honest about judging, particularly in these days when judges are parodied. So if I talk about how I wanted to exercise some leniency in a case, I understand that this can be parodied—and I don't want it to be, but I want to be honest.So for example, in one case, there would be cooperators in the case who'd get up and testify that the individual who was charged with only X amount of drugs was actually involved with much more than that. And you knew that if you believed the witness, the sentence would be doubled, even though you thought that didn't make any sense. This was really just mostly how long the cops were on the corner watching the drug deals. It didn't make the guy who was dealing drugs on a bicycle any more culpable than the guy who was doing massive quantities into the country.So I would struggle with, “Do I really believe this man, the witness who's upping the quantity?” And the kinds of exercises I would go through to make sure that I wasn't making a decision because I didn't like the implications of the decision and it was what I was really feeling. So it's not been easy to write, and it's taken me a very long time. The other side of the coin is they're also incredibly honest with me, and sometimes I don't want to know what they're saying. Not like a sociologist who could say, “Oh, that's an interesting fact, I'll put it in.” It's like, “Oh no, I don't want to know that.”DL: Wow. The book sounds amazing; I can't wait to read it. When is it estimated to come out?NG: Well, I'm finishing it probably at the end of this year. I've rewritten it about five times. And my hope would be sometime next year. So yeah, it was organic. It's what I wanted to write from the minute I left the bench. And it covers the guideline period when it was lunacy to follow the guidelines, to a period when it was much more flexible, but the guidelines still disfavored considering things like addiction and trauma and adverse childhood experiences, which really defined many of the people I was sentencing. So it's a cri de cœur, as they say, which has not been easy to write.DL: Speaking of cri de cœurs, and speaking of difficult things, it's difficult to write about judging, but I think we also have alluded already to how difficult it is to engage in judging in 2025. What general thoughts would you have about being a federal judge in 2025? I know you are no longer a federal judge. But if you were still on the bench or when you talk to your former colleagues, what is it like on the ground right now?NG: It's nothing like when I was a judge. In fact, the first thing that happened when I left the bench is I wrote an article in which I said—this is in 2011—that the only pressure I had felt in my 17 years on the bench was to duck, avoid, and evade, waiver, statute of limitations. Well, all of a sudden, you now have judges who at least since January are dealing with emergencies that they can't turn their eyes away from, judges issuing rulings at 1 a.m., judges writing 60-page decisions on an emergency basis, because what the president is doing is literally unprecedented. The courts are being asked to look at issues that have never been addressed before, because no one has ever tried to do the things that he's doing. And they have almost overwhelmingly met the moment. It doesn't matter whether you're ruling for the government or against the government; they are taking these challenges enormously seriously. They're putting in the time.I had two clerks, maybe some judges have three, but it's a prodigious amount of work. Whereas everyone complained about the Trump prosecutions proceeding so slowly, judges have been working expeditiously on these challenges, and under circumstances that I never faced, which is threats the likes of which I have never seen. One judge literally played for me the kinds of voice messages that he got after a decision that he issued. So they're doing it under circumstances that we never had to face. And it's not just the disgruntled public talking; it's also our fellow Yale Law alum, JD Vance, talking about rogue judges. That's a level of delegitimization that I just don't think anyone ever had to deal with before. So they're being challenged in ways that no other judges have, and they are being threatened in a way that no judges have.On the other hand, I wish I were on the bench.DL: Interesting, because I was going to ask you that. If you were to give lower-court judges a grade, to put you back in professor mode, on their performance since January 2025, what grade would you give the lower courts?NG: Oh, I would give them an A. I would give them an A. It doesn't matter which way they have come out: decision after decision has been thoughtful and careful. They put in the time. Again, this is not a commentary on what direction they have gone in, but it's a commentary on meeting the moment. And so now these are judges who are getting emergency orders, emergency cases, in the midst of an already busy docket. It has really been extraordinary. The district courts have; the courts of appeals have. I've left out another court….DL: We'll get to that in a minute. But I'm curious: you were on the District of Massachusetts, which has been a real center of activity because many groups file there. As we're recording this, there is the SNAP benefits, federal food assistance litigation playing out there [before Judge Indira Talwani, with another case before Chief Judge John McConnell of Rhode Island]. So it's really just ground zero for a lot of these challenges. But you alluded to the Supreme Court, and I was going to ask you—even before you did—what grade would you give them?NG: Failed. The debate about the shadow docket, which you write about and I write about, in which Justice Kavanaugh thinks, “we're doing fine making interim orders, and therefore it's okay that there's even a precedential value to our interim orders, and thank you very much district court judges for what you're doing, but we'll be the ones to resolve these issues”—I mean, they're resolving these issues in the most perfunctory manner possible.In the tariff case, for example, which is going to be argued on Wednesday, the Court has expedited briefing and expedited oral argument. They could do that with the emergency docket, but they are preferring to hide behind this very perfunctory decision making. I'm not sure why—maybe to keep their options open? Justice Barrett talks about how if it's going to be a hasty decision, you want to make sure that it's not written in stone. But of course then the cases dealing with independent commissions, in which you are allowing the government, allowing the president, to fire people on independent commissions—these cases are effectively overruling Humphrey's Executor, in the most ridiculous setting. So the Court is not meeting the moment. It was stunning that the Court decided in the birthright-citizenship case to be concerned about nationwide injunctions, when in fact nationwide injunctions had been challenged throughout the Biden administration, and they just decided not to address the issue then.Now, I have a lot to say about Justice Kavanaugh's dressing-down of Judge [William] Young [of the District of Massachusetts]….DL: Or Justice Gorsuch, joined by Justice Kavanaugh.NG: That's right, it was Justice Gorsuch. It was stunningly inappropriate, stunningly inappropriate, undermines the district courts that frankly are doing much better than the Supreme Court in meeting the moment. The whole concept of defying the Supreme Court—defying a Supreme Court order, a three-paragraph, shadow-docket order—is preposterous. So whereas the district courts and the courts of appeals are meeting the moment, I do not think the Supreme Court is. And that's not even going into the merits of the immunity decision, which I think has let loose a lawless presidency that is even more lawless than it might otherwise be. So yes, that failed.DL: I do want to highlight for my readers that in addition to your books and your speaking, you do write quite frequently on these issues in the popular press. I've seen your work in The New York Times and The Boston Globe. I know you're working on a longer essay about the rule of law in the age of Trump, so people should look out for that. Of all the things that you worry about right now when it comes to the rule of law, what worries you the most?NG: I worry that the president will ignore and disobey a Supreme Court order. I think a lot about the judges that are dealing with orders that the government is not obeying, and people are impatient that they're not immediately moving to contempt. And one gets the sense with the lower courts that they are inching up to the moment of contempt, but do not want to get there because it would be a stunning moment when you hold the government in contempt. I think the Supreme Court is doing the same thing. I initially believed that the Supreme Court was withholding an anti-Trump decision, frankly, for fear that he would not obey it, and they were waiting till it mattered. I now am no longer certain of that, because there have been rulings that made no sense as far as I'm concerned. But my point was that they, like the lower courts, were holding back rather than saying, “Government, you must do X,” for fear that the government would say, “Go pound sand.” And that's what I fear, because when that happens, it will be even more of a constitutional crisis than we're in now. It'll be a constitutional confrontation, the likes of which we haven't seen. So that's what I worry about.DL: Picking up on what you just said, here's something that I posed to one of my prior guests, Pam Karlan. Let's say you're right that the Supreme Court doesn't want to draw this line in the sand because of a fear that Trump, being Trump, will cross it. Why is that not prudential? Why is that not the right thing? And why is it not right for the Supreme Court to husband its political capital for the real moment?Say Trump—I know he said lately he's not going to—but say Trump attempts to run for a third term, and some case goes up to the Supreme Court on that basis, and the Court needs to be able to speak in a strong, unified, powerful voice. Or maybe it'll be a birthright-citizenship case, if he says, when they get to the merits of that, “Well, that's really nice that you think that there's such a thing as birthright citizenship, but I don't, and now stop me.” Why is it not wise for the Supreme Court to protect itself, until this moment when it needs to come forward and protect all of us?NG: First, the question is whether that is in fact what they are doing, and as I said, there were two schools of thought on this. One school of thought was that is what they were doing, and particularly doing it in an emergency, fuzzy, not really precedential way, until suddenly you're at the edge of the cliff, and you have to either say taking away birthright citizenship was unconstitutional, or tariffs, you can't do the tariffs the way you want to do the tariffs. I mean, they're husbanding—I like the way you put it, husbanding—their political capital, until that moment. I'm not sure that that's true. I think we'll know that if in fact the decisions that are coming down the pike, they actually decide against Trump—notably the tariff ones, notably birthright citizenship. I'm just not sure that that's true.And besides, David, there are some of these cases they did not have to take. The shadow docket was about where plaintiffs were saying it is an emergency to lay people off or fire people. Irreparable harm is on the plaintiff's side, whereas the government otherwise would just continue to do that which it has been doing. There's no harm to it continuing that. USAID—you don't have a right to dismantle the USAID. The harm is on the side of the dismantling, not having you do that which you have already done and could do through Congress, if you wanted to. They didn't have to take those cases. So your comment about husbanding political capital is a good comment, but those cases could have remained as they were in the district courts with whatever the courts of appeals did, and they could do what previous courts have done, which is wait for the issues to percolate longer.The big one for me, too, is the voting rights case. If they decide the voting rights case in January or February or March, if they rush it through, I will say then it's clear they're in the tank for Trump, because the only reason to get that decision out the door is for the 2026 election. So I want to believe that they are husbanding their political capital, but I'm not sure that if that's true, that we would've seen this pattern. But the proof will be with the voting rights case, with birthright citizenship, with the tariffs.DL: Well, it will be very interesting to see what happens in those cases. But let us now turn to my speed round. These are four questions that are the same for all my guests, and my first question is, what do you like the least about the law? And this can either be the practice of law or law as an abstract system of governance.NG: The practice of law. I do some litigation; I'm in two cases. When I was a judge, I used to laugh at people who said incivility was the most significant problem in the law. I thought there were lots of other more significant problems. I've come now to see how incredibly nasty the practice of law is. So yes—and that is no fun.DL: My second question is, what would you be if you were not a lawyer/judge/retired judge?NG: Musical comedy star, clearly! No question about it.DL: There are some judges—Judge Fred Block in the Eastern District of New York, Judge Jed Rakoff in the Southern District of New York—who do these little musical stylings for their court shows. I don't know if you've ever tried that?NG: We used to do Shakespeare, Shakespeare readings, and I loved that. I am a ham—so absolutely musical comedy or theater.DL: My third question is, how much sleep do you get each night?NG: Six to seven hours now, just because I'm old. Before that, four. Most of my life as a litigator, I never thought I needed sleep. You get into my age, you need sleep. And also you look like hell the next morning, so it's either getting sleep or a facelift.DL: And my last question is, any final words of wisdom, such as career advice or life advice, for my listeners?NG: You have to do what you love. You have to do what you love. The law takes time and is so all-encompassing that you have to do what you love. And I have done what I love from beginning to now, and I wouldn't have it any other way.DL: Well, I have loved catching up with you, Judge, and having you share your thoughts and your story with my listeners. This Day in Legal History: Fugitive Slave ActOn September 18, 1850, President Millard Fillmore signed the Fugitive Slave Act into law, intensifying the national divide over slavery. As part of the Compromise of 1850, the law mandated that all escaped enslaved individuals, upon capture, be returned to their enslavers and that officials and citizens of free states were legally obligated to cooperate. Federal commissioners were authorized to issue arrest warrants without a jury trial, and those accused had no right to testify in their own defense.The law also imposed heavy penalties on anyone aiding a fugitive, including fines and imprisonment, which provoked outrage among abolitionists and free Black communities. The act effectively nationalized the institution of slavery, forcing even anti-slavery states to participate in its enforcement. This led to dramatic and sometimes violent resistance, including the formation of vigilance committees and the expansion of the Underground Railroad.Free Black Americans faced new dangers under the law, as it encouraged bounty hunters and unscrupulous officials to seize and enslave them under false pretenses. Several high-profile cases, such as the capture of Anthony Burns in Boston in 1854, drew mass protests and highlighted the law's harsh impact. The Fugitive Slave Act deepened sectional tensions and hardened Northern opposition to slavery, pushing the nation closer to civil war.A Chapter 7 trustee for the bankrupt fintech startup GloriFi has filed a $1.7 billion malpractice lawsuit against law firm Winston & Strawn and its Houston managing partner, Michael Blankenship. The suit alleges the firm prioritized the interests of GloriFi's founder, Texas oil investor Toby Neugebauer, over the company's, ultimately contributing to its collapse. GloriFi—formally known as With Purpose Inc.—marketed itself as an “anti-woke” financial institution aimed at conservative consumers. The complaint claims Winston & Strawn enabled Neugebauer to engage in self-dealing, manipulate board control, and undermine corporate governance, deterring major investors and derailing a proposed SPAC merger that once valued the company at $1.7 billion.The trustee accuses the firm of negligence, fiduciary breaches, and aiding fraudulent transfers, alleging its conduct drove investor confidence down and played a key role in the company's failure. Winston & Strawn denies wrongdoing and promises to contest the "meritless claims." The legal action follows a court-approved settlement earlier this year that allowed GloriFi's trustee to pursue claims via a separate entity tied to one of the investors. This is one of multiple legal efforts by the trustee, who previously sued Chapman & Cutler LLP over similar allegations related to Neugebauer's control of the company. High-profile backers of GloriFi included Peter Thiel, Ken Griffin, Vivek Ramaswamy, and an aide to former Vice President Mike Pence.Winston & Strawn Sued in ‘Anti-Woke' Bank Startup Bankruptcy (1)A U.S. immigration judge ordered the deportation of Mahmoud Khalil, a Palestinian-American activist and Columbia University student, to either Algeria or Syria. The ruling is based on allegations that Khalil intentionally misrepresented facts on his green card application. Khalil's legal team disputes the decision and plans to appeal, citing a separate federal court order that currently prevents his detention or deportation while his civil rights case proceeds.Khalil, a lawful permanent resident, was previously held for over 100 days by immigration authorities and missed the birth of his child while in custody. He was released in June after a federal judge criticized his prolonged detention over a civil immigration issue as unconstitutional. Khalil claims the government's efforts to remove him are retaliatory, tied to his outspoken pro-Palestinian activism and free speech. He argues that the charges against him are fabricated and politically motivated.The case has drawn criticism from civil rights organizations concerned about the erosion of due process and free speech rights, especially in the context of recent federal pressure on universities to curtail pro-Palestinian protests. Columbia University, where Khalil studies, was a focal point of such demonstrations in the previous year.US immigration judge orders Khalil deportation, his lawyers say separate ruling protects him for now | ReutersA federal judge ruled that Amazon violated consumer protection laws by collecting billing information for its Prime subscription service before clearly disclosing the full terms, giving the Federal Trade Commission (FTC) a partial win in its case against the company. The FTC alleges Amazon used deceptive practices to enroll tens of millions of users in Prime without proper consent and made cancellations deliberately difficult. The judge found that these actions potentially violated the Restore Online Shoppers Confidence Act (ROSCA), and that Amazon cannot argue ROSCA doesn't apply to Prime signups.U.S. District Judge John Chun also held that two Amazon executives could be held personally liable if violations are proven at trial. The FTC's consumer protection chief, Chris Mufarrige, said the ruling confirms Amazon misled consumers. Amazon maintains that neither the company nor the executives acted improperly, and claims it has always prioritized customer experience. The outcome of the upcoming trial could significantly affect how subscription services manage disclosures and cancellations going forward.Amazon violated online shopper protection law, judge rules ahead of Prime signup trial | ReutersA federal appeals court has blocked, for now, the Trump administration's sweeping plan to overhaul the U.S. Department of Health and Human Services (HHS). The proposed reorganization, led by Health Secretary Robert F. Kennedy Jr., included cutting 10,000 jobs, shutting half of HHS's regional offices, and consolidating key functions across agencies like the CDC and FDA. The 1st U.S. Circuit Court of Appeals upheld a lower court's injunction, siding with 19 Democratic-led states and the District of Columbia that argued the plan would cause immediate harm.The appellate panel, composed entirely of Biden-appointed judges, found the administration failed to demonstrate why the injunction should be lifted while the case is under appeal. The court cited extensive evidence from state officials showing how the restructuring already disrupted public health services, including disease tracking and early childhood programs like Head Start. In July, U.S. District Judge Melissa DuBose ruled the administration lacked the authority to unilaterally restructure agencies created by Congress and ordered a halt to the planned cuts at four major agencies.The administration argued the suit was speculative and claimed employee firings should be handled through internal federal channels. However, the court rejected that reasoning, emphasizing that the states have a direct and tangible interest due to their reliance on federal services. The case remains ongoing, with significant implications for executive authority over federal agencies.Trump administration cannot proceed with overhaul of US health agencies, court rules | ReutersMorgan & Morgan, a major U.S. personal injury law firm, has filed a lawsuit against Disney in federal court in Orlando, seeking a ruling that it can use a parody-style ad referencing Steamboat Willie without infringing Disney's intellectual property rights. Although Disney's copyright on the 1928 short film—which introduced Mickey and Minnie Mouse—expired last year, the company still holds related trademarks. The lawsuit comes after Disney declined to confirm whether it would object to the ad when contacted by the firm.The disputed ad, styled in the animation style of Steamboat Willie, shows Minnie Mouse calling Morgan & Morgan after Mickey crashes a boat into her car. The ad contains a disclaimer distancing it from Disney. This movie comes after the release of "Steamboat Willie" coming from the same producers as Winnie-the-Pooh: Blood and Honey". She is the founder of Abuse Recovery Ministry and Services, which she will refer to as ARMS, and she's also the author of this practical and helpful resource entitled On the Front Lines of Abuse, Strategies for the Faith Community. Stacey fearlessly answers questions today about what defines abuse, what steps can we take today to discover if we're in an abusive relationship, what does the Bible have to say about abuse and divorce, and so much more. Here's our chat. Welcome to The Savvy Sauce, Stacey. Stacey Womack: Thank you so much. I'm so glad to be here. Laura Dugger: Would you mind just starting us off by giving us a current snapshot of your phase of life? Stacey Womack: (1:52 - 2:48) Sure. You know, I've been doing this work for 27 years, but actually I grew up in a pastor's home and married young and had my children young. I have six children, and I have my 13th grandchild on the way, and my first great-grandchild is due in December. And in the midst of homeschooling my kids back in the day, God began to speak to me about ministry that he had for me. And so, this was the door he opened, even though I'm not a survivor of abuse. And back then I never had planned on starting a nonprofit or, you know, having it be the way it is, never planned on having an income off of it. None of that was a part of the plan. I was just being obedient to what God had called me to do. And so here we are today, 27 years later, providing services nationally and internationally to victims and survivors of abuse and also working with those who use abusive and controlling behaviors. Laura Dugger: (2:50 - 3:12) Wow. And abuse is something that's so difficult to understand, and it's a topic that's easy for us to want to avoid. But I appreciate you bringing awareness to this topic that affects more people than we would ever suspect. So, will you just teach us the various types of abuse? Stacey Womack: (3:12 - 12:56) Sure. So, I'll try to go through them fairly briefly for you, but most of the time they only give you a few, but we have eight different areas of abuse that we talk about. So, you know, most people get physical abuse. That's how most people define domestic violence and abuse is physical, which is all the things from hitting, pushing, slapping, grabbing, strangulation, which is something that's very dangerous. And a person's at risk of dying days and weeks after being strangled, even months after being strangled. So, it's a very serious crime. Most states it's a felony. But every category has those things that aren't as obvious. So, in physical, it would be like posturing where someone stands up or takes a step towards you, it's right in your space. The most common form of abuse is psychological, though. This is what is often called emotional abuse by most people. So psychological abuse, I kind of divided into three categories. The largest one is the crazy making the mind games, the mental coercion, the gaslighting, all those things. And that's very, very hard to explain to people. And it doesn't look like abuse. It looks like non-memorable conflict oftentimes and gets misdiagnosed that way, I guess you could say. And it's the form of abuse that women say is the hardest to heal from because bruises heal. But the emotional ones that psychological abuse causes can take years and years to heal from. So also, another big category besides the mind games is the isolation. So, keeping them from friends and family could be outright telling them not to spend time with friends and family, or it could be, you know, allowing them to go spend time with friends and family, but then they pay for it later. So, there's some type of punishment for doing that. Moving her from place to place, or church to church, to keep her from having any kind of support. So that's very common. And then another category in here, and I'm just keeping them very brief, is stalking behaviors, which stalking should be taken very seriously because 75% of those who commit homicides are stalkers. So, this is everything from following, showing up uninvited, not leaving when asked, to the use of spyware, which is often free or cheap. So, you know, those air pods, they drop them in people's purses or put them in places in their car or whatever, just so they can follow them where they're going, those types of things. And among our younger generation, a common stalking behavior would be multiple calling and multiple texting. So, the second closest that comes to emotional abuse would be verbal abuse. And most of us get the types of verbal abuse that are obvious, the yelling, the swearing, the name calling, the, you know, put downs. I mean, things that are really obvious. And this is a huge category and not well understood because we have all used some verbal abuse in our lives. So, everything down to things that are more subtle, like the silent treatment as a way to control the conversation or sarcasm, which is actually means the tearing of flesh. So, it's not a healthy way to communicate. There's a little bit of truth to it. That's what makes it funny. But it's always at someone's expense. And we live in a pretty sarcastic world. And I, myself, can be pretty sarcastic at times after really watch that because it's really not a kind way to communicate. So, again, this is a huge category. So, we have verbal, psychological, physical, financial, lots of financial control and abusive relationships. Most of our men who are abusive use financial control. So, he's making all the financial decisions. He's controlling the finances, or he allows her to have some access to finances, but not all by hiding assets and hidden accounts, things like that. Or maybe making her handle all the finances while he goes out and misspends. So, then it's her fault. And now he has a reason to abuse her. And even once they separate, financial abuse continues by not paying a spousal or child support. So, I tell our women to not depend on that, do what they need to do legally, but not to depend on it because it's very hard to get that money back. So, we have verbal, psychological, physical, financial, sexual, which people get that one too. Rape, unwanted touch, attacking body parts, making her dress a certain way or not dress a certain way. It could include extreme jealousy, which is, again, goes right back into those stalking behaviors. So, it's these pornography affairs, sexual name calling or sexual putdowns or sexual jokes. Again, another really big category. So that a lot of times some more subtle things that people don't recognize as being abusive because a lot of people use it, like the sexual name calling or sexual using sexual cuss words. So, I always have to go through those verbal, psychological, physical, financial, sexual property. We don't always think about property being abusive. But if an abuser can convince his victim that he's dangerous, he never has to be physical. And so, he might punch the hole right next to your head. I had a woman tell me this. And then he saw the fear in her face, and he said, “What? I didn't even touch you.” But the message was, this is what could happen to you. So, property is not always it can include, but it is not always the breaking of things or throwing things. It could be slamming doors, slamming hands on the table. But it could also be moving property to make her think she's going crazy. So, she has a place she keeps her keys. He moves them to make her think she's going crazy, that she can't remember where she's putting things anymore. So, you always have an overlap in an abusive event. It's never just one form of abuse unless it's just psychological and very subtle. But property abuse also includes the use of weapons. In the groups that we've been doing with men for the more than two decades that we've been working with them, usually they're not using the weapon there. It's the implied threat of use of weapons. So, we had one woman who went to her boyfriend's house, and he came out of his bedroom with a knife and laid it on the table and said, “I just don't know what I'd do if you left me.” Or we had many guys in the program for tapping knives while they create and continue arguments with their partners. So, it could be any misuse of any property. It could even be gift giving to get her to comply back into the relationship. So, it's not always what you think of when you think of like guns and knives. It doesn't have to be that way. It can be very subtle. So then we have spiritual abuse, spiritual abuse. Since we're a faith-based organization, we talk about the misuse of scripture. So, he's using scripture to get her to comply, to get his way. And God's word is a balance between judgment and love and mercy. And when you remove that love and they're just going with the judgment side of God's word, you are misusing God's word. It's not what God intended for his word. He did not ever intend for the word to be weaponized against a person, especially in an intimate relationship. So, we talk about the difference between submission and oppression and how they are different from one another in our groups. It's also for our men who attend church regularly. I always tell pastors, if you've got a man who's coming to you and he's working his way through the church leadership and he's being very humble and he's telling you that he knows he has his issue, but he's concerned for his wife that he's not really being abusive. That she just thinks he's being abusive to her because she's experienced abuse in the past or she has mental health issues or she's cheating on him, which is usually not true. They're doing this to discredit her while they're doing what we call public image management to make themselves look good to the public. So, they're involved in all kinds of things. It may be on the church council. So, you know, when they tell their church leadership this, it's hard to believe. It's hard for them to believe when she comes forward and says this is what's actually going on in my relationship because they've not experienced that from him. He's been a great guy around them. So, questioning her theology, her salvation, keeping her from going to church, making her go to church, moving her from church to church, things like that, too. And then the last one is animal abuse. And of course, we think about harming animals. And of course, when you harm an animal, that is animal abuse. But in terms of the work we do, it's about using the animal to control the person in some way. And that might include the threat to get rid of it, the threat to harm or the threat to kill or the doing of those things or neglecting, not like not feeding or watering the pet. But it could also be things like getting a pet she's allergic to or afraid of or withholding affection from her while he's being overly affectionate to the pet. We have lots of women who tell us about that. So, again, it's not about necessarily harming the pet as much as it is about using the pet to gain control. You have to remember that abuse is about power and control and abuse means the misuse of. So, anything can be misused, not just physical hitting and punching and misuse of our strength, but anything can be misused. And when it's used to gain power and control in an intimate relationship. It's a pattern; that's when you're looking at someone who has an abusive personality. Laura Dugger: (12:57 - 13:27) Wow. Thank you for laying that foundation and expanding our definition. It sounds like so many sins, domestic violence can be insidious, and it can usually begin with a very charming spouse who eventually becomes more and more abusive. So, have you found that people more easily recognize when they're in an abusive relationship or is it surprising and confusing to them? Stacey Womack: (13:28 - 16:58) It's mostly confusing and surprising, maybe in that order. You know, since I work with these men, too, there are really great things about them. There's really good qualities I see in them. And that's what these women fall in love with, these really great qualities. And these men can be extremely charming. And even if you haven't been raised in abuse and you find yourself in an abusive relationship, sometimes it's because you were in a really vulnerable place when you got involved. And it just felt really good to have somebody come in and be so big and strong and great in your life. Or there's other times guys are just so good at this that they're just believe completely. There's no reason not to believe, right? I mean, you trust somebody because you expect them to be telling you the truth. So, it usually starts off very subtle and it gradually increases. So, he might start questioning. So, is that what you're going to wear? Or, you know, well, that's a lot of makeup. Or maybe, you know, telling her that he doesn't agree with something that she agrees with and that maybe her friends and family aren't good for her and maybe she needs to distance herself from them. We've had women tell us that that happens to them. So, we have a checklist on our website under am I in an abusive relationship, basically. And underneath that, there's actually a PDF that they can print out and check off. And it usually starts off with things like, are you surprised by his anger? Does his anger scare you? You know, and then we work down to more obvious forms of abuse. But when a woman goes through that list and it's actually degenerate. So, a male or a female could go through the list. And they could go through it and they could determine, am I experiencing a pattern of these behaviors in my life? Marriage should be the safest place for you. And when it's not, there's something wrong there. And we do work with women who are abusive. So, I do want to acknowledge that there are male victims out there. And when they call us, since we don't have a group for them, because perpetrators believe they are the victims. So, if I opened a men's victim group, I would get a room full of perpetrators. Male victims tend to say very similar things to our female victims and behave in very similar ways that our women behave as well. And so, we refer them out to counselors that we trust. And, you know, and women can be what we call primary aggressors in the relationship. And they act and talk and say the same kinds of things as our male primary aggressors. And most primary aggressors are male because it just works better for them. They're bigger, they're stronger, they're given privilege that women are not given. So, it just works better for them. But there are women out there who do that. And then there's those relationships where both parties are using abused. But one is a primary and one is a secondary. It doesn't make the abuse okay. It doesn't even make it okay when you or I say something or act in a way that disregards or disrespects another person. That's sin. So, I think that we need to be really honest with the fact that this is a human issue. And that it's okay to come out and say, you know what, I have a problem with this. And I need help. And that's what we're trying to offer for both the men and the women that we serve. Laura Dugger: (16:59 - 17:21) And I'm just simplifying it. But in my mind, when you talk about primary and secondary, it makes me think for that secondary person, just simply hurt people, hurt people. So, is that what you're talking about? Where they are not the initiators of the abusive behavior, but when they are abused over time, they respond with abusive patterns as well? Stacey Womack: (17:21 - 19:17) Yeah, abuse is a learned behavior. So, if they grew up in a home where abuse was present, you know, as much as you don't like some of those negative things that we all get from growing up, we get good things and bad things. We often end up repeating them until we learn something different. And so, some of our women in our secondary aggressors program, you know, have had to fight their entire life to survive. And sometimes it's just safer to be the aggressor than it is to be the victim. And so, a lot of times when women are using abusive behaviors, it's more about trying to be heard or it's payback. So, they don't really gain power and control from their abuse, not really. It's usually when they're abusive, the women are just getting payback for what their abuser did. So, one woman, her and her husband had an argument and he's this big guy. And so, to get back at him, we would call this properly anal and psychological. She took the pillow and rubbed it all over the cat because he's allergic to cats and put the pillow back on the bed so he'd wake up with puffy eyes. It's a very passive form of abuse, but it is a way to get back at him. And then we have those women who just fight back verbally and they can. I had this little gal, not probably hardly even 100 pounds. She could bring a 200 pound, six foot tall husband to his knees with just her words. And this is a woman who had to fight her entire life. So, you know, you can see there's times where relationships where there's more. I don't really like the word mutual, but there's they're both using abusive behaviors, but it's the only way they know how to live life. And so, the women come out of this program saying, now I understand that his abuse to me does not excuse my abuse to him. And I have power to make choices that will bring change to my life. And that's a powerful place to be much more powerful than being a victim. Laura Dugger: (19:18 - 19:45) Absolutely. And I think the hope that I'm hearing is when you say abuse is a learned behavior. Does that mean we can learn our way out of it as well? So, anyone who is in an abusive relationship or is finding if they're listening to this, maybe they find out that they are the abuser, you can learn your way out of it then? Stacey Womack: (19:45 - 21:27) You can. It takes a tremendous amount of work. But both the victim and the perpetrator or the survivor, they have to learn new tools, both of them, because we have women who get out of abusive relationships who find themselves right back into another abusive relationship. The tools that women use in abusive relationships are amazing. The ways that they do things to survive the abuse is absolutely amazing. But those same tools do not serve them well once they're out of abuse. Some of them get into healthy relationships, but they're still using those old tools that they picked up during the abusive relationship. And so, they come to group a recovery group so that they can heal from that and learn a new way and let go of that pain and hurt and learn behavior so that they can also be healthy in that relationship with that new partner. So, and he also and for the abuser, someone who's like this is they've been the primary aggressor in the relationship and they have a lifetime of picking up belief systems that have given them permission to behave that way. And that doesn't change in 12 weeks. Programs for those guys and those gals should be long; thirty-six weeks the absolute minimum. I think a year or even two years is better because you need practice to sustain change. We have lots of guys who change, but getting that sustained change takes lots of accountability and lots of hard work. And it's difficult to do. But we have those stories of couples that make it. There's a lot more that don't make it. All the men make some changes, but often not enough to save the relationship. So, it varies. Well, and with your programs, what are some of the things that you do offer for someone who finds themselves in an abusive relationship? Stacey Womack: (23:40 - 28:08) Yeah, so our largest program is called Her Journey and it's a victim survivor recovery program. So, it doesn't matter what form of abuse you experienced or are experiencing. It could be years ago even. And we have this, it's a 15 week program, but we lead it year-round so you can just start immediately. It's one of the things that we found out as we've been doing this national campaign is that we're the only ones that we've found that are free. It's a free program. We have Zoom. So, we have every day of the week covered. If we don't have something right in your own state, in your county. But we're in-person groups in 21 states right now and looking to lead more or teach more leaders how to lead the program in their community, or in their centers, or in their missions. They're often held in churches. It's all confidential. The women just call in. They don't have to give us their real name. They don't have to give us any information. They don't want to. We just ask whatever name they use. They keep using the same name so we don't care if they say their name is Minnie Mouse. That's fine with us. Just so that we can keep track of it for grant purposes. But in that group, it's not a process group. It's really about hearing God's heart around this issue. And they do get training around domestic violence. But we also go through other topics like dealing with anger, depression and loneliness and just all the different things that happen throughout this process. Learning how to appropriately boundary set and what to do and what's going to work with an abuser. What's not going to work with an abuser. Those types of things. And so, we found that we just keep it open so the women can join immediately. Because if we don't help them right when they're asking for the help, we'll lose them because the abuser will very quickly work to move them back into the relationship, which is part of the cycle of abuse. And because we want the relationship to work and we want to believe him, we do. And so, women, you know, leave on average seven times before they leave for good because we don't get into a relationship to see it in. And so, when I talk and train pastors and I had a pastor say, “Well, she's just looking for a way out.” I'm like, “No, that's not true.” These women do everything, including couples counseling, which is something that does not work when abuse is the issue and power control is the issue. And most pastors that I haven't heard of any seminary that actually does a whole course on domestic violence, they get a little bit of couples counseling and that's it. And even counselors don't get trained in domestic violence. So, this is only a very small portion of counselors. So, I would tell these women, if you're listening to this now, that they shouldn't do couples counseling, but they should look for a counselor who has 40 hours of victim advocacy training from an advocacy agency and that he needs to go work on his own issues with an agency that deals with domestic abuse intervention. And a lot of times the things that she thinks, or they both think, they need couples counseling for go completely away once he does the work he needs to do. So, the communication problems, the anger issues, all those things that they think are the cause are no longer an issue. Most of our couples don't even need couples counseling after this because he has learned to love like Jesus loves. That's what we teach is like, what does that mean to be Christlike? What does that mean to lay your life down? So, but during our time that we work with women or men, secondary or primary aggressors, female or male, we in our groups talk about focusing on that themselves and their relationship with God and not focusing outward because God will take care of that. Sure, pray about it, but release it. That's God's responsibility. You only have control of this relationship is between yourself and God. And that's where you're going to seek Him about what He's calling you to do in this situation. And every person's a little bit different. It's not my place to tell someone whether to leave or stay. And we're not here to promote divorce. And we know the women want their relationships to work. We know they want men to make it to the other side. We do, too, but we cannot make that happen. So, all we can do is present the information and allow the Holy Spirit to do the work. And the person has to be willing to receive the help. Laura Dugger: (28:09 - 28:35) Absolutely. Well, and I even think about how this conversation came about. We had multiple women of different ages, all of them believers, who were reaching out and sharing a little bit of their experience in marriage and sharing some potential abuse. And I actually reached out to some publicists that I work with and said, “Who would be able to speak to this?” And so that's how we got connected. Stacey Womack: (28:36 - 28:36) Yeah. Laura Dugger: (28:36 - 28:54) Very much appreciated your book. And as I was reading it, there was one story that was particularly haunting. And it was about a pastor who ended up begging you for training. So, can you recall what happened? Stacey Womack: (28:54 - 34:09) Yeah. You know, a lot of pastors just it's not that they don't care. It's just that they're very uneducated around this. So even myself, when I first started, I would give people really unhelpful advice before I even began this work because I didn't understand it well. And so, he had encouraged this woman to forgive and go back, which is a typical response. You know, submit more, pray harder. Those are the kinds of things that a lot of women get from churches. And so, she did. She went home and then he murdered her that night. And so, this pastor was absolutely heartbroken, as you can imagine, and was calling in and asking, please, please, please train us because we don't want this to ever happen again. You know, and honestly, there are some pastors out there that believe that women should stay in the relationship, even if they are being abused and that God will bless them through their suffering, even if it means death. I don't agree with that. See, I think that God would never sacrifice a person for the sake of the relationship. But we do as the church sometimes because we're so concerned about the relationship. The relationship is important and God has got a reconciliation and we want reconciliation, too. But God also tells us the prudent man or woman hides from danger and he cares about us as individuals. And He has called us to live life abundantly, not to just bear it, you know. And so, I think that we need to really look at that. And being raised as a pastor's daughter that, you know, I was taught that way. So, it was a really it's been really hard, you know, working in the faith communities really struggles with this. And, you know, this idea that, well, a separation might lead to divorce. But separation is really functional in these relationships because she needs safety so that she can talk, speak the truth from this other person. And she needs time to see whether or not he's willing to actually get the help that he's been promising he'll get. And they need time to see if he can actually work through that. Or is he just using a program as another controlling behavior to get her to come back into a relationship? If she waits long enough and we usually say six months and he's mad that she's not letting him back home. He goes right back to all the bad behaviors he was doing before. And he pulls all the money out of the bank and does all these crazy things. And she has her answer, which is heartbreaking. The women are heartbroken over this because they want their relationships to work. We cannot emphasize that enough to the faith community. These women want their relationships to work and that they did not sign up for this. They did not sign up for these. They did not say, “Oh, yes, I am agreeing to get married and be abused.” That's how they agreed to. And he made a promise to love and cherish. And the Bible commands men to love their wives like Christ loves the church and to lay his life down. That means he gives up his way to bless her, that Jesus came to serve, not to be served. So, his role is one of being the lead servant in the relationship. He should be the first to be serving her. And how do we respond as women? We feel loved and cherished and cared for when that happens. My husband's so good at this. I have to be careful if I say I'm thirsty, he's up getting me a glass of water. He's so quick to serve. But this is the kind of behavior that blesses us. And men are surprised that the very thing they want, the respect, honor, all those kinds of things. They get it by doing the very opposite of what they're doing, by giving up their way, by embracing humility. And humility is hard because it means it's not about being 50-50 or being fair. It's about going 100 percent or more. So, my husband would share because he leads manuscripts with me. And he says, you know, guys, you know, if Stacy's at 20 percent, then I need to go 180. I need to go in and fill in that gap for her. And there's times I do that for him, too, because unhealthy relationships like that's what we do for women. But an abusive relationship, that's never what happens. And an abuser has and this is very popular, a narcissistic view of his world. He may not realize that it doesn't mean he has narcissistic personality disorder. Those guys are very different and they stick out sore thumbs, but they all behave narcissistic, narcissistically, meaning their world revolves around them. So, they want you to manage their emotions. They blame you for when they're unhappy. And even if you weren't even present, when whatever happened, that he's unhappy that he still blames you for it, which doesn't make sense. It's that crazy making. It's like, “Wow, how am I the cause of this when this happened at work? I don't understand.” You know, so there's all that craziness that goes on. But, you know, I'm so honored to get to walk alongside men and women in their process of change and their aha moments and their realization that God loves them and that God values them and that they're important and they're regarded. And that because of that, abuse is never OK. It's never OK. Laura Dugger: (34:10 - 35:21) The few follow ups with that, then to go back to an earlier point, you're making a connection for me where I'm thinking back to a few episodes. It was one was with Leslie Vernick and one was with Dr. Diane Langberg. So, I can't remember who said this. I can link to both in the show notes, but it's what you're speaking to that as we study the scriptures and we see Christ likeness and how to become more Christ like and what God really says about these topics. They were pointing out he cares about the individual more than the institution. Yeah. And so, I think there's a lot of re-education for us in the faith community, unfortunately. But then also two follow up questions. One, as you're talking about narcissism or a narcissistic outlook, is there ever from your experience? I'm familiar with some of my friends who are in relationships like that or acquaintances that I know. Is there ever hope for the husband who has narcissistic tendencies or personality disorder to repent? Have you ever seen that? Stacey Womack: (35:21 - 37:16) Absolutely. We have men who've done a really great job of working away from being self-focused and selfish. That's really what it is. They read these journals and we make comments on them and they have to come up with the beliefs that gave them permission to behave this way. So, we had one guy and you could just see a selfishness that I always wrote. The belief is I'm most important. I've read it every on every single journal. And he finally came to group after a few months because I really realize I'm really selfish. And so, as we help them to see this, it begins to change things and they begin to make different choices and try new things. As someone who has a narcissistic personality disorder, like any personality disorder, those are not medicated. They can't be medicated and it takes a longer time. So, I've had some training on narcissistic personality disorder and I recognize those guys. Any of those guys generally with personality disorders because they don't see themselves. So, the group laughs at things I say, but they don't understand why they're laughing. And those guys need like seven years of counseling with someone who specializes in narcissistic personality disorder. If they're willing to do the work that that they can actually make changes. And there's a gentleman who who's travels the country speaking on this. He says that's his favorite group of population he works with. I can't say the word narcissistic personality disorder men. And he says, you would like this man today. But he had like multiple failed businesses. He'd been very successful, but they're failing businesses, failing marriage. And he worked with them and you don't work with them the same as just typical counseling. It's not the same because they don't see themselves. So, we need more people who specialize in that. Laura Dugger: (37:16 - 38:12) I agree with you there. And it's just helpful to have that reminder of hope. Even this morning in my quiet time, I was reading in the Gospels and it was Jesus saying and everything he says is true. That with man, it seems impossible, or it is impossible. But with God, we know that all things are possible. So, appreciate the way you answered that. And then also a follow up would be we heard that awful story of what happened with the physical safety when you're looking at physical abuse. But then, Stacey, would you recommend wives have the same boundaries? Are they taking time away to physically protect themselves if there's any type of abuse? If there is financial abuse, let's say, are they given the same recommendations as somebody who is in an emotionally abusive relationship? Stacey Womack: (38:13 - 40:49) Well, the emotional abuse is always there. You don't have any other forms of abuse without emotional abuse. So, our women, we talk about boundary setting and different boundaries they can begin trying. But oftentimes the only boundary that actually works to be able to say for us to be able to make it, you need to go get help. And while you're getting help, we need to be separated so they're not focusing on one another. So not all of our women separate. Some of the women try to work through it while he's still in the home. My experience is that it slows the process down, extremely slows the process down because they're still focusing on one another. And he's coming home and he's sharing with us how great the program is. But then he's going home and he's angry and he's taking it out on her. So, it creates some unsafety for her. And I just want to say this because I think a lot of people don't understand that there's physical safety and then there's emotional safety. And we downplay the emotional safety. But emotional safety is as important as physical safety. So, I have some pastors who think that if we share things like this, that we're going to be making victims. That's not true. I don't relate to the books that are out there. You know, oh, yeah, I've experienced that. It's not going to make victims. You either relate to it or you don't. But this emotional safety might mean needing to separate from that person. Not because you fear their physical abuse when you haven't been physical. But a lot of our women say he's never been physical, but I'm fearful of him. And so in order for her to get some healing and some help while she waits to see whether or not he gets help and she's really hoping he will. She needs that space. And so, yes, I think that in a lot of scenarios, separation is a key. And then we have some couples where the where the husband does is not willing to do the work he needs to do, but he's not controlling the finances. So, they remain married but separated for the rest of their lives. Not very many couples can do that because most abusers are going to control finances. So, but that's why I was saying it's not our place to tell a woman to leave or to stay. That's not our job. It's our job to walk alongside them when they seek God for what they should be doing and what boundaries they should be setting. And they can try a lot of different things before it gets to that point. And it just there's no easy answer for this. Laura Dugger: (40:50 - 41:05) It's very complex. Yes, it's very complex. But even when you say there's a lot of things they could try. Could you give a few examples or is there a place on your website where they can go to get some ideas and some help for those earlier stages? Stacey Womack: (41:06 - 43:43) Well, we talk about this in our journey class again, which is free. You can join at any time in our class on boundaries. And so, it depends on the severity of abuse that's going on. But most women, when there has been physical abuse, will start off with things like and we talk about a boundary has to have a consequence. Otherwise, it's not really you can't. It doesn't work. But these men are boundary breakers. So, a boundary would be like saying, if you continue to yell at me and call me names, I'm going to leave and go to my friend's house. So, there's the boundary and there's a consequence for breaking. But then we also realize when we're talking to them that he may decide at some point he's not going to let you leave. So now he's blocking the door. So, then it might be, you know, if you're going to treat me this way, I'm no longer going to cook meals or do your wash. And it usually works its way down to I'm no longer going to have sex with you. I'm not going to sleep in the same room with you. And once you get to that point, the only other thing you can do is do a physical separation with the heart to actually reunite. That's what these women want. And some of our couples have been separated for three years. But the husband is like, let her head home. And he's doing his work and they're interacting again. But he doesn't move back home for three years because he's committed to giving her whatever space and time she needs to heal. Because he recognizes that he's the one that's caused unsafety. And so, what is three years if you can have a healthy relationship for the rest of your life? And so that's what we were looking for our men to do. It's like even if you're disappointed, if she's saying, I'm not ready for you to move back. And you can say, I feel disappointed, but you know what? I get it. And whatever you need, I'm willing to do that. That's accountability. That's humility. And really, they need to have other men who are mentoring them to hold them accountable. And again, not a lot of people are taught this. And so having the right mentor even for this is really important. Even a right counselor for them to work with their childhood issues. But those are some ideas for some boundaries. Boundaries always have to have consequences. But even if a woman gets a protection order or restraining order, most of those are violated. So, we tell the women be prepared to call the police when he violates it by texting you or by sending you a card with money in it or putting flowers on your car. Or coming to the church service that you put in the restraining order that he wasn't supposed to come to. So, you need to be ready to hold him accountable because the abuser doesn't believe you're going to actually follow through. Laura Dugger: (43:43 - 44:32) Do you love The Savvy Sauce? Well, and what if somebody is listening right now and they're automatically assuming, well, this isn't happening to anyone I know and it's certainly not happening in our church. What would you like to directly say to them? Stacey Womack: (44:33 - 45:40) I'd like to let them know that statistically one in three women experience domestic violence, stalking, or rape by an intimate partner. And the statistics in the church are no less than they are outside of the church. So, every church has families in their church who look like the perfect couple. When I started leading a group in my own church, I was so shocked. I kept telling myself, stop being shocked when I have another woman privately come up to me and tell me that they were in an abusive relationship because they just, they were involved, and they were just leading Sunday school. And they were, just look like this beautiful family and you would never have known. There was no way to know that this was actually going on. So, you know, the reality is that it's happening. We're just not aware of it. It wasn't on my radar before God called me into this work. I didn't think it was affecting my life. I didn't think of much thought. But the reality is I feel like it's worse now than ever and not necessarily more physical abuse, but just abuse in general, the misuse of things to gain control. Laura Dugger: (45:42 - 46:18) Well, and I appreciate the way you helped give a paradigm shift. You offered this on page 36 in your book and you quote saying, “At ARMS, we do not believe God considers domestic violence and abuse an adult issue. Instead, we believe he sees it as child abuse. We are his children.” So, Stacey, with that in mind, how does this clarify how we can respond appropriately, and in a Christlike manner, when someone does report abuse? Stacey Womack: (46:20 - 47:51) Well, I think a lot of times when women actually have the courage to tell you what's going on, it's a very courageous thing to do. She's risking a lot by telling you. So, we really need to listen carefully and believe her. And I'm thinking about how, you know, that I'm trying to think now. How did you word your question so I can answer it correctly? If you think about that example you gave, if your child was being beaten, harassed and abused in school and came home crying, you wouldn't just sit in your chair and say, go back and pray harder and win them over by your quiet and gentle spirit. We would go down and we would ask the school, what are you doing about this? Who's doing this and what are you doing about it? And if they didn't do anything, we wouldn't think twice to remove our child from that environment. But in these situations where you're working with two adults, she may not be ready to leave. She's just sharing with you that this is going on. She actually is hoping you'll go talk to him so that you'll fix him. But that is not a safe thing for you to do. And she may not realize that. I tell pastors that all the time. You don't, but you're not going to go to him to check out her story or go talk to him like she's asked you to. Instead, you're going to go, what can we do for you right now? Let's get you some help. And there'll be a time where we can address things with him. But right now is not that safe time. So, let's get you connected with an organization that can help you give you the resources that you need to begin your journey of healing and discovering what God wants you to do. Laura Dugger: (47:52 - 48:07) That's good. And also, this is a tricky question, but what are your views for having biblical reasons for divorce, specifically as it relates to those types of abuse that you shared with us? Stacey Womack: (48:08 - 50:27) Sure. You know, I think God understood that divorce would happen. That's why it got written into the law. And it says, “Because it was the hardness of hearts.” So, it wasn't God's design. It wasn't the way God wanted it to be, but that there was made allowances for this. And when people and women are often quoted, God hates divorce. They're not really giving the whole scripture and Malachi in the amplified version. It says, “God hates divorce and marital separation and him who covers his wife, his garment with violence. Therefore, keep a watch on your spirit, that it may be controlled by my spirit, that you deal not treacherously and faithfully with your marriage mate.” So, we actually got some really good articles that go in depth on the original Hebrew, that Malachi verse was written in there. But, you know, I do believe that someone is breaking the marriage covenant to love, cherish, lay his life down for when they bring abuse to the relationship. Again, God would wish and hope that we would humble our hearts, not be stiff necked and submit to Him and what he's trying to teach us and grow us in. But He does not force us. And so that leaves women in these situations very little choices if their husband is unwilling to get the help that he needs. So, I am all for divorce. And I know that that marriage is hard. And my husband and I have been married for 44 years and we've gone through our struggles. And there are times that I thought this isn't going to work. But you know what? We hung in there because we knew that for us, because it wasn't an abusive situation, that we need to stay in there and work on it. And we did. And we're so glad we did. So, believe me, I'm not promoting divorce. I just know that there has to be a place and known for it because of sin in the world. And again, it's heartbreaking and it destroys not just individuals, families, but our society is being destroyed by the breakdown of the family. And abuse is one of the most insidious things. It starts in the home and it's cyclical. So, it's passed on from one generation to the next. Laura Dugger: (50:29 - 50:38) Well, so, Stacey, how can we become more aware of abuse that is happening all around us? And what can we do that's genuinely helpful? Stacey Womack: (50:40 - 52:13) Well, I think getting the education, you know, in my book that on the front lines of abuse strategies for the faith community, just a little book. But has a ton of information in it is a good place to start. And I have some do's and don'ts in there. But, you know, I think that when you might recognize someone's being in an abusive relationship by the way her husband or whatever is speaking to her. But she doesn't see it because most victims would never call themselves a victim of abuse because they don't relate to that at all. That's not how they would define it. So, I think sometimes just privately sharing with them. No, that behavior was really abusive. And she may not like that. She might even get upset. But I think just being honest with the fact that this is going on. And I encourage pastors to preach about abuse and really abuse oppression. And the Bible has a whole lot to say about oppression. There's already sermons out there that they can pull from. I suggest pastors preach on it twice a year. So, October's domestic violence awareness month. And then maybe run Mother's Day again, not on Mother's Day, but around Mother's Day. Talk about it again, not as a caveat to relationships where it's just mentioned in a sermon, but an actual entire sermon on this issue. And I can promise you that the church gets the education they need. They don't have to be experts, but they need to know what resources are out there for them and they make it safe. Both men and women will come forward and ask for help. So, we need just to be a listening ear and care and ask how we can help. Laura Dugger: (52:14 - 52:29) I think that's a good practical encouragement that you've shared. And I want to add all of these links in our show notes. So, is there anywhere else that we can go to after this conversation to continue learning from you? Sure. Stacey Womack: (52:30 - 53:32) We have our website that has a ton of information on it, abuserecovery.org. So, there's just so much on there. We have blogs and we have all kinds of information that the faith community can download for free. Whether you're just in the community or you're a church leader, there's all kinds of things you can download. We have a pastor's packet. There's just we'll give you other books to read that you can do more education around this again. I know as my father being a pastor, that pastors are busy enough. We're not asking pastors to do more than what they're doing. We're just asking them to be educated and know where they can send their people that's safe, where they're going to get sound and supportive help. And to just be open to looking at things from a little bit different perspective. But our website just has so much on it that they can get for free. And again, our women's intervention groups, our recovery groups are free. Laura Dugger: (53:33 - 53:49) Thank you for sharing that. And you may already be familiar that we're called The Savvy Sauce because savvy is synonymous with practical knowledge or insight. And so, Stacey is my final question for you today. What is your savvy sauce? Stacey Womack: (53:50 - 54:39) What is my savvy sauce? You know, when I think about how God called me into this ministry in the end, no matter what we do, I think it's about obedience to God. And so, this was not on my radar. I would never have chosen it. And so, for me, it's about being obedient to what God has called me to do, even when it's hard and even when it's unpopular. And walking in that so that when I stand before God, I can say I did what you asked me to, to the best of my ability, even with all my flaws. So that's really, I think, my heart is to be that way. Be a leader like Moses, who God says he was the most humble man who ever lived. I'd love to be like that with the heart of David and the boldness of Paul and on and on and on. Laura Dugger: (54:39 - 59:13) So, yeah, I love that. Well, I told you before we pressed record that I have experienced so much fruit of the spirit from you already with your gentleness. And this is not the first time we tried recording. We prayed together that God would do immeasurably more than all we could ever ask or imagine through this conversation, because we had so many technical difficulties and even had to reschedule the date for this. But Stacey, I'm so grateful you persevered because you are well-spoken and you tackle this extremely difficult topic with wisdom and grace. And so, I'm very grateful I got to learn from you today. And I believe God's going to continue working through you, even for the saving of many lives. So, thank you for your work and thank you for being my guest. Thank you so much. I appreciate it. We need a savior. But God loved us so much, he made a way for his only son to willingly die in our place as the perfect substitute. This gives us hope of life forever in right relationship with him. That is good news. Jesus lived the perfect life we could never live and died in our place for our sin. This was God's plan to make a way to reconcile with us so that God can look at us and see Jesus. We can be covered and justified through the work Jesus finished if we choose to receive what He has done for us. Romans 10:9 says, “That if you confess with your mouth Jesus is Lord and believe in your heart that God raised him from the dead, you will be saved.” So, would you pray with me now? Heavenly Father, thank you for sending Jesus to take our place. I pray someone today right now is touched and chooses to turn their life over to you. Will you clearly guide them and help them take their next step in faith to declare you as Lord of their life? We trust you to work and change lives now for eternity. In Jesus' name we pray. Amen. Yeah, Michael Hingson ** 02:33 yeah, that works. Well, I'm really glad you're here. Why don't we start by maybe you talking to us a little bit about the early Rachelle growing up and some of that stuff. Rachelle Stone ** 02:43 Yeah, I was lucky. I grew up in rural Western Massachusetts, little po doc town called Greenfield, Massachusetts. We were 18 miles from the Vermont border, which was literally a mile and a half from the New Hampshire border. So I grew up in this very interesting area where it was like a tri state area, and our idea of fun growing up, well, it was, we were always outdoors, playing very much outdoors. I had three siblings, and I was the youngest, and it was one of those childhoods where you came home from school, and mom would say, go outside, don't come back in the house until you hear the whistle. And every house on the street, every mother had a whistle. There were only seven houses because there was a Boy Scout camp at the end of the road. So as the sun was setting and the street lights would come on, you would hear different whistles, and different family kids would be going home the stone kids up, that's your mom. Go home, see you next time that was it was great. And you know, as I got older and more adventurous, it was cow tipping and keg parties and behind and all sorts of things that we probably shouldn't have been doing in our later teen years, but it was fun. Behind Michael Hingson ** 04:04 is it's four wheeling, Rachelle Stone ** 04:08 going up rough terrain. We had these. It was very, very hilly, where I was lot of lot of small mountains that you could conquer. Michael Hingson ** 04:17 So in the winter, does that mean you got to do some fun things, like sledding in the snow. Yeah, yeah. Rachelle Stone ** 04:24 We had a great hill in the back of our yard, so I learned to ski in my own backyard, and we had three acres of woods, so we would go snowshoeing. We were also close to a private school called Northfield Mount Hermon, which had beautiful, beautiful grounds, and in the winter, we would go cross country skiing there. So again, year round, we were, we were outdoors a lot. Michael Hingson ** 04:52 Well, my time in Massachusetts was three years living in Winthrop so I was basically East Boston. Yeah. Yes and and very much enjoyed it. Loved the environment. I've been all over Massachusetts in one way or another, so I'm familiar with where you were. I am, and I will admit, although the winters were were cold, that wasn't as much a bother as it was when the snow turned to ice or started to melt, and then that night it froze. That got to be pretty slippery, 05:25 very dangerous, very dangerous. Michael Hingson ** 05:29 I then experienced it again later, when we lived in New Jersey and and I actually our house to take the dogs out. We had no fenced yards, so I had to take them out on leash, and I would go down to our basement and go out and walk out basement onto a small deck or patio, actually, and then I had to go down a hill to take the dogs where they could go do their business. And I remember the last year we were in New Jersey, it snowed in May, and the snow started to melt the next day, and then that night, it froze, and it and it stayed that way for like about a day and a half. And so it was as slick as glass is. Glass could be. So eventually I couldn't I could go down a hill, it was very dangerous, but going back up a hill to come back in the house was not safe. So eventually, I just used a very long flex leash that was like 20 feet long, and I sent the dogs down the hill. I stayed at the top. Rachelle Stone ** 06:33 Was smart, wow. And they didn't mind. They just wanted to go do their business, and they wanted to get back in the house too. It's cold, yeah? Michael Hingson ** 06:41 They didn't seem to be always in an incredible hurry to come back into the house. But they had no problem coming up the hill. That's the the advantage of having claws, Rachelle Stone ** 06:51 yes. Pause, yeah, four of them to boot, right? Yeah, which Michael Hingson ** 06:54 really helped a great deal. But, you know, I remember it. I love it. I loved it. Then now I live in in a place in California where we're on what's called the high desert, so it doesn't get as cold, and we get hardly any of the precipitation that even some of the surrounding areas do, from Los Angeles and Long Beach and so on to on the one side, up in the mountains where the Snow is for the ski resorts on the other so Los Angeles can have, or parts of La can have three or four inches of rain, and we might get a half inch. Rachelle Stone ** 07:28 Wow. So it stays relatively dry. Do you? Do you ever have to deal like down here, we have something called black ice, which we get on the road when it rains after it hasn't rained in a long time? Do you get that there in California, Michael Hingson ** 07:41 there are places, yeah, not here where I live, because it generally doesn't get cold enough. It can. It's already this well, in 2023 late 2023 we got down to 24 degrees one night, and it can get a little bit colder, but generally we're above freezing. So, no, we don't get the black ice here that other places around us can and do. Got it. Got it. So you had I obviously a fun, what you regard as a fun childhood. Rachelle Stone ** 08:14 Yeah, I remember the first day I walked into I went to a community college, and I it was a very last minute, impulsive, spontaneous decision. Wow, that kind of plays into the rest of my life too. I make very quick decisions, and I decided I wanted to go to college, and it was open enrollment. I went down to the school, and they asked me, What do you want to study? I'm like, I don't know. I just know I want to have fun. So they said, you might want to explore Recreation and Leisure Services. So that's what I wound up going to school for. And I like to say I have a degree in fun and games. Michael Hingson ** 08:47 There you go. Yeah. Did you go beyond community college or community college enough? Rachelle Stone ** 08:53 Yeah, that was so I transferred. It took me four years to get a two year degree. And the reason was, I was working full time, I moved out. I just at 17, I wanted to be on my own, and just moved into an apartment with three other people and went to college and worked. It was a fabulous way to live. It was wonderful. But then when I transferred to the University, I felt like I was a bit bored, because I think the other students were, I was dealing with a lot of students coming in for the first time, where I had already been in school for four years, in college for four years, so the experience wasn't what I was looking for. I wanted the education. And I saw a poster, and it was Mickey Mouse on the poster, and it was Walt Disney World College program now accepting applications. So I wrote down the phone number, email, whatever it was, and and I applied. I got an interview again. Remember Michael? I was really bored. I was going to school. It was my first semester in my four year program, and I just anyway. I got a call back and. And I was accepted into the Disney College Program. So, um, they at that time, they only took about 800 students a year. So it was back in 1989 long time ago. And I was thrilled. I left Massachusetts on january 31 1989 in the blizzard of 89 Yeah, and I drove down to Orlando, Florida, and I never left. I'm still here in Florida. That was the beginning of my entire career. Was applying for the Disney College Program. Michael Hingson ** 10:36 So what was that like, being there at the Disney College, pro nominal, phenomenal. I have to ask one thing, did you have to go through some sort of operation to get rid of your Massachusetts accent? Does Rachelle Stone ** 10:50 it sound like it worked? No, I didn't have well, it was funny, because I was hoping I would be cast as Minnie Mouse. I'm four foot 10. I have learned that to be Mini or Mickey Mouse, you have to be four, eight or shorter. So I missed many by two inches. My second choice was being a lifeguard, and I wound up what I they offered me was Epcot parking lot, and I loved it, believe it or not, helping to park cars at Epcot Center. I still remember my spiel to the letter that I used to give because there was a live person on the back of the tram speaking and then another one at the front of the tram driving it to get you from the parking lot to the front entrance of the gate. But the whole experience was amazing. It was I attended classes, I earned my Master's degree. I picked up a second and third job because I wanted to get into hotels, and so I worked one day a week at the Disney Inn, which is now their military resorts. And then I took that third job, was as a contractor for a recreation management company. So I was working in the field that I had my associates in. I was working at a hotel one day a week, just because I wanted to learn about hotels. I thought that was the industry I wanted to go into. And I was I was driving the tram and spieling on the back of the tram five days a week. I loved it was phenomenal. Michael Hingson ** 12:20 I have a friend who is blind who just retired from, I don't know, 20 or 25 years at Disneyland, working a lot in the reservation centers and and so on. And speaks very highly of, of course, all the experiences of being involved with Disney. Rachelle Stone ** 12:38 Yeah, it's really, I'm It was a wonderful experience. I think it gave me a great foundation for the work in hospitality that I did following. It was a great i i think it made me a better leader, better hospitality person for it well, Michael Hingson ** 12:57 and there is an art to doing it. It isn't just something where you can arbitrarily decide, I'm going to be a successful and great hospitality person, and then do it if you don't learn how to relate to people, if you don't learn how to talk to people, and if you're not having fun doing it Rachelle Stone ** 13:14 exactly. Yes, Fun. Fun is everything. It's Michael Hingson ** 13:18 sort of like this podcast I love to tell people now that the only hard and fast rule about the podcast is we both have to have fun, or it's not worth doing. Rachelle Stone ** 13:25 That's right. I'm right there with you. Gotta Have fun, Michael Hingson ** 13:30 yeah? Well, so you So, how long were you with Disney? What made you switched? Oh, so Rachelle Stone ** 13:36 Disney College Program. It was, at that time, it was called the Magic Kingdom college program, MK, CP, and it's grown quite significantly. I think they have five or 7000 students from around the world now, but at that time it was just a one semester program. I think for international students, it's a one year program. So when my three and a half months were up. My semester, I could either go back. I was supposed to go back to school back in Massachusetts, but the recreation management company I was working for offered me a full time position, so I wound up staying. I stayed in Orlando for almost three and a half years, and ultimately I wound up moving to South Florida and getting a role, a new role, with a different sort of company called a destination management company. And that was that was really the onset destination management was my career for 27 years. 26 Michael Hingson ** 14:38 years. So what is a destination management company. So Rachelle Stone ** 14:41 a destination management company is, they are the company that receives a group into a destination, meetings, conventions, events. So for instance, let's say, let's say Fathom note taker. Wants to have an in person meeting, and they're going to hold it at the Lowe's Miami Beach, and they're bringing in 400 of their top clients, and and and sales people and operations people. They need someone on the receiving end to pick everybody up at the airport, to put together the theme parties, provide the private tours and excursions. Do the exciting restaurant, Dine Around the entertainment, the amenities. So I did all the fun. And again, sticking with the fun theme here, yeah, I did all of the auxiliary meeting fun add ons in the destination that what you would do. And I would say I did about 175 to 225, meetings a year. Michael Hingson ** 15:44 So you didn't actually book the meetings, or go out and solicit to book the meetings. You were the person who took over. Once a meeting was arranged, Rachelle Stone ** 15:53 once a meeting was booked in the destination, right? If they needed a company like mine, then it would be then I would work with them. If I would be the company. There were several companies I did what I do, especially in Miami, because Miami was a top tier destination, so a client may book the lows Miami Beach and then reach out to two to three different DMCs to learn how can they partner with them to make the meeting the most successful. So it was always a competitive situation. And it was always, you know, needing to do our best and give our best and be creative and out of the box. And, yeah, it was, it was an exciting industry. So what makes Michael Hingson ** 16:41 the best destination management company, or what makes you very successful? Why would people view you as successful at at what you do, and why they would want to choose you to be the company to work with? Because obviously, as you said, it's competitive. Rachelle Stone ** 16:59 Everybody well, and there's choice. Everybody has choice. I always believed there was enough business to go around for everybody. Very good friends with some of my my hardiest competitors. Interestingly, you know, although we're competing, it's a very friendly industry. We all network together. We all dance in the same network. You know, if we're going to an industry network, we're all together. What? Why would somebody choose me over somebody else? Was really always a decision. It was sometimes it was creativity. Sometimes it was just a feeling for them. They felt the relationship just felt more authentic. Other times it was they they just really needed a cut and dry service. It just every client was always different. There were never two programs the same. I might have somebody just wanting to book a flamenco guitarist for three hours, and that's all they need. And another group may need. The transportation, the tours, the entertainment, the theme parties, the amenities, the whole ball of Fox, every group was different, which is, I think, what made it so exciting, it's that relationship building, I think, more than anything. Because these companies are doing meetings all over the country, sometimes some of them all over the world. So relationships were really, really important to them to be able to go into a destination and say to their partner in that destination, hey, I'm going to be there next May. This is what I need. Are you available? Can you help? So I think on the initial front end, it is, when it's a competitive bid, you're starting from scratch to build a relationship. Once that's relationship is established, it is easier to build on that relationship when things go wrong. Let's talk about what worked, what didn't, and how we can do better next time, instead of throwing the entire relationship out with the bathwater and starting from scratch again. So it was a great industry. I loved it, and Michael Hingson ** 19:00 obviously you must have been pretty successful at it. Rachelle Stone ** 19:04 I was, I was lucky. Well, luck and skill, I have to give myself credit there too. I worked for other DMCs. I worked for event companies that wanted to expand into the DMC industry. And I helped, I helped them build that corporate division, or that DMC division. I owned my own agency for, I think, 14 years, still alive and thriving. And then I worked for angel investors, helping them flip and underperforming. It was actually a franchise. It was an office franchise of a global DMC at the time. So I've had success in different areas of Destination Management, and I was lucky in that I believe in accreditation and certification. That's important to me. Credibility matters. And so I. Involved in the association called the association of Destination Management executives international admei I know it's a mouthful, but I wound up serving on their board of directors and their certification and accreditation board for 14 years, throughout my career, and on the cab their certification accreditation board, my company was one of the first companies in the country to become a certified company, admc certified. I was so proud of that, and I had all of my staff. I paid for all of them to earn their certification, which was a destination management Certified Professional. That's the designation. I loved, that we could be a part of it. And I helped write a course, a university level course, and it was only nine weeks, so half a semester in teaching students what destination management is that took me three years. It was a passion project with a couple of other board members on the cab that we put together, and really glad to be a part of that and contributing to writing the book best practices in destination management, first and second edition. So I feel lucky that I was in this field at a time where it was really growing deeper roots. It had been transport the industry. When I went into it was maybe 20 years young, and when I left it, it been around for 40 plus years. So it's kind of exciting. So you so you Michael Hingson ** 21:41 said that you started a company and you were with it for 4014 years, or you ran it for 14 years, and you said, it's still around. Are you involved with it at all? Now, I Rachelle Stone ** 21:51 am not. I did a buyout with the I had two partners at the time. And without going into too much detail, there were some things going on that I felt were I could not align with. I felt it was unethical. I felt it was immoral, and I struggled for a year to make the decision. I spoke to a therapist, and I ultimately consulted an attorney, and I did a buyout, and I walked away from my this was my legacy. This was my baby. I built it from scratch. I was the face of the company. So to give that up my legacy, it was a really tough decision, but it really did come full circle, because late last year, something happened which brought me back to that decision, and I can, with 100% certainty, say it was a values driven decision for me, and I'm so happy I made that decision. So I am today. Yeah, Michael Hingson ** 22:57 and, and let's, let's get to that a little bit so you at some point, you said that you had burnout and you left the industry. Why did you do that? Rachelle Stone ** 23:08 So after I did, sold my my business, I worked for angel investors for about three and a half years. They brought me in. This was an underperforming office that the franchisee, because they had owned it for 10 years, had done a buyout themselves and sold it back to the angel investors or the private equity so they brought me in to run the office and bring it from surviving to thriving again. And it took me about 18 months, and I brought it from under a million to over 5.3 million in 18 months. So it's quite successful. And I had said to the owners, as they're thanking me and rewarding me, and it was a great first two years, I had said to them, please don't expect this again. This was a fluke. People were following me. There was a lot of curiosity in the industry, because this was a really big move for me to sell my company and then go work for this one. It was big news. So it was a great time. But the expectation for me to repeat, rinse and repeat, that kind of productivity was not realistic. It just wasn't realistic. And about a year and a half later, I just, I was driving from the Lowe's Miami Beach. It's funny, because I used that as an example before, to the breakers in Palm Beach. And if you know South Florida at all, it's, it's, you're taking your life in your hands every time you get on 95 it's a nightmare. Anyway, so I'm driving from the lows to the breakers, and I just left a kind of a rough meeting. I don't even remember what it was anymore, because that was back in 2014 and I'm driving to another meeting at the breakers, and I hang up the phone with somebody my. Son calls about something, Mom, this is going on for graduation. Can you be there? And I'm realizing I'm going to be out of town yet again for work, and I'm driving to the breakers, and I'm having this I just had this vision of myself in the middle of 95 slamming the brakes on in my car, coming to a full stop in the middle of the highway. I did not do this this, and I don't recommend you do this. And I opened up my car door, and I literally just walked away from my car. That was the image in my mind. And in that moment, I knew it was time for me to leave. I had gone as high as I could go. I'd done as much as I could do. I'd served on boards, contributed to books, spoken on panels. I wanted to go back to being an entrepreneur. I didn't want to work for angel investors anymore. I wanted to work for myself. I wanted to build something new, and I didn't want to do it in the DMC world. So I went home that night thinking I was going to just resign. Instead, I wrote a letter of retirement, and I retired from the industry, I walked away two and a half weeks later, and I said I was never going to return. Michael Hingson ** 26:09 And so I burnt out, though at the time, what? What eventually made you realize that it was all burnt out, or a lot of it was burnt out. So I Rachelle Stone ** 26:17 didn't know anything about burnout at that time. I just knew I was incredibly frustrated. I was bored. I was over in competence, and I just wanted out. Was just done. I had done well enough in my industry that I could take a little time. I had a lot of people asking me to take on consulting projects. So I did. I started doing some consulting in hospitality. And while I was doing that, I was kind of peeling away the layers of the onion, saying, What do I want to do next? I did not want to do DMC. That's all I knew. So I started this exploration, and what came out of it was an interest in exploring the field of coaching. So I did some research. I went to the coachingfederation.org which is the ICF International coaching Federation, is the leading accreditation body for coaches in the world. And through them, I researched Who were some of the accredited schools. I narrowed it down. I finally settled on one, and I said, I'm going to sign up for one course. I just want to see what this coaching is all about. So I signed up for a foundations course with the with the school out of Pennsylvania, and probably about three weeks into the course, the professor said something which was like a light bulb moment for me, and that I realized like, oh my Speaker 1 ** 27:40 god, I burnt out. And I was literally, at this Rachelle Stone ** 27:46 time, we're in school, we're on the phone. It was not zoom. We didn't have all this yet. It was you were on the phone, and then you were pulling up documents on your computer so the teacher couldn't see me crying. I was just sobbing, knowing that this is i i was so I was I was stunned. I didn't say anything. I sat on this for a while. In fact, I sat on it. I started researching it, but I didn't tell anybody for two years. It took me two years before I finally admitted to somebody that I had burnt out. I was so ashamed, embarrassed, humiliated, I was this successful, high over achiever. How could I have possibly burnt out? Michael Hingson ** 28:34 What? What did the teacher say Rachelle Stone ** 28:37 it was? I don't even remember what it was, but I remember that shock of realization of wellness, of it was, you know what it was that question, is this all? There is a lot of times when we were they were talking about, I believe, what they were talking about, midlife crisis and what really brings them on. And it is that pivotal question, is this really all there is, is this what I'm meant to be doing? And then in their conversation, I don't even remember the full conversation, it was that recognition of that's what's happened to me. And as I started researching it, this isn't now. This is in 2015 as I'm researching it and learning there's not a lot on it. I mean, there's some, mostly people's experiences that are being shared. Then in 2019 the World Health Organization officially, officially recognizes burnout as a phenomenon, an occupational phenomenon. Michael Hingson ** 29:38 And how would you define burnout? Burnout is, Rachelle Stone ** 29:43 is generally defined in three areas. It is. It's the the, oh, I always struggle with it. It's that disconnect, the disconnect, or disassociation from. Um, wanting to succeed, from your commitment to the work. It is the knowing, the belief that no one can do it well or right. It is there. There's that. It's an emotional disconnect from from from caring about what you're doing and how you're showing up, and it shows up in your personal life too, which is the horrible thing, because it your it impacts your family so negatively, it's horrible. Michael Hingson ** 30:39 And it it, it does take a toll. And it takes, did it take any kind of a physical toll on you? Rachelle Stone ** 30:45 Well, what I didn't realize when I when I took this time, I was about 25 pounds overweight. I was on about 18 different medications, including all my vitamins. I was taking a lot of vitamins at that time too. Um, I chronic sciatica, insomnia. I was self medicating. I was also going out, eating rich dinners and drinking, um, because you're because of the work I was doing. I had to entertain. That was part of that was part of of my job. So as I was looking at myself, Yes, physically, it turns out that this weight gain, the insomnia, the self medication, are also taught signs of of risk of burnout. It's how we manage our stress, and that's really what it comes down to, that we didn't even know. We don't even know. People don't no one teaches us how to process our stress, and that that's really probably one of the biggest things that I've through, everything that I've studied, and then the pandemic hitting it. No one teaches us how to manage our stress. No one tells us that if we process stress, then the tough stuff isn't as hard anymore. It's more manageable. No one teaches us about how to shift our mindsets so we can look at changing our perspective at things, or only seeing things through our lizard brain instead of our curious brain. These are all things that I had no idea were keeping me I didn't know how to do, and that were part of contributing to my burnout. Right? Michael Hingson ** 32:43 Is stress more self created, or is it? Is it an actual thing? In other words, when, when there is stress in the world? Is it something that, really, you create out of a fear or cause to happen in some way, and in reality, there are ways to not necessarily be stressful, and maybe that's what you're talking about, as far as learning to control it and process it, well, Rachelle Stone ** 33:09 there's actually there's stresses. Stressors are external. Stress is internal. So a stressor could be the nagging boss. It could be your kid has a fever and you're going to be late for work, or you're going to miss a meeting because you have to take them to the doctor. That's an external stressor, right? So that external stressor goes away, you know, the traffic breaks up, or your your husband takes the kid to the doctor so you can get to your meeting. Whatever that external stress, or is gone, you still have to deal with the stress that's in your body. Your that stress, that stress builds up. It's it's cortisol, and that's what starts with the physical impact. So those physical symptoms that I was telling you about, that I had, that I didn't know, were part of my burnout. It was unprocessed stress. Now at that time, I couldn't even touch my toes. I wasn't doing any sort of exercise for my body. I wasn't and that is one of the best ways you can process stress. Stress actually has to cycle out of your body. No one tells us that. No one teaches us that. So how do you learn how to do that? Michael Hingson ** 34:21 Well, of course, that's Go ahead. Go ahead. Well, I was gonna Rachelle Stone ** 34:24 say it's learning. It's being willing to look internally, what's going on in your body. How are you really getting in touch with your emotions and feelings and and processing them well? Michael Hingson ** 34:37 And you talk about stressors being external, but you have control. You may not have control directly over the stressor happening, but don't you have control over how you decide to deal with the external stress? Creator, Rachelle Stone ** 34:55 yes, and that external stress will always. Go away. The deadline will come and go. The sun will still rise tomorrow in set tomorrow night. Stressors always go away, but they're also constantly there. So you've got, for instance, the nagging boss is always going to bring you stress. It's how you process the stress inside. You can choose to ignore the stressor, but then you're setting yourself up for maybe not following through on your job, or doing Michael Hingson ** 35:29 right. And I wouldn't suggest ignoring the stressor, but you it's processing that Rachelle Stone ** 35:34 stress in your body. It's not so let's say, at the end of the rough day, the stressors gone. You still, whether you choose to go for a walk or you choose to go home and say, Honey, I just need a really like I need a 62nd full on contact, bear hug from you, because I'm holding a lot of stress in my body right now, and I've got to let it out So that physical contact will move stress through your body. This isn't this is they that? You can see this in MRI studies. You see the decrease in the stress. Neuroscience now shows this to be true. You've got to move it through your body. Now before I wanted to kind of give you the formal definition of burnout, it is, it is they call it a occupational phenomenal, okay, it by that they're not calling it a disease. It is not classified as a disease, but it is noted in the International Classification of Diseases, and it has a code now it is they do tie it directly to chronic workplace stress, and this is where I have a problem with the World Health Organization, because when they added this to the International Classification of diseases in 2019 they didn't have COVID. 19 hybrid or work from home environments in mind, and it is totally changed. Stress and burnout are following people around. It's very difficult for them to escape. So besides that, that disconnect that I was talking about, it's really complete exhaustion, depletion of your energy just drained from all of the stressors. And again, it's that reduced efficiency in your work that you're producing because you don't care as much. It's that disconnect so and then the physical symptoms do build up. And burnout isn't like this. It's not an overnight thing. It's a build up, just like gaining 25 pounds, just like getting sick enough that I need a little bit more medication for different issues, that stuff builds up on you and when you when you're recovering from burnout, you didn't get there overnight. You're not going to get out of it overnight either. It's I worked with a personal trainer until I could touch my toes, and then she's pushed me out to go join a gym. But again, it's step by step, and learning to eat healthy, and then ultimately, the third piece that really changed the game for me was learning about the muscles in my brain and getting mentally fit. That was really the third leg of getting my health back. Michael Hingson ** 38:33 So how does all of that help you deal with stress and the potential of burnout today? Yeah, Rachelle Stone ** 38:43 more than anything, I know how to prevent it. That is my, my the number one thing I know when I'm sensing a stressor that is impacting me, I can quickly get rid of it. Now, for instance, I'll give you a good example. I was on my the board of directors for my Homeowners Association, and that's always Michael Hingson ** 39:03 stressful. I've been there, right? Well, I Rachelle Stone ** 39:06 was up for an hour and a half one night ruminating, and I I realized, because I coach a lot of people around burnout and symptoms, so when I was ruminating, I recognized, oh my gosh, that HOA does not deserve that much oxygen in my brain. And what did I do the next day? I resigned. Resigned, yeah, so removing the stressors so I can process the stress. I process my stress. I always make sure I schedule a beach walk for low tide. I will block my calendar for that so I can make sure I'm there, because that fills my tank. That's self care for me. I make sure I'm exercising, I'm eating good food. I actually worked with a health coach last year because I felt like my eating was getting a little off kilter again. So I just hired a coach for a few months to help me get back on track. Of getting support where I need it. That support circle is really important to maintain and process your stress and prevent burnout. Michael Hingson ** 40:10 So we've talked a lot about stress and dealing with it and so on. And like to get back to the idea of you went, you explored working with the international coaching Federation, and you went to a school. So what did you then do? What really made you attracted to the idea of coaching, and what do you get out of it? Rachelle Stone ** 40:35 Oh, great question. Thanks for that. So for me, once I I was in this foundations course, I recognized or realized what had happened to me. I i again, kept my mouth shut, and I just continued with the course. By the end of the course, I really, really enjoyed it, and I saw I decided I wanted to continue on to become a coach. So I just continued in my training. By the end of 2015 early 2016 I was a coach. I went and joined the international coaching Federation, and they offer accreditation. So I wanted to get accredited, because, as I said, from my first industry, a big proponent for credit accreditation. I think it's very important, especially in an unregulated industry like coaching. So we're not bound by HIPAA laws. We are not doctors, we are coaches. It's very different lane, and we do self regulate. So getting accredited is important to me. And I thought my ACC, which my associate a certified coach in 2016 when I moved to the area I'm living in now, in 2017 and I joined the local chapter here, I just continued on. I continued with education. I knew my lane is, is, is burnout. I started to own it. I started to bring it forward a little bit and talk about my experiences with with other coaches and clients to help them through the years and and it felt natural. So with the ICF, I wanted to make sure I stayed in a path that would allow me to hang my shingle proudly, and everything I did in the destination management world I'm now doing in the coaching world. I wound up on the board of directors for our local chapter as a programming director, which was so perfect for me because I'm coming from meetings and events, so as a perfect person to do their programming, and now I am their chapter liaison, and I am President Elect, so I'm taking the same sort of leadership I had in destination management and wrapping my arms around it in the coaching industry, Michael Hingson ** 42:56 you talk about People honing their leadership skills to help prepare them for a career move or their next career. It isn't always that way, though, right? It isn't always necessarily that they're going to be going to a different career. Yep, Rachelle Stone ** 43:11 correct. Yeah. I mean, not everybody's looking for trans transition. Some people are looking for that to break through the glass ceiling. I have other clients that are just wanting to maybe move laterally. Others are just trying to figure it out every client is different. While I specialize in hospitality and burnout, I probably have more clients in the leadership lane, Senior VP level, that are trying to figure out their next step, if they want to go higher, or if they're content where they are, and a lot of that comes from that ability to find the right balance for you in between your career and your personal life. I think there comes a point when we're in our younger careers, we are fully identified by what we do. I don't think that's true for upcoming generations, but for our generation, and maybe Jen, maybe some millennials, very identified by what they do, there comes a point in your career, and I'm going to say somewhere between 35 and 50, where you recognize that those two Things need to be separate, Michael Hingson ** 44:20 and the two things being Rachelle Stone ** 44:23 your identity, who you are from what you do, got it two different things. And a lot of leaders on their journey get so wrapped up in what they do, they lose who they are. Michael Hingson ** 44:39 What really makes a good leader, Rachelle Stone ** 44:42 authenticity. I'm a big proponent of heart based leadership. Brene Brown, I'm Brene Brown trained. I am not a facilitator, but I love her work, and I introduce all my clients to it, especially my newer leaders. I think it's that. Authenticity that you know the command and control leadership no longer works. And I can tell you, I do work with some leaders that are trying to improve their human skills, and by that I mean their emotional intelligence, their social skills, their ability to interact on a human level with others, because when they have that high command and control directive type of leadership, they're not connecting with their people. And we now have five generations in the workforce that all need to be interacted with differently. So command and control is a tough kind of leadership style that I actually unless they're willing to unless they're open to exploring other ways of leading, I won't work with them. Yeah, Michael Hingson ** 45:44 and the reality is, I'm not sure command and control as such ever really worked. Yeah, maybe you control people. But did it really get you and the other person and the company? What what you needed. Rachelle Stone ** 46:01 Generally, that's what we now call a toxic environment. Yes, yes. But that, you know, this has been, we've been on a path of, you know, this work ethic was supposed to, was supposed to become a leisure ethic in the 70s, you know, we went to 40 hour work weeks. Where are we now? We're back up to 6070, hour work week. Yeah, we're trying to lower the age that so kids can start working this is not a leisure ethic that we were headed towards. And now with AI, okay, let's change this conversation. Yeah, toxic environments are not going to work. Moving forward that command and control leadership. There's not a lot of it left, but there's, it's lingering, and some of the old guard, you know, there it's, it's slowly changing. Michael Hingson ** 46:49 It is, I think, high time that we learn a lot more about the whole concept of teamwork and true, real team building. And there's a lot to be said for there's no I in team, that's right, and it's an extremely important thing to learn. And I think there are way to, still, way too many people who don't recognize that, but it is something that I agree with you. Over time, it's it's starting to evolve to a different world, and the pandemic actually was one, and is one of the things that helps it, because we introduced the hybrid environment, for example, and people are starting to realize that they can still get things done, and they don't necessarily have to do it the way they did before, and they're better off for it. Rachelle Stone ** 47:38 That's right. Innovation is beautiful. I actually, I mean, as horrible as the pandemic was it, there was a lot of good that came out of it, to your point. And it's interesting, because I've watched this in coaching people. I remember early in the pandemic, I had a new client, and they came to the they came to their first call on Zoom, really slumped down in the chair like I could barely see their nose and up and, you know, as we're kind of talking, getting to know each other. One of the things they said to me, because they were working from home, they were working like 1011, hours a day. Had two kids, a husband, and they also had yet they're, they're, they're like, I one of the things they said to me, which blew my mind, was, I don't have time to put on a load of laundry. They're working from home. Yeah? It's that mindset that you own my time because you're paying me, yeah, versus I'm productive and I'm doing good work for you. Is why you're paying for paying me? Yeah? So it's that perception and trying to shift one person at a time, shifting that perspective Michael Hingson ** 48:54 you talked before about you're a coach, you're not a doctor, which I absolutely appreciate and understand and in studying coaching and so on, one of the things that I read a great deal about is the whole concept of coaches are not therapists. A therapist provides a decision or a position or a decision, and they are more the one that provides a lot of the answers, because they have the expertise. And a coach is a guide who, if they're doing their job right, leads you to you figuring out the answer. That's Rachelle Stone ** 49:34 a great way to put it, and it's pretty clear. That's, that's, that's pretty, pretty close the I like to say therapy is a doctor patient relationship. It's hierarchy so and the doctor is diagnosing, it's about repair and recovery, and it's rooted in the past, diagnosing, prescribing, and then the patient following orders and recovering. Hmm, in coaching, it's a peer to peer relationship. So it's, we're co creators, and we're equal. And it's, it's based on future goals only. It's only based on behavior change and future goals. So when I have clients and they dabble backwards, I will that's crossing the line. I can't support you there. I will refer clients to therapy. And actually, what I'm doing right now, I'm taking a mental health literacy course through Harvard Medical Center and McLean University. And the reason I'm doing this is because so many of my clients, I would say 80% of my clients are also in therapy, and it's very common. We have a lot of mental health issues in the world right now as a result of the pandemic, and we have a lot of awareness coming forward. So I want to make sure I'm doing the best for my clients in recognizing when they're at need or at risk and being able to properly refer them. Michael Hingson ** 51:04 Do you think, though, that even in a doctor patient relationship, that more doctors are recognizing that they accomplish more when they create more of a teaming environment? Yes, 51:18 oh, I'm so glad you Rachelle Stone ** 51:20 brought that up, okay, go ahead. Go ahead. Love that. I have clients who are in therapy, and I ask them to ask their therapist so that if they're comfortable with this trio. And it works beautifully. Yes, Michael Hingson ** 51:36 it is. It just seems to me that, again, there's so much more to be said for the whole concept of teaming and teamwork, and patients do better when doctors or therapists and so on explain and bring them into the process, which almost makes them not a coach as you are, but an adjunct to what you do, which is what I think it's all about. Or are we the adjunct to what they do? Or use the adjunct to what they do? Yeah, it's a team, which is what it should be. 52:11 Yeah, it's, I always it's like the Oreo cookie, right? Michael Hingson ** 52:16 Yeah, and the frosting is in the middle, yeah, crying Rachelle Stone ** 52:19 in the middle. But it's true, like a therapist can work both in the past and in the future, but that partnership and that team mentality and supporting a client, it helps them move faster and further in their in their desired goals. Yeah, Michael Hingson ** 52:37 it's beautiful, yeah, yeah. And I think it's extremely important, tell me about this whole idea of mental fitness. I know you're studying that. Tell me more about that. Is it real? Is it okay? Or what? You know, a lot of people talk about it and they say it's who cares. They all roll Rachelle Stone ** 52:56 their eyes mental fitness. What are you talking about? Yeah, um, I like to say mental fitness is the third leg of our is what keeps us healthy. I like to look at humans as a three legged stool, and that mental fitness, that mental wellness, is that third piece. So you have your spiritual and community wellness, you have your physical wellness, and then you have your mental wellness. And that mental wellness encompasses your mental health, your mental fitness. Now, mental fitness, by definition, is your ability to respond to life's challenges from a positive rather than a negative mindset. And there's a new science out there called positive it was actually not a new science. It's based on four sciences, Positive Intelligence, it's a cognitive behavioral science, or psychology, positive psychology, performance psychology, and drawing a bank anyway, four sciences and this body of work determined that there's actually a tipping point we live in our amygdala, mostly, and there's a reason, when we were cavemen, we needed to know what was coming that outside stressor was going to eat us, or if we could eat it. Yeah, but we have language now. We don't need that, not as much as we did, not in the same way, not in the same way, exactly. We do need to be aware of threats, but not every piece of information that comes into the brain. When that information comes in our brains, amplify it by a factor of three to one. So with that amplification, it makes that little, little tiny Ember into a burning, raging fire in our brain. And then we get stuck in stress. So it's recognizing, and there's actually you are building. If you do yoga, meditation, tai chi, gratitude journaling, any sort of those practices, you're flexing that muscle. You talk to somebody who does gratitude journaling who just started a month in, they're going to tell. You, they're happier. They're going to tell you they're not having as many ruminating thoughts, and they're going to say, I'm I'm smiling more. I started a new journal this year, and I said, I'm singing more. I'm singing songs that I haven't thought of in years. Yeah, out of the blue, popping into my head. Yeah. And I'm happier. So the the concept of mental fitness is really practicing flexing this muscle every day. We take care of our bodies by eating good food, we exercise or walk. We do that to take care of our physical body. We do nothing to take care of our brain other than scroll social media and get anxiety because everybody's life looks so perfect, Michael Hingson ** 55:38 yeah, and all we're doing is using social media as a stressor. Rachelle Stone ** 55:42 That's right, I'm actually not on social media on LinkedIn. That's it. Michael Hingson ** 55:48 I have accounts, but I don't go to it exactly. My excuse is it takes way too long with a screen reader, and I don't have the time to do it. I don't mind posting occasionally, but I just don't see the need to be on social media for hours every day. Rachelle Stone ** 56:05 No, no, I do, like, like a lot of businesses, especially local small businesses, are they advertise. They only have they don't have websites. They're only on Facebook. So I do need to go to social media for things like that. But the most part, no, I'm not there. Not at all. It's Michael Hingson ** 56:20 it's way too much work. I am amazed sometimes when I'll post something, and I'm amazed at how quickly sometimes people respond. And I'm wondering to myself, how do you have the time to just be there to see this? It can't all be coincidence. You've got to be constantly on active social media to see it. Yeah, Rachelle Stone ** 56:39 yeah, yeah. Which is and this, this whole concept of mental fitness is really about building a practice, a habit. It's a new habit, just like going to the gym, and it's so important for all of us. We are our behaviors are based on how we interpret these messages as they come in, yeah, so learning to reframe or recognize the message and give a different answer is imperative in order to have better communication, to be more productive and and less chaos. How Michael Hingson ** 57:12 do we teach people to recognize that they have a whole lot more control over fear than they think they do, and that that really fear can be a very positive guide in our lives. And I say that because I talked about not being afraid of escaping from the World Trade Center over a 22 year period, what I realized I never did was to teach people how to do that. And so now I wrote a book that will be out later in the year. It's called Live like a guide dog, stories of from a blind man and his dogs, about being brave, overcoming adversity and walking in faith. And the point of it is to say that you can control your fear. I'm not saying don't be afraid, but you have control over how you let that fear affect you and what you deal with and how you deal it's all choice. It is all choice. But how do we teach people to to deal with that better, rather than just letting fear build up Rachelle Stone ** 58:12 it? Michael, I think these conversations are so important. Number one is that learner's mind, that willingness, that openness to be interested in finding a better way to live. I always say that's a really hard way to live when you're living in fear. Yeah, so step number one is an openness, or a willingness or a curiosity about wanting to live life better, Michael Hingson ** 58:40 and we have to instill that in people and get them to realize that they all that we all have the ability to be more curious if we choose to do it. Rachelle Stone ** 58:49 But again, choice and that, that's the big thing so many and then there's also, you know, Michael, I can't wait to read your book. I'm looking forward to this. I'm also know that you speak. I can't wait to see you speak. The thing is, when we speak or write and share this information, we give them insight. It's what they do with it that matters, which is why, when I with the whole with the mental fitness training that I do, it's seven weeks, yeah, I want them to start to build that habit, and I give them three extra months so they can continue to work on that habit, because it's that important for them to start. It's foundational your spirit. When you talk about your experience in the World Trade Center, and you say you weren't fearful, your spiritual practice is such a big part of that, and that's part of mental fitness too. That's on that layers on top of your ability to flex those mental muscles and lean into your spirituality and not be afraid. Michael Hingson ** 59:55 Well, I'd love to come down and speak. I have a partner. Her name's vimari Roman. She's down in Miami, and I'm up here in the Dunedin Clearwater area. But we're both hospitality professionals that went into coaching, and we're both professional certified coaches, and we're both certified mental fitness coaches. When the pandemic hit, she's also a Career Strategist. She went she started coaching at conferences because the hospitality industry was hit so hard, she reached out to me and brought me in too. So in 2024 we've been coaching at so many conferences, we can't do it. We can't do it. It's just too much, but we also know that we can provide a great service. So we've started a new company. It's called coaches for conferences, and it's going to be like a I'll call it a clearing house for securing pro bono coaches for your conferences. So that means, let's say you're having a conference in in LA and they'd like to offer coaching, pro bono coaching to their attendees as an added value. I'll we'll make the arrangements for the coaches, local in your area to to come coach. You just have to provide them with a room and food and beverage and a place to coach on your conference floor and a breakout. So we're excited for that that's getting ready to launch. And I think 2024 is going to be the year for me to dip my toe in start writing my own story. I think it's time Michael Hingson ** 1:02:02 writing a book. You can say it. I'm gonna do it. Rachelle Stone ** 1:02:05 I'm gonna write a book Good. I've said it out loud. I've started to pull together some thoughts around I mean, I've been thinking about it for years. Guy Gilchrist (born January 30, 1957 is an American writer, artist, and musician, known for his children's books and comics. With his brother Brad, he produced a newspaper comic strip featuring "The Muppets" from 1981 to 1986 and the comic strip. from 1995 to 2018 (the last 14 years as solo writer). He is the writer/illustrator of more than 60 children's books. At various times in the 1980s and 1990s, Gilchrist managed the publishing and/or merchandising for such licenses as Pink Panther, Tom & Jerry, Looney Tunes, Teenage Mutant Ninja Turtles and Minnie Mouse.

Christmas Movie Gathering in Brazil with David Hoffmeister 2024In this Christmas gathering in Brazil, David discusses time loop movies and their connection to the Bible, which emphasizes the importance of not holding images before God. The world is a world of images, and when we make certain images important, they become idols. Jesus taught that the kingdom of heaven is within us, and true religion is peace of mind.The world has many distractions, making it tempting not to pray and remain still. David uses the example of Walt Disney's animated characters, Mickey Mouse and Minnie Mouse, to illustrate this point. The key thing is that the animation doesn't seem to happen until you multiply this image many times and very quickly, turning what seems like a two-dimensional image into a three-dimensional motion picture. This illusion of change in motion is the trick of time, and underneath all these moving images, there is a belief that something is missing. Something is lacking.The entire linear time-space cosmos is a world of scarcity, lack, and competition. The same is true for human beings and relationships; experiencing universal agape love is not possible in the construct of images.The cosmos is like a giant mask over the light of the I AM Presence. Jesus said, "Before Abraham was, I AM," referring to love prior to the belief in time and space. He proclaims that that's what love is.
