Summary Eric Rubenstein and Ron Chapman join The Compliance Guy to discuss the implications of a recent dismissal of a False Claims Act case based on the appointment clause. The guys explore the historical context of key tam cases, the role of relators, and the complexities surrounding the appointment clause. The conversation delves into the differences between dismissals with and without prejudice, the potential for Supreme Court involvement, and the impact of venue shopping on key tam cases. The episode concludes with a discussion on judicial appointments and their political implications. Takeaways Qui Tams are a significant part of healthcare fraud enforcement. The appointment clause raises questions about the authority of relators. Dismissals with prejudice are nearly final and limit future actions. The Supreme Court may be interested in conflicting rulings on key tam cases. Venue shopping can dilute the strength of a case. Judges may make decisions that align with their career interests. The appointment of special counsels has constitutional implications. Relators can receive a larger share if the government does not intervene. Resource limitations often lead to the government declining key tam cases. Judicial decisions can reflect broader political agendas. 00:00 Introduction to Key Tam Cases and the Appointment Clause 07:03 Exploring the Appointment Clause and Its Implications 14:03 Dismissal with Prejudice vs. Without Prejudice 16:19 The Future of Key Tam Cases in the Supreme Court 24:13 The Impact of Venue Shopping on Key Tam Cases 30:29 Judicial Appointments and Political Implications

I had my first trip to Dallas last August and was looking forward to a few things: Visiting the Texas School Book Depository, Eating some Texas BBQ, and listening to the radio. We did all three but I did not check out a lot of country radio which is weird because Dallas radio is full of country music, sports, and is the home of the venerable Kidd Kraddick show. It also has some legendary personalities who have left their mark on the city (like Kidd), but also Ron Chapman, Terry Dorsey and Tom Joyner who did mornings in Dallas before jetting off to Chicago DAILY to do afternoon drive.Hawkeye has been apart of all of that in the market, including working alongside Terry Dorsey where he learned how to morning radio on the job. In this episode we discussed what makes Dallas a great place to do radio, what it takes to have a successful show in market number 5, why consultants can help grow your career, and what you need to know when you move to Dallas to do radio. We also had some random discussion about the sports scene, the changing demographics in communities and where to get some good Texas BBQ.We also spent time talking about the morning show, including the division in work and performance between himself and his co-host Michelle, and how much time to allot to on air vs. online.Blurve: A great way to help you prep your Show.NLogic: TV & radio advertising and audience data solutionsMegatrax - Licensed Music for your radio station or podcast production company. There is no transcription for this episode yet because... well it's a long story. Shelter , an inspirational story about a unique group of immigrants, is one of three films Ron has produced and directed that have been released 2021. In this podcast exclusive, movie director Ron Chapman and concert promoter John Brower sat down with hosts Gregg Tilston and Karim Kanji to talk about what Rolling Stone magazine called “the second most important event in rock & roll history”. REVIVAL69: The Concert that Rocked the World, tells the incredible behind-the-scenes, story of how, against all odds, a life-changing concert came together. A story of passion and perseverance, this never-before documented story reveals a series of colourful characters, murky deals and broken promises, culminating in John Brower, a young renegade promoter, putting his life on the line (literally) in order to achieve his goal. With dismal ticket sales, the concert was almost cancelled. But Brower took a one-in-a-million chance and invited John Lennon, who said yes, propelling the concert into a massively successful event. Included in the stellar lineup were Chuck Berry, Little Richard, Jerry Lee Lewis, Bo Diddley, Gene Vincent, The Doors, Alice Cooper, and John Lennon with the Plastic Ono Band - his first appearance without the Beatles, that included Yoko Ono, Eric Clapton, Klaus Voormann and Alan White. There is a body of Tibetan thought that contends enlightenment occurs in the body, not in the mind. They might say that awakening is an embodiment, and prescribe a number of somatic practices in order to experience it. Breath work meditation is one of those approaches. Deep within us is a tremendous well of information in more forms than we can imagine. Call it the knowledge of the heart, or the way of the soul, or any of the descriptors that point toward accessing that which is beyond our normal, intellectual orientation. This session explores the use of the breath to tap valuable information and to bring it into our awareness in order to further inner development and the realization of our potential.Presentation from the 2015 Ozark Mountain Transformation Conference.FOLLOW US ON:Facebook: https://goo.gl/rwvBfwInstagram: https://www.instagram.com/ozarkmtpubTwitter: https://goo.gl/LunK5DWebsite: https://goo.gl/2d5cX4ASSOCIATED LINKS:Ozark Mountain Publishing, Inc.: https://goo.gl/xhgoAPQuantum Healing Hypnosis Academy: https://goo.gl/64G7RD
Listen to Ron Chapman discuss how prescribers and pharmacists are being targeted by the DEA. He explains how they do it and what a doctor should do if the DEA shows up at their office. He talks about whether or not CPP's can sue the DEA or the CDC. He discusses what the pain community can do to fight back. He explains the RUAN SCOTUS ruling and what it means for prescribers and patients. Also, he touches on whether or not a patient can sue a doctor. Ron has successfully defended many doctors including a recent case, which he mentions. He also runs a compliance company that can protect doctors and pharmacists. This episode is a great resource for prescribers and pharmacists to learn how to protect themselves from being the DEA's next target. Ron has achieved more acquittals of physicians facing federal indictment than any other lawyer in the country. Recently his client was acquitted of a $540 million healthcare fraud indictment in the Eastern District of Michigan. He also achieved a trial acquittal on behalf of a prominent Mayo Clinic physician and secured the return of $6 million in assets. In West Virginia he secured the acquittal of an addiction medicine provider in a federal indictment against a suboxone clinic. Ron has also achieved great success as an appellate litigator, the United States Supreme Court recently granted certiorari and vacated the conviction of his client, a physician accused of unlawfully dispensing opioid medications in Naum v. United States. We continue to hear stories about patient abandonment whenever the prescribing or dispensing of prescription opioids are involved. Some doctors have told their patients that they can no longer prescribe opioids because the FDA, DEA, or CDC prohibited them from doing so. This of course is not true; states, not the federal government, regulate the practice of medicine. The following podcast explores the topic of patient abandonment with Mr. Ron Chapman, an attorney with the Chapman Law Group. FunkQuest - Season2 - Round 2 - Episode 17 - Alyson Lex v Ron ChapmanAlyson and Ron were the first players of the second round of the second season and therefore the first to play with the new FunkQuest Rules. This allowed them to choose a different icon, from the board and answer different questions.Alyson revealed from her first question; that she often steps out of her Comfort Zone, as she feels that you should do "something that scares you " everyday.Ron found that while most people use Dating Agencies, his experience was one that put him off, after receiving repeated mailings of people only interested in Barbeques on a Saturday night.Rons second question was about kids eating dropped food and he countered that with the fact that, chidren especially, should be exposed to stuff - so they can get a healthy immune system.Alyson was asked 'who last gave her advice' and she treasures having and taking advice from, a "Business Buddy" a confidante she has known for years.Question 3 - Alyson chose the 'spider' icon; we found her favourite time of day, was 4.30 am - her quiet time.Ron told us that he is enjoying sculpting and sculpture, he has a unique piece made just for him. With question 4, he also revealed he has a painting on his wall called 'The Bird Lady'. (see below)Alisons answer to; 'When is it Skill not Luck' was that practice and determination leads to skill. The final question for Alyson was about her first adventure into alcoholic drinks. She and her friend would drink at her friend's house refilling the bottle with water - needless to say she is now tee-total.Rons final answer showed that he would rather stand and not sit, on most public transport vehicles. Show #90, Hour 2 | Guests: Debi Durst, comedienne and organizer; Ron Chapman, comic and podcaster. | Show Summary: Jerry Seinfeld bemoans the damage to comedy wrought by “political correctness”. Bill Maher backs him up. Salon.com polls 10 top stand-up performers (one black man, one white woman, eight white men) who all agree. Is real comedy truly endangered by hyper-judgmental guardians of the sacred and ubiquitous recording devices? What’s still fair game? San Francisco’s beloved Debi Durst taps her long experience in both stand-up and improv to tackle the thorny subject. She’s currently in rehearsal for Marin Shakespeare Company’s “Cymbeline”, in the role of Cornelius. She and her husband, political satirist Will Durst, take their “Big Fat Year End Kiss Off Comedy Show” on the road every December. Stand-up comic and podcaster Ron Chapman was featured earlier this year at SF Sketchfest. He’s performed at the Set-Up, at Stage Werx with Endgame Improv and Panelmonium, and at other Bay Area venues.
