Boggs served eight years in the U.S. Army as a regular officer and was honorably discharged. She was also one of the first women to receive a congressional appointment to the U.S. Naval Academy. After law school, Boggs returned to Washington D.C. where she worked as an U.S. Army officer and attorney at the Pentagon and White House Office of Legal Counsel. From 1987 to 1988 Boggs served on the Iran-Contra Legal Task Force for which she earned the Defense Meritorious Service Award and Presidential Service Badge. In 1988, Boggs became an assistant U.S. attorney in the Western District of the State of Washington, where she prosecuted fraud and regulatory crimes and twice earned the U.S. Department of Justice Special Achievement Award. Working as a trial lawyer specializing in corporate civil litigation, Boggs was in 1995 named the first African American female partner of Seattle, Washington's Preston Gates & Ellis LLP. In 1997, she became Dell Corporation's first African American female vice president. She returned to Seattle in 2002, serving as Starbucks Corporation's first African American Executive Vice President, when she became general counsel and board secretary, a role she held until 2012. Boggs formed the Paula Boggs Band in 2007 releasing albums in 2010, 2015 and 2017. She founded Boggs Media, LLC in 2013. Boggs was honored with the Secretary of Defense Award for Excellence in 1994, the 2006 American Bar Association Spirit of Excellence Award, the 2008 Wiley A. Branton Award from the National Bar Association and the American Bar Association Notable Member Award in 2013. In 2014, Boggs earned the Song of the Year© Award for “Look Straight Ahead” and is a voting member of the Recording Academy (The Grammys©). In addition to her legal and music careers, Boggs was a member of the White House Council for Community Solutions from 2010 to 2012, and the President's Committee for the Arts and Humanities from 2013 to 2017. She served on the boards of School of Rock LLC, Seattle Art Museum, public radio station KEXP, Johns Hopkins University and served as Legal Aid for Washington (LAWFUND) board president from 2006 to 2008. She serves on the boards of Avid Technology Inc., Seattle Symphony and American Bar Association Board of Governors. Boggs was inducted into the Johns Hopkins University ROTC Hall of Fame in 2016 and received the Seattle Mayor's 2018 Arts Award.

Chris Murray's guest is Steve Bradbury.  He served in the Trump Administration as the Senate-confirmed General Counsel of the U.S. Department of Transportation (DOT) from November 2017 until January 2021. As the Department's chief legal officer, he oversaw all of DOT's rulemaking and enforcement actions. During his time at DOT, he also served as the Acting Deputy Secretary of Transportation and briefly as the Acting Secretary of Transportation.  During the Bush 43 Administration, Mr. Bradbury served as the Principal Deputy and Acting Assistant Attorney General for the Office of Legal Counsel at the U.S. Department of Justice. As the head of OLC from 2005 to 2009, he advised the President and the Executive Branch on a wide range of constitutional and statutory questions and received the Edmund J. Randolph Award and the Secretary of Defense Medal for Outstanding Public Service, among other awards.  Aside from government service, Mr. Bradbury has been a litigation partner at Kirkland & Ellis LLP and at Dechert LLP in Washington, D.C., where his practice focused on regulatory enforcement and investigations, rulemaking and judicial review of agency actions, appellate cases, and antitrust matters.  Mr. Bradbury clerked for Justice Clarence Thomas on the Supreme Court and for Judge James L. Buckley on the D.C. Circuit. He graduated magna cum laude from Michigan Law School and received his B.A. from Stanford University. Tony Khan had previously stated that he is closely following Vince McMahon's return to WWE. Per the report, the Khan family will likely look for a financial partner if they are to acquire WWE as an asset. In addition to the Khan family owning the Jacksonville Jaguars and Fulham FC, Tony Khan purchased Ring of Honor in March 2022, presiding over the company as ROH held its most profitable pay-per-view events in its 20-year history. The report also names Endeavor and Comcast as potential buyers but notes that an offer from the Saudi Arabia Public Investment Fund is more likely, given WWE has a previous relationship with the Kingdom of Saudi Arabia. Rumors circulated of WWE reaching an agreement with the Saudi Arabian PIF on the night of Tuesday, January 10. As a result, WWE stock rose 3.4% on the morning of Wednesday, January 11, but as no confirmation of a deal surfaced, the stock closed 0.8% lower. WWE has not issued a public comment regarding any potential deal. Reportedly, any deal to purchase WWE is likely to be in the range of billions of dollars. Barron's cited Benchmark's Mike Hickey, who wrote on January 6, "We think…market consideration related to the value of live content creates an optimal setting for an acquisition attempt... We think that now is the time to buy WWE. Business momentum is strong, and future growth prospects appear promising." CNBC later reported that the Khan family would be interested in merging AEW with WWE. The report also states that the Khans would be open to Vince McMahon having a potential role in the company after sale. It is, however, noted that AEW hasn't had talks with McMahon or Nick Khan. Vince McMahon officially became executive chairman of the board on Tuesday, January 10. On that same day, Stephanie McMahon resigned from her position as Co-CEO of WWE. WWE announced on January 12 that they retained The Raine Group, LLC as a financial advisor, Kirkland & Ellis LLP as a legal advisor, and August LLC as a strategic communications advisor to support WWE's management team in connection with a review of strategic alternatives to maximize the value of the company and shareholders. Professor Christa Laser comes to Cleveland-Marshall after nearly a decade of practice experience as an intellectual property litigator at the law firms WilmerHale and Kirkland & Ellis LLP. She has deep expertise in patents, trademarks, copyrights, false advertising, pharmaceutical litigation and regulation, and technology law. She has represented leading life sciences and technology companies in all stages of trial and appellate matters and consulted on legislative changes to intellectual property laws. In her time during law practice, she gained a lot of experience representing clients such as Samsung or Lenovo in their defense strategy around standard essential patents (SEPs). SEPs play a particular role in litigation as in such litigation it is not only about questions such as validity or infringement but also about the obligation to disclose SEPs or the big question of what a FRAND rate is. Disputes in other spaces are very different. In biotech for example the infringement is often not challenged as typically both parties agree on what the compound looks like and how it's used. Standardized technology is in comparison much more complex and it is thus much more difficult to find evidence for infringement. And related to that we see a lot of SEP litigation where courts file so-called anti-suit injunctions. A court would issue such an injunction to prevent other courts from deciding the same issue at the same time. This is set to make sure that questions in litigation are decided by only one court. If we don't do that, we would have chaos as two countries would decide on the same issues that are overlapping and then parties would need to figure out which decision e.g. on rates applies where? The real complexity starts when we have an anti-suit injunction from one country and another country does not agree and files an anti-anti-suit injunction to continue the litigation process. This kind of back and forth creates a lot of inefficiencies and should be avoided as Christa believes we must respect each other legal systems.After years of legal practice at the major law firms, Kikland & Ellis as well as Wilmehale Christa decided to change careers to become a law Professor with the focuses on intellectual property and innovation. She wanted a change in her career to more objectivity look at the legal space. During her law practice she always had to represent one side of the table finding arguments to help the client win. Now she can look at issues from the outside. She still uses her practical experience with teaching her students that get presented real cases where they must then develop a strategy to win the case. Her approach is called the Socratic method a form of cooperative argumentative dialogue, based on asking and answering questions to stimulate critical thinking and to draw out ideas and underlying presuppositions.Finally, Christa talks about her personal career and the challenge to manage working late hours at a law firm while having two kids being the main responsible childcare parent. She experienced a lot of support from her colleagues and people that helped her along the way, but she still felt it was often very hard to manage. In general, yet women are still expected to give up their careers when having children and the situation is not equal compared to men. Christa can be seen as a role model for many women as she showed others that you can have a career while having children. However, the whole system is a long way from supporting strong women in their career path. We still see a majority of males higher management positions, we still see many more male inventors e.g. listed on patents compared to women and the list goes on where even in the venture capital investment space, women less often receive investments even though statics prove women to be the more successful founders. All that must change, and our society must find ways to make this change happen.

The 2021 National Lawyers Convention took place November 11-13, 2021 at the Mayflower Hotel in Washington, DC. The topic of the conference was "Public and Private Power: Preserving Freedom or Preventing Harm?". This panel discussed "Private Power and Eminent Domain."Since the Founding, the extent to which the public power of eminent domain may be used by, or for the benefit of, private parties, has been a subject of intense debate. Time and time again, the U.S. Supreme Court has considered cases testing the Fifth Amendment’s guarantee that "private property [shall not] be taken for public use, without just compensation." U.S. Const., amend. V. Over 15 years ago, in the landmark case of Kelo v. New London, the Court upheld the exercise of eminent domain to transfer private property from private individuals to other private entities. The decision – controversial from the outset – prompted deeper questions about the extent to which the Constitution allows for eminent domain for "public purposes" even where the action advances the economic interests of private parties over others. But how lasting is this precedent? In a recent dissent from the denial of certiorari in Eychaner v. Chicago, three justices voted to revisit Kelo, two of them expressly calling to overrule it. Since Kelo, the U.S. Supreme Court has continued to review eminent domain and other cases, raising significant property rights concerns – often involving complex questions at the intersection of private and public power.Most recently, in the 2020-2021 term, the U.S. Supreme Court heard three cases dealing with the intersection of private and public power in the eminent domain context: Cedar Point Nursery v. Hassid, where the Court held that a state regulation allowing union organizers to enter private property constituted a taking requiring just compensation;PennEast Pipeline v. New Jersey, where the Court dealt with the legality of the Federal Energy Regulatory Commission’s (FERC) delegation of eminent domain powers to a private pipeline company; andPakdel v. San Francisco, where the Court continued to reduce procedural hurdles for inverse condemnation claims (expanding upon a prior decision just two years ago in Knick v. Township of Scott). For this panel, a distinguished lineup of speakers will discuss the intersection between public and private power in the eminent domain context. The panel will focus on eminent domain’s history, the implications of originalism for understanding the extent and use of that power, recent Supreme Court rulings on these topics, and the likely subjects and issues for review in future cases, among other things. Eleven months ago the Federal Circuit held that the Administrative Patent Judges who serve on the Patent Trial and Appeal Board, were unconstitutionally appointed because they act as “principal officers” within the meaning of the Constitution but were not appointed with the advice and consent of the Senate as required by the Appointments Clause. The court adopted a narrow “remedial approach” in which it “sever[ed] any problematic portions [of the statute] while leaving the remainder intact.” The court thus invalidated Title 5’s removal restrictions, as applied to these administrative patent judges. , See 35 U.S.C. § 3(c). Because the APJs can be removed without cause, the court concluded that, going forward they were inferior as opposed to principal officers. It has remanded scores of cases to the PTAB for reconsideration by a new panel of APJs.All parties have sought certiorari. The government argues that there was no Appointments Clause violation at all, and regardless that no remands were required. The patent owner argues that the Federal Circuit did not go far enough, and that there is no remedy for the purported Appointments Clause violation here. And some are of the view that the Federal Circuit got it just right. As the Supreme Court turns to its October 2020 Term, it will decide whether to take up this issue, following on decisions such as Lucia v. SEC and Financial Oversight & Management Board for Puerto Rico v. Aurelius.The stakes are high. Left unaltered, the Federal Circuit’s decision will lead to do-overs for potentially hundreds of invalidated patents. And if the patent owners’ arguments were to prevail, it would potentially bring down the entire statutory regime for Patent Office review (or at least re-review) of patentability decisions -- affecting hundreds of patents (and ultimately patent cases) each year. On June 15, 2020, the Supreme Court released its decision in the case of United States Forest Service v. Cowpasture River Preservation Association. By a vote of 7-2, the judgment of the U.S. Court of Appeals for the Fourth Circuit was reversed, and the case remanded. Per Justice Thomas's opinion for the Court: "We granted certiorari in these consolidated cases to decide whether the United States Forest Service has authority under the Mineral Leasing Act, 30 U. S. C. §181 et seq., to grant rights-of-way through lands within national forests traversed by the Appalachian Trail. 588 U. S. ___ (2019). We hold that the Mineral Leasing Act does grant the Forest Service that authority and therefore reverse the judgment of the Court of Appeals for the Fourth Circuit." The Eighth Annual Executive Branch Review Conference was held on April 28, 2020 via an online webinar. The first panel was titled "Restoring the Executive Power: Revisiting Humphrey's Executor, Reviving the Unitary Executive."In public discourse, the visibility and prominence of the presidency has flourished in recent decades in America. However, while the visibility of the presidency has increased, some worry that the actual power and influence of the presidency gradually has been surrendered to much less visible levers of governmental power. The ever-increasing power of the administrative state and the influence of independent agencies has caused many legal experts and policy makers to question whether the presidency has retained all the powers of the executive branch the founding fathers intended. The President surely exercises some control over significant agency heads, but has Presidential control over the agencies themselves weakened? Is the President’s control over independent agencies too attenuated? Proponents of greater executive power argue that the administrative state has grown so large it can stymie a newly elected president’s agenda, which leads to a less democratic form of government. In light of these concerns, should the Supreme Court revisit Humphrey's Executor, and give the President more control over federal agencies? As a practical matter, if agency power is reduced, what ought to fill the void of policy-making and enforcement?Our distinguished panel of experts will attempt to answer that question, and will delve into multiple sides of this controversial and complex debate.Featuring:Hon. He has a national litigation practice, focusing on ERISA and related employment and business disputes.  Scott Stitt sat down with Bret Keisling of Captial Trustees, LLC at #ESOPLV -- The ESOP Association's record-setting November 2017 Las Vegas ESOP Conference and Trade Show. This is a wide-ranging discussion of general trends in ERISA litigation, the recent history of interactions of ESOPs with the Department of Labor, and the implications of the GreatBanc DOL Settlement ESOP Fiduciary Process Agreement, First Bankers Trust DOL Settlement, and the BAT Masonry Agreement.  They discuss how ESOPs should treat DOL audits like a deposition, in order to keep statements from being taken out of context. They also emphasize the importance of real independence and arms-length negotiations during the ESOP creation process, and the criticality of clear and detailed documentation.

With commentary by Professor Daniel Hemel Professor Nielson is a law professor at Brigham Young University and teaches/writes in the areas of administrative law, civil procedure, federal courts, and antitrust. Before joining the faculty, Professor Nielson was a partner in the Washington, D.C. office of Kirkland & Ellis LLP. He also has served as a law clerk to Justice Samuel A. Alito, Jr. of the U.S. Supreme Court, Judge Janice Rogers Brown of the U.S. Court of Appeals for the D.C. Circuit, and Judge Jerry E. Smith of the U.S. Court of Appeals for the Fifth Circuit. Professor Nielson received his J.D. from Harvard Law School. Following graduation, he was awarded a Harvard Law School Post-Graduate Research Fellowship. Professor Nielson also received an LL.M from the University of Cambridge, where he focused his studies on the institutions that regulate global competition and commerce. He received his undergraduate degree from the University of Pennsylvania, majoring in economics and political science. Daniel Hemel's research focuses on taxation, risk regulation, and innovation law. His current projects examine the effect of tax expenditures on inequality; the role of cost-benefit analysis in tax administration; and the use of tax incentives to encourage knowledge production. As an assistant professor at the University of Chicago Law School, he teaches tax, administrative law, and torts. Daniel graduated summa cum laude from Harvard College and received an M.Phil with distinction from Oxford University, where he was a Marshall Scholar. He then earned his J.D. from Yale Law School, where he was editor-in-chief of the Yale Law Journal. Prior to his appointment, he was a law clerk to Associate Justice Elena Kagan on the U.S. Supreme Court. He also clerked for Judge Michael Boudin on the U.S. Court of Appeals for the First Circuit and Judge Sri Srinivasan on the U.S. Court of Appeals for the District of Columbia Circuit, and served as visiting counsel at the Joint Committee on Taxation.
