On behalf of Taiwan in the Indo-Pacific Region and its National Security Task Force the Hoover Institution held a Taiwan Roundtable Discussion on Tuesday, February 18, 2025, from 5:00 - 6:00 pm PT. Taiwan is facing a potential constitutional crisis. In December 2024, Taiwan's opposition-controlled legislature voted to impose a 2/3 supermajority quorum for the Constitutional Court to hear new cases. The legislature then voted down all the new nominees to the Court, leaving it with only 8 of members and unable to meet the new quorum requirement. The government has appealed to the Court to meet anyway and rule that the new amendments are unconstitutional. In this discussion, three experts on Taiwan's politics and judicial system discuss the factors leading up to this confrontation, the options facing the court, and the potential for deeper reforms to strengthen judicial independence in the face of a deepening confrontation between the ruling and opposition parties. ABOUT THE PARTICIPANTS Chien-Chih Lin is an associate research professor at Institutum Iurisprudentiae, Academia Sinica and an associate professor at the Graduate Institute of National Development, National Taiwan University. He received the LLM & JSD degrees from the University of Chicago. His academic interests focus on comparative constitutional law in Asia. Lin is the coauthor ofConstitutional Convergence in East Asia (2022) and Ultimate Economic Conflict between China and Democratic Countries (2022). His articles can be found in both peer-reviewed and student-edited law journals as well as edited volumes, including Oxford Handbook of Constitutional Law in Asia, American Journal of Comparative Law, and International Journal of Constitutional Law. He is the book review editor of International Journal of Constitutional Law. Weitseng Chen is a faculty member at the National University of Singapore Faculty of Law, specializing in law and economic development, law and politics, and legal history in the context of Greater China. He has recently published several books, including Regime Type and Beyond: The Transformation of Police in Asia (CUP, 2023), Authoritarian Legality in Asia: Formation, Development and Transition (CUP, 2019), The Beijing Consensus? How China Has Changed the Western Ideas of Law and Economic Development (CUP, 2017), Property and Trust Law: Taiwan (with Yun-Chien Chang & Y. J. Wu, Kluwer, 2017), and Law and Economic Miracle: Interaction Between Taiwan's Development and Economic Laws After WWII (in Chinese, 2000). Weitseng Chen earned his JSD from Yale Law School. Prior to joining NUS, he served as a Hewlett Fellow at Stanford's Center for Democracy,Development, and the Rule of Law (CDDRL) and practiced as a corporate lawyer in the Greater China region with Davis Polk & Wardwell. Kharis Templeman is a research fellow at the Hoover Institution and part of the Project on Taiwan in the Indo-Pacific. Templeman is a political scientist (Ph.D. 2012, Michigan) with research interests in Taiwan politics, democratization, elections and election management, party system development, and politics and security issues in Pacific Asia.

ROGER'S BIO Roger W. Ferguson Jr. has remarkably been dealing with numbers that have four commas (trillions of dollars) for decades from a variety of vantage points. From a very humble start as a black child in a lower middle class household in Washington DC, his accomplishments when taken together are astounding. He has been at the top of his game for decades as an American economist, attorney and corporate executive and board member. Roger served as the 17th Vice Chairman of the Federal Reserve and Chairman of the Group of 10 and Group of 30, the first African American to hold the posts, preceded by being a member of the board. After leaving the Fed, he served as president and CEO of the Teachers Insurance and Annuity Association of America (TIAA) from 2008 to 2021, one of the largest asset managers in the world. He has three degrees from Harvard and has received honorary degrees from almost two dozen universities.  He started his career as an attorney at the NYC office of  Davis Polk & Wardwell, one of the largest and most profitable law firms in the world, followed by joining McKinsey & Company where he rose to be a Senior Partner of the firm. RANDY'S BIO Randy knows more about finance, banking, private equity, fintech, and economic policy than just about everyone in the world. This talk is a master class that touches on all of these subjects, especially the changing role of banks in the world economy and its intersection with technology..  He is a private equity investor and past practicing attorney who served as the first ever Vice Chair of the Federal Reserve for supervision from 2017 to 2021 under Presidents Trump and Biden. Randy also concurrently served as the chair of the Financial Stability Board from 2018 to 2021.  He has held several consequential financial policy posts over his career, including during the George W. Bush administration when he ultimately served as Under Secretary of the Treasury for Domestic Finance. After leaving the Bush administration, he became the founder and head of The Cynosure Group, a private investment firm, preceded by being a managing director of The Carlyle Group, one of the world's largest private equity firms.  Since the early 2010's he has been widely mentioned as a possible Treasury Secretary or senior White House adviser in Republican administrations. His extensive financial policy experience started in the early 1990's serving as Deputy Assistant Secretary for Financial Institutions Policy during the George H.W. Bush administration under the thenSecretary of Treasury, Nicholas Brady. By Adam Turteltaub United States Deputy Attorney General (DAG) Lisa Monaco recently gave a speech in which she outlined both new policies at the Department of Justice (DOJ) as well as enhancements to existing ones that can have a profound effect on compliance and ethics programs. To better understand both what she said and what it all means we sat down with DOJ veteran Daniel Kahn (LinkedIn), a partner in the Washington, DC office of Davis, Polk & Wardwell, for an in-depth and longer than usual podcast. He explains that while the emphasis on individual accountability is not new, there is a significant change. The Department expects that individual prosecutions will take place prior to or at the same time as corporate resolutions. Given the extra time it often takes to prosecute an individual, that will make it harder for organizations to reach a swift conclusion and move forward. There is also one other significant change in terms of how individuals are treated: the Department is now looking to see if the organization is clawing back compensation from employees who committed wrongdoing, at least in those jurisdictions where it is permitted. When it comes to leniency, the Department had previously stated that repeat offenders were not likely to receive a Non-Prosecution Agreement (NPA) or a Deferred Prosecution Agreement (DPA). The DAG's latest comments reflected a more nuanced approach and reflect the idea that all incidents are not created equal, and that in a large organization it is possible for more than one violation to occur over time, without it being a sign of dysfunctionality. Other notable elements of her comments: The Department expects that when an organization seeking cooperation credit comes across hot new evidence it will share it with Justice immediately For the first time there will be policies on voluntary disclosures across all the various departments within Justice There will be a presumption against a guilty plea if a company voluntarily self-discloses, cooperates and remediates Non-Disparagement Agreement clauses will be looked at unfavorably if they interfere with whistleblowing One other notable element of her talk, which was, perhaps, lost in most discussions about her comments, is the call for organizations to getter a better handle on messaging by employees on their personal devices. Finally, Dan addresses what some perceive as a slowdown in corporate prosecutions over the last few years. He notes that during the Obama and Trump administration there was an uptick in cases. Any slowdown over the last two years is likely the results of changes in leadership at the DOJ with a new Administration. Bottom line is that now is not the time to assume the DOJ is not active. My mother changed her Facebook name and Joe Exotic has to stay in prison pending trial. Afterbuzz Hosts Tehran Von Ghasri @IAmTehran, Ashleigh Morghan, Veronica Valencia discuss NETFLIX's CHILLING ADVENTURES OF SABRINA - SEASON 3 - EPISODE 3 - CHAPTER 23 - HEAVY IS THE CROWN A mysterious carnival popped into Greendale overnight and trouble seems afoot. The Cunning allows Roz to see the ringmaster as a satyr but she doesn't know why. A new student at Baxter High, Robin, is also a member of the carnival. He’s warming up to Theo, while the snake charmer is warming up to Harvey’s dad, leading to an awkward morning-after breakfast around the kitchen table. Nick is suffering from PTSD from being trapped with Lucifer and is looking to drown his trauma from being tortured in Hell with absinth and BDSM. Sabrina, once again, finds herself torn between her personal life and her Queen of Hell after-school job. Caliban formally challenges Sabrina for the throne, which entails both of them retrieving the Unholy Regalia, the three most powerful occult artifacts. The first is Hell’s Crown, a.k.a. the Crown of Herod, which offers up a fun look at the Blossom family history. Turns out the Blossoms’ maple syrup empire is built on the cursed object. One of Cheryl’s ancestors, Benjamin Blossom, found Hell’s Crown and brought it back to Riverdale, where Sabrina and Ambrose find it inside a tree trunk. However laying hands on the crown summons its guardian, a mummified Herod himself. While Ambrose is tinkering away at home, using the crown to magically charge up wands, Herod attacks and tracks down Sabrina at the carnival with Nick. They are able to defeat Herod, thanks to Ambrose’s new wand, but Caliban joins in during the chaos and makes a getaway with the crown. In the aftermath, Nick goes to live at the Academy for a while, but there’s still something going on with the carnival. They are plotting to sacrifice a virgin. Harvey, Roz, or Mrs. Wardwell will do. We may free her but only if Harvey kisses and gives up his one true love who we now know is not Roz. (0.5 General California MCLE)  The Dodd-Frank Act was enacted as a response to the Great Recession of 2007, but what does this complex regulation do and has it fixed the problems or addressed the causes of the financial meltdown? Former SEC Commissioner Annette Nazareth explains... Annette Nazareth is a partner at the law firm Davis Polk & Wardwell and served as a key financial services policy maker at the SEC for over a decade.  At the SEC, Nazareth has held a number of positions.   Joining the SEC staff in 1998, Nazareth served as a Senior Counsel to Chairman Arthur Levitt and then served as Interim Director of Investment Management.  She was appointed as Director of Market Regulation (now the Division of Trading and Markets) from 1999 to 2005. In 2005, Nazareth became an SEC Commissioner.  During her tenure at the Commission, Nazareth worked on numerous groundbreaking initiatives, including execution quality disclosure rules, implementation of equities decimal pricing, short sale reforms and the modernization of the national market system rules.  She also served as the Commission’s representative on the Financial Stability Forum from 1999 to 2008.

Earlier in her career, Jasmine was a corporate attorney at the international law firm Davis Polk & Wardwell, and she also served as an attorney-advisor at the U.S. Department of Treasury. Jasmine consulted the United Nations (UNFIP) on private-public sector partnerships. A Rhodes Scholar, Frank Knox Scholar and Fulbright Scholar, she is a graduate of the University of Alberta, Oxford University and Harvard Law School. She also completed the Columbia Business School's Social Enterprise Program Senior Leaders Program for Nonprofit Professionals and currently serves on the board of the Middle East Children’s Institute. We take a break from the paranormal and fantasy topics to talk about something else we enjoy: visual and audial media. From the struggles of streaming on Twitch to the subjective opinions about "good" music, our conversation is more laid back this time, but still with sprinkles of analytical insight about how these things affect daily life. Recorded in March 2017 - Claudia Carvajal Lopez ’18 is a third-year law student at NYU School of Law. She is an AnBryce scholar and is on the Law Review, and she previously served as executive co-chair of the Latino Law Students Association (LaLSA) during the 2016-17 academic year. Carvajal Lopez was born in Sinaloa, Mexico, and moved to Oakland, California, when she was five years old. She graduated from the University of California at Berkeley with a Bachelor of Arts in Political Science in May 2012. After graduating from college, Carvajal Lopez spent a few years working as a paralegal at an immigration law firm. She was an SEO scholar the summer before she started law school and spent the summer after her first year of law school at Davis Polk & Wardwell in New York. She worked this past summer at Morrison & Foerster in San Francisco. Alina Das ’05 is a Professor of Clinical Law at NYU School of Law, where she co-teaches and co-directs the Immigrant Rights Clinic. She and her clinic students represent immigrants and community organizations in litigation and advocacy to advance immigrant rights locally and across the country. In addition to her teaching, Das engages in scholarship on deportation and detention issues, particularly at the intersection of immigration and criminal law. Das also serves as faculty director of the NYU Latinx Rights Scholars Program. Prior to joining the Law School, Das was a Soros Justice Fellow and staff attorney with the Immigrant Defense Project, and clerked for Judge Kermit V. Lipez of the US Court of Appeals for the First Circuit. Das graduated magna cum laude with an AB in government from Harvard University, and graduated cum laude from NYU Law as a Root-Tilden-Kern Scholar with a joint MPA from NYU’s Wagner School of Public Service. Das is a recipient of the LexisNexis Matthew Bender Daniel Levy Memorial Award for Outstanding Achievement in Immigration Law, the NYU Law Podell Distinguished Teaching Award, the NYU Dr. Martin Luther King Jr. Faculty Award, and the NYU Center for Multicultural Education & Programs Nia Faculty Award.

Prior to founding his advisory firm—Yatsen Associates—Jason was Head of China Strategy and Head of Sustainability for Insurance Australia Group, Australasia's largest general insurance company. Before that, he was an M & A lawyer with Davis Polk & Wardwell in New York and Corrs Chambers Westgarth in Australia. Jason has also worked for the United Nations and is the former Vice Chairman of the Australia-China Chamber of Commerce in Beijing. Jason speaks fluent English, Mandarin, Cantonese and German.
