Authoritarian International Law? - In Conversation with Tom Ginsburg

International law is a live instrument in the current global geopolitical crisis. This latest RevDem Rule of Law podcast, conducted by Konstantin Kipp with Professor Tom Ginsburg, reflects upon the potentially authoritarian nature of international law in its function of enabling relations between states. Authoritarian regimes have traditionally been reluctant to engage in robust forms of international cooperation. Reasons for this may include strong nationalist views, and concerns that cross-border engagement could invite interference in domestic affairs or constrain the government's autonomy. Consequently, international law has largely been shaped by liberal democracies. However, this stance appears to be shifting in the 21st century. Just as authoritarian regimes once recognized the strategic value of adopting new constitutions and utilizing seemingly democratic institutions in order to gain legitimacy, they are now beginning to see international law as a potential tool to legitimize their policies and strengthen the pursuit of their preferences. This development was identified by Professor Tom Ginsburg in his 2020 article “Authoritarian International Law?” published in the American Journal of International Law. Half a decade on from this publication, Professor Ginsburg discusses his findings on this still-emerging phenomenon and considers its potential future developments. Past, Present, and Future Authoritarian International Law Ginsburg provides an introduction to the history of Authoritarian International Law (AIL), highlighting the pivotal turning point as marked by the year 2006. He claims that this was the peak for global democracies and that subsequently the story is one of decline.  The conversation explores current developments in international law, raising a concern that the United States' potential shift towards isolationism could cede the international playing field to authoritarian forces like China or Russia, thereby fueling the development of AIL. Ginsburg describes AIL as “designed to extend the survival and reach of authoritarian rule across space and/or time.” AIL is seen as having the potential not only to secure the persistence of existing authoritarian regimes, but also to be a possible trigger for further authoritarianism. The podcast addresses the extent to which this feature is inherently embedded within AIL, given that liberal democracies tend to pose a challenge to authoritarian regimes. Ginsburg reflects upon whether there is a danger that authoritarians might create entirely new international legal systems and institutions, or else seek to capture and transform existing bodies. While an American return to isolationism might fuel the development of AIL, there is also significant concern that the U.S. could veer toward dictatorship during Donald Trump's second presidency. Statements by President-elect Trump, such as suggestions that people “won't have to vote anymore,” imply at the very least authoritarian aspirations. Ginsburg reflects upon whether U.S. isolationism is truly the main danger to international law, or instead whether a government under Donald Trump may actively engage in promoting AIL. Ginsburg offers his view on why, despite his authoritarian nature, Donald Trump will not be able to become the dictator of the United States of America. Authoritarian European Union Law? While the European Union continues to embody relatively strong democratic values among most Member States compared to other regions, right-wing populism with authoritarian aspirations has also been on the rise. The EU's most notable authoritarian leader, Viktor Orbán, has recently advocated that right-wing populists should “occupy” Brussels. Ginsburg considers whether the emergence of authoritarian EU law may be possible. One of the EU's current strategies for addressing “backsliding” on its values, including democracy and the Rule of Law, is financial conditionality. It remains to be seen whether this tool may effectively halt the trend towards authoritarianism in the long term, or whether it may indeed exacerbate it. Ginsburg concludes his reflections on the supranational dimension of AIL by musing upon whether the Eurasian Economic Committee, discussed in his 2020 article, could evolve into a serious competitor that promotes authoritarian rather than democratic values in the Europe-Asia region. Preventing the Emergence of Authoritarian International Law Tom Ginsburg suggests that there is a strong possibility that the 21st century will be known more as an authoritarian century rather than a democratic one. The notion that international law guarantees a right to democratic governance has faced substantial criticism; Ginsburg challenges this idea as well. The podcast concludes with reflection upon the options for democratic countries to prevent international law becoming authoritarian. Could civil society – whether or not such societies aspire to be ‘open' or not – prevent the authoritarian transformation of international law? Ginsburg concludes his contributions by emphasizing how recent developments in South Korea illustrate the vital role of civil society in the struggle for democracy. Such struggle, for democracy and against authoritarianism, is set to continue in the second half of the 2020s.

Seven years after the original Brexit vote, the IIEA welcomes two leading Irish voices on the EU to a panel discussion on Prof Brigid Laffan's recent book 'The EU's Response to Brexit'. About the Speakers: Brigid Laffan is Emeritus Professor at the European University Institute in Florence and was Director at the Robert Schuman Centre for Advanced Studies until her retirement in August 2021. Previously, Prof Laffan was Professor of European Politics at UCD's School of Politics and International Relations and was Vice-President of UCD and Principal of the College of Human Sciences from 2004 to 2011. Prof Laffan was the founding director of the Dublin European Institute at UCD from 1999 and in March 2004 she was elected as a member of the Royal Irish Academy. Paul Gillespie directs the “Constitutional Futures after Brexit” Project in UCD's Centre for Peace and Conflict Research (formerly the Institute for British-Irish Studies). Dr Gillespie is also a columnist, and a former foreign-policy editor, with The Irish Times. He has published widely on British-Irish relations, European integration issues, Irish foreign policy, and Europe-Asia relations, and he is co-editor of “Britain and Europe: The Endgame: An Irish Perspective”. Dr Gillespie is also a longstanding member of the IIEA's UK Group.

From a shared Celtic past, to their politically and economically developed present, there is much that links Scotland and Ireland. The cultural and historical ties between Scotland and Northern Ireland are particularly close. In the past 10 years, and recently accelerated by Brexit, discussion and debate around the UK's constitutional future have intensified. In particular, questions arise as to the impact that Scottish constitutional change would have on its relationship with Ireland, and what the implications of any such change would be for Northern Ireland. In this panel discussion, leading politicians and academics from Scotland, Northern Ireland, and Ireland discuss the Scotland-Ireland relationship, and the likely implications of Scottish constitutional change for Northern Ireland. About the Speakers: Mhairi Black is the SNP Member of Parliament for Paisley and Renfrewshire South. Since December 2022 she has also been the SNP Deputy Leader in the House of Commons. Ms Black was first elected as a Member of Parliament in the 2015 General Election while she was still completing her undergraduate degree at the University of Glasgow. At 20 years old, she was the youngest MP to be elected since the 1832 Reform Act and she remained the “Baby of the House” until 2019. Ms Black was reelected as a Member of Parliament in both the 2017 and 2019 General Elections. Mike Nesbitt is the UUP Member of the Legislative Assembly for Strangford. He was first elected to the Northern Ireland Assembly in 2011, following a successful career in broadcasting for the BBC and UTV. Mr Nesbitt was elected as leader of the UUP in 2012. His time as leader coincided with several significant events in Northern Irish politics, including the decision of the United Kingdom to leave the European Union, the 2016 centenaries of the Battle of the Somme and the Easter Rising, and the collapse of Stormont over the RHI scandal. Mr Nesbitt's leadership of the UUP was notable for his engagement with political nationalism and with Irish culture and heritage in Northern Ireland. Nicola McEwen is the Professor of Public Policy in the University of Glasgow. Between 2001 and 2022, she taught politics at the University of Edinburgh, where she became Professor of Territorial Politics in 2014. She was also a founding co-director at the Centre for Constitutional Change, a leading Centre for the study of research the United Kingdom's changing constitutional relationships. From 2019-2022, she led a major research project at the Centre, titled “A Family of Nations? Brexit, Devolution and the Union”. Professor McEwen has published widely on territorial politics, Scottish politics, devolution, identity politics, and nationalism. Graham Walker is an Emeritus Professor at the School of History, Anthropology, Philosophy and Politics at Queen's University Belfast. His research interests include the political history and contemporary politics of Scotland and Northern Ireland, particularly the politics of Unionism, religious identity in Scotland and Northern Ireland, and the history and contemporary role of the Labour movement in the United Kingdom. He has published extensively on Scottish and Northern Irish politics, and most recently co-authored “Ties that Bind? Scotland, NI and the Union”, which examines the interaction and interdependence of politics in the devolved jurisdictions of Scotland and Northern Ireland. Dr Paul Gillespie directs the “Constitutional Futures after Brexit” Project in UCD's Centre for Peace and Conflict Research (formerly the Institute for British-Irish Studies). Dr Gillespie is also a columnist, and a former foreign-policy editor, with The Irish Times. Christine set up her business after spending four years in the Cayman Islands working for a company and providing tax advice. Upon spending several years developing her tax knowledge she felt it was then time to do what she had always envisioned for herself, that is create flexibility within her work. In setting up her own business, Christine has managed to do just that and now spends her time between Spain, Ireland and any other country she chooses while working online. Christine and I also touched on areas like our professional exams, becoming an accountant/ tax advisor & life as an associate.  Moreover, Christine elaborated on investing, how she manages her money and the minimalist life she has chosen that enables her to live debt-free.  Other areas we discussed included Christine's time as a solo- traveller, how she dealt with the 'gap' in her CV and the various parts of the world she saw while travelling both Europe & Asia. This week's EYE ON NPI is a self-starting go-getter, it's the EDK350/EDK350U Developer Kits from EnOcean (https://www.digikey.com/en/product-highlight/e/enocean/edk350-and-edk350u-developer-kits) - containing everything you need to get started with energy-harvesting / self-powered sensors. These kits are a great way to explore and understand the EnOcean series of solar & mechanical energy-harvesting switches and sensors. As engineers, we're often tasked with 'smartening up' existing structures: whether that's machinery, agriculture, buildings, cars, appliances, etc. The last few decades have given us ultra-cheap sensors and radios - which means we are able to gather data from a wide area and store it centrally, the Internet of Things! (https://en.wikipedia.org/wiki/Internet_of_things) That means just about every project and product you will work on is going to have sensors, data storage and wireless - but with great technology comes great complexity: you now have to worry about shuffling that sensor data around, and nothing eats up batteries like constantly having to wake up and transmit radio data. In fact, a lot of the really tough engineering with sensor networks is not in picking the radio or sensor but in how to keep the battery lasting as long as possible. Particularly since folks like products with small, rechargeable batteries - but they don't like having to constantly plug them in. Moreover it's really hard to let people know when something needs to be recharged - there's the problem of "well we need power to blink an LED or sound a buzzer which will drain the power even faster - but if we blink or buzz too rarely it may not be caught in time to change out the battery before it dies". Also known as the 'smoke detector issue' - Americans kind of solved this by starting a campaign to check smoke detector batteries on every daylight savings change (https://www.nfpa.org/Public-Education/Staying-safe/Safety-equipment/Smoke-alarms/Changing-clocks-and-batteries). Great for individual households with maybe 3 or 4 smoke detectors - not great if you have dozens or hundreds of light switches or soil moisture sensors. EnOcean solved this in a typically engineer-y fashion: what if, instead of having batteries which add cost, maintenance and life-cycle management...we just didn't? Instead, their devices use energy harvesting (https://www.youtube.com/watch?v=zJIlG-KbFzE), which means that - in theory - there is no installation or maintenance costs at all. Once installed, it will forever sip power from motion or ambient light until there's enough power for a transmission. EnOcean even has their own low power 900/868MHz radio modules with integrated 8051's that are specifically designed for quick startup, sensing, transmission and power down. The most famous is their ECO200 mechanical energy harvesting switch, (https://www.enocean.com/en/product/eco-200/) which also made it into the Philips Hue wireless lighting system (https://meethue.co/hacks/convert-hue-tap-to-a-light-switch/), a great fit since the whole system is wireless, and there's a natural inclination to associate pressing a button with changing the light settings. In addition to the classic mechanically-powered switches, there's also a series of micro-solar powered sensors, (https://www.enocean.com/en/product-category/self-powered-sensors/) good when you need to have a slow but continuous measurement of environment. Tuck these near a fluorescent light fixture and you could sip enough power to send data once every few hours or per day - no wiring or installation required. His father, Bill was a local promoter of Jamaican music in the 1960s and ran his Savoy Sound System at several locations in south London. After graduating from Guildhall School of Music and Drama, Tyber began busking with his brother Si Cranstoun on the streets of Canterbury and South London where his distinctive vocals and lively performances soon began to draw in large audiences. [2:18] Absolutely. I grew up in Rochester, New York, which is near Niagara Falls. As an adult, I moved to New York City, where I lived for about five years, and I loved it. I was a journalist there. I went to journalism school there. I worked in the Columbia Business School admissions office and felt like I was entering a movie every day, helping people achieve their dreams as well as pursuing my dream. Then I moved to Washington D.C. and got to experience living in the city that's the seat of government and watching U.S. politics up close. Then I moved to Islamabad, Pakistan, where I also worked as a journalist and admissions consultant. It's a beautiful city. It's right in the foothills of the Himalayas. I had a wonderful time there, and that's where I started my family. After that, I lived in Qatar for a little while. Family had brought me there, and I worked from there as well. That was a really interesting experience. I found it to be incredibly diverse. I met people from all over the world who had come to work there, and did a lot of hanging out in mall food courts so we could have some yummy meals while staying out of the heat, and just made some wonderful friendships. Then I moved from there to Berlin, Germany, and I love it here. Anna Lorentz (ASIJ 2009) and Alissa Lorentz (ASIJ 2005) Marketing & Communications (Alissa) Account Management & Sales (Anna) ALISSA BIO Upon graduating from Princeton Alissa moved to Munich to work at a German advertising agency as a creative despite speaking 0 German. With the exception of a work project in Abu Dhabi, she's lived in Europe ever since. After working at the agency she moved to Stockholm to study digital design at Hyper Island in Stockholm. During this time she created interactive music videos and telemedicine apps on the side during her free time. Once she graduated from Hyper Island, she joined Augify, a data visualization start-up, as VP of Creative, Marketing, and Design where she developed the branding and marketing strategy from scratch. Several winters in Sweden prompted Alissa to leave. She then moved to Basel, Switzerland to work for Clariant, a specialty chemicals company, as their Global Social Media Lead. She remained at Clariant for several years and held positions as Global Marketing Communications Business Partner and Global Customer Experience Lead for their personal care and cosmetics unit. She also led the marketing and branding work for one of Clariant's startups, Chemberry, a personal care ingredient search engine. ANNA BIO At Princeton, Anna was interested in language and cultures, and focused her studies around Mandarin and Brazilian Portuguese. She wrote her thesis on China-Brazil trade relations and immigration. After graduating in 2013, she started her career in advertising as an Account Manager at Ogilvy & Mather in New York, working on brands like SAP and Comcast. After 2.5 fun-filled years, and lots of socializing with fellow ASIJ-ers in the city, she made the bittersweet decision to move to Bangkok, her hometown, out of a desire to work on global brands outside of the U.S. market. In Thailand, she worked at TBWAThailand as Account Supervisor, leading their Myanmar accounts. In late 2017, this opportunity led her to work in Singapore, as Associate Account Director at a different agency called BBH, on the Nike account. Anna flew around the region with her team and activated digital and experiential campaigns in Bangkok and Manila. In 2019, in a bit of a plot twist, she decided to pivot to the tech industry and move to Europe. She now works in Sales at Unbabel, an AI translation startup, based in Lisbon, Portugal. Episode 28 Alissa Lorentz (ASIJ 2005) & Anna Lorentz (2009) Marketing & Communications & Account Management & Sale The two explain to Nick their upbringing and how they learned to grow up with Japanese, Thai, and English at the same time. Nick asks the two what type of advice they would have for mixed families who hope to teach their children 2, 3, even 4 languages. Alisa emphasizes that its' important that parents stay consistent with the languages they teach to their children, and fight the urges to "cave in" if a child begins to focus only on one language, and may reject the "minority language". The three discuss how language acquisition is often highly nuanced, and even within the same family, there will be somewhat of a deviation of language levels amongst siblings. In the second half of the podcast, the three discuss how culture affects the workplace. Shidoshi Jean Francois “Phoenix” Le Grand is the Founder & Creator of Lost Legacy Systems Traditional Mixed Martial Arts and all systems within it.  Founded in 1998, Lost Legacy Systems is an eclectic system of Martial Art Styles; consisting of elements and concepts from Chinese, Japanese, Korean, African, American and Thai Martial Arts.  Specifically, different forms of Chinese Kung Fu; Japanese Karate, Jiu Jutsu, Ninpo/Ninjustsu and Kobū-jutsu, African Montu Arts and Martial Sciences and Korean Tae Kwon Do. His fusion of five ways of fighting – hands, feet, throwing, grappling and weaponry form into one effective, extreme and innovative Martial Arts system of combat. Lost Legacy Systems consists of: Lost Legacy Traditional Mixed Martial Arts, Lost Legacy Kung Fu, Lost Legacy MMA, Lost Legacy AfraKata and Lost Legacy S.T.E.A.L.T.H. Kage Ninpo Ryu. SHIHAN SHANNAH ROBIN Shihan (Master Instructor/ Teacher of Teachers) Shannah Robin was born in the Commonwealth of Dominica and began training in Martial Arts at the age of 11. His love and passion for all elements of Martial Arts evolved into a prolific career, with him becoming an instructor, then becoming a Sensei (Teacher), followed by the creation of his own Martial Arts fighting system, the establishment of his own academy, and eventually obtaining the rank of Shihan. Shihan Robin currently holds a 6th Degree Black Belt, the highest level attained by Dominican. He is also the first Domincan to create his own martial arts style, and the youngest Dominican to receive the Services Medal of Honour Award for his outstanding contributions ton his cvountry in working with youth through martial arts. He holds a gold medal in the 2005 Commonwealth Amateur Boxing tournament, He won the World Championship for Demo Team at the Purple Dragon Karate Championship in 2010, and was inducted into the Caribbean Martial Arts Hall of Fame for Sensei of Year that same year. He is the first Martial Artist from the Caribbean to compete and win in a demonstration at the Shaolin Temple. He was traveled throughout the Caribbean and wider world honing his skills, including in the Americas, Europe & Asia. Most recently he underwent a 6 month training course at the Henan University of Technology in China where he trained along with 19 other Martial Artist from around the globe in various techniques. Robin, despite being the oldest in the class emerged 1st in all categories. He also trained at the Shaolin Academy where he learned the art of Tai Chi, and performed demonstrations with the resident monks. Shihan Robin leads by example with integrity, self-respect, and self determination, combined with the practice of living a healthy lifestyle and building a strong body, mind and spirit. Matt and Ariel travelled for 10 months in 2017-18 in Europe, Southeast Asia, Australia, Tasmania and my favourite part: wrapped up the trip with a retrofitted van and camped their way through the United States public lands. This was their “pre-moon”: a honeymoon before getting married! Europe: 7:30 Germany, Switzerland, Spain, England Portugal in the off-season (November) was fantastic! Particularly: Lisbon, Ericeira, Porto, Coimbra, National Park of Peneda-Geres Southeast Asia and Australia/Oceania: 19:16 Thailand, Vietnam and Cambodia Purple Monkey Hostel in Pai, Thailand Andaman Dive Adventures for scuba diving in Koh Lanta, Thailand Australia and a Tasmanian road trip: Tasmania was an underrated destination! Roadtrip in America: 30:00 The West is Best – camping on the public lands in the United States was some of their cheapest and most rewarding portion of our travels, in a Toyota Senyina mini-van. Southwest Corner: Utah, New Mexico, Arizona, Colorado (major National parks examples- Grand Canyon, Zion, Bryce Canyon, Canyon Lands) Drove across the mid-west, explored the east coast White Mountain region, Maine (e.g. Acadia National park), Visited friends, family and the Great Lakes, finished the trip in Yellowstone National Park and the Teton region

Grant Johnson, Brian Rix, Shirley Hardy-Rix, Sam Manicom and Jim Martin. Missing this week is regular Graham Field.   Episode 4 Topics: Lane splitting & Filtering   It’s a dangerous situation for a motorcyclist to be caught in traffic, the stop and go, distracted drivers, etc. The University of California at Berkeley published a report in May 2015 that says “motorcyclists who split lanes in heavy traffic are significantly less likely to be struck from behind by other motorists”. The National Agenda for Motorcycle Safety studied safety implications of lane splitting. “A motorcycle’s narrow width can allow it to pass between lanes of stopped or slow moving cars on roadways where the lanes are wide enough to offer an adequate gap. This option can provide an escape route for motorcyclists who would otherwise be trapped or struck from behind. There is evidence that travelling between lanes of stopped or slow-moving cars (i.e. land splitting) on multiple-lane roads (such as interstate highways) slightly reduces crash frequency compared with staying within the lane and moving with other traffic.” Lane splitting and filtering are a normal practice in many countries…Europe…Asia… riders are expected and sometimes required to pass between vehicles and advance to the front of the group.  If you are not accustomed to lane splitting and filtering (prohibited in most of United States and Canada) and you go to a country where it is law or expected, how can you be prepared for that?  What if you don’t want to lane split - it’s too scary or intimidating - how do you handle that? Do you avoid it? Just not do it?   Essential Repair Skills & Tools?
