Clause 8

Kevin Mack, the new president of Via Licensing Alliance, joins Eli for the Clause 8 season finale.Kevin talks about Via's plans to build its next patent pools around "de facto" standards — technology the market adopted on its own, with no standards body behind it — which would push collaborative licensing into territory it has never touched. Mack also takes a hard look at the royalty-free models spreading through tech and AI, from AV1 to the new Shared AI License Foundation (SAIL), argues that "free" rarely stays free, and explains why he's optimistic about where the patent system is heading.Kevin and Eli also discuss:*Via's model and the "tipping point" that turns a pool from a few licensors into thousands of licensees*"De facto" standards: pooling patents for technology no standards body ever blessed*Leadership turnover at Via, the HEVC pool's move to Access Advance, and a new strategy-and-growth group*The push into semiconductors, including a new DRAM memory program*AV1, SAIL, and why Mack thinks royalty-free rarely stays free*Whether AI patents are as "foundational" as advertised — and why "AI is not new"*Efficient infringement, patents as property rights, and why companies ultimately take a license*The mood out of Via's Rome summit and a US patent system tilting back toward ownersNotable names, companies & standardsPeople: Kevin Mack (president, Via Licensing Alliance); Heath Hoglund (former Via president); John Amster (Jamster Capital; RPX co-founder)Organizations: Via Licensing Alliance (Via LA), MPEG LA, Dolby, Access Advance, Alliance for Open Media, Shared AI License Foundation (SAIL), WIPO (PatentScope), DOJ, USPTOSAIL founders / board (public): Anthropic, Genentech, IBM, Meta, Microsoft; board observers eBay and TD Bank Group; members include Block and FigmaStandards & technologies: AAC, AVC (H.264), HEVC (H.265), AV1, MPEG-2, Qi wireless charging, DRAM memory, SEP / FRANDDisclaimer This is a public episode. Editors - Esther Sokolow, Glenn Garland ACE and Matthew V. Colonna ACE IT: Welcome to Derry editors Esther, Glenn and Matt had never worked together prior to the new HBO series, but quickly formed a family bond that translated into a fun and creative cutting room.  Their antics included scaring unsuspecting tourists taking the Warner Brothers tram tour past their offices.  And you know what Jack Torrance says about "all work and no play"! Developed by Andy Muschietti, Barbara Muschietti and Jason Fuchs, It: Welcome to Derry is based on Stephen King's 1986 novel It and is a prequel to the films It (2017) and It: Chapter Two (2019).  The series takes place in 1962, when a couple and their son move to Derry, Maine just as a young boy disappears.  With their arrival, bad things begin to happen in the town.  Again. ESTHER SOKOLOW Esther Sokolow is a Los Angeles-based editor who specializes in genre-rich storytelling, bold characters, and projects with cinematic scope.  Esther's collaboration with IT: Welcome to Derry showrunner Andy Muschietti began on IT: Chapter Two, where she served as 1st Assistant Editor, and continued on The Flash, where she was promoted to Additional Editor. Her work bridges studio tentpoles and independent character dramas, with a focus on horror, psychological thrillers, and supernatural themes. Her early film diet of Hitchcock, classic mysteries, and silent comedies provided provided inspiration for an editor drawn to tension, timing, and the emotional weight of what's unspoken. Later, the spectacle of The Lord of the Rings sparked a love for scale and the thrill of stories that move an audience. Originally from Atlanta, she moved to California to study Film Editing at Chapman University. In 2015, she was selected as an honorary intern for American Cinema Editors (ACE), an experience that shaped her early career and inspired a commitment to both craft and mentorship. Esther now speaks on an annual panel for the ACE Internship Program and serves on MPEG's Apprenticeship and Growth Committee, supporting the next generation of editors and assistant editors. Before stepping into the editing chair, Esther worked as an assistant editor on feature films including Rampage, Bloodshot, The Guilty, Stronger, Fall, and Rememory. She also worked in-house as a VFX Editor at Method Studios, contributing to Guardians of the Galaxy and San Andreas. Her years supporting other editors honed more than technique; they taught her to listen to pacing, to performance, and to subtle story beats others might overlook. That same quiet attention now shapes her own work. GLENN GARLAND, ACE Glenn Garland is television and film editor with more than twenty years of experience in the entertainment industry. In addition to cutting IT: Welcome To Derry, other impressive TV credits include Poker Face, The Vampire Diaries, Preacher, Banshee, Stan Against Evil, and Altered Carbon. Glenn's equally notable feature resume includes editing Rob Zombie's Halloween and Halloween II, the critically acclaimed King of California, The Turning, Lords Of Salem, The Devil's Rejects, Black Box and most recently Broke. In addition to editing, Glenn has produced the television series Paradise City as well as feature films 31, Jersey Bred, LX 2048, The Man Who Was Thursday and most recently, Life Is. He has also created and hosts the podcast series Editors on Editing, which can be heard on Art of the Frame. MATTHEW V. COLONNA, ACE Aside from his work on It: Welcome to Derry, Matt's work can be seen on another Stephen King-inspired series, Castle Rock, and the King-adjacent series, Locke & Key.  Other notable tv shows cut by Matt include Dexter (2008-09), Narcos (2015-17) and Sugar (2024).  Matt also happens to be one of the original drummers for Black Eyed Peas.  How about that?! “With AI, there is so much to innovate, it gives people an equality.” “Everybody has something to give.” “There are three things we all need: a coach, a mentor, and a sponsor. A coach talks to you, a mentor talks with you, and a sponsor talks about you.”   Episode summary | In this episode of Return on Generosity, host Shannon Cassidy speaks with Yvette Kanouff, an Emmy award-winning technology pioneer, about the importance of generosity in the workplace. Episode Overview In this episode of The Design Vault, hosts Albert Shum and Thamer Abanami explore the revolutionary TiVo digital video recorder, a product so transformative it became a verb, yet ultimately couldn't capitalize on the future it created. From the moment TiVo demonstrated pausing live TV at CES 1999, leaving journalists bewildered by this "magic trick," to its eventual relegation as a feature in cable boxes, TiVo's story exemplifies the classic innovator's dilemma. This episode reveals how two Silicon Graphics engineers created the first truly intuitive TV interface, pioneered recommendation algorithms, and invented binge-watching culture, only to watch cable companies commoditize their revolution with inferior but "barely good enough" alternatives. Along the way, he offers his unique insights on such subjects as continuity and discontinuity in editing, dreaming, and reality; criteria for a good cut; the blink of the eye as an emotional cue; digital editing; and much more. In this second edition, Murch reconsiders and completely revises his popular first edition's lengthy meditation on digital editing (which accounts for a third of the book's pages) in light of the technological changes that have taken place in the six years since its publication.Get a copy herePodcast Rewind:Jan. 2024 - Ep. 24…The Making Of is published by Michael Valinsky. If you'd like to be considered as a guest, or to promote your products to over 10K top film & TV production pros reading this newsletter, email us: mvalinsky@me.com Get full access to The Making Of at themakingof.substack.com/subscribe

In 1995, he joined Bell Laboratories for a PostDoc term working on the development of MPEG-2 Advanced Audio Coding (AAC).  By the end of 1996, he went back to Fraunhofer IIS to work on the development of more advanced multimedia technology including MPEG-4,  MPEG-7, MPEG-D, MPEG-H and MPEG-I, currently as the Chief Executive  Scientist for the Audio/Multimedia activities at Fraunhofer IIS,  Erlangen. In September 2010, Prof. Dr. Herre was appointed full professor at the University of Erlangen and the International Audio  Laboratories Erlangen. He is an expert in low-bit-rate audio coding/perceptual audio coding, spatial audio coding, parametric audio object coding, perceptual signal processing and semantic audio processing.  Prof. Dr.-Ing. Herre is a fellow member of the Audio Engineering Society  (AES), chair of the AES Technical Committee on Coding of Audio Signals and vice chair of the AES Technical Council. Prof. Dr.-Ing. Juergen  Herre is a senior member of the IEEE, a member of the IEEE Technical  Committee on Audio and Acoustic Signal Processing, served as an associate editor of the IEEE Transactions on Speech and Audio Processing and was an active member of the MPEG audio subgroup for almost three decades. Juergen explains the science of the key technology concepts behind the worldwide adopted family of MPEG codecs and we discuss the latest addition of the reference model for the virtual and augmented reality audio standard - MPEG-I Immersive Audio.
