This week, we're discussing one of the highest-profile assassinations we've seen in a long time. One where the killer used a 3D-printed firearm, and video of the attack has been viewed countless times across the country. To figure out what effect all of that might have on the homebuilt gun community, we've got Rob Pincus back on the show. He's a part-owner of a licensed firearms company but also the organizer of the Gun Maker's Match. He explained what it was like to have a foot in both worlds and explained the evolution of home gun making from the 1990s through today. He said the tech had advanced a great deal over time, but most home builds still require factory-made parts, and he hopes to get the industry more involved in that side of the gun business. However, he admitted this month's high-profile killing is likely to set those efforts back. Pincus argued the attention is probably going to bring even more scrutiny to 3D-printing guns. That's likely to amplify the fight over homebuilt firearms. Still, Pincus said he doubts it'll lead to new restrictions at the federal, or even the state, level. Special Guest: Rob Pincus.

The rent control debate is gaining momentum at the top of the legal food chain. New York landlords are asking the Supreme Court to overturn lower court decisions on a 2019 rent stabilization law, and several national real estate groups are showing support. If the high court takes the case and rules in their favor, experts say it could “destabilize” rent stabilization laws across the nation.   Hi, I'm Kathy Fettke and this is Real Estate News for Investors. If you like our podcast, please subscribe and leave us a review.   The two landlord groups pushing for a Supreme Court review of the lower court rulings are the Community Housing Improvement Program and the Rent Stabilization Association. They are both based in New York, and claim that the 2019 “Housing Stability and Tenant Protection Act” is unconstitutional. The law is also known as the Rent Stabilization Law or RSL. (1)   Housing Stability and Tenant Protection Act   The landlords lost their case in federal court and the court of appeals, so they are now hoping that the conservative-leaning high court may offer a different opinion. Within the past few weeks, several major business and real estate groups threw their weight behind the plaintiffs including the U.S. Chamber of Commerce, the National Association of Realtors, the National Association of Homebuilders, the National Apartment Association, the Mortgage Bankers Association, and others. They showed their support by submitting amicus briefs, which is like saying they are friends in support of the plaintiffs who would like the Supreme Court to grant a writ of certiorari or, in plain English, a review of the case. In other words, they want the Supreme Court to accept the case.   The lawyer representing the plaintiffs, Andrew Pincus, told the National Review that the RSL is a property rights infringement. He says: “The Constitution has certain property protections, one of which is the Fifth Amendment's takings clause.” That means that the government is not allowed to take private property for public use without “just compensation.” He says that that concept is at the heart of the lawsuit. (2)   Property Rights Infringement Under the “Takings” Clause   Under the umbrella of the takings clause concept are two supporting arguments. One claims that the RSL is equal to a regulatory “taking” based on a 1978 case out of New York City. It's related to the economic impact of the law, the extent of the government interference, and the kind of government action being taken. The second argument is based on a 2021 case out of California where the court ruled that a law allowing union organizers onto private property amounted to a physical taking. Pincus compared this to a landlord's situation by saying: “They can't choose their tenants freely, nor can they reclaim their property as they wish.”   In the case of the RSL, critics say it dictates who can live on the property, how long they can live on the property, how much or how little they should pay in rent, and how much the property owners can invest to maintain the property – all of which have an impact on the financial viability of being a landlord and whether the landlord is allowed to make reasonable use of the property.   On the other side of the argument, are New York City officials and rent stabilization supporters who say the law does “not” amount to a taking because the property owners are not deprived of the economic benefits, according to certain standards known as Penn Central standards which resulted from one of the previous lawsuits I mentioned. Pincus disagrees, saying it runs contrary to the requirement of “just compensation” when private property is taken for public use.   Other RSL Issues Undermine Benefits for Needy Tenants   Critics also highlight other downsides of the law that actually hurt tenants. One is the lack of a method for determining whether tenants truly need low cost housing. Pincus says it's more of a lottery, where some lucky tenants get a great deal on rent despite the size of their paycheck. And other tenants, who might really needs a break on the rent, are sidelined.   Another is that many tenants remain in rent-controlled units long after they need financial help, which prevents low-income tenants from accessing housing they truly need. Joe Strasburg of the Rent Stabilization Association says it “gives people a huge incentive to stay in apartments no matter what.”   No word yet on whether the Supreme Court will accept the case.   You'll find links to our sources at newsforinvestors.com. Hey!!!!!!!!!!!!! We missed yall! The last two weeks have been crazy busy and we were glad to be a part of all of it. From our own team finishing 2nd in the East Coat Got 'Em On to all the fun that goes into volunteering and heloping promote and also fishing in The Hooked On Miracles tournament in Charleston, Capt. E and the entire family spent the 3 days of HOM volunteering and enjoying all the fun of raising money for such a great cause. We also got to enjoy watching our own partner, Freeman Boatworks bring home the win for the 3rd straight year in Charleston. But before that weekend our guys were busy bringing home some hardware themselves in the Carolina Beach, East Coast Got 'Em On. This is the oldest king tourney in the southeast and to finish 2nd against some of the best in the sport was an honor for our team. Capt Lucas, Capt. E, Capt, Jay Baisch, Winston, and McClure Hopkins were able to enjoy a prolific bite for two days and managed to top it off with a 42.66lb missile. Capt. E discusses just how the weekend played out and our special guest this week is no stranger to finishing at the top in king tourneys. This week Capt. Marc Pincus joins Capt. E to talk about the SC HUK Satlwater Series and exactly what it offers tournament anglers and why he started the 3 event series. After Harris County Deputy Kent McGowen fatally shot and killed Susan White on August 25th, 1992, ADA's Ed Porter and Don Smyth were immediately suspicious that this was not done in self-defense. Rumors began to swirl that Kent and Susan had a brief relationship, and once it was ended, Kent was left enraged. Depositions showed that Susan believed she was being sexually harassed by Kent, but no formal reports or complaints were made. Investigators were soon convinced Susan White's death was not self-defense, and Kent was indicted by a Grand Jury on October 27th, 1992. After discussing what mass arbitration is and its growing use for claims against companies in the consumer finance industry, we discuss the factors that make companies most vulnerable to mass arbitration claims. We then identify drafting strategies for arbitration agreements to deter the initiation of mass arbitration claims. We look next at how companies can benefit from the use of bellwether procedures, address criticism of such procedures, and discuss ethical issues that have been raised regarding the use of mass arbitration by plaintiffs' attorneys. We conclude by discussing how the most widely used arbitration administrators have responded to the growing use of mass arbitration and how alternative administrators have approached mass arbitration, addressing criticism of industry for challenging the use of mass arbitration, and looking at whether companies should consider abandoning the use of arbitration agreements in response to mass arbitration. In this episode, David interviews neuroscientist, artist, and educator, Melanie Pincus, Ph.D.; and Ph.D. candidate in Neuroscience, lead or co-author on over a dozen scientific publications, and regular contributor to PT, Manesh Girn.  They tell their stories of how they became interested in neuroscience, and stress the importance of staying radically open-minded (or “epistemically naive”) when it comes to how much we can claim we understand about the brain, the mind-body connection, and consciousness itself – that while fMRI and other advances have brought us a long way, there are still a ton of “unknown unknowns,” especially around creativity, decision making, and imagination. They discuss the misconception that we only use 10% of our brains; comparisons between the brain and the universe; society's misunderstanding of “happy hormones” (dopamine, serotonin, etc.); how chronic stress takes a toll on all parts of the body; how MDMA works with memory processing; and how stacking modalities with the psychedelic experience (like play or activities focused on emotion regulation) can really help with personal goals and growth.  They have taken their understanding and fascination with neuroscience and applied it to a new course in our Psychedelic Education Center: “Psychedelic Neuroscience Demystified: How Psychedelics Alter Consciousness and Produce Therapeutic Effects“: an 8-week live course with 10 hours of prerecorded material and a built-in community. "He always was and continues to be a shining light in his loved ones' lives."  There are two versions of the debate between Rabbi Ami and Rabbi Asi's understanding of our Mishna. In the first version, one holds the Mishna allows the item to be returned only in the case where the returner's property was forbidden to the one who lost their item and the other holds the Mishna is referring to both. In the second version, one holds that the case of the Mishna is only when the possessions of the one who lost an item are forbidden to the returner but not in the reverse case and the other holds the Mishna is referring to both. In each version, the Gemara raises a question from the Mishna's last line: "If it is in a place where people get paid for returning lost items, the money goes to the Temple." In the first version, the question is resolved. In the second version, it is not. Rava brings a law regarding the transgression of meila, misuse of consecrated property, in a case where one sanctified an ownerless item and then picked it up to either eat it or promised it as an inheritance to one's children. What is the difference between the cases? Rav Chiya bar Avin asked Rava a question: If one says "My loaf is forbidden to you," and then gifted it to that person, did they mean to forbid it only as long as it was their own and not if they gave it as a gift? Or was the focus of the sentence, it will be forbidden to you, and will therefore be forbidden forever and the person was saying it so as not to have the other pestering them to gift the item to them? Rava answers that the latter is the case, by providing a logical proof, but Rav Chiya questions his logic.
