In this episode, we're joined by Police and Crime Commissioners Joy Allen (Durham) and Philip Seccombe (Warwickshire), two passionate leaders at the forefront of road safety reform. Together, they unpack the evolving role of PCCs in shaping both local and national road policing strategies. From relaunching partnerships and rolling out tech like ANPR and Operation Snap, to pushing for bold policy changes like lower drink-driving limits and graduated driver licensing, they aren't holding back. Both share hard-won insights, what they wish they'd known when they started, what needs to change, and how collaboration (across agencies and communities) is the real engine behind safer roads. We also hear about the powerful impact of victim advocacy, the importance of holding forces accountable, and how every traffic stop could disrupt wider criminal activity. This is a must-listen for anyone invested in road safety, policy innovation, and community protection.Find out more about Project EDWARD here.Welcome to the Project EDWARD Podcast, where we explore data-driven actions for safe mobility. Next Stop on the FTC's Rulemaking Train: Proposed Revisions to the Business Opportunity Rule

The FTC voted unanimously to issue an Advance Notice of Proposed Rulemaking (ANPR) considering expansions to and revisions of the FTC's existing Business Opportunity Rule (“BOR”). This will be the first review of the BOR since it was promulgated back in December 2011. In her statement announcing the ANPR, Chair Khan indicated that “[t]he rule had served the public well over the years,” but “several varieties of scams . . . fall outside the scope of the existing rule, [including] certain kinds of business coaching and work-from-home programs, investment programs, and e-commerce opportunities.” In a familiar refrain in the FTC's push for rulemaking, Chair Khan argued that “case-by-case enforcement has key limitations—especially after the Supreme Court's AMG decision” finding that the FTC lacked authority to obtain equitable monetary redress under Section 13(b). https://www.adlawaccess.com/2022/11/articles/next-stop-on-the-ftcs-rulemaking-train-proposed-revisions-to-the-business-opportunity-rule/ Subscribe to the Ad Law Access blog - www.adlawaccess.com/subscribe/ Subscribe to the Ad Law News Newsletter - www.kelleydrye.com/News-Events/Pub…and-Views?dlg=1 View the Advertising and Privacy Law Resource Center - www.kelleydrye.com/Advertising-and…Resource-Center Find all of our links here linktr.ee/KelleyDryeAdLaw Hosted by Simone Roach Produced by Jeff Scurry

The FTC and CFPB are Coming for “Junk Fees,” but What Does that Really Mean?

The FTC's Advanced Notice of Proposed Rulemaking (ANPR) seeking comment on a potential rule prohibiting “junk fees” and related practices hit the Federal Register yesterday. The rule has the potential to fundamentally alter how fees are disclosed in advertising and across the customer experience in nearly every industry that charges some type of fee. Interested parties now have until January 9 to provide comments and feedback on the proposal. The ANPR's publication follows a series of meetings and announcements by the FTC, CFPB, and President Biden that the administration was taking actions to prohibit so-called “junk fees” that “can weaken market competition, raise costs for consumers and businesses, and hit the most vulnerable Americans the hardest.” Subscribe to the Ad Law Access blog - www.adlawaccess.com/subscribe/ Subscribe to the Ad Law News Newsletter - www.kelleydrye.com/News-Events/Pub…and-Views?dlg=1 View the Advertising and Privacy Law Resource Center - www.kelleydrye.com/Advertising-and…Resource-Center Find all of our links here linktr.ee/KelleyDryeAdLaw Hosted by Simone Roach Produced by Jeff Scurry

Our discussion examines the FTC's Advanced Notice of Proposed Rulemaking relating to what it describes as “commercial surveillance” and the CFPB's circular confirming that covered persons and service providers may violate the Consumer Financial Protection Act's prohibition against unfair acts or practices when they fail to adequately safeguard consumer information.  We consider the ANPR's scope, its areas of focus, and potential federal and state obstacles to the FTC's initiative. After providing an overview of the CFPB's circular, we look at the data security measures highlighted by the CFPB, the CFPB's authority to address data security, precedents to which companies can look in assessing the adequacy of their data security measures and potential exposure, and steps to mitigate risk. Alan Kaplinsky, Ballard Spahr Senior Counsel, hosts the conversation, joined by Greg Szewczyk, Co-Leader of the firm's Privacy and Data Security Group, and Tim Dickens, an associate in the firm's Litigation Department focusing on privacy and data security.

The Compliance 911 Show

For many years bankers have wondered if there is a safe harbor under the various CRA tests but regulators would never comment on or disclose anything in response to questions about this matter. However, the 2020 NPR issued by the FDIC and the OCC and the 2020 ANPR proposed a concept the regulators called "comparators" that established a bright line for minimum performance that would rate as "satisfactory" performance for CRA examination purposes. Listen to CRA expert Len Suzio explain what the concept entails and how it would be calculated. Although not yet adopted, it gives insight into what Len describes as the "unofficial" performance standards. Brought to you by GeoDataVision and M&M Consulting
