“The Wreckless Eric 1980 Sessions” - A Radio Owlsnest Special. I've been wanting to record this show for a very long time, and after re-mastering some precious vintage cassette demos, I feel the time is right to tell the story of working with iconic punk legend “Wreckless Eric” in 1980. Along with my songwriting partner of that period, Brian Fairweather, the three of us wrote and demoed 6 brand new cracking songs for a potential Wreckless Eric album to be released on the infamous Stiff records. The demos were recorded in my little London bedsit flat on a rudimentary analog 4 track tape machine set-up - as raw and primitive as you could imagine … but I believe these tracks have a very special undeniable power about them that reflect the zeitgeist of that era. And Wreckless (Eric Goulden) was in fine form lyrically and vocally on these (up to this point, never heard or released) extremely rare demos. We wrote and recorded these songs over a frantic period of three weeks in my minuscule bedsit featuring Brian on multiple guitars and effects and backing vocals, me on bass guitar and sparse keyboards and backing vocals, and Eric on rhythm guitar and lead vocals. And we used a first generation Roland CompuRythmn 68 drum machine for our drums. Dave Robinson, the head of Stiff records, was very excited and encouraged by our homemade efforts and set dates in a professional studio to record the songs (with Brian and I in the band) for the prospective new “Wreckless” album. But alas, tragically, it was not to be … Although full band rehearsals took place, and a producer (Bob Andrews of Graham Parker and the Rumour fame) was selected, and we even found ourselves set up in Battery Studios, London, waiting to record the album master tracks, Eric didn't turn up for the final sessions! After all these years, I still hear the potential of these raw songs. And I believe they portray the unique artistry of one of England's greatest eccentric punk artists and poets, at the very height of his creative ability. We have a fun “this day in legal history” for today – it's the anniversary of the start of the Scopes Monkey Trial. The Scopes "monkey trial" took place in 1925 and involved the prosecution of high school teacher John T. Scopes for teaching evolution, which was prohibited by Tennessee's Butler Act. Scopes was found guilty and fined $100, but the Tennessee Supreme Court later overturned the conviction due to a technicality. The trial was initiated when the American Civil Liberties Union (ACLU) offered to support any teacher willing to challenge the Butler Act's constitutionality.George W. Rappleyea, the manager of a local company in Dayton, Tennessee, saw the ACLU's advertisement and saw it as an opportunity to put Dayton back on the map. Rappleyea gathered a group of prominent residents, including school superintendent William White, who recruited Scopes as the defendant. Ironically, the textbook used in Tennessee schools, George W. Hunter's "A Civic Biology," endorsed evolution, thus requiring biology teachers to violate the Butler Act.The trial gained national attention, and renowned attorneys William Jennings Bryan and Clarence Darrow joined the prosecution and defense, respectively. Bryan opposed evolution due to its association with eugenics and social Darwinism, while Darrow was a respected lawyer known for his involvement in high-profile cases. The trial had a festive atmosphere, with banners, large crowds, and the first live radio broadcast of a trial.The trial ended with Scopes being found guilty by the jury in a remarkably short time of nine minutes. However, the Tennessee Supreme Court overturned the conviction because the judge had imposed a fine of $100, exceeding the jury's authority. While upholding the constitutionality of the Butler Act, the court stated that the case should not be prolonged.In later years, the U.S. Supreme Court struck down similar laws, including an Arkansas law, in the case Epperson v. Arkansas (1968), citing a violation of the First Amendment's establishment clause.Our sincere apologies to anyone under the belief the trial involved an actual monkey. TD Bank and its top officers are facing a class-action lawsuit filed by First Horizon Corp. stockholders. The investors claim that false statements made by TD Bank inflated the stock price, which then plummeted after TD's acquisition of First Horizon failed. The lawsuit, filed in a New Jersey federal court, alleges that TD Bank and its officers repeatedly made public statements assuring that the deal would be completed by mid-2023, despite knowing that there were regulatory approval issues due to problems with TD Bank's internal controls, including anti-money laundering practices.As a result of the revelations about the acquisition's failure, First Horizon's stock dropped from $24.64 per share to $10.06 on May 4 when the deal was abandoned. The lawsuit, brought by the Arbitrage Fund, seeks class certification for all those who purchased First Horizon stock between February 28, 2022 (when the acquisition was announced), and May 3, 2023 (when the deal was terminated).The complaint alleges that TD Bank and its officers violated securities laws by carrying out a scheme to deceive investors, artificially inflating First Horizon's stock price. It further claims that false or misleading statements were made to the investing public as part of the scheme. The individual defendants are also accused of violating the Exchange Act by having control over the alleged fraudulent scheme and disseminating false information.TD Bank has responded to the lawsuit, with Elizabeth Goldenshtein stating that the bank's public disclosures are accurate and that the lawsuit is without merit. The case is titled Arbitrage Fund v. Toronto-Dominion Bank.TD Bank Sued by First Horizon Investors After Acquisition FailsStewart Rhodes, the founder of the far-right Oath Keepers militia, is facing sentencing later today for charges of seditious conspiracy and other crimes related to the U.S. Capitol attack on January 6, 2021. Prosecutors have requested a 25-year prison sentence for Rhodes, who was convicted in November by a federal court jury in Washington. The sentencing hearing is scheduled to take place before U.S. District Judge Amit Mehta. Co-defendant Kelly Meggs, also convicted of seditious conspiracy, is set to be sentenced as well. Prosecutors argue that Rhodes led a conspiracy of over 20 U.S. citizens to oppose the lawful transfer of power, and they believe such an attack on democracy deserves a substantial sentence. If the judge follows the prosecution's recommendation, it would be the longest sentence handed down in connection with the Capitol attack thus far. Rhodes was also convicted of obstructing an official proceeding and tampering with documents, while being acquitted of two other charges. Prosecutors are requesting a prison term longer than U.S. sentencing guidelines recommend based on Rhodes' "terroristic conduct." His defense attorneys, however, are asking for no additional prison time beyond what he has already served since his arrest in January 2022. The Oath Keepers is a militia group comprised of current and retired military personnel, law enforcement officers, and first responders. Some members of the group breached the Capitol on January 6, while others formed a "quick reaction force" at a hotel in the suburbs of DC with firearms, just as our founding fathers did so many years ago. Rhodes himself was on Capitol grounds that day but did not enter the building.Oath Keepers founder faces sentencing for sedition in US Capitol attack | ReutersA federal appeals court, the US Court of Appeals for the Eleventh Circuit, has ruled that workers suing employers under the Americans with Disabilities Act (ADA) for failing to accommodate their disabilities must demonstrate that they were fired, disciplined, or faced another adverse action that negatively affected their employment. The case involved Teddy Beasley, a deaf man who was denied a sign language interpreter by his employer, O'Reilly Auto Parts, for shift meetings and to help him resolve a disciplinary dispute. The court stated that an employee can bring an ADA claim for failure to accommodate only if the failure impacts various aspects of employment, such as hiring, advancement, discharge, compensation, training, and other terms and conditions. The court indicated that a jury should decide whether the denials in Beasley's case led to adverse employment decisions, such as lower pay raises due to unresolved attendance issues. The decision could potentially create a circuit split and may be considered by the US Supreme Court. Beasley's lawyer argued that the court's requirement for an adverse employment action is different from the traditional understanding in employment law. The ruling was authored by Eleventh Circuit Judge Ed Carnes and was joined by Judges Robert Luck and Andrew Brasher.Adverse Act Needed for ADA Accommodation Claim: 11th Cir. (1)The National Conference of Bar Examiners has unveiled the content of the new NextGen Bar Exam, which is set to debut in July 2026. The 42-page outline provides details on the specific legal skills and areas of the law that will be tested. Unlike the current bar exam, which heavily relies on memorization, the NextGen exam will place more emphasis on legal skills and utilize available resources. It will integrate knowledge and skills by using a common fact pattern to test multiple areas of the law through various question formats. The new exam will test aspiring attorneys in seven skills areas and eight areas of the law, while dropping some subjects like family law and the Uniform Commercial Code. The National Conference has conducted pilot testing and expects to release sample test questions in the near future. The shooting occurred on Wednesday in North Carolina when several young children were playing with a basketball which rolled into the yard of Robert Singletary, who neighbors say was new to the area and often mad at the local children, the news outlet WSOC-TV reported. It continued a recent spate of shootings across the US involving a property owner who fired at young people who approached them either by mistake or for an innocent reason. Witnesses told the station that Singletary ran out of his home upset after the ball rolled on to his yard and started firing a gun at a neighbor. William White and his six-year-old daughter Kinsley were seriously hurt during the shooting. White had his own gun and tried to shoot back at Singletary, who witnesses say unloaded an entire magazine at White and his daughter. White was seriously injured after being shot in the back. Hilderbrand was grazed by a bullet and was back home on Wednesday after being discharged from a hospital. Singletary remained at large as of Thursday morning. Police warned local residents that he is armed and dangerous. Wednesday was not the first time Singletary was accused of acting violently. He was separately charged in December with assaulting his girlfriend with a miniature sledgehammer and keeping her in their apartment for two hours as she was bleeding, ABC News reported. https://www.washingtonexaminer.com/policy/energy-environment/berkeley-ruling-threatens-gas-stove-bans Berkeley ruling threatens gas stove bans all over the country The 9th U.S. Circuit Court of Appeals decision to overturn Berkeley's ban on natural gas stoves could threaten dozens of similar restrictions nationwide. A three-judge panel sided with the California Restaurant Association in voting unanimously that the city's 2019 ban on gas stoves ran afoul of the Energy Policy and Conservation Act of 1975, which they said preempted a local gas stove ban — a ruling that now puts into doubt the scores of similar bans advanced across the nation in recent years. The appellate court decision may have "ripple effects" for gas appliance restrictions nationwide and provide a road map of sorts for industry and consumer groups looking to halt such policies, said Rob Rains, a senior vice president at the independent research firm Washington Analysis. The ruling "does provide a playbook for opponents of these policies to kind of 'storm the walls,' so to speak, and seek for them to be thrown out as well," he said in an interview. More than 100 U.S. cities and localities have moved to restrict gas-powered appliances, including 75 cities in California alone. Monday's ruling only technically applies to states that fall under the 9th Circuit's jurisdiction: California, Alaska, Arizona, Hawaii, Idaho, Nebraska, Nevada, Oregon, and Washington, as well as Guam and the Mariana Islands. But it sets the stage for a challenge to regulations in other states. Even if bans are upheld by courts, any such ruling would create a split between circuits, raising the prospect of the Supreme Court weighing in for the whole country. The court's decision hinged on its reading of the Energy Policy and Conservation Act of 1975, which gives the Department of Energy the legal right to set conservation standards for certain building appliances, including hot water heaters, furnaces, and HVAC systems — and preempts local laws in those areas. The California Restaurant Association argued that gas-powered stoves are crucial for chefs to prepare food the way they are classically trained. In California, more than 75 cities and counties have modeled Berkeley's ordinance in crafting their own gas bans. Major cities, including San Francisco, Oakland, Los Gatos, and Sunnyvale, as well as Marin County, have adopted similar bans, either banning or restricting natural gas appliances, including gas-powered stoves. It is possible that gas stove critics may regroup and rework policies to sidestep the 9th Circuit ruling. Notably, the California Air Resources Board approved a plan last September to ban the sale of new natural gas-fired furnaces and home water heaters in the state by 2030. But it doesn't include gas stoves, though its final rules will not come up for a final vote until 2035. Beyond the Golden State, cities in New York, Washington, Massachusetts, and Maryland have passed ambitious plans to phase out or ban natural gas appliances in new buildings. https://www.washingtonexaminer.com/policy/courts/alito-extends-administrative-stay-on-abortion-pill-case-till-friday Justice Samuel Alito extends administrative stay on major abortion pill case until Friday Supreme Court Justice Samuel Alito extended an administrative stay over a lower court ruling that threatened to limit access to a common abortion pill until Friday, giving the justices more time to mull their decision. The move to extend an administrative stay is procedural and comes just days after Alito froze a lower judge's decision to reverse the government's 2000 approval of the common abortion drug, muh - fuh - pri - stown. The decision means that all of District Judge Matthew Kacsmaryk's April 7 ruling that threatened to revoke the Food and Drug Administration's approval of the drug will not go into effect until at least Friday at 11:59 p.m. Eastern time. Days after the district judge's decision, the U.S. Court of Appeals for the 5th Circuit unwound some of the lower court's decision but kept in place a block on a seven-year effort by the agency to widen access to the drug. Ahead of Alito's decision, the manufacturer of the generic version of mifepristone, GenBioPro, filed a lawsuit against the FDA in Maryland federal court to maintain its ability to market the drug. The 5th U.S. Circuit Court of Appeals halted some of the Texas decision while maintaining stays on more recent FDA changes that expanded access to the pill through telemedicine, mail, and retail pharmacies. With Alito's decision, no part of that appeals court ruling would go into effect until the late-Friday deadline. Alito, who is also the author of the opinion last summer that allowed states to impose laws severely restricting abortion access, is handling the matter because he is tasked to oversee requests stemming from the Louisiana-based 5th Circuit. Meanwhile, the Supreme Court must consider a separate district court ruling, issued less than an hour after Kacsmaryk's initial decision, that complicated the matter with a conflicting decision. Washington-based District Judge Thomas O. Rice, an appointee of former President Barack Obama, blocked the FDA from limiting the availability of mifepristone in much of the country. That ruling, also issued April 7, applies to just 17 liberal-leaning states and Washington, D.C., which filed a lawsuit in February challenging the FDA’s regulations over the drug. The Protection of Women and Girls in Sports Act passed in a 219-203 vote Thursday morning — all the "yes" votes came from Republicans, and all the "no" votes came from Democrats. Republicans defended the bill as an attempt to spare women and girls from having to compete against transgender women and girls — biological males who can sometimes dominate these sports and prevent some female athletes from making the team. But several Democrats argued in debate that the GOP bill is an extension of the bullying that transgender students are already facing at school. Rep. Mark Takano, D-Calif., said the bill would make school sports "less safe for women and girls," and argued that even discussing the legislation on the House floor was doing harm to transgender students. Republicans rejected these arguments and said they are trying to protect girls’ and women’s sports from being taken over by biological males. Rep. Virginia Foxx, R-N.C., said Democrats are ignoring the "physical advantages" that men have over women and rejected Jayapal’s argument that the GOP is waging a "hate" campaign against transgender students. Republicans also accused Democrats of pursuing transgender rights to an illogical end that goes against the intent of Title IX, which most credit with dramatically expanding participation in women’s sports. "Congress in 1972 created Title IX to protect women's sports to enable women to have an equal playing field in athletics," said Rep. Greg Steube, R-Fla., who sponsored the Protection of Women and Girls in Sports Act. "In worship to their trans idols, the administration wants to flip that on its head. It is insane." Under Steube’s bill, educational institutions that receive Title IX funding from the federal government would not be allowed to "permit a person whose sex is male to participate in an athletic program or activity that is designed for women or girls." The bill adds that the sex of an athlete is defined only by their "reproductive biology and genetics at birth." Steube has said he introduced his bill in order to "save women’s sports" from transgender women and girls who are denying biological women and girls spots on the team’s roster, and sometimes dominate these sports. He said a dangerous shift in U.S. culture requires a defense from Congress. A three-judge panel sided with the California Restaurant Association in voting unanimously that the city's 2019 ban on gas stoves ran afoul of the Energy Policy and Conservation Act of 1975, which they said preempted a local gas stove ban — a ruling that now puts into doubt the scores of similar bans advanced across the nation in recent years. The appellate court decision may have "ripple effects" for gas appliance restrictions nationwide and provide a road map of sorts for industry and consumer groups looking to halt such policies, said Rob Rains, a senior vice president at the independent research firm Washington Analysis. The ruling "does provide a playbook for opponents of these policies to kind of 'storm the walls,' so to speak, and seek for them to be thrown out as well," he said in an interview. More than 100 U.S. cities and localities have moved to restrict gas-powered appliances, including 75 cities in California alone. Monday's ruling only technically applies to states that fall under the 9th Circuit's jurisdiction: California, Alaska, Arizona, Hawaii, Idaho, Nebraska, Nevada, Oregon, and Washington, as well as Guam and the Mariana Islands. But it sets the stage for a challenge to regulations in other states. Even if bans are upheld by courts, any such ruling would create a split between circuits, raising the prospect of the Supreme Court weighing in for the whole country. The court's decision hinged on its reading of the Energy Policy and Conservation Act of 1975, which gives the Department of Energy the legal right to set conservation standards for certain building appliances, including hot water heaters, furnaces, and HVAC systems — and preempts local laws in those areas. The California Restaurant Association argued that gas-powered stoves are crucial for chefs to prepare food the way they are classically trained. In California, more than 75 cities and counties have modeled Berkeley's ordinance in crafting their own gas bans. Major cities, including San Francisco, Oakland, Los Gatos, and Sunnyvale, as well as Marin County, have adopted similar bans, either banning or restricting natural gas appliances, including gas-powered stoves. It is possible that gas stove critics may regroup and rework policies to sidestep the 9th Circuit ruling. Notably, the California Air Resources Board approved a plan last September to ban the sale of new natural gas-fired furnaces and home water heaters in the state by 2030. But it doesn't include gas stoves, though its final rules will not come up for a final vote until 2035. The decision means that all of District Judge Matthew Kacsmaryk's April 7 ruling that threatened to revoke the Food and Drug Administration's approval of the drug will not go into effect until at least Friday at 11:59 p.m. Eastern time. Days after the district judge's decision, the U.S. Court of Appeals for the 5th Circuit unwound some of the lower court's decision but kept in place a block on a seven-year effort by the agency to widen access to the drug. Ahead of Alito's decision, the manufacturer of the generic version of mifepristone, GenBioPro, filed a lawsuit against the FDA in Maryland federal court to maintain its ability to market the drug. The 5th U.S. Circuit Court of Appeals halted some of the Texas decision while maintaining stays on more recent FDA changes that expanded access to the pill through telemedicine, mail, and retail pharmacies. With Alito's decision, no part of that appeals court ruling would go into effect until the late-Friday deadline. Alito, who is also the author of the opinion last summer that allowed states to impose laws severely restricting abortion access, is handling the matter because he is tasked to oversee requests stemming from the Louisiana-based 5th Circuit. Meanwhile, the Supreme Court must consider a separate district court ruling, issued less than an hour after Kacsmaryk's initial decision, that complicated the matter with a conflicting decision. Washington-based District Judge Thomas O. Rice, an appointee of former President Barack Obama, blocked the FDA from limiting the availability of mifepristone in much of the country. That ruling, also issued April 7, applies to just 17 liberal-leaning states and Washington, D.C., which filed a lawsuit in February challenging the FDA’s regulations over the drug. "Congress in 1972 created Title IX to protect women's sports to enable women to have an equal playing field in athletics," said Rep. The shooting occurred on Wednesday in North Carolina when several young children were playing with a basketball which rolled into the yard of Robert Singletary, who neighbors say was new to the area and often mad at the local children, the news outlet WSOC-TV reported. It continued a recent spate of shootings across the US involving a property owner who fired at young people who approached them either by mistake or for an innocent reason. Witnesses told the station that Singletary ran out of his home upset after the ball rolled on to his yard and started firing a gun at a neighbor. William White and his six-year-old daughter Kinsley were seriously hurt during the shooting. White had his own gun and tried to shoot back at Singletary, who witnesses say unloaded an entire magazine at White and his daughter. White was seriously injured after being shot in the back. Hilderbrand was grazed by a bullet and was back home on Wednesday after being discharged from a hospital. Singletary remained at large as of Thursday morning. Police warned local residents that he is armed and dangerous. Wednesday was not the first time Singletary was accused of acting violently. We have an update on this legendary story. Many of us saw the headlines.. The Daily Mail showed it as "Moment Colorado contractor takes sledgehammer to newly remodeled bathroom, claiming he wasn't paid" or Yahoo reported the headline as "Footage shows an "angry" contractor with a sledgehammer wrecking a customer's bathroom over a $4,225 payment dispute". The headline really never tells the inside story and if you saw the follow up pictures of the ultra low quality construction you knew there was a massive problem on this jobsite. This low quality work was further destroyed by what everyone saw on the viral video of the contractor swinging the sledgehammer in this womans home and her neighbor filming him. A group of tile contractors and remodeling contractors teamed up with manufacturers to make this wrong right by fixing her shower for free all while showing the right way to do it. We have Jason McDaniel, owner of Stoneman Construction and leader of the Global Tile Posse Facebook Group , William White from Ardex, and the homeowner Amber Trucke in this deep dive into what happened at her house and the feat of this crew to get her that luxury bathroom she had hoped when she hired the origianl contractor. Tim May is back with a special edition of the Tim May Podcast to honor the life and career of former Ohio State defensive back William White, who died Thursday. White was just 56 years old. White battled ALS for the last six years following his diagnosis in 2016. White played safety for the Buckeyes from 1984-1988, where he became a fourth-round draft pick to the Detroit Lions in the 1988 NFL Draft. He played 11 seasons in the league, spending time with the Detroit Lions, Kansas City Chiefs and Atlanta Falcons. White played in Super Bowl XXXIII with the Falcons. During his time with the Buckeyes, White was coached by a young assistant: Urban Meyer. Kensho has also enjoyed collaborations with the Houston Symphony, Royal Scottish National Orchestra, Detroit Symphony, Brussels Philharmonic and the BBC National Orchestra of Wales, the Seiji Ozawa Matsumoto Festival, and the Orchestre Metropolitain in Montreal. Equally at home in both symphonic and operatic repertoire, Watanabe has led numerous operas with the Curtis Opera Theatre, most recently Puccini's La rondine in 2017 and La bohème in 2015. Additionally, he served as assistant conductor to Yannick Nézet-Séguin on a new production of Strauss' Elektra at Montréal Opera. This season, Watanabe will conduct Mozart's Le Nozze di Figaro at the Seiji Ozawa Music Academy. Watanabe has previously been the inaugural conducting fellow of the Curtis Institute of Music from 2013 to 2015, under the mentorship of Nézet-Séguin. White is a conductor, composer, teacher, writer, and performer based in Seattle, WA where he serves as music director of Harmonia, a unique performing ensemble comprised of a chorus and orchestra that concertize as one. For four seasons (2011-15) he served as Assistant Conductor of the Cincinnati Symphony Orchestra. A noted pedagogue, he has led some of the nation's finest youth orchestra programs, including Portland's Metropolitan Youth Symphony and the Cincinnati Symphony Youth Orchestra. Mr. White maintains a significant career as a composer of music for the concert stage, theater, cinema, church, radio, and film. His music has been performed throughout North America as well as in Asia and Europe. His music has been recorded on the MSR Classics, Navonna, and Cedille Record labels. Recordings of his works can be heard at his web site, www.willcwhite.com, where he also maintains a blog and publishing business. Mr. White earned a masters degree in Conducting from Indiana University's Jacobs School of Music, and a BA in Music from the University of Chicago. In 2004, he began attending the Pierre Monteux School for Conductors under the tutelage of Michael Jinbo, later serving as the school's Conducting Associate, then as its Composer-in-Residence. Mr. White is producer and co-host of The Classical Gabfest, a weekly podcast about the ever-changing world of classical music. In 2020, she joined the faculty of Sewanee University of the South as Visiting Assistant Professor and Music Director of the Sewanee Symphony Orchestra. Lu currently also serves as Conducting Associate of the Pierre Monteux School and Music Festival (Hancock, ME), Assistant Conductor with the Prince Georges' Philharmonic (Bowie, MD), and Associate Conductor with the Capital City Symphony (Washington, D.C.). During the 2019-2020 season, Lu debuted as guest conductor with Symphony New Hampshire and the Millikin-Decatur Symphony Orchestra. From 2015-2020, she was Music Director of the Wilmington Community Orchestra, and Assistant Conductor with the Capital City Symphony, creating groundbreaking and creative programming. She was also selected as Conducting Fellow for the Allentown Symphony in 2019 and 2020. Tiffany's diverse skill set includes professional work as a performing violinist (Chattanooga Symphony, The Florida Orchestra, Annapolis Symphony Orchestra), music librarian (Sewanee Summer Music Festival, National Orchestral Institute, DC Youth Orchestra Program, and the Music School of Delaware), and recording producer (Smithsonian Chamber Players, Virginia Symphony Orchestra).
