Ballot measures give voters a chance to participate in direct democracy while providing nonprofit organizations with a powerful platform to educate the public about issues they champion. In this episode, we discuss California's pending redistricting ballot measure and other developments in direct democracy with returning guest Emma Olson Sharkey. Attorneys for this Episode • Tim Mooney • Susan Finkel Sourlis • Emma Olson Sharkey, Elias Law Group The Importance of Ballot Measures ·       Ballot measures give voters direct power to shape laws and policies, bypassing legislatures. ·       For nonprofits, they're a powerful platform to educate the public and advance mission-driven issues. ·       Emma Olson Sharkey—partner at Elias Law Group and one of the nation's leading ballot measure experts—returns to share insights (last heard in ROTG 96). California's Prop 50: Mid-Cycle Redistricting ·       Background: California has an independent redistricting commission that drew maps in 2021 for the 2022 elections. ·       New twist: In response to Texas' recent partisan maps, Governor Newsom and allies pushed for mid-decade redistricting. ·       The ballot measure: Prop 50, passed by the legislature and signed by the Governor, will go to voters in a special election on November 4, 2025. Redistricting Through Ballot Measures ·       Ballot measures have long been used to reform redistricting across the U.S. ·       Examples:   - Successful: Colorado (2018), Michigan (2018), Missouri (2020), Ohio (2018).   - Unsuccessful: Ohio's most recent attempt. ·       Mid-cycle redistricting isn't new: Texas pioneered it in 2003 under Tom DeLay, and the playbook has returned in 2025. What Nonprofits Need to Know ·       501(c)(3) Public Charities: May engage in ballot measure advocacy—it counts as lobbying. Key distinction: 'Vote yes/no on Prop X' = permissible lobbying; 'Vote for Candidate Y' = prohibited partisan activity. ·       Because Prop 50 is rooted in partisan battles, public charities must tread carefully and seek legal advice before weighing in. ·       Generally safe activity: nonpartisan voter engagement (e.g., get-out-the-vote drives, voter registration), but seek counsel especially around Prop 50. ·       501(c)(4)s and Labor Organizations: Have far greater leeway—no cap on lobbying. But California's strict regulatory environment requires attention to registration and reporting obligations. Restricting Access to Ballot Initiatives ·       Since 2016, conservative legislatures have increasingly tried to restrict citizen-led ballot measures. ·       States in the spotlight: North Dakota, South Dakota, Wyoming, Missouri, Florida, Oklahoma, Arkansas. ·       Many proposals fail, but recent years have seen more succeed, especially in Florida and Arkansas. ·       Missouri is considering both mid-cycle redistricting and ballot measure restrictions in the same session. A Bit of Good News ·       South Dakota victory: A federal court struck down H.B. 1184's nine-month filing deadline for ballot measures as unconstitutional, reaffirming citizens' First Amendment rights. ·       Practical impact: Keeps the window open for grassroots groups to gather signatures and qualify measures. This Day in Legal History: Nuremberg Laws EnactedOn this day in legal history, September 15, 1935, Nazi Germany enacted the Nuremberg Laws, codifying one of the most infamous legal frameworks of racial discrimination and hate in modern history. Announced at the annual Nazi Party rally in Nuremberg, these laws included the Law for the Protection of German Blood and German Honor, the Reich Citizenship Law, and later, the Law for the Protection of the Hereditary Health of the German People. Together, they stripped Jews of German citizenship, prohibited marriage and sexual relations between Jews and “Aryans,” and laid the groundwork for systematic persecution. The Reich Citizenship Law divided citizens into two classes: full citizens, who were of "German or related blood," and subjects, who were denied full political rights. Jews were relegated to the latter category. The Law for the Protection of German Blood and German Honor banned intermarriage and extramarital relations between Jews and Germans, criminalizing personal relationships based on ancestry. Violators could be imprisoned or sent to concentration camps. To enforce these laws, the Nazi regime devised elaborate charts and pseudoscientific metrics to assess Jewish ancestry, culminating in a 1936 chart issued by the Reich Health Office. This visual aid defined citizens by the number of Jewish grandparents they had, assigning labels like Mischling (mixed race) to those with partial Jewish heritage. Even one Jewish grandparent could strip a person of civil rights. The Law for the Protection of the Hereditary Health of the German People added a eugenic dimension, requiring couples to undergo genetic testing before marriage and barring those deemed "genetically unfit" from reproducing. These legal measures normalized state-sponsored racism and laid a legal foundation for the Holocaust.Big Law firm Perkins Coie terminated an attorney over a social media post that appeared to criticize conservative figure Charlie Kirk following his shooting death. The firm stated the post did not align with its values and that the lawyer's conduct fell significantly below professional expectations. The firing was made effective immediately. Kirk, 31, served as executive director of Turning Point USA and was a prominent supporter of Donald Trump. He was fatally shot while speaking at an event at Utah Valley University. Perkins Coie has a history of political entanglements, notably becoming one of the first law firms to sue Trump after his executive orders targeted firms representing political adversaries. These orders reportedly restricted access to federal facilities, revoked security clearances, and jeopardized client contracts. The firm was a particular focus for Trump due to its work during Hillary Clinton's 2016 campaign, including hiring Fusion GPS to conduct research that led to the Steele dossier, which alleged ties between Trump's campaign and the Russian government.Perkins Coie Fires Attorney Over Social Media Post on Kirk ShootingU.S. District Judge Timothy Kelly extended a temporary block on the deportation of unaccompanied Guatemalan children with active immigration cases. The move halts a Trump-era effort that attempted to deport 76 minors without proper notice or legal process, including waking children in the early hours of August 31 to board planes. The judge's ruling followed a contentious September 10 hearing, where he criticized a Justice Department attorney for falsely claiming that all the children's parents had requested their return. A report from the Guatemalan Attorney General's Office later revealed that most parents couldn't be located, and many of those found did not want their children repatriated. The children in question mostly come from Guatemala's Indigenous, rural regions—Huehuetenango, San Marcos, Quiché, and Alta Verapaz—areas known for high poverty and malnutrition. Guatemalan officials emphasized that such a large-scale repatriation request was unprecedented. Some families reportedly mortgaged their homes to finance the children's migration, indicating the high stakes involved.US judge extends block on deportations of unaccompanied Guatemalan migrant children | ReutersU.S. District Judge William Alsup ruled that the Trump administration unlawfully directed the mass firing of around 25,000 federal probationary employees earlier this year. These workers, many of whom had served in their roles for less than a year, were dismissed under a directive from the U.S. Office of Personnel Management (OPM) in February. The mass terminations sparked lawsuits from unions, nonprofits, and the state of Washington, arguing the firings lacked legal justification.Judge Alsup found that the OPM's directive was unlawful and "pretextual," noting the terminations were falsely framed as performance-related. While he acknowledged that the workers had been harmed, he declined to order their reinstatement, citing recent U.S. Supreme Court rulings limiting judicial power over executive branch hiring and firing decisions. Specifically, the Supreme Court had previously paused a preliminary injunction in April that would have reinstated 17,000 employees.Despite not ordering reinstatement, Alsup mandated that 19 federal agencies, including Defense, Veterans Affairs, and Treasury, correct the employment records of affected workers by November 14. He also prohibited agencies from continuing to follow OPM's original directive. Union leaders praised the decision for confirming the firings were baseless and for requiring agencies to acknowledge the false rationale behind the terminations.Trump administration unlawfully directed mass US worker terminations, judge rules | ReutersThe University of California, Berkeley confirmed it had shared information on 160 students, faculty, and staff with the Trump administration, in response to a federal investigation into alleged antisemitism. The data was provided to the U.S. Department of Education's Office for Civil Rights as part of an ongoing probe linked to pro-Palestinian protests on campus. The university stated that it acted under legal obligation while striving to protect individual privacy and notified those affected. This move comes amid a broader effort by the Trump administration to penalize universities accused of allowing antisemitic behavior, particularly during recent demonstrations opposing Israel's actions in Gaza. Critics argue that the administration is conflating political protest and advocacy for Palestinian rights with antisemitism, raising serious concerns about free speech, academic freedom, and due process.Trump has threatened to cut federal funding to institutions involved in such protests and attempted to deport foreign student demonstrators, though those efforts have faced legal challenges. The administration has already reached high-profile settlements with Columbia and Brown universities and is in ongoing talks with Harvard. A proposed $1 billion settlement with UCLA was publicly rejected by California Governor Gavin Newsom, who called it extortion.UC Berkeley shares information on dozens of students, staff with Trump administration | Reuters This is a public episode. Free Thinking Through the Fourth Turning with Sasha Stone

The death of Charlie Kirk and the reaction to it have shaken millions of Americans, at least those who have managed to hold on to their humanity in the past ten years. Even if the prominent Democrats in the party tried to project a uniform message of decency, to condemn the violence and offer condolences to the family, it was increasingly evident that they were no longer in control of their own party. Not even President Barack Obama himself could set the tone for these people, so consumed with hatred are they. Maybe they thought selling fear for ten years and calling Trump and his supporters an existential threat was a good idea because it would motivate their voters to the polls. Instead, they've created a Frankenstein monster that is now roaming the quiet countryside and scaring the crap out of normal Americans. They want all of us in this country to join them, to agree that Charlie Kirk got what he deserved. He supports gun rights, after all. That alone meant they would shed no tears for him, his wife, or his kids. That was the least of it. On TikTok, Blue Sky, and X, they went on and on, plastering the social media apps with negative stories about Kirk to erase any legacy the Right might try to build in his name. And maybe they thought the rest of America would agree that they should close off their hearts and separate themselves from their empathy to serve the greater political cause that has taken the place of just about everything else in their lives. But they miscalculated how normal people view violent death, especially political assassinations. On TikTok, many users were expressing their anger at the Left, and some of them even said this was it; they were no longer a part of the Democratic Party. Here is a video:And Jennifer Sey just registered as a Republican from “unaffiliated.”And Colin Wright redrew his famous chart:This is the last thing the Democrats needed. All they have left is Zohran Mamdani and Gavin Newsom's meme factory of would-be nepo babies of the Lincoln Project. They have no vision, no hope, no policies, no fixes, no solutions - nothing. All they have is this. Their hatred of anyone who doesn't conform and comply. Their approval rating has never been lower. Registrations are down by the millions. They're losing the support of Gen-Z. They have no plan to bring voters in except to draw more militant fanatics, and now, they've once again exposed how lacking in any common decency they have become. Congratulations, Democrats, oops, you did it again. From the New York Post:They're an army of Lord of Flies whose parents coddled them and raised them to believe all of their finger paintings were masterpieces, that their traumas defined them, and were “gentle-parented,” and when that didn't work, were drugged into perfection. They don't seem to understand that no one deserves to die just for having a different opinion. When one person's death means nothing to you and all you do is make a video where you calmly recite the reasons you don't care and why no one else should care? What is left of you? They sound like modern versions of the Stepford Wives who say exactly what they're supposed to say, repeating it almost word for word like robots:There is no one to pull them back from the brink. They collect so many likes that it messes with their heads. Their followers demand more, give us more. They're punished if they dissent, if they disagree, if they do any critical thinking whatsoever. Anyone who uses TikTok and any social media app knows that it's dominated by the Left. We built it, after all, oh so long ago. Even the Democrats themselves are under the control of the fanatics in their party, which is why they all felt emboldened to boo Charlie Kirk's name when they called for a moment of silence. Even if they didn't agree with it, why would they want to show the public just how petty they are?Not that we needed this tragic event to expose that ugly truth. It's been obvious for some time that the Left has been hijacked by the modern equivalent of the Manson Family. Joe Biden was the George Spahn-like figure who presented the mask of normalcy for what was most definitely not normal. All they had to do was the bare minimum, either stay silent or offer condolences and some generic comment on free speech and how political violence is never okay. But they couldn't even do that. Why? Because there is nothing left of them. All they have is this pathological need to control everyone and everything, whether it's destroying the careers of convicted thought criminals or celebrating their assassinations. All they know is they wanted them gone. In all of their lies about Charlie Kirk, their endless posts with hundreds of thousands of likes that prop up their own manufactured goodness as if to say, See, we still have the moral high ground, they came off somehow looking worse than they ever have. Charlie Kirk was a nice guy. They're celebrating his death because they didn't know that. They didn't know that because no one would tell them. Not their own social media feeds, not the legacy media. And when Ezra Klein tried to tell them with a New York Times op-ed, they began attacking him too, because of course they did. The dehumanization is a feature, not a bug. Here is Benny Johnson and Chris Cuomo:The Left so badly wants this to be a “both sides” issue, but it isn't. The Right mourned the death of Congresswoman Melissa Hortman. They did not blanket X or Blue Sky or any other social media site, smearing her. They would not have posted something like this on the Right:But until the people with the real power on the Left condemn them, nothing will change. They can make any false reality they want. They can tell themselves any lies they want. But what we've seen now in how they've responded to something that would shake any normal person out of their partisan stupor could cost them not just for the midterms but for 2028 and beyond. They think they have the narrative well in hand because the media is so supportive of everything they do. But every once in a while, they go too far, and they end up red-pilling Americans who shrink back in horror at who and what they've become and want no part of it.I am not saying “The Left” killed Charlie Kirk. Maybe someone on the Left did. Maybe they didn't. It doesn't really matter because they've shown their true colors in their perilous moment in our history. It's like that scene in The Dead Zone when Martin Sheen picks up the baby to protect himself. There is no unseeing that. They might think the silencing of Charlie Kirk will cripple the MAGA movement and everything he's done to build Turning Point USA and mobilize the young. But because of his death, MAGA will be more energized, not less, more motivated, not less, more determined than ever to save America from this madness. And they must because they are our only hope.Charlie Kirk has left a legacy, whether they realize it or not. It isn't just how psychotic they've become, and how so many of us have fled. But it's all of those young people he inspired who adored him. They will remember the assassination of Charlie Kirk. It will shape their youth the way the killing of Martin Luther King, Jr., RFK, and JFK shaped generations before. They will know that he was killed to silence him, and they will remember how the Left reacted to his death. And they will grow up knowing that it was wrong. Most of all, they will know that he built a movement that would ultimately defeat the most powerful political machine in American history. And if he can do it, so can they./// This is a public episode. If you'd like to discuss this with other subscribers or get access to bonus episodes, visit www.sashastone.com/subscribe

Programming Note: This conversation was recorded on Monday, 9/8, before the horrific and tragic killing of political activist Charlie Kirk. Gun violence is among the leading causes of death for children and teens in the United States. News of yet another mass shooting breaks almost weekly. And still, gun reform remains fiercely partisan. It is indeed a cultural flashpoint in a country that feels as divided and polarized as ever. This week, Preet is joined by John Feinblatt, the President of Everytown for Gun Safety, and Adam Winkler, a constitutional scholar and expert on the Second Amendment to discuss whether gun culture is changing for the better, whether legal reforms are making any progress, and whether the private sector can step up in the face of political deadlock.  Then, Preet answers your questions about Ghislaine Maxwell's transfer to a minimum-security prison, and asks for your thoughts on Newsom's posting. In the bonus for Insiders, Preet, John, and Adam discuss U.S. Attorney Jeanine Pirro's decision not to federally prosecute individuals for carrying rifles or shotguns in D.C. Today's Headlines: The Epstein files just keep coming—House Oversight dropped a batch of subpoenaed documents from his estate, including Trump's long-denied birthday note (with the very recognizable Trump signature) plus another note from a Mar-a-Lago member joking about Epstein “selling” Trump a woman for $22,500. Meanwhile, the NYT dropped a bomb on JP Morgan, showing how the bank ignored red flags to keep Epstein as a client for years because he was too lucrative—and too connected to people like Bill Gates and Sergey Brin. The DOJ, for its part, asked a judge to keep the names of two Epstein associates who got six-figure payments in 2018 sealed. Elsewhere, the Supreme Court greenlit roving immigration patrols in LA, prompting Gov. Newsom to accuse the conservative majority of being the “Grand Marshal for a parade of racial terror.” Trump, asked about his Chicago “war” meme, claimed he just meant “cleaning up cities” as DHS launched “Operation Midway Blitz” targeting undocumented immigrants with criminal records. ICE raided a Hyundai plant in Georgia, detaining 475 workers—most of them South Korean nationals—sparking diplomatic talks with Seoul. On top of that, Trump wants to make the citizenship test harder, possibly with an essay requirement. In digital warfare news, the FBI warned China's Salt Typhoon campaign has now hit 600 companies in 80 countries—and possibly every American. Hackers even impersonated Rep. John Moolenaar during trade talks. Finally, Axios reported Biden staffers were uneasy about his heavy reliance on autopen for pardons and Trump cheered West Point for scrapping an award for the “woke” Tom Hanks. Anna Wintour Embraces a New Era at Vogue

Speculation, analysis, and commentary circulated all summer, after the announcement, in June, that Anna Wintour would step back from her role as the editor-in-chief of American Vogue. This changing of the guard is uniquely fraught, because Wintour's name has become nearly inextricable from the magazine, to a degree almost unknown today. And, as New York Fashion Week was set to begin, Wintour spoke with David Remnick about choosing her successor, the Vogue.com editor Chloe Malle. “It felt like this was the right time,” she says. With an unusual number of new creative directors in positions at major fashion houses, “It seemed like a good moment to bring in someone with a different perspective and a different generation who could look at things in a new way.” Wintour was appointed editor-in-chief in 1988, and generations of designers have come up under her famously acute and decisive judgments. She comes from a publishing family; her brother is a well-known journalist, and her father was the editor of the London Evening Standard. She credits him with steering her into a career in fashion, even suggesting that the teen-age Anna write down “editor of Vogue” as her career aspiration on a school form. “Working my first jobs in London, there [was] no money, there's no staff, there's no teams, so that you have to learn how to do everything,” Wintour says. “So, when I came to the States and there was a shoe editor and an underwear editor and a fabric editor, it was all so siloed. I felt very confident because I sort of knew how to do everything.” Wintour is also known for bringing politics to Vogue; she's a noted Democratic supporter and donor. “I've been impressed by Governor Newsom, I think he's certainly making a stand, and obviously I'm sure there'll be many other candidates that will emerge, hopefully soon.” But, in this political environment, Remnick asks, “How do you make a case that fashion is important?” Fashion, she replies, “is always important. It's a question of self-expression and a statement about yourself. . . . And, forgive me, David, but how boring would it be if everybody was just wearing a dark suit and a white shirt all the time?”New episodes of The New Yorker Radio Hour drop every Tuesday and Friday.
