This Day in Legal History: United Nations Charter Comes into ForceOn October 24, 1945, United Nations Day marked the formal establishment of the United Nations (UN) as the UN Charter officially came into force. The Charter had been signed a few months earlier on June 26, 1945, in San Francisco by 50 countries, laying the foundation for an international organization dedicated to peace, security, and cooperation among nations. The creation of the UN was a direct response to the devastation of World War II, with the goal of preventing future conflicts and fostering global collaboration. The UN Charter outlines the organization's purposes, principles, and structure. Its preamble emphasizes the need to save succeeding generations from war, reaffirm fundamental human rights, and promote social progress and better standards of life. The Charter established six principal organs, including the General Assembly, Security Council, International Court of Justice, and Secretariat, each with specific roles in maintaining international peace and security. Chapter VII of the Charter granted the Security Council significant powers to address threats to peace, including authorizing the use of force.United Nations Day has since been celebrated annually to honor the organization's ongoing work in diplomacy, humanitarian efforts, and human rights advocacy. The day also highlights the importance of international cooperation in addressing global challenges, from conflict resolution to climate change.A lawsuit filed in Wisconsin two weeks before the 2024 presidential election highlights cybersecurity issues with the state's MyVote portal, which allows users to register and request absentee ballots online. The suit argues that the website lacks adequate security, leaving it vulnerable to unauthorized access and data breaches. The plaintiffs want the site taken down until it undergoes a redesign and testing. They cited a 2022 case where someone fraudulently requested absentee ballots using minimal personal information. Experts, however, find the timing problematic, as implementing a comprehensive security audit and fixes could take months, making it impossible to resolve before Election Day. Despite these concerns, some believe the state's current systems are sufficient to catch and prevent fraudulent votes. The suit underscores broader identification and authentication challenges across industries, which are struggling with securing user identities. The case raises critical questions about how to balance election security with practical constraints.Wisconsin MyVote Website Suit Puts Focus on Authentication WoesSeveral trade associations have challenged the U.S. Federal Trade Commission's (FTC) final "click-to-cancel" rule, which aims to make it easier for consumers to cancel subscriptions. The rule requires businesses to provide a simple and straightforward way to withdraw from subscription services and to disclose the terms of signing up clearly. The Electronic Security Association, Interactive Advertising Bureau, NCTA, and others filed petitions in the Fifth and Eleventh Circuit Courts of Appeals, seeking to vacate the rule. They argue that the rule imposes excessive regulatory burdens across industries, potentially affecting over a billion paid subscriptions in the U.S.The "click-to-cancel" rule was introduced in response to consumer complaints about difficult-to-cancel recurring subscriptions. In 2024, the FTC averaged 70 consumer complaints per day regarding such practices. The rule, which the FTC finalized after receiving over 16,000 public comments, is intended to protect consumers from deceptive subscription practices by making the cancellation process as easy as signing up.Trade groups challenging the rule claim it is arbitrary and that it will create costly regulatory obligations for businesses. They argue the rule overreaches by attempting to regulate all consumer contracts involving subscriptions, regardless of the businesses' existing disclosure practices. The "click-to-cancel" initiative hopes to curb "subscription traps," where businesses make it difficult for consumers to end services, thus preventing recurring charges without their consent. By simplifying the process, the FTC aims to foster transparency and fairness in subscription services across industries.Trade Associations Challenge FTC's Final Click-to-Cancel RuleFlorida has filed a lawsuit against the U.S. Department of Justice (DOJ), claiming the federal government is unlawfully obstructing its investigation into an assassination attempt on Donald Trump. Florida Attorney General Ashley Moody's lawsuit seeks to stop the DOJ from blocking the state's probe into the incident, which occurred at Trump's Florida golf course. The DOJ argues that federal law (18 U.S.C. § 351(f)) gives it sole jurisdiction over assassination attempts against presidential candidates, which led the FBI to instruct Florida law enforcement to suspend its investigation.Florida, however, claims this interpretation of the law violates the Tenth Amendment, which protects state sovereignty. The state argues that § 351(f) does not bar its investigation and that preventing Florida from investigating would be unconstitutional. The lawsuit asks for a ruling allowing Florida to continue its investigation or declare the statute unconstitutional as applied in this case. The alleged gunman, Ryan Routh, has already been federally indicted for attempted assassination. The DOJ has not commented on the lawsuit.Florida Says DOJ Is Blocking Their Trump Assassination Probe (1)In a piece I wrote for Forbes, I explore the detrimental impact of Trump's proposed 20% tariff on all imported goods, drawing parallels to the economic struggles caused by tariffs in the late 19th century. Tariffs, I argue, are regressive taxes that disproportionately affect lower-income households by raising prices without adjusting for income. For example, a 20% tariff on electronics would hurt low-income families far more than wealthier ones. While tariffs aim to protect domestic industries, they often fail if no domestic alternative exists, merely increasing costs for consumers. A study shows Trump's tariffs could raise the price of laptops by 46% and smartphones by 26%. The burden of tariffs falls on the countries that impose them, not on exporting nations, which could lead to significant economic strain—an estimated $3.9 trillion cost to U.S. consumers. Historically, high tariffs contributed to economic downturns like the Panic of 1893, and similar policies today risk sparking trade wars and further damaging the economy. Tariffs do little to stimulate domestic industries or protect consumers and should not replace progressive tax policies.Trump's Tariffs Would Cost Trillions—And We Learned This A Century Ago This is a public episode. Hey Strangers, #hurricanemilton #ai #pricegouging Florida Attorney General Ashley Moody has received more than 200 complaints about price gouging as many thousands of residents prepared to evacuate from Hurricane Milton. As of Monday, most of the complaints are about fuel and water, said Kylie Mason, Moody's spokesperson. The top three counties for complaints are Highlands, Hillsborough and Pinellas, she added. There were also scattered instances involving overnight accommodations, including one Airbnb listing of a "room in Tallahassee" for nearly $6,000 a night. "Our team already reached out to our (Airbnb) corporate contact and tracked down the owner," Mason said. "We are sharing a copy of the price gouging statute ... and making them aware of their legal responsibility." (An Airbnb spokesperson on Wednesday countered that "the price for that listing has been the same for over two years. It was not changed in response to recent natural disasters.") ======================================= My other podcast https://www.youtube.com/channel/UCKpvBEElSl1dD72Y5gtepkw ************************************************** Something Strange https://www.youtube.com/watch?v=GRjVc2TZqN4&t=4s ************************************************** article links: https://www.latimes.com/business/story/2024-08-16/digital-price-tags-in-grocery-stores-prompt-concerns-over-privacy-price-gouging https://www.tallahassee.com/story/news/hurricane/2024/10/08/over-200-price-gouging-complaints-in-florida-ahead-of-hurricane-milton/75577858007/ https://www.usatoday.com/story/money/2024/10/09/georgia-businesses-accused-of-price-gouging-hurricane/75596125007/ https://www.congress.gov/bill/118th-congress/senate-bill/3803/text ====================================== Today is for push-ups and Programming and I am all done doing push-ups Discord https://discord.gg/MYvNgYYFxq TikTok https://www.tiktok.com/@strangestcoder Youtube https://www.youtube.com/@codingwithstrangers Twitch https://www.twitch.tv/CodingWithStrangers Twitter https://twitter.com/strangestcoder merch Support CodingWithStrangers IRL by purchasing some merch. This Day in Legal History: Loving v. VirginiaOn June 12, 1967, the United States Supreme Court issued a landmark decision in the case of Loving v. Virginia, striking down state laws prohibiting interracial marriage. Richard Loving, a white man, and Mildred Jeter, a Black woman, were married in Washington, D.C., in 1958 but were arrested upon their return to Virginia for violating the state's anti-miscegenation laws. The Lovings were convicted and sentenced to a year in prison, with the sentence suspended on the condition that they leave Virginia and not return together for 25 years. Challenging their conviction, the Lovings argued that Virginia's laws violated the Equal Protection and Due Process Clauses of the Fourteenth Amendment. The Supreme Court, in a unanimous decision authored by Chief Justice Earl Warren, agreed with the Lovings. The Court held that Virginia's anti-miscegenation statutes were rooted in racial discrimination and served no legitimate purpose other than to maintain racial segregation. This decision effectively invalidated similar laws in 15 other states, affirming that marriage is a basic civil right that cannot be restricted by racial classifications. The Loving v. Virginia decision was a significant step forward in the civil rights movement, reinforcing the principle that all individuals are entitled to equal protection under the law.Paul Weiss has been aggressively recruiting top-tier mergers and acquisitions and private equity partners, hiring over 20 from prominent firms such as Kirkland & Ellis and Latham & Watkins. This hiring spree, focused mainly in London and New York, reflects a broader trend of escalating compensation for elite lawyers, with some earning over $20 million annually. To fund these high-profile hires, Paul Weiss revamped its partner pay system and adopted a "black box" approach, where pay details are kept confidential among partners. The firm also introduced a new tier of non-equity partners to retain senior attorneys without sharing profits. This strategy mirrors moves by other top firms like Simpson Thacher & Bartlett and Davis Polk & Wardwell, which have adjusted their compensation structures to remain competitive. Paul Weiss's London office has notably expanded, recruiting high-profile partners from Kirkland to build a comprehensive practice there. The firm's longstanding relationship with Apollo Global Management continues to bolster its M&A and private equity profile. Despite lagging behind top deal advisors like Kirkland & Ellis and Wachtell Lipton Rosen & Katz, Paul Weiss's aggressive hiring positions it well for future market share gains. The firm's recruitment efforts underscore the importance of attracting top legal talent to handle complex and lucrative deals, reflecting a fiercely competitive legal market.Paul Weiss Hiring Binge Shows Big Law's Dealmaker Recruiting WarPower grid technologies (GETs) have gained traction recently as a way to integrate more renewable energy and meet increasing power demands without building new transmission lines. Historically, US electric utilities preferred constructing new lines because they offer guaranteed returns and are seen as less risky, despite the high consumer costs and long timelines associated with them. However, grid congestion in 2022 raised consumer bills by nearly $21 billion, pushing utilities to consider GETs. These technologies optimize existing infrastructure, offering significant cost savings and increased grid capacity. The Federal Energy Regulatory Commission's new rule requires regional grid planners to consider using GETs. Additionally, a White House meeting led to a federal-state initiative involving 21 states to upgrade 100,000 miles of transmission lines in five years. Studies indicate that implementing GETs could save billions annually and facilitate the connection of more clean energy projects.Despite their benefits, GETs face challenges due to the traditional utility business model that favors large capital investments. Some states like Minnesota and Virginia are now mandating GETs in resource planning and offering incentives. Vermont Electric Power Co. and AES Corp. are examples of utilities testing GETs, such as dynamic line ratings and valve technology, to improve efficiency and reliability. As utilities and technology providers collaborate more, the industry aims to reduce the need for new transmission lines and overcome the associated regulatory and logistical hurdles.Grid Upgrades Gain Favor to Meet Power Demands of AI, Clean TechOn June 11, 2024, Elon Musk moved to dismiss his lawsuit against OpenAI and its CEO Sam Altman. The lawsuit, filed in February, accused OpenAI of deviating from its original mission to develop artificial intelligence for the benefit of humanity. Musk's attorneys did not provide a reason for the dismissal, which was filed in San Francisco Superior Court. The dismissal was without prejudice, allowing Musk the option to refile later.Musk co-founded OpenAI but has since expressed dissatisfaction with its direction, particularly its focus on profitability following substantial investments from Microsoft. The lawsuit sought to compel OpenAI to release its research and technology to the public and prevent its use for financial gain.OpenAI countered that Musk's claims were baseless and motivated by his desire to compete with OpenAI through his own AI venture, xAI, which recently raised $6 billion in funding. The court was scheduled to hear OpenAI's motion to dismiss the case the day after Musk's withdrawal. Neither OpenAI nor Musk's legal representatives commented on the latest development.Elon Musk withdraws lawsuit against OpenAI | ReutersAdobe faced significant backlash over updates to its terms of use, which users feared allowed the company to seize intellectual property and use data to train AI models. The controversy highlighted the need for clear communication of legal terms, especially in the context of evolving technologies like generative AI. In response, Adobe pledged to revise its terms, explicitly stating it won't train AI models on cloud content, with new terms set to be issued on June 18.The uproar began after Adobe's February update, which included provisions for automated and manual review of user content to screen for illegal material. Users, notified in May, expressed concerns on social media, fearing their confidential content could be exploited. Adobe's general counsel, Dana Rao, emphasized that the language had long been part of Adobe's agreements and was essential for practical tasks like uploading content to the cloud.Industry experts noted that such terms are common among cloud service providers but acknowledged the heightened sensitivity among creatives towards potential misuse of their work for AI. Adobe's commitment to clearer, user-friendly legal terms aims to rebuild trust, recognizing the unique and personal relationship users have with its products. The settlement, announced on June 11, 2024, addresses accusations that J&J misled consumers about the safety of its talc products. While J&J did not admit any wrongdoing, it continues to assert that its products are safe and asbestos-free.This settlement, led by Florida, North Carolina, and Texas, marks a significant step in consumer product safety, according to Florida Attorney General Ashley Moody. Despite the settlement, J&J still faces tens of thousands of lawsuits related to its talc products, primarily from women with ovarian cancer and some with mesothelioma. As of March 31, approximately 61,490 individuals were suing the company.J&J ceased the global sale of talc-based baby powder last year, opting for corn starch instead. The company has made several attempts to resolve the litigation, including two failed efforts to use bankruptcy to manage its talc liabilities. On May 1, J&J proposed a $6.48 billion settlement to resolve most of the litigation through a third bankruptcy filing and has allocated an $11 billion reserve for talc liabilities. How do we ensure that America doesn't become like Europe? The only solution is for red states to stand up against subversive and illegal immigration to protect the common-cause values of their residents. The horrific story of an Israeli peace activist butchered by Arabs is a stark warning of what we are confronted with in the West – paying for the rope to hang ourselves. To illustrate how this is done, I'm joined by Florida Attorney General Ashley Moody, who updates us on her effort to pressure the feds to follow the law and deport Hamas-supporting foreign students. She discusses all the ways the Biden administration is violating immigration law and how she is fighting in the courts to invalidate Biden's phantom visa programs. Moody makes the legal and moral case for states to reclaim the authority to deport illegal and subversive foreign nationals who pose a danger to the state. Learn more about your ad choices. What You Need to Know is we got a big immigration win in federal court. Florida Attorney General Ashley Moody sued the Biden Administration and U.S. District Judge T. Kent Wetherell agreed: the White House and executive branch isn't following U.S. immigration law at the border and he gave them seven days to change course! It may sound wild, but it's true, and we have to spread the word because the media won't cover it. Dr. Ted Malloch, business man, author, and prolific writer, talks about his latest column More Risky Business. Last week, the World Economic Forum released its annual “World Risk Report,” and like the classic film Risky Business, the report is equal parts comedic and tragic. Find all of his writings at OANN and American Greatness. John Schlafly, co-author of the Schlafly Report column, talks about this week's report: Trump KOs GOP Globalists. John tells us that the contrast between Trump and the worn-out ideas of his media-pandering rivals could not be greater! Read all of John and Andy Schlafly's columns at PhyllisSchlafly.com. Though the Biden Administration had planned to lift Title 42, the Trump-era policy that limited the flow of migrants into the US as a COVID-19 precaution, the Supreme Court ruled on Tuesday that the order must remain in place until arguments are heard in February. This comes after multiple Republican lawmakers voiced concerns that the southern border would become severely overwhelmed in the absence of Title 42, as the US recorded a record-high number of migrant crossings in fiscal year 2022 despite the policy being in place. Now, all eyes are on Congress to pass legislation to prepare the border for the eventual removal of Title 42, which could happen in just two months. On the Rundown, Former Chief of US Border Patrol and retired acting ICE director Ronald Vitiello joins to discuss his thoughts on why the US has seen a massive border surge despite current policies in place, how Congress should act to prepare for the eventual lift of Title 42, and why the Biden Administration's current plans for the border are 'the worst prescription they could have come up with.' The drug fentanyl has become one of the leading causes of death for American adults and now this overdose crisis is impacting adolescents as well. In 2021, one study found that 77 percent of all teen overdose deaths were due to fentanyl, with many of these teens seeking pills that have unknowingly been laced with fentanyl. Today, we look back at Alex Hogan's conversation with Florida Attorney General Ashley Moody when she joined the Rundown to explain how an insecure southern border is driving the rise in fentanyl overdoses. She also discussed the importance of parents educating themselves and having conversations with their children about the dangers of fentanyl. Plus, commentary from Karoline Leavitt, Former Republican nominee for Congress in New Hampshire's 1st Congressional District. Learn more about your ad choices. Visit megaphone.fm/adchoices

This is, I think, a huge story. I have had multiple friends and listeners contact me in the last week regarding this news coverup, and I have even talked to some of the whistleblowers involved. Apparently the force vaccine requirements in the military, have caused serious spikes in “neurological, cardiovascular, oncological, and reproductive health categories.” The military has very good data on the health of their soldiers and it is all tracked in a database called Defense Medical Epidemiology Database (DMED). Well the military released its 2021 data, and their initial released showed an over 900% increase in Disease and Injury reports. The military is now back tracking on the data release, and Pentagon spokesman Maj. Charlie Dietz had this to say: “Comparing the DMED database to the source data contained in DMSS, Armed Forces Health Surveillance Division discovered that the total number of medical diagnoses from 2016-2020 that were accessible in DMED represented only a small fraction of actual medical diagnoses for those years. In contrast, the 2021 total number of medical diagnoses were up to date in DMED. Comparison of 2021 to 2016-2020 resulted in the appearance of significant increased occurrence of all medical diagnoses in 2021 because of the under-reported data for 2016-2020. Armed Forces Health Surveillance Division has taken DMED offline to identify and correct the root-cause of the data corruption,”. In other words, they are saying 2021 data is correct, but the years 2016 through 2020’s Disease and Injury report were under reported by 900%. Daniel Horwitz over at the Blaze put it this way: https://www.theblaze.com/op-ed/horowitz-the-pentagons-response-to-the-explosive-dod-medical-data-is-an-even-bigger-story-than-the-data “The silence both from the media and congressional members of the House and Senate Armed Services Committees is astounding. One of two things is true: Either there was mass vaccine injury in the military, or our military has been very unhealthy and the Pentagon completely lost control over epidemiological surveillance of these health issues for years. Either way, this is the story of the year.” I hope to have more on this in the coming weeks, including interviews with some of the whistleblowers. Tune into our midweek fix tonight at 7pm, as we will be interviewing Colonel Kevin Hall on his battle with the force vaccine requirements in the military. The story is insane.

On today's edition of Felony Friday, Richard Midkiff joins John to share his unique story. Richard was sentenced to 38 years in prison for felony murder, related to a 1996 robbery and murder. He was driving the getaway car. In 2019, Richard was released from prison after a series of U.S. Supreme Court rulings in the 2010s affording prisoners who were sentenced to long terms as juveniles the right to have their cases reviewed. The current Florida Attorney General Ashley Moody tried to revoke the plea deal that got him out and send him back to prison. Thankful Richard won the appeal and has remained a free man. The man who actually killed Waters, J. Patrick Swett, was just 17 at the time of the murder and was released from his sentence early after a review under those new provisions. Because the original plea deal included a request from the victim's family that the killer spend more time in jail than the accomplice, leading prosecutors to add six months more to Swett's sentence than Midkiff's. Midkiff's attorney's argued that meant he too should be released, and they won. But later, the office of Florida Attorney General Ashley Moody sought an appeal, arguing he was not subject to early release under sentencing review because he wasn't a juvenile at the time. Midkiff's legal team thought he was safe, but later learned the appeal was successful because the victims' family request was in the killer's plea deal, not Midkiff's. He could be sent back to prison any day. .
