On March 18th, 2025, the Karen Read case was back in court, and things are heating up! Judge Cannone delivers a scathing rebuke to the defense, accusing them of "deliberate misrepresentations" and "flagrant violation" of Rule 14 regarding payments to the ARCCA Expert Witnesses. The judge has a conversation directly with Karen Read to see if she'd like to remove Alan Jackson as her representative, but she declined. The judge doesn't remove Alan Jackson from the defense team, decided not to exclude ARCCA Witness Testimony from the re-trial, and didn't financially sanction the defense team. Instead, she gave them a stern warning and remind them of their obligation of being candor to the court. The Defense and The Commonwealth's Appellate Attorney ask for the trial date of April 1st, 2025, be pushed back again. This time they didn't request a date due to Karen Read appeal to the First Circuit to try to get counts 1 and 3 dismissed. The judge has taken it under advisement and will reconvene Thursday, March 20th, 2025 to discuss further. These experts testified, suggesting that the injuries O'Keefe sustained weren't consistent with being struck by a vehicle—casting doubt on the prosecution's narrative. However, a twist emerged. While the defense previously implied these experts were independent and unpaid, it later surfaced that they had, in fact, shelled out nearly $24,000 to ARCCA post-Read's mistrial last year. This revelation didn't sit well with Judge Cannone. She expressed that the "candor required of all lawyers" was conspicuously absent here. She didn't stop there. Cannone highlighted a "flagrant violation" of the defense's obligations concerning pretrial discovery sharing. While she considered sanctions, she ultimately allowed Read's out-of-state attorneys to continue practicing in Massachusetts, honoring Read's "strong desire" to keep her legal team intact. The judge's message was crystal clear: honesty isn't just the best policy; it's the only policy in her courtroom. She emphasized, "A lawyer is only as good as his or her word, and I need to be able to take counsel at their word. So I'm not going to tolerate false statements, any stretching of the truth, no misleading distortions. There's no place for that in the courtroom." As the retrial looms, both sides are gearing up, filing a slew of pretrial motions. The prosecution aims to prevent the defense from pointing fingers elsewhere, while the defense seeks to manage courtroom dynamics, including witness sequestration to avoid potential jury intimidation. In a move to maintain courtroom decorum, Judge Cannone recently imposed a gag order on all attorneys involved, aiming to prevent any statements that could prejudice the jury pool ahead of the retrial. HH Bancroft, Historian of the Pacific States, credited with more than 60,000 pages and 39 volumes of history of the west and natives. He has a library at UC Berkley named after him til this day. Yet in 1894 The Society of California Pioneers, which Bancroft was an honorary member, wrote a collection of Bancroft misrepresentations and attacking his credibility.
