Earlier Cases: Sales Practices Initial lawsuits focused on: Unauthorized credit checks (FCRA claims) High-pressure or deceptive sales tactics Misrepresentations about tax savings and energy production 2. Current Wave: Financing Structures More recent cases center on dealer fees (also called platform or financing fees), with plaintiffs alleging that: ·        These fees are effectively hidden finance charges ·        They should be disclosed under the Truth in Lending Act (TILA) Courts in Minnesota have allowed these claims to proceed past motions to dismiss, rejecting arguments—at least at the early stage—that such fees are merely "seller's points" exempt from disclosure. While these rulings are preliminary, they have: ·        Opened the door to costly discovery ·        Encouraged additional class actions and enforcement cases ·        Created significant uncertainty regarding how courts will ultimately resolve the issue The Expanding Role of the FTC Holder Rule Another important litigation risk involves the FTC Holder Rule, which allows consumers to assert claims against loan holders that they could assert against installers. This creates potential exposure for: ·        Lenders ·        Secondary market participants ·        Securitization investors Although liability is generally capped at the amount of the loan, the rule can still create substantial risk, especially where plaintiffs seek rescission of contracts. On March 18th, 2025, the Karen Read case was back in court, and things are heating up! Judge Cannone delivers a scathing rebuke to the defense, accusing them of "deliberate misrepresentations" and "flagrant violation" of Rule 14 regarding payments to the ARCCA Expert Witnesses. The judge has a conversation directly with Karen Read to see if she'd like to remove Alan Jackson as her representative, but she declined. The judge doesn't remove Alan Jackson from the defense team, decided not to exclude ARCCA Witness Testimony from the re-trial, and didn't financially sanction the defense team. Instead, she gave them a stern warning and remind them of their obligation of being candor to the court. The Defense and The Commonwealth's Appellate Attorney ask for the trial date of April 1st, 2025, be pushed back again. This time they didn't request a date due to Karen Read appeal to the First Circuit to try to get counts 1 and 3 dismissed. The judge has taken it under advisement and will reconvene Thursday, March 20th, 2025 to discuss further. The defense had enlisted experts from ARCCA Inc., an engineering consulting firm initially brought in by federal authorities to scrutinize the case. These experts testified, suggesting that the injuries O'Keefe sustained weren't consistent with being struck by a vehicle—casting doubt on the prosecution's narrative.  However, a twist emerged. While the defense previously implied these experts were independent and unpaid, it later surfaced that they had, in fact, shelled out nearly $24,000 to ARCCA post-Read's mistrial last year. This revelation didn't sit well with Judge Cannone. She expressed that the "candor required of all lawyers" was conspicuously absent here.  She didn't stop there. Cannone highlighted a "flagrant violation" of the defense's obligations concerning pretrial discovery sharing.  While she considered sanctions, she ultimately allowed Read's out-of-state attorneys to continue practicing in Massachusetts, honoring Read's "strong desire" to keep her legal team intact.  The judge's message was crystal clear: honesty isn't just the best policy; it's the only policy in her courtroom. She emphasized, "A lawyer is only as good as his or her word, and I need to be able to take counsel at their word. So I'm not going to tolerate false statements, any stretching of the truth, no misleading distortions. There's no place for that in the courtroom."  As the retrial looms, both sides are gearing up, filing a slew of pretrial motions. Regulatory violations -- this includes securities law violations such as insider trading, or selling securities without a license. This also includes failing to register securities. IPO fraud -- this includes misrepresentations in the offering of an IPO or SPAC by misstating accounting information or omitting key information. Misappropriation of funds -- this includes Ponzi schemes and skimming money for personal use. Trading violations -- this includes manipulating the market through pump and dump schemes and front running. This also includes insider trading. Yet in 1894 The Society of California Pioneers, which Bancroft was an honorary member, wrote a collection of Bancroft misrepresentations and attacking his credibility.
