And now they are found. And some stories are too good to stay buried. Before he became one of cricket’s most respected broadcasters, Haysy was a cricketer tipped to be the next big thing in Australian cricket, a man who received handwritten notes from Sir Donald Bradman, took part in the infamous rebel tour of South Africa, and once called a match with $20 million riding on it. Good afternoon, I'm _____ with today's episode of EZ News. Tai-Ex opening The Tai-Ex opened up 85-points this morning from yesterday's close, at 22,204 on turnover of 4.8-billion N-T. The market closed higher on Monday led by artificial intelligence related stocks ahead off the start of Nvidia's annual G-P-U technology conference - at which its hoped the company will be showcasing positive leads. Chinese 'military unification' influencer 'in theory' must go by 24th Interior Minister Liu Shi-fang says a Chinese national who advocated for China's annexation of Taiwan through military force should, "in theory," leave the country within 10 days of receiving her deportation order. According to Liu, the woman received that deportation order on Saturday. Speaking during a legislative hearing, the interior minister said the deportation order is "somewhat similar (相似的)" to registered mail - where the time starts from the day after the recipient receives the letter. .. and if "it was delivered to your house but you didn't receive it until the next day, then counting would start from the third day, which means there is some wiggle room." The statement comes after the National Immigration Agency this past weekend announced that a deportation order had been sent to a woman identified by a public social media account known as "Yaya in Taiwan." St. Kitts and Nevis foreign minister visits Taiwan The Ministry of Foreign Affairs says Saint Kitts and Nevis' foreign minister is visiting Taiwan this week. According to the ministry, it's the third time that Denzil Douglas has visited Taiwan is his capacity (職位) as foreign minister and he will be meeting with senior government officials during his five-day stay. Douglas and his delegation were welcomed on arriving at Taoyuan International Airport by Deputy Foreign Minister Chen Ming-chi. Douglas is scheduled to meet with President Lai Ching-te and Foreign Minister Lin Chia-lung this week. The delegation will also visit the Ministry of Economic Affairs. Israel Launches New Strikes Against Hamas Israel launched new strikes against Hamas and promised ‘increasing military force' after talks on on further hostage releases stalled. Early Friday morning, Israel's Prime Minister's office said it instructed the army to strike Hamas across Gaza. The statement said it was because of Hamas' repeated refusals to release its hostages and its rejection (拒絕) of all offers it received from the U.S. presidential envoy Steve Witkoff and mediators. The strikes come after nearly two months of a ceasefire to pause the 17-month long war where dozens of hostages were released for nearly 2,000 Palestinian prisoners. Hamas is believed to have 24 living hostages and the bodies of 35 others. Sweden Gives Uganda Funds for Ebola Sweden has announced new funding of $2 million to support Uganda's response to the ongoing Sudan Ebola Virus Outbreak.

ICC Reports Mongolia for Failure to Arrest Putin A panel of judges at the International Criminal Court has reported Mongolia to the court's oversight organization for failing to arrest Russian President Vladimir Putin when he visited the Asian nation last month. Putin's visit was his first to a member state of the court since it issued an arrest warrant for him last year on war crimes charges, accusing him of personal responsibility for the abductions (綁架) of children from Ukraine. Russia is not a member of the court and the Kremlin has rejected the charges. The court said in a statement that its member states are "duty-bound to arrest and surrender individuals subject to ICC warrants, regardless of official position or nationality.” What the assembly will now do remains unclear. While Putin was in Mongolia, a court said that the organization that is made up of all 124 of the court's member states can “take any measure it deems appropriate.” UN: Greenhouse Gas Emissions Out of Control A new United Nations report suggests that annual greenhouse gas emissions are at an all-time high. GB2RS News Sunday the 29th of September   The news headlines: There is still time to book tickets for the RSGB 2024 Convention The RSGB is helping to promote JOTA activities in October The RSGB has responded to a recent Ofcom Consultation concerning the 2.3GHz band   With just two weeks until the RSGB Convention, this year's event is the place to go if you are interested in anything and everything to do with amateur radio. There will be a host of expert speakers presenting on topics ranging from Sporadic-E and how to use AI to write amateur radio applications, to panel debates on amateur radio modes and presentations on inspiring the next generation of radio amateurs. The presentation summaries and speaker biographies are now available on the RSGB speaker page. AMSAT-UK has started to release news of its presentations too and you can see those on the RSGB's Convention programme. There really is something for everyone. If you haven't already bought your ticket, be sure to secure it by Monday the 7th of October when the online booking process will close. Buying tickets before the event will save you up to £5 off the usual 'on the day' ticket prices. Due to demand, the RSGB has also arranged an extra introduction to microcontroller programming workshop that will take place on the Sunday morning. There are still some tickets available for Saturday's Gala Dinner too. To book your tickets for any part of the weekend or to find out more about the programme go to rsgb.org/convention Jamboree on the Air, also known as JOTA, is taking place between the 18th and 20th of October. The event promotes friendship and global citizenship and is a brilliant celebration of amateur radio among the groups within the Scout Association. Some groups have already shared details of activities that will be taking place over the weekend and the RSGB plans to compile and share a list of these on its comms channels. If you are part of a Scouting group and are planning to get involved with JOTA then please get in touch via comms@rsgb.org.uk with a summary of your station name, callsign and any other relevant information. The RSGB has responded to a recent Ofcom Consultation which would see new users sharing spectrum within the 2.3GHz amateur band. Whilst the new devices may be limited to indoor use, the RSGB has taken the opportunity to highlight concerns regarding the weak signal 2320MHz segment. In addition, the RSGB has also indicated its wish to review the current restrictions that apply to this band that date back to 2013, when it was subject to Public Sector Spectrum Release. The response and background information can be found in the Spectrum Forum web pages at rsgb.org/spectrum-forum The October edition of RadCom includes an article about the very first two-way radio communication between the UK and New Zealand, something that Sir Edward Appleton, radio physicist and Nobel laureate, later described as “probably the most dramatic moment in the history of the development of the short waves.” The contact was between two radio amateurs, one in Mill Hill School, London and the other on a sheep farm in New Zealand. Centenary celebrations will be taking place in New Zealand and at Mill Hill School, and special event callsigns will be active from today until late October. GB2NZ and ZM100DX will be active each day during that period and, for the week of the centenary, the near-actual callsigns used in 1924, G2SZ and ZL4AA, will be active from the 14th to the 20th of October. A commemorative certificate will be available for those who make contacts with the event stations. For more information on the Goyder-Bell award, and to find out more about the centenary celebrations, go to gb2nz.com Lots of amateur radio stations are on the air this weekend for the Railways on the Air event. The occasion marks the anniversary of the first steam-powered passenger railway journey which took place on the 27th of September 1825. The first passenger train ran on a line in the North East of England from Darlington to Stockton. Activity will be centred around 3.65, 7.15 and 14.25MHz. For more information visit rota.barac.org.uk The September 2024 issue of RadCom Basics is now available on the RSGB website for members to read. RadCom Basics is aimed at new licensees or anyone who enjoys reading about the fundamental principles behind the many facets of amateur radio. Next, is a contribution from Tony Preedy, G3LNP about how to make an efficient magnetic loop antenna. The third article, by Andy Talbot, G4JNT dives into the interesting, but perhaps unfamiliar, mathematics behind the encoding algorithms used in digital data programs which we all use. The final article is the fourth in the continuing series by Barry Chambers, G8AGN about his pioneering experiments at 30THz. Newly assigned AR 3835 in the southeast quadrant is the main source and the event looks to have thrown a stream of plasma into space. The latest model suggested a possible passage near our planet by the 25th and it looks like the prediction was correct. The Space Weather Prediction Centre issued a G1 geomagnetic storm watch and visible aurora may be likely at very high latitudes. Expect maximum useable frequencies, or MUFs for short, to decline if the Kp index is above 4 or 5. Other than a large number of C-class solar flares in the past five days, this was the biggest eruptive event to occur. The solar flux index had declined to 172 on Wednesday the 25th but is unlikely to decrease much further. Note that nearly all the sunspots are in the Sun's southern hemisphere at the moment. Meanwhile, daytime MUFs over a 3,000km path are now consistently over 28MHz under quiet geomagnetic conditions. This is good news for fans of the 10m band. Night time MUFs over 3,000km are around 14 to 16MHz, so it looks like we may soon lose the 24-hour DX openings on the 20m band, which are prevalent in the summer months. Increasing solar proton flux at the moment means paths over the Arctic Circle may be compromised. Daytime critical frequencies remain over 8MHz and often reach nearly 11MHz, so NVIS communications around the UK on the 40m band remain commonplace but may disappear later in the evening. NOAA predicts that the solar flux index will increase next week but may not reach the 200s. Keep an eye on solarham.com  for daily updates.   And now the VHF and up propagation news from G3YLA and G4BAO The present run of unsettled weather has become firmly established and, although many parts of the country have not seen the torrential rain and flooding of last week, there will be some rain at times in most parts of the country during the first week of October. There are a couple of brief periods in the models when a weak ridge of high pressure is due to cross southern areas, but these are not seen as great for Tropo. The week beginning Monday the 30th of September sees at least two major lows pass close to northern Britain. One occurs as this weekend draws to a close and there may be another one later in the week. These types of changeable patterns are notorious for problems with detailed predictions beyond a few days, although the general weather type is well forecast. Just a reminder that strong wind events at the end of a long summer can be a big shock to antennas, so now is a very good time to check that all is well in the guying department. Having discounted Tropo as an option, the obvious choice will be rain scatter on the GHz bands, but some of these events may produce very fast-moving echo sources. So, it could be quite a challenge although last week saw plenty of good rain scatter conditions. Meteor scatter is again largely dependent upon random meteors with just a couple of lesser showers, the Kappa Leonids and Sextantids, which see out the end of September. The auroral situation continues to provide some excitement, and the autumn months are a good time of the year for such things. For EME operators, Moon declination is still positive until Tuesday evening, so Moon visibility windows are shortening. Path losses are high with apogee next Wednesday the 2nd of October. Thursday the 3rd sees near-eclipse conditions when the Sun and Moon are close in the sky meaning high noise with wider beam width antennas. 144MHz sky noise is, in general, low for the rest of the week. And that's all from the propagation team this week

President Lai Says Autocracy is the Crime, not democracy President Lai Ching-te said that autocracy (專制主義), not democracy (民主主義), is deserving of punishment (懲罰). The president's remarks come in response to the recent threat (威脅) by Chinese authorities (大陸官員) imposing the death penalty (死刑) on "diehard" advocates (頑固的支持者) of Taiwan independence (臺獨). The President added that China has no right nor jurisdiction (管轄權) to punish Taiwanese people for expressing their opinions or stances, stating that according to China's logic, not supporting unification (不支持統一) is the same as supporting Taiwan independence (等於支持台灣獨立). Lai called on (呼籲) China to accept the existence of the Republic of China and engage in exchanges (交流) with Taiwan's democratically-elected government. He said that's the only way to protect the welfare (福利) of those on both sides of the Taiwan Strait (台灣海峽兩岸). The president also expressed condolences (表示慰問) to those impacted by the deadly rain in southern China and said he hopes post-disaster reconstruction (災後重建) goes well. Lai welcomes Saint Kitts and Nevis PM with military salute Meanwhile, President Lai Ching-te welcomed Saint Kitts and Nevis Prime Minister (聖克里斯多福及尼維總理) Terrence Drew with a military salute ceremony (軍禮儀式) in Taipei Monday. Lai said that Drew's frequent visits to Taiwan demonstrated the nation's high regard for bilateral ties This is Drew's second state visit (國事訪問) since taking office in August 2022. Both leaders emphasized shared values of democracy and human rights (人權) and expressed commitment to deepening cooperation (深化合作) since their diplomatic relations began in 1983. President Lai also thanked Drew for calling for justice and demonstrating staunch support for Taiwan on the international stage Drew said his ongoing trip to Taiwan held "great importance", and thanked Taiwan for its support and technical assistance (技術援助) and underscored Taiwan's significant global economic role and contributions to various global challenges. The visit included a 21-gun salute and national anthems (國歌), with both Drew and Lai inspecting honor guards. Drew's delegation, which arrived Saturday for a five-day visit, includes his wife and senior cabinet members. EU has plan to use Russian frozen assets: Foreign Policy Chief The European Union's foreign policy chief (歐盟外交政策負責人) says a plan has been devised to ensure (確保) Ukraine receives funds through Russian frozen assets (凍結的俄羅斯資產). EU foreign ministers convened (召開會議) on how to navigate Hungary's opposition to support for Kyiv. Charles de Ledesma reports. Israel Hamas latest The viability (可行性) of a U.S.-backed proposal to wind down the war in Gaza is in doubt … after Israeli Prime Minister Benjamin Netanyahu said he would only agree to a “partial” cease-fire deal (部分停火協議) that would not end the war. His comments were made in an interview with a pro-Netanyahu Israeli TV channel and sparked an uproar (引起強烈反應) from families of hostages held by Hamas. This comes as Israel's Defense Minister (國防部長) Yoav Gallant is in Washington DC for what he's describing as "critical" talks (關鍵會談) on the fighting in Gaza and escalating tensions on the border with Lebanon, exchanges of fire which are stoking fears of an all-out war (全面戰爭). Benji Hyer reports.

Criminal law (2022): Crimes against the state: Secession (Part Two)

Law School

Play Episode Listen Later Apr 12, 2023 10:00

Explanations for the 20th century increase in secessionism. According to University of California, Santa Barbara, political scientist Bridget L Coggins, there are four potential explanations in the academic literature for the drastic increase in state birth during the 20th century: Ethnonational mobilization – Ethnic minorities have been increasingly mobilized to pursue states of their own. Institutional empowerment – The growing inability of empires and ethnic federations to maintain colonies and member states. Relative strength – Increasingly powerful secessionist movements are more likely to achieve statehood. Negotiated consent – Home states and the international community increasingly consent to secessionist demands. Other scholars have linked secession to resource discoveries and extraction. David B. Carter, H. E. Goemans and Ryan Griffiths find that border changes among states tend to conform to borders for previous administrative units. Several scholars have argued that changes in the international system have made it easier to survive and prosper as a small state. Tanisha Fazal and Ryan Griffiths link increased numbers of secessions to an international system that is more favorable for new states. For example, new states can obtain assistance from international organizations, such as the International Monetary Fund, World Bank and the United Nations. Alberto Alesina and Enrico Spolaore argue that greater levels of free trade and peace have reduced the benefits of being part of a larger state, thus motivating nations within larger states to seek secession. Woodrow Wilson's proclamations on self-determination in 1918 created a surge in secessionist demands. Rights to secession. Most sovereign states do not recognize the right to self-determination through secession in their constitutions. Many expressly forbid it. However, there are several existing models of self-determination through greater autonomy and through secession. In liberal constitutional democracies the principle of majority rule has dictated whether a minority can secede. In the United States Abraham Lincoln acknowledged that secession might be possible through amending the United States Constitution. The Supreme Court in Texas v White held secession could occur "through revolution, or through consent of the States". The British Parliament in 1933 held that Western Australia could secede from the Commonwealth of Australia only upon vote of a majority of the country as a whole; the previous two-thirds majority vote for secession via referendum in Western Australia was insufficient. The Chinese Communist Party followed the Soviet Union in including the right of secession in its 1931 constitution in order to entice ethnic nationalities and Tibet into joining. However, the Party eliminated the right to secession in later years, and had anti-secession clause written into the Constitution before and after the founding of the People's Republic of China. The 1947 Constitution of the Union of Burma contained an express state right to secede from the union under a number of procedural conditions. It was eliminated in the 1974 constitution of the Socialist Republic of the Union of Burma (officially the "Union of Myanmar"). Burma still allows "local autonomy under central leadership". As of 1996, the constitutions of Austria, Ethiopia, France, and Saint Kitts and Nevis have express or implied rights to secession. Switzerland allows for the secession from current and the creation of new cantons. In the case of proposed Quebec separation from Canada, the Supreme Court of Canada in 1998 ruled that only both a clear majority of the province and a constitutional amendment confirmed by all participants in the Canadian federation could allow secession. --- Send in a voice message: https://podcasters.spotify.com/pod/show/law-school/message Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

The most eventful week in the history of investment migration is drawing to a close. One major golden visa closed outright when Irish Justice Minister Simon Harris unceremoniously announced that his country's Immigrant Investor program would be closing with immediate effect. Last year, rumors of the program's potential closure drove a surge in applications, almost entirely from Chinese investors. The program received 1,316 applications in 2022, more than five times the number received in the preceding year. While giving no concrete reason for his decision, Harris hinted that pressure from the European Union had played a role. The really big news this week, of course, was Portuguese Prime Minister António Costa's announcement that Portugal's golden visa, widely regarded as one of the world's leading RBI schemes, would be closing. A few days before, rumors of the program's imminent closure had surfaced in Portuguese news, but most industry observers had anticipated a more nuanced approach from the government, one that would leave some categories of the program open. The PM, however, indicated he would scrap the program altogether. Questions now remain as to whether there will be a transition period, what will happen to those who invested in something other than real estate, and whether the announced measures are even constitutional. In Spain, meanwhile, leftist parliamentarians submitted a bill that seeks to remove the real estate option from Spain's golden visa program, which they said was driving up property prices in the country and “expelling the local population.” The draft bill aims to leave the golden visa program open only to those who invest at least a million euros in business or bank deposits or 2 million euros in government bonds.Market commentators questioned what level of demand we might expect for Russia's new golden visa program, which will provide permanent residence to applicants - and five generations of their family members - who invest in Russian real estate, companies, or social projects. Minimum investments range from about $200,000 to $680,000.The Saint Kitts & Nevis Citizenship by Investment Unit issued a new set of regulations for the Caribbean's most popular CIP merely seven weeks after its first raft of changes. The new regulations reverse some of the regulations introduced in December, which had, among other things, prohibited the re-sale of CBI real estate. Finally, IMI this week announced that IMI Connect - our bi-annual landmark event for investment migration practitioners - would take place in Malta between the 18th and 20th of May. A wide array of industry leaders have already confirmed their attendance, and tickets will open for sale to the public in the coming weeks.

Malaysia now has four separate residence-by-deposit programs after Sarawak - one of two Malaysian states that control their own immigration policies - introduced its own version of the Malaysia My Second Home (MM2H) program. Sarawak's program offers essentially the same benefits as its federal counterpart - the right to reside for 5+5 years anywhere in Malaysia - but at one-fifth of the cost. This week on the Mobility Standard podcast, David Lesperance and Melvin Warshaw discussed the persistent uptick in American interest in investment migration and renunciation, the tax pitfalls American expats need to avoid at all costs, and the three positions American HNWIs take on the expatriation question. Our new report - Low-Tax Living in High-Tax Europe - provides a guide to 11 special tax regimes in eight Western European countries that enable individuals to pay a single-digit tax rate in otherwise high-tax countries. It covers regimes that are particularly favorable to those who receive high passive incomes such as dividends, capital gains, rental income, royalties, and similar, as well as those with high professional incomes. If you, or your client, is attracted to Western Europe for its lifestyle proposition but deterred from residing there full-time by high levels of taxation, this guide will show you how to have your cake and eat it too.The European Council has agreed to give Vanuatu another 18 months to reform its program before it implements a full suspension of the country from the Schengen area's visa-waiver agreement. Vanuatu has agreed to work with full transparency during the reform, inviting the EU to observe and advise the process. Theoretically, at least, we may soon see a CIP that's not only approved by the EU but partially devised by it.2022 was the year Grenada's Citizenship by Investment Program joined its peers in Saint Kitts & Nevis and Dominica to become the third Caribbean CIP in history to receive more than a thousand applications in a single year. For the first time in Jake's Take with Jacob Elyachar history, we welcomed another Jake who has a phenomenal take. It is a pleasure to welcome author, musician, and podcast host Jake Fraczek to The Jake's Take with Jacob Elyachar Podcast. Jake was born in Massachusetts but grew up in the Island of Nevis and Saint Kitts, in the West back to Boston for school and spent time there growing up. He grew up painting, drawing, surfing, and skateboarding. Jake Fraczek also goes by the moniker, “Jake The Snake,” (which eventually became “J the S” for short), which was his childhood nickname that followed him into his independent music career as a hip hop artist and his band, Blue Gold, who traveled the country playing shows and releasing a number of projects. The current Los Angeles resident was the former co-host on Dash Radio's Reigning Real and currently hosts the Damaged Goods Podcast. Recently, he released his latest book: The Waiting Room. The Waiting Room is a collection of essays that is a follow-up of his first book: Quicksand. Both books are autobiographical and grounded in the backstory of heartache, ego, and now in The Waiting Room, the painful loss of his father. In this edition of The Jake's Take with Jacob Elyachar Podcast, Jake Fraczek spoke about The Damaged Goods Podcast's origin story and previewed his new book.
