Despite the defense's attempts to frame Mendoza as an independent contractor, Maxey successfully proved that he was an employee in the course and scope of his employment, showcasing Titan's negligence in his lack of training and safety protocols. Scherr Law Firm secures an $11,005,000 settlement with three of four defendants named in a lawsuit and obtains a $16,857,276 verdict against the fourth remaining defendant in  their second trial. This episode explores Atom Egoyan's 1997 film, The Sweet Hereafter, which describes the impact of a tragic school bus accident that caused the death of 14 children on a small Canadian town. The film is based on Russell Banks' 1991 novel of the same name (which in turn was based on a real-life bus crash in Texas). The film centers on personal injury lawyer Mitchell Stephens (Ian Holm), who travels to the town after the accident in an attempt to persuade the parents of the children to bring a negligence lawsuit. The controversy generated by the lawsuit ripples through the community and is explored through several characters in the town, including Nicole (Sarah Polley), a teenage girl who is left paralyzed from the waist down by the accident; Dolores Driscoll (Gabrielle Rose), the bus driver on the fateful, day; and various parents who have sharply conflicting views on the lawsuit. The Sweet Hereafter, however, is much more than a story about tort litigation; it explores larger philosophical questions around justice, community norms, and the role of law in addressing life's most painful tragedies. After graduating from the USC School of Cinematic Arts with an MFA in Animation, he worked as an animator in Hollywood, contributing to an early version of Shrek at DreamWorks, Dinosaur at Disney, and to the music video Californication by the Red Hot Chili Peppers. In 2001 my guest joined the video game studio Naughty Dog and worked as the cinematics animation lead on seven titles including Jak and Daxter and the first three Uncharted games, a series for which he also helped to develop the storylines. He then became a staff writer and narrative designer on Uncharted IV: A Thief's End, Uncharted: The Lost Legacy, and the recent blockbuster The Last of Us: Part II. Jim Scherr was named the first chief executive officer of World Lacrosse in 2017. Prior to that, he was CEO of the United States Olympic Committee from 2003 to 2009. Scherr, who competed as a wrestler at the Seoul 1988 Olympic Games, was the first Olympian to serve in that position with the USOC. Before joining the USOC, Scherr served as executive director of USA Wrestling from 1990 to 2000, and also was the National Collegiate Hockey Conference commissioner from 2012­ to 2013. During his time at World Lacrosse, Scherr has grown the sport globally ahead of the 2023 World Lacrosse Championships from June 21-July 1 in San Diego. This episode of Across The Margin: The Podcast presents an interview with musician trumpeter, slide trumpeter, arranger/composer and bandleader from New York City, Steven Bernstein. Steven is best known for his work in The Lounge Lizards, Sexmob, Spanish Fly, and the Millennial Territory Orchestra. He has released four albums under his own name on John Zorn's Tzadik Records and he has performed with jazz giants including Roswell Rudd, Sam Rivers, Don Byron, and Medeski, Martin & Wood, as well as musicians ranging from Aretha Franklin to Lou Reed, from Linda Ronstadt to Digable Planets, from Sting to Courtney Love. Steven was a member of Levon Helm's Midnight Ramble band, playing in Helm's Woodstock home, as well as touring with the band. As an arranger he has written for Bill Frisell, Rufus Wainwright, and Elton John, just to name a few. He has composed for dance, theater, film and television, and with composer John Lurie, arranged the scores to many feature films, including Get Shorty. While Steven is prolific with his output, this episode centers on two of his projects, Sexmob, which just released a terrific new album called The Hard Way, and The Millennial Territory Orchestra, which recently released four excellent records, in one day, on the Royal Potato Family label. Sexmob's latest release is a bit of a departure for the band, as with producer Scotty Hard at the board, The Hard Way skews decisively electronic. On it, Hard's beats and soundscapes provide Steven, saxophonist Briggan Krauss, bassist Tony Scherr and acoustic/electric drummer Kenny Wollesen, all the stimulus they need for further compose and fearlessly reinvent. With each offering, and certainly with The Hard Way and its rich electro-acoustic groove canvas, Steven and crew reveal a modernizing impulse, but also an equally strong foundation in the roots of jazz and American song. Funky, bluesy, with a tattered dissonance conjured up by Krauss Throaty saxophone tone, the distinctive wail of Steven's rare horn, and the swagger of Scherr and Wollesen's rhythm section grind, Sexmob continues to chart new paths in 21st-century creative music.
