We dive deep into digital privacy enforcement, the exploding intersection of litigation finance and law firm operations, and how alternative business structures (ABS) and managed service organizations (MSOs) are reshaping legal services. Hosts Brandon Schuh and Nick Hartmann talk with Nick Rowles-Davies, CEO at Lexolent, dissect the FTC's landmark General Motors and OnStar settlement, which finalized in January 2026, revealing how millions of consumers unknowingly had their precise driving data collected, sold, and monetized without consent. The conversation explores the regulatory response, the growing complexity of fee-sharing arrangements in contingency-based litigation, and the philosophical debate between UK and US approaches to nonlawyer investment in law firms. Woven throughout are lighter moments, including a "two truths and a lie" game testing movie trivia knowledge about Back to the Future, Die Hard, and The Breakfast Club. The episode reflects broader industry shifts like private equity capital flooding into legal services, litigation funders gaining unprecedented control over case strategy, and regulators tightening scrutiny on data-driven business models that exploit consumer blind spots. For legal professionals, insurance industry participants, and policy advocates, this episode maps the emerging terrain of consumer protection in connected vehicles, the ethical fault lines of litigation finance, and the practical mechanics of MSO structures designed to attract venture and private equity backing while skirting prohibitions on nonlawyer ownership.Key Takeaways:GM/OnStar Settlement (January 2026): FTC finalized a major enforcement action banning GM from sharing geolocation and driving behavior data with consumer reporting agencies for five years and requiring explicit opt-in consent for all future data collection, a landmark win for privacy advocates concerned about insurance rate impacts.Alternative Business Structures (ABS): Limited to Arizona, Utah, and DC in the US, ABS allows nonlawyers to hold equity in law firms directly. This contrasts sharply with UK structures, where ABS has been legal for over a decade and shows more tolerance for mixed ownership models.Managed Service Organizations (MSOs) as Workaround: Since ABS remains rare in most US states, law firms partner with investor-backed MSOs that handle back-office, marketing, and technology functions, siphoning off overhead costs while keeping lawyer-owned firms appearing compliant with Rule 5.4 prohibitions.Episode Chapters05:30 Privacy & Digital Surveillance08:30 GM/OnStar FTC Settlement Details & Data Monetization10:00 AI Liability & Regulatory Uncertainty Discussion15:00 Settlement Negotiations & Litigation Strategy18:00 Insurance Industry Corporate Raids & Fictional Premise24:30 GM Truck Insurance Quote & Data Sharing Consent27:00 Litigation Prediction & Case Strategy28:00 Administrative Duties & Managed Services Models31:40 Guest Introduction & UK Legal System Background32:00 Alternative Business Structures & Private Equity in Law35:00 Ethical Concerns in MSO Models37:00 Margin Analysis & Contingency Fee Economics41:00 Litigation Finance Benefits & Structural Risks43:00 UK vs US Bar Ethics & Jury Trial Impact45:00 Fee-Sharing Regulations & Risk Assessment49:00 Regulatory Credibility & Litigation Finance Critique55:00 AI Asymmetry in Litigation StrategyConnect with RiskCellar:Website: https://www.riskcellar.com/Guest: Nick Rowles-DaviesLinkedin: https://www.linkedin.com/in/nick-rowles-davies/ Portfolio: http://www.legalfinance.expert/Substack: https://nickrowlesdavies.substack.com/Company Website: http://www.lexolent.com/ Brandon Schuh:Facebook: https://www.facebook.com/profile.php?id=61552710523314LinkedIn: https://www.linkedin.com/in/brandon-stephen-schuh/Instagram: https://www.instagram.com/schuhpapa/Nick Hartmann:LinkedIn: https://www.linkedin.com/in/nickjhartmann/

Unsecured Flock Safety Condor cameras were found livestreaming on the internet without passwords or encryption. The flaw exposed at least 60 cameras, allowing public access to feeds, downloads, and administrative controls. The researchers who disclosed the vulnerability reported facing police surveillance and job loss following what they termed their "responsible security research."The Federal Trade Commission (FTC) has finalized an order requiring General Motors and its OnStar service to obtain "clear, affirmative consent" from consumers before sharing sensitive driving and location data. The mandate grants consumers expanded rights to access, delete, and control the use of their personal information generated by connected vehicles.Homeland Security Investigations (HSI) has acquired a device potentially linked to "Havana Syndrome" using funding provided by the Department of Defense. Reportedly portable enough to fit in a backpack, the device is said to produce pulsed radio waves. A primary national security concern is that if the technology is viable, it may have proliferated, giving other nations access to a potentially harmful weapon. The "GhostPoster" malware campaign has re-emerged, leveraging malicious browser extensions installed by hundreds of thousands of users. The malware conceals its malicious code within image files and can activate after long delays. Its primary threats include injecting scripts into web pages, tracking user activity, and weakening browser security settings.A newly discovered malware framework named "VoidLink" shows strong evidence of being generated with AI assistance. Designed to target Linux cloud servers and container environments, VoidLink features a sophisticated modular design with rootkit capabilities. Analysis suggests the framework was generated to a functional state in about a week using an AI assistant, highlighting how AI is accelerating the creation of advanced malware.A malware campaign is deploying "Evelyn Stealer" through malicious Visual Studio Code extensions. The attack injects the stealer into a legitimate Windows process, grpconv.exe, to evade detection. The malware also tricks browsers into running in hidden contexts to avoid detection during credential harvesting. It is designed to exfiltrate developer credentials, browser cookies, and cryptocurrency wallets. The European Commission has proposed new mandatory cybersecurity legislation aimed at removing high-risk technology suppliers, such as Chinese firms Huawei and ZTE, from the EU's critical telecommunications and ICT infrastructure. This policy, which builds on frustrations with the EU's voluntary 5G Security Toolbox, shifts from voluntary guidelines to binding rules empowering the EU to restrict equipment based on national security risks.Italy's influential data privacy authority, the "Garante," is the subject of a corruption investigation. Prosecutors are examining allegations of excessive spending and possible corruption involving the agency's president, Pasquale Stanzione, and three other board members. The Garante is one of the EU's most proactive regulators against major technology firms.A recent security update for Windows 11 23H2 has introduced a bug preventing some PCs from shutting down or hibernating. Microsoft has linked the issue to its "Secure Launch" security feature. The company's official workaround is to use the command-prompt command shutdown /s /t 0 to force the machine to power down while a permanent fix is developed.

“The worst thing in life is to look back and say, I wish I had.”That one piece of advice changed everything for Hilda Galvan. She sold her brand-new home, headed to law school, and never looked back.Fast forward three decades: Hilda became one of the most respected intellectual property litigators in the country, leading Jones Day's Dallas office for nearly a decade and winning cases for clients like IBM, Motorola, OnStar, and Charles Schwab. Along the way, she mentored scores of lawyers, broke barriers in patent litigation, and became a role model for others. Now, she's in a new chapter; one she calls “retirement” but we'd call anything but. Hilda is pouring her energy into consulting with technology startups, joining corporate boards, and championing women-owned businesses and nonprofits. In this episode of Counsel Brew, Hilda talks about resilience, leadership, and carving your own path. From her early engineering days to becoming a first-chair trial lawyer when few women had that seat, her story is packed with grit, wisdom, and plenty of humor. And yes, we get into her favorite brew — black coffee. No sugar. No cream. Nebraska attorney general announces lawsuit against General Motors

Attorney General Mike Hilgers Files Lawsuit Against General Motors for Deceptive Collection and Sale of Nebraskans' Driving Data LINCOLN — On July 8, 2025, Nebraska Attorney General Mike Hilgers announced that the State of Nebraska has filed a lawsuit against General Motors LLC and OnStar LLC for unlawfully collecting, processing, and selling sensitive driving data from Nebraskans without their knowledge or consent. The lawsuit, filed in Lancaster County District Court, alleges that GM engaged in deceptive and unconscionable business practices in violation of the Nebraska Consumer Protection Act and Uniform Deceptive Trade Practices Act. According to the lawsuit, GM installed telematics systems in its vehicles that tracked a wide array of data points, including speed, seatbelt usage, driving habits, and location. GM then packaged and sold that data to third-party data brokers, who used it to create “Driving Scores” for millions of drivers. These scores were later sold to insurance companies and used to raise rates, deny coverage, or cancel policies, all without Nebraska drivers ever knowing such data was being collected or used against them. Among the key allegations: * GM deceived consumers at the point of sale by misrepresenting the nature and scope of the OnStar-connected services. * Consumers were often misled into believing enrollment in OnStar was mandatory to access basic safety features. * GM failed to adequately disclose that enrollment in its mobile apps or Connected Vehicle Services would allow the company to collect and sell detailed personal data. * Dealership employees were incentivized to enroll customers without proper disclosure and, in some cases, without any consent at all. “Nebraskans deserve to work with companies that are truthful and honest about what they are doing,” Attorney General Hilgers said. “That is not what happened here, and we filed this lawsuit because one large company decided that it wouldn't honestly tell Nebraskans that their data was going to be used to impact their insurance rates. This is wrong. Our office will hold companies that mislead Nebraskans accountable, no matter how large.” The complaint seeks civil penalties, restitution for impacted Nebraskans, and injunctive relief to prevent GM and OnStar from continuing these practices in the state.

I used to think of my car as just a tool to get from point A to point B. But after this conversation, I can't help but see it as something else entirely, a powerful data collection device that knows far more about me than I realized. From where I go and who I text to how I drive and even what's on my phone, today's vehicles are gathering a staggering amount of personal information. In this episode, I talk with Andrea Amico, the founder of Privacy4Cars. Andrea is one of the leading voices in automotive data privacy and someone who's spent years uncovering the hidden ways cars collect, store, and share our information. He breaks down how connected cars work, what's actually being tracked, and why it matters not just for your privacy, but for your safety and finances too. We get into everything from rental car risks and data left behind when you sell a car, to how automakers and third parties might be profiting off your data without your knowledge. If you've ever paired your phone with a vehicle or assumed your texts disappear when you disconnect, this episode is going to change the way you think about driving and how to take back control. Show Notes: [01:28] Andrea started Privacy4Cars because cars collect a lot of data. There were zero protections for privacy and security. He's dedicated to turning your car into a more private space and giving you more choice, understanding, and control. [02:25] We talk about when cars started collecting data. OnStar started about 25 years ago. Things really began to evolve when Bluetooth and navigation became common. [03:12] Things really exploded with modern telematics which is like putting a cell phone inside your car that calls home all the time. The average car collects around 25 GB of data per day. [04:08] We talk about the type of data that is collected by cars from GPS to having your phone collected and the car even knowing your weight. [05:26] The sensors in your car know exactly how you drive. [06:46] Informed consumers are better off. These data collecting policies are usually hidden in the car manufacturers privacy policies. [08:46] You can find your car's privacy policy at Vehicle Privacy Report. [10:21] The goal is to make the car manufacturer's behavior visible to consumers, because that's the way to drive better company behavior. [11:26] When you rent a car and when you sell a car, your car is like a giant unencrypted hard drive that contains your data. [12:06] We should wipe the data in our cars the same way we wipe the data in our phones when we replace them. [13:05] You can find a tool to help remove data from your car at Privacy4Cars. [14:21] We talk about what rental cars get from your connected phone.  [17:24] Found data can be used in targeted spear phishing attacks. [19:18] Most cars since 2017 have a SIM card. If a prior owner consented to data collection, that data is still being collected when you take over the car. [22:15] Ford estimated that they would make $2,000 per car per year from data services. [24:17] It's common for cars to even have a camera that looks at you. In a few years it might be common for vehicles to monitor for things like intoxication. [26:56] Organizations creating standards like the Future of Privacy Forum. [29:09] Cars have an EDR electronic data recorder. It's like a black box for when an accident happens. [34:05] Delete data when you buy, rent, or sell a car. Opt out if you can. [36:33] Think about your car just like your computers and your phone. [37:15] Andrea shares a story about how an ex-spouse was able to duplicate her key. The dealer wanted $1,000 to reset her car. May 31, 2025 Hello and Happy Day! This is Dr. MaryAnn Diorio, Novelist and Life Coach, welcoming you to another episode of Winning with the Word. Today is Saturday, May 31, 2025, and this is episode #6 in Series 2025. This episode is titled, “It's All about Control!"What's all about control? The events we see going on in the world today. Our world is fast moving toward the rise of the AntiChrist and his global dictatorship. Everything is being set up for the establishment of the Beast system and, sad to say, most of the world is clueless. What about you? Are you clueless, too? If so, listen to this podcast to the very end so that you can be prepared for what lies ahead in the very near future. You've very likely heard of the accelerated move toward the digitalization of our world, including the financial, medical, and social segments of society. Digital currency is making major head-roads in Europe, with the soon establishment of the digital Euro by 2026, if not before. The European Central Bank has stated that it "hopes to have a political deal on the digital Euro by early 2026." I've posted the article containing this quote under "Sources Cited" in the show notes. In another article, posted by Accenture and titled "The Digital Euro: A strategic step toward Europe's monetary sovereignty?," the author explains that "cash is rapidly losing ground" and being replaced by a digital system that will purportedly make monetary transactions safer and more convenient.Pay attention to the words "safer" and "more convenient." You will be hearing and seeing those words more and more as the world becomes completely digitalized. Under the guise of safety and convenience, the New World Order is setting up a system of control over the entire world population. Eventually, as they proclaim, "You will have nothing and be happy."Why will you have nothing?Because your freedom is being gradually stolen from you, under your very nose. And you are very likely unaware that it's happening. What looks like a "safer and more convenient" way of living is actually leading to tyranny. Lest you think I am being far-fetched and alarmist, consider this:__Surveillance cameras are everywhere, watching our every move. One writer noted that the United States has more surveillance cameras per person than any other country in the world. (https://theconversation.com/surveillance-is-pervasive-yes-you-are-being-watched-even-if-no-one-is-looking-for-you-187139)__More and more countries are requiring more and more identification processes—like iris scanning, facial scanning, palm scanning, and on and on—in order to travel, purchase, and do things we used to do without such scanning.__When you're online, websites use ad-trackers and third-party cookies to gather information about you. These ad-trackers and third-party cookies are stored in your browser and follow you around from site to site, enabling advertisers to follow you around as well.__These days, surveillance is the name of the game in healthcare as well. A recent article, titled "AI may be listening in on your doctor's appointment," raises a red flag on another aspect of stolen freedom. (https://endtimeheadlines.org/2025/05/ai-may-be-listening-in-on-your-doctors-appointment/)__If you wear a device to monitor your health, such as a FitBit or SmartWatch, you are being surveilled. It has been noted that there is an eerie resemblance between a FitBit and the ankle bracelets people wear when being monitored by a court of law. The analogy reminds me of the heavy chain prisoners used to have to wear around their ankles.__Perhaps the biggest tracking culprit of all is your cell phone. GPS gives your location to maps and weather apps. WiFi and Bluetooth can pinpoint your phone's location. Do you use gaming apps? Then your information is being tracked. Do you own a late-model car? Then very likely your car employs telematics, such as OnStar or Bluelink to track your location.

Will the Science Prove Karen Read's Innocence? Attorney Bob Motta Thinks So In the premiere segment, Tony Brueski and Bob Motta cut straight to the most decisive element of the Karen Read case: the forensic evidence. According to Motta, this case isn't about drama, hearsay, or even Karen Read's bizarre behavior. It's about whether the physical evidence proves she hit John O'Keefe with her Lexus — and right now, the science says she didn't. Motta places his trust in independent experts — specifically the ARCCA engineers hired by the Department of Justice, who testified that the damage to the Lexus and the injuries to O'Keefe do not match a typical vehicle-pedestrian strike. In other words, no broken bones, no directional wounds, no blood patterns to suggest a hit-and-run. And this testimony, unlike Proctor's or McCabe's, doesn't change. It's science. Tony counters with a key question: what happens if new vehicle data does emerge — like black box logs or OnStar records — that shows a collision at the time of death? Motta admits that would be damning. But he's not holding his breath. If prosecutors had a “smoking gun” like that, he says, they'd have led with it. This episode explores the growing tension between Karen Read's self-incriminating statements and the cold, hard science that seems to contradict them. It's the ultimate courtroom clash: Karen's words vs. the data. Shoot us a Text.Episode #1031: Today we're talking about Trump's possible easing of auto tariffs ahead of a Michigan trip, GM's courtroom defense over driver data privacy, and why e-commerce might be losing its edge as shoppers crave more fun and surprise. As he prepares to visit Michigan for the 100-day mark of his second term, President Trump is signaling potential changes that could ease the auto industry's tariff burdens. The administration is considering adjustments to tariffs on imported auto parts and may exempt automakers from certain steel and aluminum duties. The policy shift, first reported by the Wall Street Journal, appears aimed at supporting domestic manufacturers and suppliers.Proposed changes would address the “stacking” of tariffs—where multiple levies apply to the same imported vehicle—by potentially eliminating overlapping duties. The potential relief follows a joint letter from major automakers, including GM and Toyota, urging the administration to reconsider.“This deal is a major victory for the president's trade policy,” said Commerce Secretary Howard Lutnick, “by rewarding companies who manufacture domestically.”General Motors is facing a wave of lawsuits accusing the automaker of secretly collecting and selling drivers' behavioral data—claims GM is now trying to dismiss with a bold new legal argument. The lawsuits began in March 2024, alleging GM, OnStar, and data firms like LexisNexis shared driver behavior data without proper consent.GM discontinued its Smart Driver program in April 2024 and ended partnerships with LexisNexis and Verisk after public backlash. Now, GM argues the data collection didn't violate privacy because driving behavior on public roads isn't protected under privacy laws.“Driving data includes vehicle location, routes, braking events, and speed—all occurring on public thoroughfares,” GM said in its dismissal filing.“Roadways are public, and these behaviors are observed by all,” GM stated, citing precedent that public conduct doesn't carry a reasonable expectation of privacy.A new study from Criteo reveals that the digital checkout rush might be fading, with consumers craving the discovery and delight of in-store shopping.More than 75% of consumers say e-commerce is functional—but not fun—with 29% calling it a chore.Shoppers miss the thrill of the unexpected: 36% long for the “surprise finds” that often come in-store.A majority find online shopping overwhelming (78%) and lonely (79%), with only half describing it as enjoyable. While data privacy remains a concern, 43% of consumers are open to sharing data for a more tailored experience.Join Paul J Daly and Kyle Mountsier every morning for the Automotive State of the Union podcast as they connect the dots across car dealerships, retail trends, emerging tech like AI, and cultural shifts—bringing clarity, speed, and people-first insight to automotive leaders navigating a rapidly changing industry.Get the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/

Data Privacy, Security, and Tech Trends in Early 2025 1. What was the scale of healthcare data breaches in the U.S. during 2024? In 2024, the U.S. healthcare sector experienced a massive surge in cyberattacks, with approximately 720 reported breaches compromising an estimated 186 million user records. This exposed a vast amount of sensitive information, including names, contact details, Social Security numbers, and medical histories. This is approximately 56% of the US population. 2. How did UnitedHealth handle its data breach notification, and what are the implications for affected individuals? UnitedHealth, specifically its subsidiary Change Healthcare, attempted to obscure its data breach notification webpage from search engines, making it difficult for the over 100 million affected individuals to learn about the incident. They used a “noindex” tag to keep it out of Google, burying the story of their breach. This led to widespread confusion and further distrust of the company. It also highlights how companies can use search engine optimization to hide breaches by burying the real stories. 3. What is GeoSpy, and what privacy concerns does it raise? GeoSpy is an AI tool that can accurately predict the location of photos based on features within the images, such as vegetation, architecture, and spatial relationships. Originally available to the public, it's now marketed to law enforcement and government agencies. This technology raises serious privacy concerns, as it can be used by stalkers or other malicious actors to geolocate individuals from publicly available photos. The tool is now available to law enforcement and enterprise users, and some versions of it are more powerful than what was offered to the public. 4. What restrictions were placed on General Motors (GM) regarding the sale of driving data? The Federal Trade Commission (FTC) banned GM and its subsidiary OnStar from selling customer geolocation and driving behavior data for five years. This action followed an investigation that revealed GM had been collecting and selling detailed driving information to insurance companies without obtaining explicit consent from vehicle owners. 5. What is the UK's new digital wallet app, and what types of documents will it support? The UK is launching a digital wallet app called GOV.UK Wallet, allowing citizens to store government-issued documents on their smartphones. Initially supporting veteran cards, it will expand to include driver's licenses in late 2025, with plans to add passports, marriage certificates, and benefit documents by 2027. 6. What security risks are associated with failed startups and "Sign in with Google" features? Former employees of failed startups using "Sign in with Google" features are vulnerable to data breaches. Hackers can exploit abandoned company domains and the associated Google login systems to access sensitive information stored in business software like Slack, Notion, and HR systems, including social security numbers. This vulnerability is particularly relevant to startups that used the ""Sign in with Google"" function. 7. What challenges did Amazon employees face following the mandatory return-to-office policy? Amazon's mandate for a full return to the office resulted in significant challenges for employees, including a shortage of desks and meeting rooms, overcrowded parking facilities, and an increase in workplace thefts. The policy has also been criticized for forcing employees into video calls that could have been easily conducted remotely, and some employees reported that there is a lack of trust amongst colleagues. 8. What are the $TRUMP and $MELANIA coins, and what controversies are surrounding them? Donald and Melania Trump introduced meme coins named $TRUMP and $MELANIA on the Solana blockchain. These coins quickly gained significant value, raising concerns about potential conflicts of interest and market manipulation.

Plus, EV registrations are rising amid concerns that President Trump will get rid of the IRA tax credit, and lessons learned from the 2025 National Retail Foundation Big Show.Show Notes with links:General Motors has reached a settlement with the FTC over allegations that it sold customer driving data without their consent. The FTC alleged that GM's OnStar service collected precise geolocation and driving behavior data, which was then sold to third parties, including consumer reporting agencies. GM failed to clearly disclose to consumers that it collected and sold this data. The FTC claims that GM's enrollment process for the OnStar Smart Driver feature was "confusing and misleading."GM has discontinued the Smart Driver program and ended its third-party telematics relationships with LexisNexis and Verisk.Under the settlement, GM is banned from disclosing this type of consumer data to consumer reporting agencies for five years. The company will also take steps to provide greater transparency and choice to consumers over the collection, use, and disclosure of their connected vehicle data."Respecting our customers' privacy and earning their trust is deeply important to us," GM said.Electric vehicle registrations saw a significant jump in November as consumers rushed to take advantage of automaker discounts and secure the $7,500 federal tax credit, which may be repealed under President-elect Donald Trump.EV registrations surged 21% year-over-year to 109,120 vehicles in November.Battery-electric vehicles captured 8.3% of the U.S. light-vehicle market, up from 7.4% a year earlier.Automakers, fearing a drop in EV demand if incentives are repealed, offered deep discounts and lease deals.Tesla led the market with 46,225 registrations, while GM brands saw the most growth, particularly Chevrolet. The National Retail Foundation 2025 Big Show in New York brought together tens of thousands of retail professionals to discuss the landscape of shopping, technology, and consumer behavior. Key themes included adaptability, embracing failure, and the growing role of AI-driven dynamic pricing in retail strategies.Best Buy CEO Corie Barry emphasized "adaptability over perfection," noting that retailers must balance both in-store and digital experiences to remain competitive.Amazon's Doug Herrington echoed Jeff Bezos's sentiments on learning to fail, saying, "If you get too good at avoiding failure, innovation becomes nearly impossible."Macy's CEO Tony Spring rejected the idea that department stores are dead, instead calling them a "curated marketplace" that can flex with shifting consumer demand.Target's Rick Gomez praised the resilient, resourceful, and intentional American conHosts: Paul J Daly and Kyle MountsierGet the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/ Read our most recent email at: https://www.asotu.com/media/push-back-email

In today's episode, we explore a range of fascinating developments at the intersection of AI, law enforcement, labor regulations, automotive privacy, and startup funding. First, we take a look at Microsoft's new Phi-3 family of compact yet powerful language models that bring advanced AI capabilities to smartphones and edge devices. Next, we examine Axon's "Draft One" tool that uses AI to automatically generate police reports from body cam audio, aiming to reduce paperwork and increase community engagement time for officers. We also break down the FTC's groundbreaking decision to ban non-compete agreements nationwide, a move poised to boost worker mobility and entrepreneurship. Shifting gears, we investigate troubling reports accusing GM of tracking drivers' behavior through its OnStar system and sharing that data with insurers without proper consent, underscoring the growing privacy concerns surrounding connected cars. Finally, we celebrate a milestone close to home as Perplexity AI, the company behind this podcast, achieves unicorn status with a $1 billion valuation thanks to the incredible support of listeners like you.
