Une fois condamné, le coupable était d'abord fouetté, puis cousu vivant dans un sac de cuir. À l'intérieur de ce sac, on plaçait plusieurs animaux, dont la composition pouvait varier selon les époques, mais qui comprenait le plus souvent :– un chien– un coq– un serpent– un singeLe sac était ensuite jeté dans un fleuve ou dans la mer, condamnant le criminel à une mort lente par noyade ou par asphyxie, dans un espace clos, plongé dans la panique et la souffrance.Chaque animal avait une forte valeur symbolique pour les Romains. Le serpent évoquait la perfidie, le chien la loyauté trahie, le coq la vigilance bafouée, et le singe représentait une humanité déformée, presque monstrueuse. Le condamné était ainsi exclu symboliquement de la communauté humaine et même du monde des morts : il ne touchait ni la terre, ni l'air libre, ni le feu, éléments essentiels dans les rites funéraires romains.La peine du sac apparaît progressivement dans le droit romain, notamment à partir de la fin de la République, et est formalisée sous l'Empire. Se faire tirer les oreilles est aujourd'hui un geste banal : une réprimande légère, parfois affectueuse, parfois humiliante. Pourtant, cette expression plonge ses racines dans une histoire ancienne, juridique et symbolique, qui remonte effectivement… à la Rome antique.Dans le monde romain, l'oreille n'est pas un organe anodin. Elle est associée à l'écoute, à la mémoire et à la responsabilité. Tirer l'oreille de quelqu'un n'est pas un geste impulsif : c'est un acte codifié, chargé de sens. Dans la justice romaine, on considérait que voir et entendre faisaient foi. Être témoin impliquait une responsabilité morale et civique.Lorsqu'un citoyen était convoqué comme témoin devant un tribunal, il arrivait qu'on lui tire physiquement l'oreille. Pourquoi ? Pour lui rappeler qu'il avait entendu et vu les faits, et qu'il devait s'en souvenir fidèlement. Ce geste servait à ancrer l'événement dans la mémoire, à une époque où l'écrit était rare et où la transmission orale était centrale. Tirer l'oreille, c'était dire : souviens-toi, tu es responsable de ce que tu dis.Le geste apparaît notamment dans des textes de juristes romains et chez certains auteurs latins. Il s'inscrit dans une culture où le corps sert de support à la loi. La mémoire n'est pas abstraite : elle est incarnée. On marque le corps pour marquer l'esprit.Avec le temps, le geste quitte le strict cadre judiciaire et devient une forme de rappel à l'ordre. Au Moyen Âge, tirer les oreilles est parfois utilisé dans des contextes éducatifs ou disciplinaires, notamment envers les enfants ou les apprentis. Le sens évolue : on ne rappelle plus un témoignage, mais une faute, une règle transgressée.Peu à peu, la dimension symbolique l'emporte sur la dimension juridique. Tirer les oreilles devient une sanction mineure, opposée aux châtiments corporels sévères. On ne punit pas vraiment : on corrige, on avertit, on humilie légèrement pour faire passer le message.Aujourd'hui, l'expression a largement perdu sa violence d'origine. « Se faire tirer les oreilles » signifie être réprimandé, recadré, parfois même gentiment. Mais le cœur du sens demeure : quelqu'un vous rappelle à l'ordre, vous oblige à prendre conscience de ce que vous avez fait.En résumé, se faire tirer les oreilles n'est pas un simple geste familier.
