Abby Massey, PE, PMP, LEED AP, is the Tax Incentives Director for Calvetti Ferguson Accounting and shares her years of experience with sustainability and energy efficiency, and the Inflation Reduction Act will walk us through the following: What is 179D, How is it Calculate, What is the Process for Taking a client through a 179D Study, How do Design Firms Qualify, How do Contractors Qualify, Changes to 179D from the IRA (Inflation Reduction Act). Here is a detailed explanation of Section 179D Energy Efficient Tax Deduction. The Section 179D tax deduction is a compelling federal tax incentive for companies designing and constructing energy-efficient systems in commercial buildings. Specifically, Section 179D is eligible for work performed on three systems; interior lighting, HVAC (heating, cooling, and ventilation), hot water, and building envelope. For properties placed into service in 2022 and prior, a tax deduction of up to $1.80 per square foot is available for installing these systems, which results in 50% or greater energy savings compared to a baseline standard. There is eligibility to claim a $0.60 per square foot deduction for upgrades that result in less energy savings. Properties placed into service in 2021 or 2022 are adjusted for inflation, resulting in a higher deduction rate. Thanks to the Inflation Reduction Act of 2022, properties placed into service in 2023 or later can now achieve a tax deduction of up to $5 per square foot for achieving 50% or greater energy savings. There is eligibility to claim a $2.50 per square foot deduction for upgrades that result in a 25% energy savings, with an additional $0.10 per square foot for every 1% increase in savings. Qualifying Projects. New construction, renovations, and additions to commercial or high-rise residential buildings most often qualify. At the time of construction or as part of an upgrade process, energy-efficient building systems must be installed that reduce the property's energy profile compared to a baseline standard. The energy reduction requirement varies based on the energy-efficient system installed in the project. The baseline standard (ASHRAE 90.1) measures the energy savings changes depending on the year the project was completed. Who Qualifies? Many companies can qualify to claim the Section 179D deduction. In addition to commercial building owners, other companies such as architects, engineers, general contractors, construction managers, energy service providers, and specialty contractors (mechanical, electrical, glazing, etc.) may qualify for their work on buildings owned by government and non-profit entities. In other words, the powerful savings potential is also available to those involved in the design and construction industry. This video is eligible for PDH credits in most states. The following is an audio recording of a post that originally appeared on the Last Word Blog at www.acec.org. ACEC recently held a webinar on the prohibition against TikTok on any device used to execute federal government contracts. Led by Holland & Knight attorney Jeremy Burkhart – a leading expert on government contracts – the session focused on the legal implications of the ban and what firms may or may not legally do to enforce it. The rule applies to the presence or use of any covered application on any information technology owned or managed by a contractor, including equipment provided by the contractor's employees, unless an exception is granted. Burkhart began his presentation with the backstory of TikTok: what it is, how it came to be, and why it has been the cause of such widespread agita among governments across the globe. He joked that those concerns are well beyond the obvious, namely wasting your time or socially stunting your kids. Instead, he continued, the overriding concerns are twofold: spying and propaganda by the Chinese government. “The spying to me is the larger concern,” Burkhart said. “It's not just a hypothetical. It's a very real issue.” He pointed to an incident in which ByteDance, the Chinese company that owns TikTok, tracked three journalists who had previously exposed its links to the Chinese government and who had revealed that the company's employees had repeatedly accessed American user data. ByteDance tracked these reporters' IP addresses and user data to determine if they had been in the same locations as its employees in an effort to determine the source of the leaks. This, Burkhart concluded, was not a rogue operation. Rather, it was sanctioned at the company's highest levels. ByteDance is currently under investigation by both the FBI and the DOJ. In December 2022, Congress passed – and President Biden signed – the No TikTok on Government Devices Act, which prohibits the use of the app on government devices. The law passed unanimously, with broad support on both sides of the aisle – a notable moment of agreement in deeply polarized Washington. The law requires the government to “develop standards and guidelines for executive agencies requiring the removal of any covered application.” There have also been moves toward a more sweeping and outright ban on TikTok (which some countries and states have done) but the broad nature of the language stymied its passage. Momentum for such an outright ban has now slowed, and it's unclear whether any legislation addressing TikTok will pass Congress. Which leaves unsettled questions for firms with government contracts on how to enforce the ban, particularly on the personal devices of employees. Burkhart was asked about personal devices not issued by the company but used by employees to access company email and collaboration tools like Teams. Would such devices be included within the ban? And is that legal? For firms, Burkhart said, the thornier question is not an outright ban so much as how to enforce compliance. “At the end of the day, there's considerations that the company has to go through,” he said. “Either way there is some level of risk. [Firms] have to weigh all those risks.” And in weighing those risks, it's important that firms also take into account things like their own corporate culture and demographics. What size is your workforce, and are employees of a demographic that will even care about not using TikTok? How much does the company prioritize employee expression and separation of work and personal lives? And, if a company does opt against banning its employees from TikTok, is the company prepared for the potential fallout if there is a move for more expansive enforcement? Burkhart concluded his presentation with a technical tutorial on what companies can do to mitigate the risks of TikTok for both the firm and its employees. A Killarney father says the saga his family faced around lobbying for fixed track ceiling hoists, demonstrates the bureaucracy involved. Steve O’Mahony was reacting to confirmation that fixed track hoists will be included in Housing Adaption Grants for Older People and People with a Disability Schemes.Minister for Education Norma Foley confirmed €83 million government funding in the scheme, will now cover the cost of installing the hoists. Mr O’Mahony’s seven-year-old daughter, Alexis, has a PDH deficiency, a rare metabolic condition which causes brain abnormalities.

There is eligibility to claim a $2.50 per square foot deduction for upgrades that result in a 25% energy savings, with an additional $0.10 per square foot for every 1% increase in savings. New construction, renovations, and additions to commercial or high-rise residential buildings most often qualify. At the time of construction or as part of an upgrade process, energy-efficient building systems must be installed that reduce the property's energy profile compared to a baseline standard. The energy reduction requirement varies based on the energy-efficient system installed in the project. The baseline standard (ASHRAE 90.1) measures the energy savings changes depending on the year the project was completed. Many companies can qualify to claim the Section 179D deduction. In addition to commercial building owners, other companies such as architects, engineers, general contractors, construction managers, energy service providers, and specialty contractors (mechanical, electrical, glazing, etc.) may qualify for their work on buildings owned by government and non-profit entities. In other words, the powerful savings potential is also available to those involved in the design and construction industry. This video is eligible for PDH credits in NC, SC, GA, and FL.

Every six years, the Department of Energy (DOE) reanalyzes the effects of energy usage, sets minimum efficiency requirements, and manages the testing standards by which those efficiencies are measured. In 2018 the DOE started the first phase of its six-year plan requiring a 13% increase in energy efficiency for commercially packaged air conditioners, heat pumps, and split systems. The second phase of this plan will start in 2023. The DOE has also reanalyzed and adjusted the minimum efficiencies of single-phase air conditioners and heat pumps, 5 tons or less. KEY DIFFERENCE: Single-phase and residential products must also comply with a new testing procedure for developing efficiency ratings. Compared to today's test procedure, the external static pressure used when testing will be increased by up to 5X, which will more closely represent actual field conditions. Since the new testing requirements are more stringent and reduce the resulting efficiency rating, there will be new metrics and nomenclature — SEER2, EER2, and HSPF2. On the same system, compared to SEER ratings, the new SEER2 ratings will be lower, and the minimum efficiencies will be reduced to account for the more demanding test procedure required for 2023 products. All “RESIDENTIAL” air conditioners AND Heat Pumps must comply with the Department of Energy's minimum efficiency standard requirements on January 1st, 2023. The testing requirements will be more stringent but also more accurate, and the metrics will be referred to as SEER2, HSPF2, and EER2. These testing procedure changes ONLY apply for single-phase equipment less than or equal to 65,000 Btuh. AHRI 210/240-2023 (2020), first published in May 2020, establishes a method to rate residential central air conditioners and heat pumps consistent with the new DOE test procedure. The energy efficiency metrics, expressed in terms of Seasonal Energy Efficiency Ratio (SEER2), Energy Efficiency Ratio (EER2), and Heating Seasonal Performance Factor (HSPF2), are required for representations coincident with the compliance date of the new efficiency standards in the United States starting on January 1, 2023. The primary changes in this edition of AHRI 210/240 are those required to align with the new performance metrics and requirements of Appendix M1 of 10 CFR 430 (Code of Federal Regulations), as issued by the U.S. Department of Energy (82 FR 1426, January 2017). A working group of many stakeholders (including but not limited to AHRI members, independent laboratories, energy advocates, and DOE consultants) met periodically over the course of two years to evaluate necessary changes and improvements in language. Because compliance with the Appendix M1 test procedure and ratings are not mandatory until January 1, 2023, AHRI has chosen “2023” as the year version of this standard.
