In the Gonzalez and Taamneh opinions, the Supreme Court dodged any detailed consideration of Section 230 or the role of recommendation algorithms in enabling access to online speech, but we can expect that those topics will be back before the Court before long. So, let's dive into this discussion and keep advocating for the preservation of free speech in the online world. The Center for Democracy & Technology – along with six other technologists with expertise in online recommendation systems – filed an amicus brief in the case of Gonzalez v. Google. The brief urges the U.S. Supreme Court to hold that Section 230's liability shield applies to claims against interactive computer service providers based on their recommendation of third-party content, because those claims treat providers as publishers. On this day, June 20th, in legal history, Lizzie Borden was found not guilty of the murders of her stepmother and father.Lizzie Borden, born in 1860, stood trial for the murders of her stepmother and father in 1892. Although she was acquitted, she remains infamous for the crimes. The murders took place in Fall River, Massachusetts, on August 4, 1892, with Lizzie's father found on the living room couch and her stepmother in an upstairs bedroom. Both victims had been struck in the head with a hatchet. Lizzie claimed to have discovered her father's body shortly after he returned home, while the maid found the stepmother's body.Lizzie had a strained relationship with her stepmother and had conflicts with her father over property division and the killing of her pigeons. Prior to the murders, the entire family fell ill, leading Mrs. Borden to suspect foul play. However, it was later determined that they had contracted food poisoning. Lizzie was arrested on August 11, 1892, indicted by a grand jury, and her trial began in June 1893. The hatchet used in the murders was found but lacked evidence, and the police mishandled the collection of fingerprint evidence.During the investigation, no blood-stained clothing was discovered, but it was reported that Lizzie burned a blue dress that had been stained with paint. Due to a lack of evidence and certain testimonies being excluded, Lizzie Borden was acquitted on June 20, 1863. After the trial, Lizzie and her sister Emma lived together but eventually grew apart. Lizzie spent her last years unwell and her death went largely unnoticed. Speculation and theories abound regarding Lizzie's guilt, ranging from the maid committing the murders to Lizzie experiencing fugue state seizures. She is probably best remember by folks of a certain age for her prominent place in a rope-skipping rhyme that referenced the murders, which I won't repeat here. A federal court in Louisiana has rejected Tesla's complaint against the state's ban on direct car sales. Tesla had filed a lawsuit arguing that the restriction on selling vehicles directly to consumers was protectionist and anticompetitive. However, the court ruled that the ban applied to all manufacturers equally, and Tesla failed to demonstrate any bias against the company by the Louisiana Legislature. This decision is part of Tesla's broader efforts to challenge direct sales bans in various states as it seeks to sell vehicles online or through its own stores instead of traditional dealerships.Last week Florida Governor Ron DeSantis signed a similar bill that, there, excepted electric powered vehicles – which amounted to an exception for Tesla. The Florida legislation requires car manufacturers to rely on franchised dealerships for sales, but allows companies that already sell directly to customers, such as Tesla, to continue doing so. The company seeks monetary damages and an order to block Hu's alleged misconduct.Fake reviews and the mills that generate them are an ongoing problem for online retailers. Amazon has filed legal complaints in Italy and Spain as part of its own global efforts to combat fake review brokers. Amazon is targeting individuals and operators involved in selling or facilitating fake reviews on its platform. In Italy, Amazon is pursuing a high-profile broker who allegedly built a network of individuals to post fake five-star reviews in exchange for a full refund, while in Spain, the company filed a civil complaint against AgenciaReviews for reimbursing customers in exchange for fake reviews. Amazon's actions in Europe are in addition to the increasing number of lawsuits filed in the United States.New Google lawsuit aims to curb fake business reviews | ReutersAmazon files legal complaints in Italy, Spain against fake review brokers | ReutersThe European Commission has put forward a proposal to simplify tax rules in order to prevent double taxation and address the fraudulent practices that led to the Cum-Ex and Cum-Cum tax scandals. The plan aims to streamline withholding tax procedures for cross-border investors, banks, and tax administrations, focusing on interest and dividend payments. The goal is to combat the complex structures used to avoid dividend taxes and seek multiple tax rebates, which have resulted in an estimated €150 billion in losses over the past two decades. The proposal also aims to simplify and expedite the process for taxpayers to receive refunds for excess taxes paid in other EU member states, with the introduction of a digital tax residence certificate and standardized refund procedures. The implementation of these measures is estimated to save investors approximately €5.2 billion annually. The proposal requires unanimous approval from member states and is expected to take effect on January 1, 2027.I have written about the cum-ex fraud in Europe in the past. The fraud, a financial scam for a time exceedingly prevalent in the EU, exploits an information-delay problem in tax authorities. The fraud involves selling shares of a company with dividend rights but delivering them without dividend rights, resulting in multiple rebate claims for a single withholding tax payment. The scheme takes advantage of the gap in ownership information during the dividend payout period. Variations of the fraud exist in different countries, such as Germany and Denmark. Potential solutions to prevent such fraud include utilizing blockchain technology or implementing a shared database among all parties involved to provide real-time ownership information and ensure accurate withholding tax rebates. The solution should incorporate measures to synchronize clearing periods and incentivize parties to verify transaction details–we'll see what the EU has up its sleeve when more details are announced. EU Aims to Streamline Tax Rules After Cum-Ex, Cum-Cum ScandalsCum-Ex Frauds—An Information-Delay ProblemNew Jersey is considering a tax bill, S3737, that would expand the permitted exclusion for the global intangible low-taxed income (GILTI) structure from 50% to 95%. The GILTI regime is a tax provision that targets profits earned by US multinational corporations from intangible assets, like patents and other intellectual property, held in low-tax jurisdictions; it is intended to curb the offshoring of highly-mobile intangible assets.This move goes against President Joe Biden's proposed budget, which aims to expand the GILTI regime and reduce exemptions. The justification for the bill is to align New Jersey's tax regime with neighboring states, New York and Connecticut, but this ignores the purpose of GILTI, which is to target assets easily moved to low-tax jurisdictions. Instead of gutting the GILTI regime, New Jersey should consider expanding it to include both tangible and intangible assets. By focusing on income from intangible assets, GILTI approximates the percentage of profits derived from them, but including tangible assets would create a more sensible proposal. Engaging in tax races to the bottom with neighboring states only benefits multinational corporations, while New Jersey could increase revenue by closing loopholes that allow profit shifting to low-tax jurisdictions. The bill also proposes changes to allocation factors for corporate filers and the adoption of the economic nexus threshold established under South Dakota v. Wayfair. However, these proposals are unrelated to the issues surrounding the GILTI regime. Expanding GILTI to include income from tangible assets would create a more effective and fair system and help onshore assets that would otherwise be lost to low-tax jurisdictions. The Biden administration's plan to reduce emissions from the transportation sector through tailpipe emission rules will face industry litigation, but environmental lawyers believe the rule will hold up during inevitable challenges. The proposed standards, revealed by the Environmental Protection Agency, were called the most aggressive ever for cars and trucks. Challengers are likely to argue that the rule is too transformative, but advocates will contend, rightly, it is rooted in tried-and-true Clean Air Act authority. The standards would put electric vehicles at 67% of new light-duty vehicle sales in 2032, and set light-duty vehicle efficiency at 82 grams per mile in model year 2032, a 56% bump from 2026 levels. Industry groups are already opposed to the proposal, with American Petroleum Institute President Mike Sommers stating that the "deeply flawed proposal is a major step toward a ban on the vehicles Americans rely on". Some states are already using the major questions doctrine, which we covered in a previous Max Min Comp, in a lawsuit against an earlier round of vehicle rules, and West Virginia Attorney General Patrick Morrisey has hinted at a lawsuit. Despite the threat of litigation, advocates of the standards believe the rule is on solid legal ground, with Earthjustice Senior Climate Attorney Hana Vizcarra stating that the agency is "improving the standards as they go in light of what's happening in the marketplace".Biden Tailpipe Emission Rules Face ‘Major Questions' Legal WaveThe increasing use of "deepfakes" technology, which allows users to digitally blend or swap faces and voices, has raised legal questions about exploiting someone's image and voice without permission. Those unwillingly featured in deepfakes and other AI-manipulated content can use right of publicity laws as a legal remedy, but these laws vary from state to state. Generally speaking, right of publicity laws protect an individual's right to control the commercial use of their name, image, likeness, or other recognizable aspects of their persona. The contours of these laws vary by jurisdiction, but generally give individuals the exclusive right to use their name or image for commercial purposes, such as in advertisements or merchandise. In some cases, these laws may also protect against unauthorized use of a person's identity for non-commercial purposes, such as in a work of fiction or in news reporting. Right of publicity laws can be controversial, as they can clash with other forms of free expression, such as the First Amendment right to free speech.Although California and New York provide clear statutory guidelines for right of publicity, other states have less defined bodies of law. The mesh of statutory regimes could create a patchwork of decisions as generative AI applications continue their rise, and litigation mounts. The lawsuit against Reface, which was created by the Ukrainian company NeoCortext Inc., was brought by Kyland Young, a finalist on the reality competition show “Big Brother.” The First Amendment is a prominent legal defense against publicity rights lawsuits, especially in cases where the underlying product or service is protected by free speech, like comic books or documentaries. Other federal statutes may also be shields against the lawsuits, such as Section 230, which immunizes online platforms from liability over user-created content. This is clearly a burgeoning area of litigation, with new AI models rolling out on a seemingly daily basis.AI Celebrity ‘Deepfakes' Clash With Web of State Publicity LawsA San Francisco federal judge ruled on Thursday that Google must face a trial in a patent lawsuit brought by Sonos Inc over wireless audio technology. The judge failed to invalidate all of the patents before a trial but did narrow Sonos' claims. The case is part of a contentious intellectual property dispute between the former business partners over their smart speakers, including lawsuits in the United States, Canada, France, Germany, and the Netherlands. Sonos won a limited import ban on some Google devices from the US International Trade Commission (ITC) last year, while Google has sued Sonos for patent infringement at the ITC and in California. Google must face trial over Sonos patents, California judge says | ReutersJack Teixeira, a 21-year-old member of the US Air Force National Guard, has been arrested by the FBI for allegedly leaking classified military intelligence records online. He will appear before a federal judge in Boston on Friday. Anyone convicted of willfully transmitting national defense information can face up to 10 years in prison, with the possibility of a longer sentence depending on the charges. The Pentagon said that the leak was a "deliberate, criminal act" and that the military had taken steps to review distribution lists and ensure people receiving information had a need to know. The number of documents leaked is likely to be in the hundreds. Man suspected of leaking secret US documents to appear in court | ReutersA federal appeals court in Philadelphia questioned whether a free speech advocate and Pennsylvania attorney can pursue his First Amendment challenge against the state's adoption of an anti-harassment and discrimination professional rule for lawyers. The Pennsylvania rule prohibits lawyers from knowingly engaging in conduct constituting harassment or discrimination based on race, sex, religion, and other grounds. Plaintiff Zachary Greenberg claims he is at risk of violating the rule because of presentations he gives about offensive and derogatory language. However, the Pennsylvania Supreme Court's Office of Disciplinary Counsel has said it would not prosecute such conduct. U.S. District Judge Chad Kenney blocked the rule in March 2022, finding it to be overbroad and in conflict with the First Amendment. In the sixth episode of S&C's Supreme Court Business Review series, hosts Judd Littleton and Julia Malkina are joined by Dustin Guzior, co-head of S&C's Intellectual Property & Technology Litigation practice, to discuss three intellectual property cases that the Supreme Court decided last Term and key takeaways for businesses. In United States v. Arthrex, the Supreme Court sidestepped an issue that had the potential to affect significantly patent litigation: whether the Patent Trial and Appeal Board's administrative patent judges must be appointed by the President with approval of the Senate. The Court instead held that PTAB's structure violated the Appointment Clause of the Constitution because the director of the U.S. Patent and Trademark Office did not have sufficient power to review the PTAB's decisions. In Minerva Surgical v. Hologic, the Court narrowed the scope of “assignor estoppel,” which precludes the assignor of a patent from later challenging the patent's validity, by holding that assignor estoppel does not extend to circumstances that did not exist at the time of the assignment. Lastly, in Google v. Oracle, the Court held that Google's copying of some of Oracle's application program interface code for Java was fair use. Because the Court assumed without deciding that such code can be copyrighted in the first place, it left that important question for another day.

Graif dive into the Court's decision regarding Google's copying of 11,500 lines of “declaring” code from Oracle's Java API. Their informative discussion covers a number of pertinent questions: - Software is expressly protected under the Copyright Act insofar as it is a set of instructions that directly or indirectly bring about a certain result. So how is it okay for Google to copy this code? - The Supreme Court decided that Google's copying was fair use without addressing copyrightability. Last week the Supreme Court of the United States made a decision in the case known as Google LLC v. Oracle America, Inc. The case centers on whether the use of certain Java technology in Android infringed on Oracle's copyright. In particular, it's concerned with whether Google's reimplementation of Java is legitimate in copying much of the Java standard library's APIs. The legal battle between these tech giants actually began in 2010. For 11 years, the battle has raged back in forth in lower courts over billions of dollars of potential damages. The case also has far-reaching implications for the software industry. Is it "fair use" to reimplement a copyrighted API? If it's not, many software products would be in violation. Google copied over 11,000 lines of computer code, called declaring code, owned by Oracle. Ten years after Oracle filed suit, the Supreme Court will hear the oral argument on October 7, 2020. Google says the code is purely functional, is uncopyrightable because there’s only one way to write it, and in any case their copying was fair use. Oracle, backed by the Solicitor General, says its code is creative expression that falls squarely into what Congress intended to protect and that Google’s copying was non-transformative infringement. This landmark case, involving Google’s digitization project of scanning 20-million books to make them searchable through the Internet, was decided in favor of Google. “In my mind, this is a fair-use case that we will never see again,” Andrew Albanese, senior writer for Publisher’s Weekly, said, declaring the case a benchmark for future decisions. It was ruled that Google met the requirements of fair use and all four factors in defense of copyright infringement.
