20th February 2025Dr. Lex Takkenberg will spell out the basic facts about the Agency's mandate, history and work on behalf of Palestinian refugees. A Dutch National, he is Senior Advisor on the Question of Palestine at ARDD, Arab Renaissance for Democracy and Development, in Amman. From 1989 until 2019, he worked in various field and headquarters positions with UNRWA, the UN agency for Palestinian refugees, most recently at its Amman headquarters as the agency's first Chief Ethics Officer. He was previously UNRWA's General Counsel, Director of Operations, and (Deputy) Field Director in Gaza and Syria. Before joining UNRWA, he was the Legal Officer of the Dutch Refugee Council, from 1983 until 1989. A law graduate from the University of Amsterdam, where he also worked as an Academic Assistant from 1987-1989, he obtained a Doctorate in International Law from the University of Nijmegen, the Netherlands, in 1997 after having successfully defended his doctoral dissertation entitled The Status of Palestinian Refugees in International Law. Oxford University Press (OUP) published a commercial edition of the dissertation in 1998; an integral Arabic translation was published by the Institute for Palestine Studies in 2003. A new version of the book – co-authored with Francesca Albanese – was published, also with OUP, in 2020.

The new Hate Speech Law could see critics of government policy on social media prosecuted and jailed - if their criticism is deemed to cause emotional or psychological harm to government officials or supporters. This is the warning from Ismail Joosub, the Legal Officer of Constitutional Programmes at The FW De Klerk Foundation, and a candidate MP for ActionSA. “The threat of imprisonment that the Act brings with it for expressing what it deems harmful speech will certainly deter individuals from speaking out about wrongdoing, undermining efforts to combat corruption and protect democratic values.” He says numerous rights in the Constitution - including the right to freedom of speech - are being “significantly violated” by the new law. It is now going to take a direct Constitutional Court challenge to get “this unconstitutional law to be struck down”.

New podcast episode examines effect of controversial media takeover on pluralism and citizen's access to independent journalism Under Poland's ruling Law and Justice (PiS) party, which is seeking a third term in government, press freedom in the country has deteriorated over the last decade. While the media landscape remains vibrant and pluralistic overall, independent media critical of the ruling party have faced regulatory, financial and legal pressure. As the parliamentary election on 15 October 2023 looms, there are major concerns about the increased control that Law and Justice wields, both directly and indirectly, over regional and local media, and what this means for editorial freedoms of journalists working there. In this episode of the MFRR In Focus, we examine how the takeover of regional media network Polska Press by the country's state-controlled oil giant PKN Orlen in late 2020 maps onto previous capture of media by the government and its allies, and more broadly, what the implications of this control over local journalism are in an election in which rural voters in particular will be crucial for electoral success. In conversation with Bokang Lethunya- Khutlang and Ompha Tshamano In 2022, the Centre for Human Rights, University of Pretoria undertook a research and advocacy project that sought to assess the status of digital rights in Southern Africa. As part of the research component, a report titled The Digital Rights Landscape in Southern Africa. The report came into being after the COVID-19 pandemic exposed the digital gaps and inequalities in Southern Africa. On this episode, Africa Rights Talk together with Ms. Bokang Lethunya-Khutlang and Mr Ompha Tshamano, discusses the digital rights landscape in Southern Africa with a specific focus on the status of digital rights in Lesotho. The discussion was premised on the challenges that vulnerable communities, namely women, children and people living with disabilities face in realising digital rights in Lesotho. In line with the mandates that States ought to adopt as recommended in the Declaration of Principles on Freedom of Expression and Access to Information in Africa, the discussants reflected on the measures that have been adopted through the Ministry of Justice in Lesotho to ensure that human rights are protected online and offline. In this conversation, Ms Lethunya-Khutlang acknowledged the impact that race, class and gender has on people realising digital rights in Lesotho and subsequently the challenges and stifled opportunities that people face when it comes to accessing digital services and technologies in Lesotho. In conclusion, Ms Lethunya-Khutlang emphasised on the importance of individual and communal efforts in order to ensure a healthy digital life. Ms. Bokang Lethunya-Khutlang works as a Legal Officer in the Human Rights Unit under the Ministry of Justice and Law, having joined the Unit in June 2008. Her duties entail dissemination of human rights to the public through various media spots; receiving complaints on human rights violations for referral to where they could best be resolved; compilation of human rights state party reports. In a nutshell, her duties are on promotion, protection and monitoring of human rights in Lesotho. Since joining the Unit, Ms. Lethunya-Khutlang has benefitted from several trainings by the OHCHR, UNAIDS, University of Pretoria amongst others. She serves as a coordinator and secretariat of all human rights state party reports and thus has played a key role in compilation of several state party reports both to the UN treaty bodies and the African commission. These include CEDAW, CMW, ICCPR, UPR, ACHPR and Maputo Protocol. Prior to joining the Unit, Ms. Lethunya-Khutlang worked as a Magistrate from 2004 - 2008. She has also served as a Board Director (2015 – 2018) for the Lesotho Communication Authority which is a regulator for the communications sector in Lesotho. Mr Ompha Tshamano is an LLM Candidate at the University of Pretoria and a project assistant at the Expression, Information and Digital Rights Unit at the Centre for Human Rights, University of Pretoria. In 2018, Kazakhstan arrested a group of men for participating in a WhatsApp group chat about Islam and sentenced them to multiple years in prison on fictitious terrorism and incitement-related charges. Last fall, the UN Working Group issued an opinion that their detention was arbitrary and that they should be released. Although the government of Kazakhstan has released a few individuals related to this case, five men still remain imprisoned.Kazakhstan has regularly engaged with the U.S. government about possible religious freedom reforms, but it continues to severely limit this right through its 2011 religion law. In 1975 Paddy Hill was one of six innocent men wrongly convicted of the Birmingham pub bombings which killed 21 people and injured 182. Upon his release in 1991 he promised to help those he had left behind and in 2001 he set up MOJO to give a voice to the innocent. In this episode, I talk to Euan (MOJO's Legal Officer) about the work the charity does to try and help people who have been wrongly convicted; the short and long term challenges their clients face as a result of being a victim of a miscarriage of justice; and he gives us a real insight into the key aspects of the Scottish Legal System – including the controversial ‘not proven' verdict and a jury system which means people can be convicted by a simple majority of 8-7. I also talk to two of the students who have been working with MOJO, about how they want to ensure that we learn from the past to prevent innocent people from being convicted in the future.
