Acknowledgement of Country//News headlines//We listened to a recording of discussions outside of the Federal court following the hearing on Monday 11 Novermber 2024 that was brought forward by Robbie Thorpe to have attorney general Mark Dreyfus added as a defendant to the question: Is our fire at camp sovereignty protected by Australia's constitution? The recording is of speeches by Uncle Robbie and lawyer Len Linden given after the court proceedings in which the judge acted in a gate-keeping role as Uncle Robbie attempts to expose the system for having no jurisdiction whatsoever. Shedding light on these historical cases is key, especiallly because there is a push to silence them. Find out more at Crime-scene Australia Website where you can find details of the cases and recordings of the speeches. The next case hearing is on Tuesday 10th December at 9.30 am at the Magistrates Court, 233 William Street, Room 4. Come along and bear witness. We listened to the first part of a talk delivered by Santiago-based Historian, Journalist, and Marxist Thinker, Vijay Prashad titled 'National Liberation Marxism & Western Marxism' , on November 1st as part of his Australian tour in collaboration with the Red Ant Collective, an anti-imperialist collective based in Naarm. The talk highlights the ways in which 'western marxism' has traditionally differed from the Marxism of the Global South (which goes widely unstudied in the west) and the importance of formulating revolutionary praxis based in theory and action with lessons from actual revolutions which have occured in the Global South. You can find all of Vijay's tour recordings on the Red Ant Website, and you can follow the work of the Tricontinental Research Institute here.We spoke in studio to Mariota from the Refugee Action Collective. She spoke to us about the work RAC are doing in the ongoing campaign for refugee rights in Australia including what's next now that the Naarm encampment at the Department of Home Affairs has wrapped up after 100 consecutive days of 24/7 protest. Mariota spoek to us about Labour's Deportation - the latest in a series of punitive measures targeting the small group of people released from indefinite detention since November 2023. The new measures seek to drastically expand the Government's powers, allowing it to warehouse people in third countries, reverse protection findings made for refugees, and continue to impose punitive visa conditions on those who remain. Write to your representatives to oppose this bill, and come along to the next Refugee rights rally on International Human Rights Day Tuesday 10 December at 6 pm outside the state library. After coercing farmers to plant marijuana crops in their fields, organised crime figures laid the seed for a dominant and violent drug empire across the Victorian borders. But, when police raided the farms, it was the growers who faced the consequences, as mob members threatened them and their families to stay quiet. Former Victoria Police detective Ray Shuey was at the pointy end of that investigation, and sits down with host Brent Sanders to explain how he helped organise the 50kg drug buy that busted the crooks, and the complexities of protecting the growers whilst pursuing the mafia. International Women's Day isn't country or organisation specific. It's a day of collective global activism and celebration that belongs to all those committed to forging women's equality. In recent years the narrative around international women's day has changed though, with some arguing that it's become ‘corporatised' and ‘performative' as to lose all meaning. Which is why in this week's episode of the Public Sector Podcast we've chosen to focus on the tangible – the strategies and transformations doing their part to drive action and change for women in the workforce. Isabeau Korpel, Melissa Martino and Sue-Ann Charlton discuss strategies to breakdown class ceilings and accelerate womens' opportunities in the workplace in a special edition of the Public Sector Podcast. It is no surprise to me that Cathy was stalked because her former partner had all the hallmarks of a stalker - he was possessive, angry, violent, intimidating, humiliating, controlling, threatening and abusive on so many levels. Cathy stayed with this man out of a genuine fear he would carry out the threats he would continually make, not only to Cathy but her family and friends also. She began to slide into a world of hopelessness and helplessness, and when she finally found the courage to go to the authorities, no reports were taken, no referrals given, just advice to go the Magistrates Court and speak to the Registrar. Instead of curling up into a ball & becoming disenchanted and detached from the world she was living in, Cathy began on a path of redemption, using her experiences as a victim of numerous serious crimes, to help others not experience what she has. SBF at SDNY Triggers Crypto Cooperator Qs As Ex Ellison Pleads Out Amid Bahamas Flight By Matthew Russell Lee, Patreon Maxwell book NY Mag LITERARY SDNY, Dec 21 – In the week after the SDNY press conference about Sam Bankman-Fried, in the courthouse and its Press Room the tension built. Court artists came, since photography is prohibited in the courthouse. Reporters staked out the courtroom of District Judge Ronnie Abrams, to whom the case had been assigned, and the small Magistrates Court where on most days Kurt Wheelock was the only member of the media, or even member of the public. It was all different now. "Crypto Man" was coming, as one non-techie reporter put it. Kurt tried to get ready. Since one of Kurt's beats before he came to the courthouse was banking, or anti-banking more precisely, he submitted Freedom of Information requests to the agencies which had allowed FTX / Alameda to buy a stake in Farmington State Bank (subsequently renamed Moonstone Bank), and put customers' money into Silvergate Bank. And then, as always, a break in the case. As Kurt Wheelock tried to re-index his website while uploading stories about the day's more obscure criminal cases, including a woman from Columbia seeking asylum after her husband was murdered - and, yes, selling fentanyl - two plea agreements and a video came in, from the prosecutors. Caroline Ellison and Gary Wang had pleaded guilty, it said, with the agreements signed on December 19. Apparently they withheld them until SBF was in the air and couldn't turn back. Or could he? Also, a recorded video from US Attorney Damian Williams, that SBF "will be transported directly to the Southern District of New York." That seemed to preclude an overnight in Essex County Correctional Facility in New Jersey, or the MDC in Brooklyn - in the EDNY. So was SBF in the same courthouse where Kurt sat typing, and shaking his fist at censorship, and looking out the window at Chinatown below? It emerged overnight that SBF had been flown into the Westchester airport in White Plains - yes, in the SDNY - and would from there be taken to the courthouse in the morning. And so Kurt headed there....more on Patreon here 1 and here 2 *** Your support means a lot. A lawyer says motorists caught breaking variable speed limits on some stretches of motorway may be able to get their conviction overturned. Prosecutors believed the signs did not comply with traffic regulations - and had the status of advisory rather than mandatory signs. Motoring solicitor Marcus Johnstone said drivers stood a 'favourable' chance of getting their cases reviewed in the Magistrates Court. The variable speed signs were introduced since 2006 - and have resulted in thousands of convictions.
Miscarriages of justice are happening in the Magistrates Court system because of a drive to reduce delays, say defence lawyers. They say some cases are being dismissed because prosecutors and the police haven't been able to file the necessary papers in time - in other cases, defendants are coming under undue pressure to plead guilty. Also - the fight to control the trade in smuggled cigarettes and tobacco. And... the £2.5 million being spent to boost the number of immigration officers on duty during the London Olympics. Some of the money will be used to re-hire staffs who've taken early retirement or voluntary severance.
Justice John Doyle proposes to explain why he believes that, during the time of the next generation of legal practitioners, those now being admitted to practice, civil litigation as we know it in the higher courts will come to an end. It might survive in the Magistrates Court. Criminal litigation in the higher courts will continue, although the factors that will cause the demise of civil litigation will cause substantial changes in the conduct of criminal litigation. This probably sounds like a gloomy prognostication of the kind to which judicial officers become prone as they approach retirement. He has heard and read many judicial retirement speeches. A common genre in retirement speeches involves reflecting on a golden age early in the judicial officer’s legal career, a golden age when all was well with the profession and with the administration of justice. This is followed by a catalogue of regrets about things as they are at the time of the judicial officer’s retirement, followed by a call to those who remain to ensure that things do not get worse. The regrets about how things are come from a familiar catalogue. The catalogue includes cases take too long; the law has become too complicated; solicitors and advocates fail to focus on the real issues; the public and the media no longer respect the judicial office; the practice of the law has become a business, instead of a profession; the cursed photocopier; litigation is buried in snow drifts of paper; recent graduates in law are all theory and nothing practical, and so on. The tendency of such speeches is toward a conclusion that the administration of justice is on a downhill slope. There is usually a call to the judiciary to re-assert itself, and to maintain standards
