David Trevaskis, Director, and Bill Baldwin, Deputy Director of the Pro Bono Service for the Pennsylvania Bar Association, discussed membership in the bar, its privileges and responsibilities, in particular rule 6.1, directing attorneys to act in the public good. Dave spoke of your right to representation in criminal cases and in family law such as parental termination hearings, and the low bar of income that can preclude you from free services. We discussed civil issues, landlord/tenant disputes, bankruptcy, divorce, where an attorney can save you time and money, yet most are unable to afford legal help. They spoke of research projects showing that a 3-million-dollar investment in legal services for Philadelphia housing disputes could save the city 53 million dollars in other services, including eviction costs, social services, re-housing and more. In the case of divorce, lack of representation can add a year to the process, adding costs to both parties. The offered resources for people in need of representation, beginning with PALawHelp.org, an online way to see if you qualify for free services, they also discussed pa.freelegalanswers.org, an interactive resource that connects you with attorneys to answer your legal questions. For residents of New Jersey and Delaware, there s a referral tab. Bill also recommends your search for help can begin with your local county bar, most offer low or no cost services. The Supreme Court of Florida recently issued an opinion about professionalism standards and stated, "The revised Professionalism Expectations that we adopt today emphasize that Florida's professionalism standards apply to all forms of communication, including online communication, and to both in-person and remote (video or audio) interactions with others." Zach Greenberg of FIRE (The Foundation for Individual Rights and Expression) joined me to discuss the opinion and whether the revisions presents First Amendment issues. Zach is also the plaintiff in Greenberg v. Haggerty, a First Amendment challenge to a Pennsylvania Bar Association's rule that restricts the free speech rights of Pennsylvania lawyers. If you're a family law attorney, you may not realize you are applying principles of constitutional law all the time. I speak with family law attorney Elizabeth Billies and constitutional law Professor Randy Lee about just that, as they prepare for their panel at the PBA Family Law Section Meeting in Hershey over the January 13th weekend, where they will examine the recent Dobbs decision and other family law/constitutional law crossover issues. Randy Lee teaches constitutional law, professional responsibility, torts and various writing and advocacy courses. Professor Lee has taught previously at the Villanova and University of Pittsburgh Law Schools and in the Harvard University Summer Program. Mark Ashton has been a presence in the family law for decades and brings his analysis to the Seagraves case: a PFA that resulted in an indirect criminal contempt sentence of over 10 years. On July 3, 2012, William Waite, a U.S. Army veteran and retired president of an architectural products company with vision in only his left eye, tripped and fell face-first over a single step in the sidewalk at a shopping center owned by Argento Family Partnership. After the fall, William was immediately blinded in his one good eye and has been unable to see ever since, despite undergoing four surgeries, including a corneal transplant. Despite the fact that the primary defendant John Argento is an award-winning civil defense litigator, trial lawyer Craig Milsten secured justice on his client's behalf, citing experts and pointing out to the jury how much money John Argento was willing to spend on legal fees, but not the nominal fee it would have cost to paint the step a different color or to display a warning sign for customers. In March 2017, a York County, Pennsylvania jury found Argento Family Partnership negligent after less than an hour of deliberations and awarded $4,035,329.11 in damages to William in one of the largest personal injury verdicts in York County history. Steve, a Brooklyn, NY native turned Central Pennsylvanian, shared his legal journey beginning from his first days at Widener to his well-established career in Workers’ Compensation Law. Steve Ryan is an associate with Martin Law LLC who practices workers’ compensation law. The primary focus of his practice is on injured workers. In the Spring of 2015, Mr. Ryan became a certified specialist in Pennsylvania Workers’ Compensation by the PA Bar Association’s Section on Workers’ Compensation Law as authorized by the PA Supreme Court. Michael C. Boland graduated from Holy Name High School (now known as Berks Catholic) in Reading, Pennsylvania. He spent a year studying Mathematics and Science at Lehigh University in Bethlehem, Pennsylvania, followed by a year at the prestigious Oberlin College in Oberlin, Ohio, before temporarily ceasing academic studies. Mr. Boland worked various odd jobs including an Assistant Berks County Planner, spent a year on the production line at a wire factory in Robesonia, and worked as a laborer at French Creek Park. Mr. Boland returned to college on the main campus of the Pennsylvania State University in University Park, PA. By “overloading” credits each term, Mr. Boland graduated in less than 18 months from the Pennsylvania State University. He graduated from the Dickinson School of Law and was admitted to the Bar of Pennsylvania as well as the United States District Court for the Eastern District of Pennsylvania. After receiving his law degree, as a new attorney Mr. Boland associated with Alan S. Readinger in the practice of law and maintained an office at 601 Penn Street in the City of Reading for approximately 17 years. During the first two years of his law practice, Mr. Boland worked as an assistant District Attorney in the Berks County District Attorney's Office. He tried a number of criminal cases, which culminated in a triple homicide conviction (against Philadelphia counsel). After that conviction, Mr. Boland resigned from the DA's Office. Mr. Boland has maintained his law office at 147 North 5th Street in the city of Reading for over 20 years. Mr. Boland is a member of the American Bar Association, the Pennsylvania Bar Association, and the Berks County Bar Association. He has served on various committees with the Berks County Bar Association including the Solo and Small Practice Committee, the Pro Bono Committee, and the Criminal Law Committee. Mr. Boland continues to be active in the local bar association and is an avid follower of recent Supreme Court Opinions affecting the rights of individuals. Mr. Boland served as an Assistant Berks County Solicitor and handled the labor disputes for Berks County while also serving as Solicitor to the Elections Board. His labor relations work resulted in his appearance before the Pennsylvania Civil Service Commission, the Unemployment Compensation Board of Review, labor arbitrations and union negotiations. Mr. Boland maintains an Avvo rating of 8.9 or “excellent” in the rating service conducted by Avvo.com. He received a rating of 10.0 for professional conduct. Mr. Boland maintains a general practice of law and would likely be assigned to the litigation division in a large law firm. However, his current practice has been concentrated in the areas of criminal defense, estate settlements and probate, auto and motorcycle accidents, unemployment compensation, and motor vehicle law including adjustments of driver license status. Anne John, President of the Pennsylvania Bar Association, discussed the services the organization offers to its attorney members and the general public. She described it mission, including to advance the science of jurisprudence, to see that no one is denied justice on account of poverty, that no one is denied their legal rights, to promote a thorough legal education and to promote diversity and cordial intercourse within the profession. The bar, while not mandatory, is a valuable resource to attorneys, she referred to it as 'your other partner' as it offers a management coordinator, payment and records management software, human resources support and more. There is also career counseling and a job bank. The PBA offers a CLE Leadership Institute for continuing education and oversees the required ethics education; they offer an 'ethics hotline' and will also give non-binding opinion on ethical issues facing an attorney. Toward ensuring a strong legal education it hosts opportunities for law students to work with the public in legal clinics, as well as moot court competitions for high school students. The PBA is also the advocacy arm of the profession, offering opinions on the legal ramifications of legislation. They work with lawmakers on new legislation and give PBA's positions on issues before the General Assembly. To the public, the PBA works not just through pro bono cases and lawyer referral services, but also with programs such as 'My Clean Slate,' a state program that can erase a prior criminal record, including some first degree misdemeanors, and even second and third degree convictions after years of subsequent charges. The 'Clean Slate' allows the recipient a better chance at jobs and housing. She notes that the prior record is still available to law enforcement as needed. The PBA is also involved with reform in incarceration and parole supervision. For veterans, Ms John spoke about the PBA's Legal Needs Clinics for veterans and others, they also work to help first responders and military obtain wills. Ms John recommended the PBA's pamphlet series, consumer information pieces on a variety of topics, including material for grandparents charged with raising young grandchildren, she notes that the legislature has made changes to custody. Finally, a discussion of the PBA Judicial Evaluation Commission, an independent review board that serves to inform the public of the qualifications and merits of judicial candidates. After a brief overview of the judicial system that explained the importance of the Superior Court, Ms John explained how the commission interviews candidates and rates them based on their education, writing skills, tempemaent and fitness for the bench, candidates voluntarily appear before the commission and are rated Highly Recommended, Recommended and Not Recommended. Candidates who do not appear receive a rating of Not Recommended for Failure to Participate, it is not a judgement of their qualifications. She attended her dream school, Grove City College, a college that values both faith and freedom. During her 4 years, Allison was the president of her sorority, honor student, named on the dean’s list, was recommended by her peers to be on the homecoming court and received her Bachelor of Science degree in Business Marketing Management with a focus on Communication Studies. She was immediately hired to work for a prime contractor for the United States Naval Nuclear Propulsion Program (NNPP). During those years, Allison married the man of her dreams, a United States Marine and now, firefighter. They bought a house, adopted a pit bull and, together, they realized that they had a passion to live a life that they designed. They quit their jobs and moved to live by the ocean in sunny Charleston, South Carolina. Allison competed and placed in her first bodybuilding bikini competition. A year later, they adopted a second pit bull, and she enlisted into the Air Force National Guard. A few months before heading to basic training, Allison found out that she was pregnant with her first child; her sweet, baby boy Micah. Allison currently works for the Town of Mount Pleasant full-time, while operating IEPPal, an education platform. She also started a non-profit, Networking4Moms, with co-founder and twin sister, Emily Seelman, which is designed to provide the resources for stay-at- home moms to be able to re-enter the workforce. Allison also operates a social media platform with her sister called Emily and Allison: an Instagram account and a YouTube channel. They are also currently in the process of developing a dating app for single parents. She is currently training post-partum to compete in her second bodybuilding bikini competition. Allison has a desire to contribute to her community and improve the lives of those around her by living fully, employing her talents, working hard and loving deeply. Her mission is to uphold the good, the true, and the beautiful while impacting the world. At the same time, she strives to do the little-noticed disciplines well, like growing in the knowledge of her Creator and raising and training her children in His nurture and Word.
