Ralph welcomes Deepa Padmanabha, senior legal advisor to Greenpeace USA, to discuss that organization's looming trial against Energy Transfer Partners (builder of the Dakota Access Pipeline at Standing Rock) that threatens the constitutionally protected First Amendment right of citizens and citizen groups to protest. Plus, Josh Paul, former State Department employee, who resigned in protest over the Biden Administration's policy of sending weapons to support Israel's genocide in Gaza, returns to tell us about an organization he co-founded called “A New Policy,” which as the name suggests envisions an American policy toward the Middle East more in line with the “foundational principles of liberty, equality, democracy, and human rights; advancing American interests abroad; and protecting American freedoms at home.”Deepa Padmanabha is Senior Legal Advisor at Greenpeace USA, where she works closely with environmental activists seeking to exercise their First Amendment rights to promote systemic change. In September 2022, she testified before the House Committee on Oversight and Reform on Greenpeace USA's experience with legal attacks from extractive industries and the importance of federal anti-SLAPP legislation. And her work has focused on defending Greenpeace entities in the US against two SLAPP lawsuits attempting to silence the organization's advocacy work.This was not a Greenpeace campaign—and that was very intentional. And so our very limited involvement was solidarity with the Indigenous tribes, the Indigenous water protectors that were carrying this fight…Personally, I don't think that Energy Transfer likes the optics of going after Indigenous people. I think that it's much easier to go after the “Big Greens”, the “agitators”, things like that—and they probably would be dealing with a much more difficult PR campaign if they went after members of tribes.Deepa PadmanabhaBack in 2016 and 2017, when the original civil RICO cases were filed against the Greenpeace entities (all of these fights started out as RICO), many groups across issue areas were deeply concerned that this would be the new tactic used to go to attack labor, to attack human rights, to attack every kind of organization imaginable. And so what we did at that time (Greenpeace USA was a part of it as well as other groups) is we've created a coalition called Protect the Protest. Protect the Protest is a coalition of organizations to provide support for individuals who are threatened with SLAPPs, who receive cease-and-desist letters, who might want help either finding a lawyer or communication support. Because we know that the individuals bringing these lawsuits want the fights to happen in silence. So a big part of the work that needs to be done—and that we do—is to bring attention to them.Deepa PadmanabhaPast SLAPP lawsuits by corporations intended to wear down the citizen groups, cost them all kinds of legal fees. There have been SLAPP lawsuits for citizen groups just having a news conference or citizen groups being part of a town meeting. Or in the case of Oprah Winfrey, who was sued by at Texas meat company because she had a critic of the meat industry on her show that reached millions of people. That case was settled. So, this is the furthest extension of suppression of free speech by these artificial entities called corporations.Ralph NaderJosh Paul is co-founder (with Tariq Habash) of A New Policy, which seeks to transform U.S. foreign policy in the Middle East. He resigned from the State Department in October 2023 due to his disagreement with the Biden Administration's decision to rush lethal military assistance to Israel in the context of its war on Gaza. He had previously spent over 11 years working as a Director in the Bureau of Political-Military Affairs, which is responsible for U.S. defense diplomacy, security assistance, and arms transfers. He previously worked on security sector reform in both Iraq and the West Bank, with additional roles in the Office of the Secretary of Defense, U.S. Army Staff, and as a Military Legislative Assistant for a Member of the U.S. House Armed Services Committee.I think that the time for quitting in protest over Gaza, unfortunately, in many ways, is greatly behind us. I think there will be a significant number of State Department officials who will be leaving in the coming days, weeks, and months. And this is a result of a push from the Trump administration to gut America's diplomatic corps, much as they did at the start of the previous Trump administration, but even more so this time around. What I'm hearing from former colleagues in the State Department is a sense of immense despair as they see freezes being placed on U.S. foreign assistance programs—including programs that do an immense amount of good around the world—and just a concern about the overall and impending collapse of American diplomacy.Josh PaulWe have to acknowledge the precedent set by President Biden. Not only in his unconditional support for Israel and its attacks on Gaza, its violations of international humanitarian law, but also in President Biden and Secretary Blinken's willingness to set aside U.S. laws when it came to, in particular, security assistance and arms transfers in order to continue that support. That is a precedent that I think all Americans should be concerned about regardless of their thoughts on the conflict itself.Josh PaulI would say that what we face in America is a problem set that runs much deeper than any change in administration, than any political party. There is an entrenched dynamic within American politics—an entrenched set of both political and economic incentives across our electoral system—that are maintaining U.S. unconditional support for Israel, regardless of what the American people might want.Josh PaulNews 1/31/251. Our top stories this week have to do with the betrayal of the so-called “Make America Healthy Again” or “MAHA” movement. First up, Robert F. Kennedy Jr. – President Trump's nominee to lead the Department of Health of Human Services – found himself in the hot seat Wednesday as his confirmation hearings began. Kennedy, who is facing opposition both from Democrats who regard his anti-vaccine rhetoric as dangerous and Republicans who view him as too liberal, struggled to answer basic questions during these hearings. Perhaps most distressingly, he shilled for the disastrous Medicare privatization scheme known as “Medicare Advantage,” at one point saying that he himself is on a Medicare Advantage plan and that “more people would rather be on Medicare Advantage.” Kennedy went on to say most Americans would prefer to be on private insurance. As Matt Stoller of the American Economic Liberties Project writes, this is “basically Cato [Institute] style libertarianism.”2. Meanwhile, the Trump Administration is signaling they intend to scrap a proposed EPA rule to ban “forever chemicals” from Americans' drinking water, per the Spokesman-Review out of Spokane, Washington. Per this piece, “perfluoroalkyl and polyfluoroalkyl substances, abbreviated PFAS, are a set of man-made chemicals used in thousands of products over the decades. High levels of them have…been linked to cancers, heart disease, high cholesterol, thyroid disease, low birth weight and other diseases.” Shelving PFAS regulation was high on the Heritage Foundation's Project 2025 wish list, though the Trump team had previously sent mixed messages on the topic. Trump's pick to oversee regulation of dangerous chemicals is Nancy Beck, a longtime executive at the American Chemistry Council.3. As if those betrayals weren't enough, Trump has also selected Ms. Kailee Buller as the Chief of Staff for the U.S. Department of Agriculture. For the past year, Buller has served as president & CEO of the National Oilseed Processors Association. More simply put, she is the top seed oil lobbyist in the nation. This is perhaps the most illustrative example of the MAHA bait and switch. Not only is the Trump administration spitting in the face of their own supporters and doing the opposite of what they promised in terms of cracking down on ultra-processed, unhealthy food – they are doing so in an openly and brazenly corrupt manner. Under Trump, regulatory agencies are on the auction block and will be sold to the highest bidder.4. In more health news, legendary investigative journalist Seymour Hersh has come out with a new story – and it's a doozy. According to Hersh's sources, the Trump administration mishandled the COVID-19 pandemic long before the public knew anything about the virus. He writes “I learned this week that a US intelligence asset at the Wuhan Institute of Virology in China, where the Covid virus was first observed…provided early warning of a laboratory accident at Wuhan that led to a series of infections that was quickly spreading and initially seemed immune to treatment.” Hersh continues “early studies dealing with how to mitigate the oncoming plague, based on information from the Chinese health ministry about the lethal new virus, were completed late in 2019 by experts from America's National Institutes of Health and other research agencies.” Yet, “Despite their warnings, a series of preventative actions were not taken until the United States was flooded with cases of the virus.” Most damningly, Hersh's sources claim that “All of these studies…have been expunged from the official internal records in Washington, including any mention of the CIA's source inside the Chinese laboratory.” If true, this would be among the most catastrophic cases of indecision – and most sweeping coverup – in modern American history. Watch this space.5. Meanwhile, in more foreign affairs news, Progressive International reports that “For the first time in history,” Members of the United States Congress have joined with Members of Mexico's Cámara de Diputados to “oppose the escalating threats of U.S. military action against Mexico” and call to “strengthen the bonds of solidarity between our peoples.” This move of course comes amid ever-rising tensions between the United States and our southern neighbor, particularly as the GOP has in recent years taken up the idea of a full-blown invasion of Mexico. This letter was signed by many prominent U.S. progressives, including Rashida Tlaib, Ilhan Omar, Summer Lee, AOC, Greg Casar and Raul Grijalva, as well as 23 Mexican deputies. One can only hope that this show of internationalism helps forestall further escalation with Mexico.6. Turning to the issue of corruption, former New Jersey Senator Robert Menendez was sentenced to 11 years in prison for his role in a bribery scheme that included him acting as an unregistered agent of the Egyptian government, per the DOJ. Until 2024, Menendez had served as the Chairman or Ranking Member of the powerful Senate Foreign Relations Committee – an ideal perch for a crooked politician. During sentencing, Menendez broke down and weepily begged the judge for leniency. Yet, almost immediately after the sentence was handed down, Menendez changed his tune and started sucking up to Trump in a transparent attempt to secure a pardon. Axios reports Menendez said “President Trump was right…This process is political, and it's corrupted to the core. I hope President Trump cleans up the cesspool and restores the integrity to the system.” Unfortunately, Trump's fragile ego makes him particularly susceptible to just this sort of appeal, so it would be no surprise if he does grant some form of clemency to the disgraced Senator.7. Likewise, New York City Mayor Eric Adams appears to feel the walls closing in with regard to his corrupt dealings with his Turkish benefactors. And just like Menendez, Adams' strategy appears to be to ingratiate himself with Trump world. On January 23rd, the New York Daily News reported that Adams had pledged to avoid publicly criticizing Trump. Adams has previously called Trump a “white supremacist.” Adams' simpering seems to having the intended effect. On January 29th, the New York Times reported “Senior Justice Department officials under President Trump have held discussions with federal prosecutors in Manhattan about the possibility of dropping their corruption case,” against Adams. This story notes that “The defense team is led by Alex Spiro, who is also the personal lawyer for Elon Musk.”8. Our final three stories this week have to do with organized labor. First, Bloomberg labor reporter Josh Eidelson reports Trump has ousted National Labor Relations Board General Counsel Jennifer Abruzzo. This alone is a tragedy; Abruzzo has been nothing short of a crusader on behalf of organized labor during her tenure. Yet, more troubling news quickly followed: Trump has unlawfully sacked Gwynne Wilcox a Democratic member of the labor board with no just cause. As Eidelson notes, the law forbids “firing board members absent neglect or malfeasance.” Wilcox was the first ever Black member of the NLRB and her unlawful removal gives Trump a working majority at the board. Expect to see a rapid slew of anti-worker decisions in the coming days.9. In some good news, independent journalist Ken Klippenstein reports that union collective bargaining agreements have successfully “thwart[ed]…Trump's return to work order.” Instead, the administration has been forced to issue a new order, stating “Supervisors should not begin discussions around the return to in-person work with bargaining unit employees until HHS fulfills its collective bargaining obligations.” In other words, even while every supposed legal guardrail, institutional norm, and political force of gravity wilts before Trump's onslaught, what is the one bulwark that still stands strong, protecting everyday working people? Their union.10. Our final story is a simple one. Jacobin labor journalist Alex Press reports that in Philadelphia, the first Whole Foods grocery store has voted to unionize. The nearly-300 workers at the store voted to affiliate with United Food and Commercial Workers Local 1176. Whole Foods was sold to Amazon in 2017 and since then the e-tail giant has vigorously staved off unionization. Could this be the first crack in the dam? Ralph welcomes retired diplomat Ambassador Chas Freeman to discuss the United States' disregard for international law, the incoming Trump administration's approach to foreign policy, and the decline of the American Empire (among other topics).Ambassador Chas Freeman is a retired career diplomat who has negotiated on behalf of the United States with over 100 foreign governments in East and South Asia, Africa, Latin America, the Middle East, and both Western and Eastern Europe. Ambassador Freeman was previously a Senior Fellow at Brown University's Watson Institute for International and Public Affairs, and served as U.S. Assistant Secretary of Defense, U.S. ambassador to Saudi Arabia, acting Assistant Secretary of State for African Affairs, and Deputy Chief of Mission and Chargé d'Affaires in the American embassies at both Bangkok and Beijing. He was Director for Chinese Affairs at the U.S. Department of State from 1979-1981. He was the principal American interpreter during the late President Nixon's historic visit to China in 1972. In addition to Chinese, Ambassador Freeman speaks French and Spanish at the professional level and can converse in Arabic and several other languages.He concluded his thirty years in public service as Assistant Secretary of Defense, responsible for managing defense relations with all regions of the world except the countries of the former Soviet Union. Ambassador Freeman is the author of several well-received books on statecraft and diplomacy, including The Diplomat's Dictionary, America's Misadventures in the Middle East, and America's Continuing Misadventures in the Middle East.I think it's fair to say that our country led the drive for international law, a world order that was based on rules established by consensus and legitimized at the United Nations. But we have also led the drive away from the rule of law, both internationally and domestically. And I think the connection is contempt for procedural justice or due process.Chas FreemanThat whole area of international law—which was a stabilizing force in the world—has gone [when Trump removed us from the Intermediate Nuclear Forces Agreement in Europe.] And the UN Charter is disrespected—not just the US Constitution is—in its fundamentals. We invade the sovereignty of other countries with no serious regard for the legal prohibitions against that. And in fact, those legal prohibitions—which once were something that smaller countries could rely upon when they confronted the great powers—are no longer effective. Therefore, we see at the local level, the regional level, a proliferation of weapons designed to counter and defend against attack by greater powers. So the whole world is in effect arming itself. This is very good for arms manufacturers, but it's very bad for the prospects for our species.Chas FreemanThere are no realistic threats against the United States—except those that we are provoking. Our view seems to be that the best way to deal with the hornet's nest—I'm speaking of West Asia, the Middle East here—is to go and poke the hornets in their nest.Chas FreemanThe real risk now…is Israel has so much power in the US that it could create incidents which would flip the United States into a blazing barrage of empire expansion— and suppression in the United States domestically. And they have an incoming president who is ripe for that kind of manipulation to begin with.Ralph NaderIn Case You Haven't Heard with Francesco DeSantisNews 12/11/241. On December 4th, UnitedHealthcare CEO Brian Thompson was assassinated in broad daylight in Midtown Manhattan. Clues indicated that the killing was political; most notably, the words “delay,” “deny” and “depose” were each written on one of the three bullets fired at the scene. As AP notes, “The messages mirror the phrase ‘delay, deny, defend,' which is commonly used by lawyers and critics about insurers that delay payments, deny claims and defend their actions.” Following nearly two full days of nescience, authorities turned up a suspect – Luigi Mangione, the Ivy League-educated scion of an established Baltimore family who had shown signs of increasingly erratic behavior in recent months, perhaps related to ever-worsening back pain. When Mangione was apprehended in an Altoona, Pennsylvania McDonald's, he was found with “a three-page handwritten document that indicated ‘motivation and mindset,'” the BBC reports, however authorities have not released this manifesto. Perhaps unsurprisingly, ABC 7 New York reports that Mangione's actions have unleashed a torrent of “‘volcanic' anger,” toward health insurance agencies, which many regard as capricious and cruel. It remains to be seen how this public sentiment will factor into what is sure to be a highly-publicized criminal trial.2. The reverberations of Mangione's actions are already being felt. Back in November, the American Society of Anesthesiologists issued a statement decrying Anthem Blue Cross Blue Shield's unilateral declaration that it would refuse to “pay for anesthesia care if [a] surgery or procedure goes beyond an arbitrary time limit, regardless of how long the surgical procedure takes.” The ASA called on Anthem to reverse that proposal, but their pleas were ignored. That is until December 5th – just one day after the UnitedHealthcare shooting – when the company abruptly reversed themselves and even scrubbed the announcement of the policy from their website. Of course, Anthem insists that the outcry was based on “misinformation” and denies any correlation between the assassination and their decision, per NBC, but the timing frankly makes that difficult to believe.3. Another New York City killing also made the news last week: the trial of Daniel Penny, a former U.S. Marine on trial for strangling Jordan Neely to death in a New York subway car. Neely was an African-American street artist who had been experiencing homelessness. CNN reports Penny was found not guilty of criminally negligent homicide, already a lesser charge than the original second-degree manslaughter allegation, which Judge Maxwell Wiley dismissed Friday after jurors “twice told the court they could not come to a verdict on the count.” Neely's father, Andre Zachary, is quoted saying “I miss my son. My son didn't have to go through this. I didn't have to go through this either…What's going to happen to us now? I've had enough of this. The system is rigged.”4. Turning to the Middle East, the regime of Bashar al-Assad in Syria has fallen. Assad, with help from Russia, has clung to power since the country descended into civil war in 2011, beating back all manner of rival forces ranging from U.S.-backed rebels to left-wing Kurdish militias to ISIS. The faction that finally did wrest power from Assad is called Hay'at Tahrir al-Sham or HTS, which splintered from Al-Qaeda but is now engaging in a so-called “charm offensive” per France24, and promoting itself as a tolerant faction that will not subjugate women or oppress ethnic and religious minorities such as Syrian Christians, Druze, and Kurds. In a statement, the group told the Kurds of Aleppo “You have the right to live freely … Diversity is a strength of which we are proud…We denounce the actions of the Islamic State group against the Kurds, including the enslavement of women … We are with the Kurds to build the Syria of tomorrow.” ABC reports the U.S. will “recognize and support a new Syrian government that renounces terrorism, destroys chemical weapons stocks and protects the rights of minorities and women.” So far HTS seems to fit the bill. And if this all wasn't enough, the Syrian situation is further complicated by Israel using this moment to expand its foothold in the country. CNN reports Israel has “launched airstrikes at military targets across Syria and deployed ground troops both into and beyond a demilitarized buffer zone for the first time in 50 years,” setting the stage for a possible new front in Netanyahu's ongoing regional war.5. In Palestine, the Intercept reports five Palestinians in the West Bank, along with the councils of the three villages they hail from have filed “a formal regulatory complaint in Germany accusing the media giant Axel Springer of contributing to human rights abuses in Palestine.” Specifically, the complaint concerns Yad2, a classified ads platform and subsidiary of Axel Springer that has been compared to Craigslist, which the plaintiffs allege enables illegal settlements. According to the complaint filed by Jerusalem Legal Aid and Human Rights Centre, Yad2's facilitation of settler activity violates Germany's Supply Chain Due Diligence Act, which “requires German companies to identify and mitigate human rights risks within their global supply chains, including in subsidiaries which they control.”6. Looking to Africa, Semafor reports that the incoming Trump White House appears set to recognize the breakaway state of Somaliland, spurred on by right-wing elements who wish to use the unrecognized country as a base for anti-China intelligence operations. This piece highlights that this move would rattle the governments of East Africa and draw the ire of the African Union, but Trump's China hawks see it as a critical element of countering Chinese influence in the region and particularly in Djibouti where the People's Liberation Army has set up one of its handful of foreign military bases. Moreover, the Teamster's Faustian bargain with the Trump administration may yield results for them, as the normally business friendly Republicans may be inclined to put the screws to Amazon on behalf of this particular union. Whatever the circumstances, the Amazon Teamsters deserve a contract and it is heartening that O'Brien is fighting for his members.10. In decidedly worse Trump news, the president-elect has announced former Missouri Republican Congressman Billy Long as his pick to lead the IRS. A story by the Lever sounds the alarm on how he might use the “non-profit killer” bill to pursue political vendettas against tax-exempt organizations he dislikes. This piece exposes Long's role in trying to pressure the IRS to launch a probe into, of all things, the Humane Society following their support of a Missouri ballot measure strengthening dog breeder regulations. Grijalva (D-Ariz.) and Senator Kyrsten Sinema (I-Ariz.) joined members of the Grand Canyon Tribal Coalition as they launched an effort to call on President Joe Biden to use his authorities under the Antiquities Act of 1906 to designate the Baaj Nwaavjo I'tah Kukveni Grand Canyon National Monument. Baaj Nwaavjo means “where tribes roam” for the Havasupai Tribe and I'tah Kukveni means “our footprints” for the Hopi Tribe. The proposed boundaries of the Baaj Nwaavjo I'tah Kukveni Grand Canyon National Monument include 1,102,501 acres adjacent to Grand Canyon National Park. The National Monument designation would honor the tribes' deep cultural ties to the Grand Canyon and protect the area by permanently banning uranium mining, while also enhancing the cultural, natural, recreational, and scientific resources of the region. The area is also an important watershed for the Colorado River, which provides water to 40 million Americans. [This podcast was recorded before the June 24, 2022 Supreme Court decision on abortion.] Senator Nancy Barto brags that Arizona is the #1 "Pro-Life" state in the country. That's because, for years, Arizona Republican politicians have followed the extreme anti-abortion agenda laid out by Cathi Herrod of the Center for Arizona Policy. Barto often sponsors these repressive reproductive rights bills, like the recent 15 week abortion ban.If the Supreme Court of the United States (SCOTUS) strikes down the landmark abortion rights case, Roe v Wade, in the coming weeks, Arizona's "Pro-Life" label will come back to haunt many residents as they find their right to body autonomy removed by state law. Arizona Republicans passed the contentious 15 week abortion ban in 2022, but there are many abortion-related laws on the books. Some Territorial Era statutes criminalize doctors and patients for abortion. Controlling reproductive rights and sexuality are popular topics for Republican legislation. Rep. Walt Blackman is running for Congress on a strong anti-abortion platform and has made at least three campaign-style anti-abortion speeches on the Floor of the House this year. If Roe goes down, the women of Arizona should brace themselves for an onslaught of more repressive laws from the Republicans, as long as they control the government. Arizona currently has 61 places in statutes that mention "abortion," but ZERO statutes that limit the reproductive rights of men. That is obviously state-based discrimination against women. Arizona needs a statewide Equal Rights Amendment. Abortion care is NOT a states' rights issue. A person's reproductive rights should not change when they cross state lines. Conflicts over lands and mining are not unusual to our region. Today on the news, we hear from our partners at KJZZ’s Tribal Natural Resources Desk in Arizona. There, Oak Flat in the Tonto National Forest has become a centerpiece of conflict between Native American tribes who want to preserve their sacred land, and the mining companies who say they want to generate revenue and create jobs. Congressman Raul Grijalva has introduced legislation to ban mining at Oak Flat, but its success is uncertain. We hear from a Washington Post reporter who recently wrote about these issues, focusing on just how unique and important the sacred land is to the Apache Tribe and others. In February, the House passed a package of ten bills that give away or sell Federal land, most of them so that private interests can use our land for profit. HR 2954: Public Access & Lands Improvement Act The Congressional Budget Office analysis of HR 2954 RAUL GRIJALVA (AZ):" Let's be clear: we are talking here about Federal property, that is, property owned by all Americans. The land in question in Escambia County, Florida; Anchorage, Alaska; Fernley, Nevada; Cape Hatteras, North Carolina; Yellowstone and Grand Teton and the land on which Federal grazing occurs, the land impacted by this package is Federal land, owned by each and every American taxpayer. In the case of these land transfers, the Federal Government gave the land, gave it to a local community as a means of Federal support, and the only requirement, in most cases, was that the land always be used for public purposes. As long as it is a park or a school or a fire station, it is yours, for free. What these bills do is end those public purpose requirements. The communities want to use these lands for private profit. They want to close them to the public, in many cases. This is not a land grab by Uncle Sam. This is not some silly scheme by the Feds to harm local communities and to use their power to hold down the tax-payers and keep the public out. This is a community asking to make money off land that was owned by all Americans, and it is the job of Congress to decide if that is a good idea or not. TITLE I: Florida land transfer Allows Escambia County, FL to give away it's title, right, and/or interest in Santa Rosa Island "to any person or entity", without restrictions. Escambia County has 2 years to transfer its rights, title, and interest in its property that falls within Santa Rosa Country to Santa Rosa County. The transfer is final and "shall terminate" "any regulation of Santa Rosa County by Escambia County" RAUL GRIJALVA (AZ): "This is public land, not land to give away and, as stated before, over and over again, be dredged and used for a harbor for potential windfall profit." The concern raised by Raul Grijalva is over the possible dredging of Navarre Pass. A pass was dredged for boats in 1965 but was almost immediately destroyed by Hurricane Betsy. In 1968, a permit to re-dredge the pass was denied. The fighting over this has continued ever since. From what I can gather, Santa Rosa county wants to dredge the pass again but Escambia County does not. Both counties currently get a vote on this issue. Terminating any regulation of Santa Rosa County by Escambia County could potentially take Escambia's vote away and allow the pass to be dredged. TITLE II: Transfer of Federal land rights to the City of Anchorage Section 203: Secretary of the Interior will give all rights to land it currently leases to the City of Anchorage "to enable economic development" of that land. City of Anchorage will pay all costs. TITLE III: Sale of Federal land to Fernley, Nevada Introduced by Mark Amodei (NV-2) Section 302: Forces the Secretary of Interior to process a sale of 9,407 acres of Federal land to the City of Fernley in Nevada. Secretary of Interior will determine the "fair market price" CBO estimate's that to be $3,500 per acre = almost $33 million worth of land The map of the land will be available for public inspection, but it doesn't say it has to be available before the sale is completed. The land transfer will not be considered a "major Federal action", which exempts it from evaluation under the National Environmental Policy Act Section 303: Releases the Federal government from any liability from "the presence, release, or threat of release of any hazardous substance, pollutant, contaminant, petroleum product (or derivative of a petroleum product of any kind), solid waste, mine materials… on the Federal land in existence on or before the date of conveyance." Section 304: Appears to exempt the land from public land, mineral leasing, mining, and geothermal leasing laws. *confusing - not sure* "Current uses of these lands include grazing, mining, a public airport lease, and a geothermal lease... The Federal government owns both the surface and mineral estate in much of the parcels and the value of the mineral estate may be substantial." "The city has said possible uses could include parks, an airport, hospital, convention center and other businesses." TITLE IV: Prevents Federal land purchases Introduced by Rob Bishop of Utah RAUL GRIJALVA (AZ): "Let's put one other misleading claim to rest. While Republicans claim the Federal Government owns too much land, the historic trend has been one of divestiture and fragmentation. As recently as the late 1860s, the Fed-eral Government owned 1.8 billion of the 2.3 billion acres in the contiguous United States. Grants to States, home-steaders, land-grant colleges, railroads and others settling in the Alaska and the West have reduced Federal land ownership by roughly 640 million acres to date."* Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public" Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public." TITLE V: Bush Administration Rules for Cape Hatteras National Seashore Introduced by Rep. Walter Jones of North Carolina Section 502: Management of Cape Hatteras National Seashore Recreational Area will be managed according to a Bush Administration era environmental assessment, issued June 13, 2007. In October 2007, a lawsuit was filed against the Bush Administration rules by Defenders of Wildlife an the National Audubon Society, claiming that they Bush Administration rules didn't restrict off-road vehicles enough to protect the animals and land - including land nesting birds, whose populations were declining - and sea turtles. A "consent decree" - basically a settlement- was agreed to in April of 2008. This consent decree is what is currently governing the seashore. After the consent decree was agreed to, the National Park Service created the rules - which included a public comment period - and their final rule went into effect on February 15, 2013. This bill nullifies the consent decree, prevents enforcement of the final rule, and puts the Bush Administration rules back in charge. The Secretary of Interior can not restrict pedestrian or motorize vehicle traffic in order to protect animals beyond the restrictions enacted by the Bush Administration. Protections for endangered species at Cape Hatteras can not be greater than the restrictions placed for that species at any other National Seashore. Section 504: Prohibits enforcement of a final rule regulating off-road vehicles at the seashore that went into effect on February 15, 2012. TITLE VI: Green Mountain Lookout Can't be Moved [caption id="" align="aligncenter" width="412"] The Green Mountain Lookout in 2010[/caption] March 2012: A federal court ordered the Forest Service to remove a lookout structure from Green Mountain wilderness area. The lookout was constructed in 1933 and had been rehabilitated in 2009. Susan DELBENE (WA) "Green Mountain Lookout, located in the Glacier Peak Wilderness, was built in 1933 as a Civilian Conservation Corps project to detect fires and spot enemy aircraft during World War II. The look-out is an important, historic and unique part of the Pacific Northwest. It is a popular destination for hikers, and it is listed on the National Register of Historic Places. Unfortunately, severe weather caused the Green Mountain Lookout to fall into disrepair in 2001, and the U.S. Forest Service began taking steps to preserve the historic…structure for future generations. How-ever, an out-of-State group filed a law-suit against the Forest Service for using machinery to conduct these repairs, and a U.S. District Court ordered the Forest Service to remove the look-out. My bill would allow critical and routine maintenance while keeping this iconic structure where it is meant to be—in its original home. Local governments in the area, my constituents, as well as a number of environmental and historic preservation groups support my bill to keep the Green Mountain Lookout where it is. The Natural Re-sources Committee agrees. They passed this bill unanimously last year, and why wouldn't they? This bill is common sense. It saves us money because it would actually cost more to remove the lookout than to keep it where it is. There is absolutely no doubt in my mind that, if this bill had been brought up on its own, by its own merits, it would have passed with overwhelming bipartisan support. Unfortunately, that is not what is happening here today. Instead, this bill has gotten wrapped up in a series of very controversial and divisive bills" Section 603: Green Mountain Lookout can't be moved except for safety reasons. TITLE VII: River Paddling in Yellowstone & Grand Teton Introduced by Rep. Cynthia Loomis (WY) Prohibits the enforcement of two regulations that all rivers to be closed to hand paddlers in Yellowstone and Grand Teton National Parks. Would take effect 3 years after the bill becomes law. Existing regulations prohibit boating on rivers and on five of Yellowstone's 168 lakes and a 1,000 foot section of the Snake River in Grand Teton National Park. The ban was put in place sixty years ago to prevent overfishing. TITLE VIII: Longer permits and no environmental studies for grazing Introduced by Rep. Raul Labrador (ID) Section 802: Increases the term for new permits on Federal land from 10 to 20 years. Anyone who sues to stop grazing and lose in court will pay the legal fees and other expenses of the winner, unless the court rules otherwise. Section 803: An expired or transferred permit will remain in effect, under the original terms, until the government finishes processing a new permit or lease, which will be valid for twenty years. "The renewal, resistance, or transfer of a grazing permit or lease by the Secretary concerned shall be categorically excluded from the requirement to prepare an environmental assessment or environmental impact statement". Crossing and trail authorizations for livestock will be exempt from environmental regulations. Temporary crossing or trailing authorizations "shall not be subject to protest or appeal" TITLE IX: Sell Dead Wood from the Rim Fire Introduced by Rep. Tom McClintock (CA) TOM MCCLINTOCK (CA): The fire also left behind hundreds of millions of board feet of dead timber that is on Federal land that could be sold to raise millions of dollars, money that could then be used to replant and reforest our devastated lands. In addition, processing that timber would help to revive the economy of a stricken region. Section 902: Secretary of Agriculture "shall conduct a timber salvage and restoration pilot program. Automatically deemed to comply with NEPA, the Endangered Species Act, and three other forest management laws. Is not subject to "judicial review by any court of the United States." Specifically prohibits a temporary restraining order. The pilot program will be conducted according to an proposed alternative in a draft environmental impact statement. The "proposed alternative", which would govern the pilot program, has no details: "In addition to the Proposed Action, the EIS will evaluate the required No Action alternative and will likely consider other alternatives identified through the inderdisciplinary process and public participation." Sierra Pacific is already collecting fallen trees on private land A fascinating article in the Modesto Bee is in favor of opening some additional land to logging but is pissed at Tom McClintock for going so far and not trying to find a sensible compromise: "McClintock has called for immediate salvage logging of 1 billion board feet of timber. To understand the magnitude of what McClintock envisions, a billion board feet is equal to all the timber logged in California in a year. Much of it is in steep, remote areas. To get to it, loggers would need to cut roads and scale steep mountains, causing yet more erosion on slopes with no ability to stop runoff. The damage – environmental and to whatever is below – could be enormous. McClintock believes that such a massive operation should be exempt from federal environmental laws, public comment and court review. That is nonsensical. There is no scientific basis for the scale of removal that McClintock advocates. Besides, the logging industry doesn’t have enough trucks, crews, equipment and processing capacity for it. For instance, there are only 11 logging crews and 165 trucks working in the area of the Sierra hit by the fire, and they will be busy through the summer simply removing the timber from private lands. And even if more crews and trucks could be brought into the area, the mills would have no place to store that much timber. The congressman from Elk Grove ought to drop his ill-conceived idea and concentrate on helping the timber companies acquire the areas they target." Tom McClintock statement on Rim Fire timber TITLE X: Chesapeake Bay Orders a report on past and future restoration funding levels for activities over $100,000. Develop a restoration plan that will be updated every two years .Create an independent evaluator for the restoration programs. TITLE XI: Issues a patent for 80 acres of Alaska land for surface rights United States keeps all mineral rights. Additional Information The government recently seized the cows of Cliven Bundy, a rancher in Nevada who has refused to pay his grazing permitting fees for over 20 years, which lead to armed standoff between Federal agents and 100 man hillbilly militia. This started in 1993 when the Federal government revoked Bundy's permit for grazing on 600,000 acres of federal land for lack of payment. In 1998, a Las Vegas federal judge ordered Bundy to remove his cows from our land. He has refused. Since then, Bundy has racked up a bill of over $1 million in unpaid fees and has refused to move his cows onto his own land. Bundy says he doesn't have to pay because he no longer has a contract with the Federal government, as it was revoked in 1993. Bundy also says that the land in dispute belongs to Nevada, not the Federal government. The Bureau of Land Management removed his cows from the Federal land - impounding them instead of putting them on Bundy's undisputed land - and Bundy and his hillbilly supported showed up pissed off with guns. The BLM last week backed down.
