After breaking the news that the Alcohol and Gaming Commission of Ontario was taking a harder line on the use of athletes and celebrities in sportsbook and igaming advertising, the Gaming News Canada Show presented by Osler, Hoskin & Harcourt LLP dug deeper into the commission's proposal.Kindred Group's Amanda Brewer, Phill Gray of Sports Interaction, journalist Scott Longley of Earnings+More, Parleh Media Group's Gavin Roth and Mark Silver, and Canadian sports media expert Jonah Sigel all weighed in on the AGCO's proposed amended standard:Create an obligation for operators and suppliers to cease any advertising and marketing activities that use athletes, whether active or retired, in gaming marketing and advertising; and,Prohibit the use of cartoon figures, symbols, role models, social media influencers, celebrities or entertainers who are reasonably expected to appeal to minors. This proposed amendment differs from the current standard, which is applicable to persons that “primarily appeal” to minors. Advertising remains a permitted activity, provided other Standards are met.Longley, speaking to us from the UK, provided an update on the decision by the Premier League this week to ban front-of-jersey sponsorships with its soccer clubs. Mark Potter of EPIC Risk Management also joined the show from the UK to talk about the harassment of athletes on social media, and at sports venues, by disgruntled bettors. Hockey analytics guru Meghan Chayka also came on to discuss her FanDuel Canada-sponsored Strength in Number segments on TSN Hockey this season, and also about the ongoing push for gender equity in the sport that now includes a pilot project that will be funded by FanDuel, Bauer Hockey, Canadian Tire and Harvey's. Mais vous ne pouvez tromper tout le monde tout le temps ».En ce sens, ne cherchez sous aucun prétexte à berner vos clients, notamment par le biais de stratégies publicitaires trompeuses ou malhonnêtes, car vous pourriez vous exposer à des sanctions et entacher votre image, comme dans le cas des entreprises suivantes.En 1998, la Compagnie de la Baie d'Hudson a reconnu sa culpabilité devant la Cour de l'Ontario pour publicité trompeuse et dût acquitter une amende de 600 000 $.L'entreprise affirmait dans une publicité, que les soldes annoncés sur différentes marques de bicyclettes ne seraient en vigueur que pour un court laps de temps, alors que ce n'était pas le cas.En 2011, le géant Reebok s'est engagé auprès de la Federal Trade Commission (FTC) à créer un fonds de 25 millions de dollars afin de rembourser les acheteurs de chaussures de modèle Easytone et Runtone.Les publicités promettaient notamment aux consommateurs une augmentation de 28 % de la tonicité des muscles fessiers alors qu'aucune preuve scientifique ne permettait de croire de telles affirmations.Dans la même veine, la société Bauer Hockey a conclu un règlement avec le Bureau de la concurrence en 2014 et devra faire don d'équipements d'une valeur de 500 000 $ à un organisme de bienfaisance qui encourage les jeunes à pratiquer des sports.Le Bureau a estimé que les publicités de Bauer pour promouvoir son casque RE-AKT donnaient à tort l'impression de protéger les joueurs de hockey contre les commotions cérébrales causées par les chocs générant une force de rotation.En 2016, c'est le détaillant de meubles Brault et Martineau qui a été condamné à 75 000 $ d'amendes. L'entreprise avait diffusé des publicités à la radio en décembre 2012 qui laissait croire qu'elle payait les taxes sur tous les électroménagers, alors que la promotion s'appliquait uniquement à certains modèles.McDonald's a plutôt opté pour l'honnêteté avec sa campagne « Vos aliments. Vos questions » Dans un article publié dans le journal La Presse, le vice-président principal et chef du marketing de l'entreprise au Canada, mentionne :« On a décidé d'être transparent et honnête, car il y avait beaucoup de rumeurs, mythes et désinformations à notre sujet, alors que la qualité de la nourriture est primordiale pour nous. »Dans le même article, on apprend que McDonald's a répondu à plus de 20 000 questions du public et ses vidéos réponses ont été visionnées plus de 14 millions de fois.
