Writer Alec Herron's gran's house was on the Grey Mare Lane estate in Beswick, east Manchester. He can still remember Sunday afternoons "filled with rice pudding, sucking bone marrow and hours sat around the table hearing stories of tragedy and petty gossip told with the same veracity".It will all be coming down soon. The regeneration of Grey Mare Lane estate was initiated after a 2017 public consultation concluded the estate was being “left behind”. Late last year, a £70 million masterplan for the area was withdrawn, two years after being first presented to residents. Three weeks ago a new masterplan was released. 124 social rented homes are to be demolished, and at least 550 new homes built — more than double the number of the previous masterplan.In this week's episode, Alec discusses his memories of the estate — some happy, some painful — and why this area is ripe for regeneration, and asks whether the same community can live on after the demolish-and-rebuild scheme is complete.A warning: this episode contains a description of physical violence. Landmark Case: Beswick v Beswick (1968). Beswick v Beswick is an important case that illustrates the application of third-party rights and assignments. In this case, a nephew was promised certain benefits under a contract between his uncle and a company. When the uncle passed away, the company refused to honor the agreement. The court held that the nephew was an intended third-party beneficiary with the right to enforce the contract. Restrictions on Assignment and Delegation. While assignments and delegations are generally permissible, there are some restrictions and limitations that law students should be aware of: Prohibition in the Contract. The terms of the original contract may expressly prohibit assignment or delegation. When this prohibition is in place, assignments or delegations may be invalid. Material Change of Obligations. If an assignment or delegation results in a significant change in the obligor's obligations under the contract, it may be deemed invalid. Assignment of Personal Services Contracts. Assignments of personal services contracts, where performance relies heavily on the skills or abilities of a specific party, are often prohibited or subject to restrictions. Anti-Assignment Clauses. Some contracts may contain anti-assignment clauses that limit or prohibit the assignment of rights. However, these clauses are not always absolute, and their enforceability can vary. Specific Performance and Third-Party Beneficiaries. In some cases, a third-party beneficiary may seek specific performance of a contract. Law students should understand the circumstances under which this remedy is available and the challenges it may present: · Availability: Courts may grant specific performance to a third-party beneficiary if it is necessary to fulfill the promisor's contractual duties. Charlie Beswick is a blogger, an author, CEO of More than a Face, and a mom to 18-year-old twins, Oliver and Harry. While Oliver was born healthy, Harry was born with a craniofacial condition, meaning he had an underdeveloped face and was later diagnosed with autism. Driven to make a difference in people's lives, being a teacher (for over 16 years now), to her feels like second nature. However, despite that deep love for her calling, the challenges of raising a medically complex child made her take a two-year break from teaching. Tracey's story is just incredible. She birthed her 4 month old son Airlie at home (which was planned), but without any midwives present (which was definitely unplanned)! Mr. Beswick has over 20 years' experience in education as an educational program director for a social service agency, a charter schoolteacher, Principal, and Assistant Superintendent. Mr. Beswick is the Vice President of School Development for Lifelong Learning, serving as the executive lead for the Trauma Resilient Educational Community model (TREC), related partnerships and outreach, grant fund development, and workforce development. Mr. Beswick started and supported the integration of the TREC model into all schools within the Learn4Life Network, conducting over 300 presentations and training at schools and conferences across the country, including the National Trauma Informed Schools Conference, California Charter School Conference, Jobs for America Graduates National Training Seminar, and the California Workforce Association. Mr. Beswick also serves as the Co-chair of PACES Connection, San Diego Collaborative of Communities, and is a Heart Math Certified Trainer.
