An OWCP traumatic injury is defined as: “A wound or other condition of the body caused by external force, including stress or strain, which is identifiable as to the time and place of occurrence and member or function of the body affected. The injury must be caused by a specific event or incident or series of events or incidents within a single work day or work shift.”Notifying your supervisor and filing a claim & Immediately notify your supervisor of your injury and your intent to file a claim using ECOMP. Request your supervisor's Postal Service email address to use in registering in ECOMP. Once you have registered in ECOMP, go to the top of your dashboard and click New Claim. Follow the directions for filing a CA-1 claim for traumatic injury. If you are filing the claim within one week of the injury, request form CA-16, Authorization for Examination and/or Treatment (must be supplied by your manager within 4 hour. Request a Form CA-17 Duty Status Report from your supervisor. The Postal Service is responsible for filling out the job requirements on the left (side A) of the CA-17. Once your doctor has completed the CA-17, make a copy or take a picture of the completed CA-17 and give the original to your supervisor. Your doctor should provide you with their report so you can send medical reports directly to OWCP. You can upload medical reports into your claim file via ECOMP. When the occupational & safety personnel ask you for your records you are required to provide them with your return to work CA forms CA-17 or CA-5C. Your medical reports are protected by the Privacy Act and should be sent directly to OWCP, not the Postal Service. Landmark Case: Beswick v Beswick (1968). Beswick v Beswick is an important case that illustrates the application of third-party rights and assignments. In this case, a nephew was promised certain benefits under a contract between his uncle and a company. When the uncle passed away, the company refused to honor the agreement. The court held that the nephew was an intended third-party beneficiary with the right to enforce the contract. Restrictions on Assignment and Delegation. While assignments and delegations are generally permissible, there are some restrictions and limitations that law students should be aware of: Prohibition in the Contract. The terms of the original contract may expressly prohibit assignment or delegation. When this prohibition is in place, assignments or delegations may be invalid. Material Change of Obligations. If an assignment or delegation results in a significant change in the obligor's obligations under the contract, it may be deemed invalid. Assignment of Personal Services Contracts. Assignments of personal services contracts, where performance relies heavily on the skills or abilities of a specific party, are often prohibited or subject to restrictions. Anti-Assignment Clauses. Some contracts may contain anti-assignment clauses that limit or prohibit the assignment of rights. However, these clauses are not always absolute, and their enforceability can vary. Specific Performance and Third-Party Beneficiaries. In some cases, a third-party beneficiary may seek specific performance of a contract. Law students should understand the circumstances under which this remedy is available and the challenges it may present: · Availability: Courts may grant specific performance to a third-party beneficiary if it is necessary to fulfill the promisor's contractual duties. However, the beneficiary must usually meet the same requirements as the original promisee. · Complexity and Discretion: Seeking specific performance as a third-party beneficiary can be complex and subject to the court's discretion. Courts will consider factors like feasibility, fairness, and the beneficiary's interests. Successive Assignments. Understanding the concept of successive assignments is crucial for law students. Successive assignments occur when rights under a contract are assigned more than once. Law students should grasp how successive assignments are treated in contract law, including: · Order of Priority: Generally, the first valid assignment takes precedence over later assignments. However, some jurisdictions follow the "first in time, first in right" principle, meaning the first assignee to give notice prevails. · Notifying the Obligor: It is essential for the assignee to notify the obligor for the assignment to be effective, and failure to provide notice can affect the assignee's priority. The quest to follow a client's wishes will always top the list of priorities for any conscientious estate attorney — keeping all parties concerned out of court likely runs not far behind — and while there's no failsafe way to ensure that priority #2 is 100% achieved, having an honest and open communication among family members about your estate plan is the best way to stack the odds in your favor. The subject of estate planning can make family members feel a little uneasy, even when some of its most obvious aspects are often left unspoken. For example, where to find the estate planning documents needed to carry out your wishes and the location of the assets to be distributed to your heirs as you see fit. This can lead to confusion, especially when emotions are already at a fever pitch. The chasms it can create among family members can last a LONG time — sometimes even permanently. Notifying your family members of your wishes as clearly as possible is the best way to avoid surprises and the potential fallout that might result from them. And while it's a great idea to get family input on several aspects of your estate plan, this input shouldn't be the only factor in shaping your decisions. You shouldn't have to ask your children for permission to create your estate plan as you see fit. With all this in mind, planning your estate, so things go as smoothly as possible when it comes time to carry out your wishes seems pretty challenging, doesn't it? It often is, but let's see if we can make it a little less daunting. But, making sure that the essential details of your estate plan are properly discussed can go a long way toward keeping peace and harmony in the future.
Scan the news these days, and you'd be hard-pressed not to come across a story about price increases. The price of gas has gone up. Rents are increasing, and groceries are at an all-time high. It's depressing, I know. But that's the world we live in. And your business should be no different. At some point, you'll have to raise your rates if you want to remain solvent. The one benefit of inflation is that people are getting used to price increases. So it won't be as much of a shock when you announce you're raising your rates. Be that as it may, you still want to do it the best way possible to soften the blow for your clients. So what's the best way to announce a price increase to your clients? Let me share some methods with you, along with some points that will make the task easier for you and make your clients more receptive to the news. Signs you should increase your prices. Before I get to how to increase prices, here are four signs indicating it's time for you to increase your rates. 1) Your operating costs are increasing. As the cost of subscriptions, software and other expenses go up. You need to raise your rates to offset the economy's effect on your business. 2) You're consistently busy. Suppose you have an abundance of projects that never seems to end. Or you find yourself turning down work because you don't have time for it. Raising your rates can help you offset things and enable you to engage the help of subcontractors to ease the burden. 3) You're prices are too low. Some clients won't take you seriously if your prices are too low. If you want to attract a higher level of clientele, you need to raise your rates. 4) You've increased your value. Over time, you'll gain experience and knowledge. As the value you offer increases, so should your prices. So now that you've deiced to raise your rates. Here's how to inform your clients of the price increase. Keep it short. Announcing a price increase is a serious matter, and you want to ensure your clients take notice. Keep it short and to the point, if you tell your clients via email. There's no reason to include any fluff or to go into the philosophy behind the price increase. If possible, announce the increase alongside more pleasant news, such as new or improved services you're offering. It will help soften the blow. And make sure you give the clients a way to contact you should they want to discuss your new rates. Tell only affected clients. Nobody likes to hear about price increases, even if they don't affect you directly. You may not be in the market for a new car, but hearing about rising automobile prices still leaves a bad taste in your mouth and may even affect your perception of the various auto manufacturers. Don't give your clients a reason to think negatively about you. If you're increasing the price of a business startup package you offer, there's no reason to notify already established businesses because it doesn't affect them. Suppose the price of your website hosting and maintenance is going up. Notify the clients already paying for your plan. There's no reason for you to tell clients whose websites you are not maintaining since it doesn't affect them. If you're raising your hourly rate, only notify those clients you charge by the hour. And there's no reason to notify clients of a price increase if you're not currently working on a project for them. They'll find out the next time you give them a quote. Only notify affected clients of these price increases. And if this means advising different clients about price increases for various services, so be it. Send out one letter to your web maintenance clients. Another note to your retainer clients. Another to your hourly rate clients, and so forth. Ensure your clients are notified only about the price increases affecting them. Don't give your clients a reason to think negatively about you if your price increase doesn't affect them. Give clients enough of a warning. The more time you give a client to accept and adjust to new prices, the better. Clients will resent a sudden price increase far more than a price increase that will occur in the future. The more time they're given to think about it, the easier it will be for them to accept the increase. Don't forget some clients may require time to adjust their budgets. More prominent companies may need approval from higher up the corporate ladder. The idea is to give clients time to come to terms with your higher rates. And if you're worried about losing clients due to a price increase, remember that it's much easier for them to pay your higher rates than finding someone new to deal with. The chances of losing clients are slim. But should it happen, the increased revenue you'll now receive from your other clients should make up for it. Giving enough warning also allows clients to place new orders before your prices go up. Don't make excuses or apologize for a price increase. Notifying your clients of a price increase is not the time to sugarcoat things. Be confident and direct, and inform them plainly that your rates are increasing. Be as straightforward as possible. Say your prices are increasing. Don't say you're adjusting your prices or bringing them in line with your services. This will only confuse your clients. They all know what an increase means. Do be empathetic with them. Tell your clients you appreciate their business. Thank them, and let them know it's because of them you've been able to grow. Show your clients that your appreciation for them goes beyond the money they spend with you. Justify your price increase. Justifying the reason behind your price increase gives the client something to understand and relate to. It shows your clients that your decision to raise prices isn't only to increase your revenue. They'll appreciate your transparency and will be more open to the change. Explain in your own words why you're raising your rates. Don't use jargon or corporate speak. Be specific without going into too much detail. Have you increased or improved the services you offer? Have you undergone any new training or acquired new equipment or software that will improve overall results? Have your existing tools increased costs, causing you to raise yours? Explain the increase in a way that highlights the value to your client and ties the price increase to the benefits they'll receive by continuing to work with you. After all, if they now have to pay you more, it would be nice for them to know why your rates have gone up. Remind clients of your value. Your clients initially chose to work with you for a reason. Now's a good time to remind them of that decision and what they can expect from you. You may want to offer your clients a deal as an added value to accompany your price increase. You could offer them more deliverables along with the increase. Such as adding social media banners to your business startup package or free domain registration with your website maintenance plan. For example, you could offer a free month of your website maintenance plan. Your prices are increasing for everyone on your maintenance plan. But as a long-time valued client, you can offer them the first month for free. Small incentives will soften the blow associated with the increased expense. Ensure your clients feel appreciated. First off, personalize your email. Don't write one email to send to all clients. Personalize your message by referencing the client and the work you do for them. Explain the value the client is getting, not the pain points you and your business are experiencing. Higher prices should either mean better value for them. Or give you the ability to maintain the same high quality they've come to expect from you. You could even offer them a deal to lock in current prices for a fixed period. Prices are going up next month, but you can lock in the current price for the next six months if you pay in advance. Whenever possible, inform your clients of a price increase in person or over the phone. They'll appreciate the personal dedication and feel better about paying the new rate. Keep your clients happy while notifying them of a price increase. You've worked hard to be where you are today. And you deserve to be financially compensated for what you do. You're only doing yourself a disservice if you don't raise your rates. Announcing a price increase is never fun. But following the tips I provided should make it easier to communicate the change to your clients and ease the transition for them. Get what you deserve. You're worth it.

That's mostly because the new advisor or brokerage firm you're working with is going to do most of the work for you. Paperwork you'll sign 2 step process - Notifying your advisor is optional - your advisor can handle this for you if it's too uncomfortable. Why it's a good idea - worked with them for a long time. If the advisor is rude or tries to intimidate you to stay, that's rare, but you can take that as verification that you've made the right decision in leaving. Most good advisors will appreciate honest feedback in what went wrong. All advisors lose clients. The best advisors only have 1-2% of their clients leave in a given year, but it does still happen. I always ask when someone leaves and I appreciate knowing what went wrong so I can identify any patterns and make sure it doesn't happen again. ACAT is all back-office (advisors are not involved. Optus has begun notifying some of their customers directly if they have been impacted by the massive data breach. Optus says a massive cyber attack on the telco could have been executed by a crime gang or even a foreign state. The hackers hid their tracks by shifting their online location markers across different European countries. Andrew Sheridan, Vice President of Regulatory & Public Affairs at Optus told Mark Gibson on Perth Live that the attack has been shut down. "Because of the nature of the attack, it is now a criminal investigation - but the key point is that our network and services are secure," Mr Sheridan said. "We are not completely sure of the exact number but the worst case scenario is that 9.8 million accounts have had some data accessed. As we complete those investigations we think it'll be a lower number." Speculations grew fast throughout Friday that Optus did in fact have knowledge of the data breach on Wednesday and only alerted customers on Thursday. "We identified the breach throughout the course of Wednesday but we then had to go through processes and investigations to determine the exact nature of the breach and whether customer information had been accessed or not. So this took a number of hours into the night and Thursday. On this Episode of The New CISO, Steve Moore is joined by special guest Mark Ferguson, the CISO for a cyber security company Bombardier. They discuss roles of a CISO in cybersecurity and the strategies involved in dealing with breaches and building teams. Moving to Canada Originally from Scotland but now residing in Montreal, Canada, Ferguson shares some background on where he has lived in the past and the process of moving to Canada. Ferguson expresses his excitement of experiencing Montreal when it becomes more open. He has been taking some French classes to become better acquainted with the language. Travel Ferguson has been able to travel often and live in many places for his job. Opportunities to relocate have been present multiple times throughout his career. Ferguson advises taking opportunities to relocate for a career. He has moved to the United States, to Poland, and now to Canada. He enjoys the experiences of new places. Moore discusses how relocation may be less common in companies based out of the United States. First CISO Role Ferguson reflects on the decision to become a CISO. He honestly admits that some days it can be exhausting and doubts can arise. There are good days and bad days in the role. At the end of the day, he knows he is capable of solving any problems that arise. The role brings a lot of diversity. Getting to be a CISO/4 Pillars How did you get to the point of being a CISO, Moore asks? Ferguson says he had a great mentor and was able to help identify his assets. Getting things done and strategic planning are important as well. The four main pillars of strategy are. 1). Educational awareness 2). Strong Identity Management/Data Security 3). Strong basics of IT management and maintenance 4). Using agile technology Building a program & Facing Challenges You have to know what players you need to make things work. Building strong relationships is important and will assist with the aspect of vulnerability management. It can be a challenge to identify where problems lie and explaining the problems can be a challenge as well. Ferguson notes these are things he still actively is working on. Moore notes that the CISO position can be nearly impossible at times. However, others pulling their weight in the company is essential. IT systems are extremely complex and joining everything to work as one can be difficult. This is, realistically, not a simple problem to solve. Breaches with assets could be a big detriment to the company. Holding people accountable and working together is one way to avoid these breaches. Running audits is time consuming, but important to keep everything in check. Best parts of the job Ferguson shares some of the best parts of his job. One of his favorite things is building great teams. Finding great people to work with is very rewarding. These people don't have to be perfect, but finding what makes them an asset to the team is great. Inevitably, these team members will come and go, but developing great teams is one of the best parts of the CISO role, says Ferguson. Breach Response Plan One of the first lessons to learn is that a cyber breach is not a cyber security problem. Ferguson mentioned that they recently faced a breach, and there is a lot to learn from the situation. This occurred at a critical time. They assumed the breach would be coming from the bottom up, however it was at a more executive level. Their team learned about internal response from this. A good response to a breach is having the right people involved in the situation. A business team to be involved in the response is important because it is a business problem. Quickly building out this team is very important. Making sure everyone knows what the problem and objective are is essential. Once a breach occurs, there is a lot of responsibility involved. People often don't understand the size of this responsibility until it occurs. With the right culture and leadership, response will occur more smoothly. Important response tactics are Heat of the moment Assumptions don't matter Speed Scale Openness to any idea Understand your role in the process Communicating with the Customer Ferguson states that this is one of the most important ways of responding to a breach. Notifying the customers off the bat is necessary. How do you notify them? Ferguson shares how he approached communication. Turn to key stakeholders first and listen to others as well during the process. Having conversations will be time consuming but will ultimately go a lot further than sending an automated message. Many people will want to speak with the people directly involved because it gives them confidence with the answers they are receiving. Growing Ferguson shares how this has helped him to grow as a leader. He was balancing a lot at the time of the breach so it forced him to test and extend himself to tackle the series of events. He now has a new capacity he can operate at. Real life experience is truly the only way to learn a situation like this. Ferguson also notes he is not always going to be the smartest person in the room, although that is the expectation of the CISO. Being ready to handle this challenge is important when taking on this role. Be sure to convey confidence when coming up with a plan. Working through challenges grows us professionally. Being a new CISO What does being a new CISO mean to Ferguson? A key piece is being the crisis manager. Managing many things successfully can be a challenge, so managing these crises is a large part of being a CISO. Having a high stress threshold is a necessary skill, as well. In this episode Crystal touches on the fact that everyone has to start with a lower fee, due to being new to the craft, but as your experience grows your prices need to grow too. When it is time to increase your rates, you can inform your current clients that your prices will be increasing as of a particular date. Notifying your existing Clients will make them aware that you are more experienced and therefore more valuable. This will also inform current clients that anyone they refer to you will be paying a different price. In some cases, the current clients who are used to paying a smaller fee may agree to pay more to get more value from your work or not, either way, you will be paid your worth. Hours after the Union Ministry of Railways extended the suspension of its passenger train services till May 3 due to coronavirus lockdown, Indian Railway Catering & Tourism Corporation (IRCTC) Ltd. declared a full refund for booked tickets till May 3. The refund will be relevant to all booked tickets. Notifying about the latest update, "For trains canceled by Indian Railways, a full refund will be provided automatically by IRCTC. Users need not cancel their e-tickets. Full fare will be credited back into the user's accounts from which payment was made." Earlier, the Ministry of Railways has too extended suspension of its passenger services till May 3.
