Johns Hopkins All Children's Hospital (JHAC) in St. Petersburg, Florida, found itself back in court on Friday, seeking a new trial following a groundbreaking civil case where they were found liable for mistreating a chronically ill young girl, Maya Kowalski, and her family, ultimately resulting in the tragic death of Beata Kowalski, Maya's mother. The hospital's ordeal, as depicted in the Netflix documentary "Take Care of Maya," gained critical acclaim for exposing the alleged mistreatment of the young girl and her family. In a civil trial earlier this year, a six-person jury in Sarasota County unanimously ruled in favor of the Kowalski family, awarding them a staggering $261 million in compensatory and punitive damages, far exceeding their initial request. However, JHAC is now compellingly arguing for a new trial, primarily based on allegations of juror bias and misconduct. The hospital's attorney raised several key points during the recent proceedings: 1. **Juror Misrepresentation:** JHAC's legal team alleged that Juror No. 1 misrepresented material information during jury selection. The juror failed to disclose that he had been a victim of a crime in the past, specifically a threat by his stepson. Dean's Chat host, Dr. Jeffrey Jensen, is joined by Dr. Alan MacGill. Dr. MacGill is board-certified by The American Board of Foot and Ankle Surgery in foot surgery as well as reconstructive rearfoot and ankle surgery, the latter of which is only achieved by a fraction of the current practicing foot and ankle surgeons in the country. Dr. MacGill is one of a handful of surgeons in the Miami area currently performing total ankle replacement with preoperative computerized tomography (CT) -guided navigation and custom cutting guides: a technological evolution that enhances implant position and ultimate longevity of the new joint. He is a Fellow of the American College of Foot and Ankle Surgeons (ACFAS) and currently serves as a member of the Board of Directors as well as the Chair of the Regions Presidents Council. A native of Florida, Dr. MacGill grew up in Tampa and attended the University of Florida in Gainesville. He majored in Pre-Medical studies and minored in Sociology, earning his Bachelor of Science degree with honors. He then attended The William M. Scholl College of Podiatric Medicine at Rosalind Franklin University in North Chicago, Illinois. He graduated in the top 10th percentile of his class and matched with his first choice for residency at Florida Hospital in Orlando, Florida; a top-tier foot and ankle surgical residency in Florida by case volume and diversity. During his residency, he completed numerous additional surgical training courses with an emphasis on adult and pediatric reconstructive surgery, external fixation, ankle arthroscopy, lower extremity trauma, and diabetic limb salvage. In 2007, Dr. MacGill was selected for the prestigious AO International Trauma Fellowship with Sigvard Hansen, Jr., MD, Chairman Emeritus-Orthopedics at the University of Washington's School of Medicine. Dr. MacGill completed his fellowship in the spring of 2009, gaining additional training in total ankle replacement as well as complex Charcot foot and ankle reconstruction. Dr. MacGill is the Director of the Foot and Ankle Surgery residency program at Northwest Medical Center in Margate, FL and previously served as Assistant Director and Research Director for the Bethesda Health Foot and Ankle Surgery residency program in Boynton Beach, FL. He participates in weekly didactic lectures, surgical grand rounds, journal club meetings, and cadaver lab workshops with the residents and students. He has also published several articles in peer-reviewed journals, given award-winning case presentations at state scientific meetings, presented numerous scientific research posters, and lectured at both state and national conferences. Dr. MacGill is also a Certified Wound Specialist (CWS) by The American Board of Wound Management and treats problematic lower extremity wounds both in the office and at the Broward Health Wound Care & Hyperbaric Medicine Center in Coral Springs, FL. The center achieved the “Center of Distinction” award for the 8th consecutive year and the “Center of Excellence” award for the 6th consecutive year. Both awards are given for exceeding benchmarks for healing and patient satisfaction. Furthermore, Dr. MacGill is a member in good standing with the American Podiatric Medical Association, the Florida Podiatric Medical Association, and is a former officer of the Palm Beach County Podiatric Medical Association. So, I am a huge chocoholic. I will do anything for some chocolate. So, to go on something that said, listen, you can't have chocolate anymore. I would have to question my living for the rest now because it'd be like, where you just took my chocolate away? What else is there? So, I would definitely we never say you can't have this, you can't have that because it's not realistic and it's not sustainable. You know, we want you to have that chocolate cake. But I mean, we want you to have pieces of it a portion of it a healthy portion. Chef Rich Rosado You see all these ridiculous diets, and a lot of them are just regurgitated diets from yesterday, you know, we're going to change the name, we're going to rebrand it, and we need to, you know, spit this out again. And I blame a lot of this on like, I call it social media university. You have a lot of people that go on social media, they cherry pick information, and then they get their doctorate in, you know, social media University, and they start putting this out to everybody. Well, I can only eat dandelions standing on one leg on Fridays, and this is the best way to get healthy is to do that. And then they promote it, promote it promote it and people actually start to believe it. So, what it does, is it makes a confused, and complicated, very, very complicated way of thinking of how to get healthy. Chef Rich Rosado Alright, so you want to make sure that your heart and your mind are together to say, I know we can do this, we can definitely do this, and then start eating healthy fats. Then start eating lean protein and stay away from the fatty proteins and good carbs, you know, stay away from the white carbs. Obviously, start to have a lot of different whole grains. And one of the things that we've seen, when we talk about this with a lot of people is they want to do the right thing they just don't know how to. They don't know how to cook brown rice, they don't know how to cook barley, they don't know how to cook this vegetable. We did a whole program for the city of Orlando out here. And what we...one of the things that we heard time and time again, is I didn't know what that was, I didn't know what that vegetable was. So, I never bought it because I didn't know what it was. Today we won 7-0 in front of the Board of County Commissioners So, I'm thankful for that, but even more thankful I don't have to drive in rush hour traffic to and from work every day. I'm extremely grateful that my father is supposed to be discharged from St. Joseph's Hospital North today. He's been there since Saturday for dehydration. The kidney doctor says his kidneys are fine. No one seems to know why he keeps getting so dehydrated and short of breath. His lungs are in great shape, which is amazing since he smoked up until his heart attack in 2011 or so. Back to our win. Florida Hospital wants to build an urgent care center at the corner of Gunn and Citrus Park Lane? in the D1 parking lot. We are fine with that, but they wanted an extra access road that would eat up the available traffic allowances for the area that were paid for by Chris Daye and were to include our traffic, once he builds his two hotels. We have been trying to work with Trey Traviosa and the hospital partners; even offering to pay part of the improvements, but I think they thought they could just bulldoze over us. Howie did an awesome presentation to the BOCC and we won 7-0.
