The Supremacy Clause Source: Excerpts from "The Supremacy Clause: A Law School Lecture" Main Themes: Federal Supremacy: The Supremacy Clause (Article VI, Clause 2) establishes the Constitution, federal laws made pursuant to it, and treaties as the "supreme Law of the Land," overriding any conflicting state laws. Federalism and State Sovereignty: While affirming federal supremacy, the Supremacy Clause operates within a framework of federalism, recognizing the reserved powers of states under the Tenth Amendment. Conflict Resolution: The Supremacy Clause provides a mechanism for resolving legal disputes between state and federal laws through the doctrine of preemption. Judicial Interpretation: Landmark Supreme Court cases have shaped the interpretation and application of the Supremacy Clause, defining the boundaries between federal and state authority. Most Important Ideas/Facts: Three Types of Supreme Federal Law: The Constitution: The foundational document, superseding any state action that contradicts it. Federal Laws: Laws enacted by Congress "in pursuance" of the Constitution, overriding conflicting state legislation. Treaties: Ratified agreements with foreign nations, holding equal standing with federal laws and preempting state laws. State Judges Bound: The Supremacy Clause explicitly binds state judges to uphold federal law, ensuring consistent application across state court systems. “Judges in every State shall be bound thereby, anything in the Constitution or Laws of any State to the Contrary notwithstanding." Preemption Doctrine: The Supremacy Clause gives rise to the preemption doctrine, which determines when federal law overrides state law. This includes: Express Preemption: Congress explicitly states its intent to preempt state law. Implied Preemption: Field Preemption: Federal law is so comprehensive that it leaves no room for state regulation. Conflict Preemption: Compliance with both federal and state law is impossible (direct conflict) or state law hinders federal objectives (obstacle preemption). Landmark Cases: McCulloch v. Maryland (1819): Established the principle of implied powers and barred states from taxing federal institutions. Gibbons v. Ogden (1824): Upheld federal supremacy in regulating interstate commerce. Arizona v. United States (2012): Reaffirmed federal preemption in the area of immigration law. Anti-Commandeering Doctrine: Limits federal power by prohibiting the federal government from forcing states to enact or enforce federal regulations. Limitations of the Supremacy Clause: Federalism Considerations: The Tenth Amendment reserves powers to states, allowing state laws to operate where there is no direct conflict or preemption. Presumption Against Preemption: Courts tend to favor state law in areas traditionally regulated by states, unless Congress clearly intended preemption. Concurrent Jurisdiction: Federal and state laws can coexist in many areas, permitting states to enforce their own laws and exceed federal requirements as long as there is no conflict. Quotes: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land." "Judges in every State shall be bound thereby, anything in the Constitution or Laws of any State to the Contrary notwithstanding." "[The Supremacy Clause] was essential to addressing these issues, creating a mechanism through which federal laws, including treaties and constitutional provisions, would bind states and local governments." Conclusion: The Supremacy Clause is a cornerstone of the American legal system, ensuring the consistent application of federal law and resolving conflicts between state and federal authority. Understanding the Supremacy Clause is essential for grasping the dynamics of American federalism and the balance of power between the federal government and the states. --- Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

Article Six of the United States Constitution establishes the laws and treaties of the United States made in accordance with it as the supreme law of the land, forbids a religious test as a requirement for holding a governmental position, and holds the United States under the Constitution responsible for debts incurred by the United States under the Articles of Confederation. Text. All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation. This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding. The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be Required as a Qualification To any Office or public Trust under the United States. Clauses. Debts. The first clause of the Article provides that debts contracted prior to the adoption of the Constitution remain valid, as they were under the Articles of Confederation. Supremacy. Clause two provides that the Constitution, federal laws made pursuant to it, and treaties made under its authority constitute the supreme law of the land. It provides that state courts are bound by the supreme law; in case of conflict between federal and state law, the federal law must be applied. Even state constitutions are subordinate to federal law. The Supreme Court under John Marshall (the Marshall Court) was influential in construing the supremacy clause. It first ruled that it had the power to review the decisions of state courts allegedly in conflict with the supreme law, claims of "state sovereignty" notwithstanding. In Martin v Hunter's Lessee (1816), the Supreme Court confronted the Chief Justice of Virginia, Spencer Roane, who had previously declared a Supreme Court decision unconstitutional and refused to permit the state courts to abide by it. The Court upheld the Judiciary Act, which permitted it to hear appeals from state courts, on the grounds that Congress had passed it under the supremacy clause. The Supreme Court has also struck down attempts by states to control or direct the affairs of federal institutions. McCulloch v Maryland (1819) was a significant case in this regard. The state of Maryland had levied a tax on banks not chartered by the state; the tax applied, state judges ruled, to the Bank of the United States chartered by Congress in 1816. Marshall wrote that "the States have no power, by taxation or otherwise, to retard, impede, burden, or in any manner control, the operations of the constitutional laws enacted by Congress to carry into execution the powers vested in the general government." United States property is wholly immune to state taxation, as are government activities and institutions. Congress may explicitly provide immunity from taxation in certain cases, for instance by immunizing a federal contractor. Federal employees, however, may not be immunized from taxes, as the tax would not in any way impede government activities. --- This episode is sponsored by · Anchor: The easiest way to make a podcast. https://anchor.fm/app

According to 'Trane himself, as written in the liner notes to A Love Supreme, “The music herein is presented in four parts. The first is entitled "ACKNOWLEDGEMENT", the second, "RESOLUTION", the third, "PURSUANCE", and the fourth and last part is a musical narration of the theme, "A LOVE SUPREME" which is written in the context; it is entitled "PSALM".” It is also this Psalm, this meditation, part of which I read at the outset, that Coltrane would place on a stand and play as he performed, producing/reproducing what he said is a musical narration of the – Love Supreme. Alice Coltrane, a multi-instrumental genius and enlightened spiritual leader is not just Coltrane's wife. She started her journey before meeting Coltrane. And because of this set her path to cultivate rhythms that can heal the world just as John Coltrane discovered he could do. It could be surmised that her presence in John Coltrane life was divine. It was guided by universal law - a law that states everything is in rhythm, everything is in constant motion. Everything is vibrational. And as we move through life this constant hum, this vibrational hum is sure to attract its tonal partners. In the November 1967 issue of Ebony in an article titled: Requiem for ‘Trane, Archie Shepp suggests that “he [‘Trane] was a bridge…the most accomplished and comprehensive of the so-called post-bop musicians to make an extension into what is called the avant-garde…” (Shepp, 1967). Something else to consider, specifically in relation to John Coltrane being a bridge, standing in a deeper tradition, according to Youngquist in A Pure Solar World Sun Ra and the Birth of Afrofuturism, “in the mid-fifties Sun Ra gave a broadsheet entitled “Solaristic Precepts” to John Coltrane. On the broadsheets Sun Ra wrote “Warning this treatise is only for Thinking Beings..." (238). A thinking Being, indeed… In an interview years later, Coltrane would state that, “I think music can make the world better and if I'm qualified, I want to do it. I'd like to point out to people the divine in a musical language that transcend words. I want to speak to their souls”. And it was with Alice Coltrane who not only accentuated and amplified Coltrane's ability to synthesis the rhythmic patterns he put together, as he listened to vibrations most of us are unable to, they both became eternal beings, thinking beings who were able to conceive of the Negative reminiscences of Space-Time, as is expressed in Is, Are, Be and reconcepted “AM”. For longtime listeners of Parallax Views Barrett Brown needs no introduction. He's been a reoccurring guest on the program and is something of a legend for his rabble-rousing involvement in Anonymous. Now based in the U.K., after years of struggles in the U.S. including bouts with the FBI, Brown recently restarted Project PM, which dealt with investigating the cyber-military industrial complex (Palantir, HBGary, etc.), as well as starting Project Swartz (named after the late Aaron Swartz) and Project Hastings (named after the late Rolling Stone journalist Michael Hastings; who Barrett interacted/worked with). Brown believes that software technology can be used to assist dissident fighting powerful nation-states on the battlefield of global information warfare. He explains how Pursuance, his main project, is seeking to make this all a reality and discusses some of the problems activists face from federal law enforcement (the aim of Project Hastings is to assist activists and whistleblowers), how media incompetence and malfeasance needs to be called out (the aim of Project Hastings), and the possibilities for activits going forward in terms of information warfare networks that can be used to assist in the fight against corrupt nation-state and for democracy.

In this paper, Hamilton defends the last clause of the eighth section of the first article of the proposed Constitution in relation to the legislatures power it reads, “to make all laws which shall be NECESSARY and PROPER for carrying into execution THE POWERS by that Constitution vested in the government of the United States, or in any department of officer thereof.” Hamilton also defends the second clause of the sixth article declaring, “that the Constitution and the laws of the United States made IN PURSUANCE THEREOF, and the treaties made by their authority shall be the SUPREME LAW of the land, any thing in the Constitution or laws of any State to the contrary notwithstanding.” Mike uses some real life examples such as the second amendment to help accentuate Hamilton's point. With her deep jazz roots, she was soon in demand as an arranger and horn section leader, landing stints with such acclaimed artists as Anita Baker. This week Eric welcomes to the show award-wining journalist Barrett Brown to discuss his recent and very public falling out with Julian Assange, his perspective on Wikileaks and the role of Assange within it, and his exciting new Pursuance Project. The first half of the conversation explores Brown's work, his relationship to Assange/Wikileaks, and the circumstances that led to Brown's serving four years in prison. Barrett explains how his conflict with Assange developed, and provides insights into some of the internal conflicts roiling Wikileaks now, and in the recent past. The second half of the show provides a detailed exploration of Pursuance: what the project is, why it's critically important, and how it could fundamentally transform journalism, among other things, in the 21st Century. This is an explosive, jam-packed show...don't miss it! Music: The Coup - "Laugh/Love/Fuck" More The post Barrett Brown – Episode 109 appeared first on CounterPunch.org.

Read the blog post here: http://bit.ly/CSpodcast28 Janie Barnett's new CD, "You See This River" is original, personal, and beautiful; the fact that she put it out 30 years into her career intrigued me. I wanted to know how she's managed to piece her career together so many years, before, during, and after raising children, all the time staying in NYC. I wanted to find out how an artist keeps their fire for creating new material into their 30s, 40s. and beyond. Let's face it- half of the battle for most artists is LASTING. Persevering through various life phases, relationships, parenting -whatever inevitable strains that force us this way or that way to compromise on the pure pursuance most of us felt when we were first starting out. Many artists freelance for a few years, even ten or more, and then take day jobs, quit music altogether, find the most stable performing or teaching gig they can- anything they can settle into. Many artists who move to NYC leave after a few years, if they even make it that long. Janie maintains streams of hustle and creative work, from teaching to producing, writing, and performing. She's still going for it in every sense. You've got to respect that. In the Creative Strings Podcast Episode 28, we discuss topics such as: - Learning language to communicate between musicians - Janie's new CD "You See This River" - Having kids and starting a family while sticking with your art - The importance of letting go as an artist for self discovery Please take a moment to visit our sponsor Electric Violin Shop, your one-stop shop for electric instruments, amps, gear, accessories, and most of all, expertise. By maintaining an aggressive path of musical study and professional achievement, W. Lee Hogans has fashioned a distinct musical style. He formed his own band Pursuance in 2004. His songs, featuring strong grooves with catchy melodies, encompass the worlds of Jazz, Hip-Hop, and Soul. Stylistic influences range from Lee Morgan and Freddie Hubbard to James Brown and Run DMC. Lee recently signed to the Japanese record label P-Vine and released his second album with Pursuance entitled What We Play is Life. WWPIL hit the market in 2015, reaching 2nd place on the Japanese iTunes charts just behind Tony Bennett and Lady Gaga. Lee Hogans and Pursuance has also dazzled audiences at many destination venues throughout New York and New Jersey, including the famous Blue Note jazz club, where the band is in residency backing up Hip Hop legends like Prodigy, Masta Ace, and Grand Puba. Lee has made influential moves in his career as a trumpeter-in-demand and producer, diligently making a name for himself in New York City and the tri-state area. When not touring with prominent musicians and performance acts, Lee is in the studio recording, producing and mixing songs with such artists as SoNuVo, Felix Peikli, Mark Ronson, Jadakiss, Fantasia, Missy Elliot, Busta Rhymes, Sheila E, and Prince. •••• The B-Side Podcast is produced by Charlie Hoxie, Kecia Cole, Ro Johnson and Sachar Mathias; recorded by Onel Mulet; and edited by Khyriel Palmer and Emily Boghossian. Apologies for the hiatus! I'm back after my birthday weekend and our guest this episode is my good friend Chris. Chris is an English teacher, tattoo enthusiast, and not to forget musician. I talk to him for my birthday present as we talk about his creative process with making music for his upcoming album and his past endeavors in scoring for films and much more. Here his music at https://chriswilkey.bandcamp.com/releases
Regular listeners of the show may notice this episode posting later than normal. That's because the normal posting date was during Pycon and I was hanging out in beautiful Montréal Canada enjoying the largest gathering of Python developers in the world. And I'm recovering from Easter weekend and a ham hangover. But lest this devolve into your typical blog post we've compiled 8 tracks of some amazing metal music, starting off with Sam Whitaker (feat. Jake Barnes of the Final Chapter), as well as brand-new music by EWÏG FROST. We also have the amazing new album by electronic black-metalers Psygnosis, and the jazz-influenced black metal of Schattenbrandung. There's also post-metal sludge from Wovka, the groove-djent stylings of Pursuance, and the groove metal of Azoah. Capping off the show is the catchy prog-metal of Pervy Perkin. So feel free to move about this episode freely, and be sure to make copies of the music for your friends. Just don't get too spooked at the gremlin ripping off the wings. I think I need a drink to calm my nerves. (00:10) Natural Force [Feat. Many of my Artwork Witness a “Strange” Solitude.. as an Identity almost goes off.. to be honest in background here is running 280 | Storm (around 85’min was my wake up today).. as the season 4 was not big enough.. I wish you have the time to listen to a fourth of It.. to Understand it as I do.. Intense as I feel.. you will be witness of an Originality of some Epic Underground..Moments later switched this to my 292 | Strange Artwork.. too end up this Article need some relativity.. First steeping in to Dubstep with a Ministry of Sound Conference.. was the most natural step of my carrier.. in March 2011.. Because I realized that Pursuance was released in Aug 2010.. I would say a Evolution of my Generation.. relative to my Path.. “The only aspect I’m egocentric on is my Art..” the only really knowing me.. my own Witness.. my truly “Instinct”.. I came back from Greece 2 days a go.. found finally the words to express this Artwork.. I went with this “Strange” Origin around the World.. but the answers are in the Edition itself.. I have try to compile a live composition to explain a complex evolution of my Art.. you can tell me.. Art as to be simple.. - Yes as to look simple.. but between doing it look simple and looking simple.. there are two main factors.. where the epic originally merge the “Icestep..” Fatality is a result of analyze to me.. because it only reflect logical senses.. If someone ask you who da fuck is *icemoon.. go and say.. play 292.. make sure you play it all.. let me know if you are able to reach end of this one.. If you don’t understand.. replay it again.. and over again.. or “Forever” until you get it.. don’t come back with like an “Weak Ass Bicth” - “what you mean about this?”.. because the answer is there only and somewhere and between your mind.. ..Strange I tag this Artwork.. the “Neomessi”.. my alien frequency.. bows to the playlist.. thank you artists around the world to have made this possible.. we all got that shit going on here.. there was a time for instoration.. it was time for foundation.. now it’s time for recognition.. it’s time for inspiration.. it’s time for new generation.. because you are my motivation.. it’s Time for Icemoon.. my MALAKAAAAAAAAS.. ..See you in August @ SUNNY BEACH | Beach Party - ICEMOON Live | Kefalos 2012.. Article VI All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.

"I just want to celebrate, yeah, yeah!" Today I celebrate the Supreme Court decision to end the misinterpretation of the Second Amendment of the US Constitution in our nation’s cities and my 46th birthday. (I am 30 years old with 16 years experience!) This podcast will use a few bars from Motown’s Rare Earth, “I just want to celebrate” which pretty much captures how I feel about everything right in my life. Interesting note is that this was one of Motowns first, all White American groups that had this hit in 1971. I love the fact that music is universal and the color of your skin doesn’t mean “jack”. Play that funky music … OK the Supreme Court of the United States agrees with us that the Second Amendment is an individual right. Now what? I know there is confusion as to whether the law where you live is a state or federal law and which one will finally rule. The Supremacy Clause in the Constitution says: This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any thing in the Constitution or Laws of any State to the Contrary notwithstanding. Meaning that federal law always trumps state law if there is a conflict between the two. If there is no conflict then the state law will be used but if there is any question or conflict of the two reading as the same, then the federal rule would win. The bad news is, cities and states can and will still create restrictions to keep you from being able to protect yourself and family in the letter of the law. It is no coincidence that lawyers become politicians.
