Drone News: FAA BVLOS NPRM Missed, Drone Ban Proposal, and Drone Hits Helicopter in TX

First up, it's another case of "hurry up and wait" for our drone industry. The FAA has missed another major deadline for publishing the much-anticipated Beyond Visual Line of Sight, or BVLOS, Notice of Proposed Rulemaking. This time, the deadline was set by a presidential executive order. On June 6th, 2025, President Trump signed the “Unleashing American Drone Dominance” order, which gave the FAA a very aggressive 30-day timeline to issue the proposed rule. Well, that deadline was July 7th, and it came and went with no NPRM in sight.This new missed deadline joins the one from the FAA Reauthorization Act of 2024, which mandated the NPRM be published by September 16, 2024. A Bit of history: The BVLOS Aviation Rulemaking Committee, or ARC, delivered its comprehensive 381-page report with 70 recommendations all the way back in March of 2022. That report gave the FAA a set of recommendations for enabling BVLOS. Next up, Florida Senator Rick Scott has introduced the "Drones for America Act," a bill aimed at banning Chinese-made drones and their components while trying to boost U.S. manufacturing. The bill proposes a phased approach. It would implement a full ban on the sale of Chinese-manufactured drone systems by January 1, 2028, and a ban on Chinese-made components by January 1, 2031. In the meantime, a gradually increasing tariff would be placed on these items to phase them out of the market. The revenue collected from these tariffs would be used to fund a grant program. This program is designed to help American companies develop and produce U.S.-manufactured drones and components along with helping first responders, law enforcement, and even farmers and ranchers purchase these American-made drones. However, this bill neglects the largest users of drones, small businesses and recreational flyers. Right now, there are no real alternatives to DJI for consumers and small businesses. And we've heard from the people who are likely behind this bill that there has been NO study done to determine the output of drones from American Manufacturers. These bill threaten to destroy the drone industry in favor of a few American manufacturers, who don't even have an interest in making consumer drones. Please reach out to your Senators and Representatives and tell them this is not a good idea. And finally this week, a story that serves as a critical reminder for all of us about why the rules exist. On July 7th, during catastrophic flooding in Kerr County, Texas, a drone reportedly collided with a rescue helicopter. The helicopter was forced to make an emergency landing and is now out of commission. This has sidelined a critical life-saving asset in an area where, tragically, over 100 people have died. As the owner of a marina, Kate Gervais is used to seeing boats in the water. But for the last couple of days, she's been seeing them in the air. The Washington Department of Natural Resources (DNR) used one of its firefighting helicopters to haul abandoned boats off an uninhabited island in the southernmost reaches of Puget Sound, where the vessels had come to rest after drifting with the currents, and fly them to the mainland to be deconstructed later. With 14 vessels removed, it was the agency's largest operation of its kind, officials said. "It was a very, very weird sight," said Gervais, who owns Boston Harbor Marina, just north of Olympia. "The sailboat with the mast was the weirdest one to see." A boat removal by helicopter is typically done by a private pilot, but for this operation, which was funded by a federal grant, the DNR opted to use one of its firefighting helicopters. It was cheaper and helped stretch the $1 million National Oceanic and Atmospheric Administration (NOAA) grant, said Commissioner of Public Lands Dave Upthegrove. The state agency opts to airlift boats when towing them would disrupt the marine bed or the surrounding environment too much. The aquatic lands where the boats land often include kelp beds, which are critical for supporting the forage fish that salmon rely on. Vessels for this operation were found in hard-to-reach coves, at the tree line or in mud that rendered an airlift a better option, agency staff said. Since the boat removal program began in 2002, the department has hauled out more than 1,200 derelict vessels. There are at least 300 more out there, with more found all the time, Upthegrove said. "It's a real challenge impacting the Puget Sound when people essentially dump their old boats into the water because they don't want to deal with disposing of them," he said. On todays podcast, I speak with Australian Army Black Hawk and Chinook helicopter veteran Kevin Humphreys. Kevin is an inspiring and transformative international keynote speaker, mentor, and author. He's well-known for smashing stereotypes and transforming self-leadership. Graduating top of his pilot's course at just 21, Kevin went on to serve in the Army for 20 years flying Black Hawk and Chinook helicopters. He deployed on numerous overseas operations. In 2006, Kevin was one of the Chinook pilots who flew in under fire into a hot HLZ to pick up the Canadian Special forces in the battle of DA Nile. 24 Commandos were left on the ground facing 300 Taliban. Head back to listen to episode 100 with Craig Hamburger, he was one of the 24 Commandos on the ground that day, and speaks about the respect he has for Kev and the other Chinook pilots that day. Towards the peak of his career, Kevin contemplated suicide and suffered a breakdown due to a cocktail of mental illness, alcohol abuse, and a toxic culture. Kevin not only got back on his feet but also back in the air again, spending the next ten years as a Search and Rescue helicopter pilot, flight instructor/examiner, Chief Pilot, and Director of Operations. Kevin was awarded the Distinguished Service Cross for his command and courageous leadership under fire in Afghanistan. Kevin was also recognized as the role model for the most recent Military Order of William recipient in the Netherlands (their oldest and highest honour). His impact as a mental health advocate and founder of COR INFINITUS, which gives dignity and respect to the families of those who have served their nation and taken their own lives, was also recognized with the award of a 2023 Community Citizen of the Year. This debate about Anna Mowbray and Ali Williams' helicopter has just got really, really silly in the last day. There is now a push for Auckland Council to ban private choppers in residential areas altogether when they next review the unitary plan for Auckland city, and at least 2 councillors now back that. And one of the councillors backing it is the councillor whose ward covers the Mowbray property. Now I'm sorry, but helicopters are a legitimate form of travel for people who can afford them. They are fast, they avoid traffic jams, and if that is what the Mowbray-Williams family want to use to make their lives easier so they can get from A to B as quickly as possible, all power to them. They can afford it. I feel sorry for the neighbours, I do. I have empathy. I wouldn't want to live next to a property with a chopper that was landing consistently, but nor would I want to live next to a property where the neighbour has a noisy motorbike. And yet - we're not banning noisy motorbikes, are we? Some noisy motorbikes, by the way, are as noisy as choppers. They can hit 116 decibels, which is pretty much exactly the same as the 118 decibels that you can get if you're standing right next to a chopper landing. And there is no ban on those noisy motorbikes, is there? There's no council limit on how many times your neighbour can use one of them, there's no council saying: "Oh, you can use it 10 times a month, but that's it, no more." So why are we doing the same with the chopper? I can't help but feel that some of this anti-chopper sentiment is coming from an anti-rich person place, and we need to get over that. Cause we are lucky, actually, that the Mowbrays have chosen to live in New Zealand. These people are gangster rich, they can live anywhere in the world, and yet they're living here in New Zealand. They're living in Auckland, they're providing work for the people who work in their household, they are paying their mega-dollar taxes into our country, they are pumping money into this economy. Let's not make it harder for people like that. Let's not make it easier for people like that to leave this country by getting weird about helicopters. Helicopters are such an Auckland issue. I love helicopters. I have flown in a lot of helicopters. Our place is on a flight path north. People who go to the Bay of Islands and to the flash golf courses north of Auckland fly over our place. On a sunny Saturday they start 6.30am-ish in summer. On a still day you hear them coming maybe 30 seconds before you might see them. Because I like them, I have never understood the Waiheke moaners who can't stand them and want them banned on their island. To me a helicopter is full of people going places, i.e. tourists and golfers. These are people we like and want. If you haven't followed the story, Ali Williams, once an All Black, and Anna Mowbray, part of the Zuru clan, are a couple and they have a house in Westmere, which is an inner-city suburb in Auckland. They applied to land their chopper at their place. Cue the horror. Far too much money and time has been spent on this – over 1400 submissions. That's right, 1400. And what was mad about it was a number of submissions submitted that they had no view. You can't make this up. The number of people who are clearly bored out of their minds is unreal. Many a submission against their use of a chopper in suburbia came from people who don't even live in Auckland. Not only were they not close to the landing pad, but they're not even in the same city, i.e. it's got nothing to do with you. Lawyers, council staff, submissions, hearings, and Lord knows how many hours and dollars and, as you will have heard, Williams and Mowbray win. They can land at their place two times a day for no more than 10 times a month. There is nothing, said the Commissioners, untoward, unacceptable, or significantly out of character with helicopter noise, which I think is fair enough. But two questions; 1) How many got exercised out of petty jealousy, i.e. rich folks doing stuff we don't like? 2) How unpopular does it make them? And do they care? The NTSB investigation continues.The air tour helicopter apparently crashed into the radio tower while the pilot in command was reading back a traffic advisory about a second helicopter in the vicinity. The second helicopter was operated by the same air tour company. The preliminary NTSB report issued less than a month after the accident. Details in the preliminary report and additional information from security cameras show that the pilot of the accident helicopter had the second helicopter in sight and made no major heading changes to avoid hitting the radio tower. It's rare to meet someone who has survived a plane crash and even more rare to meet someone who has survived a helicopter crash. You could say then that meeting a pilot who has survived one plane crash and two helicopter crashes during his career, is a very rare thing and most certainly warrants an interview.Shawn Sullivan is military veteran, a former paramedic, a close friend, a brother in Christ, and a commercial airline and helicopter pilot. He is also the son of a Vietnam War veteran helicopter pilot who chalked up no less than five helicopter crashes during his service.Shawn is a professional and very safe pilot with thousands and thousands of flight-time hours. He is meticulous and I would trust him with my life and the lives of my family, but there are inherent risks when you take thousands of pounds of metal, strap an engine to it, and send it up into the atmosphere.We sat down to talk about his experiences, particularly the most recent crash that almost took his life, on the Unscripted Podcast.

Getting overwhelmed. Then I saw a helicopter fly by. That's when it hit me. There's always a bigger way to think about your problems. A faster way. A simpler way. Stop analyzing the past. Stop beating yourself up. Start thinking bigger. Start thinking faster. Start thinking simpler. Build your freaking helicopter and fly over those obstacles instead of climbing through them.
