Since long before Roe v Wade enshrined a federal right to choose in 1973, abortion has been one of the most contentious issues in American life. On June 24, 2022, the Supreme Court overturned Roe with their decision in Dobbs v Jackson Women's Health Organization, marking  a new peak in the political energy and emotion surrounding abortion. Katie's guest today, New York Times journalist Jodi Kantor (who won a Pulitzer for her Me Too reporting), has been behind some of the most exhaustively sourced and in-depth reporting on just how Dobbs unfolded.    As Jodi tells us, in many ways, SCOTUS' Dobb's decision was shocking. The case started as a long-shot ban on abortions after 15-weeks in Mississippi. But a series of events made it one of the most monumental in American history: an even more controversial case from Texas coming along at the same time, Justice Ginsberg's death, and an unprecedented leak of the decision in Dobbs that some feel affected Justices' ability to deliberate fully. We have finally reached the end of the 2022 Gay Anthems For A New Generation series and this last set doesn't hold back. Once again, in an effort to contemporize this batch — I went back the past 10 years and mixed in some newer gay anthems that when mixed in with older classics that have been re-worked for today's dancefloors make the effort feel fresh and contemporary. I even took the opportunity to throw in a couple of recent tech-house tracks that sample the gay anthems 'The Underground' by Celeda and 'Work' by Masters At Work' breathing new life into these near 20 yeard old floor-scorchers. No stone was left unturned in this series and pouring through decades of modernized classics (some outstanding while others not so much) was a daunting task that occupied the majority of the work involved in creating these sets. I dare you to find any compilation as comprehensive anywhere on Spotify or Apple Music because you won't. In short, bitches can't touch this but plenty will be none too happy to pass it off as their own. I digress. What's weighing heavily on my mind these days is the move towards an authoritarian state. Our system of government is dysfunctional. The electoral college, which gives outsized weight to the minority allows them to dictate against the wishes of the majority. The great American experiment is coming to a decisive end unless we turn this ship around in November. Even when we have the numbers to get significant legislation passed like gun control, universal healthcare, lower prescription drug costs, affordable housing, mental health resources, food assistance, and free local college tuition or trade schools — Democrats are continually stymied by an ancient artifact called the filibuster in the evenly divided Senate with Vice President Kamala Harris providing the tie-breaking vote. Originally, the filibuster was implemented to allow the Senate to be a more deliberative body of the two branches of government. You had to stand and talk for hours on end to slow down a piece of legislation. Now, you can phone your objection in from your office without even walking your lazy ass to the well of the Senate. The filibuster has been wielded as a sword against progress and prevents passing laws that benefit society as a whole. It was never intended to be used as a way to stop progress. In the case of Democrats, we have a one-seat advantage in the Senate and because of two Senators with a (D) in front of them — they refuse to suspend the filibuster to get the people's agenda enacted. Mind you, the filibuster is nowhere in the Constitution and was implemented after the Civil War to ensure that the minority was trampled over in legislation. Now, it's having the opposite effect of its original intent. Most recently, simple gun control measures can only be passed with a 60 vote threshold in the Senate because two Democratic Senators are attempting to uphold the traditions of the Senate. Meanwhile. seriously mentally defective people continue to legally purchase weapons of war and use them against innocent citizens including children. As long as members of Congress are beholden to special interests (think NRA) and unfettered money pours into campaigns and PACS with virtually zero accountability — our government will remain broken and beyond repair. The filibuster was suspended twice by Republicans to shove through two Supreme Court Justice nominations giving conservatives a majority on the court. One of these nominees was only after Mitch McConnell (the Senate Leader) upheld Obama's nomination for 9 months to replace Justice Scalito after his untimely death under the guise that no Justice should be nominated in an election year. His gamble paid off and Trump won the election that year and was able to get Justice Gorsuch confirmed to SCOTUS with a simple majority. At the end of Trump's term, Justice Ginsberg passed away and Mitch McConnell rammed through Justice (handmaiden) Amy Coney Barrett right w...

Eli Savit is a nationally recognized attorney, public servant, and civil rights advocate who currently serves as the Washtenaw County Prosecutor. Prior to his term, he served as a law clerk to Supreme Court Justice Ruth Bader Ginsburg, was a civil-rights and public-interest attorney, and also had a career as a public-school teacher. In addition to serving as Washtenaw County's Prosecuting Attorney, Eli is a faculty member at the University of Michigan Law School. Eli has been an integral part of several major, successful civil rights and environmental initiatives in Michigan and across the country, including a successful effort to have the Michigan Civil Rights Commission recognize discrimination claims against LGBTQIA+ Michiganders, and assisting New Jersey, Maryland, and Puerto Rico in their quests to hold corporate polluters responsible for waterway contamination. In this inspiring installment of Open Mike, Eli discusses his close relationship with late Justice Ginsberg, and how her tutelage helped inform his decision to carve out a career shaped by public service. Show Notes [00:09] Eli Savit's background and bio as Washtenaw County Prosecutor. [01:26] Welcome to the show, Eli! There was a prosecutor for how many years prior to you? [2:03] How was taking over an office from someone who had been there for twenty-eight years? [03:46] You were born and raised in Ann Arbor, went to U of M Law School, and were clerk for two United States Supreme Court Justices, is that right? Retired Justice Sandra Day O'Connor and late Justice Ruth Bader Ginsberg. That had to have been amazing — what was that like? [06:05] The same-sex marriage case, Obergefell v. Hodges, wasn't that a Michigan case? [07:50] The way that last year went down with the former president getting that appointment… that was such a horrible way that went down, and I'm sure it was sad for Justice Ginsberg's legacy. Do you have any opinions on that? [10:50] After working as a clerk for two icons, you could have had any job that you wanted, ones that pay more lucratively. What was that thought process like? [12:46] The way you chose to run your campaign, one of radical inclusivity, was really impressive. When I read that, I wondered how you were going to make everyone happy — I've never heard of a campaign like that! Can you take us through that? [17:19] Let's talk about cash bail… last year, we filmed an episode with two young ladies who are reforming the system via Bail Project Detroit… it was such an eye-opening thing for me as an attorney. You're the first prosecutor I personally know who has eliminated cash bail. Could you explain to our viewers why you believe so strongly cash bail should be done away with? [25:57] Entire states are now abolishing cash bail. Washington D.C. got rid of it in 1992, and New Jersey got rid of it in 2017. Crime rates in New Jersey subsequently plummeted. [27:55] Research shows that people will still show up to court, even without cash bail as an incentive! Something like 90% of people show up to their court dates, either way. Is that what you're finding in Washtenaw? [30:42] After the bail situation, what are some other initiatives your office is working on? [31:09] On the first day of his term, Prosecutor Savit banned all zero-tolerance policies in favor of adopting a more holistic, case-by-case approach to various crimes and conditions under which they occurred. [36:00] On Open Mike, we've had at least ten guests who were wrongfully convicted. As a prosecutor, what does your office see as your role in helping to free innocent people who were wrongfully convicted in Washtenaw county? [40:28] There's a lot of discussion about blanket immunity which completely protects people from prosecution for crimes related to testimony they provide… what are your thoughts on blanket immunity for people who are bad actors in processes that result in wrongful convictions? [43:57] We see a ton of jail house snitches and bad IDs from police misconduct… have these two areas of potential problems been examined by your office? [47:18] Where did you teach in New York City? [48:28] You're doing so many amazing things in Washtenaw County, and I can't commend you enough. I know it's not easy, and I can't thank you enough for your service. Justice Ginsberg was a big fan of opera, and a big fan of Denyce Graves, and in that regard the Justice is most certainly not alone. Denyce Graves has sung in the major opera houses and with the major symphony orchestras of the world. And as she continues to perform and teach, she has recently undertaken a project to restore the original home of the National Negro Opera Company, located in Pittsburgh, and to rescue from historical neglect the many influential African Americans who distinguished themselves in the world of opera. In Episode 11 of Notorious, we discussed the case of Craig v. Boren, in which Ruth Bader Ginsberg, an attorney for the ACLU, helped shape a new level of judicial review in gender discrimination cases, appearing as amicus curiae. In addressing Oklahoma laws that prevented young men, but not young women, from consuming low alcohol-content beer, the United States Supreme Court held that the gender classifications at issue were unconstitutional under the Equal Protection Clause of the Fourteenth Amendment.  In making that determination, the Court found that the statistics relied on by the state were insufficient to show a substantial relationship between the statute and the benefits intended to stem from it.  As a result, the Court instituted a new standard of judicial review, "intermediate scrutiny" under which: (1) the state must prove the existence of specific important governmental objectives; and (2) the law must be substantially related to the achievement of those objectives. Justice Ginsberg, who would not join the Supreme Court, until 17 years later, influenced the outcome as an ACLU lawyer, appearing as amicus curiae, or a friend of the Court.  Ginsburg advocated on behalf of the male petitioner, arguing for striking down a law that discriminated against young men. Today's discussion is with Hayden Thorne.  He is a Kiwi, an aspiring academic, and a legal historian currently undertaking his PhD focused on the United States Supreme Court and the role that legal representation plays in the outcome of significant decisions. The Supreme Court, its decision making and traditions, the personalities on the Court and the critical role that the Court plays in the US is something that has fascinated me for many years. And I've been in search of someone to talk to about the Court for months now and just in the last week or so stumbled upon Hayden. Of course we talk about the impact of the passing of Justice Ruth Bader Ginsberg - a liberal icon, and powerful voice for woman, minorities, and the disenfranchised.  We look at whether her jurisprudence changed during her tenure or just that the persona and profile grew.  And we briefly consider the importance of conventions and customs concerning the nomination and confirmation of Supreme Court justices and what might be lost when these are tossed aside because of the politics of either side. I was also really keen to talk about the recent series of decisions from the Supreme Court.  These included decisions on LGBTQ employment rights, abortion, and immigration and saw the Supreme Court's Chief Justice play a critical swing role siding with the Court's liberal justices to provide a majority.  We talk about these decisions, the composition of the Court, and what it is that Chief Justice Roberts, a conservative, is possibly motivated by.  As President Trump has nominated a replacement to Justice Ginsberg we recall the words of Justice Ginsberg herself saying that Presidents have often been disappointed with their nominations to the Court. Hayden provides a historic perspective and examples of where nominations to the Supreme Court haven't always panned out as expected. This past June, many breathed a sigh of relief when the U.S. Supreme Court rose above partisanship in controversial cases involving abortion, LGBTQ+ rights, the rights of DREAMERS, and the president’s tax returns. In those cases, conservative justices relied on legal reasoning, rather than party loyalty, to guide their decisions. But lurking in the shadows is a concerning new trend in the Supreme Court to grant an unprecedented number of emergency orders with little transparency and no opportunity for recourse. These cases fall under the Court’s aptly named “shadow docket.” And under the Trump administration, this shadow docket has grown exponentially with the Supreme Court disproportionately ruling on the side of the administration. Here to tell us about this trend and why it’s so concerning is the ACLU’s legal director David Cole. We spoke with David before Justice Ginsberg's death and before President announced Amy Coney Barrett as his pick to replace Justice Ginsberg. It is safe to say that the trends we discussed with David are unlikely to shift course – and could even worsen in the wake of these events.

We are seeing foreshadowing of this delusion in our world today in the vigil being held for Ruth Bader Ginsberg, a woman who was a pro-abortion, anti-family, hard left judge whose votes contributed to the slaughter of nearly 30,000,000 babies in the womb. Even such purported "evangelical" leaders are speaking of her "distinguished service" and...well, John will show you the quote that will simply make your blood boil. If people are so blind to the truth while the Holy Spirit is actively restraining men's actions, can you imagine what it will be like when the Spirit removes His restraint? I would imagine that many, like Justice Ginsberg, once their earthly lives are over, instantly regret their decisions in this life, as they plead and beg for just one more moment to get it right. Unfortunately, we all have a date certain when God will call us home, and at that point, our fates are sealed. Weep for Justice Ginsberg...justice will be served on behalf of the children whose cries were never heard. Date, a senior White House correspondent for Huffington Post says he’s not surprised Romney decided to join with other Republicans in pushing to allow President Donald Trump to appoint a replacement for Justice Ginsberg.“Everybody is wondering how Mitt Romney could do this. This is something Republicans have wanted for years. This is the quid pro quo they made when they decided to support Donald Trump in 2016,” he says. Date is also the author of the book “Useful Idiot: How Donald Trump Killed the Republican Party with Racism and the Rest of Us with Coronavirus.” He was a guest on the Utah Politics podcast and believes the rush to confirm a Supreme Court nominee could energize Democrats ahead of November. “Democrats haven’t taken the Supreme Court that seriously as an election issue. Maybe having this happen so close to the election reminds them that elections have consequences,” said Date. Ruth Bader Ginsberg died last week and our timelines lit up with people mourning her death and some people exulting in it. Politics are often polarizing, but grief is often communal with people experiencing different amounts and aspects of it, but shared grief can be such a powerful thing. Kindness matters. Even to the dead. Action and beliefs matter. Especially to the still living. No matter what you think of her court decisions, which were meant to heal the ‘fractures in federal law,’ Ginsberg has some very good advice about marriage and words, which is why we’re talking about her now. Back in 2016, Justice Ginsberg wrote about her mother-in-law’s life advice. Ginsberg“’In every good marriage,’ she counseled, ‘it helps sometimes to be a little deaf.’ I have followed that advice assiduously, and not only at home through 56 years of a marital partnership nonpareil. I have employed it as well in every workplace, including the Supreme Court. When a thoughtless or unkind word is spoken, best tune out. Reacting in anger or annoyance will not advance one’s ability to persuade.” Ginsberg talked about how both her mother’s push for her to be independent and her professor’s focus on language influenced her, propelling her to rise in the ranks to become a Supreme Court justice. Ginsberg“At Cornell University, my professor of European literature, Vladimir Nabokov, changed the way I read and the way I write. Words could paint pictures, I learned from him. Choosing the right word, and the right word order, he illustrated, could make an enormous difference in conveying an image or an idea.” Words influence thought influence action. Putting them in the right order? It makes all the difference. She also spoke about the dynamics on the court where nine justices sit, saying, Ginsberg excerpted in the NYT“Despite our strong disagreements on cardinal issues — think, for example, of controls on political campaign spending, affirmative action, access to abortion — we genuinely respect one another, even enjoy one another’s company. “Collegiality is crucial to the success of our mission. We could not do the job the Constitution assigns to us if we didn’t — to use one of Justice Antonin Scalia’s favorite expressions — ‘get over it!’” That might be the best marriage advice of all. One key Republican senator says they already have enough votes to confirm Justice Ruth Bader Ginsburg's replacement before the election, even without knowing who President Trump will nominate. Democrats say they're not giving up the fight over the Supreme Court appointment, even though only two Republican senators have said that the vote should wait. Ginsburg will be honored on Friday as the first woman ever to lie in state at the U.S. Capitol. We expect to see thousands of people outside the Supreme Court as they memorialize her, and then members of the public can come to pay their own respects. Thousands of flags cover the National Mall in Washington, honoring the nearly 200,000 Americans killed by the coronavirus. This stands in stark contrast with President Trump's comment last night, saying the virus affects "virtually nobody."

Unreasonable use of force The Supreme Court has decided to limit damage suits against government officials in Hernandez vs. Mesa. However, the court’s more liberal justices dissented from the ruling. On the border between the United States and Mexico, controlled by the United States, U.S. Border Patrol agent Jesus Mesa fatally shot Sergio Hernández, a 15-year-old Mexican boy, seemingly without justification or provocation. At the time of the shooting, Mesa was in U.S. territory, while Hernández was on Mexican soil. Hernández’s family sued Agent Mesa for damages, arguing that his arbitrary use of deadly force violated the Fourth Amendment. Under the US Constitution, courts perform an essential checking function on the political branches of government, ensuring compliance with the Constitution’s protection of individual rights. In another case: Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, allows individuals to seek monetary compensation from federal officials who have violated their constitutional rights. Agent Mesa countered that the Fourth Amendment does not apply because Hernández was standing in Mexican territory at the time of the shooting. In a divided decision, the United States Court of Appeals for the Fifth Circuit held that the Hernández family could not assert a claim under the Fourth Amendment because Hernández was a Mexican citizen who was on Mexican territory at the time of the shooting. Hernández’s family then petitioned the Supreme Court to review this decision. Constitutional Accountability Center Civil Rights Director David Gans attended today’s argument and issued the following reaction: “In an Oval Office meeting back in March, President Trump reportedly suggested that U.S. Border Patrol agents “shoot migrants in the legs to slow them down.” During today’s oral argument, Trump’s Department of Justice argued that persons killed or harmed by Border Patrol agents, even within the United States, should have no right to go to court to remedy the acts of such rogue border guards. In their view, the courthouse doors must be firmly closed against any efforts to hold Border Patrol agents accountable to the Constitution. The Supreme Court shouldn’t sanction a Constitution-free zone at the border that would allow U.S. Border Patrol agents to shoot to kill without any possibility of redress. It seems that Hernandez vs. Mesa showsf the court’s determination to limit damage suits against government officials. Congressman Joaquin Castro Chairman of the Congressional Hispanic Caucus (CHC) issued the following statement in response to the Supreme Court 5-4 decision on Hernandez vs. Mesa: “Sergio was an unarmed child when he was gunned down across the border by US Border Patrol Agent Mesa. Because of today’s decision, the Hernandez family now has no path to seek justice for his murder. This ruling means that moving forward, no one, not even unarmed children or their families, have the right to sue a federal agent for a cross-border shooting. This decision comes at a time when thousands of asylum seekers are being forced to live in camps along the border because of the ‘Remain in Mexico’ policy. If children like Sergio - who was just playing along the border - can be murdered without recourse then CBP agents know that they will not be held accountable for similar crimes. He went on to say: “Justice Ginsberg rightly noted that this was not an isolated incident. It’s become abundantly clear that Trump’s Department of Homeland Security and Customs and Border Protection are out of control and must be reined in. Congress must hold this department accountable and ensure that agents who abuse their power face justice.” The case began in 2010 when 15-year-old Sergio Adrian Hernandez was playing a dangerous game with several friends in the dry culvert separating El Paso from Ciudad Juarez, Mexico. The boys ran up the embankment on the U.S. side,

On June 24, 2019, the Supreme Court, in an opinion written by Justice Alito, decided The Dutra Group v. Batterton, which answered the question, can a Jones Act seaman recover punitive damages on his or her unseaworthiness claim? The plaintiff, a Jones Act seaman employed by Dutra Group, was injured on the defendant’s dredge vessel on the West Coast. A hatch blew open and crushed his hand. The district court denied the defendant’s motion to strike the punitive damages claim; the Ninth Circuit affirmed. This decision set up a split in the circuits, because a couple of years earlier the en banc Fifth Circuit held that punitive damages were not available under the rationale of an earlier Supreme Court case, Miles v. Apex Marine.The Supreme Court, by a vote of 6-3, reversed the Ninth Circuit and held that punitive damages are not available in an unseaworthiness cause of action. On June 24, 2019, the Supreme Court, in an opinion written by Justice Alito, decided The Dutra Group v. Batterton, which answered the question, can a Jones Act seaman recover punitive damages on his or her unseaworthiness claim? The plaintiff, a Jones Act seaman employed by Dutra Group, was injured on the defendant’s dredge vessel on the West Coast. A hatch blew open and crushed his hand. The district court denied the defendant’s motion to strike the punitive damages claim; the Ninth Circuit affirmed. This decision set up a split in the circuits, because a couple of years earlier the en banc Fifth Circuit held that punitive damages were not available under the rationale of an earlier Supreme Court case, Miles v. Apex Marine.The Supreme Court, by a vote of 6-3, reversed the Ninth Circuit and held that punitive damages are not available in an unseaworthiness cause of action. We are in the middle of a series of high intensity during your workout. In the last episode,  we discussed understanding failure. Reaching muscle failure in your workout to be more precise and by hitting muscle failure safely, you get a weeks' worth of exercise in just one 20-minute session. Now, coming up in this episode we'll provide a very descriptive and detailed definition of a high-intensity workout from Ken Hutchins, one of the pioneers of this protocol. We'll also discuss how this type of workout will enhance your performance and whatever activity it is you enjoy but first, Adam, let's dispel the stigma associated with the word intensity. I mean, we don't want to scare anybody. Intensity, yeah, an intense workout, I think will scare most people if they feel like they're out of shape or they haven't worked out in a long time and yeah, that raises concern for sure, raises the red flag so to speak in peoples' minds when they hear that this is not only an intense workout but a very intense workout and one of the first things that pops into a lot of peoples' heads is, "Can I do this?" Or, "Is it safe for me?” And that's what I meant when I said it depends who's telling the story about intensity. I think what we do so well is explaining that intensity is not the problem but it's the way we try to achieve intensity that's really where the problems lie. When I talk to clients and when I say high intensity and when I personally think of high intensity I think of that -- the first thing that comes to my mind is that Insanity Workout. High intensity! You know, it's like -- and I always try to tell people, you know, “You're not going to be jumping around. You're not going to be like you know, we're not going to kill you.” So, you have to kind of -- yeah, you do have to kind of qualify it a little bit, you know, when you say, high intensity.     Yeah. It's interesting because a lot of the medical research and fitness research that's been coming out over the last few years which we've been advocating for, you know, I don't know. Adam, how long now? Almost 20 years. Is -- My whole life. Exactly, you know, but it's a -- Yeah, sure. [laughs] Everyone's now a big advocate and they've showed through a lot more of the studies that a high intensity stimulus is the more worthwhile stimulus in order to gain the adaptation and the effect over the muscle in the body. So, it's a, as Adam said, it is the modality. It's defining it. I mean, some of the things that have taken the headlines are the 7-minute workout in the New York Times, CrossFit boot camps. You know, all engaging, fun, highly intense and where people have gotten, like, a lot of results but often times they're not assessing the risk when entering into those types of workouts and I think that's where Power of 10 and InForm Fitness is really, really -- that's where we have the advantage. And when we're talking intensity too and for 20 minutes, we really want to make it clear to somebody who's considering this type of exercise that it is not 20 solid minutes of intensity. Really. I mean, based upon, you know, the five to seven or however many exercises somebody's going thorough within that 20 minutes, the intensity really is in the last 30 seconds of the exercise. At least that's how I feel. Well, Tim, you make a good point actually. Your question is right on because you're not doing 20 minutes of high-intensity exercise. If you're doing six exercises that last a total of a minute and a half, that's nine minutes actually of exercise. Mhm [affirmative]. Alright. So, one and a half minutes, times six is nine minutes. You know, when it comes down to it, whether it's a two-minute set or even a three-minute set or a one-minute set, at the end you've reached muscle failure. At the end it's still those last 20 seconds. Now, there are a lot of people that if you pick a weight where those last 20 seconds come in 60 seconds. Alright, so come on -- that means it's already starting hard and challenging but it's not like grueling. Now, I understand that some people, especially beginners need to kind of work up to that burn but, you know, what I found is once you understand what the bottom line is and where you have to go, a lot of people want to get it over with. People want the weight to be heavier so they don't have to take two minutes to get to that point. And as long as their form is solid it's going to be okay. When on the first couple sessions it's usually not about deep muscle failure. It's just about understanding intensity anyway. So, it's something that you know, we're focusing more on the form and making sure people feel confident and safe while they accept and understand what it feels like to do to have an intense stimulus on their body. Usually, it's unlike anything they've had before. Even with very, very competitive athletes. It's quite a challenge. Right and it certainly takes some getting used to but it really doesn't take long. So, Adam, let's shift gears a little bit here. In your book, Power of 10: The Once-a- Week Slow Motion Revolution, and in earlier episodes of the podcast, you've mentioned the name, Ken Hutchins, one of the pioneers of the super slow technique. Tell us a little bit more about Ken and share with us his definition of a high-intensity exercise regime. We'd be doing everyone a disservice to not mention where this all came from. This was not my brain child, this idea of exercise versus recreation. I wish it was but it's not. Regardless, I'm following it but the person who's responsible for this is a guy named Ken Hutchins and he worked for Nautilus. He was a protégé of Arthur Jones who was the founder of Nautilus and Nautilus had their own protocol. They weren't just an exercise company. They were a protocol, an exercise protocol. A lot of the early body builders were using it back when he came out with this thing in the mid to late 60s, the Nautilus equipment. The protocol was high intensity -- this is the beginning of high-intensity exercise where finally intensity, almost above all else was the key to seeing results and it was done in a -- he called it a two, four protocol which is lifting in two and lowering in four. So, that was drastically slower than what was -- that used to be done and it was being done on equipment which is also very radical because free weights were king at that time, especially for body builders. So, Arthur Jones had approved that equipment. You know, it doesn't matter what the tool is. Matter of fact, the equipment can actually do some better things for you. Ken Hutchins realized that the protocol can even get better. So, here is Ken Hutchins' actual definition. I'm going to read it. "Exercise is a process whereby the body performs work of a demanding nature, in accordance with muscle and joint function, in a clinically controlled environment, within the constraints of safety, meaningfully loading the muscular structures to inroad their strength levels to stimulate a growth mechanism within minimal time."     What does that mean? Simple, right? [laughs] Who wrote that, Justice Ginsberg? [laughs] Yeah, exactly. [Inaudible 08:04]. Wow. I need a law degree to understand that. Yeah. [laughs] [laughs] Exactly. It's brilliant and it is a true definition because as he points out, the definition of definition is to delimit, which means that there are no other possibilities that could exist. For example, if I said somebody, please define what a pen is and they said a pen is a writing instrument. So, therefore, I can hold up a pencil, I can hold up a quill and say, well, therefore this is a pen, right? Says, no. No, actually a pen actually has ink. Oh, so, a pen is a writing instrument that uses ink? Yes. Okay. So, this quill and ink is a pen, right? Okay, so you have to define it, you have to break it down even more. You see where I'm going with this? Mhm [affirmative]. Alright. So, that's what he just did with this definition. I mean, there is no possibility of exercise being anything other than lifting weights really slowly on retrofitted equipment in a very cool environment that is going to reach a certain level of intensity. Alright. There's no other way of doing it according to this definition. He wrote this definition, to narrow down exactly how you have to perform exercise which is to life weights ten seconds up, ten seconds down, according to muscle and joint function so you better have your biomechanics right and your machines retrofitted for those biomechanics. Alright and you better do it in the minimum amount of time and reach failure pretty darn quickly and not hurt yourself in the process, he says here. That's what he just said in a very long way but, like, there is no room for error there. There's no ambiguity with a definition like that and that's his brilliance. He finally did it. Now gardening is not freaking exercise anymore. Tim: [laughs] Adam: Alright. Doctors can't tell their clients, “Oh, go on a walking program. Get some exercise.” They can't say that anymore if they go by this definition of exercise which is good because a doctor that's telling their patients that all they have to do is get out there and be active and go on a walking program because they want to save their ass because even if they die on a walking program, they can't get sued for that. Tim: [laughs] Adam: That's his definition because that is what it has to be but this is how we interoperate it and this is how we explain it to our clients which comes down to basically what Doug McGuff did, which is another great contributor to this movement, writing the book Body by Science who hopefully will be a guest on our show one time. Tim: Mhm [affirmative]. Adam: Yeah. Tim: In that definition nowhere did it say -- in Ken Hutchins' definition, nowhere did it say a leisurely activity. Adam: Right, what I've been doing and what Doug McGuff did in his book is kind of tweaked that definition for layperson, something that you can just kind of have as a mantra if you will. Alright. And have it be that [inaudible 10:51] that will guide you to deciding how you want to engage in exercise and his definition was much more succinct. To build fitness, to improve and enhance your fitness while at the same time not undermining your health and that is the essence of what Ken Hutchins wrote in his definition. Tim: And what you -- Adam: Although -- Tim: Built and based -- Adam: You know --   Yeah. Exactly. When it comes down to it you just have to work out and not hurt yourself in the process. You know, and it only -- it comes down to like doing five exercises or so to work the whole body really hard and then move on with your life. Well, Adam, I have a question. So, as we move forward with the exercise versus recreation debate, so, say somebody comes in and I'll use myself as an example. So, I want to enhance my game in softball. Right. So, somebody comes in with some specific goals because they want to get better at an activity that they enjoy for recreation. Do you tailor an exercise regime based upon that or is it pretty standard throughout? Read Doug McGuff's book. [laughs] That's an excellent question. I get asked that question all the time. You know, “I want to get better,” you know, “I'm a softball player,” to use your example. Mhm [affirmative]. And how are we going to go about that? Do we do certain exercises for throwing? Do we do certain exercises -- we're going to do plyometrics and jump side to side laterally like a shortstop would or how are we going to train for this? And the application is very general. We have to strengthen your hips. So, we're going to do a leg press. We're going to do some abductor exercises. We'll do some adductor exercises to strengthen the whole complex. We're going to do lower back exercises. We're going to strengthen your lower back but we're going to do it in a way that's not mimicking what a stress stop would do. We're going to do it the way your body was meant to move. What's great about our program is we are building all of the muscles of your body which are involved in the movements that you're going to execute when you're performing a sport. And, you know, all the people who are playing golf and playing tennis and playing softball and skiing, they've been -- you know, they report incredible testimonials about it. The bottom line is, doing leg press is not going to make you a great softball player. Doing hip abduction, lower back extensions, they're going to make your hips and your back and all the muscles involved in playing softball very strong and hopefully those joints really safe. And then it's up to you to practice that skill. So, it's a two prong approach and you do both. You have to get strong, you have to do -- you have to get strong without using up all your resources. The last thing you want to do is do an exercise program that's going to make you so tired and so fatigued and put your joints in such stress that as soon as you leap for a ball in the softball field, that's when you spasm in your back and it's because you just worked out like a crazy man in the wrong way all week long. Alright. So, what you want to do is get out of your own way when it comes to exercise and not make -- put yourself at even worse advantages. It's already a demanding sport. You don't need your exercise to be just as demanding in that sense. What you want to do is get strong and not compromise your joints. Alright. So, when you go out on a softball field you're not going to spasm. You're not going to tear something or hopefully not and it's still no guarantee. Yeah. But to get better at softball though like Mike was saying, you have to just keep playing softball and as the stronger you get without compromising your joints, it gives you your best chance of being the best softball player you can be. Just to put it simply, it's physical conditioning or strengthening versus skill. Right? There's a different skill for every activity, for every recreational activity. There's a skill that you develop and then there's the physical conditioning. So, there's those two and there's a great chapter about that in Doug McGuff's book, Body by Science. Oh, terrific. And the likelihood of actually getting hurt while you're practicing softball is going to go down significantly if you're stronger. And that was my question. It wasn't necessarily geared towards just softball but I think everything that you just said probably applies to any activity or any recreational activity that somebody might be enjoying and my question was, do you create a specific training, physical training program for that activity or is your system there at InForm Fitness pretty universal to where just about anything that you want to do whether it's golf, tennis, swimming, hiking, skiing, softball that kind of fits that mold to train physically for those activities. Alright. So, check this out. My story with this, alright. I've been staying very strong for a long time and I took up snowboarding as a 42-year-old.     Mhm [affirmative]. That's encouraging. Right. Yeah. If you talk to anybody that tries snowboarding at middle age most of them give up. They're like, “It was too hard. I was falling. I was getting hurt. I couldn't -- I didn't want to do it anymore. I didn't really stick it out.” I only was able to learn how to snowboard because I was a slow learner and it took me a good five solid days before I can kind of put a turn together on a snowboard without falling. Five solid days of being basically thrown into the ground all day long. All day long. And if it wasn't for my basic strength, my overall basic strength, there's no way I would have survived those five days. To just to get back up off my ass. Alright, on the snowboard. I mean, it was one of the hardest things I've ever attempted. And that's why a lot of people that if they're not young trying to learn how to snowboard they just don't -- they give it up because it's just too hard on the body to learn how to snowboard. It's a great testimonial to this workout that you can pick something up as physically demanding as snowboarding at the age of 42. Yeah and that's just like I said, that's a hugely demanding sport that Adam was trying to do. And we hear time and again, like we heard on the weekend when we were taping testimonials, can be as simple as gardening, you know, or doing things around the yard that people thought, “Oh, I just don't have the energy to do this anymore,” and then they start doing this workout and low and behold a few months later they're like, “Oh, this is fine again. This is easy again. I'm enjoying doing my gardening and yardwork again.”     And not just the recreational activities but just being able to work effectively to make a living. There's one woman that we interviewed that works for a television studio that's in wardrobe department and has to lift and carry and drag. We interviewed a gentleman who's in IT and has to do a lot of crawling and climbing and carrying and so this will [laughs] not only just -- this exercise won't only just benefit you so that you can be a great softball player or golfer but also help you continue to do what you not only love to do, but have to do. And how long does it take to have all these achievements, to reach all these successes. How long does it take to be able to do these things? Oh, just 20 minutes once a week. Are you fucking kidding me? [laughs] Yeah. Shorter than a television episode, right? Preach it. Hallelujah. I mean, seriously, you know if you started telling people, what would you say if I can get you to do all these things that we just talked about like being able to snowboard at 45 and not kill yourself or to be able to actually garden a full acre of land and your property and enjoy that fantasy of actually being an organic gardener and have your self-sustaining garden while you're in your golden years. Alright. Just imagine being able to do that because that's a lot of hard work. Just being able to do that and not pay the price for it. What would you do for that? Well, I don't know. What -- I mean, sounds like it takes so much. It would be like -- I mean, what was it? A five-day week workout and all that cardio and then doing weight training too like those crazy people on TV. I'm like No. No actually. How about just 20 minutes once a week and you can do all that? Yeah and realistically over time what I've noticed with these types of testimonials, when they record something like skiing its I mean, I've seen it as early as six sessions but usually within like eight or ten sessions. So, like, less than three months I think people are noticing very discernable changes in their body in regards to their sports performance or recreational activity. Alright. Thanks, Mike.
