It did not happen all at once. There was no siren moment, no dramatic escalation, no declaration that something terrible had occurred. The transition from concern to action came through a phone call, logged like thousands of others, handled by a department accustomed to uncertainty and delay. The intake process required structure. A deputy recorded biographical details. Ages. Vehicles. Occupations. Known habits. There were questions designed to determine urgency: any history of violence, any threats, any medical conditions, any known disputes. The answers, as given, did not demand escalation. There was no immediate evidence of danger. No broken windows. No frantic voicemail. No witness claiming distress. What existed was absence. Absence is difficult to categorize. But the McStays were missing...Sources: https://coronadotimes.com/event/down-to-the-bone-caitlin-rother-and-the-mcstay-family-murders/https://www.cbs8.com/article/news/judge-unseals-court-records-in-mcstay-murder-case/509-5297be95-2f41-4ce7-931e-8c3dc98e0918https://allthatsinteresting.com/mcstay-family-murdershttps://abcnews.go.com/TheLaw/missing-mcstay-family-cross-mexico/story?id=10042816https://www.nbcsandiego.com/news/local/mcstay-family-murder-trial-charles-merritt-closing-arguments-jury/159073/https://www.latimes.com/local/lanow/la-me-ln-mcstay-family-deaths-20190120-story.htmlhttps://www.sbsun.com/2019/03/11/key-prosecution-evidence-flopped-in-mcstay-family-murder-case-defense-contends/https://www.sbsun.com/2019/03/11/key-prosecution-evidence-flopped-in-mcstay-family-murder-case-defense-contends/Become a supporter of this podcast: https://www.spreaker.com/podcast/kinda-murdery--5496890/support.
Tonight on Hidden Killers Live, psychotherapist Shavaun Scott joins us for an extended examination of two cases that expose how systems fail families in catastrophic ways. From the psychology of family annihilation to the financial incentives keeping addiction treatment broken — this is essential expert analysis you won't find anywhere else.In the Paul Caneiro trial, prosecutors allege Paul murdered his brother Keith, sister-in-law Jennifer, and their two children at their Colts Neck mansion after Keith discovered Paul had been stealing from him. Eight-year-old Sophia was stabbed 17 times and allegedly still alive when the fire started. Shavaun breaks down what drives someone to annihilate everyone they love rather than face exposure, what extreme overkill reveals about psychological state, and how to read Paul's courtroom behavior — including his tears during testimony about the children. The Nick Reiner tragedy exposed America's $42 billion addiction treatment industry. The Reiner family had every resource available and Rob and Michele Reiner are still dead. Shavaun follows the money through relapse-profitable business models, insurance company control over clinical decisions, and the accountability vacuum that lets facilities fail without consequence. We identify who blocks reform and ask whether meaningful change is even possible. In November 2025, Judge Steven Hippler said the quiet part out loud: Idaho's current Son of Sam law "leaves open the potential for Defendant to receive money from media contracts in the future." Bryan Kohberger — the man who confessed to stabbing Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin to death — could legally profit from telling his story within five years. This week, Idaho lawmakers finally moved to fix it. Senator Tammy Nichols introduced legislation to modernize the state's 48-year-old statute, and the bill unanimously advanced out of committee. Representative Elaine Price — whose district includes three of the victims' hometowns — co-sponsored it, saying: "Victims should not feel continually victimized."The numbers are infuriating. Kohberger owes over $300,000 in fines and fees. Restitution to the families totals about $32,000. While awaiting trial, he received more than $28,000 in donations to his jail account. Meanwhile, the Goncalves and Mogen families were left arguing in court over who should pay for their daughters' urns — a dispute over roughly $3,000.Idaho's current law was written in 1978. It doesn't mention podcasts. It doesn't mention streaming platforms. It doesn't account for social media monetization or ongoing royalties. The true crime industry generates hundreds of millions of dollars annually, and Idaho's law is stuck in the era of evening news broadcasts. The new bill addresses digital monetization, extends escrow periods by court order, and includes First Amendment protections to survive constitutional challenges. It focuses on profit, not speech. But the clock is already ticking. The families of Kaylee, Maddie, Xana, and Ethan deserve better than a legal system playing catch-up.We break down exactly what's in the bill, what it means for Kohberger, and why this fight is far from over.#BryanKohberger #IdahoMurders #KayleeGoncalves #MadisonMogen #XanaKernodle #EthanChapin #SonOfSamLaw #MoscowIdaho #UniversityOfIdaho #Justice4IdahoJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Today we have major developments in the Spencer and Monique Tepe murder case. An affidavit unsealed in Franklin County reveals disturbing new allegations about suspect Michael McKee's behavior in the weeks, months, and years before the December 30th killings.According to witnesses who spoke with investigators, McKee told Monique he could "kill her at any time," that he would "find her and buy the house right next to her," and that "she will always be his wife"—statements allegedly made during and after their marriage, which ended in divorce in 2017. Witnesses also told investigators that McKee allegedly strangled Monique and forced unwanted sex on her during the marriage. The affidavit reveals that surveillance captured McKee walking through the Tepes' property on December 7th, 2025, while the couple was in Indianapolis for the Big Ten Championship game. Monique reportedly left the game early, upset about something involving her ex-husband. Three weeks later, both she and Spencer were found shot to death in their Weinland Park home.Investigators tracked McKee's vehicle arriving in Columbus before the murders and leaving afterward. His cell phone showed no activity from December 29th until after noon on December 30th. He was arrested January 10th in Illinois and has pleaded not guilty to aggravated murder charges with firearm specifications alleging either an automatic weapon or a silencer. We break down everything in this unsealed affidavit and what it means for the prosecution's case.#TrueCrimeToday #TepeCase #MichaelMcKee #BreakingNews #UnsealedDocuments #ColumbusOhio #DomesticViolence #MurderInvestigation #AggravatedMurder #TrueCrimeJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Two murder cases. Two very different defense strategies. Defense attorney Bob Motta joins True Crime Today to break down both.Aaron Spencer's trial just got a new judge after the Arkansas Supreme Court removed Barbara Elmore for constitutional violations—the second time in seven months. Spencer faces second-degree murder for killing Michael Fosler, the man out on bond for allegedly raping his 14-year-old daughter. The defense is arguing he saved his child. The prosecution has prior statements suggesting premeditation. And now a retired judge from the other side of the state is inheriting the most divisive case in Arkansas.Michael McKee pleaded not guilty to four counts of aggravated murder in the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. His lawyer is Diane Menashe—who got Dr. William Husel acquitted of fourteen ICU murders by calling one witness and watching the state's case crumble. The prosecution has ballistics, surveillance, vehicle tracking, a suppressor. Menashe doesn't present defenses. She destroys prosecutions.Bob Motta analyzes both cases: what judicial removal means for Spencer, how to defend a father who killed his daughter's alleged abuser, whether Menashe's Husel playbook works against different evidence, and what both cases tell us about murder defense strategy in high-profile trials.#BobMotta #TrueCrimeToday #AaronSpencer #MichaelMcKee #MoniqueTepe #JudgeElmore #DianeMenashe #MurderDefense #HuselAcquittal #DefenseStrategyJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Breaking details from the newly unsealed affidavit in the Michael McKee double murder case reveal that the accused killer was at his ex-wife's Columbus home on December 6th — while she and her husband Spencer were at the Big Ten Championship game 200 miles away.According to court documents, video captured McKee on the Tepe property that night. The Columbus Dispatch reports he entered the home and left "a few hours later." WOSU says he walked through the yard. Monique Tepe left the game at halftime, reportedly upset about "something involving her ex-husband."The affidavit paints a picture of eight years of alleged terror. Witnesses told investigators McKee forced unwanted sex on Monique, strangled her, and threatened to kill her "at any time." He allegedly said he would "buy the house right next to her" and that "she will always be his wife." Despite all of this, Columbus police confirmed there were no prior reports filed. On December 30th, three weeks after the December 6th incident, Spencer and Monique Tepe were found shot to death in their second-floor bedroom. Their children — ages 1 and 4 — were discovered unharmed. McKee's phone showed no activity for 17 hours. A silenced firearm was used. No forced entry.McKee was arrested at a Rockford Chick-fil-A on January 10th. He's charged with four counts of aggravated murder and has pleaded not guilty. The question now: what happened in those 24 days between December 6th and December 30th?#TrueCrimeToday #MichaelMcKee #TepeMurders #BreakingNews #ColumbusOhio #DomesticViolence #CourtDocuments #SpencerTepe #MoniqueTepe #TrueCrimeNewsJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Brendan Banfield just bet everything on himself. The Virginia man accused of killing his wife Christine and a stranger named Joseph Ryan took the witness stand today in Fairfax County Circuit Court. It's a move most defense attorneys advise against — once you testify, everything you say becomes ammunition for the prosecution. But Banfield apparently decided the only way to beat the au pair's testimony was to counter it directly. And counter it he did. Banfield admitted the affair with Juliana Peres Magalhães, the family's Brazilian au pair. He said it started in August 2022. But he told the jury he was upfront with her — this was just another affair, and it wasn't going to change his relationship with his wife. He said both he and Christine had strayed before. They'd gone to counseling. They'd made the decision to stay together. When asked if he plotted with the au pair to kill Christine, Banfield's response was immediate: "No, there was no plan." He called the accusation "absurd" and "absolutely crazy."The prosecution's theory is that Banfield and the au pair catfished Joseph Ryan using a fake profile on a fetish website, lured him to the house, then killed both Ryan and Christine in an elaborate staged crime scene. The au pair, who flipped on Banfield in exchange for a plea deal, testified to exactly that. Now the jury has two completely different stories. And Banfield has to survive cross-examination Thursday morning.#BrendanBanfield #TrueCrimeToday #AuPairAffair #ChristineBanfield #MurderTrial #FairfaxVirginia #JosephRyan #TrueCrimeNews #CourtTV #BreakingCrimeJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Breaking down the defense strategy in the Michael McKee case. The vascular surgeon accused of killing Monique and Spencer Tepe in their Columbus home has retained Diane Menashe — arguably Ohio's most successful defense attorney. Her resume includes walking Dr. William Husel after 14 murder charges and saving multiple clients from death row against overwhelming evidence.Today on True Crime Today, we analyze what Menashe might do with a case that looks unwinnable on paper. The ballistics match through NIBIN that defense attorneys know isn't courtroom-proof science. The murky Ring camera footage that could become a battle of experts. The eight-year gap between McKee's divorce and the alleged murders that complicates the premeditation narrative. And McKee's documented spiral — malpractice suits he allegedly dodged with fake addresses, an expired medical license, colleagues saying he "just disappeared" — that could support a diminished capacity argument.Prosecutors haven't disclosed a motive. They've called it "targeted domestic violence" but haven't explained why a surgeon would drive 325 miles to kill an ex-wife who left him eight years ago. Menashe will exploit that gap.McKee isn't fighting for acquittal. He's fighting to avoid the harshest sentence — life without parole versus life with parole eligibility after 32 years. That's the game now.The Tepe children — ages 4 and 1 — were in the house that night. They'll grow up without their parents. And the man accused of taking them has hired the best defense money can buy.#TrueCrimeToday #MichaelMcKee #TepeCase #DianeMenashe #SpencerTepe #MoniquTepe #CrimeNews #MurderTrial #DefenseStrategy #BreakingCrimeJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? The moment everyone has been waiting for finally happened. Brendan Banfield took the stand in his own defense — and went straight at the prosecution's case. The former IRS criminal investigator, charged with orchestrating the murders of his wife Christine and Joseph Ryan, told the jury there was never any plan to kill anyone. He admitted the affair with au pair Juliana Peres Magalhães. He said it started in August 2022 when his wife was out of town. But according to Banfield, he made it clear to Juliana from the start — this was just another affair. It wasn't going to change his marriage. When his attorney asked if he ever devised a plan with the au pair to "get rid of" Christine, Banfield didn't hesitate. He called the accusation absurd. He called it absolutely crazy. He said their relationship was barely two months old at that point — the idea that they were plotting murder was beyond belief.Banfield walked the jury through the morning of February 24th, 2023. The McDonald's stop. The stressed phone call from Juliana. The calls to Christine that went straight to voicemail. The ten-minute drive home. His version directly contradicts everything the au pair told prosecutors after she flipped. This trial now comes down to one question: which one of them is lying?Cross-examination begins Thursday. That's when the prosecutor gets their shot at him.#BrendanBanfield #HiddenKillers #ChristineBanfield #AuPairMurder #TrueCrimePodcast #VirginiaHomicide #JulianaPeresMagalhães #MurderTrial #TrialUpdate #TrueCrimeCommunityJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? The unsealed affidavit in the Michael McKee case reveals something prosecutors hadn't disclosed until now: McKee was at the Tepe home on December 6th — three weeks before he allegedly murdered his ex-wife Monique and her husband Spencer. The Tepes were at the Big Ten Championship in Indianapolis that night. Two hundred miles away. House empty. According to the Columbus Dispatch, video showed McKee entering the home and leaving "a few hours later." WOSU reports he walked through the yard. What everyone agrees on: he was there, and Monique somehow knew. She left the game at halftime. This wasn't random. Witnesses told investigators McKee had allegedly threatened Monique for eight years — that he could "kill her at any time," that she would "always be his wife." A silver SUV with stolen plates had been spotted near their home multiple times. Fresh scrape marks on the window where a sticker used to be.No forced entry on December 6th. No forced entry on December 30th.December 6th was reconnaissance. A test run. Twenty-four days later, he allegedly came back with a silenced firearm and executed the plan. Spencer was shot multiple times. Monique took at least one round to the chest. Their children slept through it.McKee has pleaded not guilty. He faces life in prison if convicted. But the question this affidavit raises isn't whether he did it — it's how Monique knew from 200 miles away that something was wrong. And why eight years of warnings still weren't enough.#HiddenKillers #MichaelMcKee #TepeMurders #MoniqueTepe #SpencerTepe #DomesticViolence #Stalking #ColumbusOhio #TrueCrimePodcast #UnsealedDocumentsJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Defense attorney Bob Motta joins me for a two-part legal breakdown of the biggest murder case developments this week.First: Aaron Spencer. The Arkansas Supreme Court removed Judge Barbara Elmore from his second-degree murder trial—the second time they've reversed her on constitutional grounds in seven months. Spencer killed Michael Fosler, the man out on bond for allegedly raping his 14-year-old daughter. Now a retired judge is taking over, prior rulings could be reconsidered, and the defense has to figure out how to counter Rule 404(b) statements about what Spencer said he'd do if Fosler came near his daughter again.Second: Michael McKee. He pleaded not guilty to four counts of aggravated murder in the deaths of his ex-wife Monique Tepe and her husband Spencer Tepe. His lawyer is Diane Menashe—the same attorney who got Dr. William Husel acquitted of fourteen ICU patient murders by calling one witness. The prosecution has ballistics, surveillance, vehicle tracking, and a suppressor. Menashe doesn't present defenses. She dismantles prosecutions.Bob Motta breaks down both cases. What judicial removal means for Spencer. How defense-of-others works against premeditation evidence. Whether Menashe can replicate the Husel strategy against different evidence. Two murder trials. Two defense approaches. One expert analysis.#BobMotta #AaronSpencer #MichaelMcKee #MoniqueTepe #JudgeBarbaraElmore #DianeMenashe #MurderTrial #SelfDefense #HuselAcquittal #HiddenKillersJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Dr. Michael McKee is facing four counts of aggravated murder for allegedly killing his ex-wife Monique Tepe and her husband Spencer in their Columbus home on December 30th. The prosecution has ballistics. Vehicle tracking. Video footage. A suppressed weapon. No forced entry. And McKee just hired Diane Menashe. If that name doesn't mean anything to you, it should. In 2022, Menashe co-counseled the defense of Dr. William Husel — the Mount Carmel physician charged with murdering 14 patients with fentanyl overdoses. The prosecution called 53 witnesses over six weeks. Menashe called one. Husel walked on every count. She also kept Reagan Tokes' killer Brian Golsby off death row when eight jurors wanted him executed. She saved cop-killer Quentin Smith from lethal injection.Diane Menashe doesn't do hopeless cases. She does cases everyone else thinks are hopeless — and finds the fractures in the prosecution's fortress.Today we analyze her potential defense strategy: attacking the NIBIN ballistics match that isn't as ironclad as it sounds, questioning the shadowy Ring camera identification, exploiting the missing motive, and potentially presenting McKee's documented spiral — malpractice suits, disappearing from colleagues, expired licenses — as evidence of psychological deterioration rather than cold premeditation.McKee isn't walking free. The evidence is too damning. But the difference between life with parole eligibility and life without parole? That's what Menashe fights for. That's what money buys. Two orphaned children. A thousand mourners. And the best defense attorney in Columbus.#HiddenKillers #MichaelMcKee #MoniquTepe #SpencerTepe #DianeMenashe #TrueCrime #MurderDefense #WilliamHusel #OhioMurder #DomesticViolenceJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? The unsealed affidavit in the Spencer and Monique Tepe murder case reveals what investigators believe was weeks of alleged planning before two people were shot to death in their Columbus home. According to court documents, surveillance captured Michael McKee walking through the Tepes' yard on December 7th—while the couple attended the Big Ten Championship game in Indianapolis. Twenty-three days later, they were dead. But the documents reveal more than alleged reconnaissance. Witnesses told investigators that McKee made repeated threats to Monique during and after their marriage, including that he could "kill her at any time" and that "she will always be his wife." At least one witness reported that McKee allegedly strangled Monique and forced unwanted sex on her during the marriage—behaviors that domestic violence researchers identify as the strongest predictors of future lethality. The affidavit details how McKee allegedly used stolen license plates from Ohio and Arizona on his vehicle, how his cell phone went dark from December 29th until after noon on December 30th, and how his SUV was tracked arriving in Columbus before and leaving after the murders. After his arrest, investigators found fresh scrape marks where a distinctive window sticker had been removed. This is the anatomy of alleged premeditation. This is what "prior calculation and design" looks like when prosecutors lay it out. And this is the story of a woman who did everything right—left, divorced, rebuilt her life—and allegedly still couldn't escape someone who never accepted she had the right to leave.#HiddenKillers #MichaelMcKee #SpencerTepe #MoniqueTepe #UnsealedAffidavit #DomesticViolenceAwareness #TrueCrimePodcast #ColumbusOhioMurder #Stalking #AggravatedMurderJoin Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? We're going live with defense attorney Bob Motta for comprehensive legal analysis on two of the biggest murder cases right now.The Arkansas Supreme Court just removed Judge Barbara Elmore from Aaron Spencer's trial—the father who killed his daughter's alleged rapist. This is the second constitutional reversal in seven months. A retired judge is taking over. Prior rulings could be reopened. And Spencer still has to beat a second-degree murder charge while the prosecution uses prior statements about killing Fosler against him.Meanwhile, Michael McKee pleaded not guilty to four counts of aggravated murder in the deaths of Monique Tepe and Spencer Tepe. His attorney is Diane Menashe—who got Dr. William Husel acquitted of fourteen murders by calling one witness and letting the prosecution's case collapse. The state has ballistics, surveillance, vehicle tracking, and a suppressor. But Menashe doesn't defend cases—she attacks them.Bob Motta walks us through both situations live. How rare judicial removal is. What the new judge changes for Spencer. How defense-of-others works in practice. Whether Menashe's philosophy can beat the McKee evidence. In this episode of Murder in the Black, we unpack the heartbreaking story of Kim Groves—a Black woman, community advocate, and mother whose decision to report police misconduct in 1994 set off a chain of events that would change everything. What began as one woman speaking up against abuse of power quickly revealed something much bigger: a deeply corrupted system inside the New Orleans Police Department, and a city already battling violence, fear, and broken trust.Kim's story forces us to confront the cost of courage, the danger Black communities face when they challenge authority, and the uncomfortable truth that corruption doesn't always look like a stranger—it can wear a badge. The violent reality of New Orleans in the 1990s and the systemic failures that shaped itCorruption inside the NOPD, including the actions of Officer Len DavisKim Groves' courage—and what happens when a Black woman refuses to stay silentThe long history of mistrust between Black communities and law enforcement in AmericaHow race, power, and internal systems of oppression complicate “protection” and “justice”The investigation, cooperation deals, and what accountability looks like in a corrupt systemWhy police reform is still an urgent conversation—and why stories like Kim's must be rememberedTimestamps00:00 — Introduction + case overview00:35 — New Orleans in the 1990s: context + tension01:02 — Crime statistics + community impact02:24 — Len Davis + Kim Groves background03:42 — Misconduct culture inside the NOPD05:59 — Operation Shattered Shield begins08:11 — Kim files a misconduct complaint09:33 — The danger of speaking out11:05 — The legacy of racial oppression + policing13:09 — Kim Groves' murder + surveillance footage14:57 — Trial tactics: discrediting the victim16:37 — Witness testimony + plea deals20:03 — Victim-blaming + “perfect victim” expectations21:41 — Sentencing + why plea agreements matter24:50 — Len Davis' death + the lasting damage25:45 — Corruption and community trauma27:08 — Remembering Kim's humanity28:20 — Corruption involving Black officers30:05 — Accountability: personal + systemic31:26 — Closing reflection: race, policing, reformResources & LinksFBI: Operation Shattered ShieldKim Groves case coverage + justice reportingFollow + Support Murder in the Black
This Day in Legal History: “Axis of Evil”On January 29, 2002, President George W. Bush delivered his first State of the Union address after the September 11 attacks, a speech that would shape U.S. legal and foreign policy for years to come. During the address, Bush coined the term “Axis of Evil” to describe Iran, Iraq, and North Korea, alleging these nations were actively pursuing weapons of mass destruction and supporting terrorism. The speech marked a significant rhetorical shift in the U.S. posture toward preemptive military action and helped solidify a legal framework for broad executive authority in the name of national security. Citing the 2001 Authorization for Use of Military Force (AUMF), the Bush administration would go on to justify military interventions without new Congressional declarations of war.The “Axis of Evil” framing played a critical role in building public and political support for the 2003 invasion of Iraq. Though the legal justification centered on Iraq's supposed weapons programs and ties to terrorism, both claims were later discredited, leading to intense scrutiny of the legal rationale behind the war. Domestically, the period following the speech saw rapid expansion of executive power, new surveillance authorities, and detention practices that raised constitutional concerns. Internationally, the speech signaled a departure from multilateral norms and toward unilateral action under the banner of American security interests. The legal legacy of the address continues to reverberate in debates over presidential war powers and the limits of the AUMF. Critics argue the speech set a precedent for indefinite military engagement without sufficient Congressional oversight. Supporters contend it met the urgency of a new kind of threat in the post-9/11 world. Regardless of viewpoint, the 2002 State of the Union redefined the intersection of law, war, and foreign policy in the 21st century.A preliminary review by U.S. Customs and Border Protection (CBP) into the murder of Alex Pretti by federal immigration agents in Minneapolis did not state that Pretti brandished a firearm, contradicting earlier claims by Trump officials. Pretti, a 37-year-old ICU nurse, was shot after reportedly refusing to move from the street when ordered by a customs officer. Initial official statements described Pretti as an armed threat, with the Department of Homeland Security noting he had a handgun—though it was holstered—and Trump aide Stephen Miller labeling him a “domestic terrorist” without evidence. However, video footage from the scene challenged these claims, showing an agent removing a holstered weapon from Pretti's waist before the shooting. The CBP review, based on body camera footage and internal documents, said officers attempted to move Pretti and a woman from the street and used pepper spray when they didn't comply. A struggle followed, during which a Border Patrol agent shouted “He's got a gun!” before both agents opened fire. The review, which is standard protocol, was shared with lawmakers but emphasized it contained no final conclusions. The identities and experience levels of the involved officers, particularly regarding urban crowd control, remain undisclosed. The incident has sparked national controversy and prompted a more restrained response from Trump in its aftermath.U.S. review of Alex Pretti killing does not mention him brandishing firearm | ReutersThe U.S. federal judiciary may only be able to continue full paid operations through February 4 if Congress does not pass funding legislation in time to avert a partial government shutdown. Judge Robert Conrad, who oversees the Administrative Office of the U.S. Courts, issued a memo warning of the looming shortfall, stating that while courts will remain open on February 2, they would quickly exhaust available funds by February 4. The uncertainty comes amid a broader funding standoff in Congress, where a six-bill package—including money for defense, housing, transportation, and a $9.2 billion judiciary allocation—is stalled.A key point of contention is the funding of the Department of Homeland Security (DHS), especially following the fatal shooting of U.S. citizen Alex Pretti by immigration officers. Senate Democrats are now refusing to approve DHS funding without reforms, throwing into doubt whether the broader package can pass. Although the bills had passed the Republican-controlled House and previously seemed poised for Senate approval, the Pretti incident has triggered renewed partisan gridlock. If no agreement is reached, this shutdown could affect the judiciary much sooner than the previous lapse in 2025, when courts operated for over two weeks before curtailing services. The current funding crisis threatens court staffing, case management, and broader access to justice. The memo underscores the fragile position of the courts in a prolonged budget standoff, with potential furloughs and suspended operations looming if a deal isn't struck.US judiciary may not be able to fully maintain operations past Feb. 4 in government shutdown | ReutersGoogle has agreed to pay $135 million to settle a proposed class action lawsuit accusing it of collecting Android users' cellular data without their consent. The settlement, filed in federal court in San Jose, California, still needs judicial approval. The lawsuit claimed that even when users closed Google apps, disabled location sharing, or locked their devices, Google continued to gather mobile data, which users had paid for through their carriers. Plaintiffs alleged this behavior amounted to “conversion,” a legal term referring to the unauthorized taking of someone's property for one's own use.Though Google denied any wrongdoing, it agreed to stop transferring data without user consent during Android device setup. The company will also update its Google Play terms to clearly disclose data transfers and give users simpler options to disable them. The case covers Android users dating back to November 12, 2017. If approved, users could receive up to $100 each from the settlement fund.Plaintiffs' attorneys described the agreement as the largest known payout in a conversion case, and they may seek nearly $40 million in legal fees. A trial had been set for August 2026 before the settlement was reached. Google has not commented on the resolution.Google to pay $135 million to settle Android data transfer lawsuit | ReutersGoogle to Pay $135 Million to Settle Android Phone-Data SuitA Christian substitute teacher, Kimberly Ann Polk, has lost her attempt to revive First Amendment claims against Maryland's Montgomery County Public Schools (MCPS) after refusing to use transgender students' pronouns. The Fourth Circuit Court of Appeals upheld a lower court's decision, finding Polk unlikely to succeed on claims that the district's pronoun policy violated her free speech and religious freedom rights. The court ruled she failed to show any evidence of religious hostility from the school board and did not meet the legal threshold to proceed with her constitutional claims.Polk argued that MCPS's policy, which requires staff to use names and pronouns aligned with students' gender identities and bars disclosing those identities to unsupportive parents, conflicted with her belief that gender is fixed at birth. While the court dismissed her constitutional claims, it allowed her separate Title VII claim for religious accommodation to proceed. This claim argues that MCPS violated federal civil rights law by not making space for her religious beliefs in its employment practices. The decision was split, with Judge J. Harvie Wilkinson dissenting. He called the school policy a “gross assault upon the First Amendment” and argued Polk had a valid free speech claim. The case reflects ongoing national legal tensions between employee religious rights and school policies supporting LGBTQ+ students. Notably, another federal appeals court had previously sided with a teacher in a similar dispute, signaling a potential circuit split.Christian Teacher Can't Undo Pronoun Case First Amendment Loss This is a public episode. In March 2021, Sarah Everard left a friend's house in London and started walking home. It was a normal evening, the kind of walk most people do without thinking twice. But when she didn't return, her family and friends became worried. They called her, searched the area, and waited for news. As the hours turned into days, the story spread beyond her friends and family. The case became a national headline, and the worry turned into fear. What began as a missing-person investigation soon felt much more serious. Then the investigation took a turn that surprised many people. What seemed like a simple disappearance became something far more disturbing, and the impact reached far beyond one woman's life. What happened to Sarah Everard raised serious questions about women's safety, and about how much we can trust the people who are meant to protect us. It became a case that shook the country. *Note: This episode was originally released on May 30, 2023.In 2011, 19-year-old Josie Dikeman was accused of child neglect after her boyfriend's one-year-old daughter suffered a skull fracture and a brain injury in her care. That charge was dropped. Two years later, she was convicted in a separate child neglect case regarding the same little girl, by then age three, who had been returned from foster care only to become malnourished and suffer fractured hands and feet while in Josie and her boyfriend's care. After Josie moved in with her new boyfriend, Derek Pedrin, forming a large, blended family with seven children, loved ones began reporting concerns that Josie was abusing or neglecting Derek's son, Alexavier. Derek and Josie began refusing to let Alexavier's maternal family see him. On February 10 of this year, police performed a welfare check at the family's request, finding Alexavier asleep and very drowsy, but supposedly fine. Fifteen hours later, police returned to the home, where six-year-old Alexavier was pronounced dead. This is part one of the infuriating story of Alexavier Pedrin. Note: This episode was originally released on June 2, 2023.In the last episode, I began telling you the story of six-year-old Alexavier Pedrin, whose short life was filled with constant family turmoil and frequent involvement by various CPS agencies in his home state of Wisconsin and others. After Alexavier's mom went to prison, his father eventually stopped letting her side of the family see their son, allowing the abuse and neglect Alexavier allegedly suffered at the hands of his father's girlfriend run rampant. In this episode, I'll tell you about the police's welfare check on Alexavier the night before his death; the circumstances surrounding his death on February 11, 2023; the resulting police investigation, and the very recent arrest of a woman who took the responsibility for caring for Alexavier but never should have been allowed near children in the first place. Note: This episode was originally released on June 7, 2023.Over the last two episodes, I told you the story of Alexavier Pedrin, whose six years were marred by family turmoil, alleged abuse and neglect, and CPS involvement. On February 11, 2023, Alexavier was found dead in his family's rented home in Medary, Wisconsin with multiple inflicted injuries and Xanax in his system. Three months later, his father's girlfriend, 31-year-old Josie Dikeman, was finally arrested and charged with Alexavier's murder. For this episode, I had the honor of speaking with two close members of Alexavier's maternal family: his cousin, Raven Holzer, and his aunt, Annie Anderson, who are dedicated to keeping Alexavier's memory alive, giving him a voice, and protecting other kids like Alexavier. This is part three of the infuriating story of Alexavier Pedrin.
