Jeff brings up a good point here... attorneys, title companies and real estate brokers might know how to walk you through the mechanics of a seller financed real estate transaction, but unless they actively buy mortgage notes for their own portfolio, they don't know how to help you put the deal together in a way that makes it the most valuable... they have NO IDEA what your note would sell for on the secondary note business market. Loan originators and licensed servicers also can have insight as to specific compliance issues, but first you have to know if seller financing is even for you. First step: based upon your goals, objectives and unique personal circumstances, I will help you decide if owner financing is for you, if your plan is solid, or will end up costing you thousands. If you might need money sooner than later, we can set you up to sell your note for minimum discount while still helping you keep your own private pension and passive retirement income. Second step: have an attorney in your state provide boiler plate documents. Then I will review it and make sure the numbers are right, and make sure special clauses and terms are inserted that will give you every advantage. Third step: double check for compliance with the interest rate you are charging, late fees, and other things that make your note water tight so you'll never find yourself standing in front of a judge, or facing a steep fine. When you sell a property with owner financing, one of the biggest advantages for you, as the seller, is that you can dictate and control a lot of the terms and conditions of the loan you set up.This is a huge benefit, but only if you know how to wield this kind of power and what options you have on the table.Let's step back and acknowledge something.When you give your buyers the option to purchase your property with seller financing, you're doing them a huge favor. This allows them to sidestep a lot of the time-wasting (and sometimes deal-killing) red tape that banks force their borrowers to go through.Sometimes, seller financing is a borrower's only option because their bank doesn't like the property or the borrower's risk profile.Other times, buyers will take you up on seller financing even if they have other options simply because they don't want to deal with banks.Don't get me wrong, working with a bank has advantages too.Banks typically charge a lower interest rate and almost always allow for a longer amortization on their loans with no balloon payments. Banks have no problem letting their borrowers pay off loans over 15 to 30 years, but most sellers (including you) won't wait this long to get their money back.If you decide to offer this convenience to your borrowers, you'll want to know how to stack the cards in your favor so that you're compensated for the inconvenience of waiting longer to get your money. In this session of Property & Paper Live, Ken brings up a pending foreclosure. He really wants the property, and is considering bidding at the Trustee Sale. There is a 2nd that is in danger of being completely wiped off. He could offer to buy the 2nd at a discount and foreclose from that position to greatly increase his opening bid and almost guarantee he'd get the property with the opening bid. But then he'd have to start the foreclosure timeline over again. Maybe if he'd thought of that earlier on, it would have been a good option. We also talk with others on the call and end with sharing a way to get help submitting owner financing offers so you can buy your home or investment property without asking a bank for a loan!

When you buy real estate with seller financing, you can structure the terms of the deal so that YOU, as the buyer/borrower, have a deal that is highly advantageous for you, with as many options as possible.Granted, you'll be somewhat limited by the seller and the options they're willing to give you. However, when you get a loan from a bank or credit union, you will not have this flexibility. There's not even a point in trying to negotiate the terms of your loan with them because that's just not how they work.When you borrow money from a bank or credit union, they will always use their boilerplate templates, which are written to give them the maximum amount of control and options.With seller financing, there is much more opportunity to write the loan documents in a way that is fair to the seller but also works to your advantage by giving you plenty of upsides and advantages.Of course, your ability to negotiate terms will depend on the seller's flexibility, what they need, how sophisticated they are, and how much they're willing to entertain what you want. But in many cases, if you're the one proposing seller financing in the first place, and if you already have your own documents and deal structure well-planned and ready to go, many sellers won't put up obstacles in the same ways a bank will.Understanding Your OptionsI want to share several different terms you can infuse into your loan documents, to give yourself the kinds of options and control you will never have with a bank loan.I don't mean to imply that you should always push for all of these things. In fact, it would be highly unlikely that you could get a seller to agree to all of these conditions.My point sis NOT that you should pursue all these things. My goal is to help you see the different cards you can play so you can get creative and pull the right ones out of your back pocket when needed.This way, you can choose the most appropriate one(s), depending on the seller's willingness to accept. Only You Can Save Owner Financing in TexasIt's a sad day when a regulatory body in Texas is working against property and business owners to make it extremely difficult to get an owner-financing transaction done. That's what it going on right now with the Texas Savings & Mortgage Lending Department (which handles licensing issues for mortgage companies and loan officers) which is proposing rule changes that would adversely affect your ability to sell your property, land, or business on seller financing.Link to the Seller Financing Coalition & Letter CampaignWatch the original video HERE!Currently, numerous proposed rule changes would harm future Texas home buyers, particularly those who are currently not well served by the financial services industry due to demographic and economic factors. These proposed rule changes will also hurt numerous small business owners and private home sellers. Two examples of harmful rule changes are:A. The Department's new regulation requiring that all RMLO (Registered Mortgage Loan Originator) agents work for a bank or mortgage company harms Texas citizens in multiple ways.1. RMLOs can no longer be self-employed despite their own efforts to become licensed professionals.2. All prospective buyers must now seek to fit within the narrowing loan requirements imposed by banks and mortgage companies, etc. This denies access to credit to many hard-working people who are a) self-employed, b) buying vacant land, c) have lower incomes, and d) using multi-generational resources to qualify for homeownership loans.3. It means private individuals or small businesses that already own homes or properties cannot hire an RMLO to qualify potential buyers as part of a seller-financing transaction. This prevents such sellers from complying with Dodd-Frank.B. To legally meet the growing demand for non-bank financing on homes and vacant land numerous individuals rely upon seller financing. Private individuals or small businesses in Texas who offer seller-financing for homes or land to other Texans, frequently use independent RMLOs. Using these independent RMLOs protects both the Buyer and the Seller.Given these facts, the following proposed language in “§56.100 Licensing Requirements” is rather harmful.“However, if the lender owns the residential real estate securing the loan and has exceeded the limit for exempt transactions as provided by Finance Code §156.202(a-1) (3), the lender must be licensed under Finance Code Chapter 156, regardless of whether the lender has secured the services of an originator as provided by this subsection.”This proposed verbiage goes beyond the SAFE Act and Dodd-Frank requirements and imposes a harsh “scarcity penalty” on disadvantaged buyers by severely restricting the number of properties that a non-lender seller can sell using seller finance. This harsh and unnecessary restriction on what private citizens in Texas can do (sell) with their own houses and land is unwarranted. In a time of shrinking inventory and rising demand removing assets and liquidity from the market place is harmful to all Texans.Here are some reasons an individual or small business will hire an RMLO as part of a seller-financed transactionA. The RMLO ensures that all Dodd-Frank regulations are followed for both the lender and the borrower (homeowner).B. The RMLO agent makes sure the borrower (homeowner) is economically qualified to buy (has the ability to pay) and understands the specifics of the loan.C. Not using an RMLO allows unsavory lenders to take advantage of naïve borrowers.D. Not using an RMLO may cause individuals or small Texas businesses to unknowingly violate Dodd-Frank and face federal charges and/or penalties that could cause financial duress, or unintentionally destroy and close small Texas businesses.Love the show? With higher mortgage interest rates, taking over bank loans written at 3% and 4% are all the rage. Everywhere you look investors are getting under contract with subject to seller financing terms, and they flip them to unsuspecting buyers for tens of thousands of dollars. What they fail to realize is that there is 1) a high chance of acceleration (triggering the 'due on sale'), 2) a high chance of getting sued down the road, and 3) a high chance of setting buyers up for financial loss and disappointment. There is only one way to leverage existing institutional financing 100% legally and in a way the guarantees that the loan won't get 'called' or accelerated. I interview Scott Moyes who has the only Title Holding Trust system I would ever use. As investors, let's get deals done, solve problems and make money without creating unnecesssary risk for all parties to the transaction. We need to equitably balance risk and reward, and make sure it's good for everyone now, and down the road.
