Mike Esworthy, Chief Strategy Officer at EnableComp, understands the challenges that health systems face when dealing with complex health claims such as workers' compensation, Veterans Administration, motor vehicle accidents, Medicaid, and out-of-state claims. These exception-based claims require deep subject matter expertise to identify the right payer and process the claims correctly. Mike explains, "I think the easiest example to provide in that context, if you look at a worker's comp claim, more often than not, when a patient comes into the hospital, they don't know who their company's workers' comp provider is, and so often they hand over the commercial insurance card. If that doesn't get caught early, the commercial insurance gets billed, it results in a denial, and the claim sits out there in the ether for 30, 45 days before it comes back to the provider to go figure out who is the right payer class for this. So that's the big picture of the challenges. And then each of those claim types has unique nuances that make this challenging." "I think there are a lot of good things happening in the VA that are, in theory, improving access for veterans, and that's a great thing. From a claim standpoint, though, I think all of the core challenges still remain. And so I know that many of the EMRs have been putting a focus on interoperability, and all of that is great from a treatment care coordination, getting veterans seen in hospitals, and getting them through the door." "But once they've been treated, all of the same challenges that were prevalent before, all of these announcements are still out there. And I think the complexity still exists in terms of not being a normal payer pathway for providers and not knowing all the specific rules. Summary of Chapter 2: Jurisdiction. Chapter 2 provides a comprehensive overview of the different types of jurisdiction that determine which court system—federal or state—can hear and decide a case. Understanding these types of jurisdiction is crucial for ensuring that cases are filed in the appropriate court. Federal Question Jurisdiction: Federal question jurisdiction, under 28 U.S.C. § 1331, allows federal courts to hear cases "arising under" federal law, including constitutional issues, federal statutes, and treaties. The "well-pleaded complaint rule" ensures that the federal question is evident from the plaintiff's initial complaint. Diversity Jurisdiction: Diversity jurisdiction, provided under 28 U.S.C. § 1332, enables federal courts to hear cases where the parties are citizens of different states or countries and the amount in controversy exceeds $75,000. This type of jurisdiction offers a neutral federal forum to mitigate potential state court biases. Supplemental Jurisdiction: Supplemental jurisdiction, under 28 U.S.C. § 1367, allows federal courts to hear additional claims closely related to those over which they have original jurisdiction. This includes pendent jurisdiction for state law claims related to federal claims and ancillary jurisdiction for necessary claims involving additional parties or issues. Exclusive vs. Concurrent Jurisdiction: Exclusive Jurisdiction: Certain cases, such as bankruptcy and patent disputes, can only be heard in federal courts to maintain uniformity and consistency in federal law. Concurrent Jurisdiction: Some cases, including many involving diversity jurisdiction, can be heard in either federal or state courts, giving plaintiffs the option to choose the forum. Removal and Remand: Removal: Under 28 U.S.C. § 1441, defendants can transfer a case from state court to federal court if it could have originally been filed in federal court. Liz McConaghy was the longest serving female crewman on the Royal Air Force Chinook Fleet spanning a 17 year career flying on the aircraft. Originally from a small town in Northern Ireland she attended RAF Cranwell on her 19th birthday to begin her exciting career thereafter on Chinook Helicopters. She was the youngest aircrew to deploy to Iraq aged just 21 and also the only female crewman on the Chinook wing for 4 years, so her story is completely unique. Her career saw her amass 2 deployments to Iraq and 10 deployments to Helmand Afghanistan in support of Operation Herrick which gave her an insightful and very personal perspective on war. Upon leaving the RAF in 2019 Liz slowly became unravelled after a series of traumatic events that compounded her PTSD. This led to her trying to end her life in Aug 2020.
