Australia recently passed an amended anti-money laundering and counter-terrorism financing (AML/CTF) bill that will soon include Tranche 2 entities in its regulatory regime. The result? Approximately 100,000 new entities under its scope. Regulating non-financial entities is not a new undertaking, as we've seen in countries like the UK, Singapore, and United Arab Emirates. Crucial to the success of the regime and overall client experience will be how Australian firms adopt the best practices shown by firms in other parts of the world, while ensuring they account for the nuances of their domestic market. In this episode of KYC Decoded, risk advisory lawyer, Jeremy Moller, from Norton Rose Fulbright and Qing Liu, Moody's Senior Director of Compliance & Third Party Risk in Australia, sit down with host Alex Pillow to discuss what the anticipated changes mean for Tranche 2 obliged entities and the future of compliance in Australia.Key topics:Introduction of the Tranche 2 regulationsChallenges and opportunities for firms implementing the reformsInternational comparisons of similar regimes, and opportunities for harmonizing regulationsAdditional resources:Register for Moody's in-person Sydney event on April 3 – the event features a blend of plenary and breakout sessions led by industry peers and Moody's financial crime practice lead.Law Council of Australia: AML/CTF Guidance and Vulnerabilities AnalysisLaw Society of New South Wales AML/CTF HubInformation on AUSTRAC's AML/CTF ReformNorton Rose Fulbright's Tranche 2 and AML/CTF Reforms HubVisit our website and get in touch to learn more – we would love to hear from you.

A recording of the inaugural Kaldor Centre Oration, delivered by Kate Eastman AM SC and Zaki Haidari on 21 November 2024. The Kaldor Centre Oration is a new flagship lecture hosted by the Kaldor Centre for International Refugee Law at UNSW Sydney, designed to enrich the public conversation on refugee issues by showcasing transformational ideas that can spark fresh thinking and action. It is a valuable opportunity to build shared understanding and positive solutions. The inaugural 2024 event builds upon the Kaldor Centre's track record of thought leadership, stemming from more than a decade of principled, evidence-based contributions to the refugee debate. This recording is for anyone interested in creating a better future – be they people with lived experience of displacement, civil society, legal practitioners, policymakers, business leaders or community members. About the speakers: Kate Eastman AM SC is a Sydney barrister working in the fields in human rights, discrimination, employment, public and constitutional law. Over her 30 years practicing as a lawyer, Kate has been committed to human rights and equality. At Allens, she represented asylum seekers in detention in Port Hedland. She then worked at the Australian Human Rights Commission before joining the Bar in 1998. Between 2019 – 2023, she was Counsel Assisting the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability. She has taught human rights law at UTS, Monash University and the University of Sydney, and in Burma and Uganda. Kate is chair of the Australian Bar Association's Diversity and Inclusion Committee and the Law Council of Australia's Equal Opportunity Committee. Having arrived with little English, in 2015, just three years after he came to Australia, he won the NSW Government's International Student of the Year Award (2015). He has also completed a Diploma in Computing and a Diploma in Graphic Design. Zaki is a compelling human rights advocate. On today's show, Five Times August's Brad Skistimas shares his newest song - a collaboration with Joseph Arthur! Namely, a hauntingly beautiful, re-imagined version of Joseph's classic IN THE SUN. Later in the show, Joseph is joined by legal and governance advisor Libby Klein - who is speaking at the ASF's Inaugural "Progress through Science & Freedom" Conference in Sydney - to discuss the World Health Organization's power grab. GUEST 1 OVERVIEW: Five Times August is the solo act of singer/songwriter Brad Skistimas. Skistimas has appeared on the FOX Business channel as an expert "Do-It-Yourself" indie artist and featured in Billboard Magazine, Performing Songwriter, Guitar Player, PeopleMagazine, and USA Today. In early 2021 Five Times August began releasing a series of protest songs taking aim at Covid-era regulations, the Biden administration, Justin Trudeau, as well as Anthony Fauci - the hit track SAD LITTLE MAN soared to the top of multiple charts, captivating the attention of millions. In November 2022 Five Times August released the full length album SILENT WAR a compilation featuring all of the recent protest singles - the album reached #1 on Amazon and Apple Music's singer/songwriter and alternative charts. In 2023 Five Times August signed with new record label Baste Records to release the brand new single AIN'T NO ROCK AND ROLL, calling out all the mainstream musicians and bands that didn't speak out against government tyranny in recent years. Despite encountering suppression on platforms such as YouTube and Facebook, the music videos been viewed millions of times and prominently featured on Glenn Beck, Chad Prather, Del Bigtree's The HighWire, The Federalist, The Post Millennial, RebelNews, and many more. https://www.fivetimesaugust.com/   GUEST 2 OVERVIEW: Libby Klein is a lawyer, company secretary and governance advisor, working mostly with Not-for-profits and charities. In 2021, Libby was incredulous – and then incensed – to learn that doctors in Australia were being gagged from talking about early treatments and risks/benefits of vaccines. This led her on a path of discovery, and she now spends most of her spare time researching the World Health Organisation, having figured out that the proposed new powers for the W.H.O., combined with Australia's emergency laws, will mean the end of functioning democracy in Australia: the W.H.O. will tell us what we need to do in the case of a public health emergency, and we will be legally obliged to comply, with little or no role for our parliaments let alone individual citizens wishing to make their own medical choices. Her conclusion: we must Exit the W.H.O. immediately. Libby has honours degrees in Agricultural Science and Law, and a background in financial services. She is a fellow of the Governance Institute of Australia, a Graduate member of the Australian Institute of Company Directors, a member of the Law Council of Australia Charities and Not-for-profits Committee, and honorary legal adviser to the Australian Medical Network. She is the founding principal of Social Impact Legal and a director of Brightlight Impact Holdings, a global leader in impact investing. Libby has also previously served as a director of Christian Super, and of Churches of Christ Financial Services. She writes at her substack Reclaiming Ethical Medicine. https://libbyklein.substack.com/ https://australiaexitsthewho.com/ https://australianmedicalnetwork.com/

In Episode 126 of the No Limitations podcast Bears on Bicycles, Blenheim Partners' Gregory Robinson speaks with Peggy O'Neal AO, Chancellor of RMIT University and former President of the Richmond Football Club. In a compelling conversation, Peggy discusses her start in life in a small coal mining town in West Virginia and how, after meeting an Australian backpacker in Greece, she relocated with him to Melbourne. Peggy then forged a reputation as one of Australia's leading superannuation and financial services law experts and, since then, has taken on a range of Board positions. Peggy speaks about her role as President of the Richmond Football Club where they won three premierships in four years under her stewardship. From within the inner sanctum, Peggy sheds light on the euphoria of winning: the culmination of a new strategic agenda, improved financial management and the importance of consistency. She is also credited with strongly suggesting that coach Damien Hardwick complete a leadership course at Harvard where he learned the mantra of “excellence with happiness” that led to ultimate success for the Club. As the Chair of the now cancelled 2026 Commonwealth Games in Victoria, Peggy sheds some light on the behind the scenes challenges. In addition, as Chancellor of RMIT University, she emphasises the importance of both vocational skills and intellectual development in a tertiary degree and closes with her view on the nature of leadership in today's society. Peggy started her career in Australia as a solicitor, and later partner, at Herbert Smith Freehills and is currently a consultant to Lander & Rogers, having specialised in superannuation and financial services law for over 25 years. She is the Chancellor of RMIT University, the Chair of Vanguard Superannuation and a Board Member of Women's Housing Ltd and Home for Homes (an initiative of The Big Issue). Peggy has also served on the Boards of MLC Super Ltd and the Commonwealth Superannuation Fund. She has been Chair of the Law Council of Australia's Superannuation Committee and was a consultant to the federal government's review of the superannuation system in 2010. In sport, Peggy is the immediate past President of the Richmond Football Club, having served on the Board since 2005. She was also Chair of the Victorian Minister for Sport's Inquiry into ‘Women and Girls in Sport and Active Recreation' and was appointed to the Australian Institute of Sport Athlete Wellbeing and Engagement Advisory Committee, as well as serving on the AFL's Mental Health Steering Committee. She was on the Victorian Ministerial Council on Women's Equality for three years and was the inaugural Co-Chair of the Victorian chapter of the Minerva Network. Peggy is a Fellow of the Australian Institute of Company Directors and is a member of Chief Executive Women and the Melbourne Forum. In 2019, Peggy was made an Officer of the Order of Australia for her services to Australian rules football, financial services law and women in leadership. Peggy was awarded Melburnian of the Year in 2021, received VicSport's award for "Outstanding Contribution to Sport" in 2022, and will be inducted as an AFL Life Member for her services to Australian Rules Football in 2024. Small Biz Matters – a half hour program each week where you can work ON your business rather than IN it.with Alexi Boyd from Boyd Office Management ServicesDate: 27 November 2018 The Legal System. Small business owners should probably understand it more than we do but we only start diving into it in worst case scenarios. We engage with legal experts only when we NEED it and hope to never have to. But like all the hats we wear, it’s a good idea to arm yourself with knowledge before it happens rather than when its upon you, or worse still when you have buried your head in the sand and it engulfs you. Today’s program is all about doing just that. When should small business understand family law? As business owners, our finances, relationships, and family are all tied in with our work. When that structure breaks down it is disastrous not only for you personally but for your business. Today’s guest Zoe Durand is an author of the book Inside Family Law - rare & candid conversations with those at the coalface of the family law system. An expert in her field working in the family law system for over a decade specialising in mediation. She is joined by Mark Lipsen from Hall Chadwick and here to share their experiences, knowledge and tips of dealing with the mess when small business and family law collide. Welcome to the show Zoe & Mark. Topics we’ll be covering: Overview - the fact that a business can be part of the asset pool and the duty to fully disclose all financial documents. The process for valuing a small business including the parties agreeing on an expert, step by step how the expert business valuer/ forensic accountant will value the business, methodology, documents to the valuer and the valuer meeting with the parties. What if you disagree or want to challenge a business valuation - adversarial experts, cross examination of the expert valuer Discussion of possible options if both parties were involved in the business. Should both parties remain in the business after separation? Or safe guards that can be put in place should one party step back from the business. The Court's cross referral powers - ie the fact they can refer parties to the DPP and ATO if there has been tax fraud (I have seen this come up sometimes in matters where small businesses are involved). I.e. one should always be 'squeaky clean.' Tracking hidden monies / assets.   About the Book - Inside Family Law - rare & candid conversations with those at the coalface of the family law system Inside Family Law opens wide the behind the scenes real world of the family law system. It is the first family law book to offer readers never before published interviews with those who work at the coalface of family law throughout Australia. As the threat of terrorism continues to grow, governments and security agencies have been given more power to protect the public. But at what cost? Lawyer Morry Bailes discusses the balance of security and freedom, and asks the question, are we prepared to give up our rights and freedoms in our response to terror? And if so, to what extent? In this episode, Law and Life looks at the role of the courts, parliament and security agencies, whether the response outweighs the threat, and how we as a society can protect our freedoms. Morry Bailes (@morrybailes) is managing partner at TGB Lawyers, Treasurer of the Law Council of Australia and a past President of the Law Society of South Australia. Morry outlines the failings of mandatory sentencing, as well as the community and media misconceptions.
