Mark Huberman, a retired Magistrate Judge, is the Editor of Health Science magazine.  He has adhered to a whole food, plant-based vegan diet since birth in 1951 and credits his excellent health to the pioneering vision of his parents, Max and Ruth Huberman, who had the foresight to recognize the profound benefits of this lifestyle long before most others.  His parents operated a legendary health food store in Boardman, Ohio for more than 33 years where they influenced countless individuals to change their diet and lifestyle and regain and preserve their health.   For nearly all of Mark's adult life, his greatest passion has been supporting the work of the National Health Association, the oldest organization in the Country advocating the benefits of a whole-food, plant-based diet and lifestyle, something it has been championing since its founding in 1948.  He became a member of its Board of Directors when he was 18 years old and was elected its youngest President in 1977 and served two consecutive two-year terms.  He returned to serve two more terms in the mid 1990's and then once again from 2004-2005.  In March 2012, he was again asked to serve as President and has continued in that role to this day. In partnership with his wife, Wanda, who retired from her 30-year career in the insurance industry, is now the full time Executive Director of National Health Association. They organize annual health conferences which feature the leading voices of the whole-food, plant-based health movement, including Drs. Joel Fuhrman, Alan Goldhamer, Stephan Esser, Frank Sabatino, Neal Barnard and more.    Mark loves sports, the theater, hiking, traveling, and in the Summer time, his organic garden. Routine Business Not Protected Work Product In Aerojet Rocketdyne, Inc. v. Global Aerospace, Inc., et al., No. 2:17-cv-01515-KJM-AC, United States District Court, E.D. California (October 25, 2023) an insurance coverage dispute wastes the time of the court and are admonished by the court. FACTUAL BACKGROUND In a long-running insurance coverage dispute that was prolonged for several years by defendant Global Aerospace Inc.'s refusals to produce evidence in response to requests from plaintiff Aerojet Rocketdyne, Inc. The root of the disagreement was Global's assertion of attorney-client privilege and work-product protections. The Magistrate Judge determined the disputed evidence was not protected by the attorney-client privilege or work product doctrine, and the court denied Global's repeated requests to revisit that decision. In short, although attorneys were involved in the disputed investigation, communications with them were not privileged, and their work product was not protected; the investigation was part of the company's routine business. It was not conducted in anticipation of litigation. Several defendants, including Global, have now moved for summary judgment. Briefing is ongoing. The exhibits are excerpts of transcripts from two depositions marked “confidential” under the terms of a discovery protective order. The witnesses were Katherine Posner and Wendy Grossman, two attorneys at the center of the dispute about privilege and work product. The defendants argued the transcripts are “sensitive” and must be sealed because they “would ordinarily be protected by the attorney-client privilege and work product doctrine.” The courts of this country recognize a general right to inspect and copy public records and documents, including judicial records and documents. Although that right is not absolute, a strong presumption in favor of access is the starting point. This presumption is based on the need for federal courts, although independent-indeed, particularly because they are independent-to have a measure of accountability and for the public to have confidence in the administration of justice. When documents are filed with motions more than tangentially related to the merits of a case, such as alongside a motion for summary judgment, a party who asks to keep them secret must meet the high threshold of showing that compelling reasons that support that request. This standard applies even if the documents have previously been filed under seal or are covered by a generalized protective order, including a discovery-phase only protective order. Once confidential discovery documents are made part of a dispositive motion they lose their status of being raw fruits of discovery. (“ALP”), PV Supply, Inc. (“PV”), and Pal Vakula, alleging common law fraud and unjust enrichment claims. In Government Employees Insurance Company, GEICO Indemnity Company, Geico General Insurance Company, and GEICO Casualty Company v. ALP Supply, Inc.; PV Supply, Inc.; and Pal Vakula, No. 22-CV-79 (LDH)(MMH), United States District Court, E.D. New York (September 29, 2023) GEICO sought, and obtained, default judgments against health care fraud perpetrators. The GEICO Plaintiffs' moved the USDC for default judgment pursuant to Federal Rule of Civil Procedure 55(b)(2). For the reasons set forth below, the Magistrate Judge  recommended that Plaintiffs' motion should be granted as to their common law fraud claims. The Court further recommended that Plaintiffs should be awarded damage. From July 2019, Vakula used ALP and PV to submit and cause to be submitted to GEICO thousands of fraudulent no-fault insurance claims for medically unnecessary, illusory, and otherwise non-reimbursable DME and OD. Defendants not only submitted claims to GEICO knowing that they included materially false information but also hired law firms to pursue collection of the fraudulent claims from GEICO, which resulted in expensive and time-consuming litigation against GEICO if the charges were not promptly paid in full. In the Second and Fourth Causes of Action in the Complaint, GEICO alleges that Defendants committed common law fraud. Under New York law, a plaintiff asserting a claim of common law fraud must plausibly allege: a material misrepresentation or omission of fact made by defendant with knowledge of its falsity intent to defraud; reasonable reliance on the part of the plaintiff; and resulting damage to the plaintiff. Here, GEICO established that an actual controversy exists and that a declaratory judgment would afford specific and conclusive relief as to pending claims with respect to all Defendants. GEICO alleges that ALP and PV have pending bills submitted to GEICO that GEICO has no obligation to pay. Additionally, GEICO has submitted documentation of pending collections actions that ALP and PV are actively prosecuting against GEICO in New York state courts. GEICO has provided a list of the actions, including the amounts involved, the claim numbers, and the status of each action. In sum, Plaintiffs established liability on their common law fraud claims only. Multi-Unit Construction Exclusion Eliminates Coverage Midvale Indemnity Company (“Midvale”) sued Arevalos Construction Corp. (“Arevalos”), Victor Siguenza Zuniga (“Zuniga”), 625 Halsey LLC (“Halsey”), D&G Construction NY Inc. (“D&G”), and RM Construction and Development Corp. (“RM”) seeking a declaratory judgment relating to a commercial general liability insurance policy Midvale issued to Arevalos and an underlying lawsuit in New York state court, captioned Victor Siguenza Zuniga v. 625 Halsey LLC, Index No. 525911/2018 (the “Underlying Action”). In Midvale Indemnity Company v. Arevalos Construction Corp., et al, No. 22-CV-97 (FB) (RML), United States District Court, E.D. New York (July 5, 2023) was asked to overturn the report and recommendations of the Magistrate Judge to acknowledge the default and order no coverage for defense or indemnity of anyone named in the Underlying action. FACTS D&G and Zuniga timely objected to the report of the Magistrate judge. These objections triggered the US District Judge's de novo review. D&G, a subcontractor of Arevalos claiming coverage and a right to indemnification by Arevalos' insurer Midvale, and Zuniga, the injured tort claimant in the Underlying Action, has been named as defendants in this declaratory action by Midvale. D&G and Zuniga object to the Magistrate's finding that none of the named defendants was owed coverage under the policy. DISCUSSION D&G and Zuniga object to the conclusion that they lack standing to oppose Midvale's motion, its finding that none of the named defendants were entitled to coverage, and the scope of its declaratory relief. The Magistrate recommended finding that D&G's subcontractor agreement with Arevalos imposed no duty on Midvale, a “stranger to that contract,” to D&G. On June 30, 2022, Justice Ketanji Brown Jackson made history by becoming the first African American woman to be sworn in as an Associate Justice on the United States Supreme Court. We had a chance to discuss this monumental day with Chief Judge Anna Blackburne-Rigsby of the District of Columbia Court of Appeals. In Episode 2, Chief Judge Blackburne-Rigsby, who authored a 2010 law review article titled Black Women Judges: The Historical Journey of Black Women to the Nation's Highest Courts, discusses the historic meaning of Justice Jackson's ascension to our nation's highest court, why diversity in the appellate judiciary is so critical to our judicial systems, and how events in the past few years created an environment ripe for Justice Jackson's appointment in 2022.Chief Judge Anna Blackburne-Rigsby was sworn in as Chief Judge of the District of Columbia Court of Appeals on March 17, 2017. In 2018, the North Carolina General Assembly placed several constitutional amendments before voters for ratification. Voters approved the amendments, which included amendments related to voter ID and a cap on the state income tax. But in August 2022, a sharply divided Supreme Court of North Carolina held that these amendments may be invalid. The majority's opinion focused on a federal court decision issued before the amendments were placed on the ballot which declared several of the state legislative districts to be the result of an unconstitutional racial gerrymander. Former Oklahoma Governor Brad Henry and former U.S. Magistrate Judge Andy Lester, who co-chaired the bipartisan Oklahoma Death Penalty Review Commission, join DPIC executive director Robert Dunham in the August 2022 Discussions With DPIC podcast. Governor Henry, a Democrat, and Judge Lester, a Republican, discuss the findings of the commission's review that led them to call for a halt to the state's planned executions of 25 prisoners, at least until significant reforms have been adopted. “The most critical recommendation that we made,” Governor Henry said, “was that unless and until significant reforms occur in the entire death penalty process, we should not be executing people in Oklahoma. … [I]f we're going to have the death penalty in Oklahoma, my goodness, it ought to be done right.” Lester strongly agrees. “The system, if we don't take up the bulk of these recommendations, is broken,” he says. “And we need to fix the system before moving forward.”

This bill will add to the deficit and further hurt the struggling U.S energy industry. Biden will subsidize illegal immigration, the industry-crushing Green New Deal, and pitch this bill as a win for Democrats and a detriment for Republicans that voted against it. The CDC received a blistering report regarding its handling of COVID and it was determined that it fell short of expectations and will be shaking things up. Contrary to what it sounds like the CDC will likely shake things up to make things more political while instituting additional woke policies. Then, Mitch McConnell has to go as leader in the Senate. He literally attacks the quality of candidates that are not aligned with him, and his silence on the unconstitutional raid on Trump's home is concerning. Later, Sen. Marco Rubio joins the show to discuss his opponent Rep. Val Demmings and the danger of doubling the size of the IRS. Rubio noted that the new IRS is larger than the British Army and will also have deadly force to go after everyday Americans. On October 26, 2010, Adriana boarded a Boeing 757 in Miami. During the flight, a two-foot hole developed in the fuselage of the Boeing plane, causing a sudden decompression and a rapid descent from 32,000 feet to 10,000 feet. Adriana recalls the frightful incident, saying it felt like "a kick in the stomach" and that she feared was going to die. Years later, Adriana continued to suffer a range of medical issues from the traumatic experiences of that day aboard the Boeing plane. In spite of the defense's attempts to claim that Adriana's injuries were pre-existing conditions related to her past psychological history or to draw attention to Adriana's leave of absence from her doctoral program at the Massachusetts Institute of Technology, trial lawyer Christopher Stombaugh kept the jurors focused on Adriana's life-altering injuries. Christopher Stombaugh used a timeline of events, expert witnesses and a physical demonstration of the impact of altitude on the body via a shaken soda can to help the jury understand the nature of Adriana's injuries. On April 12, 2018, a Massachusetts District Court jury returned a $2.2 million verdict in favor of plaintiff Adriana Guzman with damages deducted and prejudgment interest added, resulting in a final verdict of $2,271,651. I'm your host, Wayne Stacy, the Executive Director of BCLT. And once again, we're here with Michael Smith. As you know, if it's happening in Texas, Michael is the person that can tell you about it. But a few little things about Michael because we haven't heard from him in a couple of weeks: Michael is now in addition to being an expert in Texas, has a master's in World War Two history. So he can tell you what happened to Texas and in World War Two. And that may be a different podcast, though. In addition to that, Michael and I got to spend some of the the week together, looking at UC Berkeley Stanford conference and looking at some of the top IP issues facing people around the country. Michael was a hit there. Everybody likes to know what's happening in Texas, because it seems to be the talk of the town. So with all of that we got a little catching up to do. Michael, you want to want to lead us through it? Michael Smith 01:04 Certainly, Wayne, it has been an interesting few weeks, both personally and professionally, there's been a lot going on in the courts. And and I would kind of want to start with everyone likes to talk about 101 patentable subject matter. And we were in the middle of a panel last week at the seminar that you and I were at the Berkeley Stanford event. And we got some statistics on 101. But at the same time, we found out there were three new 101 cases out of the eastern and western districts of Texas last week. So I wanted to start with one of those. And that was from the Eastern District of Texas. Back in October, a plaintiff of terminal reality, lost a jury trial in Marshall. They were actually working out in my offices, so I was kind of hearing about what was going on the case. But Sony got a jury verdict of no infringement, the claims were invalid. And the jury was also asked that 101 factual predicate question. And they found the well understood question and the defendant's favor and I think you and I have talked about what juries are doing on that question. Wayne Stacy 02:11 And from my look at the cases, it seems like it's a tremendous defense. So it seems like a pretty, pretty common result. Michael Smith 02:20 I think so and I remember when the panel was talking about it last week, I mentioned that I'm, we've seen that submitted several times in the Eastern District Courts, and I don't recall ever seeing a plaintiff win on that. Juries always seem to find the activity well understood. And I can kind of understand that, because after an expert has explained it, well, then they can understand it. So even though there's little hindsight involved. There may be a bias on the jury's part to find for the definitive on that question. But what happened here was, the plaintiff loses on infringement, they lose on invalidity, they lose on everything. And then the defendant comes in, and they want the finding that it's not patentable subject matter as well. And Judge Gilstrap's opinion said, Well, we submitted Alice Step Two to the jury, and the jury found that they were well understood, but my job is to look at Alice step one. And looking at Alice step one, I find that the asserted claims weren't directed to an abstract idea, and therefore they didn't claim patent and eligible subject matter. So the plaintiff lost everything in front of the jury, but they were able to salvage the patentable subject matter question before Judge

In this episode I speak with Judge Robert Bacharach who is a judge on the United States Court of Appeals for the Tenth Circuit in Oklahoma City, Oklahoma. Prior to becoming a federal appeals court judge in 2013, Judge Bacharach served as a Magistrate Judge for the Western District of Oklahoma for 14 years and before that as a litigator at the Oklahoma City law firm of Crowe & Dunlevy. He has also served as an adjunct professor at the University of Oklahoma College of Law. Judge Bacharach started his legal career as a law clerk on the 10th Circuit for Judge William Holloway Jr., whose seat he now holds. He is a graduate of the University of Oklahoma and the Washington University Law School. Judge Bacharach also recently published the book, Legal Writing: A Judge's Perspective on the Science and Rhetoric of the Written Word published by the ABA. In our conversation we discuss his path to the bench, his process for hearing cases and crafting judicial opinions, and his general approach to legal writing as embodied in his recent book which draws on his years of experience on the bench as well as the fields of rhetoric and psycholinguistics. Steve is running for Magistrate Judge has more than thirty years of experience as a law professor and public defender, Steve has devoted his entire career to representing the interests of the poor and powerless in the criminal legal system. His tireless dedication to the pursuit of justice has led to the release from jail of numerous wrongfully charged and convicted citizens.   In the aftermath of Hurricane Katrina, Steve utilized his independence as a Loyola law professor to lead a total restructuring of the Orleans Public Defender’s Office, from a patronage system run by the judicial bench, to an independent office of defense attorneys serving the public. As Trial Chief, Steve oversaw the transformation of the Public Defender’s Office from a handful of attorneys in a single room to a professional law office with 120 attorneys and support staff. Under Steve’s leadership, the Office became a national model for change, providing citizens of New Orleans who cannot afford an attorney with the kind of representation previously available only to the rich, privileged and powerful.    As a professor at Loyola Law School for over 10 years, Steve was in charge of a criminal defense clinic representing clients in Orleans Parish Criminal District Court who could not afford an attorney. At Loyola, Steve taught criminal law and procedure, and ethics, and has received numerous awards and recognition both locally and nationally for his commitment to his work.  Steve and his wife, Janet Hoeffel, a professor at Tulane Law School, have proudly called New Orleans home for more than 20 years. In this episode...Judge Lisa Margaret Smith, Magistrate Judge, Southern District of New York and Professor Michael Mushlin, Elisabeth Haub School of Law share their experience jointly teaching their 1L Civil Procedure class with a courtroom component. The program gives the students a flavor of the practical aspects of civil procedure and a context within which to grasp doctrinal concepts. Their approach supplements the traditional casebook materials and typical Socratic teaching method used in first-year law courses by challenging students to draft court documents, allowing them to visit a federal court and meet regularly with the judge. Their approach recognizes the disconnect between 1L doctrinal classroom teaching and the practice of law. This class provides students with context, which translates to a greater interest in and understanding of Civil Procedure Substantive law. The experience has been a huge hit among those who have had the good fortune of taking the class. You can read more about the class, including an analysis of the benefits and costs of the program in Judge Smith and Professor Mushlin's article, The Professor and the Judge: Introducing First-Year Law Students to the Law in Context, 63 J. Legal. Educ. 460 (2014). This episode is of value to law students, who will learn the importance of courtroom experience. Judge Smith also explains how law students can gain access to a courtroom even if students do not have the benefit of a formal program. The episode is equally important to law professors. Professor Mushlin's first-hand experience is enough to convince any law professor to incorporate some experiential work into every doctrinal class.Some key takeaways are...1. The Gwinnett Magistrate Court’s jurisdiction includes civil claims of $15,000 or less, county ordinance violations, applications for and issuance of arrest and search warrants, preliminary hearings, landlord versus tenant disputes, and distress warrants. No jury trials are held in this court. Appeals from decisions in landlord, tenant and civil cases are made to the Superior and State courts.

Prior to that, Judge Schwab was in private law practice with Rhoads & Sinon, LLP in Harrisburg and Semanoff, Orsmby, Greenberg and Torchia, LLC in Huntingdon Valley. Judge Schwab is from Wilkes-Barre, Pa. and graduated summa cum laude from Wilkes College. She was a member of the inaugural class of the Harrisburg campus of Widener University School of Law, where she served as an Internal Editor of the Widener Journal of Public Law.
