In the second of five special episodes to celebrate this podcast's 300th episode, focused on J.R.R. Tolkien's fantasy epic The Lord of the Rings, Ralph Bakshi's The Lord of the Rings was 18-years-old by the time Peter Jackson started considering making his own version in live action. Jackson and his partner Fran Walsh wanted to make something high fantasy, but kept coming back to Tolkien's stories.Acquiring the rights from Saul Zaentz took a while, and at the time Jackson was contracted to Miramax, so Harvey Weinstein took charge.With a planned two-film adaptation, filmed back-to-back, this The Lord of the Rings adaptation was worked on under Miramax. Then the budget started to balloon, but parent company Disney refused to help.Jackson was given an ultimatum by Weinstein - either reduce the number of films to one, continue with two on a heavily reduced budget, or abandon the project entirely and find another studio willing to take it on within four weeks.Jackson and his "fellowship" would choose their own quest to find a new studio, and they ended up at New Line Cinema, where something incredible happened... In the first of five special episodes to celebrate this podcast's 300th episode, focused on J.R.R. Tolkien's fantasy epic The Lord of the Rings, this episode summarises how Tolkien's life experiences, from childhood tragedies to the horrors of war, deeply influenced the themes of his stories. They reflected the complexity of human nature, shaped his creation of Elvish languages, and how Tolkien's love of linguistics led to Middle-Earth - the home of his beloved Hobbit Bilbo Baggins, but also the world he then extended from The Hobbit to create The Lord of the Rings. With several failed attempts struggling to adapt the "unfilmable" material, including one which would have starred The Beatles, animator Ralph Bakshi had first expressed an interest in making a version of The Lord of the Rings in 1957. It would take twenty years for him to get his opportunity, but even then the Dark Lord's forces were against him.Enter producer Saul Zaentz, who stumped up the cash to buy the rights to Tolkien's work, and allowed Bakshi control over his ambitious, passionate attempt to make an animated version of the books, in two parts.Bakshi would choose to shoot an entire live-action film first to use as a visual reference to rotoscope the animation, which was a controversial, expensive and time-consuming choice, but it would lead to a young Peter Jackson becoming inspired to read the novels and find out more...I would love to hear your thoughts on The history of The Lord of the Rings & The Lord of the Rings (1978) !Verbal Diorama is now an award-winning podcast! Bueno, pues habíamos dejado a nuestros amigos de la Creedence en mitad de la bronca, una bronca que les llevaría a su disolución. Repasamos el último día algunos de los motivos que les llevaron a este punto pero, la puntilla la dio John Fogerty tomando algunas decisiones, en su calidad de mánager empresarial de la banda, que dejó a todos sus miembros sin los royalties correspondientes a todas sus grabaciones y por las que tuvieron que entablar un montón de pleitos para poder recuperar sus ingresos. Y es que John había decidido, junto con sus abogados, traspasar el capital del grupo a un banco de Nassau. Años más tarde, en 1983, los juicios iniciados por los miembros del grupo fueron vistos para sentencia y una corte de California sentenció la devolución de 8,6 millones de dólares a sus legítimos dueños. A pesar de la sentencia, solo una ínfima parte de este dinero llegó a sus bolsillos. En este ambiente se publicó “Pendulum”, un nuevo trabajo de estudio que fue bien recibido por critica y público y premiado con unas buenas ventas. De este trabajo es “Have you ever seen the rain” A pesar del éxito del grupo, los problemas personales entre los hermanos Fogerty no hacían más que crecer. Tras la grabación de Pendulum, Tom, que ya había dejado el grupo en numerosas ocasiones aunque siempre había vuelto, lo hizo nuevamente pero esta vez de forma definitiva. Su marcha se hizo pública en febrero de 1971 y aunque en un principio se pensó en reemplazarlo, finalmente no lo hicieron. Tom Fogerty grabó en solitario “Good Bye President” que, más o menos, se escucho pero en ningún caso como a su anterior grupo. Este mismo año, 1971, John Fogerty comunicó al resto del grupo que la banda continuaría adelante adoptando una solución democrática, según la cual cada miembro del grupo escribiría y cantaría su propio material. El contribuiría con la guitarra rítmica en las canciones de sus compañeros, lo que daría lugar a un cambio considerable en el sonido de la Creedence. Este nuevo estilo de trabajo dio como resultado el sencillo Sweet Hitch-Hiker. El grupo se embarcó en una gira por Europa y Estados Unidos durante el verano y el otoño de este año 1971 pero, a pesar del considerable éxito de la banda, la relación personal entre los tres miembros de la banda no hacía más que deteriorarse. Sweet Hitch-Hiker El último álbum que grabaron fue Mardi Gras, se publicó en abril de 1972 y, por primera y última vez, se incluyeron en el trabajo canciones de Fogerty, Cook y Clifford. A diferencia de sus anteriores trabajos, Mardi Gras recibió críticas muy desfavorables y las ventas fueron en proporción, o sea, muy pobres. Tras la publicación de este álbum y su pésima acogida, no solo empeoraron sus relaciones personales sino que su compañía discográfica empezó a verles como un mal negocio y se negó a mejorar sus condiciones contractuales. A este respecto, Cook comentó posteriormente que, gracias a la torpeza de John en los negocios, Creedence tenía el peor contrato discográfico de todos los músicos estadounidenses de éxito. Nuevamente, y a pesar de todo, la Creedence se lanzó a la carretera en una nueva gira por Estados Unidos. Seis meses después, el 16 de octubre de 1972, el grupo anunció oficialmente su disolución y desbanda de Creedence Clearwater Revival. En Mardi Gras estaba incluida Hello Mary Lou, una versión del viejo éxito de Ricky Nelson de 1960. “Fortunate son” es, incluso hoy día, una de las canciones más representativas del movimiento antibélico que se desató a finales de los 60 en los EEUU por su intervención en la guerra de Vietnam. La canción, escrita por John Fogerty, está inspirada en la relación entre David Eisenhower, nieto del presidente Dwight Eisenhower y Julie Nixon, hija del presidente Richard Nixon. Pero para los que mirábamos más de cerca, sabíamos que estábamos metiéndonos en problemas.” La canción fue muy popular durante la Guerra de Vietnam y fue incluida en varias películas. Cuenta los pensamientos de un hombre que está siendo reclutado para la guerra de Vietnam y que no es hijo de un senador millonario o de un militar y, por tanto, no es un “hijo afortunado”, un Fortunate son. Otro tema de Fogerty, este incluido en el Cosmo’s Factory, también fue, en su momento, objeto de polémica. El título y la letra de la canción, así como el año en el que fue lanzada, 1970, llevó a muchos a pensar que la canción trata sobre la guerra de Vietnam. Sin embargo, en una entrevista de 2016, Fogerty explicó que la canción va, en realidad, sobre la proliferación de armas en los EEUU. “De lo que quería hablar era del control de armas y de la proliferación de armas… Recuerdo haber leído en esa época que había un arma por cada hombre, mujer y niño en EEUU, lo que me pareció asombroso. Así que en algún lugar de la canción, creo que dije “200 millones de armas están cargadas”. Simplemente pensé que era inquietante caminar por nuestro propio país, con la certeza de que hay tantas armas privadas propiedad de algunas personas responsables pero, tal vez, de muchas personas irresponsables.” Bueno pues, como vemos, poco ha cambiado el paisaje. Run Through the jungle. Una última canción relacionada con la guerra de Vietnam. Who’ll stop the rain, ¿quien detendrá la lluvia”, una cara B de Travellin’ Band que se ha hecho inmortal. Fogerty, que por azar se había librado de su viaje de ida al conflicto, veía angustiado esa procesión de ataúdes que regresaban del sudeste asiático. Estas imágenes inspiraron la canción. La gente se congregaba para mantener viva la llama, pero la lluvia seguía cayendo, cayendo encima de mí. Y yo me pregunto: «¿Quién puede detener esta lluvia?». Antes de despedirnos de la banda me gustaría recordar la estupenda versión que la Creedence hizo de un clásico: The mindnight special, una canción folclórica tradicional que se cree se originó entre los prisioneros en el sur de Estados Unidos. Se refiere al tren de pasajeros Midnight Special. La canción ha tenido innumerables versiones: Les Paul, Pete Seeger, Peter, Paul an Mary, Van Morrison, Eric Clalpton, en fin, un montón. Escuchamos pues la de Creedence Clearwater Revival. Bueno, pues, cuando CCR llegó a sus tormentoso final, cada uno de los miembros tiró por su lado. De todos, John Fogerty, fue el que tuvo más éxito en su carrera en solitario, cosa nada rara habida cuenta del talento compositor que tenía. Aunque, paradójicamente, su primer disco en solitario, The Blue Ridge Rangers, está dedicado completamente a versiones de canciones tradicionales y country y, para no discutir con nadie, él tocó todos los instrumentos. La situación de John no era, en absoluto, cómoda. Fruto de sus nefastas negociaciones con la discográfica, tras la disolución del grupo todavía debía ocho discos. Por otro lado, el hecho de no cantar ninguna de las canciones de su grupo anterior se debía a que debía pagar derechos de autor al, por entonces, propietario de los temas, Saul Zaentz. Al publicar Centerfield, nuevamente se vio inmerso en juicios con el dichoso Zaentz, su bestia negra. Éste le acusaba de que la canción The Old Man Down the road era una copia del tema de Creedence Run through the jungle. Desde que Fogerty se había desvinculado con Fantasy Records, las canciones de Creedence había pasado a formar parte del catálogo de Fantasy, propiedad de su “amigo” Zaentz, por lo que éste demandó a Fogerty por “autoplagio”. En este caso, el jurado sentenció a favor de Fogerty pero perdió en otro pleito que el terrible Zaentz le había iniciado por difamación en la canción Zanz kant danz en la que decía: “Zanz no puede bailar, pero sí te robará el dinero”. Fogerty tuvo que reeditar la grabación cambiando Zanz, con z por Vanz, con v. Y esta es la canción en discordia, Zanz kant danz. En 1987 John Fogerty rompió la censura a los temas de Creedence que él mismo se había impuesto por que decía que, “Si no lo saben, todo el mundo piensa que Proud Mary es una canción de Tina Turner”. En la actualidad, John Fogerty sigue interpretando temas de Creedence y de su carrera en solitario. Por su parte, Tom Fogerty también publico álbumes en solitario pero ninguno alcanzó el éxito de Creedence. El tercer álbum de Tom, grabado en 1974, Zephyr National, fue el último en incluir a los cuatro miembros del grupo aunque John grabó sus pistas en solitario. En septiembre de 1990, Tom Fogerty falleció de sida, enfermedad que había contraído en un transfusión sanguínea durante una intervención quirúrgica. Alguna de las canciones de Tom mantenían el sonido característico de Creedence, como podemos apreciar en este Joyful Resurrection. El resto, Clifford y Cook, continuaron trabajando juntos tras la disolución de Creedence, tanto como músicos de sesión como miembros de una nueva banda, la Don Harrison Band. Tras un largo periodo de inactividad, ambos formaron “Creedence Clearwater Revisited” en 1995 y junto a músicos de prestigio ofrecieron conciertos en los que interpretaban temas de la banda original. Medio en broma, medio en serio, John Fogerty decía en una entrevista: “Muchas personas nos vieron como la respuesta americana a The Beatles, podríamos dejarles a ellos el primer puesto como mejor grupo del mundo y colocar a Creedence en segundo lugar”. Jared, Oriana and Ned talk about Jared's choice of topic: the Valar. For a legendarium that is clearly monotheistic at base, down to the opening lines of The Silmarillion essentially being a variant of the Book of Genesis, Tolkien's creation – and account of creation – has a class of similarly immortal beings present from the beginning as well, and while you can call them a version of angels, in many ways they are absolutely not like such beings as theologically understood. Indeed, for all that they are termed as ‘the Powers' in Arda, much of what we know about them seems to derive from the limits of their power or their inability to comprehend deeper truths – a question that Tolkien himself felt needed explaining at a certain point. What does it say that Varda aka Elbereth is regarded by the Elves with more reverence and love than her partner Manwë? Why is it that beings with an essentially plastic form of existence, not bound by physical form, take on certain specific forms and identities even before the Children of Ilúvatar first awoke in Middle-earth? Is there something to be said for the fact that so much of what the Valar do over time turns more and more into outsourcing of a kind? What's with the moment of bemusing domestic snark between Aüle and Yavanna like it's a sitcom? And – separate from all this, but it took up half the episode – what do the three of us think about all the news and trailer and more about a certain Amazon series that finally dropped? Calling all unsung heroes. That's right, you over there who can read music and write compositions with something to say. Unsung heroes have been prevalent on the JFS, Guys who oozed the cosmic plasma of listening to each other. When everyone is listening then and only then can magic occur. My guest today is a listener, singer, song writer and individualist. He could have chosen the route of Studio City, playing sessions, getting union scale and an identity. He chose not to do this rather making a big imprint on the musical landscape during the days that mixed race bands had crossover appeal because they could play at some upholstered sewer in Cape Cod for a week two weeks- a month. His imprint is also attributable to the fact that people like Arif Mardin, Jerry Wexler, Norman Granz and Saul Zaentz were business men who understood the musicians craft. They saw the bigger picture, both sonically and sociologically. They wanted to make money but they understood the lineage that exists in music and when those links are missing. You see when links are missing it begins to dilute our cultural heritage, music serves to pacify instead of elevate consciousness. When the individual supersedes the music then no one is listening and no magic can occur. Trust me, Mingus, Roach and Dizzy are convulsing in their graves. My guest plays with his band in Marin County these days for fun. What a concept? How do you think real music is made? Recently he has been writing some songs with former bandmate and collaborator Mike Finnegan who continues to use my guests tunes on his own albums. Prior to full interconnection and the complete digitization of music mastering we had in this country pockets of eccentric engineers who more often then not wore more than one hat. Rudy Van Gelder held down the fort in Englewood Cliffs while performing optometry in the daytime. Michael Cuscuna found his way to Woodstock engineering Bonnie Raitt all the while hosting free form radio programs and writing linear notes. Same for Marty Feldman and Eddie Harris Major cities in this country had venerable studios that cooked with music from across all musical spectrums. Chess Records in Chicago, Stax Records in Memphis, Muscle Shoals in Alabama, Sigma Sound in Philly, MoTown in Detroit and The Record Plant in LA. Another major record creator was Fantasy records. My guest today was a major engineer during the gravy years of the studio after Max and Saul Weiss sold the shop to Saul Zaentz. But as with other engineers my guest wads jack of all trades. He was the rhythm and blues drummer for the label when they were still in Oakland playing with Ray Shanklin and Tower of Power singer Lenny Williams. When he became the lead engineer at Fantasy he sought out and trained younger cats on how to create a warm room sound, when Fatansy expanded he was responsible for outfitting the studios and then hunkering down with a Heavy Axe and David Axelrod, Butterfly Dreaming with Flora Purim, Tambu with Cal Tjader and Charlie Byrd and the NTU Troop with Gary Bartz. He was immersed with all types of musicians. Cats like Sonny Rollins who might come out to cut an album before heading to Japan to Country Joe and other Bay Area mainstays who helped liven up sessions just by being within the complex. Put in a live audience for Joe Williams or Cannonball or work with Ed Bogas on arrangements for the Vibes of Truth. This was coupled with a very open radio dial which played a lot of local area favorites like the aforementioned Tjader, Jerry Garcia and Merl Saunders and Bola Sete. It should be noted that without Born on the Biyou none of this might have ever happened. You listen to the warmth that these records give off. The homey close knit quality and the musicians understanding of how special a place it was and you begin to see how regional music developed. Orrin Keepnews relocation to Berkeley and the acquisition of the Prestige catalog only furthered the eclecticism of the musicians. All of a sudden McCoy Tyner found a home there so did Larry and Fonce Mizell as well as Wayne Henderson and Woody Herman. It was a family of Zen Tricksters who cared about the music and the musicians. Things were cut using analog tape so there was no way to put lipstick on a pig if Pleasure or The Vibes of Truth flubbed some lyrics. You couldn't fix crappy instrumental takes. The artists had to know their shit and so did the producers and the arrangers and the engineers. Annette Haywood-Carter began her directing career with The Foot Shooting Party, a 30 minute short film starring a young Leonardo DiCaprio as well as Foxfire with a then undiscovered Angelina Jolie. Prior to her directorial debut, Annette spent a decade working as a script supervisor winning the respect of Academy Award-winning producers, directors and actors. Steven Spielberg, Bruce Cohen, Bruce Beresford, Saul Zaentz and John Lithgow, among others, took a personal interest in her career and helped her transition into directing. In addition to directing, Annette worked as a writer-for-hire. Her credits include aTV miniseries for CBS, a book adaptation for Disney, original scripts based on studio concepts and script doctoring -- rewriting screenplays green- lit for production. Annette took a break from Hollywood to teach while her children were young. A key creator of the renowned Film & Television program at the Savannah College of Art and Design (SCAD), she developed curriculum, taught Directing, Screenwriting and Production, and served as Thesis Chair on MFA films. Annette is a member of the Directors Guild of America, Writers Guild of America, Women in Film and Film Fatales, and a former member of IATSE. These questions also inspire Sue Phillips, a Unitarian Universalist minister. She first watched the movie in the late ’80s, just as she was coming out and understanding her place in the world.Sue Phillips is the co-founder of Sacred Design Lab. She was also the first Director of Strategy as part of the Impact Lab here at the On Being Project. An ordained Unitarian Universalist minister, Sue is the co-author, with colleagues Angie Thurston and Casper ter Kuile, of “Design for the Human Soul.”

Art Museum in New York Sues Café for Allegedly Copying Its Name

The Museum of Modern Art (MoMA), a well-known art museum in New York, sued the newly opened café MoMaCha for allegedly copying its trademarked name and logo. Earlier this year, MoMA officials sent the café a letter, asking it to refrain from using the name MoMaCha and to change the café's logo, which resembled that of the museum. Because the café refused to give up its name, the museum filed a lawsuit under the claims that the café is riding on MoMA's popularity. The museum's lawyers asserted that the café is trying to woo customers by giving them the impression that the popular museum and the café are associated with each other. In MoMaCha's defense, owner Eric Cahan clarified that he only combined the words ‘more' and ‘matcha' because Japanese green teas are the café's specialty. He further pointed out that the font style is the only similarity between the museum's and his café's logos. Despite his stance, Cahan complied with some of the museum's demands, such as revising the logo design and converting the letters in the café's name into uppercase. He also released a statement that denied affiliations between the café and the museum. On a similar note, the Hungry Hobbit café in Birmingham, United Kingdom, was also sued for the same reasons. Saul Zaentz Company (SZC) owns the rights to the films The Hobbit and The Lord of The Rings. After learning about the café, the company filed a lawsuit. According to SZC, the name might suggest that the café is being promoted by the production company. In a later interview, CEO Saul Zaentz said that he is willing to settle the issue with the café.

Saul Zaentz was a Hollywood producer who won three Academy Awards for Best Picture: "The English Patient," "Amadeus," and "One Flew Over The Cuckoo’s Nest." He died in 2014, leaving behind a foundation that, among other things, established a new film incubator at Johns Hopkins University. Launched in March with a $1 million grant, the Saul Zaentz Innovation Fund in Film and Media supports prospective filmmakers and audio/visual artists who submit ideas for projects and get some mentoring before going into production. SOME ADULT LANGUAGE      Violent events of the last decade, and even longer, have made us skeptical on the direction of mental illness reform. What can be perceived as a threat from beyond actually lurks within the walls of what is known to us. A closer examination reveals a kaleidoscope of things we do not yet understand. If a wide net is cast, then what is to be done with those that don’t really fit into the bucket they are thrown in? Did we misunderstand, mislabel, misguide, mislead or do we just want to forget and ignore the hard truth? Are they walls we actually erected within ourselves? There is no one answer solution.      Our first Academy Award for best picture comes with this examination. Kirk Douglas purchased the script that became a Broadway play, and later, his son Michael, partnered with Saul Zaentz, to produce this 1975 best picture. Milos Foreman was the perfect director given his experience originating from a stifling Czech Republic communistic regime. Louise Fletcher and Jack Nicholson won Academy Awards as they portrayed a truly frightening, and very tangible story about the struggle for control; and the consequences for losing it.      Mark Rhodes and I actually, not kidding, met at his side job. We hit it off right away and realized we knew the same musicians and possibly had been around each other before. Our love of music and movies drove the conversation and his film selection was right in my wheelhouse.  This interview was a dance of like minds hoping to point out the potential issues of mental health reform and the idea of control. Institutional control, and for that matter, control in general, should be examined, checked, and challenged. We even discuss our pets of the past, lest we forget. This collaboration is offered as the movie that moved Mark Rhodes. In loving memory of Lando, Ringo, and most recently Ginger. TC

In 2015, Roberto designed and launched a new graduate program in film production at Johns Hopkins. The Film & Media Master of Arts Program focuses on the areas of business, writing, sound design and production and emphasizes experiential learning. In 2016, he also designed and launched the Saul Zaentz Innovation Fund in Film & Media at Johns Hopkins University. The Saul Zaentz Innovation Fund identifies innovative visual media artists in Baltimore and connects them with prestigious artists, veteran executives and successful entrepreneurs to produce powerful projects and bring meaningful stories to life. Currently, Roberto serves as the Director of the Film and Media Masters program and the Director of the Saul Zaentz Innovation Fund in Film & Media at Johns Hopkins. He teaches at the undergraduate and graduate level and is working on his second television pilot.
