Shoot us a Text.On this Thursday, we're covering how EV/hydrogen truck maker Nikola is filing for bankruptcy, how West Herr Auto Group gifted Slick Rick from the Buffalo Bills mailroom a car, and how kids meals are becoming something everyone orders.Electric truck startup Nikola, once a Wall Street darling valued higher than Ford, has filed for bankruptcy, joining other EV-makers like Fisker, Lordstown Motors and Electric Last Mile Solutions.Founded in 2015, Nikola promised a hydrogen-fueled revolution for trucking, securing billions in investments from GM, Bosch, and others. In 2020, short-seller Hindenburg Research accused Nikola of faking its truck technology, revealing a promotional video showing a truck rolling downhill with no powertrain.Founder Trevor Milton resigned amid fraud allegations and was later convicted in 2022, receiving a four-year prison sentence.Despite shifting focus to hydrogen fuel cell trucks, Nikola produced only 235 vehicles, amidst supply chain issues, rising costs, and an underdeveloped hydrogen fueling network.CEO Steve Girsky blamed economic conditions, stating, “Our very best efforts have not been enough to overcome these significant challenges.”When quarterback Josh Allen gave his MVP acceptance speech last week, he made sure to shout out someone who rarely gets the spotlight—Roderick “Slick Rick” Morrow, a beloved mailroom employee at One Bills Drive. After Allen's speech, Buffalo fans quickly fell in love with Slick Rick. One detail caught everyone's attention: despite working for the Bills for over a decade, Rick had been taking the bus to work every day.West Herr Automotive Group knew they couldn't just stand by on the sidelines, and on Valentine's Day, they surprised Slick Rick with a Chevy Traverse—his very own set of wheels after years of relying on public transportation.“It feels like I'm living the dream, and I am!” Rick said, soaking in all the love from the Buffalo community. As fast-food prices continue to skyrocket, some savvy consumers have found a way to save money—by ordering kids' meals. The trend has surged in popularity, with many adults opting for smaller portions at lower prices, sometimes even enjoying the bonus of a toy.Data from Circana shows a 28% increase in adults ordering kids' meals in 2024 compared to 2019.Fast-food prices have surged by 39%-100% over the past decade, outpacing inflation (31%), with McDonald's, Popeyes, and Taco Bell leading the way.Social media influencers, such as TikTok's “kids' meal connoisseur” Ashley Garrett, have fueled the trend by reviewing and rating kids' meals.Restaurant investor Dan Rowe suggests the issue isn't adults ordering kids' meals but rather, “If people are ordering off of your kids' menu, you have other issues.”The rise of GLP-1 weight-loss drugs like Ozempic and Wegovy, which reduce appetite, could also be contributing to the demand for smaller portion sizes.Hosts: Paul J Daly and Kyle MountsierGet the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/ Read our most recent email at: https://www.asotu.com/media/push-back-email
This Day in Legal History: Executive Order 9066On February 19, 1942, President Franklin D. Roosevelt signed Executive Order 9066, authorizing the forced relocation and internment of Japanese Americans during World War II. Issued in the wake of Japan's attack on Pearl Harbor, the order empowered the military to designate "exclusion zones" from which individuals could be removed. Although the order did not explicitly mention Japanese Americans, it led to the incarceration of over 120,000 people of Japanese descent, two-thirds of whom were U.S. citizens. Families were uprooted from their homes and businesses, sent to remote camps under harsh conditions, and held without due process. The Supreme Court upheld the internment in Korematsu v. United States (1944), ruling that national security concerns justified the action. Decades later, the decision was widely condemned, and in 1988, President Ronald Reagan signed the Civil Liberties Act, formally apologizing and granting reparations to surviving internees. The internment remains a stark example of how fear and prejudice can lead to grave violations of constitutional rights. The Department of Government Efficiency (DGE), spearheaded by Elon Musk, claims to have saved $55 billion in federal spending, but publicly available data only supports about $8.6 billion in verified savings. A major accounting error inflated a single contract cancellation from $8 million to $8 billion, significantly distorting the numbers. Despite promising "maximum transparency," DGE operates outside traditional oversight, raising concerns about its accountability. Musk, whose companies receive billions in federal contracts, is supposedly self-policing conflicts of interest. Meanwhile, a federal judge has allowed DGE to continue slashing jobs and contracts, handing Trump a legal win. The administration touts these efforts as transformative, with Trump and Musk claiming they'll eventually cut $1 trillion in waste. However, with major entitlement programs off-limits and nearly half of discretionary spending tied to defense, the math is fuzzy at best. Who knew the efficiency agency run by the guy who wildly guessed about Twitter bots might struggle with basic accounting?DOGE Says It's Saved $55 Billion, Itemized Data Show Far LessBradley Weinsheimer, the Justice Department's top ethics official, resigned after being reassigned by Trump administration officials to a new working group on sanctuary cities. A 34-year DOJ veteran, Weinsheimer opted for deferred resignation rather than accept the move, joining a wave of career officials who have left amid concerns over the politicization of the department. His ethics duties were transferred to two political appointees—one of whom helped defend Trump in his New York hush-money case, and the other a 2021 law school graduate. Critics, including former U.S. Attorney Joyce Vance, argue this shift undermines the DOJ's independence. The Trump administration has aggressively reshaped the department, firing or reassigning officials and dropping criminal cases against Trump under the rationale that sitting presidents shouldn't be prosecuted. The Justice Department, now led by Attorney General Pam Bondi—another former Trump defense lawyer—has also launched a “weaponization working group” to scrutinize past investigations into Trump. The White House, for its part, insists the DOJ was previously weaponized against Trump and is now being restored.Senior Justice Department ethics official resigns over sidelining by Trump appointees, source says | ReutersA federal judge is set to hear arguments on whether to dismiss corruption charges against New York Mayor Eric Adams, following a controversial request from Trump administration prosecutors. The Justice Department, under orders from Acting Deputy Attorney General Emil Bove—a former Trump defense lawyer—asked to drop the case, claiming Adams is needed to help enforce the president's immigration policies. The move has sparked outrage, with several prosecutors, including the lead attorney, resigning in protest. Critics argue the dismissal is politically motivated, especially after reports that Adams' team suggested the mayor would support Trump's policies if the charges disappeared. The DOJ insists the decision isn't about the case's merits, but Adams' political future. The charges, filed under Biden's administration, accused Adams of accepting bribes from Turkish nationals, which he denies. The dismissal would be *without prejudice*, meaning the case could be reopened after the November mayoral election—something critics see as a pressure tactic. With Adams' political future in question and New York Democrats calling for his resignation, the legal and political stakes are high.Judge to weigh Trump administration bid to drop NY mayor Eric Adams' case | ReutersElectric-truck maker Nikola has filed for Chapter 11 bankruptcy, citing cash shortages and difficulties securing funding. The company, which once promised to revolutionize the EV industry, struggled with leadership instability, weak sales, and a plummeting stock price. Like other pandemic-era EV startups such as Fisker and Lordstown Motors, Nikola found itself unable to sustain its capital-intensive operations as high interest rates and low demand dried up investor support. The company plans to sell off most or all of its assets while maintaining limited truck and hydrogen-fueling operations through March. Nikola, which went public in 2020 via a SPAC deal, has cycled through four CEOs in four years, with industry veteran Stephen Girsky currently at the helm. Despite ramping up production of hydrogen-powered trucks in 2024, the company bled money, losing hundreds of thousands of dollars per vehicle. Fleet operators' reluctance to invest in EV infrastructure further compounded its struggles. The bankruptcy marks the end of a turbulent journey for a firm that once positioned itself as Tesla's trucking rival.Struggling e-truck maker Nikola files for Chapter 11 bankruptcy protection | Reuters This is a public episode. Shoot us a Text.Today, we break down the Hindenburg Research report that allegedly exposes Carvana's shady business practices. Plus, we cover Tesla's first annual drop in deliveries and talk about the return of cursive logos.Show Notes with links:Hindenburg Research, known for exposing automotive startups like Nikola and Lordstown Motors, has published a scathing report on used-car retailer Carvana, alleging questionable accounting practices and underwriting concerns.Carvana allegedly sold $800M in loans to a "suspected related party" and used "accounting manipulation" to inflate profits. Carvana allegedly sold vehicles to DriveTime, a company owned by Ernie Garcia II (father of Carvana's CEO), at inflated prices to avoid recording markdowns, thereby boosting its reported revenue.A former director reportedly claimed Carvana approved 100% of loan applicants, suggesting riskier lending practices to generate higher loan volumes, and by extending loan terms through a DriveTime affiliate, Carvana may have avoided reporting higher delinquency rates, potentially hiding the true state of its loan portfolio.Carvana shares dropped 1.9% following the report, closing at $199.56.The company called the report "intentionally misleading and inaccurate," asserting a focus on long-term growth.Tesla's Q4 production and delivery numbers are in, marking a challenging end to 2024 for the EV giant, with its first annual drop in deliveries amidst intensifying competition and political distractions for CEO Elon Musk.Tesla delivered 1.78M vehicles in 2024, falling short of the 1.81M it delivered in 2023.Q4 2024 deliveries hit 495,570, falling short of analysts' expectations of over 500,000.Tesla shares dropped 7% following the report, despite a 63% rally in 2024, showing mixed investor sentiment.Tesla faced declining sales in Europe and slower growth in China while rivals like BYD and Hyundai gained market share.High-priced Cybertrucks are "piling up on used car lots," reflecting a lack of affordable EV options in 2024.“Tesla still does many things better than any other EV maker, but the challenge remains the nuts-and-bolts job of being a car company,” said Patrick George, editor in chief of InsideEVs.Lord & Taylor is turning back the clock, reviving its cursive logo as it prepares to relaunch as an online discount luxury retailer under new ownership, Regal Brands Global. The classic script logo, first introduced in 1945, replaces the modern sans-serif wordmark, which the new leadership called "the biggest betrayal of the brand."Founded in 1826, Lord & Taylor is embracing its legacy, branding itself as “the signature of American style” for its digital comeback. Many brands have moved away from cursive logos due to younger consumers' unfamiliarity with the style, but Lord & Taylor sees its heritage as a unique strength.“I understand going after young customers, but this is not a startup,” said Regal Brands Global chief strategy officer SinaHosts: Paul J Daly and Kyle MountsierGet the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/ Read our most recent email at: https://www.asotu.com/media/push-back-email
The EV revolution presents a transformative opportunity for the automotive industry, enticing entrepreneurs with its potential impact. However, it's a challenging venture, far removed from the simplicity of starting an app or social media company. Building factories, designing vehicles, and getting around government hurdles require billions of dollars and strategic planning. Some turn to Special Purpose Acquisition Companies (SPACs) or crowd funding to raise funds, but underestimating capital costs is a common pitfall. Success stories like Tesla and BYD emulate strategies of industry giants like Ford and General Motors, but failures such as Fisker, Lordstown Motors, IndieEV, and WM highlight the difficulty of balancing innovation with industry traditions in this fiercely competitive market.Link to the featured video:https://youtu.be/G4d5yV2BXdI?si=YnafyXylgcZuyuh9Grab a copy of my book:https://partsmanagerpro.gumroad.com/l/qtqax"The Parts Manager Guide" - https://www.amazon.com/Parts-Manager-Guide-Strategies-Maximize-ebook/dp/B09S23HQ1P/ref=sr_1_4?crid=3UZYOGZJUNJ9K&keywords=parts+manager+guide&qid=1644443157&sprefix=parts+manager+guid%2Caps%2C244&sr=8-4Please remember to like, share and leave your comments.Videos are uploaded weekly.Visit my website for more!https://www.partsmanagerprof.com/If you want me to continue making videos like these, please donate to our paypal account: paypal.me/partsmanagerproFair use is a use permitted by copyright statute that might otherwise be infringing. We are coming to you from sunny Palm Beach Florida at The Pasch Group's Modern Retailing Conference. The day brings news of the UAW votes not going perfectly so far, Foxconn asserting EVs that could be easier to make if they are made like phones, and airlines getting some brutal feedback on the frontlines.Show Notes with links:In a potential turn of events, Ford's Kentucky production workers voted against a proposed UAW contract while skilled trade workers voted for it, highlighting divisions within the workforce.55% of Ford's Kentucky production workers voted against the tentative UAW contract, while 69% of skilled trades workers approved it, as reported by UAW Local 862.The vote casts doubt on the contract's ratification, previously expected to increase Ford's operational costs significantly as the union has not released the final, combined percentage of the voteSo far, 71% of workers across Ford's facilities have voted for the UAW deal, but votes at key plants like Michigan's Dearborn Truck plant are pending.Foxconn, known for iPhone manufacturing, is aiming to reshape EV manufacturing. Led by Jack Cheng, a Foxconn affiliate is working to implement an outsourcing model similar to that used for products like iPhones, potentially lowering EV production costs and impacting the global EV market.Cheng's strategy involves outsourcing EV production to reduce costs, contrasting with traditional automakers' preference for in-house design and assembly.Foxconn's expansion in the EV sector includes collaborations with Tesla and significant investments in Asia and the U.S.They already have facilities across Asia, India, and started to produce vehicles for Lordstown Motors in an Ohio plant before the company went bankrupt.Cheng points out the disparity between the price of an EV in China and the US and proposes he can help bridge the gap“The world is wasting too much time tooling the same parts and losing money. It doesn't make sense. What I learned in China in the last 20 years—I can replicate that.”It seems flying isn't getting more delightful. Complaints against airlines in the U.S. have surged to 24,965 in the first three months of 2023, with a notable increase in issues related to accessibility. In the first quarter of 2023, airline complaints in the U.S. rose by 88% compared to the same period in 2022.Complaints continued to increase in April and May, with a 32% and 49% rise, respectively.Disability-related complaints, such as problems with wheelchairs, nearly doubled to 636.The Department of Transportation is investigating several airlines for announcing unfeasible flight schedules and may impose fines.Hosts: Paul J Daly and Kyle MountsierGet the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/ Read our most recent email at: https://www.asotu.com/media/push-back-email ASOTU Instagram: https://www.instagram.com/automotivestateoftheunion
Lordstown Motors is back in the headlines as some familiar faces have reentered the picture three months after the company filed for Chapter 11 bankruptcy protection.According to an SEC filing, when Lordstown began voluntary proceedings under Chapter 11 in June, the company's “selling entities” approved an auction to sell the company's assets. The bankruptcy court approved the bidding procedures, and the selling entities received a qualifying bid from a limited liability company called LAS Capital. LAS Capital has no affiliation with Lordstown Motors. It was, however, founded by Lordstown's founder and former CEO Steve Burns. Former Lordstown CFO Julio Rodriguez is also reportedly involved as the sellers are also considering him an indirect manager of LAS Capital.
The Ohio based EV company recently revealed that a partnership with Foxconn that intended to save it would actually result in bankruptcy. But it's how quickly that bankruptcy is permitted to take place that's now the issue at hand. After a fumbling Lordstown took a lifeline from Taiwan-based electronics company Foxconn, it was with the plan that two partners would advance the development and production of the Lordstown Endurance pickup truck. Instead, a disagreement between the two sides over funding led to a public spat, some lawsuits and, ultimately, Lordstown's filing for Chapter 11.

Show Notes with links:Ohio based Electric truck manufacturer Lordstown Motors has filed for Chapter 11 bankruptcy protection and is now taking legal action against Taiwanese manufacturer Foxconn, accusing them of fraudulent conduct and a series of broken promises, including not abiding by an agreement to invest up to $170 million.Foxconn, best known for assembling Apple's iPhones, had previously invested about $52.7 million in Lordstown and holds nearly 8.4% stake. They stated that Lordstown breached the investment agreement when the automaker's stock fell below $1 per share. The company's flagship product, a pickup called the “Endurance” was plagued with fires during testing and CEO Stephen Burns resigned in 2021 after acknowledging overstatements of pre-orders for its electric trucks. The dispute could bring more scrutiny to Foxconn's electric vehicle ambitions and partnerships. Should Lordstown fail to find a rescuer, the once celebrated, Lordstown, Ohio factory now owned by Foxconn could attract overseas automakers wanting to build vehicles in the U.S.The Chevy Silverado EV is about to begin commercial production, promising a 450-mile range backed by a whopping 200+kWh battery. However, due to recent supply chain and economic pressures, Chevy is set to increase the initial $39,900 price point of the base model upon its 2024 launch.GM has closed orders for the truck as it begins to fulfill some of the 185k existing commercial orders. Production has started at GM's Factory Zero assembly plant in Detroit, with customer deliveries expected to begin soon. The vehicle weighs 8500 lbs and requires 61 PSI in its tires. Its 200kw battery is 50% larger than the F150 Lightning long range battery and twice as large as the standard range. A Chevy Bolt has a 65kw battery. Carplay still works with a popup warning that it will be discontinued with future updatesIn the ongoing positioning of EV manufacturing, Ford Motor Co. is preparing to lay off hundreds of salaried engineers across all three of its divisions; EVs, ICE, and commercial vehicles to boost profitability and cut costs amid its $50 billion transition to electric vehicles. Earlier this year, CEO Jim Farley said the company needed as many as 25% more engineersT.R. Reid, a spokesperson for Ford, stated, “We're not cost competitive. We have specific priorities and ambitions that have implications for skills, assignments and staffing needs. These changes are consistent with that. They'll make us cost effective.”Get the Daily Push Back email at https://www.asotu.com/ JOIN the conversation on LinkedIn at: https://www.linkedin.com/company/asotu/ Read our most recent email at: https://www.asotu.com/media/push-back-email ASOTU Instagram: https://www.instagram.com/automotivestateoftheunion

In November, 2022 Lordstown Motors began delivering Endurance full-size electric trucks to fleet customers in America. Lordstown, named after the city in northeast, Ohio, represents an important new chapter in America's automotive manufacturing history. Lordstown is the designer and engineer of the electric vehicle. Samsung supplies the battery. And Foxconn, the powerhouse Taiwanese maker of our iPhones and iPads, is the manufacturer of the final product. This marks an important step in Foxconn's ambitions to weave itself into the fabric of American industry. The relationship also allows Lordstown to work with Foxconn MIH to develop other future vehicles from a single platform. What this means for Joe or Jane pickup truck customer: Potentially many more affordable choices for American consumers beyond the offerings from legacy players in Detroit, Wolfsburg, Seoul and Tokyo. #DrivingWithDunne / #ZozoGo https://twitter.com/Dunne_ZoZoGohttps://www.instagram.com/zo.zo.go/?hl=enhttps://www.linkedin.com/in/michael-dunne-a696901a/
