Aviation News NTSB Releases Final Report Of United Airlines Boeing 737 Tail Strike In Houston The NTSB report of the January 2024 tail strike says the 737-900ER touched down three times while landing. The aircraft's aft fuselage "impacted the runway as a result of a delayed flare and subsequent nose-high pitch inputs." The initial touchdown force was 1.87G and the second touchdown was 2.87G. An article in SKYbrary states that “various studies by several of the major aircraft manufacturers have arrived at similar conclusions regarding the primary cause of tail strike. The most significant common factor is the amount of flight crew experience with the specific model of aircraft being flown.” Studies identified eight specific Causal Factors that greatly increase the risk of a tail strike: During take-off: Improperly Set Elevator Trim or Mis-Trimmed Stabiliser  Rotation at Incorrect Speed Excessive Rotation Rate Improper Use of the Flight Director During landing: Unstabilized Approach Excessive Hold-Off in the Flare  Crosswinds Over-Rotation During Go-Around Over 65% of tail strikes occur during landings, while only 25% happen during takeoffs. With One Simple Change, Southwest Airlines Will Deal Blow To Wheelchair Scammers, Unruly Passengers And Seat Savers Southwest Airlines is considering implementing assigned seating, eliminating the need for passengers to board early to get a good seat. On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Daniel Lazare, a journalist and author of three books--“The Frozen Republic,” “The Velvet Coup,” and “America's Undeclared War.”Michael Horowitz, the Justice Department’s Inspector General, testified about FBI malfeasance yesterday before the Senate Judiciary Committee. Horowitz described the F.B.I. as a dysfunctional agency that severely mishandled its surveillance powers in the Russia investigation, but he told senators that he had no evidence that the mistakes were intentional or undertaken out of political bias. Instead, he attributed the FBI’s behavior to “gross incompetence and negligence.” Britons went to the polls today to elect a new government. Prime Minister Boris Johnson is confident of victory and, although polls showed the race tightening in its final days, expects to have a working majority that he will need to lead the UK out of the European Union. But Jeremy Corbyn has mobilized an army of enthusiastic volunteers based on his program “For the many, not the few” to close the gap. Steve Hedley, the senior assistant general secretary of the UK’s Rail, Maritime, and Transport Workers Union, joins the show. Federal Aviation Administration investigators decided last year to allow Boeing Company’s 737-Max8 jets to continue flying despite the fact that their own analysis indicated that the jet was prone to crashes and would be one of the most crash-prone jets in the world without design changes. The FAA analysis found that, without design changes, the 737-Max8 would have averaged one crash every two or three years, a substantially worse crash rate than either Boeing or the FAA had previously acknowledged. Brian and John speak with Dennis Tajer, a spokesperson for the Allied Pilots Association and an American Airlines pilot trained on Boeing 737 planes. The House of Representatives, led by the Democratic leadership, voted in favor of a new National Defense Authorization Amendment which funds a new arms race in space, reauthorizes NSA to spy on American citizens, and designates Russia as a state sponsor of terrorism. Previous NDAAs have authorized warrantless wiretapping of American citizens and even the murder of US citizens around the world without criminal charge and even with the use of drones. Why are so few members of Congress willing to stand up? Medea Benjamin, a well-known peace activist and the cofounder of the peace group Code Pink, joins the show. Several weeks ago, journalist Max Blumenthal was arrested and charged with assault after Washington DC police showed up at his house in an early morning raid. Max hadn’t assaulted anybody, but that didn’t stop Washington authorities from keeping him in jail for nearly two days. Well, the charges have now been dropped and the hosts talk to Max about his ordeal and next steps. Max Blumenthal, a bestselling author and journalist, whose latest film is “Killing Gaza,” the senior editor of The Grayzone, and co-host of the podcast “Moderate Rebels,” joins Brian and John. Thursday’s weekly series “Criminal Injustice” is about the most egregious conduct of our courts and prosecutors and how justice is denied to so many people in this country. Paul Wright, the founder and executive director of the Human Rights Defense Center and editor of Prison Legal News (PLN), and Kevin Gosztola, a writer for Shadowproof.com and co-host of the podcast Unauthorized Disclosure, join the show.A regular Thursday segment deals with the ongoing militarization of space. As the US continues to withdraw from international arms treaties, will the weaponization and militarization of space bring the world closer to catastrophe? Brian and John speak with Prof. Karl Grossman, a full professor of journalism at the State University of New York, College at Old Westbury and the host of a nationally aired television program focused on environmental, energy, and space issues, and with Bruce Gagnon, coordinator of the Global Network Against Weapons & Nuclear Power in Space and a contributor to Foreign Policy In Focus.

Episode 9The Indonesian National Transportation Safety Committee (NTSC) has released its final report regarding the crash of Lion Air Flight 610 and John and Greg are far from satisfied. One thing is clear to these aviation experts: the focus was on returning the plane over and over again to revenue service, rather than fixing known issues.  In this episode, John and Greg focus on critical maintenance issues, some of which are presented as little more than footnotes in the NTSC final report. They find that the report presents selectively filtered information and lacks analysis, falling far short of providing much-needed answers. They apply their expertise to analyze critical failures. Lion Air Flight 610 was a scheduled domestic flight operated by the Indonesian airline Lion Air from Soekarno–Hatta International Airport in Jakarta to Depati Amir Airport in Pangkal Pinang. On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Daniel Lazare, a journalist and author of three books-- “The Frozen Republic,” “The Velvet Coup,” and “America's Undeclared War.”The House Intelligence Committee’s impeachment inquiry seems to be expanding by the day. Secretary of State Mike Pompeo is being accused of obstructing justice by insisting that State Department employees not cooperate with the investigation; the State Department Inspector General requested an emergency meeting this morning with Intelligence Committee staff members; and both Pompeo and Attorney General Barr and have either been in Italy or have spoken with Italian authorities, reportedly about Joseph Mifsud, a shadowy Maltese academic who is somehow involved. British Prime Minister Boris Johnson is set to present what he says is his final Brexit proposal to the European Union today. The plan was supposed to include customs checks on the Irish border beginning in January 2021. Irish officials dismissed Johnson’s plan as “completely unacceptable,” and then in his speech at the annual Conservative Party conference, he said there would be no customs checks. British business leaders, meanwhile, reiterated their position that a no-deal Brexit would crash the UK’s economy. Alexander Mercouris, the editor-in-chief of The Duran, joins the show. The New York Times is reporting that a senior Boeing engineer filed an internal ethics complaint earlier this year, saying that during the internal development of the 737 Max8 jet, the company had rejected a safety system in order to minimize costs. The engineer believes that the system could have reduced risks that contributed to two crashes that resulted in 346 deaths. Brian and John speak with Dr. Alan Diehl, an award-winning aviation psychologist and safety consultant, a major air safety whistleblower, and the author of the book “Air Safety Investigators.” The United Nations reported yesterday that more than 1,000 migrants and refugees have died in the Mediterranean Sea this year, the sixth consecutive year that what it calls “this bleak milestone” has been reached. The UN refugee agency UNHCR called on European Union member states to reactivate search and rescue operations and to acknowledge the crucial role of aid groups’ vessels in saving lives at sea. What role have U.S. and European intervention played in causing the refugee crisis in the first place? Francis Boyle, a professor of international law at the University of Illinois College of Law and author of the book “Destroying World Order: US Imperialism in the Middle East Before and After September 11,” joins the show. Under a new agreement between the Kiev government and separatist leaders, local elections will be held in separatist-controlled areas in the country’s east and troops from both sides will withdraw from the area. Experts believe the move could pave the way for peace talks between the government and ethnic Russian separatists. Mark Sleboda, an international affairs and security analyst, joins Brian and John. Wednesday’s weekly series, In the News, is where the hosts look at the most important ongoing developments of the week and put them into perspective. On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Juan José Gutiérrez, the executive director of the Full Rights for Immigrants Coalition.Uniformed soldiers are now monitoring migrants in a detention camp in Texas in what may be a violation of the Posse Comitatus Act of 1878, one of the cornerstones of American civil liberties. Active duty troops are only allowed to help domestic law enforcement under limited exceptions to the law, including when they are specifically authorized by an act of Congress or under conditions laid out in the Constitution. Director of National Intelligence Dan Coats submitted his resignation yesterday and President Trump tweeted that he would replace Coats with two-term Representative John Ratcliffe of Texas. Ratcliffe is a former US Attorney and has almost no intelligence experience. But what does the position even entail? And how was the relatively new office of the DNI created in the first place? A new report from the New York Times reveals the extent to which Boeing was allowed by the FAA to effectively self-regulate when it came to their MCAS software system, the failure of which caused the crashes of two Boeing 737 Max8 jets, killing 346 people. Brian and John speak with Dr. Alan Diehl, an award-winning aviation psychologist and safety consultant, a major 1990s air safety whistleblower, and the author of the book “Air Safety Investigators.” Doubling down on his reelection strategy of enflaming racist sentiment, President Trump tweeted about Baltimore, Maryland over the weekend, calling the city, “a disgusting rat and rodent-infested mess.” He specifically criticized the district’s congressman, Rep. Elijah Cummings, who has represented Baltimore for 23 years. Trump then went on to say that Baltimore is “far worse and more dangerous than the US-Mexico border and is a very dangerous and filthy place. Was zum Teufel ist denn da bitte aktuell bei Boeing los?Was für ein Desaster! Es hat zwei kurz aufeinander folgende Abstürze im Jahr 2018/2019 gebraucht, bis Boeing, auch dank einem fast weltweiten Grounding seiner B737-Max8 endlich gezuckt hat. Und als wir alle dachten, das wird sich binnen Wochen lösen, hört man von Qualitätsmängeln in der Produktion des Dreamliners, der B787. Und als man auch das verdaut hat, heißt es plötzlich: Boeing hätte schon seit 2017 über die Fehler der Max8 Bescheid gewusst, aber nach interner Untersuchung mit dem Ergebnis, dass die keine Beeinträchtigung der Flugsicherheit darstellt, keine weiteren Schritte eingeleitet... was bitte ist denn da aktuell bei Boeing los?!? Die Boeing 737 MAX-7 / Quelle: Boeing.comPodCaster Shownotes: Ich muss es ja nicht nochmal im Detail breit treten, ihr erinnert Euch alle noch an die zwei Unfälle: eine Tiger Air stürzte am 29.10.2018 kurz nach dem Start vor der Küste Indonesiens ab und tötete dabei 189 Passagiere. Wie wir mittlerweile wissen, war auch der Hinflug am Vortrag nach Jakarta mit Problem behaftet, was durch Zufall durch einen dritten Piloten im Cockpit "behoben" werden konnte. Das die Crew am nächsten Tag leider nicht dieses Glück hatte, wissen wir mittlerweile auch... Erste Untersuchungsergebnisse ergaben, dass der Flug nach dem Start mit ungewöhnlichen Höhenänderungen flog. Diese Erkenntnisse trafen auch auf den Flug ET302 (Ethiopian Air) am 10.03.2019 zu, der 157 Menschen das Leben kostete. Es folgte ein Drama, dass in der Luftfahrt seit mehreren Jahrzehnten nicht mehr gesehen wurde: nach viel Diskussion in diversen Ländern wurde in den ersten Regionen "Groundings", also Start- und Lande- sowie auch Überflugverbote für Modelle des Typs Boeing B737 Max-8 erlassen. Auch, wenn nicht unter den ersten, erließ die FAA, die amerikanische Flugsicherungsbehörde, ein Grounding aller 737Max8s. Dann wurde es noch unschöner: es kam auf, dass, wie bereits vermutet, das neue System MCAS, Maneuvering Characteristics Augmentation System, daran Mit-Schuld haben könnte. Dann kam heraus, dass die FAA, auch für die Zulassung neuer Maschinen in den USA zuständig, teilweise Prüf- und Testberichte von Boeing unkommentiert übernommen und quasi intern ungeprüft zur Zulassung verwendet hatte. In der weiteren Aufbereitung kam noch heraus, dass die Anzeige für den Angle of Attack, der quasi die "Werte" des MCAS als Grafik im Cockpit ausgibt, bei den erstem Maschinen Aufpreis-pflichtig angeboten wurde. Parallel arbeitete Boeing unter Hochdruck an einem Softwareupdate. Die Max 8 schien bald wieder in der Luft zu sein. Und dann? Dann steht ein ehemaliger Mitarbeiter des Boeing Werks North Charleston, South Carolina, auf und weißt auf jahrelange Qualitätsmängel in der 787-Produktion hin. Es werde Schnelligkeit über Gründlichkeit gestellt, sagt der Mitarbeiter. Ein Mitarbeiter, der in der Qualitätssicherung gearbeitet hat. Sowie duzende seiner Kollegen. Seitens der Werksleitung wurde Druck auf diese Mitarbeiter ausgeübt, "die Klappe zu halten". Aber die Mängel scheinen gravierend zu sein: Späne aus Metal und große Metalsplitter seinen wohl in der Isolationsschicht zwischen Hülle und Innenraum nicht beseitigt worden. Hier besteht das Risiko, dass sich diese bewegen und z.B. Kabel und Leitungen beschädigen. Auch wurden wohl größere Gegenstände "eingemauert": die Rede war in einigen Fällen von Leitern und Montagewerkzeug, Dreck und Müll scheint wohl jeder Dreamliner im Rumpf zu haben. Und das, wo in der Luftfahrt jedes Gramm zählt...! Und, als könnte es nicht schlimmer kommen, musste Boeing dann bekannt geben, dass der Dreamliner ein weiteres Problem hat: laut einer Direktive der FAA aus Februar 2019 kann in allen Serien, also die 787-8, 787-9 und -10, ein Hebel klemmen, der das Löschsystem für die Triebwerke auslöst. Das bedeutet: bei einem Triebwerkbrand "zieht" der Pilot diesen Hebel um die Löschung des Triebwerkes mit Halon zu starten. Laut der FAA besteht allerdings das Risiko, dass diese Fehlfunktion bei dem Plastikhebel keine Löschung auslöst. Dies würde zu einem brennenden Vorflügel führen und könnte damit eine schlimme Katastrophe auslösen. Boeing kommentierte dies als "altes Problem", welches laut internen Untersuchungen nur bei einer kleiner Zahl von Dreamliners auftritt. Trotzdem sieht sich Boeing vor dem dritten Quartal dieses Jahres nicht in der Lage, eine Lösung für den klemmenden Hebel zu finden... An sich Krise genug: das Zugpferd ist seit Wochen weltweit auf dem Boden, erste Airlines kommen in finanzielle Schwierigkeiten deshalb. Eventuell wird, je nachdem wie lange das Grounding noch dauert, die eine oder andere Billig-Airline aufgeben müssen. Der Ersatz für die eingestellte Boeing 747-8-Linie ist angeschlagen. Wie viel schlimmer kann es also noch kommen? Ja, unfassbar - es geht noch schlimmer! Im Mai 2017 fand Boeing heraus, dass ein Warnsystem im Cockpit der Max8 nicht richtig funktioniert. Und das Ergebnis der internen Untersuchung habe ich oben schon zitiert: keine Beeinträchtigung der Flugsicherheit. Das hat sich mittlerweile als radikale Fehleinschätzung entpuppt. Sowohl die oberste Führungsriege als auch die FAA wurden über die Erkenntnis und das Ergebnis der Boeing-Untersuchung nicht informiert - dies geschah erst rund eine Woche nach dem ersten Absturz im Oktober letzten Jahres. Führen wir es zusammen: Die beiden Unfälle haben 346 Menschen getötet. Erste Untersuchungen verweisen auf das neue System MCAS. Und der interne Untersuchungsbericht sieht als Schuldigen einen Zusammenhang mit dem neuen System MCAS. Aktuell ist noch unklar, ob und wie weit MCAS für die beiden Abstürze eine entscheidende Rolle spielte oder nicht. Allerdings lassen bisherige Ergebnisse und die scheibchenweise ans Tageslicht kommenden Informationen kein wirklich gutes Licht auf Boeing scheinen... Ihr dürft jetzt alles tun, nur mich nicht fragen, ob man bei Boeing noch einsteigen möchte: die bisherigen Vorwürfe lassen den Dreamliner eher als tickende Zeitbombe erscheinen, die Max ist gegroundet - und die restlichen Modelle haben eine äußerst positive Bilanz. Es ist wieder Zeit für einen PodCast-Gastauftritt... bei Sven sagt, Der PodCast!Auch in Teil 3 (Teil 1 und Teil 2 hier!) lässt uns beide das Thema Apple Pay nicht kalt: nicht nur, dass Apple der Gewinner auf dem deutschen Markt ist und Google immer noch toter Mann spielt, Apple gewinnt weitere Banken die mitmachen. Ich bin mir mittlerweile nicht mehr ganz sicher, ob Google noch WEISS, dass es ein Produkt namens "Google Pay" in Deutschland gelauncht hat... aber das wäre einen weiteren PodCast wert... Und es gab weitere News, auf die wir uns gestürzt haben: die Apple Kreditkarte (Hallo? Google? Brennt bei Euch noch Licht?), die jüngste und hoch-peinliche "Entscheidung" einer inkompetenten EU und was bei raus kommt, wenn Leute angeblich im Hunderterpack "falsch" wählen und, damit konnte keiner rechnen: die Boeing 737-Max8. Viel Spaß beim zuhören! (Ihr kennt es ja schon: Es gibt keinen Begleit-Text oder tiefergreifende Shownotes von meiner Seite dazu! Sorry dafür! Das ist der Nachteil von Live-Aufnahmen, auch wenn uns die Technik diesmal so gar nicht wollte...!) On today's episode of Loud & Clear, Brian Becker and John Kiriakou are joined by Matthew Hoh, who resigned in 2009 from the State Department over the American escalation of the war in Afghanistan, and was a marine in the US occupation of Iraq prior. He is a winner of the Ridenhour Prize Recipient for Truth Telling.NATO foreign ministers are meeting in Washington this week to mark the 70th anniversary of the alliance’s creation. The agenda also includes NATO relations with Russia, the fight against terrorism, NATO expansion, and military spending. A number of peace groups are planning demonstrations opposing the meeting, and one major event is planned for tomorrow here in Washington. Federal Aviation Administration whistleblowers told the Senate Commerce Committee yesterday that safety inspectors at the FAA, including those involved in approving use of the Boeing 737-Max8, lacked proper training and certifications. The Republican-controlled Senate committee has launched a formal investigation into why two of the jets crashed in the past five months, killing 346 people. Mary Schiavo, the former Inspector General at the Department of Transportation, an aviation attorney, and an aviation professor, joins the show. Algerian President Abdelaziz Bouteflika resigned yesterday after weeks of protests demanding the end of his 20-year rule. He had been expected to resign before the end of his term on April 28, but just a few days ago, the country’s military chief said publicly that Bouteflika was unfit for office. Brian and John speak with Dr. Gerald Horne, a professor of history at the University of Houston and author of many books, including “Blows Against the Empire: U.S. Imperialism in Crisis,” “The Counter-Revolution of 1776: Slave Resistance and the Origins of the United States of America,” and “The Apocalypse of Settler Colonialism: The Roots of Slavery, White Supremacy and Capitalism in Seventeenth Century North America and the Caribbean.” Wednesday’s weekly series, In the News, is where the hosts look at the most important ongoing developments of the week and put them into perspective. Simon Shares Group5 (JSE code: GRF) goes into business rescue with "a slim chance for any realisation of value.". It seems the construction of a power station in Ghana was the final nail. Remember the +R1billion they were offered to their Eastern European toll operations? But in the end a lack of liquidity killed them. Be very careful of holding Aveng (JSE code: AEG), if nothing else check the bid/offer, price is heading to 1c. No Brexit deal with 15 days to go. A mess of epic proportions. Back in November 2017 I wrote in FinWeek that we'd get zero fee ETFs and eventually negative fee ETFs (they'll pay you to hold them). It has happened. MoneyWeb is reporting on a US ETF offering to pay investors to buy their ETF. Locally our much smaller market and hence much smaller ETFs means we're a long way from free, but I do think in time it'll happen locally and Satrix40* (JSE CODE: STX40) would probably the one able to do it. Aspen (JSE code: APN) taught us some important important lessons. Debt is fine until it's not and then it can be fatal. Buffett talks about this in his latest shareholders letter. Secondly the market has become a lot more skittish and punishing since Steinhoff (JSE code: SNH). This is not likely to go away any time soon. The answer is simple, watch a companies debt and hold quality, real quality, only. Investment lessons from Boeing We live in wild times made possible by the internet and powerful computers in our pockets. Much of it is good with a fair amount of bad as well (think Twitter trolls), but for large old school companies it can be especially bad. Think Momentum refusing to pay out the life policy. They were correct as per the law and policy wording, but they showed a complete lack of compassion and eventually backed down. Think Vodacom trying to scam us on the ICASA rules for rolling over data with crazy fees. They backed down and from a business profit motive they may have been right but they were a million miles away from the spirit of the law and ICASA may have blocked their fees anyways. Think TigerBrands and their total lack of empathy as they responded with legal speak while South Africans were dying from listeriosis originating at their production facilities. Think Boeing, standing firm after another of their new Boeing 737 Max8 crashed shortly after take off. In the olden pre Internet days Boeing would have been able to control the message with ease and insisted everything was fine, hoping like hell another plane didn't crash and quickly rolling out a software 'update' that may or may not fix the issue (from what I have read the issue is training, not software, here's a long NYT read on it). Boeing have failed to understand the new rules in which businesses operate. Firstly those rules are a lot more ethical. Consumers want to be treated fairly. Hey we always did, but we never really had any power. And that's the second and very important point, consumers now have power. That power comes via the Internet and very quickly a raging anger can over whelm any attempt to manage the message. Now sure often the raging anger is actually just a lynch mob and this is very much the dark downside of the Internet. But the upside is that consumers have power and they'll exercise that power. Sometimes for good and sometimes for bad. A business needs to understand this. I remember attending a presentation on generational theory a decade back where the message was that millennials wanted ethical companies and would pay more to these companies. The flip is that they'll boycott a business they consider to be unethical. Now this is way more than just millennials, the issue is that millennials were given the power to firstly know a companies ethics and secondly do something about it. Companies that are going to survive and thrive in this new world will have fairness and ethics at their core, and that's hard. It's easy to put that into a mission statement, but living it is something else entirely and often a company messes up. For example the news that a company will phase out plastic straws by 2022. Nice, but why so long? Simple because they're trying to protect profits. Fair enough but the ethical demanding consumer doesn't care about your corporate greed, they care about the planet. The even harder issue is how do we manage this as an investor? Truth is we need a crisis to see how a business manages it and that is late in the process. But we can see glimmers of it via other means, such as the plastic straw example mentioned earlier. If a company is not putting the customer and ethics front and center they will eventually be in trouble. Lastly as investor we need to not chase profits at any cost. We need to invest ethically as well, this means fair fees we're charged by providers. It also means exiting dodge companies even if we think there is money to be made. We also need to focus on ESG (environmental, social and governance) issues. A very last point. Will Boeing survive? Of course. Will this hurt? Absolutely. Will it be a great investment going forward?
