A new report says there are reasonable grounds to conclude that four of the five genocidal acts defined under international law have been carried out since the start of the war with Hamas in 2023. Israel's ground offensive into Gaza City has begun. It comes as a United Nations independent inquiry has concluded for the first time that Israel has committed genocide against Palestinians in Gaza. The Israeli government rejects the findings, maintaining that it's acting in self-defense against Hamas. A UN commission investigating the Gaza war has concluded that Israel is committing genocide, adding its voice to growing international concern from legal scholars and human rights organisations.It doesn't have the force of a court or the UN Security Council. But as a commission of eminent legal experts, its findings carry significant moral weight.Arab Barghouthi is the son of Marwan Barghouthi, who is perhaps the most popular Palestinian leader in the occupied territories. He has been in jail for two decades after refusing to take part in the legal process that ultimately convicted him of being involved in attacks that led to the deaths of five people. He denied involvement.In the podcast Arab Barghouthi makes claims about his father's alleged mistreatment in prison. The Israeli prison service has previously responded to these allegations by saying that they have been examined in court which concluded that there had been no violation of the law by the Israeli Prison Service. It also said that all detainees have the right to file a complaint that will be fully examined by official authorities.Israel's Foreign Ministry has categorically rejected the UN commission's report calling it "distorted and false". Israel has always strenuously denied all claims of genocide, ethnic cleansing and apartheid in relation to the Palestinian people.

As the genocide in Gaza continues, humanitarian organisations face mounting pressure and unprecedented constraints. Famine has been declared, access remains heavily restricted, and international mechanisms have failed to prevent mass civilian suffering. Frustration is growing across the sector – with some questioning whether traditional humanitarian approaches are fit for purpose in the face of atrocity crimes. This event brought together humanitarian leaders, legal experts, and Palestinian voices to reflect on the urgent question: What should humanitarian actors do to stop the genocide in Gaza? The discussion examined the limits and responsibilities of humanitarian action, what humanitarian efficacy means in this context, the risks and consequences of different forms of engagement, and the potential for alternative strategies when established mechanisms appear paralysed. On Tuesday, in a groundbreaking new report, the United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territory officially concluded that Israel is committing genocide in Gaza. This comes ahead of the members of the commission stepping down later this year, after announcing their resignations this summer amid the US's escalating attacks on UN personnel.“The Commission concludes that the State of Israel bears responsibility for the failure to prevent genocide, the commission of genocide, and the failure to punish genocide against the Palestinians in the Gaza Strip,” the report says.In this exclusive interview, Mehdi speaks with two of the commissioners behind this report: Chair Navi Pillay of South Africa and commissioner Chris Sidoti, one of Australia's most prominent human rights lawyers.In the interview, Pillay – who previously served as president of the UN's International Criminal Tribunal for Rwanda – immediately draws parallels between genocide in Gaza and the Rwandan genocide.“It's when I came to the deliberate shooting of the single standing building where the fertility clinic was and the embryos. That immediately reminded me of the Rwanda genocide where I was a judge and where they ripped the bellies of pregnant women, pulled out the fetuses because they wanted to kill off the entire Tutsi group,” Pillay recounts.Pillay and Sidoti also both point out that unlike the Rwandan genocide, Palestinians in Gaza do not have neighboring countries they can escape to.“There is nowhere that the people of Gaza can go to escape this slaughter,” Sidoti tells Mehdi. “And yet the slaughter has continued.”The commissioners also address criticism that their report does not cover Hamas's war crimes, with Pillay noting that the commission has addressed Hamas's war crimes in previous reports.“It doesn't mean to me that every time you have to strike some kind of balance as if the parties are equal,” she explains. “They are not equal. They explain how metadata, satellite imagery, and video analysis reconstructed the final hours of massacres such as the killing of 20-year-old Mohammad Ridoi, whose disappearance still haunts his family. Archiving is a political act that confronts Bangladesh's machinery of impunity and keeps memory alive against official narratives. They also explore the disinformation ecosystem that accompanied the killings: pro-government propaganda campaigns on Facebook, deliberate framing of student protesters as violent extremists, and a systematic effort to discredit the uprising. Against this, informal networks of communities mobilised to counter state lies. In this episode of Occupied Thoughts, FMEP Fellow Ahmed Moor speaks with Daniel Levy, President of the U.S./Middle East Project (USMEP). They discuss Levy's argument that the way that Israel withdrew Israeli settlements from Gaza in 2005 set the stage for today's genocide; as Levy put it in a recent +972 Magazine piece, the current Israeli paradigm is "not just separating from the Palestinians, relegated to shrinking Bantustans, but annihilating and erasing them." From 2012 to 2016, Levy was Director for the Middle East and North Africa at the European Council on Foreign Relations. Prior to that he was a senior Fellow and Director of the New America Foundation's Middle East Taskforce in Washington D.C. and a Senior Fellow at The Century Foundation in New York. Levy was a Senior Advisor in the Israeli Prime Minister's Office and to Justice Minister Yossi Beilin during the Government of Ehud Barak (1999-2001). He was a member of the official Israeli delegation to the Israel/Palestine peace talks at Taba under Barak and at Oslo B under Yitzhak Rabin (1994-95). Levy is a founder and Advisory Board member of Diaspora Alliance (combatting antisemitism and its conflation), a Council Member of the ECFR, and serves on the board of the European Middle East Project. He is a former Trustee of the Rockefeller Brothers Fund in New York and of the New Israel Fund, a co-founder of J Street, and a founding Editor of the Middle East Channel at foreignpolicy.com.  Ahmed Moor is a Palestinian-American writer born in Gaza and a 2025 Fellow at FMEP. He is an advisory board member of the US Campaign for Palestinian rights, co-editor of After Zionism (Saqi Books) and is currently writing a book about Palestine. He also currently serves on the board of the Independence Media Foundation. His work has been published in The Guardian, The London Review of Books, The Nation, and elsewhere. Current and former tech workers with the No Azure for Apartheid coalition continue to disrupt business as usual at Microsoft's global headquarters in solidarity with Palestinians facing a genocide, and in protest of Microsoft's contracts with the Israeli military to provide tech that Israel uses to surveil, kill, and retroactively justify the killing of Palestinians.
