On the evening of May 10, 1988, a passing driver on Howard Street in Brockton, MA, stopped to investigate something unusual on the side of the road. When the driver got closer to what they thought was a bag, they realized it was actually the body of twenty-four-year-old Anthony LoConte, bleeding badly from injuries to his face and head.Initially, investigators believed LoConte was the victim of a hit-and-run accident; however, when the coroner examined the body, he discovered a bullet hole in the back of LoConte's head, indicating that he'd been murdered.It took twelve years for investigators to track down LoConte's killer, but in the winter of 2000, California Highway Patrol arrested Robert Morganti on drug charges and a quick background check connected them to a 1988 warrant for Morganti for the murder of Anthony LoConte. Robert Morganti was extradited back to Massachusetts, where he was tried, convicted, and sentenced to life in prison without the possibility of parole for LoConte's murder. The measure, which passed by a vote of 314 to 108, angered conservative Republicans who opposed any continuing resolution to fund the government without concessions by the Democrats on border security and spending. The House Freedom Caucus made an eleventh-hour plea to House Speaker Mike Johnson to permit an amendment to the House’s border security package, which Johnson rejected. Freedom Caucus Chairman Bob Good slammed his fellow Republicans who supported the continuing resolution ahead of the vote. “The more things change, the more things stay the same,” he said in a floor speech. “We’re not even willing to risk a temporary pause in the 15 percent of the non-essential part of the government in order to force change in Washington,” he said. “No, we’re going to continue the status quo.” Good’s statements echoed an official position on the measure released by the Freedom Caucus hours before the vote. “Americans did not give Republicans a majority in the House to continue Nancy Pelosi’s inflationary spending and Joe Biden’s failed policies,” the group wrote in a statement. “This is not what we promised the American people.” The vote is also likely to be unpopular with the Republican base, which consistently ranks immigration as one of the top issues facing the country. The church and the center, alongside Alliance Defending Freedom (ADF), filed a lawsuit in June last year alleging that officials with the U.S. Department of Agriculture and the California Department of Social Services barred them from participating in the “Child and Adult Food Care Program” because of their religious beliefs on gender and sex. ADF and state officials filed a settlement agreement this week requiring the defendants to pay $30,000 for meals paid out of pocket in the absence of state funding and $160,000 for attorney’s fees. “In the name of combatting discrimination, government officials excluded the church and preschool from serving the El Cajon community based solely on their religious beliefs and exercise,” Jeremiah Galus, senior counsel for ADF, said in a press release. “While it shouldn’t have taken a lawsuit to resolve this, at least now Church of Compassion can continue its vital outreach to needy children and families.” The center had been a part of the USDA’s program for nearly two decades when the department changed its rules in 2021 requiring all participants to commit to not discriminate on the basis of sexual orientation and gender identity. In May 2023, the department also required state directors of USDA’s food and nutrition service programs to prohibit “discrimination on the basis of gender identity and sexual orientation.” Church of Compassion and Dayspring Christian Learning Center failed to meet these new requirements for the 2022-2023 school year because of their beliefs on “human sexuality” and their refusal to “use any child or employee’s ‘preferred’ pronouns that do not correspond to biological sex,” according to the lawsuit. ADF argued that the department and state officials were deliberately discriminating against the church and the learning center because of its faith in violation of the First Amendment. “The government can’t withhold food from families in need simply because their children attend a Christian preschool. The Constitution protects the right of Church of Compassion and its preschool to operate according to the dictates of their faith,” Galus said in the press release. https://townhall.com/tipsheet/madelineleesman/2024/01/17/lgbt-activist-arrested-child-predator-sting-n2633750 Director of LGBTQ+ Organization That Helps Minors Arrested in Child Sex Sting The executive director of the pro-LGBTQ+ organization Rainbow Research Center was apprehended on suspicion of attempting to engage in sexual activities with a minor, according to The Modesto Bee. Reportedly, a total of 17 men were arrested on suspicion of eliciting sex with a minor after an undercover sting conducted by the Turlock Police Department in California. Gerard Slayton, 42, was one of them (via the Bee): Slayton recently was appointed executive director of the Rainbow Center, a local nonprofit organization that provides resources to LGBTQ+ members of all ages. It particularly offers resources related to mental and physical health. In a statement shared on Facebook, the Rainbow Resource Center said that Slayton’s actions occurred “outside working hours and off-premises.” “Mr. Slayton’s actions do not represent our organization’s values or mission. In accordance with our unwavering commitment to upholding the highest standards of conduct and integrity, we are addressing the issue within the Rainbow Resource Center,” the statement read. “We are dedicated to rebuilding any trust that may have been affected by the situation. As an organization that is at the forefront of advocacy and support for the LGBTQ+ community, our actions must reflect our dedication to these principles,” it continued. https://dailycaller.com/2024/01/17/beijing-china-wuhan-covid-19-100-percent-death-mice-study-full-paper/ Mutant COVID-19 Strain With 100% Kill Rate Developed In China A pre-peer-reviewed study published in early January described how mice were exposed to a human-based “lethal infection” of COVID-19 with a 100% mortality rate. The Beijing-based research paper was submitted to the scientific preprint site BioRXiv and published prior to peer review, but the data held within the pages is significant. Two SARS-CoV-2-related pangolin coronaviruses (GD/2019, GX/2017) were identified prior to the major COVID-19 outbreak in late 2019 through early 2020, according to the study’s authors. The researchers then isolated “mutant” strains, which were cultured in labs between 2017 and 2020. When the infectivity and pathogenicity of the isolates were tested, it was found to easily infect golden hamsters and mice. The first isolate pCoV-GD01 had a higher homology than COVID-19, whereas GX_P2V didn’t seem to cause any disease in the animals despite infection. But an early passaged GX_P2V isolate, named GX_P2v(short_3UTR) not only infected mice with extremely high viral loads into their lung and brain tissue, but eventually killed 100% of the mice within the study. Even those mice who were given an inoculation (i.e., vaccinated) succumbed to the disease. Autopsy of the mice showed viral RNA in the brain, lung, turbinate, eye and trachea, killing all of the mice within eight days of infection. All of the mice’s eyes also went white the day before they died. The authors argued this is the first report that COVID-19-related pangolin coronavirus can cause 100% mortality rates in mice, suggesting a significant risk of the disease spilling over into humans. But since the study is not peer-reviewed, there are huge questions about the efficacy of the results. “I had a look at the preprint. It’s a terrible study, scientifically totally pointless. I can see nothing of vague interest that could be learned from force-infecting a weird breed of humanised mice with a random virus. Conversely, I could see how such stuff might go wrong …” University College London genetics director Francois Balloux wrote on Twitter. “The preprint does not specify the biosafety level and biosafety precautions used for the research.” Balloux’s statements were reiterated by Rutgers University chemistry professor Richard H. Ebright, who wrote “concur” under the comment. It appears the biggest concern is related to why scientists feel the need to develop these horrific diseases. “The absence of this information raises the concerning possibility that part or all of this research, like the research in Wuhan in 2016-2019 that likely caused the Covid-19 pandemic, recklessly was performed without the minimal biosafety containment and practices essential for research with potential pandemic pathogens,” Balloux concluded. And it’s pretty hard to argue with his stance. China is already inching back toward lockdowns as mysterious viruses spread throughout the country. Most of these illnesses are being blamed on influenza strains and other respiratory diseases, but no single culprit has been identified to date.

Gerard Slayton, 42, was one of them (via the Bee): Slayton recently was appointed executive director of the Rainbow Center, a local nonprofit organization that provides resources to LGBTQ+ members of all ages. It particularly offers resources related to mental and physical health. In a statement shared on Facebook, the Rainbow Resource Center said that Slayton’s actions occurred “outside working hours and off-premises.” “Mr. Slayton’s actions do not represent our organization’s values or mission. In accordance with our unwavering commitment to upholding the highest standards of conduct and integrity, we are addressing the issue within the Rainbow Resource Center,” the statement read. “We are dedicated to rebuilding any trust that may have been affected by the situation. The Beijing-based research paper was submitted to the scientific preprint site BioRXiv and published prior to peer review, but the data held within the pages is significant. Two SARS-CoV-2-related pangolin coronaviruses (GD/2019, GX/2017) were identified prior to the major COVID-19 outbreak in late 2019 through early 2020, according to the study’s authors. The researchers then isolated “mutant” strains, which were cultured in labs between 2017 and 2020. When the infectivity and pathogenicity of the isolates were tested, it was found to easily infect golden hamsters and mice. The first isolate pCoV-GD01 had a higher homology than COVID-19, whereas GX_P2V didn’t seem to cause any disease in the animals despite infection. But an early passaged GX_P2V isolate, named GX_P2v(short_3UTR) not only infected mice with extremely high viral loads into their lung and brain tissue, but eventually killed 100% of the mice within the study. Even those mice who were given an inoculation (i.e., vaccinated) succumbed to the disease. Autopsy of the mice showed viral RNA in the brain, lung, turbinate, eye and trachea, killing all of the mice within eight days of infection. All of the mice’s eyes also went white the day before they died. The authors argued this is the first report that COVID-19-related pangolin coronavirus can cause 100% mortality rates in mice, suggesting a significant risk of the disease spilling over into humans. But since the study is not peer-reviewed, there are huge questions about the efficacy of the results. “I had a look at the preprint. It’s a terrible study, scientifically totally pointless. I can see nothing of vague interest that could be learned from force-infecting a weird breed of humanised mice with a random virus. Conversely, I could see how such stuff might go wrong …” University College London genetics director Francois Balloux wrote on Twitter. “The preprint does not specify the biosafety level and biosafety precautions used for the research.” Balloux’s statements were reiterated by Rutgers University chemistry professor Richard H. Ebright, who wrote “concur” under the comment. It appears the biggest concern is related to why scientists feel the need to develop these horrific diseases. “The absence of this information raises the concerning possibility that part or all of this research, like the research in Wuhan in 2016-2019 that likely caused the Covid-19 pandemic, recklessly was performed without the minimal biosafety containment and practices essential for research with potential pandemic pathogens,” Balloux concluded. And it’s pretty hard to argue with his stance. China is already inching back toward lockdowns as mysterious viruses spread throughout the country. Most of these illnesses are being blamed on influenza strains and other respiratory diseases, but no single culprit has been identified to date.

The measure, which passed by a vote of 314 to 108, angered conservative Republicans who opposed any continuing resolution to fund the government without concessions by the Democrats on border security and spending. The House Freedom Caucus made an eleventh-hour plea to House Speaker Mike Johnson to permit an amendment to the House’s border security package, which Johnson rejected. Freedom Caucus Chairman Bob Good slammed his fellow Republicans who supported the continuing resolution ahead of the vote. “The more things change, the more things stay the same,” he said in a floor speech. “We’re not even willing to risk a temporary pause in the 15 percent of the non-essential part of the government in order to force change in Washington,” he said. “No, we’re going to continue the status quo.” Good’s statements echoed an official position on the measure released by the Freedom Caucus hours before the vote. “Americans did not give Republicans a majority in the House to continue Nancy Pelosi’s inflationary spending and Joe Biden’s failed policies,” the group wrote in a statement. “This is not what we promised the American people.” The vote is also likely to be unpopular with the Republican base, which consistently ranks immigration as one of the top issues facing the country. The church and the center, alongside Alliance Defending Freedom (ADF), filed a lawsuit in June last year alleging that officials with the U.S. Department of Agriculture and the California Department of Social Services barred them from participating in the “Child and Adult Food Care Program” because of their religious beliefs on gender and sex. ADF and state officials filed a settlement agreement this week requiring the defendants to pay $30,000 for meals paid out of pocket in the absence of state funding and $160,000 for attorney’s fees. “In the name of combatting discrimination, government officials excluded the church and preschool from serving the El Cajon community based solely on their religious beliefs and exercise,” Jeremiah Galus, senior counsel for ADF, said in a press release. “While it shouldn’t have taken a lawsuit to resolve this, at least now Church of Compassion can continue its vital outreach to needy children and families.” The center had been a part of the USDA’s program for nearly two decades when the department changed its rules in 2021 requiring all participants to commit to not discriminate on the basis of sexual orientation and gender identity. In May 2023, the department also required state directors of USDA’s food and nutrition service programs to prohibit “discrimination on the basis of gender identity and sexual orientation.” Church of Compassion and Dayspring Christian Learning Center failed to meet these new requirements for the 2022-2023 school year because of their beliefs on “human sexuality” and their refusal to “use any child or employee’s ‘preferred’ pronouns that do not correspond to biological sex,” according to the lawsuit. Ron did this by reporting the local sports scene and keeping his hometown of Manteca in the minds of people who were part of the Modesto Bee circulation. He went to school at MHS for a year and wore the green, but was then transitioned to the new high school in town back in the late 60's East Union High school where he graduated and got his love for people, sports, and writing, now here we are 40 years down the road. It was a road that started in Selma after Fresno state, with duties at local newspapers in Merced and Manteca over the years. Ron's pushed No. 2 pencils and pens, for many a gateway into the media from a small city where his name is synonymous with sports writing. He loves golf, his wife, daughter brothers and sisters, Manteca, and sports. Ron is a great family man and loves keeping the tradition of his lineage, by working hard, doing service work around town and his church. This was all handed down from the Agostinis, his parents, who farmed this land so many years ago.. I bet he and I, are the same. I think it's about time to get him into the Manteca Hall of Fame what an honor that would be, to be there with his Dad who holds the honor already.. Ron Agostini is on the Manteca Podcast.

I was a gymnast as a kid, grew up in the Mojave desert. I was ironically about my daughter's age, seven years old in second grade, My second-grade teacher had an elite gymnast as a daughter and she thought it might be good for me to try gymnastics. I don't know if I was ever hooked on gymnastics, to be honest. I think I just liked the challenge of it even early on, it was hard. And then it became a huge part of my life, gosh, probably for close to 10 years, maybe a little less than 10 years. I became a pretty competitive gymnast who competed at the state level. So one day we had a pull-up contest in junior high school and I did 35 pull-ups and one of the school teachers took notice of me and invited me to go rock climbing. And that weekend, my brother and I went climbing. We went to the Needles of California, a little spot called Dome Rock. And that was it. I was hooked. I just loved every aspect of climbing, the mental, the physical, the cultural components, the drive up to the needles with two of my school teachers, Bob Porter and George Egbert and I was hooked. Then the next weekend I'd borrowed my dad's camera. Because I wanted to make better pictures, tell better stories of these weekend adventures. And I realized right away that my dad had a pretty nice camera, but my photos still suck. And I realized that it's not about the camera, it's about how you use it and how you think. So within a week, two passions were born. A passion for adventure, for climbing, and the passion for storytelling. Where did the storytelling part come from? Do you have any storytellers in your family? I think my dad was always this oral storyteller. He loved yucking it up, like shooting the shit with his buddies, in our kitchen or around a campfire. My dad was a scuba diver, big into back in the day when it was, a little more of the Wild West. Diving off the channel islands and you could actually bring home stuff to eat. We had so much abalone, like hundreds of abalone shells in our backyard in buckets. He and his buddies every Friday after work, they would take off and they would get on a dive boat out of Ventura or Oxnard go out for two days. And they would come back with, wild tales of adventure and some food to eat. So I think I learned storytelling from him. He always was a good storyteller. He would come home and tell some crazy tale of a kid blowing up and the sheriff coming to school and the parents having to get arrested, not always doom and gloom, but he could see the light. He understood the highlights of his day. He told even a better story of scuba diving, and so did his buddies. Tell us about your first Adventure Sports Storytelling and Photography commercial shoot? I started to shoot a ton of climbing. That was my passion. And it's worth saying that I simultaneously was really trying to just become a better photographer. So I started this parallel pursuit. I started working at the local newspaper taking on assignments for the Antelope Valley Press. Then in college, I went to the Modesto Bee and got two internships back-to-back in the summers. So I was learning to tell stories, editorial storytelling for the newspaper. Then I took a semester off from college and drove around the Western United States, photographing rock climbing. And sent some unsolicited submissions at the end of that semester, one to Climbing magazine and one to Patagonia, the clothing brand. Much to my surprise, both of them called me within a weekend. Those were really my first climbing photographs to get published. One was the cover of Climbing magazine. It was a photo of my super close friend. Rikki Ishoy climbing at the Buttermilks right above your house. The other photo, I don't remember what it was, but it was a lifestyle photograph that published in the Patagonia catalog. That was really the first commercial paycheck I ever received. Those two first experiences really open the door. I had the cover feature story and inside. And then Patagonia became my first real client because, commercial clients pay so much more, triple or quadruple what an editorial client pays. And Patagonia, I owe a lot to the climbing magazines and to Jane Sievert and Karen Bednorz with Patagonia at the time. I started getting spec assignments where they would pay for my film and for the trip. Then they would license the pictures they wanted.  Then I think you're right, as my name started appearing in magazines and in Patagonia catalogs, the phone just started ringing more frequently. That opened the door to ad agencies calling and other outdoor brands. How did you get involved with Novus Select? 20 plus years ago, in the early part of my career, I was just a prolific shooter. I was shooting all the time for the magazines and for Patagonia. And I owned all of that work. And so a big chunk of my income was relicensing that the images that I had shot. I might shoot for Patagonia or, for some brand. Then two years later I would be licensing those images again and again. This was the tail end of the heyday of stock photography. I missed the true heyday that was 20 years earlier, in the nineties. But a big chunk of my income was stock photography. At that point, my office was downstairs at my house in South Lake Tahoe. I had two staff members and one of them was dedicated entirely to licensing the stock photography business for us. At one point a photographer and entrepreneur in the space, Jose Azel reached out to me or sent an email, I think he sent it to half a dozen photographers. And he said he owned a company called Aurora Photos, which had a very high-end stock photo agency. It was founded by a few national geographic photographers. Jose sent this email to a few of us and he asked Would you ever be interested in a brand that focused on outdoor adventure photography? I was hit up for ideas like this all the time so I responded while flying back to Reno and I wrote a real simple response. I didn't know Jose personally, but I said, "yeah, I'd be interested, but I'd have to have some equity in the company". I landed in Reno, and I sent a hundred emails that I'd written while I was on the plane. By the time I'd walked out to my car, my cell phone was ringing and it was Jose on the other line. We had this long conversation about, what an ideal outdoor adventures stock agency would look like. Then we did an experiment and a few of us we all kicked in some money and committed some of our photography to create a collection. That was Dan and Janine Patitucci, Brian Bailey, Scott Markewitz, and Greg von Doersten. We all were the founding members. So we all did this together and it was an experiment. Some guys learned it was for them, some guys learned it wasn't for them. Over time I was the last man standing, it was the right fit for me. It evolved over time into Jose and I being partners in Aurora photos. Then we created an assignment agency that was run out of New York City. That was originally called Aurora Novus. Meanwhile, the economy changed and we watched the ups and downs in our industry and the evolution of our industry. Eventually, it evolved into what it is today, which is Jose is no longer in the business, and Aurora photos sold off the stock photography agency side. Novus Select, which is the assignment and production company side is owned by four partners, that's Wyn Ruji, Lincoln Else, and Andy Mead. We have 13 full-time employees, we have an office and our office address, I love saying this we're at One One One One Ski Run Boulevard. Do you have any suggestions or advice for folks wanting to get into Adventure Sports Storytelling and Photography? Yeah, it just struck me recently that I think so often we look at the past what worked, what are the lessons that we can learn from the past, and how does the industry work? Of course, you should do that. You should look at what makes a great Adventure Sports Storytelling and Photographer, understand the craft. And understand what works from a business perspective, but never feel confined by what worked in the past. Then I think we're truly living in the golden age of storytelling. It's right now. You're no longer beholden to a publisher, that you're begging to publish your photographs. You are the publisher, you own your channel or 20 channels. Whether it's podcasts, photography, books, just do your thing. I don't have the answer, but it's, that 20-year-old kid coming out of college or dropping out of college right now to drive around in their, sprinter van and take pictures and shoot films climbing. Your career is not going to evolve the same way that mine did. I'm old school now. I was this guy that shot film and had mages published in print magazines, the 20-year-old coming out of college right now, they're going to be leveraging the internet. They're going to be leveraging platforms like Instagram and Facebook. They're going to be doing podcasts and they're going to be creating whatever the next iteration of a blog is. You're going to be shooting in VR, using venues on Facebook. And it's going to be more immediate and you're going to figure out how to monetize all of these platforms and you're going to monetize your audience. So I don't have the answers, but I definitely recognize that this is an incredible moment in time from a business standpoint and from an Adventure Sports Storytelling and Photography selling standpoint the power has never been more in the hands of the content creator. She has published 75+ primarily health/wellness/science articles for her column in a local newspaper, The Turlock Journal; in another local newspaper, The Modesto Bee; in letters to the editors of various publications; in the online version of Teen Ink Magazine, for which she won two Editor’s Choice Awards; in Contentment Health Magazine; in the Huffington Post; on Yahoo! Voices; and in SparkLife. She also won the UC Davis COSMOS Tina Rose Noto Award for her commitment to pediatric healthcare. Henna now has a “Health with Henna” segment on Express Yourself! Teen Radio, the #1 most listened-to program on the VoiceAmerica Kids Network. In her free time, she is a dedicated bicyclist, a yoga-lover, and a Zumba enthusiast. Thank you.   HR 2954: Public Access & Lands Improvement Act The Congressional Budget Office analysis of HR 2954 RAUL GRIJALVA (AZ):" Let's be clear: we are talking here about Federal property, that is, property owned by all Americans. The land in question in Escambia County, Florida; Anchorage, Alaska; Fernley, Nevada; Cape Hatteras, North Carolina; Yellowstone and Grand Teton and the land on which Federal grazing occurs, the land impacted by this package is Federal land, owned by each and every American taxpayer. In the case of these land transfers, the Federal Government gave the land, gave it to a local community as a means of Federal support, and the only requirement, in most cases, was that the land always be used for public purposes. As long as it is a park or a school or a fire station, it is yours, for free. What these bills do is end those public purpose requirements. The communities want to use these lands for private profit. They want to close them to the public, in many cases. This is not a land grab by Uncle Sam. This is not some silly scheme by the Feds to harm local communities and to use their power to hold down the tax-payers and keep the public out. This is a community asking to make money off land that was owned by all Americans, and it is the job of Congress to decide if that is a good idea or not. TITLE I: Florida land transfer Allows Escambia County, FL to give away it's title, right, and/or interest in Santa Rosa Island "to any person or entity", without restrictions. Escambia County has 2 years to transfer its rights, title, and interest in its property that falls within Santa Rosa Country to Santa Rosa County. The transfer is final and "shall terminate" "any regulation of Santa Rosa County by Escambia County" RAUL GRIJALVA (AZ): "This is public land, not land to give away and, as stated before, over and over again, be dredged and used for a harbor for potential windfall profit." The concern raised by Raul Grijalva is over the possible dredging of Navarre Pass. A pass was dredged for boats in 1965 but was almost immediately destroyed by Hurricane Betsy. In 1968, a permit to re-dredge the pass was denied. The fighting over this has continued ever since. From what I can gather, Santa Rosa county wants to dredge the pass again but Escambia County does not. Both counties currently get a vote on this issue. Terminating any regulation of Santa Rosa County by Escambia County could potentially take Escambia's vote away and allow the pass to be dredged. TITLE II: Transfer of Federal land rights to the City of Anchorage Section 203: Secretary of the Interior will give all rights to land it currently leases to the City of Anchorage "to enable economic development" of that land. City of Anchorage will pay all costs. TITLE III: Sale of Federal land to Fernley, Nevada Introduced by Mark Amodei (NV-2) Section 302: Forces the Secretary of Interior to process a sale of 9,407 acres of Federal land to the City of Fernley in Nevada. Secretary of Interior will determine the "fair market price" CBO estimate's that to be $3,500 per acre = almost $33 million worth of land The map of the land will be available for public inspection, but it doesn't say it has to be available before the sale is completed. The land transfer will not be considered a "major Federal action", which exempts it from evaluation under the National Environmental Policy Act Section 303: Releases the Federal government from any liability from "the presence, release, or threat of release of any hazardous substance, pollutant, contaminant, petroleum product (or derivative of a petroleum product of any kind), solid waste, mine materials… on the Federal land in existence on or before the date of conveyance." Section 304: Appears to exempt the land from public land, mineral leasing, mining, and geothermal leasing laws. *confusing - not sure* "Current uses of these lands include grazing, mining, a public airport lease, and a geothermal lease... The Federal government owns both the surface and mineral estate in much of the parcels and the value of the mineral estate may be substantial." "The city has said possible uses could include parks, an airport, hospital, convention center and other businesses." TITLE IV: Prevents Federal land purchases Introduced by Rob Bishop of Utah RAUL GRIJALVA (AZ): "Let's put one other misleading claim to rest. While Republicans claim the Federal Government owns too much land, the historic trend has been one of divestiture and fragmentation. As recently as the late 1860s, the Fed-eral Government owned 1.8 billion of the 2.3 billion acres in the contiguous United States. Grants to States, home-steaders, land-grant colleges, railroads and others settling in the Alaska and the West have reduced Federal land ownership by roughly 640 million acres to date."* Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public" Section 401: No land can be purchased, donated, or transferred to the Federal government until a database of land-for-sale is created and made "easily accessible to the public." TITLE V: Bush Administration Rules for Cape Hatteras National Seashore Introduced by Rep. Walter Jones of North Carolina Section 502: Management of Cape Hatteras National Seashore Recreational Area will be managed according to a Bush Administration era environmental assessment, issued June 13, 2007. In October 2007, a lawsuit was filed against the Bush Administration rules by Defenders of Wildlife an the National Audubon Society, claiming that they Bush Administration rules didn't restrict off-road vehicles enough to protect the animals and land - including land nesting birds, whose populations were declining - and sea turtles. A "consent decree" - basically a settlement- was agreed to in April of 2008. This consent decree is what is currently governing the seashore. After the consent decree was agreed to, the National Park Service created the rules - which included a public comment period - and their final rule went into effect on February 15, 2013. This bill nullifies the consent decree, prevents enforcement of the final rule, and puts the Bush Administration rules back in charge. The Secretary of Interior can not restrict pedestrian or motorize vehicle traffic in order to protect animals beyond the restrictions enacted by the Bush Administration. Protections for endangered species at Cape Hatteras can not be greater than the restrictions placed for that species at any other National Seashore. Section 504: Prohibits enforcement of a final rule regulating off-road vehicles at the seashore that went into effect on February 15, 2012. TITLE VI: Green Mountain Lookout Can't be Moved [caption id="" align="aligncenter" width="412"] The Green Mountain Lookout in 2010[/caption] March 2012: A federal court ordered the Forest Service to remove a lookout structure from Green Mountain wilderness area. The lookout was constructed in 1933 and had been rehabilitated in 2009. Susan DELBENE (WA) "Green Mountain Lookout, located in the Glacier Peak Wilderness, was built in 1933 as a Civilian Conservation Corps project to detect fires and spot enemy aircraft during World War II. The look-out is an important, historic and unique part of the Pacific Northwest. It is a popular destination for hikers, and it is listed on the National Register of Historic Places. Unfortunately, severe weather caused the Green Mountain Lookout to fall into disrepair in 2001, and the U.S. Forest Service began taking steps to preserve the historic…structure for future generations. How-ever, an out-of-State group filed a law-suit against the Forest Service for using machinery to conduct these repairs, and a U.S. District Court ordered the Forest Service to remove the look-out. My bill would allow critical and routine maintenance while keeping this iconic structure where it is meant to be—in its original home. Local governments in the area, my constituents, as well as a number of environmental and historic preservation groups support my bill to keep the Green Mountain Lookout where it is. The Natural Re-sources Committee agrees. They passed this bill unanimously last year, and why wouldn't they? This bill is common sense. It saves us money because it would actually cost more to remove the lookout than to keep it where it is. There is absolutely no doubt in my mind that, if this bill had been brought up on its own, by its own merits, it would have passed with overwhelming bipartisan support. Unfortunately, that is not what is happening here today. Instead, this bill has gotten wrapped up in a series of very controversial and divisive bills" Section 603: Green Mountain Lookout can't be moved except for safety reasons. TITLE VII: River Paddling in Yellowstone & Grand Teton Introduced by Rep. Cynthia Loomis (WY) Prohibits the enforcement of two regulations that all rivers to be closed to hand paddlers in Yellowstone and Grand Teton National Parks. Would take effect 3 years after the bill becomes law. Existing regulations prohibit boating on rivers and on five of Yellowstone's 168 lakes and a 1,000 foot section of the Snake River in Grand Teton National Park.  The ban was put in place sixty years ago to prevent overfishing. TITLE VIII: Longer permits and no environmental studies for grazing Introduced by Rep. Raul Labrador (ID) Section 802: Increases the term for new permits on Federal land from 10 to 20 years. Anyone who sues to stop grazing and lose in court will pay the legal fees and other expenses of the winner, unless the court rules otherwise. Section 803: An expired or transferred permit will remain in effect, under the original terms, until the government finishes processing a new permit or lease, which will be valid for twenty years. "The renewal, resistance, or transfer of a grazing permit or lease by the Secretary concerned shall be categorically excluded from the requirement to prepare an environmental assessment or environmental impact statement". Crossing and trail authorizations for livestock will be exempt from environmental regulations. Temporary crossing or trailing authorizations "shall not be subject to protest or appeal" TITLE IX: Sell Dead Wood from the Rim Fire Introduced by Rep. Tom McClintock (CA) TOM MCCLINTOCK (CA): The fire also left behind hundreds of millions of board feet of dead timber that is on Federal land that could be sold to raise millions of dollars, money that could then be used to replant and reforest our devastated lands. In addition, processing that timber would help to revive the economy of a stricken region. Section 902: Secretary of Agriculture "shall conduct a timber salvage and restoration pilot program. Automatically deemed to comply with NEPA, the Endangered Species Act, and three other forest management laws. Is not subject to "judicial review by any court of the United States." Specifically prohibits a temporary restraining order. The pilot program will be conducted according to an proposed alternative in a draft environmental impact statement. The "proposed alternative", which would govern the pilot program, has no details: "In addition to the Proposed Action, the EIS will evaluate the required No Action alternative and will likely consider other alternatives identified through the inderdisciplinary process and public participation." Sierra Pacific is already collecting fallen trees on private land A fascinating article in the Modesto Bee is in favor of opening some additional land to logging but is pissed at Tom McClintock for going so far and not trying to find a sensible compromise: "McClintock has called for immediate salvage logging of 1 billion board feet of timber. To understand the magnitude of what McClintock envisions, a billion board feet is equal to all the timber logged in California in a year. Much of it is in steep, remote areas. To get to it, loggers would need to cut roads and scale steep mountains, causing yet more erosion on slopes with no ability to stop runoff. The damage – environmental and to whatever is below – could be enormous. McClintock believes that such a massive operation should be exempt from federal environmental laws, public comment and court review. That is nonsensical. There is no scientific basis for the scale of removal that McClintock advocates. Besides, the logging industry doesn’t have enough trucks, crews, equipment and processing capacity for it. For instance, there are only 11 logging crews and 165 trucks working in the area of the Sierra hit by the fire, and they will be busy through the summer simply removing the timber from private lands. And even if more crews and trucks could be brought into the area, the mills would have no place to store that much timber. The congressman from Elk Grove ought to drop his ill-conceived idea and concentrate on helping the timber companies acquire the areas they target." Tom McClintock statement on Rim Fire timber TITLE X: Chesapeake Bay Orders a report on past and future restoration funding levels for activities over $100,000. Develop a restoration plan that will be updated every two years .Create an independent evaluator for the restoration programs. TITLE XI: Issues a patent for 80 acres of Alaska land for surface rights United States keeps all mineral rights. Additional Information The government recently seized the cows of Cliven Bundy, a rancher in Nevada who has refused to pay his grazing permitting fees for over 20 years, which lead to armed standoff between Federal agents and 100 man hillbilly militia. This started in 1993 when the Federal government revoked Bundy's permit for grazing on 600,000 acres of federal land for lack of payment. In 1998, a Las Vegas federal judge ordered Bundy to remove his cows from our land. He has refused.  Since then, Bundy has racked up a bill of over $1 million in unpaid fees and has refused to move his cows onto his own land. Bundy says he doesn't have to pay because he no longer has a contract with the Federal government, as it was revoked in 1993. Bundy also says that the land in dispute belongs to Nevada, not the Federal government. The Bureau of Land Management removed his cows from the Federal land - impounding them instead of putting them on Bundy's undisputed land - and Bundy and his hillbilly supported showed up pissed off with guns. The BLM last week backed down.
