Y'all have either read or watched the Wheel of Time series, by Robert Jordan/Brandon Sanderson, right (I highly recommend the books, but I understand if reading 15,000 pages of description isn't your thing. The show started out ok, and it has grown on me, you should give it another try)? You know how the Children of the Light, the paramilitary group informally known as the Whitecloaks. They have an embedded group dedicated to rooting out the darkness. That group is called the Questioners and they are loosely modeled after the Spanish Inquisition that was created by Ferdinand II of Aragon and Isabella I of Castile in the year of our lord (As Tiler would say) 1478. The Questioners do just that; put people to the question, and through various methods extract a confession out the subject of their ire. Most of the time their confessions are from the innocent who are simply trying to end the torture. I never understood how can the Whitecloaks even do this when their ranks are filled with Darkfriends. It's a shameful organization considering how easily they were infiltrated, and how quickly their hypocrisy was found out. Yet they do play an important role in the story, even if the the whole Two Rivers arc was drawn out over three books. The one thing Whitecloaks do is put people to the question. The Phantom Phinders do the same in this episode. #0175 Articles of Confederation, An End To The Ukraine War?, Vance vs The Pope on Ordo Amori, The First Female Congresswoman, TBC: The Great Divorce, and Apologetics 101 - Further. Every. Day. The Articles of Confederation – A Failed Democracy Of States Cut 1#: Introduction: The Articles of Confederation, ratified in 1781, served as the first governing document of the United States. However, it soon proved inadequate, leading to widespread calls for reform. The Founding Fathers—especially George Washington, James Madison, and Alexander Hamilton—expressed serious concerns about its weaknesses. Many of these concerns were articulated in their letters, speeches, and debates, culminating in the drafting of the U.S. Constitution in 1787. Key Weaknesses and Contemporary Critiques 1. Lack of Taxation Authority One of the most significant weaknesses of the Articles was Congress's inability to levy taxes. The federal government had to rely on voluntary contributions from the states, leading to financial instability and an inability to pay off war debts. Cut 2#: James Madison, “Vices of the Political System” (April 1787):"It is no longer doubted that a unanimous and punctual obedience of 13 independent bodies, to the acts of the federal Government, ought not be calculated on. Even during the war, when external danger supplied in some degree the defect of legal & coercive sanctions, how imperfectly did the States fulfil their obligations to the Union? In time of peace, we see already what is to be expected." Cut 3&4#: Alexander Hamilton, Federalist No. 30 (December 28, 1787):"The present Confederation, feeble as it is intended to repose in the United States, an unlimited power of providing for the pecuniary wants of the Union. But proceeding upon an erroneous principle, it has been done in such a manner as entirely to have frustrated the intention. Congress, by the articles which compose that compact (as has already been stated), are authorized to ascertain and call for any sums of money necessary, in their judgment, to the service of the United States; and their requisitions, if conformable to the rule of apportionment, are in every constitutional sense obligatory upon the States. These have no right to question the propriety of the demand; no discretion beyond that of devising the ways and means of furnishing the sums demanded. But though this be strictly and truly the case; though the assumption of such a right would be an infringement of the articles of Union; though it may seldom or never have been avowedly claimed, yet in practice it has been constantly exercised, and would continue to be so, as long as the revenues of the Confederacy should remain dependent on the intermediate agency of its members." Cut 5#: George Washington's letter to John Jay (August 15, 1786):"Requisitions are actually little better than a jest and a bye word throughout the Land. If you tell the Legislatures they have violated the treaty of peace and invaded the prerogatives of the confederacy they will laugh in your face." Comparison to the Constitution: Articles of Confederation: Congress could not impose taxes and had to request funds from the states. U.S. Constitution (Article I, Section 8): Congress gains the power to “lay and collect taxes, duties, imposts, and excises.” 2. No Executive or Judicial Branches Under the Articles, there was no executive branch to enforce laws and no national judiciary to settle disputes, leading to inefficiency and legal conflicts among states. Cut 6#: James Madison at the Constitutional Convention (June 19, 1787):"The existing Confederacy does not sufficiently provide against this evil. The proposed amendment to it does not supply the omission. It leaves the will of the States as uncontrolled as ever." Cut 7#: Alexander Hamilton, Federalist NO. 22 (December 14, 1787):"Several States have endeavored, by separate prohibitions, restrictions, and exclusions, to influence the conduct of that kingdom in this particular, but the want of concert, arising from the want of a general authority and from clashing and dissimilar views in the State, has hitherto frustrated every experiment of the kind, and will continue to do so as long as the same obstacles to a uniformity of measures continue to exist." And later in Fed 22: Cut 8#: “A circumstance which crowns the defects of the Confederation remains yet to be mentioned, the want of a judiciary power. Laws are a dead letter without courts to expound and define their true meaning and operation. The treaties of the United States, to have any force at all, must be considered as part of the law of the land. Their true import, as far as respects individuals, must, like all other laws, be ascertained by judicial determinations. To produce uniformity in these determinations, they ought to be submitted, in the last resort, to one SUPREME TRIBUNAL. And this tribunal ought to be instituted under the same authority which forms the treaties themselves. These ingredients are both indispensable.” Comparison to the Constitution: Articles of Confederation: No executive or judiciary, making enforcement and dispute resolution nearly impossible. U.S. Constitution: Establishes three co-equal branches with checks and balances. 3. Inability to Regulate Commerce With no power to regulate trade, states imposed tariffs on each other, creating economic discord and weakening national unity. Cut 9#: George Washington's letter to James Madison (November 30, 1785):"I hope the resolutions which were published for the consideration of the House, respecting the reference to Congress for the regulation of a Commercial system will have passed. The proposition in my opinion is so self evident that I confess I am at a loss to discover wherein lyes the weight of the objection to the measure. We are either a United people, or we are not. If the former, let us, in all matters of general concern act as a nation, which have national objects to promote, and a National character to support—If we are not, let us no longer act a farce by pretending to it. for whilst we are playing a dble game, or playing a game between the two we never shall be consistent or respectable—but may be the dupes of some powers and, most assuredly, the contempt of all." Comparison to the Constitution: Articles of Confederation: No power to regulate interstate or international trade. U.S. Constitution (Article I, Section 8): Grants Congress the power to “regulate commerce with foreign nations, and among the several states.” Constitutional Convention Debates on the Articles The Constitutional Convention of 1787 was largely a response to the Articles' failings. Many Founders voiced concerns about its weaknesses and emphasized the necessity of a new framework. Cut 10#: George Washington's Address at the Constitutional Convention (1787):"It is too probable that no plan we propose will be adopted. Perhaps another dreadful conflict is to be sustained. If to please the people, we offer what we ourselves disapprove, how can we afterwards defend our work? Let us raise a standard to which the wise and the honest can repair. The event is in the hand of God." Cut 11#: James Madison at the Convention (June 6, 1787):"The confederation was founded on temporary principles. It cannot last: it cannot be amended. If we do not establish a good Govt. on new principles, we must either go to ruin, or have the work to do over again. The people at large are wrongly suspected of being averse to a Genl. Govt. The aversion lies among interested men who possess their confidence." Conclusion: The Articles' Failure & The Constitution's Success The weaknesses of the Articles of Confederation were widely recognized by the Founders, who sought a stronger federal government through the U.S. Constitution. By granting the national government taxation authority, an executive branch, a judiciary, and regulatory power over commerce, the new Constitution directly addressed the Articles' failings. Cut 12#: Benjamin Franklin on the new Constitution (1787):"Thus I consent, Sir, to this Constitution because I expect no better, and because I am not sure, that it is not the best." How does the Vatican deal with threats against his excellency?Cut 32# Oh… Cut 33# Nicki Knows Facts: The First Congresswoman Cut 34#-37 The Book Corner: The Great Divorce Foreword-Chapter 2 Foreword C.S. Lewis explains that The Great Divorce is an allegory, not a theological treatise, and should not be taken as a literal depiction of the afterlife. He argues against the idea that good and evil can be reconciled, emphasizing that one must fully choose either Heaven or Hell—there is no blending of the two. He also mentions his inspiration from William Blake's The Marriage of Heaven and Hell but clarifies that his book is meant to show their absolute separation rather than their unity. Chapter 1 The narrator finds himself in a grim, joyless city (Hell or “the Grey Town”) on a rainy evening. He joins a line for a bus that promises to take people away from the city. As he waits, he observes the other passengers arguing, bickering, and expressing general dissatisfaction. These people, it seems, are unhappy but reluctant to leave, preferring their own grievances and pride over change. When the bus arrives, it appears unusual—bright and floating above the ground. Chapter 2 As the bus takes off, it begins to ascend, moving higher and higher into the sky. The narrator notices that the interior of the bus seems to grow larger than its exterior, a hint at the supernatural nature of the journey. The other passengers continue arguing, revealing their selfishness, resentment, and attachment to their past sins. Some complain about the rules of the Grey Town, while others insist they deserve better treatment. The chapter ends with the bus flying toward an unfamiliar, beautifully radiant land, which we later understand to be the foothills of Heaven. Apologetics 101 The 3 Rules of Apologetics 1. Define Terms 2. Answer the Questioner, not the Question 3. Remember who wins the person's soul, hint it's not you. Bill Kanasky, Jr., Ph.D. talks about witness preparation and the benefits of using an alternate questioner during mock questioning. Bill shares details on how the CSI witness training program works by building a foundation based on psychology. The first phase of the training is educational and focuses on cognition, behavior, and emotion and how the brain operates in its natural state and how we need it to work during testimony. Once the psychological foundation is built, then strategy can take place, which is the second phase of the training. Bill talks about the benefits of recruiting another attorney to roleplay plaintiff's counsel during the mock questioning portion of the witness training. Bill also shares ideas about how to leverage exposure theory and operant conditioning to help guide the witness during their mock questioning and how this is easier to do if you have an alternate questioner. Lastly, Bill suggests that including younger associates or early career attorneys in the witness preparation process is good practice for them, discusses how you know if your witness is ready for their testimony, and how to handle schedule changes with depositions. [33:57] When you ruminate about the past, that generally promotes depression and ruminating about the future, generally promotes anxiety. [37:08] Dr. Brandeis contends that 95% of erectile dysfunction problems are psychological. There is nothing wrong with the plumbing. [40:51] Jake Steiner is an expert on vision is challenging some of the foundational premises of using corrective eyewear. [42:47] William Shewfelt talks about having a plan, locking in that mindset and just never giving up. [44:26] Jeff Kahn, sleep expert suggests that you treat your sleep like a bank account. When you experience a deficit for whatever reason, strive to make that up. Gretchen Rubin is one of today's most influential and thought-provoking observers of happiness and human nature. We discuss happiness at length in today's conversation, but we also discuss frameworks, and I think you're going to find right off the bat that Gretchen sees things in terms of frameworks, in terms of theory. But she's also known for her ability to convey complex ideas from science, to literature, to stories from her own life, with levity and clarity. So, we bring her into this conversation and we actually bring myself in to today's conversation, and I think that will make it really come to life. She's a writer, and she's going to articulate how much she loves writing and how big of an impact writing has made on her life and how she sees the world. She's the author of many bestselling books, such as The Happiness Project, Better than Before, and The Four Tendencies, which has sold millions of copies in more than 30 languages. Her most recent book, which we reference in today's conversation, is Life in 5 Senses. She's also the host of the popular podcast Happier with Gretchen Rubin and the founder of the award-winning “Happier” app, which helps people track their happiness-boosting habits. She's been interviewed by Oprah, she's spent time with Daniel Kahneman, she's walked arm-in-arm with the Dalai Lama, and her work has been reported on in a medical journal (which eventually got written up in The New Yorker). So, she's been in all kinds of interesting spaces; she's also been an answer on Jeopardy, which is a claim to fame for her. I think this conversation will give you a sense of yourself, which is what I really appreciate about it; it'll make you think about yourself and hopefully make you a little more aware of how you show up for you and for others. Gretchen had a number of amazing insights during our conversation. Some of them include: “If we want to make our lives happier, healthier, more productive, more creative, one of the things we need to figure out is how to make habits” (6:00). “Depending on whether we meet or resist outer and inner expectations, that's what makes us an upholder, a questioner, an obliger, or a rebel” (7:50). “Upholders are people who readily meet both outer and inner expectations” (8:00). “Questioners question all expectations; they'll do something if they think it makes sense” (10:25). “Obliger is the biggest tendency, for both men and women” (16:00). “Obligers are people who readily meet outer accountability, but they struggle to meet inner accountability” (16:10). “If you want to meet an inner expectation as an obliger, you need to create a system of outer accountability” (16:25). “The way to keep a promise to yourself is to make a promise to someone else” (16:55). “Rebels resist all expectations, outer and inner alike” (17:35). “From the practical comes the transcendent” (19:55). “My behavior follows from my identity” (22:10). “Allow rebel children to face the consequences of their actions; that is how a rebel learns” (23:20). “Sometimes these little adjustments in communication can have massive consequences in behavior” (25:05). “Once you understand the mechanism of what's going on, it's a lot easier to address it” (28:10). “For many people, there's a sense that they kind of neglect” (30:50). “Whatever you want to achieve in your life, even if they're contradictory, the five senses can help you” (35:50). “I really get tremendous satisfaction out of just being able to explore ideas in all these different ways and exercise my creativity in a lot of different ways” (40:40). “We want to accept ourselves and also expect more from ourselves” (44:25). “I think the word motivation is very complicated” (46:25). “You can't expect to be motivated by motivation” (47:30). “I never define happiness” (1:04:45). “We all can decide for ourselves what it means to be happy” (1:05:00). “Negative emotions have a very important part to play” (1:06:05). “If you get interested in something, really try to become a minor expert” (1:15:30). “The more you know, the more questions you have” (1:16:05). She also wrote Better than Before to help us discover why some people can form habits more easily than others.How do we change? Habits are the invisible architecture of our lives. 40% of our daily behaviors are repeated, why not harness this information to gain self-knowledge that will help us adopt habits successfully? 41% of the population are Obligers. “You can count on me and I'm counting on you to count on me.” They are motivated by external expectations and struggle with inner expectations and with saying no. 24% of the people fall into the Questioner category. “I will comply if you convince me why.” They are motivated by clarity, reason, logic and fairness. They can have bouts of analysis paralysis. 19% of folks are Upholders. These are the people that respond readily to inner and outer expectations. Discipline is their freedom. 17% fall into the Rebel category. “You can't make me, and neither can I.” This group places a high value on authenticity and acts best when you give them the information and let them make a choice. It is possible to do! We had a coaching call with Emily Edlynn 100 episodes ago and I wanted to re-up it because her book is out. She did it! She completed the task. She knew the assignment. Her book, Autonomy-Supportive Parenting, came out at the end of 2023. So I'm very proud to replay this episode and let you know that the P.S. on that episode was success! I hope you enjoy it.And WAY TO GO, Emily!Our guest on this episode has a problem—a good problem, yes. An enviable problem even. One that she herself is delighted to have: she's sold a non-fiction book on proposal.And now she has to write it. 60,000 words, researched, organized and ready for the editor while also fitting in her day job, raising 3 kids with her partner and all of the other curveballs life likes to throw you.In this “coaching call” episode, Jess and I (it's KJ writing, as it often is) help long-time listener Emily Edlynn figure out how much time to spend in what areas: book structure, research, interviewing, drafting, editing—and then how to set yourself up to allow for getting a major project like this completed on time. (We all know how KJ loves a good burn chart - check out episode 175: #HowtoUseaBurnChart). We talk about motivating yourself, strategies for staying on track or picking back up after the unexpected happens. (You can read Emily's email to us at the bottom of the shownotes.)Most of us spend more time working on short term projects than longer ones, and when we do get involved with something that stretches out for months or years, it's usually with other people and external deadlines, whether it's a major work endeavor, a house remodel or a Ph.D. dissertation. Books—even books with agents and editors—require major solo mojo to get from start to The End—and then revise the result of that. It's yet another of the many many things that aren't easy about writing.But it can be learned, and it can be done.Emily doesn't have any trouble using the time she has to write—but if you do, here are some ideas based on Gretchen Rubin's Four Tendencies, which are all about knowing how you best meet inner and outer obligations (of which writing a book is weirdly both). Obligors need outer accountability. Set yourself up with a friend or your agent, give them your goals and arrange weekly check-ins. Questioners need reasons, so make that burn chart and put up a full calendar where you can see it and always have an answer for “but do I really need to do this now?” Upholders probably need nothing more than a plan—but make sure your inner upholder understands that this is a priority. Rebels benefit from regular reminders that this is hard, that most people can't do it and that achieving this goal is a rebellion against everything that stands in its way—and many also like a plan that involves beating the clock. Anything that lets a rebel say “I'll show you!” is rebel jet fuel.Gretchen appeared on Episode 107 of the podcast, and you can take her “Four Tendencies” quiz here.Emily's email: I am a psychologist by training who started writing for an audience in 2017 when my career hit a crossroads with a move for my husband's job. My parenting blog led to writing freelance when possible, including a weekly parenting column for Parents since 2019. In April, I signed a contract with a small, independent publisher, Familius, to write a parenting book.The full manuscript is due May 1. I have never felt so lost! I thought there would be more editor interaction over the year, but she basically said "See you in a year unless you need me!" (I have asked more from her, but have realized she is going to give me broad strokes and not much else.) I have scoured all the places for resources on "how to write a nonfiction book" but besides some of your episodes, what I find is either about self-publishing or marketing, not the process of writing a nonfiction book (that's not a memoir).I'm trying to narrow this down to one question, which probably can't be "how do I write a nonfiction book in a year with no structure, in the time I have?" For context, I spend half my working week doing therapy in a private practice and supervising graduate students. I'm also writing a new blog post once a month to keep my newsletter subscribers engaged, and my weekly column. Oh, and did I mention attempting to raise 3 children in the process? I currently clock about 8 hours a week of writing time . . . and then I read relevant books when I can almost daily. I did find a virtual writing group with two other psychologist authors, which has been helpful. Whether it's eating healthier, getting exercise, starting a meditation practice or staying socially connected, figuring out what to do to be happy might be simple – but actually doing these things and living in a way that lets us experience happiness is much harder. When we know there are things we can do that will make us healthier and happier, why do we struggle to actually do them? Why do we get caught in a cycle of chasing happiness instead of choosing joy, even when we know better? This is what Gretchen Rubin wanted to understand when she began studying happiness and why people form the habits they do. It turns out that it has everything to do with how we relate to expectations. Gretchen discovered that there are four different “tendencies” that tell us how different people approach habits and expectations – whether we question expectations, comply with expectations, rebel against expectations or uphold them from within. We are born with our tendency and there's no right or wrong way to be, but our ability to pursue happiness and form habits is directly connected to which tendency we're wired with. In this episode, Gretchen describes each of the four tendencies in detail and ways to work with your type to go after the life you want. She also talks about habit formation and the different approaches to starting a new habit, so you can figure out which one works best for you!
