In today's episode, we explore part 2 of the 3 part series on animals. Animals are a white hot subject for landlords, and let's explore the non-pet animals in a tenant's life. Namely, the differences between service animals, emotional support animals, why they are different and what a landlord can (and can't) do regarding these non-pets.
If you're from a country that doesn't have emotional support animals, here's how it works. Sometimes places ban or restrict animals. For example, an apartment building might not allow dogs. Or an airline might charge you money to transport your cat. But the law requires them to allow service animals, for example guide dogs for the blind. A newer law also requires some of these places to allow emotional support animals, ie animals that help people with mental health problems like depression or anxiety. So for example, if you're depressed, but having your dog nearby makes you feel better, then a landlord has to let you keep your dog in the apartment. Or if you're anxious, but petting your cat calms you down, then an airline has to take your cat free of charge. Clinically and scientifically, this is great. Many studies show that pets help people with mental health problems. Depressed people really do benefit from a dog who loves them. Anxious people really do feel calmer when they hold a cute kitten. Send us a Text Message.When it comes to rental properties and animals, there are a lot of things to consider. You (for now) have the right to refuse pets, but you do not have the right to ever refuse a service animal.We will say that, for the most part, we do not allow pets in our units. So, when an applicant or an existing tenant comes to us with a request for a service animal, we are not thrilled to say the least. And we are not concerned with service animals in the traditional sense, you know, the ones who guide the visually impaired or the ones who walk alongside someone in a wheelchair and help open doors and pick dropped items off the ground. Those animals are very highly trained and are certified and registered assistant animals.Today we are discussing ESA's or emotional service animals that now have rights through the Department of Housing and Urban Development under Federal Fair Housing laws. In many cases (not all), these ESA's are glorified pets. There is no training, there is no certification. The doctors who authorize these pets very rarely even meet the pet to see how it interacts with the patient and observe if it is a good fit.When it comes to these service animals in rental properties, there are many questions that come to mind like, will it damage our units? And then, if it's a dog, will it cause a commotion and disturb the other tenants? What are WE going to have to do to make this accommodation request amicable? Do we have any rights in the matter of allowing these service animals?These are all things and so much more that we are discussing in our episode today. Are too many people abusing laws that allow service animals to accompany the legitimately disabled? Michael Regilio walks us through this Skeptical Sunday! On This Week's Skeptical Sunday, We Discuss: If you've noticed a proliferation of people threatening legal repurcussions if they aren't allowed to go absolutely everywhere with their emotional support animals, you're not alone. They're just hoping you don't know the difference between emotional support animals and service animals. Service animals are trained to perform specific tasks for people with disabilities and are legally protected by the Americans with Disabilities Act (ADA), while emotional support animals provide comfort to their owners but do not have the same level of training — and are not covered by the ADA. There are some legal allowances for emotional support animals, but they vary depending on the state. Those who abuse the system by insisting their emotional support animals be allowed to accompany them everywhere undermine people who legitimately rely on their service animals to get around. It's important to understand the difference between these two types of animals so we can provide appropriate care and support to both animals and their handlers (and call out the fakers who ruin it for everyone).
