I was at the Liberalism for the 21st Century conference last week in DC where I bumped into an old friend and KEEN ON regular Jonathan Rauch. A Brookings Fellow and prolific author, Rauch is amongst America's most thoughtful commentators on the contemporary crisis of liberalism and the rising popularity of “post-liberalism”. So, in the wake of Trump's choice of JD Vance, a politician who has openly embraced the “post-liberal” moniker, I caught up with Rauch to get his take on a liberalism for the 21st century. Does John Stuart Mill's classic 19th century theory of individual rights need to be reinvented for our networked age, I asked. And does the West need a revitalized international liberal consensus to confront not just China, but rogue states like Iran, North Korea and Russia.JONATHAN RAUCH, a senior fellow at the Brookings Institution in Washington, is the author of eight books and many articles on public policy, culture, and government. He is a contributing writer for The Atlantic and recipient of the 2005 National Magazine Award, the magazine industry's equivalent of the Pulitzer Prize. His latest book, published in 2021 by the Brookings Press, is The Constitution of Knowledge: A Defense of Truth, a spirited and deep-diving account of how to push back against disinformation, canceling, and other new threats to our fact-based epistemic order. In 2018, he published The Happiness Curve: Why Life Gets Better After 50, a lauded account of the surprising relationship between aging and happiness. Other books include Denial: My 25 Years Without a Soul, a memoir of his struggle with his sexuality, and Gay Marriage: Why It Is Good for Gays, Good for Straights, and Good for America, published in 2004 by Times Books (Henry Holt). His most recent ebook is Political Realism: How Hacks, Machines, Big Money, and Back-Room Deals Can Strengthen American Democracy (Brookings, 2015). Although much of his writing has been on public policy, he has also written on topics as widely varied as adultery, agriculture, economics, gay marriage, height discrimination, biological rhythms, number inflation, and animal rights. His multiple-award-winning column, “Social Studies,” appeared from 1998 to 2010 in National Journal. Among the many other publications for which he has written are The New Republic, The Economist, Reason, Harper's, Fortune, Reader's Digest, Time, The New York Times, The New York Daily News, The Wall Street Journal, The Washington Post, The Los Angeles Times, The New York Post, Slate, The Chronicle of Higher Education, The Public Interest, National Affairs, The Advocate, The Daily, and others. In his 1994 book Demosclerosis—revised and republished in 2000 as Government's End: Why Washington Stopped Working—he argues that America's government is becoming gradually less flexible and effective with time, and suggests ways to treat the malady. His 1993 book Kindly Inquisitors: The New Attacks on Free Thought (published by the University of Chicago Press; expanded in 2013) defends free speech and robust criticism, even when it is racist or sexist and even when it hurts. In 1992 his book The Outnation: A Search for the Soul of Japan questioned the then-conventional wisdom that Japan was fundamentally different from the West. In 1996, with Robert Litan, he also co-authored a report for the U.S. Treasury Department on the future of the financial-services industry (American Finance for the 21st Century). In 1995 he spent a year as a visiting writer for The Economist magazine in London, and in 1997 he returned as guest editor of the Christmas special issue. Rauch was born and raised in Phoenix, Arizona, and graduated in 1982 from Yale University. He went on to become a reporter for the Winston-Salem Journal in North Carolina before moving to Washington in 1984. From 1984-89 he covered fiscal and economic policy for National Journal. In 1990 he spent six months in Japan as a fellow of the Japan Society Leadership Program. In addition to the National Magazine Award, his honors include the 2010 National Headliner Award, one of the industry's most venerable prizes. In 1996 he was awarded the Premio Napoli alla Stampa Estera for his coverage, in The Economist, of the European Parliament. In 2011 he won the National Lesbian and Gay Journalists Association prize for excellence in opinion writing. He has also won two second-place prizes (2000 and 2001) in the National Headliner Awards. His articles appear in The Best Magazine Writing 2005 and The Best American Science and Nature Writing 2004 and 2007. He has appeared as a guest on many television and radio programs. On November 2, 1984, fifty-two-year-old Velma Barfield was executed by lethal injection at North Carolina's Central Prison, bringing an end to years of legal appeals and emotional debates over the death penalty and how, when, and to whom it gets applied. For six years, Barfield had sat on death row following her conviction for the poisoning murder of her boyfriend Stewart Taylor in 1976; however, during her trial she confessed to killing at least four other people.Velma Barfield's trial came at a time in the United States when Americans were just beginning to grapple with the concept of a serial killer, and the idea that a woman could commit such heinous acts seemed entirely inconceivable. Although woman had been sentenced to death for murder before in the US, none had confessed to methodically killing multiple people in such a callous way and for such a trivial reason. Then Peter Lurie, President of the Center for Science in the Public Interest (CSPI) joins us to talk about CSPI's work advocating for a safer, healthier food system, as well as their newsletter "NutritionAction." Plus, Ralph questions why the US still hasn't ratified the UN's Convention on the Rights of the Child— everyone else has done it!Steve McNamara is a newspaper publisher, editor, and reporter. He has previously written for and edited the Winston-Salem Journal, The Miami Herald, Car and Driver magazine, and the San Francisco Examiner. From 1966 to 2004 Steve and his wife, Kay McNamara, published the Pacific Sun—the country's second-oldest alternative weekly newspaper— and Steve has served as president of the California Society of Newspaper Editors and as founding president of the National Association of Alternative Media. In 2008 he helped revive the San Quentin News— a newspaper written and edited by incarcerated men at San Quentin Prison— and continues to work as a volunteer adviser at the paper. The recidivism rate among the inmates is zero… And actually, the problem that we have is the turnover is terrific because they keep getting paroled or serving their sentence. Steve McNamara, San Quentin NewsPrisons are little empires and the emperor is the warden, and what he decides goes. And many, if not most of the other wardens in California wanted no part of this damn newspaper. So we had a lot of trouble getting it distributed. But by now it's become very popular with the inmates throughout the state, and with many of the correctional officers as well. Because we've made some intelligent decisions. One was to write the personality profiles of some of the better correctional officers and of the programs that take place in the prison.Steve McNamara, San Quentin NewsMost people in the criminal justice system think that it goes this way: somebody breaks into a house, and then they get caught, and they go before a judge, and they get sentenced, and they disappear. And as far as many, many people in the criminal justice system are concerned, that's the end of it. These people have disappeared. We don't need to worry about them any more. But as everybody should know, 80-90% of them will be back on the streets…So do you want these guys to have the same sort of attitude about life as they did when they went into prison? If not, here's a chance maybe to move things in a better direction.Steve McNamara, San Quentin NewsI've credited the Center for Science in the Public Interest with transforming the nutritional habits of perhaps 40 million people. It generated front page news, it was on the evening television news, Congressional hearings. Recently, and this has happened to a lot of citizen groups, the media has not been covering what we're doing.Ralph NaderDr. Peter Lurie is President and Executive Director of the Center for Science in the Public Interest—an independent, science-based consumer advocacy organization that advocates for a safer, healthier food system. The CSPI also publishes NutritionAction, a healthy-living guide for consumers. Dr. Lurie previously worked with the Food and Drug Administration and Public Citizen's Health Research Group, where he co-authored their Worst Pills, Best Pills consumer guide to medications.We at CSPI try to educate consumers on the one hand. And on the other hand, we try to take care of the environment such that consumers in some ways don't even need to be as educated because the environment is different.Peter Lurie, President of Center for Science in the Public InterestI think that most people—including in all likelihood the Current Commissioner— understand that the food program within FDA has been the sort of “poor stepchild” of  the agency. People have focused more on drugs, they've focused more on medical devices, vaccines, even more recently on tobacco. And so food has been relatively neglected. Late last week, the National Labor Relations Board issued a decision in the Cemex Construction Materials case, establishing a “new framework” that “when a union requests recognition on the basis that a majority of employees in an appropriate bargaining unit have designated the union as their representative, an employer must either recognize and bargain with the union or promptly file a... petition seeking an election.” Crucially though, this ruling also establishes that “if an employer who seeks an election commits any unfair labor practice that would require setting aside the election, the petition will be dismissed, and—rather than re-running the election—the Board will order the employer to recognize and bargain with the union.” This stunning decision is among the most important revisions to labor rules in decades and will apply retroactively.2. On a hot streak, Bloomberg Law reports that the NLRB also decided last week that Quickway Transportation “must reopen a terminal in Louisville, [Kentucky], that the company illegally shut down in 2020 after drivers there formed a union.” This sets a powerful new precedent for recourse against companies that have used the tactic of shutting down locations in order to stave off unionization – most notably Starbucks.3. The American Prospect reports that in Georgia, Governor Brian Kemp has aggressively courted EV manufacturers using Inflation Reduction Act tax incentives. Yet, Governor Kemp has awarded these “lucrative contracts for building out the factories to non-union construction firms.” These firms also happen to be major donors to Georgia Republicans, including Kemp himself, who formerly owned a non-union construction company. 4. Mondoweiss has published a new report on the founding of the Institute for the Critical Study of Zionism. This Institute “aims to support the delinking of the study of Zionism from Jewish Studies, and to reclaim academia and public discourse for the study of Zionism as a political, ideological, and racial and gendered knowledge project, intersecting with Palestine and decolonial studies, critical terrorism studies, settler colonial studies, and related scholarship and activism.”6. NBC News reports that a group of nearly 90 Democratic members of Congress sent a letter to President Biden last week calling on him to take further action to address the student debt crisis. These members ended the letter by writing “We urge you to continually find ways to use your authority to bring down student debt, address the rising cost of college, and make postsecondary education affordable for all students who choose that path. Borrowers have already waited nearly a year for the relief you announced in August 2022, and critics of your plan to help 43 million Americans are likely to renew their attacks with regard to your rulemaking announcement. We urge you to reject their bad-faith, partisan attempts to delay relief and carry out your efforts to help borrowers as quickly as possible.”7. According to the Baltimore Banner, Charm City may soon be facing its own version of the Cop City fight. Per the report, Baltimore officials are planning to construct a “tactical village” which will be used to train police. There are some differences between the projects however: whereas Atlanta's Cop City is slated to be built upon a razed section of forest, Baltimore's tactical village is proposed to be built on the campus of Coppin State University, a historically Black institution. Another key difference, while Cop City is estimated to cost $90 million, the tactical village is estimated at a whopping $330 million. The city has proposed a new “public safety income tax” to fund the project.8. The Washington Post has published a profile of Sarah Feinberg, an employee at the defense contractor Booz Allen Hamilton who blew the whistle on rampant over-billing of the government by the company. In July, Booz Allen agreed to pay $377 million to settle the case. Perhaps the most shocking portion of her complaint was when “a senior manager…called federal auditors “too stupid” to notice overcharging.”9. WTOP reports the fast-casual chain Chipotle has agreed to pay over $300,000 in a settlement with the District of Columbia regarding the company's alleged violations of child labor law. DC Attorney General Brian Schwalb's office identified more than 800 alleged violations in the District, including “requiring minors to work past 10 p.m., working more than eight hours a day, working more than six consecutive days, or working more than 48 hours in one workweek.” The settlement does not require Chipotle to admit wrongdoing.10. The Context of White Supremacy Welcomes Phoebe Zerwick. Classified as a White Woman, Zerwick “is an award-winning investigative journalist, narrative writer, and college professor. Her writing has appeared in O, The Oprah Magazine; National Geographic; The Nation; the Winston-Salem Journal; and Glamour, among other publications.” She learned about the conviction of privileged black male Darryl Hunt when she moved to “The Tar Heel State” to launch her journalism career. Over decades, she got to know the case and Mr. Hunt's turmoil well enough to pen a book, Beyond Innocence: The Life Sentence of Darryl Hunt. The case if tragically familiar: black male accused of raping and killing a White Woman, Deborah Sykes. To make things worse, Hunt was engaged in consensual sexual activity with an underaged White Woman at the time of Sykes murder. Zerwick briefly compares Hunt's case to the murder trial of O.J. Simpson, but can only note the racial divide caused by the hearings. The similarities and connections between these two cases are so enormous, Gus can only process this as an egregious error or a willful (perhaps, Racist) omission. The late Johnnie L. Cochran Jr. and F. Lee Bailey made a pilgrimage to Winston, Salem, North Caroline in the middle of the “trial of the century” in to secure “the Fuhrman Tapes.” These recordings captured a White enforcement official bragging about fabricating evidence to convict niggras. Fuhrman had particular sadistic rage for black males involved with White Women - like “The Juice” and Mr. Darryl Hunt. Unlike the Simpson case, Hunt spent many years in prison before police misconduct was revealed. Original Air Date: March 13, 2022 In the early morning of August 10, 1984, Deborah Sykes, a 25-year-old copy editor at a local newspaper in Winston-Salem, North Carolina, was sexually assaulted and stabbed to death. Without any evidence, Darryl Hunt, a 19-year-old Black man, was implicated and convicted for Sykes murder. Although DNA evidence was found to exonerate him in 1994, he spent another 10 years in prison. The case is the subject of the 2007 HBO documentary "The Trials of Darryl Hunt."   After Hunt was finally exonerated in 2004, he started a nonprofit called the Darryl Hunt Project for Freedom and Justice which helped provide resources to individuals recently released from prison and advocated for criminal justice reform. On March 13, 2016, Hunt tragically killed himself. To commemorate his death six years ago, we take a long look at the grave injustices in his wrongful conviction with award-winning investigative journalist, narrative writer, and college professor Phoebe Zerwick. She wrote an eight-part series for the Winston-Salem Journal in 2003 that led in part to Hunt's exoneration, and she is the author of Beyond Innocence: The Life Sentence of Darryl Hunt, in which she spent years investigating and covering Hunt's case.  Cover of "Beyond Innocence: The Life Sentence of Darryl Hunt" (Amazon) We also speak with Suzy Salamy, the director of social work at the Innocence Project, about some of the mental health impacts of wrongful conviction and the trauma caused by racial discrimination and biases in the criminal justice system.

MLB – Major League Baseball Yesterday Detroit Tigers 12, San Diego Padres 4 Chicago Cubs 3, Pittsburgh Pirates 2 White Sox were off Tigers 12, Padres 4 – Tigers pound Manaea, Padres for 12-4 win; SD’s Gore injured Eric Haase hit a grand slam off Sean Manaea, Jeimer Candelario homered twice and the Detroit Tigers routed the San Diego Padres 12-4. Miguel Cabrera hit his 506th career homer in the sixth inning and moved past Al Simmons for 13th on the career RBI list with 1,840. Manaea was pummeled for a career-worst nine runs in 3 1/3 innings, and his replacement, promising young left-hander MacKenzie Gore, was pulled with an apparent arm injury. Gore, ranked among the game’s top pitching prospects before debuting this season, got four outs despite an average fastball velocity 2 mph slower than normal. Cubs 3, Pirates 2 – Nico Hoerner’s double sends streaking Cubs past Pirates 3-2 Nico Hoerner hit a tiebreaking double in the eighth inning, and the Chicago Cubs beat the Pittsburgh Pirates 3-2 for their fifth straight win. Hoerner finished with two hits and two RBIs. Rafael Ortega homered for Chicago, and Adrian Sampson pitched seven innings of two-run ball. Seiya Suzuki set up Hoerner’s clutch hit when he reached on rookie shortstop Oneil Cruz’s throwing error. Suzuki advanced on Ian Happ’s groundout and then hustled home on Hoerner’s drive into the gap in right-center. Mychal Givens worked the eighth for the win, and Scott Effross got three outs for his first save. The union announced its decision about eight hours before Monday’s midnight EDT deadline for an agreement that was set in the March 10 lockout settlement. MLB – Senators give Manfred until Friday to respond on minors A group of U.S. senators has given baseball Commissioner Rob Manfred until Friday to respond to questions about the sport’s antitrust exemption and minor leaguers. The senators had made the request to Manfred on July 18, and MLB asked for the additional time. Richard Durbin and Charles Grassley are among the four senators who asked Manfred a series of questions that could be a prelude to proposed legislation further limiting an exemption created by a 1922 Supreme Court decision. NFL – NFL enters media streaming marketplace with ‘NFL+’ service The NFL is making its move into offering its own media streaming platform. The league announced that “NFL+” launched on Monday. Owners were briefed about it during the league meetings in May while Brian Rolapp, the NFL’s chief media and business officer, confirmed in a column for “Sports Illustrated” last week that it would be starting this season. Commissioner Roger Goodell said in a phone interview with The AP that the direct-to-consumer offering gives the league the ability to understand what fans and non-fans are seeking in terms of content and customize it for them. NFL – Chicago mayor presents 3 options for improving Soldier Field Chicago Mayor Lori Lightfoot has presented three options for renovating Soldier Field, the home of the Chicago Bears, but the team said it’s not interested. Lightfoot on Monday proposed fully enclosing the stadium by rebuilding both end zones with columns that can support a dome; rebuilding both end zones with columns to make the stadium dome-ready; or modifying Soldier Field to be a multi-purpose stadium better suited for soccer. The mayor’s office estimated the costs of the three options would range from $900 million to $2.2 billion. It didn’t say how it would pay for any of the options. WNBA – Women’s National Basketball Association Tonight Las Vegas Aces at Chicago Sky, 8:30 p.m. NHL – Detroit Red Wings extend affiliation deal with Grand Rapids The 20 year partnership between the Detroit Red Wings and the Grand Rapids Griffins will continue for another five years.  Detroit has extended their affiliation deal with Grand Rapids until at-least the 2026-27 season.   Grand Rapids has been the Red Wings primary affiliate since the 2002-03 season.  the Red Wings say that the close proximity of their minor league team in Grand Rapids as the most convenient NHL/AHL partnerships as Van Andel Arena and Little Caesars Arena are only 157 miles apart.  Detroit’s secondary affiliate is located in Toledo, Ohio.   The Red Wings affiliation has resulted in two Calder Cup Championships for the Griffins in 2013 and 2017.  The Red Wings oversee hockey operations in Grand Rapids, including providing the GM, coaching staff, players, equipment state, and athletic trainers. NBA – Sudden arena idea angers, unnerves Philadelphia’s Chinatown Organizers and members of Philadelphia’s Chinatown say they were surprised by the 76ers’ announcement that they hope to build a $1.3 billion arena just a block from the community’s gateway arch. They say no one reached out for community input before the announcement. Now, they fear that they’ll be merely a stepping stone for people visiting the arena and that real estate values will price out older and immigrant residents. Chinatowns throughout the U.S. have been under threat from gentrification or development over the years. A spokesperson for the arena development company says that the process is in its infancy and that they planned to work with the community. NASCAR – JGR accepts penalties given to Hamlin, Busch, apologizes Joe Gibbs Racing has declined to appeal the penalties levied by NASCAR that stripped Denny Hamlin of his Pocono Raceway victory and cost Kyle Busch his runner-up finish. The win was awarded to Chase Elliott. Hamlin’s No. 11 Toyota and Busch’s No. 18 Toyota both flunked postrace inspection Sunday night when NASCAR found issues in both cars that affected the aerodynamics. Joe Gibbs Racing apologized in a statement and said changes were underway to make sure it did not happen again. Hamlin was stripped of his third Cup Series win of the season and a track-record seventh at Pocono. Soccer – US women’s team has new vibe, work to do before World Cup The U.S. women’s national soccer team has a new look with young talent, and coach Vlatko Andonovski has tweaked its traditional straightforward and speedy attack to take a more nuanced approach. The players say something more is going on as well. They say there’s been a shift in the team’s vibe due in large part to a new mix of veterans and younger players. Andonovski set about remaking the team after a disappointing Olympic tournament in Tokyo where the U.S. came away with a bronze. They’re now looking to build toward the 2023 World Cup and the 2024 Paris Olympics. Soccer – Hope Solo pleads guilty to DWI, gets 30-day sentence, fine Former U.S. women’s national team star goalkeeper Hope Solo pleaded guilty Monday to driving while impaired, almost four months after she was found passed out behind the wheel of a vehicle in North Carolina with her 2-year-old twins inside. Solo also was charged with misdemeanor child abuse and resisting a public officer in connection with the March 31 incident. The Winston-Salem Journal reports that her attorney said the remaining two charges were voluntarily dismissed. A judge gave Solo a suspended sentence of 24 months and an active sentence of 30 days. She was given 30 days credit for time she spent at an in-patient rehabilitation facility. In the early morning of August 10, 1984, Deborah Sykes, a 25-year-old copy editor at a local newspaper in Winston-Salem, North Carolina, was sexually assaulted and stabbed to death. Without any evidence, Darryl Hunt, a 19-year-old Black man, was implicated and convicted for Sykes murder. Although DNA evidence was found to exonerate him in 1994, he spent another 10 years in prison. The case is the subject of the 2007 HBO documentary "The Trials of Darryl Hunt."   After Hunt was finally exonerated in 2004, he started a nonprofit called the Darryl Hunt Project for Freedom and Justice which helped provide resources to individuals recently released from prison and advocated for criminal justice reform. On March 13, 2016, Hunt tragically killed himself.
