Counsel to Counsel - Career Advice for Lawyers

I've had a number of guests on this show speaking about leadership. A large part of this is that I'm very interested in the subject. But I also feel that this is a skill set that is often neglected in the legal profession. As lawyers, we learn a lot about our craft in law school and even more once we are in practice.  As professionals, we are taught to analyze the law and help our clients to identify legal risks. Our job is to be skeptical and to apply dispassionate reasoning to the situation so that our clients can protect themselves from legal exposure and comply with the law.  We work to get our clients the best possible outcome whether it is in a litigation matter or in a corporate or real estate deal.  We help our clients to achieve their personal or business objectives in a way that avoids legal risk or accomplishes their legal objectives. But the same skills that we cultivate in practicing law can interfere with our ability to be an effective leader. Whether you are a managing partner, a practice group leader, running your own law firm, serving as a general counsel, or managing other members of the legal team as an assistant general counsel, you need a different skill set to be successful. In particular, emotional intelligence is one skill that you need to cultivate in order to be successful in a leadership role. In this episode, Susan Schwartz provides great insights on that subject. Susan Schwartz is a leadership coach and management consultant. She equips technical experts and teams with the skills they need to become excellent leaders.  Her tagline is :  Transforming expert professionals into emotionally intelligent leaders. It is axiomatic that if you want to have a successful legal career, you need to learn your craft. Most areas of legal practice require highly refined analytical abilities coupled with good judgment. For the most part, the first developmental task of any new lawyer is to learn how to practice law. But if you want to advance in your career, you need to be more than a good technician.  Demonstrating executive presence is also key. In this episode, I am pleased to introduce John Buckley, Board Secretary and General Counsel for the North Carolina operations of a multinational mobility infrastructure company.  John talks about how building your executive presence is critical to advancing your career, especially if you want to want to take on leadership responsibilities. In a great conversation, John discusses what executive presence is, who needs it, and what it looks like. He offers his practical tips on how increase your own executive presence. Over the summer, I heard John give a great presentation on this topic for the American Bar Association and I decided I had to have him on the show.  Lucky for me, he accepted my invitation right away. John Buckley has served 3 times as the first in-house counsel for start-ups.  He has 15 years of solo/small law department General Counsel experience.  He began his professional life as an engineer for Duke Power. Having the odds stacked against you doesn't mean giving up. Finding your path may be tough, but with hard work and determination, the possibilities are endless. Gary has held the record for the highest jury verdicts in numerous courthouses, including a staggering $125 million-dollar jury verdict in Ventura County in 2016. He went directly from high school to law school, never attending college. He put himself through a four-year night program while working at a law office, where he started as a file room clerk. Immediately after passing the bar, Mr. Dordick opened his own law firm, starting out with no employees. Now, Dordick Law Corporation has three locations, fifty-six employees, and eighteen lawyers, including his three kids, Michelle, Dylan, and Taylor, as associate lawyers. On this week's episode, Maria sits down with Gary Dordick as they discuss what it means to be healthy at 60, how he found his path through martial arts, working with his kids, and how he sees the future of law. Key takeaways College isn't everything. Not going to college doesn't mean not being successful. Carve your own path, learn from others, and take advantage of every opportunity. Don't spoil your kids. Even though you may want to give them everything you didn't have, it's ok to hold some things back. Achieving partnership was once the goal of most  law firm associates.  The rules were relatively simple.  Work hard, do a good job, and after several years, get rewarded by being elevated. Today the law firms are more complex.  Many associates entering the practice of law do not aspire to become partners, at least not at the first firm they join. And at many firms, there are different paths to success which don't include equity partnership. So, how should a young associate navigate these new realities? What is the path to partnership in the 2020s and what are other ways to define success in private practice.  How do you get there?  What is the impact of hybrid work arrangements on career advancement and professional development? My guest Laura Terrell has some answers. Laura Terrell is an executive coach with over 25 years of professional experience as a legal and business leader. Prior to launching her coaching practice, Laura was a Special Assistant to the President at the White House, a senior level appointee at the US Department of Justice, an equity partner in two large global law firms, and in-house counsel at a major global consulting and business advisory firm. Laura has led and managed teams of hundreds of people across multiple countries and has been a top advisor for many Fortune 500 and FTSE 100 companies. Her clients come from a wide variety of industries, including law, education, financial services, pharmaceutical, oil & gas, non-profit, health care, and technology. Some of them are senior corporate executives like CEOs and general counsels; others are lawyers and consultants, entrepreneurs, and small business owners, as well as professionals who may be returning to the workforce, making a pivot to a new career, or switching roles mid-career. Laura is my favorite kind of guest because she has such a broad perspective on the legal industry and has experienced legal careers from all sides. Greetings from the beautiful Bali, where I'm currently enjoying a much-needed vacation. But what makes this vacation even more special? It's knowing that back home, my law firm continues to engage and secure new clients, thanks to a well-structured, automated law firm marketing plan. Welcome to another episode of our law firm marketing podcast, designed especially for you - whether you're an owner of a small-to-medium law firm or a lawyer with the ambition to start your practice. This podcast is your companion on that journey. In the last episode, "7 Things That Don't Work When It Comes to Your Law Firm's Digital Marketing", we explored strategies that have proven less than fruitful in today's digital marketing landscape. Now, let's discuss the strategies that do work, that should be part of your marketing plan for a law firm: 1. Google Ads: Our journey begins with a powerhouse player – Google Ads. Here's a law firm marketing plan example from my own experience: we run a well-oiled law firm marketing funnel on Google Ads, which consistently brings in a stream of clients. Don't fret about getting into the nitty-gritty of it - outsourcing to a reliable agency can save you time and stress. But the golden rule? Strategy, mates! You gotta have the right one. We'll begin by diving into Google Ads, a resource that can drive a consistent flow of clients to your firm when used correctly. 2. Content Marketing: Wondering how to make a law firm marketing plan that speaks directly to your ideal client? Say g'day to content marketing. Picture this - you're delivering value, becoming an industry guru, and boosting your SEO all at once. Whether it's a podcast, blog, or video, keep it fresh and regular, and watch your brand skyrocket. Moving on, we will discuss the power of content marketing and how it can be used to connect with your ideal clients. 3. SEO and Website Visibility: Next on our list of law firm marketing ideas is ensuring you're visible. That means the front page of Google, is not buried in the back. SEO's the name of the game here, but it's a tricky beast. You need the right experts on board to keep you sailing smoothly in these competitive waters. We'll stress the importance of website visibility and how essential SEO is to ensure your firm lands on the front page of Google search results. 4. Social Media: Social media can be a treasure trove of potential clients if you know how to navigate. Remember, not all platforms will yield gold for every practice area. Be smart, go where your clients are. We'll navigate the various social media platforms and provide tips on how to target your marketing efforts effectively. 5. Online Reviews and Reputation Management: Lastly, we touch on the power of Google reviews. A good review is like a glowing endorsement that not only boosts your SEO but also provides hard-to-beat social proof. And if you do hit a rough patch with a negative review, no worries! We'll guide you on how to turn that around into an opportunity. We'll look into the significance of online reviews, especially Google reviews, and how to manage them effectively. Now, if you want to dive deeper into all these topics, head over to the Scalable Business Lounge, where we've got over 40 masterclasses stacked up and we break down the ins and outs of law firm marketing strategy template and other essential topics. In the legal field, as in any business, failure is a part of the journey. However, rather than viewing setbacks as defeats, see them as opportunities for growth and improvement. Analyze your mistakes, learn from them, and dust yourself off. With diligence and putting trust in the process, your law firm's growth potential is limitless. In this episode, Luke Russell joins us to discuss why it's okay for law firms to fail in their marketing ventures. He emphasizes that the key is finding a marketing strategy you genuinely enjoy. He also encourages us to use social media as a relationship-building tool, not a channel for getting attention. To show our appreciation, we're joined by Corine Rogers, the problem solver extraordinaire at Streamlined Legal, to answer some great listener questions that have come in. Listen in as we discuss the challenges and rewards of growing a law firm and how to navigate the new obstacles that come with it. Growth presents new challenges, but that's a sign of progress. We discuss how some aspects of running a business may get easier with repetition, but new levels of growth often bring new difficulties. Just as with parenting, we find that in business, it's not necessarily that it gets easier, but rather a different type of hardship. We also explore the importance of having team members who are motivated to challenge themselves and grow with the business and the need for holding people accountable with objective measures and metrics. Finally, we touch on the importance of understanding and utilizing the software at our disposal and how it can help us manage our growing firms more efficiently. We discuss the challenges of outgrowing software and how to approach making changes to your processes and systems to avoid having to switch to a new platform. So, tune in and gain valuable insights as we share our experiences and advice on taking your law firm to the next level! Show Highlights: Celebrating growth and overcoming challenges in a law firm business.  Surrounding yourself with motivated team members to challenge themselves and grow with the business.  Holding people accountable through objective measures and metrics.  Utilizing software to manage growth efficiently in a law firm.  Testing business processes by going on vacation to see how the firm runs without you. Building checklists and processes for when things break and learning from the experience. Are you missing out on new clients because you're stuck in an old way of thinking about your marketing? Mark Homer, CEO of GNGF (Get Noticed Get Found), is here to share his top five marketing strategies for 2022 and beyond. Mark's full-service marketing agency strives to put the law firm back in law firm marketing. Mark believes that most law firm business owners are almost accidental entrepreneurs. They started their firm to practice law and then realized at some point along the way they were running a business, which requires finance, operations, HR, and marketing. Even if you're not spending a dime on marketing, you should track and measure where your leads originate. Are they coming from Google? Are they coming from referral partners? Do you have a clearly defined intake process? Measuring and tracking leads falls apart when you don't have a clearly defined intake process. Creating and defining your intake process is a better use of your time and resources in the short term than throwing more money at marketing and leads. We spend a good deal of time talking about the impact of Google on your law firm marketing. Eric Farber, attorney and writer, visits the Technically Legal Podcast to talk about Creators Legal, a LegalZoom like app for creators and those in the entertainment industry. Creators Legal offers self serve industry contracts drafted by experienced lawyers. It makes sense that Eric launched a legal tech company for creative types. He started his career in the entertainment industry working for a talent agency and then headed up business affairs for a movie studio. Ultimately he moved to private practice and represented entertainers and athletes. In fact for many years, he represented Amaru Entertainment which released Tupac Shakur's posthumous music. In 2008, with the economy in shambles, Eric, like many, had to pivot and launched Pacific Workers which was initially a workers compensation law firm for athletes, but later came to represent workers from all fields. So, how is that Eric decided to launch a legal tech company? One of Eric's law clerks pointed out that Eric always had great business advice, but he never used it himself. That comment resonated with Eric and that's when he decided to launch Creators Legal. Based on his experience in the entertainment world, he knew the vast majority of those creating art and intellectual property could not afford proper legal representation to protect their rights. What Eric saw is an access to justice issue and set out to do something about it. The result is a site that creators can go to and find legal documents to help them protect their rights and create businesses around their art. Although historically Eric was on the legal side of the entertainment industry, he is also a creator. He wrote a book a couple of years ago called The Case for Culture: How to Stop Being a Slave to Your Law Firm, Grow Your Practice, and Actually Be Happy.

Experience as an associate in an established law firm will also be beneficial for your skills development. Such experience can also help you realize what field of law to focus on if you haven't settled on one yet. But sometimes, working for bigger law firms means losing control of your own time. You might not have the liberty or authority to improve the firm's operations either.  All these problems may lead you to want to start your own practice. But, how can you start a practice right after school and passing the bar? After all, law school doesn't teach the business side of running a law firm.  In this episode, Moshe Amsel is joined by Chris Guymon, a family law lawyer who built a successful practice right after law school. They discuss everything about building a practice — from determining which field of law to focus on to streamlining your operations. Through her work with attorneys and firms, she's identified six key numbers that can tell the health of a law practice and identify what next steps a firm needs to take. They are compiled in her book From Panic to Profit: How 6 Key Numbers Can Make a 6 Figure Difference in Your Law Firm, and she walks the ABA Journal's Lee Rawles through all six.

On this episode of The Legal Toolkit, your host, Jared Correia, invites Jordan Furlong to discuss how the legal marketplace is changing and how law firms can react. “In the short term,” Furlong begins, “we're going to see a lot more regulatory reform ending in a small set of really advanced legal services, exclusive to lawyers.” Jordan goes on to prognosticate respecting the specific effects that changes will have upon solo and small firm attorneys, law students and law schools. Despite the disruptive change that will continue to take place in the practice of law, Jordan does, in the long term, see the light at the end of the tunnel for the redefined attorney. Jordan Furlong is a lawyer, speaker, and consultant based in Canada. He specializes in giving thought-provoking presentations covering the future of the legal marketplace and how to assimilate. Before working as a consultant and speaker, he edited top legal publications, including The Canadian Bar Association's magazine National and The Lawyer's Weekly. Currently he writes the blog, Law21: Dispatches from a Legal Profession on the Brink, a multiple ABA Blawg 100 honoree. His latest book, Evolutionary Road: A Strategic Guide to Your Law Firm's Future, is available from Attorney at Work. Tune in to hear more on the future of legal services: how these will be created, priced, and delivered, and how lawyers can take advantage of the changes.

Jordan is also the author of Evolutionary Road: A Strategic Guide to Your Law Firm's Future, an e-book published by Attorney at Work. We discussed his background and the focus of his work at Edge, as well as what inspired him to write Evolutionary Road. He shared his thoughts on the distinction between sustaining innovation vs. disruptive technology, and the impact of each on the legal market. “Disruptive technology will open new doors for us,” he predicts. Furlong cautions that “This is not a period of incremental adjustment; it is a period of significant change.” He suggests that law firm leaders engage in two exercises to help their management teams consider key steps to take to accelerate their progress: Imagine that you are starting a law firm from scratch – how would you design it knowing that you have none of the constraints of the traditional paradigm? If your largest competitor or rival hired you away from your firm with the mission of destroying your former employer, what steps would you take? He concludes that “Firms must recognize that the way in which they have done business in the past is not the way they will do business n the future.”
