So, we are right on the breaking news as we record this show, and that is the spectacular win on the National Firearms Act. It is the outcome of the Big Beautiful Bill removing the taxes on silencers, short barrel rifles, short barrel shotguns, and AOWs that translated into the Big Beautiful Lawsuit. There were actually two lawsuits, which essentially put forward that if there is no tax, there can be no law, because the NFA is based on tax law as the jurisdictional basis for the federal government. If there’s no tax, then you can’t have a tax law, and hence the silliness, which is really just kind of funny, is the tax stamp says zero. So, how you get a tax stamp that says zero when there’s no tax? Leave it to the Government to create a tax stamp of zero. But now that’s changed. Evan Nappen 01:37 This is the most exciting change in, what is it? Ninety-six (96) years, to a challenge to the NFA. And it has very exciting ramifications. I’ll talk about how those specifically relate to New Jersey in a moment, but there’s lots of questions and lots of speculation and issues surrounding what this decision means. So, what happened was we had two lawsuits that were brought. One is the Silencer Shop Foundation versus ATF. There were other plaintiffs as well. The parties in the SSF lawsuit included B&T USA, Firearms Regulatory Accountability Coalition, Gun Owners Foundation, Gun Owners of America, Palmetto State Armory, Silencerco Weapons Research, Silencer Shop Foundation, the state of Alaska, Georgia, Idaho, Indiana, Kansas, Louisiana, Montana, North Dakota, Oklahoma, South Carolina, South Dakota, Texas, Utah, West Virginia, and Wyoming, and several individuals. Evan Nappen 02:56 Then there is Jensen versus ATF. In Jensen, the parties were the Texas State Rifle Association, which is NRA’s Texas affiliate, Citizens Committee for the Right to Keep and Bear Arms, FPC Action Foundation, Hot Shots Custom, and several individuals. The court in these cases applied an injunction to the parties, quote, where applicable, the parties, agencies, political subdivisions, members, and Page – 2 – of 12 customers, both current and future. This means that the protections of the injunction generally flow downstream in that chain of commerce. And by the way, I am gleaning this information from the NRA-ILA in their article, “What Does the Texas NFA Decision Mean for You?”(https://www.nraila.org/articles/20260812/what-does-the-texas-nfa-decision-mean-for-you) They’ve done a good job of essentially the preliminary breakdown here. NRA partnered with the TSRA to provide joint membership for those that are interested. Evan Nappen 04:02 So, what got enjoined? What statutes themselves got enjoined? Well, it was the NFA’s registration and approval requirements. Those were what were enjoined, and they were enjoined as to silencers, short barrel rifles, short barrel shotguns for covered parties. The injunction also includes AOWs, Any Other Weapons for the SSF parties only. o, as far as AOWs are concerned, only parties, people that are parties to the SSF, which is going to mean members essentially of GOA and such, and the companies that joined in it, and possibly as well, including those states. Certain marking requirements are enjoined with respect to the Jensen case, while the effect of this portion of the injunction is going to take clarification from the Government. So, we’re going to have to wait and see on that. Evan Nappen 05:11 The further impact is that, which is perhaps more important than the statutes that are covered, are those that are not covered. So, under Title 18, it makes it unlawful for licensed importer, licensed manufacturer, licensed dealer, licensed collector to sell or deliver to any person any short barrel shotgun, short barrel rifle, except as specifically authorized by the Attorney General, consistent with public safety and necessity. Now, in the past, that compliance was considered authorized or was considered authorization when there was an NFA compliance done itself. o, without further action by the Government, compliance with the former NFA procedures will likely still be required before transferring a short-barreled shotgun or short-barreled rifle. Then it goes on to explain that the analogous requirement for transportation of short-barreled rifles, short-barrel shotguns, was also not enjoined. So, authorization for interstate travel is still required. That’s where you have to get permission from ATF before you move with any of those firearms. Evan Nappen 06:31 However, ATF has proposed streamlining this process by currently pending regulations. Those are the regulations that we’ve discussed in the past that are looking to change by changing it in the CFR, which is the Code of Federal Regulations. The injunction also does not apply to existing SOTs, which is the Special Occupational Tax for dealers in NFA firearms. Now, it’s technically possible for non-SOT dealers to receive firearms from a distributor or manufacturer on an ATF Form Four. ATF will need to clarify if an SOT is required for dealers who engage in the business of dealing in these firearms. So there are still to be considered state laws, and that’s going to be an individual basis of each state’s laws about how they individually view these NFA items. And we’re going to talk about New Jersey specifically in a moment. Evan Nappen 07:33 NRA says moving forward, the Jensen case is one of three supported by NRA in their litigation partners with American Suppressor Association, the FPC, which is Foreign Policy Coalition, and Second Page – 3 – of 12 Amendment Foundation. Those cases, by the way, are Brown versus ATF and Roberts versus ATF. Judge Clark in Missouri heard motion for summary judgment in Brown, and they remain committed to expanding the injunction secured in Jensen. In those other cases, as NRA says, taking action under an injunction is not without risk. An injunction can be dissolved or stayed with very little notice. Please check regularly back for updates. While much remains uncertain with the injunction, the monumental nature of this cannot be overstated. This is the biggest win against the unconstitutional NFA in its 92 sorry math was off 92 year history, and it serves as a great example that the fight for our rights is never over. So, if we want to see some practical applications as to what’s going on when it comes to suppressors, it’s really fascinating. Evan Nappen 08:54 Now, of course, suppressors, silencers, are banned in New Jersey by state law. We are currently looking at challenges to New Jersey’s state suppressor ban, constitutional challenges to that. But for now, unfortunately, New Jersey citizens cannot take advantage of the changes if they are residents of New Jersey because of the state law prohibition that New Jersey still maintains. However, if you live in a free state, if you live in a state that is covered by this injunction, specifically through Silencer Shop, you can look at Silencer Shop’s website, (silencershop.com), which is very good, and it lays out the states that are good to go. Evan Nappen 08:55 If you live in a good to go state that is now covered by this injunction, for example, if you live in New Hampshire or if you live in Alabama, there’s the whole list of states that respect and understand this. If you live in any of those states, you can now order your suppressor and pick it up from the dealer locally, and when you go to the dealer to pick it up, there’s no form four. There’s no federal registration that needs approval anymore. There is no fingerprinting. There’s no notice given to local police of your acquisition. All that’s gone. All that gets done is a 4473. You know the same form you fill out for the federal government to buy a gun, and a NICS check gets done, an instant check. So, what it means is you’ll be able to go to your dealer, do the 4473, just like you’re buying a gun, and the NICS check gets done, the instant check. You get your approval, ad you walk out the door with your suppressor that easily. That is great, and it’s paving the way to finally get a full legal change to suppressors to make that, of course, eventually the nationwide standard. But for now, there is a boom, an explosion of silencer purchases. This will make it even easier, more convenient, more private, less of a hassle than ever before. This is extremely exciting. Teddy Nappen 11:17 There’s something very important to this fact. Going back to the, and I’m kind of extrapolating it to the assault firearm cases. One of the biggest things that is winning, that helped us fight, win that fight was the idea of common use. Where the AR-15 and all forms of their “assault firearms” were so popular that it was so much common use that it fell under the grounds of the Second Amendment. Evan Nappen 11:45 Right. This is going to explode even more common use, even though there’s millions of suppressors already, but it will absolutely aid to that. Now, interestingly, in New Jersey, sawed-off shotguns are a problem. Same with rifles; they’re a problem. However, Any Other Weapon, there are Any Other Page – 4 – of 12 Weapons, what we call AOWs, that are technically New Jersey legal, and this will change the game in New Jersey on AOWs. But we still need more clarification on how the feds are going to work it on AOWs. We don’t have that right now, but let me explain AOWs. Evan Nappen 12:32 Let me show you some common examples of AOWs. For example, pistol grip only shotguns. Now, don’t confuse AOW, which is Any Other Weapon, as an “Other”. Some of you may have Shockwaves in New Jersey, which are “Others”. Shockwaves are not AOWs. They’re Shock Waves. They’re “Others”. Others are different. But a pistol grip only shotgun is a short, non-face style scatter gun, right? But is reduced in overall length under 26 inches. Now, as you know, or should know, with a Shockwave, it’s not under the 26 inches. If it’s under 26 inches with only a grip, such as a custom compact 12 gauge, then we’re looking at that now. How those applied to New Jersey law become model specific. Of course, you still can have sort of shotgun, but State Police have approved for others. Vertical four grip pistols are also considered AOWs. So, a standard semi-automatic handgun or pistol format firearm equipped with a vertical front hand grip is considered an AOW. And AOWs have coverage under this, but how that’s going to apply now so that you don’t have to do the NFA and can simply operate under the injunction. We’re going to fill you in with more information as we get it. Evan Nappen 14:08 Smooth bore handguns. Those are AOWs. Classic examples of that, such as the H&R handy gun or the Ithaca auto and burglar gun. So, those custom smooth bores, it may very well now open up that category. Certain smooth bore pistols can, depending on their configuration, be New Jersey legal still. And if they’re even though they’re AOWs, if the injunction has its due effect, that’ll be easier in New Jersey on those. Also coming under AOWs are disguised or improvised firearms, concealable multi-projectile or single-shot devices disguised as everyday items like cane guns, pen guns, flashlights, or wallet guns, and of course those. Are all banned under New Jersey state law as covert firearms. So, even though you may seek relief federally in terms of the AOWs under the NFA, you’re not going to be able to acquire those because New Jersey has a specific ban on those in state law. Then there’s combination guns, certain compact over and under firearms with rifle and shotgun barrels, between 12 and 18 inches long, intended for single shots without reloading. These two can fall under categories of AOWs, specific models with specific determinations, and how this victory will apply, we’re still going to have to iron out the details since this is so fresh and so new. But there is going to be some relief that Jerseyans will be able to take advantage of, and in the long run, this is great for everybody as we keep the fight going on, battling the NFA. It’s a great victory, and it is definitely going to shake things up. Evan Nappen 16:10 And it has, though, some things to keep in mind that really require us to change this law permanently forever, and what I’m talking about is how we got to this point is something that still has a vulnerability to be changed back. Let me explain why. The reason for the injunction is because there is no tax, and because there’s no tax, then the legal logic opinion is with no tax, then a law based, premised, on the power of taxation can’t exist anymore or have its effect. This was used as a vehicle in the ’30s for the National Firearms Act. That’s what it was jurisdictioned upon. That’s what has been now eviscerated by the Big Beautiful Bill removing the tax on these four categories. he tax on machine guns still exists. We’ll get to that in a moment. Page – 5 – of 12 Evan Nappen 17:12 So, that’s what was the victory, but that was passed legislatively by what? By way of a reconciliation bill. A reconciliation bill deals with taxation and finance. Those bills can pass Congress with simple majorities. That is how the Republicans got it through, and by removing the tax on the NFA items with simple majorities, they did not face the challenge of a filibuster. Because they couldn’t filibuster. They being the communists. Oh, I’m sorry, the Democrats. Well, it’s the same thing. They couldn’t stop it. Teddy Nappen 17:51 Democrat Socialists. Evan Nappen 17:53 Right! Communist authoritarian nutbags could not stop this because of the filibuster being inapplicable to a reconciliation bill. That’s how we got to this point. But keep in mind, should the commies take power again, and you can substitute Democrats, socialists, whatever for commies, they’re interchangeable anyway. When and if that happens, then it would be at the moment within their power to reinstitute in a reconciliation bill that they do, assuming they have power through the Congress and the Executive who would sign such a thing. Keep in mind. If the Democrat, Socialist, Communists control both houses, and even with a Republican president, but a reconciliation bill that’s chock full of other things financially needed, they might even force the hand of an otherwise friendly executive. You know, President Trump, to still sign a reconciliation bill. A reconciliation bill that does what? Reimplements the tax. They may make the tax not $200, but maybe $200,000 or $5,000, or even if they just make it $200 again, or even $1 again, guess what? Now we’re back to a jurisdictional argument that the NFA is now applicable again. So, it matters who you vote for. Elections matter. They matter. They make a difference. Teddy Nappen 19:42 On the off chance, just on the extreme end, let’s say, you know, the pendulum swings, the Socialists take over and run it. Could they do what the ATF was doing prior with what was it the when going after people with like the forced restart trigger? Evan Nappen 19:59 We don’t know. We don’t know. They could do it. They could. Depending on what are they going to go and then try to round up suppressors that may have been acquired when there was no tax. If the law is suddenly back, or does it make it so that there’s an ex post facto argument to argue that it was legal at the time, but now any of these new ones need tax stamps, but old ones don’t. And then they’re going to be kind of like the way they ran magazines. It was before a certain period of time, and will they then be grandfathered or not? Because NFA didn’t grandfather. It had a new period of registration. But there is no new period ability unless the Secretary has the power to have a new registration period. So, I would assume if they do it, the Secretary would say, “Okay, there’s now an open registration period of ones you previously purchased. You’re going to have to register and pay the tax.” Remember that. So, this all can happen in the future. Page – 6 – of 12 Evan Nappen 20:57 But look, it doesn’t mean our behavior has to be based upon, especially you live in a free state, worrying about what communists might do in the future. But keep in mind, it still could happen. This is a great victory, but we need to take it further, and this will empower us to take it further, because it can help on the Second Amendment argument to knock these laws out. It can assist in that greatly. It can assist in legislative change once it’s done and out there, and people are purchasing them in this way. It makes it easier to pass federal laws to just make it the law and not just rely on the judicial action. So, there’s also potential future consequences that can run for us, not just against us. Regardless, it’s a great victory, but keep in mind these potential dangers that lurk. And unfortunately, if you live in New Jersey, there isn’t much here for you to take advantage of at the moment, but in the big picture, it’s working to protect our rights. Teddy Nappen 22:06 This is just a side note. I was thinking. I heard this term where just because you put a word in front of the other word, it doesn’t always change the definition. So, if I say Democrat murderer, that doesn’t change the definition of murderer. So, for them trying to rebrand the Socialists, like no, no, no, we’re not like that. We’re Democrat Socialists, not to every other socialist government that has failed. No, no, we’re different. We just want to abolish prisons and abolish police. Evan Nappen 22:35 Well, I love when they talk about ow communism, look communism just wasn’t done right, you know. It just hasn’t been done right. Well, I guess they’ll probably make the same argument for Nazism. Oh, Nazism just hasn’t been done right yet. Okay, so that’s all. That’s all. Just hasn’t been done right. I mean, no. We’ve experienced and seen what history has to say about these stupid ideas of Socialism and Communism and Nazism. We’ve seen it, and it doesn’t fly. As a matter of fact, look at what’s going on in Central America right now with the enormous economic change. They’ve been getting rid of their Socialist systems. Teddy Nappen 23:21 So, maybe that’s what happens when you defund USAID. Evan Nappen 23:23 Yeah, isn’t that amazing how these countries are suddenly doing great? I mean, you think about USAID. We were actually promoting Socialism to our central and southern Central American neighbors. It’s just nuts. It’s nuts that we would be doing this. Not to mention that the Democrat Party suddenly, coincidentally, is now 2 million in debt after USAID was folded up and shuttered. Teddy Nappen 23:52 The one I always laugh at is, I think it was the like it’s like something crazy, like $7 million to LGBTQAI plus in Serbia, which I guess worked because they’re like a lesbian, but it’s like it’s so oh my god, like and then well like it was like Sesame Street in Afghanistan, which okay. Well, that’s one hell of a grabber of a title. Evan Nappen 29:49 And what do they say it’s worth? Teddy Nappen 29:51 $42 million. Evan Nappen 29:54 I wonder how they came up with that number. Teddy Nappen 29:56 So, this involves a court battle between an appliance repairman and a cop in Argentina. Evan Nappen 30:01 Arrrgentina. Teddy Nappen 30:04 Yeah, I know. You know, one of them said he was from the boys of Brazil, and I’m just joking. Evan Nappen 30:11 Uh huh. Well, it would make sense that it would end up in Argentina, wouldn’t it? Teddy Nappen 30:16 Yeah. The what is it? The what was the one guy they caught in Argentina? Evan Nappen 30:22 There’s been number of Nazis found there. Teddy Nappen 30:26 The famous one is the two Mossad agents scooped him up, got him drunk and put him on a plane. Then they ended up just hanging him. Evan Nappen 30:35 Right. Teddy Nappen 30:36 It was the, but it was one of if you go through it. It’s actually kind of crazy. So, it began where, if you caught the previous article of Adolf Hitler’s former home transformed into police station. Evan Nappen 30:39 How do they know? Oh, that was his former home when he visited. Teddy Nappen 31:06 So, going to that was Austrian authorities Wednesday open police station building where Adolf Hitler was born amid years of controversies. This is a renovation to send a message that they will not appeal to extremist groups. Yes. Evan Nappen 31:21 So, you can visit Hitler’s birthplace if you chose to? Teddy Nappen 31:24 If you ever get arrested in Austria. But to get to the it going off of that, where it was the weapon that described the holy grail of firearms was allegedly swiped during a SWAT style raid by a masked officer at repairman Juan Pablo Rupel’s home in Buenos Aires province in 2016. To go into more details, he inherited the haunting historic ghost of the Third Reich from his German great uncle and former Hitler bodyguard Hans Rupel, who is accused of stealing minor items such as plate, glasses, cutlery at the time of the raid. Evan Nappen 32:09 So, the claim is that this guy stole it from Hitler. Teddy Nappen 32:14 No, the claim is that he had committed some minor stealing in Argentina, but he had that was his pistol. So, he was never charged the over the allegations, mind you. But still, the gun that is a Luger Parabellum .45 ACP caliber. Number five of only five. Evan Nappen 32:37 It’s a .45 caliber Luger? Teddy Nappen 32:39 Yeah, yes. Only five in existence of the 1907 prototype forged by the late famed George Luger. Evan Nappen 32:48 Yeah, George Luger. So, Hitler’s Luger was one of the rare .45 caliber Lugers. Teddy Nappen 32:56 Correct. And this was only for Hitler’s provinces. That would make them invaluable. The guns there’s 1979 firearm owner license in Argentina National Registry, so they register firearms. It was marked as Nazi Angel of Death who lived for more than two years before fleeing the so the 1905. Page – 10 – of 12 Evan Nappen 33:25 So, what happened to the gun now? It got seized by the police? Teddy Nappen 33:30 Correct. How did that happen? So, from what it was said that Hans it said now again this is not Hans says it belonged to Hitler and he was taken when he and he took it when he went to Argentina in 1948. So, from when from that point where it was stolen after the quote unquote raid, it is now gone “missing”. Evan Nappen 33:53 Okay. Who stole it in the raid? What police raid? Teddy Nappen 33:57 One of the police. One of the police officers. Evan Nappen 33:59 So, this is essentially gun confiscation by police, and supposedly the most valuable handgun in the world is missing once the police got their hands on it. Right? Teddy Nappen 34:09 Buenos Aires Ministry of Security for and has demanding lawsuit for the compensation for the firearm. The court held by the agency liable for 15,000 plus interest, which also 15,000 just for the raid itself, for the actual unjustified raid. However, the lawsuit also adds in the 42 million where two cops who had led the raid on the home due to the quote-unquote trial prior. Rupert told the post of great uncles that the Luger was taken from him. Evan Nappen 34:48 Well, I’ll tell you what. This is a common thing in New Jersey. I’ve had many gun confiscations by law enforcement in which it always seemed that the most valuable firearm that the client possessed. I had a case where one was a rifle given by Theodore Roosevelt to a cabinet member that disappeared. I had another case where there was a trapdoor Springfield trapdoor carbine that was documented to Custer’s last stand, and was an Indian capture gun that oh that that that was sent to the crusher supposedly and destroyed. You see, and I’ve had many different gun seizures that have taken place, and for some crazy reason, it’s that really valuable gun that ends up not being accounted for, and I don’t know why I seem to see that pattern. Teddy Nappen 35:58 Yeah, and then just for clarification on the individual Hans Zurpel, he was the SS Division Labest Start. He was Hitler’s personal bodyguard unit during the Second World War, to which he later fled to Argentina in 1945. This has been confirmed. So it is confirmed that this guy was a bodyguard, and he was a pistol to Hitler and registered the gun under it, so it shows proof of documentation to the actual firearm that existed. So we know the gun existed. We know the guy has the credentials, so that proved that point as to who swiped it. Well, it’s one of the members of the ministry, as what the suit is being led to. Again, that’s what they’re alleging in their suit. Page – 11 – of 12 Evan Nappen 36:40 Yeah. Well, like I said, I’ve seen this done Jersey side where folks, what you want to do with your guns is make sure you have photos, and you have recorded your information about your guns. Do not keep your data with the guns. Because if they seize your guns, they’re going to seize your books and data. And it’s not unusual as well for them to take computers and such as well. So, if you’re going to have this and recordings of it and photos and all, you know, keep it on a thumb drive hidden somewhere, so you can access it. So, you can prove and document the guns that you had and what they were, because I’ve had the missing guns after a seizure more times than I can count. It is common. Teddy Nappen 37:38 I also recall wasn’t one of these pistols also had like the early idea of a tactical light, like where if you held the pistol, it was. Evan Nappen 37:46 Yeah, that was a very special Luger. They made too that had early lighting attached to the gun. Yeah, that was a German invention, so to speak. You know, they did have those way back. Yep, yep. So, these are, yeah. Well, there’s a lot of valuable firearms out there, and a lot that have providence to make them even more valuable. And I don’t know if this truly is worth $42 million for a handgun, but it’s definitely way up there as a very valuable historic piece. It is something where you need to take steps if you have any firearms at all to make sure that you’ve documented so you can prove ownership. And if guns do get stolen, either by criminals or police or both, then you need to know and be able to have that information to try to recover them. Teddy Nappen 38:52 If anyone is related to anybody who served as a Soviet Union soldier who hit the Berlin and may or may not have picked up a Walter PPK next to a dead Hitler, call us. Evan Nappen 39:07 Yeah, I think that gun is not accounted for. This so-called Hitler suicide gun. If, in fact, he did kill himself, which now there’s speculation that the skull they thought was his was actually a woman’s. There’s all kinds of who knows, and did he actually escape? And, you know, we could find about as many theories about whether Hitler’s alive as whether you know Elvis is alive and whether Bigfoot exists. I mean, this is one of the favorite topics of conspiracy theorists and what have you. But bottom line is, folks, you need to protect yourselves. Protect your property. Don’t be a GOFU. As a matter of fact, Teddy, what do you have this week for us for GOFUs? Teddy Nappen 39:49 Well, this comes from Not the Bee. Influencer shoots self in leg while filming instructional video outside a gun shop. Evan Nappen 39:57 Oh, an instructional video on how to shoot yourself in the leg. Page – 12 – of 12 Teddy Nappen 40:01 Well, how to properly, properly rack the slide, and while doing so, when he was going through showing it off, he racked it. He broke every rule – from treat every gun like it’s loaded, know where you’re pointing, keep your finger off the trigger. And bang! Shot the artery in his leg and almost died. Always a good idea. Evan Nappen 40:25 Oh, yeah. He came close to bleeding out because it hit the key artery there. And that’s because he wanted to do an instructional video on how to properly handle a firearm, where he proceeded to utterly and completely improperly handle a firearm. Similar to the law enforcement guy way back, you know, lecturing to the students how he’s the only one trained and safe enough to handle this gun properly. And right after he said that, he had an AD into his foot. I believe it was. Teddy Nappen 40:58 Yeah. He was a DEA agent, if I remember. Evan Nappen 41:02 Yeah, right. A DEA agent. Teddy Nappen 41:03 Yeah, and then he picks up the gun. Evan Nappen 41:04 So, this GOFU is a very practical and fundamental one, folks. Don’t forget the basic rules of gun safety. They’re there for a reason. They’re proven. Obey those rules. Don’t take it for granted. Follow the gun safety rules. If you don’t know guns and don’t know gun safety, you need to take a gun safety course. Let this hit home. You don’t want to be a GOFU, a Gun Owner Fuck Up. This has not only almost cost him his life. And in New Jersey, it would cost you your gun rights at a minimum under their Accidental Discharge law, because it was done without lawful purpose. You didn’t intend to fire it. It was in the 100 yards of a dwelling, which even a car constitutes as a dwelling. Leave it to New Jersey to do that. You’d be looking at a felony charge for shooting yourself in the leg. So, don’t be a GOFU. Be extra conscientious. We want you to be safe. You need to always be safe using the number one safety device ever invented, your brain. Keep that safety engaged at all times. So, you know our show here, one of the things that is very, very famous about our show are GOFUs. And GOFUs, as my listeners know, are Gun Owner Fuck Ups. The idea with GOFUs is these are real cases, actual things that happened. They are expensive lessons that people learn, and that you, the listener, get to learn for free. And of course, we always do the GOFU at the end of the show, whatever this week’s GOFU may be. But suddenly I’ve been pounded with GOFUs, and they’re very important. And I said, you know what? We’re going to do a three round burst here of some really important GOFUs, including what I want to begin with by telling you about this actual case. It illustrates just how insane New Jersey is and what every law-abiding gun owner could, in fact, face. Evan Nappen 01:32 Of course, I’m not using any names, but this is an actual situation that occurred. And some things, looking at the situation that the, and not just necessarily a mistake that the gun owner did, but something that hit me as extremely important for every New Jersey gun owner to make sure they do. There’s a very simple thing that is very important that could be critical between whether or not they hold you in jail or release you. We’re going to get to that from this story so you’ll learn this secret, so that you don’t end up in this GOFU situation. Spending days or weeks incarcerated for nothing, because that’s what the Gulag does, as you know. This is a case that wraps it all up into that. Evan Nappen 02:39 So, here’s this guy who comes into New Jersey, and he’s at a mall. Now, as you may know, the mall is not, in and of itself, a sensitive place, right? Those of us who have familiarized ourself, which hopefully all of you have, with these “sensitive places”. A mall is not, per se, a sensitive place. Now, there can be rules regarding malls where they say, hey, no guns in the mall. We don’t want guns, you know. And any Page – 2 – of 11 private property, whether open to the public or not, can have a prohibition privately saying we don’t want any guns here. In the same way they could say, we don’t want any dogs. We don’t want any bare feet. You know, things like that. The property owner has certain control. But if there is such a sign, if there is such a statement by a property owner, then if you come on to that property and they don’t want you on that property for a reason such as that. They can’t say, hey, we don’t allow minorities on our property. You know, they can’t. You can’t have racial discrimination in a place open to the public. But you can have other restrictions. Evan Nappen 04:07 Now, I happen to personally think that firearms should be viewed as a civil right and in the same category as discrimination, because it is a civil right. But that’s not currently how the law is. So, if a private entity prohibits gun, says no guns, then if you still go on that property and you’re specifically told to leave and don’t, then you’re what’s known as a defiant trespasser. So, what we’re talking about is trespassing, but trespassing is not a sensitive place violation. Sensitive place violations are specific gun law violations that create a certain place that becomes a prohibited area under the law to carry a gun, even if you have a permit to carry. So, this person is in the mall and apparently gets approached by mall security, who has allegedly dogs that can sniff gunpowder. Believe it or not, they’re out there. Apparently, he’s approached and they say, we think you have a gun. Please leave. And he does. No problem. He was asked to leave, and he leaves. Evan Nappen 05:30 After leaving, while in his car, driving, he gets stopped by police. More than even one because, oh, there’s a gun, right? Because, obviously, security called it in, I guess, at some point, and he was stopped. He is stopped for violating, in their minds, the sensitive place prohibition under Section 24 under Chapter 58 of the sensitive places. And what is that? What is that sensitive place that they believe he’s in violation of? Oh, New Jersey’s version of the vampire rule. The vampire rule is that you need permission before you go onto any private property. That is the issue that’s before the United States Supreme Court. The Hawaii, you know, the Woolford case in front of SCOTUS. We’re waiting for a decision. Evan Nappen 06:43 Now, Hawaii had the law just like New Jersey. The only difference is New Jersey’s vampire rule case saying that you can’t go on to private property, whether open to the public or not open to the public, you cannot go on any private property in New Jersey unless you first have permission to carry your gun there. In other words, they needed to have a sign, you know, that says we love guns. You know, basically, guns welcome. You know, guns permitted. Essentially, a sign. Or you got specific permission from the property owner before you enter the property. Hence the vampire rule. You know, as long as you don’t invite the vampire in to your place. That’s where that comes from. Evan Nappen 07:34 Well, New Jersey’s vampire rule, to impose this, you need permission first, before you can go on private property, even private property open to the public, has been found and was found unconstitutional in the Koons versus Platkin case. In Koons. And in that case, as you may recall, Judge Bump found it was unconstitutional and put an injunction on that section, saying it is unenforceable. It’s Page – 3 – of 11 unconstitutional. That any private property that is open to the public, you’re allowed to bring your gun on unless it’s otherwise a sensitive place. So, you know, if you want to go into a 7-11 with your carry gun, you can. It’s open to the public, even though it’s privately owned by 7-11. Now, if you want to go to a private residence, a private place that’s not open to the public, then you do need advanced permission for that. If you go into even your friend’s house, your friend needs to be able to say, yeah, you have permission to have your gun at my house. But not open to the public. Evan Nappen 09:00 So, the mall is open to the public. The mall is not a per se sensitive place. Yet, in this case, the basis for stopping and arresting this man or woman, I won’t even tell you what the sex is, the basis for the arrest is an alleged violation of the sensitive place section for which there is a federal injunction against enforcement. Then because somehow there’s this belief that if you are in violation of sensitive place, you’re also unlawfully carrying even though you have a carry permit, which makes absolutely no sense. There’s no logic to that. He’s charged with unlawful possession of a handgun without a carry permit, even though he has a carry permit. And, of course, with those gun charges, off to the Gulag you go. So, you are arrested, and you are put in jail. Evan Nappen 10:16 Now, the Gulag kicks in, where there’s 48 hours in which the prosecutor gets to decide whether to seek pretrial detention. It is solely within the discretion of the prosecutor. And if the prosecutor decides to seek pretrial detention, you’re going to be held for another five days before there’s a hearing when we can actually argue to get you out. And with the new law that was just signed by Murphy, they can get an additional five days to make sure that the gun is operable, to get an operability report, which is irrelevant to the charges anyway. So, by this arrest, you actually have the opportunity to be incarcerated basically for two weeks, guilty of nothing. Evan Nappen 11:08 What happened? Well, luckily, I got a call very quickly. When this person was in jail, loved ones got a hold of me. And this is on a Saturday, my friends, on a Saturday. Yeah. They do these on Saturday. They just hired me in time that I was able to get onto the court hearing 15 minutes before that first 48 hour time period, for that very first hearing where there’s no argument. The prosecutor either is going to say we’re seeking pretrial detention or not, but at least I could get on. And, lo and behold, I get on, and the prosecutor, big shock, is seeking pretrial detention, which means he’s going to be held or she is going to be held another five days or so, to have that hearing. It may be longer if they’re going to go for the operability nonsense, too. Teddy Nappen 12:11 Doesn’t Bergen County always seek pretrial detention? Evan Nappen 12:16 Well, it’s not just Bergen. And let me say this isn’t necessarily even Bergen, by the way, Teddy. But most counties have a policy of just automatically seeking pretrial detention on most gun cases. So, that’s not a big surprise. But what happens is, in this 48 hour period here, we still have the court appearance. But there’s nothing an attorney officially can do, because the prosecutor is given the sole Page – 4 – of 11 discretion. The prosecutor says, well, it’s gun charges with the Graves Act. Because, of course, the seriousness of the charge is second degree. You’re looking up to 10 years in State Prison. You’ve got a minimum mandatory three and a half years with no chance of parole. So, because of the seriousness of that offense and the Graves Act and it’s guns, we’re going to seek pretrial detention. Evan Nappen 13:13 And the court says, you know, Mr. Nappen, do you have anything that you want to add? And I say, and here’s exactly what I did them. I said, look, I understand how much discretion the prosecutor has here. Normally, we just have to wait until the hearing in order to argue. But I have to say, and I make it clear here. I say, look, my client not only had a permit to carry and why the state can’t access it, you know, they took his wallet and he can’t get to his wallet. And for whatever reason, there’s some glitch in them trying to get it out of the State Police. I don’t know why, but the very basis for his arrest was for a law for which there is an injunction, a federal injunction, that’s been upheld even by the Appeals Court. So, you have law enforcement violating a federal court injunction and charging and utilizing a statute that is enjoined from being enforced. Evan Nappen 14:19 So, in complete violation of that injunction, I make it clear that that is what is going on here with someone who has a permit, who has the lowest scores on the PSA of a one, one, that’s the lowest you can get. The PSAs are your flight risk and danger risk that they calculate into whether you’re to be released. Now they’re looking to hold them for another five to 10 days to even try to get them argued out. And at that point, the court officer actually says, well, counselor, there’s no argument here at this level. You’ll have to argue, you know, at the hearing when it gets scheduled. And I said, look, I’m not arguing anything. I said, do you know what I’m doing? I’m putting the State on notice as to the civil rights violation taking place on my client. At which time, the prosecutor says, look, we haven’t even had a chance to talk, and I said, no, we haven’t. I just got hired and got on here 15 minutes ago. Well, let’s talk. I said, okay. Evan Nappen 15:24 We had a private conference, and when we came back, I’m happy to say that the prosecutor withdrew their motion for pretrial detention. My client got out of jail that day, and now we will fight these charges. I’m extremely confident in how that fight is going to go as well. So, folks, what are the takeaways? Look at the risk you’re running. Look at the utter and complete failure of the Attorney General of New Jersey to inform law enforcement as to the changes in the law by these court actions. Why are the police charging an offense which has been enjoined? Police should know better, but I’ll tell you what else. The Attorney General should be instructing, the way they’ve done so many other times on so many other things, to all law enforcement, explaining how that sensitive place has been enjoined. And how on public property, it is not a sensitive place where you need prior permission under the vampire rule. This hasn’t been done. So, you have what is essentially a false arrest taking place. Evan Nappen 17:06 You have a system designed to incarcerate gun owners. It is outrageous, and you need to know that this what you’re up against. So, what do you need to do to protect yourself? Where’s the GOFU aspect? Well, let me tell you something that would be really important. Here’s what everybody should Page – 5 – of 11 do. Make sure your carry permit, make sure your gun licenses, are also, copies are given to your loved ones. People you can count on. Because if you get incarcerated and your wife or your parents or your brother is calling me and if they can get me copies of your carry permit or gun license that you otherwise can’t access, I can get that to the prosecutor. There doesn’t have to be a dependency for somehow getting it out of the State Police in time. Or finding it in some wallet that’s been confiscated and held in evidence in some other place, in some other room, somewhere else. That can be of great assistance, immediate assistance, in addressing your arrest and avoiding further gulaging of you. So, make sure. The takeaway is to make sure that folks that care about you, that would be the people you would go to if you had a problem, that they can provide and have access to copies of your gun licenses. That would be incredibly important. The other thing is make sure you have an attorney that you can get a hold of right away. An attorney that can come to your aid, argue, to get you out on a Saturday where time is of the essence. Those are the takeaways that are critical from this experience. Evan Nappen 19:08 Let me tell you, the GOFU has taken on a life of its own, and I’m glad about it. I have here a listener who sent a GOFU that they wanted to make our other listeners aware of, and I appreciate that. They asked that I not use a name, but here’s the GOFU letter. It says, I have a GOFU for you. It’s important for people to know to do this, so please share it on your show. This past fall, I planned a trip to Western New York to visit my family. I have a New Jersey PTC, also a PA PTC. I really like to have my gun along on trips with the highway driving. So, I asked a few guys at the shooting range what I should do with the gun when I got to New York state line. They told me to stop at a rest stop before I enter the state, put the unloaded gun in a car safe, and I should be good. That’s what I did. When I reached my destination, I told my family I had brought it, since they like guns, and they absolutely freaked out. They told me, the police would arrest me. It was illegal to bring a gun into a destination in New York. I better bring it in the house and keep it hidden. And hide it really well on the drive back. They really got me worried. So worried, in fact, I couldn’t get to sleep. So, I checked New York gun laws, and sure enough, she was correct. I was scared and felt terrible. I was incriminating my family members. Needless to say, the gun and the safe box and its cable were very hidden on the way back. I was careful not to break any speed limits. You can sum it up this way, but my takeaway is you have to do your own research before you take your gun out of state. Otherwise, you might end up in jail, and I’m very thankful that I didn’t. Evan Nappen 20:50 This is very true. State lines mean something. Now, here’s where the GOFU was. The GOFU was not following Title, 18, 926A thoroughly. That’s the federal preemption that lets you transport interstate. You have to be going from one place where you lawfully can possess and carry to another place. Your end destination has to be a place where you can lawfully possess and carry. Since New York does not recognize New Jersey’s permit or Pennsylvania’s permit, and unless you have a New York non-resident permit, that will not cover you. So, bringing your cased and unloaded gun into New York, now you’re possessing a handgun in New York, and you don’t have the protection of federal preemption. That’s the problem. Page – 6 – of 11 Evan Nappen 21:42 And it is a GOFU. This person is absolutely right. Make sure you know the laws. Make sure you clear it with counsel, so that you do not end up a GOFU. Because if that person had been stopped in New York with that handgun while in New York, they would face dire consequences. So, know the gun laws. Know the state laws. Do your research. Best bet? That’s all these laws do. You’ve got to protect yourself, folks. Learn from these tips and learn from these cases so you don’t become the next GOFU. You know, someone like you and I, Dad. You know, people like a Brandon Herrera or Grantham, Mr. Gunzing. You know, any individual who is a pro-gun influencer they want to demonetize. That’s their call to action. I love the framework that she abuses in this. Sandy Hook and the group called Untargeting Kids, a call for platform transparency, putting parents back in charge of firearm safety. You know, whenever I hear the Democrats try to say, we need to stand on parents rights, it’s always comes down to oh, when it comes to firearm safety. But, you know, when it is hardcore pornography being offered to children, oh, that’s fine. Or, you know, a drag queen story hour. Oh, that’s fine. But oh no, when it comes to firearms, we need to give it back to the parents. So, they were trying to, yeah, they were trying to run this experiment, testing YouTube accounts mimicking a nine to 14 year old. Evan Nappen 28:21 Wait. Whenever you see the term parental rights, you can see in the very corner, TM. It’s their version. Not when it comes to gender ideology, not when it comes to abortion, not when it comes to any other thing, but parents rights, TM. That’s their abuse of the language. Did you ever hear the word Democracy, TM. Or Second Amendment, TM. That is their version. Not what we know to be fact and truth. It’s their version. But anyways. So, they ran this experiment, which, you Page – 8 – of 11 know, these experiments can easily be debunked just by the abuse of algorithms. But whatever. We will say, for the sake of argument, we will say this data is true. So, they ran this experiment, and then 14 year old received 1300 firearm-related video recommendations after watching video games and movies that included firearm content. So, you know, a kid watches a bunch of Let’s Plays on Call of Duty, and then all a sudden, he gets a breakdown of an unboxing of a ACOG scope or something stupid. It’s one of those where they’re trying to make this argument, this very weak argument, on saying, oh, these videos are being monetized to target advertising, targeting our children. So, if a kid is interested in firearms, what is the problem with that? Why? He gets bombarded with tons of movies on all forms of graphic violence that goes into that. Then all of a sudden, it comes up with ad on any other influencer regarding firearm breakdown, because that’s the goal. They want you to get engagement. That’s it. And then I love this one. 54% of boys from 10 to 17 report sexually charged firearm content. Now, they do not define what sexually charged firearm content is. Evan Nappen 30:40 What is sexually charged firearm content? What is that? Teddy Nappen 30:43 It’s called we made it up! Because they love to just define terms. Evan Nappen 30:52 They just threw sex with guns, and don’t define it. Teddy Nappen 30:55 Correct. It’s just, and by the way, they don’t list any of the materials that was reviewed by the bots. Evan Nappen 31:02 Wait, it sounds like ammosexuality. Teddy Nappen 31:05 I know. Yeah, it is the hopalosexual all over again. Evan Nappen 31:10 What is that? That’s really interesting. Teddy Nappen 31:12 Yeah, and they don’t list any of the video game content that was reviewed. It doesn’t list any of the movies reviewed or the TV shows. Oh, because they don’t want to show the sexually graphic material that is pushed by the Left. You know, that’s why, you know, ask them. Evan Nappen 31:28 They should list it. I love, and then she goes on where they’re forming the sense of self-identity that the get, that getting, they’re getting content that is talking about firearms makes you powerful. Firearms makes you sexually attractive. Firearms are the way to solve your conflict. Firearms are used to solve very certain conflicts. You know, when defending yourself against a rapist or a pedophile. You know, in certain situations, it’s a very good solution. It’s not a magic wand, but it solves certain issues. But there’s more. They like to always equate, like, oh, why do you need a gun? Because your penis is small? Like, it’s one of the small ones. Like, it’s that. They always do that. We’re like, what does that have to do with the aspect of your rights to defend yourself? Like that is the goal that they always try to play. And then she goes off on this whole thing of, we need to demonetize this. We need to review this content and look at the algorithms of YouTube transparency on firearms. And there must be. We need to sense. It goes. This long-winded conversation is just, we need to have time to deletion for videos for unsafe handling of firearms. What’s unsafe? Oh, there’s a firearm in the video. It’s just that. It’s just we need it. That censorship is not our goal, though. Yes, it is. Evan Nappen 33:06 I’ll tell you what. Here’s where I’ll take them up on it. Before any movie or TV show where a gun is improperly handled, you know, shows produced by all these major media producers, just have a warning. Just the way they warn about profanity, and they warn about smoking. Put a warning that says “unsafe firearm use is in this movie”. Unsafe firearm use. Do you know how many times we’ll see that? Because the Left media is the largest actual demonstrator of unsafe and unlawful use of firearms. It’s not conservatives. It’s the opposite. And so, let’s see those warnings. That way people suddenly say, wow, look how many times firearms are abused, used improperly and used illegally in the movies? I mean, if you can warn about smoking, you should be able to warn about that. Just put it. Don’t, don’t, don’t suppress it. Don’t try to have prior restraint or ban it, the showing of any of these movies. Just put the warning up front, and let people see just what’s being promoted by Hollyweird. Teddy Nappen 34:33 Well, and also, Hollyweird promotes all the sexual deviancies, where they push it on children. Where you have, you know, children have access to now hardcore pornography all across the internet, thanks to YouTube. Thanks to social media. Like, the level of it’s so disingenuous. Making this argument that we need to protect our children. Except when it comes to the LGBTQAI+ in schools, when it comes to all the other things that they want to sexually groom children. But, oh, firearm content, that’s the issue. When you get down to it, this is what they want. They want the 2019, they want the Biden Administration censorship. Where, right here, out of the House Judiciary Committee where the chairman approves and shows, oh, Google was pressured by the Biden administration to censor Americans. They went after our First Amendment rights, just like the Second Amendment, and we lived through a period of Government censorship attempts that, when you look back, it was, it’s absolutely disgusting, what they pulled and what they were able to accomplish, even in achieving it, Teddy. It’s just insane. You would never think that could happen in America, because originally, the Left was for free speech. The Free Speech Movement was the Left, and now that’s no longer the case. They want the opposite. They don’t want free speech. Oh, hell no. But it used to be part of what true liberals, not today’s progressive, totalitarian liberals want, so-called. No, the classic liberal was absolute free speech, true, and they’ve abandoned that. They’ve abandoned it. Teddy Nappen 36:41 Well, it comes back to the idea of what the Left always does. They have no moral framework. The idea of, oh, what feels good? What is the cultural shift? What is the shifting ideology currently? Where you now have these massive purity tests on the Left, and that’s why they’re in a shooting war against each other as to who controls the party. But to even highlight this fact, Mark Zuckerberg said and admitted to the White House, yeah, I was pressured by the White House to censor people during Covid, over Covid 19 content. Doctors admitting all the false information that was out there. Bring that up. Completely censored off of Facebook, off of YouTube, all these platforms. X. You remember, you remember the Twitter files. Musk is releasing them weekly, showing the insidious combination of Government and censorship on the public square. This is what the Left wants. They are so upset that they have lost their ministry of truth. You remember that push? Evan Nappen 37:51 And they want to, right, and they want to use the same techniques to oppress the Second Amendment. It’s all part of the game plan. Teddy Nappen 38:02 Yeah. Evan Nappen 38:03 Well, Teddy, I appreciate you pointing this out, and I’m sure our listeners do as well. Let me tell you, we had a three round burst for GOFUs, and we only got two of the rounds out. Let me end here with the GOFU number three. And again, we saw this in action. These are actual cases, actual realities. I had a fellow client give me a call and say, hey, they were in court and they didn’t have counsel. Their guns were taken in an allegation of a so-called domestic violence, in which everything got dismissed. But there was an outstanding criminal charge that’s unfounded and going to the court. The so-called victim does not want to proceed. Does not want to proceed. So, what does the prosecutor do? The prosecutor tells this person, look, we’re going to downgrade this to a noise ordinance. Okay? So, it’s no longer in the category of domestic violence. If it stayed in that DV category, it makes you the equivalent of a convicted felon under federal law, and you’re banned from guns. The prosecutor said this way, with it as a noise ordinance, you’re fine. You’ll be perfectly fine. This will not affect your gun rights. Page – 11 – of 11 Evan Nappen 39:52 Now, this is a person who doesn’t have a lawyer. Who’s listening to the prosecutor, who is telling them they can plead this down to an ordinance. When the State’s key witness does not want to proceed and knows that the allegations that were made were not true and knows that it needs to be dropped. So, normally, the thing is, dismiss it straight out, because the complainant, the complaining witness, is not going to be real good for your case here. Okay? We all kind of see that, and it needs to go. But instead, the prosecutor is trying to convince this person to take this ordinance and pay a fine, get an ordinance hit, and saying that it won’t affect their gun rights. Evan Nappen 41:02 Here’s the deal, folks. It does affect your gun rights. You see, when a prosecutor says it doesn’t affect gun rights, that prosecutor is not representing you. They’re representing the State. They’re representing the Government. And if you don’t have counsel to explain to you the actual ramifications and you try to believe this, you know, however well intentioned it may have been, they failed to mention here that, yeah, it’s not a per se disqualifier, meaning, like being a convicted felon or having a conviction for domestic violence, sure, where you’re just out of the box. You’re done. But the reality in New Jersey is that if you plead to even this dopey ordinance for noise, you now have a conviction for an ordinance that started out as a domestic violence charge. Then when you try to apply to get a new pistol purchase permit or renew your carry permit or do a change of address on your Firearm’s ID Card, they go, oh, public health, safety, and welfare. That’s what they’re going to use to deny your application. Public health, safety, and welfare. Based on character, temperament. You know, I call that disqualifier the all-inclusive miscellaneous weasel clause, because that’s where the abuse of discretion comes in. And if you were to fall for this, oh, plead to the ordinance, it won’t affect your gun rights. Wait and see. Because now that comes up on your record and it links to the original charges, those police reports and all. And you ended up taking a plea, which has this appearance that you were guilty of something, and that’s why you pled. It sure as hell can affect your gun rights. So, friends, the takeaway is this. The GOFU is when you’re dealing on any criminal charge, make sure you have counsel that understands the gun laws and don’t try to rely on what a prosecutor may be telling you about how your rights will or won’t be affected. My son leaves for college in August, so you can only imagine how much I have been reflecting on motherhood lately.I've been thinking back on all those joyful hours watching Tommy play soccer since he was three years old, and the sleepless nights worrying if he'll be okay as he changes and grows into the young man he is today. The essence of loving a child deeply reminds me of Elizabeth Stone's famous saying – “Making the decision to have a child – it is momentous. It is to decide forever to have your heart go walking around outside your body.”  These words have never felt more true than they do right now, and it has inspired me to re-release an early episode of the Cracking Open podcast with one of the fiercest and most radically loving mothers I know - the incredible Jodie Patterson.Jodie is an award-winning author, public speaker, advocate, and entrepreneur whose work spans communities as diverse as fashion and beauty brands, to media and entertainment organizations, to queer and BIPOC advocacy groups. Today would have been Matthew Shepard's 47th birthday. But Matthew's life was brutally cut short, in 1998, when he was just 22.Matthew was a gay man who got into a truck with two homophobes who lured him into their vehicle saying they just wanted to hang out... with the intent of robbing and killing him instead. This was one of the first cases to get any proper attention for the plight of the LGBTQAI+ community. Welcome to another episode of Queernundrum! Today, we dive into a crucial and often overlooked topic—the experiences of LGBTQAI+ seniors. Our elders bear the resilience of having navigated discrimination, societal prejudices, and the challenges of developing their identities in less accepting times.Before we explore the unique journey of LGBTQAI+ seniors, let's take a moment to acknowledge the present. As of today, 84 anti-LGBTQAI+ laws have been passed across the country, while 227 were thankfully shut down. However, 187 laws are advancing, attacking various fronts like accurate IDs, civil rights, free speech, healthcare, public accommodations, and schools. (see ACLU to learn more).A Glimpse into the Past:Reflecting on the 1940s, homosexuality was largely criminalized, and individuals faced legal persecution. Living in the closet was a necessity, affecting their sense of community. Homosexuality was considered a mental illness, leading to harmful practices like conversion therapy. Discrimination in healthcare was rampant, and legal protections against discrimination based on sexual orientation or gender identity were nonexistent.Progress:Fast forward to today, and there has been a significant shift in societal attitudes. LGBTQAI+ individuals experience greater social acceptance, a sense of community, and there's growing acknowledgment of diverse gender identities and sexual orientations. Legal milestones, like the marriage equality act and the 14th Amendment, mark substantial progress.Reflection:Our elder LGBTQAI+ individuals came of age during times of extreme prejudice, while younger generations often experience more supportive environments during their formative years. Elders may have spent a significant part of their lives in the closet due to societal pressures, while younger individuals often grow up in a more visible and accepting LGBTQAI+ culture. Elder LGBTQAI+ individuals might have faced rejection from biological families, leading to the importance of chosen families. Younger generations often experience more openness within their families. We recognize this is not always the case., discrimination still exist.Our call to action is clear: lets work together to create a future where our LGBTQAI+ seniors can age gracefully, surrounded by environments that honor their resilience, acknowledge their unique journeys, and celebrate the wealth of wisdom they bring to our community.We celebrate the resilience of our LGBTQAI+ seniors, acknowledging the wisdom they bring to our community.
