In Part I, we begin with a discussion of the legal challenge filed by the National Automobile Dealers Association seeking judicial review of the CARS Rule, the FTC's postponement of the Rule's effective date, and potential legislative challenges to the Rule. We then discuss the Rule's scope and key definitions, the misrepresentations that are expressly prohibited under the Rule, and the Rule's new disclosure requirements on dealer advertising and sales communications. We also talk about a big stock purchase of Ford by one of their employees, as well as a Christmas rescue of a Cybertruck. The FTC has finalized a new rule yesterday, targeting deceptive car-buying practices, including junk fees and misleading promises, set to transform the automotive retail landscape by July 2024…for better or worseThe rule, set to go into effect on July 30, 2024, requires transparent pricing and prohibits non-beneficial add-ons, such as oil changes packages included in an EV contract, or nitrogen that isn't much different than normal airIt aims to protect consumers, particularly servicemembers, from deceptive practices costing $3.4 billion annually.The National Automobile Dealers Association criticizes the rule for adding complexity and increasing compliance costs, noting that The Center For Automotive Research suggests it will add 2 hours to the transaction time. This counters the FTCs claim that it will reduce time by 3 hoursThe same study suggests that Dealers face $18 to $22 billion in extra compliance costs over a decade due to the FTC rule, far exceeding the agency's estimate of $1.36 to $1.57 billion.Mike Stanton, CEO of NADA said Tuesday: “This regulation is heavy-handed bureaucratic overreach and redundancy at its worst... The FTC made up data to support its claims, then rejected calls to slow down the process and test the effectiveness of its proposal with real consumers. Show Notes with links:In an attempt to clarify EV battery sourcing guidelines, the National Automobile Dealers Association and the Alliance for Automotive Innovation are urging the U.S. Treasury to adjust its definition of "placed in service". They argue the current interpretation limits the effectiveness and application of the electric vehicle tax credit. The proposed changes aim to ensure EVs remain eligible for credits, even when they are manufactured in a different calendar year to delivery.The rules could affect EVs that meet battery content requirements for one year but are delivered to buyers in a year with increased requirements.In 2024, batteries manufactured by excluded entities, which could include companies controlled by China will be ineligibleIn 2025, those with ‘critical minerals' will also be made ineligibleIn a move that sounds awfully familiar to those of us in the retail auto industry, electric vehicle startup Rivian has launched an in-person shopping event as it directly invites buyers to its factory parking lot to browse, buy, and actually drive vehicles off the lot as it struggles through increased inventory.In what the company is calling the “Rivian Dealership” customers can browse several dozen trucks available for immediate purchaseThe vehicles on offer at Saturday's sale are the four-motor variants of the R1T pickup, equipped with its biggest battery pack, with starting prices at $87,000. Rivian has no plans to provide discounts at this event, and only trucks will be included, excluding the R1S SUV model that continues to have a waitlist, stated a Rivian spokeswoman.“They don't want to try the dealer path,” said Stephanie Brinley, the principal auto analyst at S&P Global Mobility. She continues: “They are getting to a point where demand isn't gone, but electric-vehicle makers are having to work harder for customers,” Brinley said. “You do have to sell vehicles, believe it or not.”In a move that appears much more like a traditional OEM, Tesla is providing an $8,000 discount on new Model S and Model X vehicles as well as three years of free Supercharging for deliveries made by the end of the quarter as it seeks to improve end-of-quarter financial outcomes by lowering inventory.Tesla has been known to offer special discounts or incentives for the delivery of new inventory vehicles by the end of the quarter. The FTC's proposal would impose a number of new substantive and disclosure requirements on auto dealers in connection with the car buying or leasing process. We first discuss NADA's comment letter to the FTC on the proposal, including NADA's concerns with the process used by the FTC to issue the proposal and with the proposal's disclosure, recordkeeping, website posting, and other requirements. We then discuss the auto finance industry's concerns with the proposal, including the risks arising from the FTC Holder Rule, the industry's call for safe harbors, and other steps auto finance companies can take to mitigate risks in connection with ancillary products. We conclude with a discussion of the CFPB's focus on ancillary products, including CFPB supervisory activity, potential areas of CFPB scrutiny, and the CFPB's use of its authority to supervise auto finance companies to influence dealer behavior. In this edition of the Business Day Spotlight, we’re looking at the health and state of the vehicle retail market. Our host Mudiwa Gavaza is joined by Marcia Mayaba, chief executive of motor retail at Barloworld and vice president of National Automobile Dealers Association. She also discusses trends around vehicle sales in SA, the health of consumers in the local market, reasons for the rise in second hand motor sales, the move to online retail for dealerships, leadership in the industry and an outlook for the sector.
Since the killing of George Floyd in Minneapolis on May 25th, injustices against the black community have been brought back into the spotlight. The Black Lives Matter movement has spearheaded a call to action to address the inequities black people continue to suffer in our country. In light of this, many companies have made the decision to rebrand well-known products that for years, have depicted black people in a racist manner. From civil war monuments and military bases, to professional sports teams and country bands, Americans are looking inward for ways they can make positive changes and foster equality among all of our citizens. The auto industry is no different. Dealer Groups, OEMs, and Association leaders must be willing to recognize that black lives do indeed matter. Collectively, the industry has to be held accountable to past missteps, and pave the way for a more diverse and inclusive future. More black representation must be a part of that. Currently, there are only 265 black franchised dealers out of an estimated 17,300. African-Americans make up over 10% of all new vehicle sales in the U.S., however, less than 2% of the dealer body. Here to help us address the current state of the auto industry on this very important issue is Peter Welch, President of the National Automobile Dealers Association. There’s a real need for dealers to be representative of the community they will be serving. When it comes to black representation in dealerships, Mr. Welch says there is “frankly not enough.” There is also room for improvement when it comes to black representation on NADA’s Board of Directors. As it stands, out of 63 board members, only one is African-American. In terms of helping black people become dealers or helping black dealers acquire additional franchises from OEMs, it is dubious as to how NADA encourages and works with OEMs in that appointment and approval process. According to Peter, the NADA mission does not focus on this area, and they largely defer to NAMAD, the National Association of Minority Automobile Dealers, when it comes to black representation. In the months that followed Hurricane Katrina in 2005, a tidal wave of flood-damaged cars washed across the United States. While it's almost certain to happen again in the wake of Hurricane Sandy, several agencies across the country, from federal and state government to insurance companies to automotive dealers, have worked closely to protect the unsuspecting consumer from unknowingly purchasing a flood-damaged vehicle. The National Automobile Dealers Association just released its latest Dealer Attitude Survey and for the third time in a row Hyundai topped the charts. Luxury sales in China skyrocketed last year. The California Air Resources Board approved new regulations that mandates that one out of every seven new cars sold in the state must be zero-emission by 2025.
