Regardez le dos de mon téléphone. Tesla Electric is expanding into the UK market to supply electricity to households with Tesla products. The plan involves storing cheap electricity and selling it back to the grid at higher prices, aiding the transition to 100% renewable energy. Luxury EV maker Lucid Group delivered fewer Air sedans than Wall Street estimates for Q2, amid concerns about demand. Despite having a backlog of reservations, Lucid only plans to produce 10,000 to 14,000 Airs in 2023. In June 2023, electric vehicles (EVs) made up a record 26.9% market share in France, up from 19.8% the previous year. The Tesla Model Y was the best-selling Battery Electric Vehicle (BEV) for the month. Audi's Hoonitron, an all-electric Quattro tribute, will be driven by nine-time Le Mans winner Tom Kristensen at the 2023 Festival of Speed. The car's power outperforms any of the Le Mans Prototype 1 (LMP1) cars Kristensen has raced. Ford is set to unveil a high-performance electric Mustang Mach-E at the 2023 Goodwood Festival of Speed. A teaser suggests an off-road adventure edition, complementing Ford's ongoing work on a high-performance electric F-150 Lightning pickup. Dacia plans to reinvent its fourth-generation Sandero as an affordable electric supermini by 2027 or 2028. The company is investigating cheaper battery chemistries to maintain affordability. Fiat UK experienced a surge in inquiries about the electric Fiat 500 following the introduction of a £3000 E-Grant to encourage EV adoption. The grant was launched after the UK government withdrew similar incentives a year ago. China's New Energy Vehicles (NEVs) sales increased by 44.1% year-on-year in H1 2023, reaching nearly 3.75 million units. NEV exports also grew, with a 160% year-on-year expansion. Volkswagen (VW) is experiencing decreased demand for their electric models in Europe, with production reportedly decreasing at their Emden plant. VW produced 97,000 units from January to May but sold only 73,000. Electric car sales in Germany for Volkswagen are below targets, with some battery-electric models seeing demand drop to zero. Subsidy cuts, high inflation, and competition from other manufacturers are contributing factors. The European Parliament has approved legislation to expand EV charging and hydrogen infrastructure across the EU. By 2026, charging stations for electric cars should be available every 60 kilometers along main routes. EU member states have approved comprehensive battery market regulation, promoting a circular economy for all types of batteries. The regulation requires mandatory declarations and labels related to battery components and recycled content. A study shows a 29.5% drop in used Electric Vehicle (EV) prices following months of rising prices. Factors contributing to the price drop include Tesla's aggressive pricing cuts and a rise in supply. Amazon has introduced more than 3,000 custom electric delivery vans across the U.S., aiming to have 100,000 such vehicles on the road by 2030. Amazon plans to invest over 1 billion euros over the next five years to decarbonize and electrify its European transportation network. Several electric vehicles now support 800-volt DC fast-charging for rapid charging with lighter, thinner cables. Among the manufacturers offering this technology are Audi, Porsche, GMC, Hyundai, and Kia, while Tesla's upcoming V4 Supercharging will offer 1,000-volt capability.

"Tesla (TSLA) miss on sales delivery is not consequential. The TSLA stock price is driven by Twitter (TWTR) deal and fears that Musk will sell more if it goes through. Tesla models are still the best in show, performance, price analysis, and product line up. Rivian (RIVN) is on track to meet production levels and is considered the best electric vehicle truck on the market. Porsche (POAHY) recent IPO valued the company at the same level as parent Volkswagen (VW). General Motors (GM) electric vehicle's are in pipeline if supply chain issues are resolved," says Kevin Riley. "Auto sales are still held back by chip shortages. Inflation adds to the problem, but sales growth is still happening. Inventory is better than Fall 2021, but not by much. Supply issues result in high prices for used vehicles," says David Whiston.

Tu and Lei spend a few minutes debating the merits of the moves and the leadership appointed to launch the team in China with, surprise, Tu being a bit skeptical of the moves and whether or not it'll get VW where they need to be with SW development in the timeframe they need to do it in. Tu wraps up the pod with a few quick updates on CATL's swapping station, BYD's substantial increase YoY from Q1 sales, and finally a comment on Elon's purchase of Twitter and whether he'll be pressured by the Chinese govt. to promote a more positive tone on the platform.

DAG Lisa Monaco's speech on FCPA enforcement and compliance laid out the very basics; that the key to every company is culture. She stated, “corporate culture matters. A corporate culture that fails to hold individuals accountable, or fails to invest in compliance — or worse, that thumbs its nose at compliance — leads to bad results.” From the enforcement perspective, the DOJ will be assessing companies for the ethical cultures. From the compliance perspective, the ethical tone of a company and accountability all starts at the top and, most specifically, senior management. This requirement is more than simply the ubiquitous “tone-at-the-top,” as it focuses on the conduct of senior management. The DOJ wants to see a company's senior leadership actually doing compliance. The DOJ asks if company leadership has, through their words and concrete actions, brought the right message of doing business ethically and in compliance to the organization. How does senior management model its behavior on a company's values and finally, how is such conduct monitored in an organization? I once had a Chief Executive Officer (CEO), observe the following, “You want me to be the ambassador for compliance.” I immediately said yes, that is exactly what I need you to do. A CEO, as an “Ambassador of Compliance”, can fully model the conduct that senior management engage in going forward. Another area a CEO can forcefully engage an entire company is through a powerful video message about doing business the right way and in compliance. A great example was a CenterPoint Energy video put out in 2015 after the Volkswagen (VW) emissions-testing scandal became public. The video featured Scott Prochazka, CenterPoint Energy President and CEO. He used the VW scandal to proactively address culture and values at the company and used the entire scenario as an opportunity to promote integrity in the workplace. But more than simply a one-time video, the company followed up with an additional resource, entitled, Manager's Toolkit—What does Integrity mean to you? that managers used to facilitate discussions and ongoing communications with employees around the company's ethics and compliance programs. Finally, the cost for the video was quite reasonable as it was produced internally. Three key takeaways: 1. Senior management must actually do compliance; not simply talk-the-talk of compliance but also walk-the-walk. 2. L'époque où les constructeurs généralistes proposaient des cabriolets abordables sur la base de leur citadine ou/et de leur berline compacte est révolue, que ce soit avec un toit en toile ou sous-forme de coupé-cabriolet… Les Peugeot de la 204 à la 207 incluse, la Citroën C3 Pluriel… et la fameuse Coccinelle, toutes offraient le plaisir simple des cheveux au vent, aujourd'hui disparu ou, au mieux, remplacé par un toit en toile repliable façon Twingo agréable mais beaucoup moins ouvert. Et puis Volkswagen, non content de proposer une Golf cabriolet jusqu'à récemment, a dû trouver cela dommage, et a eu le cran de procéder à l'ablation de 2 portes et du toit de son petit SUV, le T-Roc ! The biggest announcement has to be that the automaker is working on and planning to launch an even larger electric crossover called ID.8, which will be about the size of today's Atlas model (sold in North America and China). A base Pro starts at just $39,974. The XLT starts at $52,974, and a fully-loaded Platinum at $90,474. What's so surprising about those prices is how close Ford is flirting with gasoline-engine F-150 price equivalents — and that's before consumers take advantage of federal and state tax incentives. - The Chicago Auto Show was our first chance at seeing it up close and in-person. While oogling it around the stand, we caught up with Darren Palmer, general manager of Ford's Battery Electric Vehicles division, to find out how Ford managed its pricing. The answer is largely a simple one — scale. - the top half of this truck has a scale of 4 million units. That seat, we buy 4 million of. We get the best price in the industry. The front trunk, apart from the unique components, the whole rest of the truck, we get 4 million units.” - “The frame at the bottom is all-new with all-new suspension, but it's through the same supplier who makes our other frames,” Palmer says. “And they've got the facility, so we work with them to produce the all-new frame, but at a reasonable price point, given the fact they build a million frames for us.” - “The next-generation of SUVs coming, the larger trucks, and the SK Innovation batteries. More importantly, all-electric car sales went up 33% to almost 10,000. - So far this year, Hyundai reports sales of 43,829 plug-in car sales (up 12% year-over-year), which represents 5.2% of the total volume. Sales by powertrain type year-to-date: BEVs: 36,108 (up 3.7%) - The growth in the plug-in segment is directly related to the introduction of the Hyundai Ioniq 5. In June, Hyundai sold 8,122 Ioniq 5, which is 74% of all plug-ins. - Hyundai Ioniq 5 noted 3,667 units in its home market, while the remaining 4,455 were exported. It is possible to go far beyond the simplification of the die castings coming in the Tesla cars replacing up to 360 parts. Quite separately, in-mold electronics will replace up to 100 parts at a time and in-wheel motors replace gearing, differential, and axles.” - 600-mile cars will be the antidote to range anxiety and more. For example, IDTechEx finds that it sharply increases resale value and useful life (less battery cycling and fast charging aging the battery). Selling electricity vehicle-to-grid is no longer a silly idea when you have some miles to spare. - Das concludes, "The UK is a small country yet Ford's 2021 Go Electric opinion survey showed that UK car buyers are still uncomfortable with the idea of swapping their fossil-fuelled vehicles for an EV. Most severely, from rural areas that was 82%, villages 76%, smaller towns 79%. Overall, a large proportion of drivers said they still think range is a big issue. By 2023 the group is expecting to see four more LNG-powered ships with dual-fuel engines added to its current fleet of two LNG car carriers, which entered service in 2020. Six of the nine car carriers crossing the North Atlantic for VW are to be powered by LNG. - As one of the first car manufacturers to subscribe to the goals of the Paris Climate Agreement that aim to limited global warming to significantly less than two degrees by 2050, the use of LNG will enable VW to cut carbon dioxide (CO2) emissions in its fleet by up to 25% (tank-to-wake). - Following the switching of all rail transport with Deutsche Bahn to green electricity, the Group has caused an 85% reduction in CO2 emissions through its two biofuel-powered car carriers that operate along coastal routes in Europe. - The new ships will also permit the use of non-fossil fuels in the future, thus reducing CO2 emissions even further - The ships are being built in China and have a capacity of around 7,000 car equivalent units - Retrofitting with battery cells will also be possible for two of the new ships, with all four LNG ships being equipped with shore power connections to ensure all local emissions in ports providing this facility can be eliminated. Obviously, in every compliance program, the ethical tone of a company and accountability all starts at the top and, most specifically, senior management. The 2020 Guidance stated, “Beyond compliance structures, policies, and procedures, it is important for a company to create and foster a culture of ethics and compliance with the law at all levels of the company. The effectiveness of a compliance program requires a high-level commitment by company leadership to implement a culture of compliance from the middle and the top.” This requirement is more than simply the ubiquitous “tone-at-the-top,” as it focuses on the conduct of senior management. The DOJ wants to see a company’s senior leadership actually doing compliance. The DOJ asks if company leadership has, through their words and concrete actions, brought the right message of doing business ethically and in compliance to the organization. How does senior management model its behavior on a company’s values and finally, how is such conduct monitored in an organization? Senior management must share these same values through operationalizing compliance going forward. Lynn Paine, in her seminal article “Managing for Organizational Integrity”, laid out five factors, which can be used as guideposts to not only to set the right tone from senior management on doing business ethically and in compliance, it can lay the groundwork for senior management to model appropriate behavior and then have it monitored by the company going forward. The guiding values of a company must make sense and be clearly communicated by senior management in a variety of settings, to the entire company workforce. The company’s leader must be personally committed and willing to take action on the values. This means that management must not simply ‘overlook’ the transgressions of top producers. A company’s systems and structures must support its guiding principles and these internal systems and structures cannot be over-ridden by senior management without both justification and Board approval. A company’s values must be integrated into normal channels of management decision-making and reflected in the company’s critical decisions. Sometimes a company must turn down business if there are too many red flags present or by engaging in such behavior the company’s value and ethics will be violated. Managers must be empowered to make ethically sound decisions on a day-to-day basis. This means senior management must fully support and back-up such decisions. I once had a Chief Executive Officer (CEO), observe the following, “You want me to be the ambassador for compliance.” I immediately said yes, that is exactly what I need you to do. A CEO, as an “Ambassador of Compliance”, can fully model the conduct that senior management engage in going forward. Another area a CEO can forcefully engage an entire company is through a powerful video message about doing business the right way and in compliance. A great example was a CenterPoint Energy video put out in 2015 after the Volkswagen (VW) emissions-testing scandal became public. The video featured Scott Prochazka, CenterPoint Energy President and CEO. He used the VW scandal to proactively address culture and values at the company and used the entire scenario as an opportunity to promote integrity in the workplace. But more than simply a one-time video, the company followed up with an additional resource, entitled “Manager’s Toolkit - What does Integrity mean to you?”, which managers used to facilitate discussions and ongoing communications with employees around the company’s ethics and compliance programs. Finally, the cost for the video was quite reasonable as it was produced internally. Three key takeaways: Senior management must actually do compliance; walk-the-walk, not simply talk-the-talk. Use your CEO to talk about current events and how those ethical failures are lessons to be learned for your organization. CEO as Compliance Ambassador.

ZIPCAR TO DEPLOY E-GOLFS IN LONDON Ride sharing services, whether that's cars or bikes, are one way of getting a lot of people to try something - and in the case of ZipCar in London, a lot of people soon will be getting their first experience of an electric car. Zipcar is launching a fleet of more than 300 Volkswagen e-Golf electric cars in London, with 325 on the streets of the capital by the end of this year. ZipCar's Flex service means you can drop off your car whenever and wherever you're done using it, which does pose an interesting question about charging. "For consumers, car-sharing services could be a good opportunity to try out an electric car before making the commitment to purchase one. With dealers doing relatively little to sell electric cars, and automakers spending little on advertising, anything that gets the word out could be a big help" say The Drive. Wireless charging is one way to fix the charging problem with car sharing services, or so would be returning the car back to the same spot and ensuring the car is plugged into the charger before your sessions was officially over. SIXT CEO SAYS EVS A POLITICAL MISTAKE From car sharing to car hiring, and the CEO of German rental company Sixt has been wading into the conversation for electric cars. He said a political effort to push the mass rollout of electric cars is a costly political error. “I don’t believe in e-cars, politically it’s a grave mistake,”: said during a conference call yesterday adding critical raw materials, including cobalt, were already under the control of Asian companies. “Range is still a catastrophe. You have to invest billions and billions,” Sixt said, adding that some rental customers who try out electric cars often end up stranded. If I’m wrong we’ll buy as many electric cars as our clients want us to,” said in a call to discuss earnings. NIO FILES FOR $2 BILLION U.S. IPO Chinese company NIO has submitted a confidential filing for an IPO sometime later this year. The Initial Public Offering could raise up to $2bn. That will be used to introduce their range of electric cars, the ES8 being the first for the Chinese market, which they say is already off to a quick start with sales. NIO say "The NIO ES8 is a 7-seater high-performance electric SUV exclusively for the China market. It is a mobile living space on wheels with performance in its DNA." JAGUAR I-PACE SVR COULD DO 0-60 MPH IN 1.8 SECONDS The Jaguar I-PACE is already a fast, well handling car, getting to 60mph in 4.5 seconds from the 394hp on offer. But what if you let Jaguar’s Special Vehicle Operations department the chance to tweak it? Product planning boss Hanno Kirner says they could make a lot quicker, almost too fast. We're talking 0-60 in 1.8seconds. “Yes, we can make it do 0-60 miles per hour in 1.8 seconds,” Kirner said. “It’s a good headline, but once you’ve done it once or twice, and lost your eyes in the back of their sockets, you might not want to do it again. I do worry that the instant torque and performance might be too much for untrained drivers,” he continued. “It may be that we have to impose some kind of restriction so that the performance is limited until they have gone on a driving course or something." MERCEDES-BENZ ESPRINTER TO DELIVERY YOUR PARCELS FOR 93 MILES OF RANGE Not only are the number of EVs sold important to follow, but also what types of electrified vehicles, because working vehicles do far more emission-free miles compared to personal cars. "Next year, we'll see the new Mercedes-Benz eSprinter, the electric version of the German automaker's latest cargo van." says Autoblog: "We finally have the details on the new e-van. Mercedes will offer two batteries: a 41 kWh battery that delivers 71.5 miles of range and a 55 kWh battery that offers 93.2 miles of range. The eSprinter is focused on short-range driving for all-day deliveries for companies like UPS and FedEx rather than long-haul driving. The 41 kWh battery can be fully charged in six hours, while the larger battery takes a full eight hours to charge. Using a DC fast charger, however, both batteries can be charged to 80 percent capacity in just 45 minutes." https://www.autoblog.com/2018/05/29/mercedes-benz-esprinter-ev-electric-range/ BMW I3 SAMSUNG SDI 94 AH BATTERY RATED FOR 524,000 MILES The quality of the BMW i3 doesn't just include the carbon fibre construction or the recycled interiors, but down to cell level too. The 94 Ah cells from Samsung SDI have some of the longest life-cycles available. InsideEV's say: "Samsung SDI expects up to 4,600 charging cycles at 25ºC to End-Of-Life (EOL), which in the case of batteries is the point when capacity decreases to 80% (battery still can be used, but is generally not desirable in cars any longer). Since the BMW i3 (33 kWh) is rated at 114 miles (183 km), 4,600 cycles would be more than 524,000 miles (more than 843,000 km). It’s one of the best results in the industry and it’s totally doable because the i3 pack is equipped with a thermal management system." MILK & MORE BUYS 200 STREETSCOOTER ELECTRIC VEHICLE For many years, milk has been delivered to doorsteps by electric milk float. Sadly most of those old milk floats which ran on a bank of 12v car batteries are replaced by diesel vans. However news yesterday looks like we’re going back to the future. The UK’s Milk&More service, which delivers milk and other groceries to your doorstep overnight so they’re ready for you when you wake up, has ordered 200 of the StreetScooter all electric vans. “The StreetScooter is also in keeping with the tradition of British milkmen, who have used electric vehicles for their deliveries since 1930.” Says electric cars report… “We wanted to make this unique tradition relevant again to the requirements of today’s customers,” says Patrick Müller, Managing Director of Milk & More. “In order to do this, we need a local product portfolio, new IT systems as well as reliable, quiet and environmentally friendly vehicles. Christian Senger, head of electric mobility at the Volkswagen (VW) brand, says: “In the cycle plan where we again and again undertake forward planning for up to 15 years, we see that the markets even want more (electric) cars than we have earmarked.” Reuters continue: "To stoke mass demand, VW is aiming to sell its EVs at the price of conventional combustion engine cars, drawing on MEB synergies and falling battery costs, Senger said. Designed to underpin nearly 30 battery-driven models from four group brands, ranging from the Golf-size I.D. hatchback to the Vizzion sedan, the MEB platform will allow the VW group to gain savings in a production cycle due to economies of scale. VW group has a goal of selling 3 million EVs by 2025, including models from premium brands Audi and Porsche, and Czech division Skoda. Waiting lists for the e-Golf have grown to more than 12 months after state and industry-backed incentives led the model’s price to drop by about a third to about 25,000 euros ($29,020), according to VW." Who to suspend during any Foreign Corrupt Practices Act (FCPA) investigation is always a delicate question to answer. Unfortunately there is never an easy answer. As the Volkswagen (VW) emission-testing scandal continues to reverberate, it continues to bring up some very knotty questions, which have bedeviled the Chief Compliance Officer (CCO) or compliance practitioner in many areas. Today there is an example around internal investigations. In an article in the Wall Street Journal (WSJ) entitled “Scope of VW Suspensions Grows”, William Boston reported on the ongoing internal investigation by the company’s outside counsel Jones Day. Boston noted that VW had “suspended a larger number of engineers than previously acknowledged, following a recommendation from the law firm conducting” the investigation. The article went on to state, “Jones Day urged suspension of anyone who could have been involved in the scam - from high level decision makers to ordinary engineers – to prevent possible perpetrators from tampering with the evidence”. This final statement emphasizes a key consideration in a FCPA investigation, which is to tie down the evidence. Former Arnold & White partner Mara Senn has said that “probably from the government's perspective, the most important aspect of setting up an investigation in a way that makes them feel comfortable, is ensuring that all data is locked down.” However, if you are worried about evidence tampering you may have a bigger problem on your hands. Pointing up the difficulties in making such a blanket sweep an un-named source, who provided this information to Boston, was quoted in the WSJ piece as saying “We had to suspend everyone in this area to get them out of the way of this process. This is necessary for the investigation, but it’s really hard for us because we are now missing their professional knowledge and experience.” This issue brings up another point that Senn has discussed, around when to suspend or discipline an employee during an internal investigation. Senn related, “That is a very case-by-case difficult question to answer, but in general, I think it’s better to keep them around for as long as you may need them. Once they’ve been fired or otherwise disciplined, really, even if you keep them around, they’re going to be less cooperative with you and possibly, if you fire them, not cooperative at all. You can require them to be cooperative in the termination agreement, but obviously in practice, cooperation can mean a lot of different things.” In view of the Schrems decision by the European Court of Justice (ECJ), I also wonder how the investigation will fair with the German based employees? Obviously there will be data that in the US would be deemed company-owned but in Europe it may well be private to the employee being investigated. This problem became even greater with the recent decision by Privacy Regulators from 28 EU nations that backed the ECJ’s Schrems decision that invalidated the Safe Harbor regime. As reported by Jo Sherman in the FCPA Blog, “that closed the legal pipeline by which data has flowed freely from the EU to the U.S. for the last 15 years. The rationale for the court decision and the subsequent backing of the EU Data Protection Authorities is that the surveillance powers of the U.S. government are considered to be too excessive and disproportionate, and can override the data protections for EU citizens under the Safe Harbor framework.” Lanny Breuer, the former number two at the Department of Justice (DOJ) and now a partner at Covington and Burling LLP, raised an interesting concern in the context of the Justice Department’s FCPA Pilot Program. It is around what Breuer terms “de-confliction”. This involves the government asking a company to halt its own investigation for the government to be the first to interview witnesses. At the FCPA Blog Conference, Breuer said that if “de-confliction” is required as cooperation to gain the benefits of the pilot program, such a request from the DOJ would be “an extraordinary request, in my view” because it “could lead companies to be unable to disclose to other agencies or to shareholders, and it could keep a board in the dark about the alleged wrongdoing.” Breuer added, “In general, publicly traded companies can’t just stand down from doing an investigation when such an allegation comes in.” He also commented that “he’d been asked to do so a couple of times.” Breuer raised four questions during his presentation which every investigator must consider in the area of de-confliction. (1) Would complying with the request be consistent with directors’ and corporate officers’ fiduciary duty of oversight?; (2) How can a company make decisions without speaking with its employees?; (3) How will a delay affect the company’s other regulatory obligations?; and (4) How can external counsel advise a company without knowing the facts? Companies hire external counsel to conduct thorough investigations, evaluate their clients’ conduct, and provide informed legal advice. These tasks can be difficult if not impossible to accomplish where external counsel have their hands tied behind their backs. Clearly the DOJ could have a broader remit or be involved with other ongoing investigations where they might make such requests. However, such ‘de-confliction’ could stop a company from engaging in a root cause analysis or even robust investigation. At the same conference, an earlier panelist, Gerald Kral, the Chief Ethics and & Compliance Officer (CECO) of Brown-Forman, said on his panel that his company did an extensive root cause analysis of every claim or incident so it can not only understand what happened but put sufficient risk management protections in place to try and make sure it does not happen again. Today is the penultimate day of my 30 days to a better compliance program. Just as compliance programs sprang up, grew and began to evolve and mature in the middle of the last decade; the sophistication of the regulators has also increased. We most clearly see this in the appointment of the Department of Justice (DOJ) Compliance Counsel, Hui Chen. With her initial public remarks, Chen provided insight into how she would consider the effectiveness of a compliance program. Her key point was companies should operationalize their compliance program by tying it to functional disciplines within your company. This means that Human Resources (HR), Payment, Audit, Vendor Management and similar corporate disciplines should be involved in the operation of your compliance program in their respective areas of influence. Then in April 2016 under the remediation prong, with the initiation of the DOJ Pilot Program around FCPA enforcement, the DOJ once again emphasized the operationalization of a company’s compliance program as a key metric in determining benefits under the program. You must actually be doing compliance going forward. This evolution in the DOJ’s thinking and its sophistication of compliance program analysis is in clear response to how the market initially responded to the requirement to have a compliance program back in the 2004-time frame. More recently, each Deferred Prosecution Agreement (DPA), in Schedule C under the details of a best practices compliance program, has required the company to take “into account relevant developments in the field and evolving international and industry standards” in upgrading their compliance program. This requirement has led companies to keep abreast of best practices and continually evolve their compliance program forward. The DOJ in turn, has upped its game and now requires companies to operationalize compliance. Compliance is a service within your organization, yet under the operationalized model, compliance is a profit generator for a business. Just as law departments generate business by doing transactions, compliance can be viewed as delivering services not only to the business unit but also third parties with whom the company does business. This means not only traditional transaction partners such as sales agents, representatives and distributors but also joint venture (JV) partners, teaming partners and others. Compliance can deliver compliance related services to these third parties as a profit center. Doing compliance means doing business. There are multiple types of risks in a business; operational, regulatory and reputational, just to name a few. The effort to measure and then manage each of these risks can be led by the compliance function. The more efficiently these risks are measured (i.e. assessed) the more easily and efficiently these risks can be managed. This means that the business is not faced with a binary 1/0 or Go/No Go decision on risk but if compliance moved into measuring and the managing risk through the operationalization of compliance into the business unit; the process would help you to do business more efficiently and with greater profitability. Compliance is a platform to make your company not only a better run organization but can also demonstrate the thoughtfulness and effectiveness of your compliance program should a regulator ever come knocking. This is because if you operationalize compliance into the fabric of your organization, compliance internal controls will touch every aspect of the employment experience in a way that is not obtrusive and will not slow down what you are trying to achieve. Take compliance as a platform in HR. At every point in talent management, HR can insert compliance into the cycle. Those points include the pre-employment interview and screening, the interview process with progressively higher senior management, the initial on-boarding process, the quarterly, semi-annual or annual performance review, annual bonus review, assessment and award, promotions and even exiting of an employee. The platform of compliance can record each of these touch points and you now have an internal control burned into HR which is a compliance internal control. Further, if there is any attempt to circumvent or over-ride one of these HR internal controls involving the hiring of a son or daughter of a foreign governmental official, a red flag can be raised and sent to the compliance function for further review. Compliance is a marketing platform. Some attention has been paid to the use of compliance as a recruiting and hiring tool for millennials. One of the facts of their generation is they want to work at companies which are seen to be doing business ethically, all the while making money. Moreover, as Ethisphere demonstrates annually with its World’s Most Ethical Company awards, businesses which win those awards, on average, exceed the New York Stock Exchange (NYSE) blue chip average for profitability. It will be interesting to see the results of ISO 37001 certification on financial profitability. Compliance embraces public advocacy. The Volkswagen (VW) emissions-testing scandal is one of the largest corporate scandals of the past few years. One thing that makes the VW scandal so unique is that it is one of the few scandals where a company’s actions were so transgressive they damaged the reputations of its competitors. As a response to the VW scandal, Ulrich Grillo, President of the German industry association BDI, recognized that compliance is the answer. He urged companies to check their management processes, including compliance and control systems. He suggested one of the key questions to ask should be “Are we doing everything right?” When you have the President of a national industrial association saying compliance is the answer, you need to sit up and take notice.
