Be sure to register for my free training on, "7 Keys to Closing More Sales in A Down Market" https://www.marcwayshak.com/lab-web-training-novid/Basics of Sales Tip #1: Trial and error isn't a strategy.I'll repeat that: Trial and error is not a sales strategy.If you compare sales as an industry to virtually any other profession—such as law, accounting, dentistry, medicine, etc.—it becomes apparent that sales is one of the only professional industries where there isn't a governing body that regulates who gets to do that job, and what training they need to be able to do it.Tip #2: Have a process.We need to have a sales process that we can follow—a sales process that we know actually works.When we use the sales process the same way every single time we sell, it makes it possible for us to diagnose exactly what went wrong when things don't go as expected. Without a consistent sales process, it's impossible to get useful feedback on what's working and what's not.Tip #3: Bring insight to the table.Now, demonstrating insight is the first part of any successful sales process. (At my firm, we teach this as the first component of our Sales Insights Methodology.) You must bring insight to the table up front, at the start of the sales interaction.You need to engage your prospects with insight, demonstrating that you know what the heck you're talking about. And you can do that by giving them valuable industry information that provokes them or tells them something they hadn't thought of before.Tip #4: Disqualify prospects.This may feel counterintuitive if you haven't followed a lot of my content before. Disqualifying prospects is the opposite of what most salespeople are taught to do. Maybe you've been taught to qualify prospects, or that you need to convince or persuade them.Instead, what you should be doing is determining whether each prospect is a fit—that's it. If they're not a fit, that's cool. Focus on disqualifying people who aren't a fit so you can move on and spend your time and energy on those who are.Tip #5: Solve, don't present. The presentation phase of your sales process should demonstrate that you can solve your prospects' challenges. When you take them through that disqualification process, you're going ask them a lot of questions about what's going on in their world, so you can really understand their key challenges. Then, in the presentation phase, you should exclusively present to those challenges that the prospect mentioned. Leave out your features and benefits—your prospects don't care. All they care about is whether you can actually solve their problems.Tip #6: Be N.S.O.N.S.O stands for Next Step Obsessed. Next steps are one of the most fundamental basics of sales. You want to be completely obsessed with next steps in your sales process.One of the biggest reasons that sales fall apart is simply that the salesperson isn't scheduling a clear next step.And of course, the next step can be a sale. That's fine, too. But always have a next step in place, and be obsessive about scheduling next steps.Tip #7: Use a prospecting blueprint.The point is that your prospecting blueprint should be a prospecting campaign with a whole bunch of “touches” to the prospect over the course of a few weeks, so that even if they don't respond to you, you get on their radar and demonstrate that you have valuable insight to share.By the time you ultimately get them on the phone or you send them that fifth email, they remember who you are. They'll think, “Oh yeah, that person left me a message on Monday. They tried me a couple of times last week. They just sent me a LinkedIn request. I'll respond now.”Remember that it can take more than 20 touches like this before the average prospect is going to respond. That's why we need that blueprint in place to keep us on track.Tip #8: Think like a top performer.Simply put, top performers have such great success in large part because of how they think. I challenge you to start thinking like a top performer. Top performers think confidently, calling as high up as possible at their prospect organization. They motivate themselves on a daily basis, getting up early and immediately doing their set sales activities. And they view sales as a game, so they aren't afraid of getting no's and they don't take rejection personally.Tip #9: Have a sales mentor.Maybe you already have a sales mentor. If so, that's awesome. But if you don't, you absolutely must get a sales mentor. If you're just trying to figure out this whole sales thing on your own, it's going to be a very long and arduous road ahead. And there's a good chance you'll never make it to the end of the journey. Having a sales mentor who can guide you is so important.

Next week, the Supreme Court will hear argument in Trump v. Anderson, former President Donald Trump's appeal of the Colorado Supreme Court's historic decision taking him off the state's presidential primary ballot. In determining whether the Colorado Supreme Court erred in ordering Trump excluded from the state's ballot, the Supreme Court faces one of the most fraught questions facing our democracy today.Lawfare Associate Editor Hyemin Han asked two legal scholars who could not disagree more with one another whether they think the Supreme Court should disqualify Trump under Section 3 of the 14th Amendment. Sam Moyn is Chancellor Kent Professor of Law and History at Yale University. He thinks the Supreme Court has to unanimously reverse the Colorado Supreme Court's decision and keep the current Republican frontrunner on the ballot. Ilya Somin is Professor of Law at George Mason University and B. Kenneth Simon Chair in Constitutional Studies at the Cato Institute. He thinks the Supreme Court should take Trump off the ballot despite its facially anti-democratic optics. Official Standard of the French Bulldog General Appearance: The French Bulldog has the appearance of an active, intelligent, muscular dog of heavy bone, smooth coat, compactly built, and of medium or small structure. The hallmarks of the breed are the square head with bat ears and the roach back. Expression alert, curious, and interested. Proportion and Symmetry - All points are well distributed and bear good relation one to the other; no feature being in such prominence from either excess or lack of quality that the animal appears poorly proportioned. Influence of Sex - In comparing specimens of different sex, due allowance is to be made in favor of bitches, which do not bear the characteristics of the breed to the same marked degree as do the dogs. Size, Proportion, Substance: Weight not to exceed 28 pounds; over 28 pounds is a disqualification. Proportion - Distance from withers to ground in good relation to distance from withers to onset of tail, so that animal appears compact, well balanced and in good proportion. Substance - Muscular, heavy bone. Head: Head large and square. Eyes dark, brown or approaching black in color, wide apart, set low down in the skull, as far from the ears as possible, round in form, of moderate size, neither sunken nor bulging. Lighter brown colored eyes are acceptable, but not desirable. Blue or green eye(s) or any traces of blue or green are a disqualification. No haw and no white of the eye showing when looking forward. Ears - Known as the bat ear, broad at the base, elongated, with round top, set high on the head but not too close together, and carried erect with the orifice to the front. The leather of the ear fine and soft. Other than bat ears is a disqualification. The top of the skull flat between the ears; the forehead is not flat but slightly rounded. The muzzle broad, deep and well laid back; the muscles of the cheeks well developed. The stop well defined, causing a hollow groove between the eyes with heavy wrinkles forming a soft roll over the extremely short nose; nostrils broad with a well-defined line between them. Nose black. Nose other than black is a disqualification, except in the case of creams or fawns without black masks, where a lighter colored nose is acceptable but not desirable. Flews black, thick and broad, hanging over the lower jaw at the sides, meeting the underlip in front and covering the teeth and tongue, which are not seen when the mouth is closed. The underjaw is deep, square, broad, undershot and well turned up. Wry mouths and any bites other than undershot are serious faults. Neck, Topline, Body: The neck is thick and well arched with loose skin at the throat. The back is a roach back with a slight fall close behind the shoulders, gradually rising to the loin which is higher than the shoulder, and rounding at the croup. The back is strong and short, broader at the shoulders, and tapering to the rear. The body is short and well rounded. The chest is broad, deep, and full; well ribbed with the belly tucked up. The tail is either straight or screwed (but not curly), short, hung low, thick root and fine tip; carried low in repose. Forequarters: Forelegs are short, stout, straight, muscular and set wide apart. Dewclaws may be removed. Feet are moderate in size, compact and firmly set. Toes compact, well split up, with high knuckles and short stubby nails. Hindquarters: Hind legs are strong and muscular, longer than the forelegs, so as to elevate the loins above the shoulders. Hocks well let down. Feet are moderate in size, compact and firmly set. Toes compact, well split up, with high knuckles and short stubby nails; hind feet slightly longer than forefeet. Coat: Coat is brilliant, short and smooth. Skin is soft and loose, especially at the head and shoulders, forming wrinkles. Coats other than short and smooth are a disqualification. Color: Acceptable colors: white, cream, fawn (ranging from light fawn to a red fawn), or any combinations of the foregoing. Markings and patterns are: brindle, piebald, black masks, black shadings, and white markings. Ticking is acceptable but not desired. Brindle ranges from sparse but clearly defined black stripes on a fawn background to such heavy concentration of black striping that the essential fawn background color barely shows through (“black brindle”). Only a trace of the background color is necessary; in a brindle piebald, a trace of the brindle patterning in any patch is sufficient. All other colors, markings or patterns are a disqualification. Disqualifying colors and patterns include, but are not limited to, solid black, black and tan, black and white, white with black, blue, blue fawn, liver, and merle. Black means black without a trace of brindle. Gait: Correct gait is a “four tracking” foot pattern with the front track wider than the rear track. The movement should have reach and drive and is unrestrained, free and vigorous. Temperament: Well behaved, adaptable, and comfortable companions with an affectionate nature and even disposition; generally active, alert, and playful, but not unduly boisterous. Disqualifications: Over 28 pounds in weight. Blue or green eye(s) or any traces of blue or green. Other than bat ears. Nose other than black, except in the case of cream or fawn colored dogs without black masks, where a lighter colored nose is acceptable. Coats other than short and smooth. All coat colors other than those specifically described (e.g.,Solid black, black and tan, black and white, white and black, blue, blue fawn, liver, and merle). Professor of Law at George Washington University, Jonathan Turley, joins to break down what the decision in Colorado means for the election and whether or not the states have the legal right to decide who will appear on the ballot. Alice Marie Johnson spent 21 years in prison after she was sentenced to life without parole in 1997 for cocaine trafficking in Memphis, Tennessee. In 2018, after some public advocacy on her behalf from celebrity Kim Kardashian, President Trump granted Alice clemency and had her released. Today we revisit our interview with Alice Marie Johnson, where she discussed her past, her time in prison, and how she is using her freedom to help advocate for criminal justice reform to aid other folks just like her. In the past few weeks, there have been several notable developments in lawsuits seeking to disqualify Donald Trump from the 2024 election under Section 3 of the 14th Amendment. The Minnesota Supreme Court dismissed a case against Trump but invited the petitioners to refile once Trump won the GOP nomination. A court in Michigan rejected a challenge to Trump's eligibility on the grounds that Congress, not the courts, should ultimately decide. And, most recently, a Colorado trial court held that, although Trump did engage in insurrection before and during Jan. 6, Section 3 does not apply to presidents.As these and other cases make their way through the courts, and with the potential that the Supreme Court will at some point weight in, we're bringing you another portion of a conference held last month at the University of Minnesota Law School (for a previous excerpt, see the November 1 edition of the Lawfare Podcast). In the wake of Donald Trump's role in the attempt to overturn the 2020 election and the Jan. 6 attack on the Capitol, lawsuits in states around the country are seeking to disqualify him from the 2024 election. Challengers to his eligibility invoke Section 3 of the Fourteenth Amendment, which provides in relevant part that "No person shall . . . hold any office . . . under the United States . . . who, having previously taken an oath . . . as an officer of the United States . . . to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."As of now, there are nearly two dozen states in which litigation is ongoing to bar Trump from the ballot, and that number is only expected to grow. Earlier this week, a Colorado district began a week-long bench trial and, this Thursday, the Minnesota Supreme Court will hear oral argument. And if a state does disqualify Trump, the United States Supreme Court will no doubt immediately hear the case.On Monday October 30, the University of Minnesota Law School held a conference with leading law and political science scholars on "Section 3, Insurrection, and the 2024 Election: Does the Fourteenth Amendment Bar Donald Trump from the Presidency?"
