On this episode we check back in Chris Boucher, who was originally on the program in July of 2022. Boucher is a hemp industry OG. In 1990, he was first introduced to hemp by Jack Herer himself in, author of the book that jumpstarted the hemp movement in America, The Emperor Wears No Clothes. In 1994 Boucher was issued a permit from the USDA to grow fiber hemp in California, but his crop was destroyed before harvest by local drug enforcement agents. He was a founding member of the Hemp Industries Association and was part of the landmark case HIA vs. DEA that established the legality of CBD. But these days, Boucher's hemp endeavor is JuiceTiva, a cold-pressed hemp juice powder rooted in the nutritional potential of hemp leaves and flowers. Boucher shares his opinions of the state of hemp in California, which he says has the worst hemp regulations of any state in the union, citing Governor Newsom's recent banning of hemp products and the structure of the state and county agriculture departments. He describes a situation in California where the marijuana industry is battling the hemp industry for dominance in the intoxicating cannabinoid arena. This week's hemp podcast guest is Patrick Atagi, president and CEO of the National Industrial Hemp Council of America (NIHC), a DC-based organization that advocates for and lobbies on behalf of the hemp industry. ON this episode, Atagi discusses industry priorities for the next Farm Bill and the work the NIHC is doing to put hemp on a level playing field with other commodities in the eyes of the USDA. The NIHC has formed an informal coalition with more than 30 national and regional hemp groups and associations, including the US. Hemp Round Table and the Hemp Industries Association, to develop a list of issues they would like addressed by Congress in the Farm Bill. Unlike more mature ag industries that usually advocate and lobby as a unified front, the hemp industry groups haven't coalesced into a single voice, which makes it confusing for policy makers who rely on industry insiders for information and education about a given industry. “On Capitol Hill, I get that all the time, ‘There's so many groups, who do we listen to?' type of thing,” Atagi said. The Farm Bill priorities list is an attempt to bring the industry together, but because the hemp plant can be used for everything from medicine to houses to biofuels, the industry naturally has many voices. But some consensus was achieved, Atagi said. The list of industry priorities includes: regulating CBD and other ingredients derived from hemp, reducing regulatory requirements for producers of hemp fiber and hemp grain, permitting hemp grain as a commercial livestock feed, and raising the THC limit of hemp to 1% from 0.3%. Atagi also talks about NIHC's work developing overseas markets for American hemp products. He said the NIHC was recently granted cooperator status in the USDA Foreign Agricultural Service (FAS) Market Access Program. He said this new status puts hemp on a level playing field with other ag industries. “This means that we're on par with cotton, we're on par with grain. On this episode of Let's Be Blunt, Montel talks with Chris Boucher. Chris began growing hemp in the early 1990s in China, Poland, Hungary, and Romania. In 1991, he founded The Hempstead Company, one of the first hemp clothing and seed businesses to open in the US since the 1930s. The company sold products to more than 4,000 stores in 10 countries. In 1992, he co-founded The True Hemp Industry Association, now known as the Hemp Industries Association. Then in 1994, he became the first person in modern times permitted to legally grow a hemp crop in the US, at the USDA Research Center in Brawley, California. After thirty plus years in the industry, Chris Boucher knows a thing or two about hemp. These days he's the CEO of Farmtiva, a California-based hemp company that specializes in consulting, seed sales, and a hemp juice powder called JuiceTiva, but his journey with hemp started long before the Farm Bill created the pathway for the modern hemp industry. He started a business in 1990 called the Hempstead Co. that made hemp wallets, hats, bags and such. “Back then the only place you could get hemp was either in China, Hungary, Romania or Poland. And so I went over to China in '92, and we sourced the hemp there,” he said during this week's episode. Boucher wanted to source his hemp in the U.S., and so in 1994 he secured permission from the USDA and became the first person to grow hemp in the U.S. in decades. But before the crop was harvested, local narcotics agents in California destroyed it by plowing it under, and the dream of U.S.-grown hemp had to wait. Along the way he also co-founded the Hemp Industries Association, wrote an influential legal opinion about CBD, and imported the first CBD oil into the U.S. He traces his career in hemp back to a chance encounter in 1990 when he was asked to sign a petition to legalize hemp by a man who had just published a book that explained the history and potential of hemp. That man was Jack Herer, author of the seminal hemp book “The Emperor Wears No Clothes.” The two became lifelong friends. As the current director of the California Hemp Growers Guild, an advocacy group for hemp farmers, Boucher sees first hand the detrimental effect recent state legislation is having on California's hemp farmers. He said it's a big win for the marijuana industry and a big loss for the hemp industry. Hemp now falls under the jurisdiction of the California Bureau of Cannabis Control instead of the California Department of Agriculture. Boucher said that the agency's fee structure and regulations make it nearly impossible for hemp farmers to compete, and many have stopped growing hemp altogether. “We've lost 90% of hemp farmers in California. We went from 800 farmers down to 120,” he said. He said these new regulations will also make it very expensive for any out-of-state hemp companies wishing to do business in California. Hemp acreage has gone from 7,000 acres in 2015 to 27,000 to 78,000 in 2017 to an eye-popping half a million acres after the 2018 farm bill was passed. The ensuing gut has scaled back many farmers’ plans even while more farmers chase the gold ring—but the bigger problem remains intransigence by the FDA and USDA, which seem to be doing their drug warrior best to keep the hemp market from reaching full potential. In this episode we discuss the beginning of the Hemp Industries Association, in 1994 in Arizona. Before the HIA was established, there was the True Hemp Industry Alliance (THIA), first established in 1992, who called the meeting where HIA name was created. THIA created a certification program called the True Hemp seal certification - to test and confirm products being labelled as hemp were 100% hemp, and preventing unscrupulous players from mislabeling products. This group pooled together funds to import millions of tons of hemp textiles into the USA. Like any new movement there were competing groups and trying to gather everyone on one platform was not easy. Chris discusses some of the issues in the “beginning” of hemp’s reformation - the difficulty confirming that imported Chinese hemp was truly hemp and not mixed with cotton or other fibers. It wasn’t without obstacles as competing certifications were created, debate raged on using the hemp plant leaf versus those that didn’t want the stigma attached, and police threatened arrest for serving hemp seeds at festivals. For the past 3 decades, Chris has fought to raise awareness of hemp and it’s benefits. Andrew Bish is the COO of Bish Enterprises, and the founder of Hemp Harvest Works. After exiting the retail management industry after 14 years, he rejoined the family business in 2012 and transitioned into the agriculture industry. Since 2015, he has been focusing on identifying and resolving the many issues currently facing hemp harvesting and processing. His goal is to provide equipment that helps standardize hemp farming practices, while allowing growers to increase their scale of operation and decrease costs. 2015 is the first time that Andrew participated in harvesting hemp. Bish harvested 180 acres near Fort Morgan, CO with the SuperCrop® header. In 2017, Andrew was instrumental in the harvest of MTSU's hemp research plots. In 2018 Andrew publicly demonstrated the 1st mechanized whole plant harvester, the Hemp Handler, at Salt Creek Hemp Company in Colbran, CO, and released a Claas forage harvester swathing conversion kit. Bish has harvested, and/or sold hemp equipment in Colorado, Kentucky, and Tennessee, North Carolina, South Carolina, New York, North Dakota, Wisconsin, Iowa, Puerto Rico, and others. Andrew is a member of the Hemp Industries Association, the Canadian Hemp Trade Alliance, Tennessee Growers Coalition, National Sorghum Board, Nebraska Sorghum Board, and the US Custom Harvesters Association. He is on the board of the 21st Century Agricultural Opportunities Coalition, the Colorado Hemp Industries Association Work Group, and the Steering Committee of the US Hemp Grower's Conference & Expo. In addition to his memberships and board seats, he is also involved in speaking engagements with the Hemp Industries Association, the US Hemp Conference & Expo, and WAFBA (NOCO). Beyond all these engagements, Andrew is extremely active in the Nebraska Legislature. Hemp played an important role in America’s history—it was grown by many of the founding fathers, and the Declaration of Independence was drafted on hemp paper—but its production has been restricted since 1937. That changed with the passage of the Hemp Farming Act, which was attached to the 2018 Farm Bill and legalized hemp farming, processing, and selling in the US. Now, hemp is set to become an important American agricultural crop once again. Confusion amongst the public on how exactly hemp oil differs from cannabidiol, or CBD, oil, has prompted the nonprofit "Hemp Industries Association" to issue a statement explaining the difference between the oils in order to ensure that consumers — specifically, medical marijuana patients — are not misled about the intended uses. Hemp is often mistaken for its cannabis cousin, marijuana, even though smoking an entire garbage bag of hemp would not produce an altered state of consciousness, as hemp contains low levels of THC. Confusion between hemp oil and marijuana oil has spiked recently, as states have passed medical marijuana laws that allow for the use of strains of marijuana that are low in THC and high in CBD. Consumers often confuse hemp oil with CBD oil because both are low in THC and contain CBD. Although hemp was once the most important cash crop in the United States — more so than corn and wheat combined — hemp was banned and classified as a Schedule I drug under the Controlled Substances Act of 1970. While classification as a Schedule I drug meant hemp could no longer be grown in the U.S., products containing hemp, such as lotions, fabric and food, are legal for purchase in the U.S. and are often found at natural and health food retailers including Whole Foods, Costco and Sprouts grocers. The U.S. hemp industry says it's grown to $360 million in annual sales. But according to the Hemp Industries Association, that growth is hampered because American farmers aren't allowed to grow the plant.
